<section id="HBA703C383C054CD59010CD7A3B0A7609" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title></quote>.</text> </section> <section id="HF9FBC5EB04954BB8B82C219D73C8CCDD"><enum>2.</enum><header>Trade negotiating objectives</header> <subsection id="HBC33EFD3F0464489B4130517E453EC73"><enum>(a)</enum><header>Overall trade negotiating objectives</header><text>The overall trade negotiating objectives of the United States for agreements subject to the provisions of section 3 are—</text> 
<paragraph id="HBB4AD9E37F734899A365C147E030192B"><enum>(1)</enum><text>to obtain more open, equitable, and reciprocal market access;</text> </paragraph> <paragraph id="H55F1D69455F4423D83A7EB7183CB4C9C"><enum>(2)</enum><text>to obtain the reduction or elimination of barriers and distortions that are directly related to trade and investment and that decrease market opportunities for United States exports or otherwise distort United States trade;</text> </paragraph>
<paragraph id="H4EB033E2A485405EBF0A71C9BF4EB946"><enum>(3)</enum><text>to further strengthen the system of international trade and investment disciplines and procedures, including dispute settlement;</text> </paragraph> <paragraph id="H9D10729FDB324E57A610A3DA866C07D6"><enum>(4)</enum><text display-inline="yes-display-inline">to foster economic growth, raise living standards, enhance the competitiveness of the United States, promote full employment in the United States, and enhance the global economy;</text> </paragraph>
<paragraph id="HD5EA7794E0DB4A6AA4C3B6CA07F8D2FA"><enum>(5)</enum><text>to ensure that trade and environmental policies are mutually supportive and to seek to protect and preserve the environment and enhance the international means of doing so, while optimizing the use of the world’s resources;</text> </paragraph> <paragraph id="H2DE322A8A66D4835B3372B7A5091219B"><enum>(6)</enum><text>to promote respect for worker rights and the rights of children consistent with core labor standards of the ILO (as set out in section 11(7)) and an understanding of the relationship between trade and worker rights;</text> </paragraph>
<paragraph id="HDB7AE27264AF41EDBDEEE8A943535A9F"><enum>(7)</enum><text>to seek provisions in trade agreements under which parties to those agreements ensure that they do not weaken or reduce the protections afforded in domestic environmental and labor laws as an encouragement for trade;</text> </paragraph> <paragraph id="H038FAC12CCB5438D981029E177EE7D7B"><enum>(8)</enum><text>to ensure that trade agreements afford small businesses equal access to international markets, equitable trade benefits, and expanded export market opportunities, and provide for the reduction or elimination of trade and investment barriers that disproportionately impact small businesses;</text> </paragraph>
<paragraph id="H046D37B8B4584DE08F4DFCD0F612F218"><enum>(9)</enum><text>to promote universal ratification and full compliance with ILO Convention No. 182 Concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labor;</text> </paragraph> <paragraph id="HE94AC4D3FC614A3380D9BECF888E6D7F"><enum>(10)</enum><text>to ensure that trade agreements reflect and facilitate the increasingly interrelated, multi-sectoral nature of trade and investment activity;</text> </paragraph>
<paragraph id="HA96E469AC558436798DEB65DC1F1E2E5"><enum>(11)</enum><text display-inline="yes-display-inline">to ensure implementation of trade commitments and obligations by strengthening good governance, transparency, the effective operation of legal regimes and the rule of law of trading partners of the United States through capacity building and other appropriate means, which are important parts of the broader effort to create more open democratic societies and to promote respect for internationally recognized human rights;</text> </paragraph> <paragraph id="H3C760FCBE7D347BBA99C894B519E088C"><enum>(12)</enum><text>to recognize the growing significance of the Internet as a trading platform in international commerce; and</text> </paragraph>
<paragraph id="HD8923D8CE005462FA6FE76632CD646C7"><enum>(13)</enum><text>to take into account other legitimate United States domestic objectives, including, but not limited to, the protection of legitimate health or safety, essential security, and consumer interests and the law and regulations related thereto.</text> </paragraph></subsection> <subsection id="HCD6FCD68659C4F748AC5753FCF40953A"><enum>(b)</enum><header>Principal trade negotiating objectives</header> <paragraph id="HFA45FE34A6984B0E94E59368121F95F5"><enum>(1)</enum><header>Trade in goods</header><text>The principal negotiating objectives of the United States regarding trade in goods are—</text> 
<subparagraph id="H7FD6E56D473A45C68C51C6DC7099F208"><enum>(A)</enum><text>to expand competitive market opportunities for exports of goods from the United States and to obtain fairer and more open conditions of trade, including through the utilization of global value chains, by reducing or eliminating tariff and nontariff barriers and policies and practices of foreign governments directly related to trade that decrease market opportunities for United States exports or otherwise distort United States trade; and</text> </subparagraph> <subparagraph id="H2C9DD0402DAD41A5AEBB4C7209F32176"><enum>(B)</enum><text>to obtain reciprocal tariff and nontariff barrier elimination agreements, including with respect to those tariff categories covered in section 111(b) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3521">19 U.S.C. 3521(b)</external-xref>).</text> </subparagraph></paragraph>
<paragraph id="H24F1DAA4C9E44C31BABAD099BF8BF9BD"><enum>(2)</enum><header>Trade in services</header>
<subparagraph commented="no" display-inline="yes-display-inline" id="HAB6696F9EFEC45B89CAE2C7E292CB135"><enum>(A)</enum><text display-inline="yes-display-inline">The principal negotiating objective of the United States regarding trade in services is to expand competitive market opportunities for United States services and to obtain fairer and more open conditions of trade, including through utilization of global value chains, by reducing or eliminating barriers to international trade in services, such as regulatory and other barriers that deny national treatment and market access or unreasonably restrict the establishment or operations of service suppliers.</text> </subparagraph> <subparagraph id="H7AB60CEC4B7D479BBDF0990A0B9A333D" indent="up1"><enum>(B)</enum><text>Recognizing that expansion of trade in services generates benefits for all sectors of the economy and facilitates trade, the objective described in subparagraph (A) should be pursued through all means, including through a plurilateral agreement with those countries willing and able to undertake high standard services commitments for both existing and new services.</text> </subparagraph></paragraph>
<paragraph id="H5F4B8686499A4E979D3073B4E96E9EB3"><enum>(3)</enum><header>Trade in agriculture</header><text>The principal negotiating objective of the United States with respect to agriculture is to obtain competitive opportunities for United States exports of agricultural commodities in foreign markets substantially equivalent to the competitive opportunities afforded foreign exports in United States markets and to achieve fairer and more open conditions of trade in bulk, specialty crop, and value added commodities by—</text> <subparagraph display-inline="no-display-inline" id="HD57F6C995D5F44499D2B5F5CDBEA86E4"><enum>(A)</enum><text display-inline="yes-display-inline">securing more open and equitable market access through robust rules on sanitary and phytosanitary measures that—</text> 
<clause id="H632359C0EA4D42E188CAEE2F79E9AAA9"><enum>(i)</enum><text>encourage the adoption of international standards and require a science-based justification be provided for a sanitary or phytosanitary measure if the measure is more restrictive than the applicable international standard;</text> </clause> <clause id="HC1ECC141DF3D4E5CB4F3E37B58FF1DAB"><enum>(ii)</enum><text>improve regulatory coherence, promote the use of systems-based approaches, and appropriately recognize the equivalence of health and safety protection systems of exporting countries;</text> </clause>
<clause id="HA71F700B8275419E8270850D4B6777CE"><enum>(iii)</enum><text>require that measures are transparently developed and implemented, are based on risk assessments that take into account relevant international guidelines and scientific data, and are not more restrictive on trade than necessary to meet the intended purpose; and</text> </clause> <clause id="HA72DB5731E8E4CF7B3D0D3FD44C50AFD"><enum>(iv)</enum><text>improve import check processes, including testing methodologies and procedures, and certification requirements,</text> </clause><continuation-text continuation-text-level="subparagraph">while recognizing that countries may put in place measures to protect human, animal, or plant life or health in a manner consistent with their international obligations, including the WTO Agreement on the Application of Sanitary and Phytosanitary Measures (referred to in section 101(d)(3) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(3)</external-xref>));</continuation-text></subparagraph>
<subparagraph id="H6D1A00364C46489694C96F9AD2DD9BF4"><enum>(B)</enum><text>reducing or eliminating, by a date certain, tariffs or other charges that decrease market opportunities for United States exports—</text> <clause id="HFD12FCE9BE554419AAAD57306104401F"><enum>(i)</enum><text>giving priority to those products that are subject to significantly higher tariffs or subsidy regimes of major producing countries; and</text> </clause>
<clause id="HEF628A589EA44DFF9F1F22BC297E6A16"><enum>(ii)</enum><text>providing reasonable adjustment periods for United States import sensitive products, in close consultation with Congress on such products before initiating tariff reduction negotiations;</text> </clause></subparagraph> <subparagraph id="HA27543D7EF3F4B6A9A85C1452240A0C8"><enum>(C)</enum><text>reducing tariffs to levels that are the same as or lower than those in the United States;</text> </subparagraph>
<subparagraph id="H73784E3421BE4A78AE7158FF1C273499"><enum>(D)</enum><text>reducing or eliminating subsidies that decrease market opportunities for United States exports or unfairly distort agriculture markets to the detriment of the United States;</text> </subparagraph> <subparagraph id="H3A4C64D3F6C14E89B1EA9D1A1D0548BD"><enum>(E)</enum><text>allowing the preservation of programs that support family farms and rural communities but do not distort trade;</text> </subparagraph>
<subparagraph id="H1D9263776309450D8A23F778D29F8B2D"><enum>(F)</enum><text>developing disciplines for domestic support programs, so that production that is in excess of domestic food security needs is sold at world prices;</text> </subparagraph> <subparagraph id="H6FC9FB400A544BFF9CA384776F77FC90"><enum>(G)</enum><text>eliminating government policies that create price depressing surpluses;</text> </subparagraph>
<subparagraph id="H6716F17DF271440FA4CDBE8C33C3AA3A"><enum>(H)</enum><text>eliminating state trading enterprises whenever possible;</text> </subparagraph> <subparagraph id="H2D3F9A35FF454A87A8B2A41C2DCB9F7A"><enum>(I)</enum><text display-inline="yes-display-inline">developing, strengthening, and clarifying rules to eliminate practices that unfairly decrease United States market access opportunities or distort agricultural markets to the detriment of the United States, and ensuring that such rules are subject to efficient, timely, and effective dispute settlement, including—</text> 
<clause id="H25073D70B249459990A614DDCD4A1B5D"><enum>(i)</enum><text>unfair or trade distorting activities of state trading enterprises and other administrative mechanisms, with emphasis on requiring price transparency in the operation of state trading enterprises and such other mechanisms in order to end cross subsidization, price discrimination, and price undercutting;</text> </clause> <clause id="H4B19E02C4160455AB82DD5C12AC630A7"><enum>(ii)</enum><text>unjustified trade restrictions or commercial requirements, such as labeling, that affect new technologies, including biotechnology;</text> </clause>
<clause id="HCF659C6E2E3B44A0904D0D10731C4943"><enum>(iii)</enum><text>unjustified sanitary or phytosanitary restrictions, including restrictions not based on scientific principles in contravention of obligations in the Uruguay Round Agreements or bilateral or regional trade agreements;</text> </clause> <clause id="H1DBC1E834C34461B8D2556A125C97591"><enum>(iv)</enum><text>other unjustified technical barriers to trade; and</text> </clause>
<clause id="H54AE6E37FD584309B48640ED4691BF04"><enum>(v)</enum><text>restrictive rules in the administration of tariff rate quotas;</text> </clause></subparagraph> <subparagraph id="H9C4B624031304F2980BF698976A8D13F"><enum>(J)</enum><text>eliminating practices that adversely affect trade in perishable or cyclical products, while improving import relief mechanisms to recognize the unique characteristics of perishable and cyclical agriculture;</text> </subparagraph>
<subparagraph id="H5C7F9821925446FD9CF2C9C36F0117CD"><enum>(K)</enum><text>ensuring that import relief mechanisms for perishable and cyclical agriculture are as accessible and timely to growers in the United States as those mechanisms that are used by other countries;</text> </subparagraph> <subparagraph id="HC88FBBCEB061480E8D3973A9DC2865F3"><enum>(L)</enum><text>taking into account whether a party to the negotiations has failed to adhere to the provisions of already existing trade agreements with the United States or has circumvented obligations under those agreements;</text> </subparagraph>
<subparagraph id="H4639D18F6C3F4C7A978241AF7F3B033B"><enum>(M)</enum><text>taking into account whether a product is subject to market distortions by reason of a failure of a major producing country to adhere to the provisions of already existing trade agreements with the United States or by the circumvention by that country of its obligations under those agreements;</text> </subparagraph> <subparagraph id="HFAF1F7ECD73A4CBE85522537CE691A88"><enum>(N)</enum><text>otherwise ensuring that countries that accede to the World Trade Organization have made meaningful market liberalization commitments in agriculture;</text> </subparagraph>
<subparagraph id="H90AD15E81F8C40699FF7283704A59955"><enum>(O)</enum><text>taking into account the impact that agreements covering agriculture to which the United States is a party have on the United States agricultural industry;</text> </subparagraph> <subparagraph id="HD7FB48E9EA984B678215EA6BB57EC642"><enum>(P)</enum><text>maintaining bona fide food assistance programs, market development programs, and export credit programs;</text> </subparagraph>
<subparagraph id="H42B32C3850084372BEE265747E7E7405"><enum>(Q)</enum><text>seeking to secure the broadest market access possible in multilateral, regional, and bilateral negotiations, recognizing the effect that simultaneous sets of negotiations may have on United States import sensitive commodities (including those subject to tariff rate quotas);</text> </subparagraph> <subparagraph id="H8801AEE151FE4DE3B872D98C0F192330"><enum>(R)</enum><text>seeking to develop an international consensus on the treatment of seasonal or perishable agricultural products in investigations relating to dumping and safeguards and in any other relevant area;</text> </subparagraph>
<subparagraph id="HED46D403C5AB41D2AFB2199507C4FBB3"><enum>(S)</enum><text>seeking to establish the common base year for calculating the Aggregated Measurement of Support (as defined in the Agreement on Agriculture) as the end of each country’s Uruguay Round implementation period, as reported in each country’s Uruguay Round market access schedule;</text> </subparagraph> <subparagraph id="H06426C6AC84D4C4EB10B5EDBC3A4C287"><enum>(T)</enum><text>ensuring transparency in the administration of tariff rate quotas through multilateral, plurilateral, and bilateral negotiations; and</text> </subparagraph>
<subparagraph id="HA0C92B46A1D9417FB1BCBD18C0ECA535"><enum>(U)</enum><text display-inline="yes-display-inline">eliminating and preventing the undermining of market access for United States products through improper use of a country’s system for protecting or recognizing geographical indications, including failing to ensure transparency and procedural fairness and protecting generic terms.</text> </subparagraph></paragraph> <paragraph id="H8B2865EB4D2944B1B7247F2EE92BA2B3"><enum>(4)</enum><header>Foreign investment</header><text>Recognizing that United States law on the whole provides a high level of protection for investment, consistent with or greater than the level required by international law, the principal negotiating objectives of the United States regarding foreign investment are to reduce or eliminate artificial or trade distorting barriers to foreign investment, while ensuring that foreign investors in the United States are not accorded greater substantive rights with respect to investment protections than United States investors in the United States, and to secure for investors important rights comparable to those that would be available under United States legal principles and practice, by—</text> 
<subparagraph id="HE63C2563A5C240AD9D176533C4127F50"><enum>(A)</enum><text>reducing or eliminating exceptions to the principle of national treatment;</text> </subparagraph> <subparagraph id="H2446B8236A0F4D3FA1D1958DF5886275"><enum>(B)</enum><text>freeing the transfer of funds relating to investments;</text> </subparagraph>
<subparagraph id="HF9E26C622BAE4DDCBED2D72977029854"><enum>(C)</enum><text>reducing or eliminating performance requirements, forced technology transfers, and other unreasonable barriers to the establishment and operation of investments;</text> </subparagraph> <subparagraph id="H29B37CB6F27D4650AA21D2469E487B09"><enum>(D)</enum><text>seeking to establish standards for expropriation and compensation for expropriation, consistent with United States legal principles and practice;</text> </subparagraph>
<subparagraph id="H9596542A74E2478585731024F017A0C4"><enum>(E)</enum><text>seeking to establish standards for fair and equitable treatment, consistent with United States legal principles and practice, including the principle of due process;</text> </subparagraph> <subparagraph id="H8064BED82A92410EAFC178246EA08FEA"><enum>(F)</enum><text>providing meaningful procedures for resolving investment disputes;</text> </subparagraph>
<subparagraph id="H0A552A64D026475EB9DBDE76631E244A"><enum>(G)</enum><text>seeking to improve mechanisms used to resolve disputes between an investor and a government through—</text> <clause id="H62813D51DCB34BBCAEBBFF1048BD53F6"><enum>(i)</enum><text>mechanisms to eliminate frivolous claims and to deter the filing of frivolous claims;</text> </clause>
<clause id="H32436D4F8CBC44D19E5BEC5FFAB58D5A"><enum>(ii)</enum><text>procedures to ensure the efficient selection of arbitrators and the expeditious disposition of claims;</text> </clause> <clause id="H17A72CAC50A24FA59A2ACFB6D4BC76C3"><enum>(iii)</enum><text>procedures to enhance opportunities for public input into the formulation of government positions; and</text> </clause>
<clause id="HB63533CD92294B0AB42B8374ABAC456D"><enum>(iv)</enum><text>providing for an appellate body or similar mechanism to provide coherence to the interpretations of investment provisions in trade agreements; and</text> </clause></subparagraph> <subparagraph id="HB1AED43DF3684F819ECD761C26AC88A2"><enum>(H)</enum><text>ensuring the fullest measure of transparency in the dispute settlement mechanism, to the extent consistent with the need to protect information that is classified or business confidential, by—</text> 
<clause id="H1C165197FC1349AA954EC38EF8C33EA7"><enum>(i)</enum><text>ensuring that all requests for dispute settlement are promptly made public;</text> </clause> <clause id="H78BE7D35CE054134A6CD663B41B0381D"><enum>(ii)</enum><text>ensuring that—</text> 
<subclause id="HCF7990326D774B5EA51EDD2F14946BA7"><enum>(I)</enum><text>all proceedings, submissions, findings, and decisions are promptly made public; and</text> </subclause> <subclause id="H8E89E0CA537341A0B20E9517AEE6701D"><enum>(II)</enum><text>all hearings are open to the public; and</text> </subclause></clause>
<clause id="HEB466F11C51348F0A9F5F49ED3D54793"><enum>(iii)</enum><text>establishing a mechanism for acceptance of amicus curiae submissions from businesses, unions, and nongovernmental organizations.</text> </clause></subparagraph></paragraph> <paragraph id="H320BBA444C9E47D09E54CA5E3A67B194"><enum>(5)</enum><header>Intellectual property</header><text display-inline="yes-display-inline">The principal negotiating objectives of the United States regarding trade-related intellectual property are—</text> 
<subparagraph id="H79F236B6419A43818641FE02C9359D4B"><enum>(A)</enum><text>to further promote adequate and effective protection of intellectual property rights, including through—</text> <clause id="H2E34BBD763D84EAC92FCB70CDDEF1006"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HB6E1235A41A242C6BDE46591BD900BDE"><enum>(I)</enum><text>ensuring accelerated and full implementation of the Agreement on Trade-Related Aspects of Intellectual Property Rights referred to in section 101(d)(15) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(15)</external-xref>), particularly with respect to meeting enforcement obligations under that agreement; and</text> </subclause>
<subclause id="H5A731C60FA5F47DBA2D5B2ABC8239668" indent="up1"><enum>(II)</enum><text>ensuring that the provisions of any trade agreement governing intellectual property rights that is entered into by the United States reflect a standard of protection similar to that found in United States law;</text> </subclause></clause> <clause id="H284EF8E5A2B04359A3EAE60A0E3D57B3"><enum>(ii)</enum><text>providing strong protection for new and emerging technologies and new methods of transmitting and distributing products embodying intellectual property, including in a manner that facilitates legitimate digital trade;</text> </clause>
<clause id="HE84BFD0E02044B12A2362B5B44F68CE6"><enum>(iii)</enum><text>preventing or eliminating discrimination with respect to matters affecting the availability, acquisition, scope, maintenance, use, and enforcement of intellectual property rights;</text> </clause> <clause id="HF8CBAEFD899C423A991BE2AA921199F3"><enum>(iv)</enum><text>ensuring that standards of protection and enforcement keep pace with technological developments, and in particular ensuring that rightholders have the legal and technological means to control the use of their works through the Internet and other global communication media, and to prevent the unauthorized use of their works;</text> </clause>
<clause id="H5F431CD6CB6746E6BBCF992D5E63B855"><enum>(v)</enum><text>providing strong enforcement of intellectual property rights, including through accessible, expeditious, and effective civil, administrative, and criminal enforcement mechanisms; and</text> </clause> <clause id="H4AD2081092184394B38BEC4F4EF0F896"><enum>(vi)</enum><text>preventing or eliminating government involvement in the violation of intellectual property rights, including cyber theft and piracy;</text> </clause></subparagraph>
<subparagraph id="HC14A8D98FE644F528A5F426E3E14B506"><enum>(B)</enum><text>to secure fair, equitable, and nondiscriminatory market access opportunities for United States persons that rely upon intellectual property protection; and</text> </subparagraph> <subparagraph id="H25C533811F0F401BA02AB8D729D4B096"><enum>(C)</enum><text>to respect the Declaration on the TRIPS Agreement and Public Health, adopted by the World Trade Organization at the Fourth Ministerial Conference at Doha, Qatar on November 14, 2001, and to ensure that trade agreements foster innovation and promote access to medicines.</text> </subparagraph></paragraph>
<paragraph id="H60D66AB8B47A441082FAB7FFBA4926DA"><enum>(6)</enum><header>Digital trade in goods and services and cross-border data flows</header><text>The principal negotiating objectives of the United States with respect to digital trade in goods and services, as well as cross-border data flows, are—</text> <subparagraph id="H2A210CA6311D47AAA7DFB7EB7F8033AB"><enum>(A)</enum><text>to ensure that current obligations, rules, disciplines, and commitments under the World Trade Organization and bilateral and regional trade agreements apply to digital trade in goods and services and to cross-border data flows;</text> </subparagraph>
<subparagraph id="HA7AA6257618F444D8397855FB10AD27B"><enum>(B)</enum><text>to ensure that—</text> <clause id="HA12F64838ABA41EBA4691FFACBBC815C"><enum>(i)</enum><text>electronically delivered goods and services receive no less favorable treatment under trade rules and commitments than like products delivered in physical form; and</text> </clause>
<clause id="H7815F4C49B974F87B850401B692CCA79"><enum>(ii)</enum><text>the classification of such goods and services ensures the most liberal trade treatment possible, fully encompassing both existing and new trade;</text> </clause></subparagraph> <subparagraph id="HE9D58292D880440BA54F2E9D1FB2A8F0"><enum>(C)</enum><text>to ensure that governments refrain from implementing trade-related measures that impede digital trade in goods and services, restrict cross-border data flows, or require local storage or processing of data;</text> </subparagraph>
<subparagraph id="H40DE86036E2649C1B1F6D1D033CF6CA5"><enum>(D)</enum><text>with respect to subparagraphs (A) through (C), where legitimate policy objectives require domestic regulations that affect digital trade in goods and services or cross-border data flows, to obtain commitments that any such regulations are the least restrictive on trade, nondiscriminatory, and transparent, and promote an open market environment; and</text> </subparagraph> <subparagraph id="H8D7810EAC06F488FBE81ECE064DBC4CF"><enum>(E)</enum><text>to extend the moratorium of the World Trade Organization on duties on electronic transmissions.</text> </subparagraph></paragraph>
<paragraph id="HF0F56ECA54A545C88CF32056E39887E6"><enum>(7)</enum><header>Regulatory practices</header><text>The principal negotiating objectives of the United States regarding the use of government regulation or other practices to reduce market access for United States goods, services, and investments are—</text> <subparagraph id="H9C994CFFB8804C60AEFBD15E4ABF99BB"><enum>(A)</enum><text>to achieve increased transparency and opportunity for the participation of affected parties in the development of regulations;</text> </subparagraph>
<subparagraph id="H58CB939CE39D42458CE64B8DCDA97B70"><enum>(B)</enum><text>to require that proposed regulations be based on sound science, cost benefit analysis, risk assessment, or other objective evidence;</text> </subparagraph> <subparagraph id="HB782CB4C8F0445608D98DAAD583094E2"><enum>(C)</enum><text>to establish consultative mechanisms and seek other commitments, as appropriate, to improve regulatory practices and promote increased regulatory coherence, including through—</text> 
<clause id="H39555EF95539474AA15DAE71DF6D2D95"><enum>(i)</enum><text>transparency in developing guidelines, rules, regulations, and laws for government procurement and other regulatory regimes;</text> </clause> <clause id="H3D6C24C11C6840698CB6E07784A53D7B"><enum>(ii)</enum><text>the elimination of redundancies in testing and certification;</text> </clause>
<clause commented="no" id="H84B76C089AF0409E9401B82407FBC4CE"><enum>(iii)</enum><text display-inline="yes-display-inline">early consultations on significant regulations;</text> </clause> <clause id="HB40D98EBA06D40A7A7432B2DE134F438"><enum>(iv)</enum><text>the use of impact assessments;</text> </clause>
<clause id="H8E210C12220B418BB25A1815C23F05B6"><enum>(v)</enum><text>the periodic review of existing regulatory measures; and</text> </clause> <clause id="H80ECBD3BBCF14B0586D3B5D53C820C2C"><enum>(vi)</enum><text>the application of good regulatory practices;</text> </clause></subparagraph>
<subparagraph id="H6B3790F6ED734C648B293E1BF77E9093"><enum>(D)</enum><text display-inline="yes-display-inline">to seek greater openness, transparency, and convergence of standards development processes, and enhance cooperation on standards issues globally;</text> </subparagraph> <subparagraph id="H92BAB3B990C9413DA79FD802DB2F0A79"><enum>(E)</enum><text>to promote regulatory compatibility through harmonization, equivalence, or mutual recognition of different regulations and standards and to encourage the use of international and interoperable standards, as appropriate;</text> </subparagraph>
<subparagraph id="HB0B2744BEC6F4326AA02F2A48AFADD72"><enum>(F)</enum><text>to achieve the elimination of government measures such as price controls and reference pricing which deny full market access for United States products;</text> </subparagraph> <subparagraph id="H92C1A0A55D4240A787B31846DDDB1E86"><enum>(G)</enum><text>to ensure that government regulatory reimbursement regimes are transparent, provide procedural fairness, are nondiscriminatory, and provide full market access for United States products; and</text> </subparagraph>
<subparagraph id="HBDB4DB38006845408D7FE3CF64D36F7A"><enum>(H)</enum><text display-inline="yes-display-inline">to ensure that foreign governments—</text> <clause id="H9DF3505DC8E24441A92CC0BD88540AC5"><enum>(i)</enum><text>demonstrate that the collection of undisclosed proprietary information is limited to that necessary to satisfy a legitimate and justifiable regulatory interest; and</text> </clause>
<clause id="H3F451CCE05CB4BE785539BA0A8D5C34F"><enum>(ii)</enum><text>protect such information against disclosure, except in exceptional circumstances to protect the public, or where such information is effectively protected against unfair competition.</text> </clause></subparagraph></paragraph> <paragraph id="H64F6510CCB8F49D098CC015CA537D5E8"><enum>(8)</enum><header>State-owned and state-controlled enterprises</header><text display-inline="yes-display-inline">The principal negotiating objective of the United States regarding competition by state-owned and state-controlled enterprises is to seek commitments that—</text> 
<subparagraph id="H8EF48D8741BB4A18A13BFE44FDF076D9"><enum>(A)</enum><text>eliminate or prevent trade distortions and unfair competition favoring state-owned and state-controlled enterprises to the extent of their engagement in commercial activity, and</text> </subparagraph> <subparagraph id="HC0BBBC2FE53A423EA672B14D7E4CED24"><enum>(B)</enum><text>ensure that such engagement is based solely on commercial considerations,</text> </subparagraph><continuation-text continuation-text-level="paragraph">in particular through disciplines that eliminate or prevent discrimination and market-distorting subsidies and that promote transparency.</continuation-text></paragraph>
<paragraph id="HED79BAACE2314643892126B14B650159"><enum>(9)</enum><header>Localization barriers to trade</header><text>The principal negotiating objective of the United States with respect to localization barriers is to eliminate and prevent measures that require United States producers and service providers to locate facilities, intellectual property, or other assets in a country as a market access or investment condition, including indigenous innovation measures.</text> </paragraph> <paragraph id="HF4A79754BF284580ACF85F6B764B7E8B"><enum>(10)</enum><header>Labor and the environment</header><text display-inline="yes-display-inline">The principal negotiating objectives of the United States with respect to labor and the environment are—</text> 
<subparagraph id="H8DC4F3D06E0F4AD9A6E070E181DA809F"><enum>(A)</enum><text>to ensure that a party to a trade agreement with the United States—</text> <clause id="H640A8479327D4157AA8A95FE886EC23E"><enum>(i)</enum><text>adopts and maintains measures implementing internationally recognized core labor standards (as defined in section 11(17)) and its obligations under common multilateral environmental agreements (as defined in section 11(6)),</text> </clause>
<clause id="HDF2342ADDAFB46B2A49A75B6F3E98D1E"><enum>(ii)</enum><text>does not waive or otherwise derogate from, or offer to waive or otherwise derogate from—</text> <subclause id="HEC87F7D5D7E840C39942E342AB576407"><enum>(I)</enum><text>its statutes or regulations implementing internationally recognized core labor standards (as defined in section 11(17)), in a manner affecting trade or investment between the United States and that party, where the waiver or derogation would be inconsistent with one or more such standards, or</text> </subclause>
<subclause id="HBEFDD19845A84060A5910DD37255AC2C"><enum>(II)</enum><text>its environmental laws in a manner that weakens or reduces the protections afforded in those laws and in a manner affecting trade or investment between the United States and that party, except as provided in its law and provided not inconsistent with its obligations under common multilateral environmental agreements (as defined in section 11(6)) or other provisions of the trade agreement specifically agreed upon, and</text> </subclause></clause> <clause id="H0481835B20CB44709C6D1A6A3A31EB67"><enum>(iii)</enum><text>does not fail to effectively enforce its environmental or labor laws, through a sustained or recurring course of action or inaction,</text> </clause><continuation-text continuation-text-level="subparagraph">in a manner affecting trade or investment between the United States and that party after entry into force of a trade agreement between those countries;</continuation-text></subparagraph>
<subparagraph id="HF2D3235A107040ECAB3236DF33058461"><enum>(B)</enum><text>to recognize that—</text> <clause id="H18412E9492C245C0AF384AEA1390C86B"><enum>(i)</enum><text>with respect to environment, parties to a trade agreement retain the right to exercise prosecutorial discretion and to make decisions regarding the allocation of enforcement resources with respect to other environmental laws determined to have higher priorities, and a party is effectively enforcing its laws if a course of action or inaction reflects a reasonable, bona fide exercise of such discretion, or results from a reasonable, bona fide decision regarding the allocation of resources; and</text> </clause>
<clause id="H6C1C80EB302043D2BDB40C51E17332A1"><enum>(ii)</enum><text>with respect to labor, decisions regarding the distribution of enforcement resources are not a reason for not complying with a party’s labor obligations; a party to a trade agreement retains the right to reasonable exercise of discretion and to make bona fide decisions regarding the allocation of resources between labor enforcement activities among core labor standards, provided the exercise of such discretion and such decisions are not inconsistent with its obligations;</text> </clause></subparagraph> <subparagraph id="H851E41BC10004061A9E893DC31B76CD3"><enum>(C)</enum><text>to strengthen the capacity of United States trading partners to promote respect for core labor standards (as defined in section 11(7));</text> </subparagraph>
<subparagraph id="H6C6453CB49E84CD7AF94A6703CB83DA7"><enum>(D)</enum><text>to strengthen the capacity of United States trading partners to protect the environment through the promotion of sustainable development;</text> </subparagraph> <subparagraph id="H6C44EFB3E1344C9A9A53652D89A919E6"><enum>(E)</enum><text>to reduce or eliminate government practices or policies that unduly threaten sustainable development;</text> </subparagraph>
<subparagraph id="H09866B1DAF7640C98751B5AE498B2D4E"><enum>(F)</enum><text>to seek market access, through the elimination of tariffs and nontariff barriers, for United States environmental technologies, goods, and services;</text> </subparagraph> <subparagraph id="H3AD14AC5E1C242BE8AD1CB669A8E1766"><enum>(G)</enum><text>to ensure that labor, environmental, health, or safety policies and practices of the parties to trade agreements with the United States do not arbitrarily or unjustifiably discriminate against United States exports or serve as disguised barriers to trade;</text> </subparagraph>
<subparagraph id="HDAE3E5A444F340F084A451E41C94F779"><enum>(H)</enum><text>to ensure that enforceable labor and environment obligations are subject to the same dispute settlement and remedies as other enforceable obligations under the agreement; and</text> </subparagraph> <subparagraph id="HD3153798129F4173B7AC0F51D687BA53"><enum>(I)</enum><text>to ensure that a trade agreement is not construed to empower a party’s authorities to undertake labor or environmental law enforcement activities in the territory of the United States.</text> </subparagraph></paragraph>
<paragraph id="H0D8B1B39889A4B778D88A2B577E39AD1"><enum>(11)</enum><header>Currency</header><text display-inline="yes-display-inline">The principal negotiating objective of the United States with respect to currency practices is that parties to a trade agreement with the United States avoid manipulating exchange rates in order to prevent effective balance of payments adjustment or to gain an unfair competitive advantage over other parties to the agreement, such as through cooperative mechanisms, enforceable rules, reporting, monitoring, transparency, or other means, as appropriate.</text> </paragraph> <paragraph id="H67463E982E6A4C7BB3DB13CC6BA8D0FF"><enum>(12)</enum><header>WTO and multilateral trade agreements</header><text>Recognizing that the World Trade Organization is the foundation of the global trading system, the principal negotiating objectives of the United States regarding the World Trade Organization, the Uruguay Round Agreements, and other multilateral and plurilateral trade agreements are—</text> 
<subparagraph id="H348E9A50BB294B2A93FAC91BDBDEBF7A"><enum>(A)</enum><text>to achieve full implementation and extend the coverage of the World Trade Organization and multilateral and plurilateral agreements to products, sectors, and conditions of trade not adequately covered;</text> </subparagraph> <subparagraph id="H761885C648FD4B6F99ED17BED57742AA"><enum>(B)</enum><text>to expand country participation in and enhancement of the Information Technology Agreement, the Government Procurement Agreement, and other plurilateral trade agreements of the World Trade Organization;</text> </subparagraph>
<subparagraph id="HE45E1A9FFFD948419A538EBC1A0B6964"><enum>(C)</enum><text display-inline="yes-display-inline">to expand competitive market opportunities for United States exports and to obtain fairer and more open conditions of trade, including through utilization of global value chains, through the negotiation of new WTO multilateral and plurilateral trade agreements, such as an agreement on trade facilitation;</text> </subparagraph> <subparagraph id="HF08E0BED19F64BC79FD235C1B98AE6D9"><enum>(D)</enum><text display-inline="yes-display-inline">to ensure that regional trade agreements to which the United States is not a party fully achieve the high standards of, and comply with, WTO disciplines, including Article XXIV of GATT 1994, Article V and V bis of the General Agreement on Trade in Services, and the Enabling Clause, including through meaningful WTO review of such regional trade agreements;</text> </subparagraph>
<subparagraph id="HD8E9471343124101B38EB06AB811FFB0"><enum>(E)</enum><text>to enhance compliance by WTO members with their obligations as WTO members through active participation in the bodies of the World Trade Organization by the United States and all other WTO members, including in the trade policy review mechanism and the committee system of the World Trade Organization, and by working to increase the effectiveness of such bodies; and</text> </subparagraph> <subparagraph id="H956496FF7B5D41E6BA939938875F069A"><enum>(F)</enum><text>to encourage greater cooperation between the World Trade Organization and other international organizations.</text> </subparagraph></paragraph>
<paragraph id="HCA6E7866F7B044ADA31F09B8FB9533A4"><enum>(13)</enum><header>Trade institution transparency</header><text>The principal negotiating objective of the United States with respect to transparency is to obtain wider and broader application of the principle of transparency in the World Trade Organization, entities established under bilateral and regional trade agreements, and other international trade fora through seeking—</text> <subparagraph id="HB72A7C8485324E7695DACB5DB77638F1"><enum>(A)</enum><text>timely public access to information regarding trade issues and the activities of such institutions;</text> </subparagraph>
<subparagraph id="H308787204CA84B77A48B995B2A81393C"><enum>(B)</enum><text display-inline="yes-display-inline">openness by ensuring public access to appropriate meetings, proceedings, and submissions, including with regard to trade and investment dispute settlement; and</text> </subparagraph> <subparagraph id="H16BFAB54F947475A84C0D4BF1776F78C"><enum>(C)</enum><text>public access to all notifications and supporting documentation submitted by WTO members.</text> </subparagraph></paragraph>
<paragraph id="H8C7D01229A9547C4B44DC67E56061038"><enum>(14)</enum><header>Anti-corruption</header><text>The principal negotiating objectives of the United States with respect to the use of money or other things of value to influence acts, decisions, or omissions of foreign governments or officials or to secure any improper advantage in a manner affecting trade are—</text> <subparagraph id="H869378FC9A4A463F9D0BFDBE19F3FE2C"><enum>(A)</enum><text>to obtain high standards and effective domestic enforcement mechanisms applicable to persons from all countries participating in the applicable trade agreement that prohibit such attempts to influence acts, decisions, or omissions of foreign governments or officials or to secure any such improper advantage;</text> </subparagraph>
<subparagraph id="H45DE62440681416CB6A4AC856C3612AD"><enum>(B)</enum><text>to ensure that such standards level the playing field for United States persons in international trade and investment; and</text> </subparagraph> <subparagraph id="H8B339C2491ED467BAA25301B6DA29921"><enum>(C)</enum><text display-inline="yes-display-inline">to seek commitments to work jointly to encourage and support anti-corruption and anti-bribery initiatives in international trade fora, including through the Convention on Combating Bribery of Foreign Public Officials in International Business Transactions of the Organization for Economic Cooperation and Development, done at Paris December 17, 1997 (commonly known as the <quote>OECD Anti-Bribery Convention</quote>).</text> </subparagraph></paragraph>
<paragraph id="H8D1113F4647641678949CEBD71BBB8DB"><enum>(15)</enum><header>Dispute settlement and enforcement</header><text>The principal negotiating objectives of the United States with respect to dispute settlement and enforcement of trade agreements are—</text> <subparagraph id="H69831A0DE978481D9F89E81124ADCBBD"><enum>(A)</enum><text>to seek provisions in trade agreements providing for resolution of disputes between governments under those trade agreements in an effective, timely, transparent, equitable, and reasoned manner, requiring determinations based on facts and the principles of the agreements, with the goal of increasing compliance with the agreements;</text> </subparagraph>
<subparagraph id="HA3A68063A59A44B58DFCB47CB8587140"><enum>(B)</enum><text>to seek to strengthen the capacity of the Trade Policy Review Mechanism of the World Trade Organization to review compliance with commitments;</text> </subparagraph> <subparagraph id="H87443923C783421F8CDA037147C64CC2"><enum>(C)</enum><text>to seek adherence by panels convened under the Dispute Settlement Understanding and by the Appellate Body to—</text> 
<clause id="H920873E30811416CAAB4153C47CE7711"><enum>(i)</enum><text>the mandate of those panels and the Appellate Body to apply the WTO Agreement as written, without adding to or diminishing rights and obligations under the Agreement; and</text> </clause> <clause id="HD713A1D1455845598891ADB8DE77640B"><enum>(ii)</enum><text>the standard of review applicable under the Uruguay Round Agreement involved in the dispute, including greater deference, where appropriate, to the fact finding and technical expertise of national investigating authorities;</text> </clause></subparagraph>
<subparagraph id="HD789AA183668476C96C8B3812A730B46"><enum>(D)</enum><text>to seek provisions encouraging the early identification and settlement of disputes through consultation;</text> </subparagraph> <subparagraph id="H4F2B26AC14AC40AB88839666413A9C43"><enum>(E)</enum><text>to seek provisions to encourage the provision of trade-expanding compensation if a party to a dispute under the agreement does not come into compliance with its obligations under the agreement;</text> </subparagraph>
<subparagraph id="H2DB7820AA1D54BF4A22E46536DB1DEFA"><enum>(F)</enum><text>to seek provisions to impose a penalty upon a party to a dispute under the agreement that—</text> <clause id="H8F6E319146BC465C81142FE6833627D3"><enum>(i)</enum><text>encourages compliance with the obligations of the agreement;</text> </clause>
<clause id="HA5C14628D0C747EAA93440ECEBC50B03"><enum>(ii)</enum><text>is appropriate to the parties, nature, subject matter, and scope of the violation; and</text> </clause> <clause id="HA21351D5C2A44895815881296C4F27D2"><enum>(iii)</enum><text>has the aim of not adversely affecting parties or interests not party to the dispute while maintaining the effectiveness of the enforcement mechanism; and</text> </clause></subparagraph>
<subparagraph id="H2C9FC1D5F274486FB1ED3B618E6C8E14"><enum>(G)</enum><text>to seek provisions that treat United States principal negotiating objectives equally with respect to—</text> <clause id="H691FC161C0E94E849A840370A8650796"><enum>(i)</enum><text>the ability to resort to dispute settlement under the applicable agreement;</text> </clause>
<clause id="H86439990759B4835B44DAF6417CF2039"><enum>(ii)</enum><text>the availability of equivalent dispute settlement procedures; and</text> </clause> <clause id="H7E59DCCEA7E74C8E9BB3CFC57BB36DAC"><enum>(iii)</enum><text>the availability of equivalent remedies.</text> </clause></subparagraph></paragraph>
<paragraph id="H394A43A69CDA4FD89DA5D56C1F29726D"><enum>(16)</enum><header>Trade remedy laws</header><text>The principal negotiating objectives of the United States with respect to trade remedy laws are—</text> <subparagraph id="HA7C09021CACF4B74A51934717FEA5481"><enum>(A)</enum><text>to preserve the ability of the United States to enforce rigorously its trade laws, including the antidumping, countervailing duty, and safeguard laws, and avoid agreements that lessen the effectiveness of domestic and international disciplines on unfair trade, especially dumping and subsidies, or that lessen the effectiveness of domestic and international safeguard provisions, in order to ensure that United States workers, agricultural producers, and firms can compete fully on fair terms and enjoy the benefits of reciprocal trade concessions; and</text> </subparagraph>
<subparagraph id="HC4A6B19C218A499486CCC11123C83204"><enum>(B)</enum><text>to address and remedy market distortions that lead to dumping and subsidization, including overcapacity, cartelization, and market access barriers.</text> </subparagraph></paragraph> <paragraph id="HA49557309C12423DBFD4D0A9ED796342"><enum>(17)</enum><header>Border taxes</header><text>The principal negotiating objective of the United States regarding border taxes is to obtain a revision of the rules of the World Trade Organization with respect to the treatment of border adjustments for internal taxes to redress the disadvantage to countries relying primarily on direct taxes for revenue rather than indirect taxes.</text> </paragraph>
<paragraph id="H077127F4F9CB479EB08738DF49A718A7"><enum>(18)</enum><header>Textile negotiations</header><text>The principal negotiating objectives of the United States with respect to trade in textiles and apparel articles are to obtain competitive opportunities for United States exports of textiles and apparel in foreign markets substantially equivalent to the competitive opportunities afforded foreign exports in United States markets and to achieve fairer and more open conditions of trade in textiles and apparel.</text> </paragraph></subsection> <subsection id="H0E21CDFB2FD9458DA15D2F8A4F809CD2"><enum>(c)</enum><header>Capacity building and other priorities</header><text>In order to address and maintain United States competitiveness in the global economy, the President shall—</text> 
<paragraph id="HD878A3F8079A40819AA51778B87CCE57"><enum>(1)</enum><text>direct the heads of relevant Federal agencies—</text> <subparagraph id="HB839CD03E6944421B85DEFF2611034EA"><enum>(A)</enum><text>to work to strengthen the capacity of United States trading partners to carry out obligations under trade agreements by consulting with any country seeking a trade agreement with the United States concerning that country’s laws relating to customs and trade facilitation, sanitary and phytosanitary measures, technical barriers to trade, intellectual property rights, labor, and the environment; and</text> </subparagraph>
<subparagraph id="H31E81FF760C742EC9248353941A77AEA"><enum>(B)</enum><text>to provide technical assistance to that country if needed;</text> </subparagraph></paragraph> <paragraph id="HDD9CB9CAC372414E949EC380E8530305"><enum>(2)</enum><text>seek to establish consultative mechanisms among parties to trade agreements to strengthen the capacity of United States trading partners to develop and implement standards for the protection of the environment and human health based on sound science;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCDAC9518992846B39EC10CB4C1360668"><enum>(3)</enum><text>promote consideration of multilateral environmental agreements and consult with parties to such agreements regarding the consistency of any such agreement that includes trade measures with existing environmental exceptions under Article XX of GATT 1994; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id50BEB627EE7F41D183F9B0CC962C883C"><enum>(4)</enum><text>submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate an annual report on capacity-building activities undertaken in connection with trade agreements negotiated or being negotiated pursuant to this Act.</text> </paragraph></subsection></section>
<section id="H6F355A1181ED41BE83521DB37C27CAE1"><enum>3.</enum><header>Trade agreements authority</header> 
<subsection id="HC3A38B1EEB424E78BB6C4FF43EDCD079"><enum>(a)</enum><header>Agreements regarding tariff barriers</header> 
<paragraph id="H3FEED6D4B1964BA1B8BE8DC48869E3D4"><enum>(1)</enum><header>In general</header><text>Whenever the President determines that one or more existing duties or other import restrictions of any foreign country or the United States are unduly burdening and restricting the foreign trade of the United States and that the purposes, policies, priorities, and objectives of this Act will be promoted thereby, the President—</text> <subparagraph id="H46B2ACB29FAD4712948A5673F5B6C55B"><enum>(A)</enum><text>may enter into trade agreements with foreign countries before—</text> 
<clause id="H68361A298FC3454BB69DFCCE45F8F8D9"><enum>(i)</enum><text>July 1, 2018; or</text> </clause> <clause id="H860E43B24C344A6C91AC20AC27125D57"><enum>(ii)</enum><text>July 1, 2021, if trade authorities procedures are extended under subsection (c); and</text> </clause></subparagraph>
<subparagraph id="H8D6190F2076D4DFDB1A3BB8824C05BCD"><enum>(B)</enum><text>may, subject to paragraphs (2) and (3), proclaim—</text> <clause id="H8323C85A266C4F16BFD653DD15CB72D5"><enum>(i)</enum><text>such modification or continuance of any existing duty,</text> </clause>
<clause id="H3E27C4CE631C4479B318FF6CFB38A17A"><enum>(ii)</enum><text>such continuance of existing duty free or excise treatment, or</text> </clause> <clause id="H2DFE574F239C47B99699DD6174E470F6"><enum>(iii)</enum><text>such additional duties,</text> </clause><continuation-text continuation-text-level="subparagraph">as the President determines to be required or appropriate to carry out any such trade agreement.</continuation-text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">Substantial modifications to, or substantial additional provisions of, a trade agreement entered into after July 1, 2018, or July 1, 2021, if trade authorities procedures are extended under subsection (c), shall not be eligible for approval under this Act.</continuation-text></paragraph>
<paragraph id="HE7401070C5BB442C95ECBEA45FA77D6E"><enum>(2)</enum><header>Notification</header><text>The President shall notify Congress of the President’s intention to enter into an agreement under this subsection.</text> </paragraph> <paragraph id="HBAA1B0F9C98340B2B127B5948289CCB2"><enum>(3)</enum><header>Limitations</header><text>No proclamation may be made under paragraph (1) that—</text> 
<subparagraph id="H062F758D9EFD4D658054C8A3EBB1E206"><enum>(A)</enum><text>reduces any rate of duty (other than a rate of duty that does not exceed 5 percent ad valorem on the date of the enactment of this Act) to a rate of duty which is less than 50 percent of the rate of such duty that applies on such date of enactment;</text> </subparagraph> <subparagraph id="H3C4BB79B2A964954AC96361DC410A19C"><enum>(B)</enum><text>reduces the rate of duty below that applicable under the Uruguay Round Agreements or a successor agreement, on any import sensitive agricultural product; or</text> </subparagraph>
<subparagraph id="HAFF62F8475214A61A679943BF60E4E62"><enum>(C)</enum><text>increases any rate of duty above the rate that applied on the date of the enactment of this Act.</text> </subparagraph></paragraph> <paragraph id="H66D13F6446DB4040B93EC71CB4F7293D"><enum>(4)</enum><header>Aggregate reduction; exemption from staging</header> <subparagraph id="H2AAF73B367354920AD405A830C6F2B27"><enum>(A)</enum><header>Aggregate reduction</header><text>Except as provided in subparagraph (B), the aggregate reduction in the rate of duty on any article which is in effect on any day pursuant to a trade agreement entered into under paragraph (1) shall not exceed the aggregate reduction which would have been in effect on such day if—</text> 
<clause id="H464093BB9D944246B68E5468CD7217A7"><enum>(i)</enum><text>a reduction of 3 percent ad valorem or a reduction of <fraction>1/10</fraction> of the total reduction, whichever is greater, had taken effect on the effective date of the first reduction proclaimed under paragraph (1) to carry out such agreement with respect to such article; and</text> </clause> <clause id="HA76E46CE4C924596B096D9403C850E37"><enum>(ii)</enum><text>a reduction equal to the amount applicable under clause (i) had taken effect at 1-year intervals after the effective date of such first reduction.</text> </clause></subparagraph>
<subparagraph id="HDACBE80CDEC447028A4CA1C19A6B3D4C"><enum>(B)</enum><header>Exemption from staging</header><text>No staging is required under subparagraph (A) with respect to a duty reduction that is proclaimed under paragraph (1) for an article of a kind that is not produced in the United States. The United States International Trade Commission shall advise the President of the identity of articles that may be exempted from staging under this subparagraph.</text> </subparagraph></paragraph> <paragraph id="H974436B6C2A140CA9538FC7D6187ACB2"><enum>(5)</enum><header>Rounding</header><text>If the President determines that such action will simplify the computation of reductions under paragraph (4), the President may round an annual reduction by an amount equal to the lesser of—</text> 
<subparagraph id="H0E54433C5BBD434C90AB06781FC4DEEC"><enum>(A)</enum><text>the difference between the reduction without regard to this paragraph and the next lower whole number; or</text> </subparagraph> <subparagraph id="H5B21628A05724F61B3EAE8F8A77ED27D"><enum>(B)</enum><text>½ of 1 percent ad valorem.</text> </subparagraph></paragraph>
<paragraph id="H00B0405113A74E5E86168CDC0EDEEB0E"><enum>(6)</enum><header>Other limitations</header><text>A rate of duty reduction that may not be proclaimed by reason of paragraph (3) may take effect only if a provision authorizing such reduction is included within an implementing bill provided for under section 6 and that bill is enacted into law.</text> </paragraph> <paragraph id="HD426B6431DBC467FA7E1C9BBEA30B746"><enum>(7)</enum><header>Other tariff modifications</header><text>Notwithstanding paragraphs (1)(B), (3)(A), (3)(C), and (4) through (6), and subject to the consultation and layover requirements of section 115 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3524">19 U.S.C. 3524</external-xref>), the President may proclaim the modification of any duty or staged rate reduction of any duty set forth in Schedule XX, as defined in section 2(5) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501(5)</external-xref>), if the United States agrees to such modification or staged rate reduction in a negotiation for the reciprocal elimination or harmonization of duties under the auspices of the World Trade Organization.</text> </paragraph>
<paragraph id="H692C53FD3D884A05B5CE498856BB2AF0"><enum>(8)</enum><header>Authority under uruguay round agreements act not affected</header><text>Nothing in this subsection shall limit the authority provided to the President under section 111(b) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3521">19 U.S.C. 3521(b)</external-xref>).</text> </paragraph></subsection> <subsection id="H22487B2EB31D49FD8EEC0012B1C16992"><enum>(b)</enum><header>Agreements regarding tariff and nontariff barriers</header> <paragraph id="HE2F61281990448D9A11252C722209CAC"><enum>(1)</enum><header>In general</header> <subparagraph commented="no" display-inline="yes-display-inline" id="H9CC14068E6924F6792FDF2AF8EE91085"><enum>(A)</enum><text>Whenever the President determines that—</text> 
<clause id="H05EF187A0A7549B4840FAA4786F41158" indent="up1"><enum>(i)</enum><text>1 or more existing duties or any other import restriction of any foreign country or the United States or any other barrier to, or other distortion of, international trade unduly burdens or restricts the foreign trade of the United States or adversely affects the United States economy, or</text> </clause> <clause id="HDED1F94D486A4781B324ABBB6629BEC5" indent="up1"><enum>(ii)</enum><text>the imposition of any such barrier or distortion is likely to result in such a burden, restriction, or effect,</text> </clause><continuation-text continuation-text-level="subparagraph" indent="paragraph">and that the purposes, policies, priorities, and objectives of this Act will be promoted thereby, the President may enter into a trade agreement described in subparagraph (B) during the period described in subparagraph (C).</continuation-text></subparagraph>
<subparagraph id="H7C8971C8CC3F4F21A2ABB7AAF8F6FA39" indent="up1"><enum>(B)</enum><text>The President may enter into a trade agreement under subparagraph (A) with foreign countries providing for—</text> <clause id="H406193FD6FCF49D19843698BFB547455"><enum>(i)</enum><text>the reduction or elimination of a duty, restriction, barrier, or other distortion described in subparagraph (A); or</text> </clause>
<clause id="HF48B465D69B6440C968E847BC9E91E77"><enum>(ii)</enum><text>the prohibition of, or limitation on the imposition of, such barrier or other distortion.</text> </clause></subparagraph> <subparagraph id="H7096554074EE492198228FB767E2AE7E" indent="up1"><enum>(C)</enum><text>The President may enter into a trade agreement under this paragraph before—</text> 
<clause id="H46052007511845BBBCF8A0CD3ED3E1F0"><enum>(i)</enum><text>July 1, 2018; or</text> </clause> <clause id="HB4D3B2E056D7444891F8D6B7AD9EA1A2"><enum>(ii)</enum><text>July 1, 2021, if trade authorities procedures are extended under subsection (c).</text> </clause></subparagraph><continuation-text commented="no" continuation-text-level="subparagraph" indent="paragraph">Substantial modifications to, or substantial additional provisions of, a trade agreement entered into after July 1, 2018, or July 1, 2021, if trade authorities procedures are extended under subsection (c), shall not be eligible for approval under this Act.</continuation-text></paragraph>
<paragraph id="HA4B22E9EA3B84461BB4113E109A7BC77"><enum>(2)</enum><header>Conditions</header><text>A trade agreement may be entered into under this subsection only if such agreement makes progress in meeting the applicable objectives described in subsections (a) and (b) of section 2 and the President satisfies the conditions set forth in sections 4 and 5.</text> </paragraph> <paragraph id="H4144CF42869A4963B468AA2AB9EC5602"><enum>(3)</enum><header>Bills qualifying for trade authorities procedures</header> <subparagraph commented="no" display-inline="yes-display-inline" id="HD311A7F6B37240289286AECD9BDEE735"><enum>(A)</enum><text>The provisions of section 151 of the Trade Act of 1974 (in this Act referred to as <quote>trade authorities procedures</quote>) apply to a bill of either House of Congress which contains provisions described in subparagraph (B) to the same extent as such section 151 applies to implementing bills under that section. A bill to which this paragraph applies shall hereafter in this Act be referred to as an <quote>implementing bill</quote>.</text> </subparagraph>
<subparagraph id="H9DCFF485DC2B471DB2FBF02E1182C81A" indent="up1"><enum>(B)</enum><text>The provisions referred to in subparagraph (A) are—</text> <clause id="H3F31C67857D34D5187312C98D52943BD"><enum>(i)</enum><text>a provision approving a trade agreement entered into under this subsection and approving the statement of administrative action, if any, proposed to implement such trade agreement; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HBD2E4BE42F724A9EB4CC1A1D9A213C94"><enum>(ii)</enum><text>if changes in existing laws or new statutory authority are required to implement such trade agreement or agreements, only such provisions as are strictly necessary or appropriate to implement such trade agreement or agreements, either repealing or amending existing laws or providing new statutory authority.</text> </clause></subparagraph></paragraph></subsection> <subsection id="HFEC5467473194BDC97155BDD8765A352"><enum>(c)</enum><header>Extension disapproval process for congressional trade authorities procedures</header> <paragraph id="H4EC193443D804947A4231E68B6B1B949"><enum>(1)</enum><header>In general</header><text>Except as provided in section 6(b)—</text> 
<subparagraph id="HD8418C7CB3E9423CB0D26466D38DF06D"><enum>(A)</enum><text>the trade authorities procedures apply to implementing bills submitted with respect to trade agreements entered into under subsection (b) before July 1, 2018; and</text> </subparagraph> <subparagraph id="H9229C916518445D2A7347C520E2111A8"><enum>(B)</enum><text>the trade authorities procedures shall be extended to implementing bills submitted with respect to trade agreements entered into under subsection (b) after June 30, 2018, and before July 1, 2021, if (and only if)—</text> 
<clause id="H39FD6C1D2E834DFDB207BACED2F1E03D"><enum>(i)</enum><text>the President requests such extension under paragraph (2); and</text> </clause> <clause id="H1F3F9A2230B24261B5A08C7A340B314F"><enum>(ii)</enum><text>neither House of Congress adopts an extension disapproval resolution under paragraph (5) before July 1, 2018.</text> </clause></subparagraph></paragraph>
<paragraph id="H96457064E82344DBBFED994294D10261"><enum>(2)</enum><header>Report to Congress by the President</header><text>If the President is of the opinion that the trade authorities procedures should be extended to implementing bills described in paragraph (1)(B), the President shall submit to Congress, not later than April 1, 2018, a written report that contains a request for such extension, together with—</text> <subparagraph id="HE56A1206FC344644A6DFB99928FB61C0"><enum>(A)</enum><text>a description of all trade agreements that have been negotiated under subsection (b) and the anticipated schedule for submitting such agreements to Congress for approval;</text> </subparagraph>
<subparagraph id="H832FCE7166644D639792DDA34C031B15"><enum>(B)</enum><text>a description of the progress that has been made in negotiations to achieve the purposes, policies, priorities, and objectives of this Act, and a statement that such progress justifies the continuation of negotiations; and</text> </subparagraph> <subparagraph id="HAC73AA68DE62478A95B06629922E125F"><enum>(C)</enum><text>a statement of the reasons why the extension is needed to complete the negotiations.</text> </subparagraph></paragraph>
<paragraph id="HE46D85EA3B2248349520CD11DFBACE3D"><enum>(3)</enum><header>Other reports to Congress</header> 
<subparagraph id="H335C0F80D0B64292AC4DF347E8D0D2C3"><enum>(A)</enum><header>Report by the advisory committee</header><text>The President shall promptly inform the Advisory Committee for Trade Policy and Negotiations established under section 135 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155</external-xref>) of the decision of the President to submit a report to Congress under paragraph (2). The Advisory Committee shall submit to Congress as soon as practicable, but not later than June 1, 2018, a written report that contains—</text> <clause id="H49C792A7945F43FDA056E5801EA9F45B"><enum>(i)</enum><text>its views regarding the progress that has been made in negotiations to achieve the purposes, policies, priorities, and objectives of this Act; and</text> </clause>
<clause id="H3BFB50EF848247CABC978625BECEB0EE"><enum>(ii)</enum><text>a statement of its views, and the reasons therefor, regarding whether the extension requested under paragraph (2) should be approved or disapproved.</text> </clause></subparagraph> <subparagraph id="H32772D28DB834D7BB635F4E00ABDBA42"><enum>(B)</enum><header>Report by International Trade Commission</header><text>The President shall promptly inform the United States International Trade Commission of the decision of the President to submit a report to Congress under paragraph (2). The International Trade Commission shall submit to Congress as soon as practicable, but not later than June 1, 2018, a written report that contains a review and analysis of the economic impact on the United States of all trade agreements implemented between the date of the enactment of this Act and the date on which the President decides to seek an extension requested under paragraph (2).</text> </subparagraph></paragraph>
<paragraph id="H63D8145947904581A2696A8B288E67ED"><enum>(4)</enum><header>Status of reports</header><text>The reports submitted to Congress under paragraphs (2) and (3), or any portion of such reports, may be classified to the extent the President determines appropriate.</text> </paragraph> <paragraph id="H4BB2DCD314BF415ABD3C6EE7798BF50F"><enum>(5)</enum><header>Extension disapproval resolutions</header> <subparagraph commented="no" display-inline="yes-display-inline" id="HD3F79902AE46491890CB1BD08D9D6CFC"><enum>(A)</enum><text>For purposes of paragraph (1), the term <term>extension disapproval resolution</term> means a resolution of either House of Congress, the sole matter after the resolving clause of which is as follows: <quote>That the ____ disapproves the request of the President for the extension, under section 3(c)(1)(B)(i) of the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title>, of the trade authorities procedures under that Act to any implementing bill submitted with respect to any trade agreement entered into under section 3(b) of that Act after June 30, 2018.</quote>, with the blank space being filled with the name of the resolving House of Congress.</text> </subparagraph>
<subparagraph id="HBAF01C4B4D574F3EAD1E8EC6A08E51A3" indent="up1"><enum>(B)</enum><text>Extension disapproval resolutions—</text> <clause id="HE3525EA87F404ADABDF9F747C6009DFE"><enum>(i)</enum><text>may be introduced in either House of Congress by any member of such House; and</text> </clause>
<clause id="HC55E5A93823C418293B2DBF945BE4B3A"><enum>(ii)</enum><text>shall be referred, in the House of Representatives, to the Committee on Ways and Means and, in addition, to the Committee on Rules.</text> </clause></subparagraph> <subparagraph id="H9001B5A57C0C4BB78636CAAB89242D12" indent="up1"><enum>(C)</enum><text>The provisions of subsections (d) and (e) of section 152 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192</external-xref>) (relating to the floor consideration of certain resolutions in the House and Senate) apply to extension disapproval resolutions.</text> </subparagraph>
<subparagraph id="HDF0A9CB1B20044DBB42A56AB81E3D67F" indent="up1"><enum>(D)</enum><text>It is not in order for—</text> <clause id="HFB945516BFE140838C72999FA8B6262B"><enum>(i)</enum><text>the House of Representatives to consider any extension disapproval resolution not reported by the Committee on Ways and Means and, in addition, by the Committee on Rules;</text> </clause>
<clause id="HEA03BD5E264B49BBA99BF282F18FC99C"><enum>(ii)</enum><text>the Senate to consider any extension disapproval resolution not reported by the Committee on Finance; or</text> </clause> <clause id="H9CC61A82D70B4356A149E1AE3845AEEE"><enum>(iii)</enum><text>either House of Congress to consider an extension disapproval resolution after June 30, 2018.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="H645905C0A0374B55B620D1F7D9E4E271"><enum>(d)</enum><header>Commencement of negotiations</header><text>In order to contribute to the continued economic expansion of the United States, the President shall commence negotiations covering tariff and nontariff barriers affecting any industry, product, or service sector, and expand existing sectoral agreements to countries that are not parties to those agreements, in cases where the President determines that such negotiations are feasible and timely and would benefit the United States. Such sectors include agriculture, commercial services, intellectual property rights, industrial and capital goods, government procurement, information technology products, environmental technology and services, medical equipment and services, civil aircraft, and infrastructure products. In so doing, the President shall take into account all of the negotiating objectives set forth in section 2.</text> </subsection></section> <section id="H1118E18408F3442BAE7485D73B7BCEC3"><enum>4.</enum><header>Congressional oversight, consultations, and access to information</header> <subsection id="HEC8EF551BC4B4FC2B0D0FBE26DFA74C1"><enum>(a)</enum><header>Consultations with Members of Congress</header> <paragraph id="H0A9F85CCE0CF4F17AF5DDFE4495F4FB2"><enum>(1)</enum><header>Consultations during negotiations</header><text>In the course of negotiations conducted under this Act, the United States Trade Representative shall—</text> 
<subparagraph id="HDB32B12EB5994D07A4F2B3B4254E8576"><enum>(A)</enum><text>meet upon request with any Member of Congress regarding negotiating objectives, the status of negotiations in progress, and the nature of any changes in the laws of the United States or the administration of those laws that may be recommended to Congress to carry out any trade agreement or any requirement of, amendment to, or recommendation under, that agreement;</text> </subparagraph> <subparagraph id="HFC2ED4470CE44EED96E3ECFB99DD7200"><enum>(B)</enum><text>upon request of any Member of Congress, provide access to pertinent documents relating to the negotiations, including classified materials;</text> </subparagraph>
<subparagraph id="HAB08A8B97ECD4689B73305A8AE8E445F"><enum>(C)</enum><text>consult closely and on a timely basis with, and keep fully apprised of the negotiations, the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate;</text> </subparagraph> <subparagraph id="HB9F78372B5C94492AFE4C6A1304C1A08"><enum>(D)</enum><text>consult closely and on a timely basis with, and keep fully apprised of the negotiations, the House Advisory Group on Negotiations and the Senate Advisory Group on Negotiations convened under subsection (c) and all committees of the House of Representatives and the Senate with jurisdiction over laws that could be affected by a trade agreement resulting from the negotiations; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4A81183ADA9B4A62AC1EB53712BE1F66"><enum>(E)</enum><text>with regard to any negotiations and agreement relating to agricultural trade, also consult closely and on a timely basis (including immediately before initialing an agreement) with, and keep fully apprised of the negotiations, the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</text> </subparagraph></paragraph> <paragraph id="H5B58B5D82DCE43D6BB7429868E5FBE51"><enum>(2)</enum><header>Consultations prior to entry into force</header><text>Prior to exchanging notes providing for the entry into force of a trade agreement, the United States Trade Representative shall consult closely and on a timely basis with Members of Congress and committees as specified in paragraph (1), and keep them fully apprised of the measures a trading partner has taken to comply with those provisions of the agreement that are to take effect on the date that the agreement enters into force.</text> </paragraph>
<paragraph id="H8A4CAF524AB04361B2B2612242908EE6"><enum>(3)</enum><header>Enhanced coordination with congress</header> 
<subparagraph id="H4E6E5CB87D2249609A50C2D263C10BA0"><enum>(A)</enum><header>Written guidelines</header><text>The United States Trade Representative, in consultation with the chairmen and the ranking members of the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, respectively—</text> <clause id="H87FA166F3FD04407A7381446C7F126A3"><enum>(i)</enum><text>shall, not later than 120 days after the date of the enactment of this Act, develop written guidelines on enhanced coordination with Congress, including coordination with designated congressional advisers under subsection (b), regarding negotiations conducted under this Act; and</text> </clause>
<clause id="H01F2C8516F694B4F9F4D71A6E9F82B15"><enum>(ii)</enum><text>may make such revisions to the guidelines as may be necessary from time to time.</text> </clause></subparagraph> <subparagraph id="H871340C1F7F94CC197D9E10E6968E69F"><enum>(B)</enum><header>Content of guidelines</header><text>The guidelines developed under subparagraph (A) shall enhance coordination with Congress through procedures to ensure—</text> 
<clause id="H51B7F570FD8E4535BA0123EFE040EFDB"><enum>(i)</enum><text>timely briefings upon request of any Member of Congress regarding negotiating objectives, the status of negotiations in progress conducted under this Act, and the nature of any changes in the laws of the United States or the administration of those laws that may be recommended to Congress to carry out any trade agreement or any requirement of, amendment to, or recommendation under, that agreement; and</text> </clause> <clause id="H2E8EAAA3B8E1400AA01BBA182C29C6CD"><enum>(ii)</enum><text>the sharing of detailed and timely information with Members of Congress, and their staff with proper security clearances as appropriate, regarding those negotiations and pertinent documents related to those negotiations (including classified information), and with committee staff with proper security clearances as would be appropriate in the light of the responsibilities of that committee over the trade agreements programs affected by those negotiations.</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2CB5DC748F864535A5B6199F5A755313"><enum>(C)</enum><header>Dissemination</header><text>The United States Trade Representative shall disseminate the guidelines developed under subparagraph (A) to all Federal agencies that could have jurisdiction over laws affected by trade negotiations.</text> </subparagraph></paragraph></subsection> <subsection id="H360B0D3806524D0FA2E2B0198FDDCB0B"><enum>(b)</enum><header>Designated congressional advisers</header> <paragraph id="H7575D2D96E6F42F1B9CBAC33601E7485"><enum>(1)</enum><header>Designation</header> <subparagraph id="H346AD03711364CCD95713A95A640F1EE"><enum>(A)</enum><header>House of Representatives</header><text>In each Congress, any Member of the House of Representatives may be designated as a congressional adviser on trade policy and negotiations by the Speaker of the House of Representatives, after consulting with the chairman and ranking member of the Committee on Ways and Means and the chairman and ranking member of the committee from which the Member will be selected.</text> </subparagraph>
<subparagraph id="HC5EE4112C8574340B32C15BC1829CDE6"><enum>(B)</enum><header>Senate</header><text>In each Congress, any Member of the Senate may be designated as a congressional adviser on trade policy and negotiations by the President pro tempore of the Senate, after consultation with the chairman and ranking member of the Committee on Finance and the chairman and ranking member of the committee from which the Member will be selected.</text> </subparagraph></paragraph> <paragraph id="HBC7E5E6F76E74640B1E5C4019B035A65"><enum>(2)</enum><header>Consultations with designated congressional advisers</header><text>In the course of negotiations conducted under this Act, the United States Trade Representative shall consult closely and on a timely basis (including immediately before initialing an agreement) with, and keep fully apprised of the negotiations, the congressional advisers for trade policy and negotiations designated under paragraph (1).</text> </paragraph>
<paragraph id="HE855702F290747AB8EF1C2BA932EF4A8"><enum>(3)</enum><header>Accreditation</header><text>Each Member of Congress designated as a congressional adviser under paragraph (1) shall be accredited by the United States Trade Representative on behalf of the President as an official adviser to the United States delegations to international conferences, meetings, and negotiating sessions relating to trade agreements.</text> </paragraph></subsection> <subsection id="HCE74B361479747008B1806527DBC8D39"><enum>(c)</enum><header>Congressional advisory groups on negotiations</header> <paragraph id="HF84A408A7A9F4ED08F9672D1AE150265"><enum>(1)</enum><header>In general</header><text>By not later than 60 days after the date of the enactment of this Act, and not later than 30 days after the convening of each Congress, the chairman of the Committee on Ways and Means of the House of Representatives shall convene the House Advisory Group on Negotiations and the chairman of the Committee on Finance of the Senate shall convene the Senate Advisory Group on Negotiations (in this subsection referred to collectively as the <quote>congressional advisory groups</quote>).</text> </paragraph>
<paragraph id="HA41F11F767EF49CA96F06AA195B89ABA"><enum>(2)</enum><header>Members and functions</header> 
<subparagraph id="H2275FFDAF4584238B8F0EB00F8B54187"><enum>(A)</enum><header>Membership of the house advisory group on negotiations</header><text>In each Congress, the House Advisory Group on Negotiations shall be comprised of the following Members of the House of Representatives:</text> <clause id="H0EDAEB1DAB5E4899A00926DEB9195E30"><enum>(i)</enum><text>The chairman and ranking member of the Committee on Ways and Means, and 3 additional members of such Committee (not more than 2 of whom are members of the same political party).</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H04388BB9EABE4541B6245D63639E0CAB"><enum>(ii)</enum><text>The chairman and ranking member, or their designees, of the committees of the House of Representatives that would have, under the Rules of the House of Representatives, jurisdiction over provisions of law affected by a trade agreement negotiation conducted at any time during that Congress and to which this Act would apply.</text> </clause></subparagraph> <subparagraph id="HFED8E2BE0C8F4378B9DEBBF7B32902FC"><enum>(B)</enum><header>Membership of the senate advisory group on negotiations</header><text>In each Congress, the Senate Advisory Group on Negotiations shall be comprised of the following Members of the Senate:</text> 
<clause id="H42655FD4114D48938FCDC6C9D2AC324A"><enum>(i)</enum><text>The chairman and ranking member of the Committee on Finance and 3 additional members of such Committee (not more than 2 of whom are members of the same political party).</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H887FB95FA8334D8FBBA047745614CFFF"><enum>(ii)</enum><text>The chairman and ranking member, or their designees, of the committees of the Senate that would have, under the Rules of the Senate, jurisdiction over provisions of law affected by a trade agreement negotiation conducted at any time during that Congress and to which this Act would apply.</text> </clause></subparagraph>
<subparagraph id="HC472B2CF00294927A447C62C82E2CD8B"><enum>(C)</enum><header>Accreditation</header><text>Each member of the congressional advisory groups described in subparagraphs (A)(i) and (B)(i) shall be accredited by the United States Trade Representative on behalf of the President as an official adviser to the United States delegation in negotiations for any trade agreement to which this Act applies. Each member of the congressional advisory groups described in subparagraphs (A)(ii) and (B)(ii) shall be accredited by the United States Trade Representative on behalf of the President as an official adviser to the United States delegation in the negotiations by reason of which the member is in one of the congressional advisory groups.</text> </subparagraph> <subparagraph id="H4CE5FA61C97F4B9090BF9B79EE2315FB"><enum>(D)</enum><header>Consultation and advice</header><text>The congressional advisory groups shall consult with and provide advice to the Trade Representative regarding the formulation of specific objectives, negotiating strategies and positions, the development of the applicable trade agreement, and compliance and enforcement of the negotiated commitments under the trade agreement.</text> </subparagraph>
<subparagraph id="H349B2AD60F974A429CECC3CD9F2D6337"><enum>(E)</enum><header>Chair</header><text>The House Advisory Group on Negotiations shall be chaired by the Chairman of the Committee on Ways and Means of the House of Representatives and the Senate Advisory Group on Negotiations shall be chaired by the Chairman of the Committee on Finance of the Senate.</text> </subparagraph> <subparagraph id="H01A24441316E42548D9AF7A4A7734B0E"><enum>(F)</enum><header>Coordination with other committees</header><text>Members of any committee represented on one of the congressional advisory groups may submit comments to the member of the appropriate congressional advisory group from that committee regarding any matter related to a negotiation for any trade agreement to which this Act applies.</text> </subparagraph></paragraph>
<paragraph id="H8FFEC43141EC46E7A4DB58F5800C49E1"><enum>(3)</enum><header>Guidelines</header> 
<subparagraph id="H58CBB403AAAD49158BC209D157D2265F"><enum>(A)</enum><header>Purpose and revision</header><text>The United States Trade Representative, in consultation with the chairmen and the ranking members of the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, respectively—</text> <clause id="HB7C3038DDB6141EDBC7DEDD7B49CF611"><enum>(i)</enum><text>shall, not later than 120 days after the date of the enactment of this Act, develop written guidelines to facilitate the useful and timely exchange of information between the Trade Representative and the congressional advisory groups; and</text> </clause>
<clause id="H628C088123C14CF1BAC170D0966118F0"><enum>(ii)</enum><text>may make such revisions to the guidelines as may be necessary from time to time.</text> </clause></subparagraph> <subparagraph id="HFF254D01211F41D1A9B94BF0E19524A9"><enum>(B)</enum><header>Content</header><text>The guidelines developed under subparagraph (A) shall provide for, among other things—</text> 
<clause id="H06A22EF383FE4642B33223050CA9DB49"><enum>(i)</enum><text>detailed briefings on a fixed timetable to be specified in the guidelines of the congressional advisory groups regarding negotiating objectives and positions and the status of the applicable negotiations, beginning as soon as practicable after the congressional advisory groups are convened, with more frequent briefings as trade negotiations enter the final stage;</text> </clause> <clause id="H44FC9C0BE2244716BB09E80B84906A7A"><enum>(ii)</enum><text>access by members of the congressional advisory groups, and staff with proper security clearances, to pertinent documents relating to the negotiations, including classified materials;</text> </clause>
<clause id="HE28D80D2DBE0485C8B07D634AE565CA7"><enum>(iii)</enum><text>the closest practicable coordination between the Trade Representative and the congressional advisory groups at all critical periods during the negotiations, including at negotiation sites;</text> </clause> <clause id="HBBB5B70724BB471D99370F13A5EE24FA"><enum>(iv)</enum><text>after the applicable trade agreement is concluded, consultation regarding ongoing compliance and enforcement of negotiated commitments under the trade agreement; and</text> </clause>
<clause id="H6A1A532850B54972AB20B7CDB6545F7B"><enum>(v)</enum><text>the timeframe for submitting the report required under section 5(d)(3).</text> </clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6E67F6261D894E8692D8AA625364F47D"><enum>(4)</enum><header>Request for meeting</header><text>Upon the request of a majority of either of the congressional advisory groups, the President shall meet with that congressional advisory group before initiating negotiations with respect to a trade agreement, or at any other time concerning the negotiations.</text> </paragraph></subsection>
<subsection id="H5493AC2FE42C4453ADB7CB09A9108854"><enum>(d)</enum><header>Consultations with the public</header> 
<paragraph id="HDD79382AA7C843B4B2146B9B50AD14F7"><enum>(1)</enum><header>Guidelines for public engagement</header><text>The United States Trade Representative, in consultation with the chairmen and the ranking members of the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, respectively—</text> <subparagraph id="HA91A2417B2FF45C8924F2199B190C5B6"><enum>(A)</enum><text>shall, not later than 120 days after the date of the enactment of this Act, develop written guidelines on public access to information regarding negotiations conducted under this Act; and</text> </subparagraph>
<subparagraph id="HE91602FA5DC049C6AEA41814336CB2E2"><enum>(B)</enum><text>may make such revisions to the guidelines as may be necessary from time to time.</text> </subparagraph></paragraph> <paragraph id="H5A0DCF3A9E994299A230EF6C20679263"><enum>(2)</enum><header>Purposes</header><text>The guidelines developed under paragraph (1) shall—</text> 
<subparagraph id="H3F4D72F402344FBB8E54A31CCDAA4760"><enum>(A)</enum><text>facilitate transparency;</text> </subparagraph> <subparagraph id="HBCE63A93105C46ECB9D98FE2CB761DB2"><enum>(B)</enum><text>encourage public participation; and</text> </subparagraph>
<subparagraph id="HDCDF82958F824A2E98B9F4F1D429DBC1"><enum>(C)</enum><text>promote collaboration in the negotiation process.</text> </subparagraph></paragraph> <paragraph id="HE22BBBBEA7A84686B5B384BEF3EC7DF4"><enum>(3)</enum><header>Content</header><text>The guidelines developed under paragraph (1) shall include procedures that—</text> 
<subparagraph id="H2227005BA69B4F12A47749D6A25BF215"><enum>(A)</enum><text>provide for rapid disclosure of information in forms that the public can readily find and use; and</text> </subparagraph> <subparagraph id="H3F99E027C89C459C836D80ADEFD944A6"><enum>(B)</enum><text>provide frequent opportunities for public input through Federal Register requests for comment and other means.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9499BD902A4247ADAD8E3AF23DFEBB9D"><enum>(4)</enum><header>Dissemination</header><text>The United States Trade Representative shall disseminate the guidelines developed under paragraph (1) to all Federal agencies that could have jurisdiction over laws affected by trade negotiations.</text> </paragraph></subsection> <subsection id="H688686DDD7B840358415CF0EDD86AB0B"><enum>(e)</enum><header>Consultations with advisory committees</header> <paragraph id="HC1954D4D4CE14E219F81FE6491BA042E"><enum>(1)</enum><header>Guidelines for engagement with advisory committees</header><text>The United States Trade Representative, in consultation with the chairmen and the ranking members of the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, respectively—</text> 
<subparagraph id="H1EC599DF13A6408AA7588B3773EE2BB0"><enum>(A)</enum><text>shall, not later than 120 days after the date of the enactment of this Act, develop written guidelines on enhanced coordination with advisory committees established pursuant to section 135 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155</external-xref>) regarding negotiations conducted under this Act; and</text> </subparagraph> <subparagraph id="H0C895004F04B4C28BBFB21EB9AAF157E"><enum>(B)</enum><text>may make such revisions to the guidelines as may be necessary from time to time.</text> </subparagraph></paragraph>
<paragraph id="H9F22AA91551A4BCDA5D38B9178BB0951"><enum>(2)</enum><header>Content</header><text>The guidelines developed under paragraph (1) shall enhance coordination with advisory committees described in that paragraph through procedures to ensure—</text> <subparagraph id="HAF6E60A866554F58BACE8C7F8368EBBD"><enum>(A)</enum><text>timely briefings of advisory committees and regular opportunities for advisory committees to provide input throughout the negotiation process on matters relevant to the sectors or functional areas represented by those committees; and</text> </subparagraph>
<subparagraph id="H2CFA6D36C68D4BA8AD34AFD9457498C8"><enum>(B)</enum><text>the sharing of detailed and timely information with each member of an advisory committee regarding negotiations and pertinent documents related to the negotiation (including classified information) on matters relevant to the sectors or functional areas the member represents, and with a designee with proper security clearances of each such member as appropriate.</text> </subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF77B7F0E1EDD48D6B0AAEB198594EE95"><enum>(3)</enum><header>Dissemination</header><text>The United States Trade Representative shall disseminate the guidelines developed under paragraph (1) to all Federal agencies that could have jurisdiction over laws affected by trade negotiations.</text> </paragraph></subsection>
<subsection id="id835A04E31AC245589ED4DE375F8F9731"><enum>(f)</enum><header>Establishment of position of Chief Transparency Officer in the Office of the United States Trade Representative</header><text display-inline="yes-display-inline">Section 141(b) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2171">19 U.S.C. 2171(b)</external-xref>) is amended—</text> <paragraph id="id75DDA09BF3854E588F3AA9A1D12D3CFA"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text> </paragraph>
<paragraph id="id15EEDCA9F52F42B9ACA9E6ACBA515A55"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="id9f0ede16aa584d37bfab0b7c22ed243d" style="OLC"> <paragraph id="idae1d9f360b6f48bdbd0707c5c78f7a25" indent="up1"><enum>(3)</enum><text>There shall be in the Office one Chief Transparency Officer. The Chief Transparency Officer shall consult with Congress on transparency policy, coordinate transparency in trade negotiations, engage and assist the public, and advise the United States Trade Representative on transparency policy.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
<section id="H360A9F14409A452FA13FEAC4B44C8950"><enum>5.</enum><header>Notice, consultations, and reports</header> 
<subsection id="HD4D9F3FF35044F26B8737098262644D3"><enum>(a)</enum><header>Notice, consultations, and reports before negotiation</header> 
<paragraph id="HFF156E13F1EA44B9853ED89D68AD1518"><enum>(1)</enum><header>Notice</header><text>The President, with respect to any agreement that is subject to the provisions of section 3(b), shall—</text> <subparagraph id="H0CF59971EEEB4D8DB53823A65960A0A3"><enum>(A)</enum><text>provide, at least 90 calendar days before initiating negotiations with a country, written notice to Congress of the President’s intention to enter into the negotiations with that country and set forth in the notice the date on which the President intends to initiate those negotiations, the specific United States objectives for the negotiations with that country, and whether the President intends to seek an agreement, or changes to an existing agreement;</text> </subparagraph>
<subparagraph id="H0795BA261A31400895CDDECF5EA48366"><enum>(B)</enum><text>before and after submission of the notice, consult regarding the negotiations with the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, such other committees of the House and Senate as the President deems appropriate, and the House Advisory Group on Negotiations and the Senate Advisory Group on Negotiations convened under section 4(c);</text> </subparagraph> <subparagraph id="H3B4D1F2FE6594C08A3F550EB85B5F648"><enum>(C)</enum><text>upon the request of a majority of the members of either the House Advisory Group on Negotiations or the Senate Advisory Group on Negotiations convened under section 4(c), meet with the requesting congressional advisory group before initiating the negotiations or at any other time concerning the negotiations; and</text> </subparagraph>
<subparagraph id="id49e0ad43165549558697a3e3dd6cfe2c"><enum>(D)</enum><text>after consulting with the Committee on Ways and Means and the Committee on Finance, and at least 30 calendar days before initiating negotiations with a country, publish on a publicly available Internet website of the Office of the United States Trade Representative, and regularly update thereafter, a detailed and comprehensive summary of the specific objectives with respect to the negotiations, and a description of how the agreement, if successfully concluded, will further those objectives and benefit the United States.</text> </subparagraph></paragraph> <paragraph id="H2D8A340DC912407F8E7ABE801C99C1A6"><enum>(2)</enum><header>Negotiations regarding agriculture</header> <subparagraph id="H0AC3449AE3ED48DBB074AB75F68E626D"><enum>(A)</enum><header>Assessment and consultations following assessment</header><text>Before initiating or continuing negotiations the subject matter of which is directly related to the subject matter under section 2(b)(3)(B) with any country, the President shall—</text> 
<clause id="HFBA2702168FC497197B96B736610E304"><enum>(i)</enum><text>assess whether United States tariffs on agricultural products that were bound under the Uruguay Round Agreements are lower than the tariffs bound by that country;</text> </clause> <clause id="H3E26B03B46A540649D407C36DBCED497"><enum>(ii)</enum><text>consider whether the tariff levels bound and applied throughout the world with respect to imports from the United States are higher than United States tariffs and whether the negotiation provides an opportunity to address any such disparity; and</text> </clause>
<clause id="H20A67ED507D346BAAE933E9F35301787"><enum>(iii)</enum><text>consult with the Committee on Ways and Means and the Committee on Agriculture of the House of Representatives and the Committee on Finance and the Committee on Agriculture, Nutrition, and Forestry of the Senate concerning the results of the assessment, whether it is appropriate for the United States to agree to further tariff reductions based on the conclusions reached in the assessment, and how all applicable negotiating objectives will be met.</text> </clause></subparagraph> <subparagraph id="H1919CED833C8480B8FC4984F9775BDC0"><enum>(B)</enum><header>Special consultations on import sensitive products</header> <clause commented="no" display-inline="yes-display-inline" id="HCCD72D1D624E49379BDF1ACEE5652753"><enum>(i)</enum><text>Before initiating negotiations with regard to agriculture and, with respect to agreements described in paragraphs (2) and (3) of section 7(a), as soon as practicable after the date of the enactment of this Act, the United States Trade Representative shall—</text> 
<subclause id="H464A88C2A255436083B381D567D69FB6" indent="up1"><enum>(I)</enum><text>identify those agricultural products subject to tariff rate quotas on the date of enactment of this Act, and agricultural products subject to tariff reductions by the United States as a result of the Uruguay Round Agreements, for which the rate of duty was reduced on January 1, 1995, to a rate which was not less than 97.5 percent of the rate of duty that applied to such article on December 31, 1994;</text> </subclause> <subclause id="H009EA5D2E4C04151AF11AE3FAFB47C76" indent="up1"><enum>(II)</enum><text>consult with the Committee on Ways and Means and the Committee on Agriculture of the House of Representatives and the Committee on Finance and the Committee on Agriculture, Nutrition, and Forestry of the Senate concerning—</text> 
<item id="HEE44735B73A64D6F8E87E8FA791279BB"><enum>(aa)</enum><text>whether any further tariff reductions on the products identified under subclause (I) should be appropriate, taking into account the impact of any such tariff reduction on the United States industry producing the product concerned;</text> </item> <item id="H8BC2D7EFB08D476A98BCDB3D03BF36F8"><enum>(bb)</enum><text>whether the products so identified face unjustified sanitary or phytosanitary restrictions, including those not based on scientific principles in contravention of the Uruguay Round Agreements; and</text> </item>
<item id="HA9C7E4CB43F44F37843BB1C38FD814D5"><enum>(cc)</enum><text>whether the countries participating in the negotiations maintain export subsidies or other programs, policies, or practices that distort world trade in such products and the impact of such programs, policies, and practices on United States producers of the products;</text> </item></subclause> <subclause id="H08A19FB04C784832B397726648AD0E3B" indent="up1"><enum>(III)</enum><text>request that the International Trade Commission prepare an assessment of the probable economic effects of any such tariff reduction on the United States industry producing the product concerned and on the United States economy as a whole; and</text> </subclause>
<subclause id="H6A19C3C47DDE4D709324A2E8227038B4" indent="up1"><enum>(IV)</enum><text>upon complying with subclauses (I), (II), and (III), notify the Committee on Ways and Means and the Committee on Agriculture of the House of Representatives and the Committee on Finance and the Committee on Agriculture, Nutrition, and Forestry of the Senate of those products identified under subclause (I) for which the Trade Representative intends to seek tariff liberalization in the negotiations and the reasons for seeking such tariff liberalization.</text> </subclause></clause> <clause id="HB4D2B0CD448E416292695CA60E9527F8" indent="up1"><enum>(ii)</enum><text>If, after negotiations described in clause (i) are commenced—</text> 
<subclause id="H858A9372A22042BFBF1338DAE2B6A8C7"><enum>(I)</enum><text>the United States Trade Representative identifies any additional agricultural product described in clause (i)(I) for tariff reductions which were not the subject of a notification under clause (i)(IV), or</text> </subclause> <subclause id="H11DC5A92EBF544C18CCA4B22258DB38B"><enum>(II)</enum><text>any additional agricultural product described in clause (i)(I) is the subject of a request for tariff reductions by a party to the negotiations,</text> </subclause><continuation-text commented="no" continuation-text-level="clause" indent="subparagraph">the Trade Representative shall, as soon as practicable, notify the committees referred to in clause (i)(IV) of those products and the reasons for seeking such tariff reductions.</continuation-text></clause></subparagraph></paragraph>
<paragraph id="H81247D0D574B4A8A8A0CC9BA7FDE0057"><enum>(3)</enum><header>Negotiations regarding the fishing industry</header><text>Before initiating, or continuing, negotiations that directly relate to fish or shellfish trade with any country, the President shall consult with the Committee on Ways and Means and the Committee on Natural Resources of the House of Representatives, and the Committee on Finance and the Committee on Commerce, Science, and Transportation of the Senate, and shall keep the Committees apprised of the negotiations on an ongoing and timely basis.</text> </paragraph> <paragraph id="HFCC2E90031E1451C9AD78A43768355AE"><enum>(4)</enum><header>Negotiations regarding textiles</header><text>Before initiating or continuing negotiations the subject matter of which is directly related to textiles and apparel products with any country, the President shall—</text> 
<subparagraph id="HDFC1B95F66414435BADB8BAB10B41EE8"><enum>(A)</enum><text>assess whether United States tariffs on textile and apparel products that were bound under the Uruguay Round Agreements are lower than the tariffs bound by that country and whether the negotiation provides an opportunity to address any such disparity; and</text> </subparagraph> <subparagraph id="H8320F7A63FC6410E865D3344917BC57B"><enum>(B)</enum><text>consult with the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate concerning the results of the assessment, whether it is appropriate for the United States to agree to further tariff reductions based on the conclusions reached in the assessment, and how all applicable negotiating objectives will be met.</text> </subparagraph></paragraph>
<paragraph id="H63393313B9484FCC88C767404D97EE16"><enum>(5)</enum><header>Adherence to existing international trade and investment agreement obligations</header><text>In determining whether to enter into negotiations with a particular country, the President shall take into account the extent to which that country has implemented, or has accelerated the implementation of, its international trade and investment commitments to the United States, including pursuant to the WTO Agreement.</text> </paragraph></subsection> <subsection id="H6F9249B318F54F94ACEE736234F4AC36"><enum>(b)</enum><header>Consultation with congress before entry into agreement</header> <paragraph id="H9C5B3DB91EE94146AF70549CD10089BA"><enum>(1)</enum><header>Consultation</header><text>Before entering into any trade agreement under section 3(b), the President shall consult with—</text> 
<subparagraph id="H9B048575B268441FB3E4A2FC0158B3D8"><enum>(A)</enum><text>the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate;</text> </subparagraph> <subparagraph id="H5C516884F4A64B8B8FFE9164441857FF"><enum>(B)</enum><text>each other committee of the House and the Senate, and each joint committee of Congress, which has jurisdiction over legislation involving subject matters which would be affected by the trade agreement; and</text> </subparagraph>
<subparagraph id="H0B9B4BC8A3AB45C0AE1AB5C5B36A98F8"><enum>(C)</enum><text>the House Advisory Group on Negotiations and the Senate Advisory Group on Negotiations convened under section 4(c).</text> </subparagraph></paragraph> <paragraph id="H123D4892E9A34253BB672E3B7610F707"><enum>(2)</enum><header>Scope</header><text>The consultation described in paragraph (1) shall include consultation with respect to—</text> 
<subparagraph id="H4403434F9252483D9085609C5F0F87F4"><enum>(A)</enum><text>the nature of the agreement;</text> </subparagraph> <subparagraph id="HF4ADCA835C4440F79777D6358A254C80"><enum>(B)</enum><text>how and to what extent the agreement will achieve the applicable purposes, policies, priorities, and objectives of this Act; and</text> </subparagraph>
<subparagraph id="H71779418633B4446A49B91CC3B0183A8"><enum>(C)</enum><text>the implementation of the agreement under section 6, including the general effect of the agreement on existing laws.</text> </subparagraph></paragraph> <paragraph id="H73A15226A3DC4F539B4927A8134FDD83"><enum>(3)</enum><header>Report regarding united states trade remedy laws</header> <subparagraph id="H2FCF5FBB02F042C19506597554854AD6"><enum>(A)</enum><header>Changes in certain trade laws</header><text>The President, not less than 180 calendar days before the day on which the President enters into a trade agreement under section 3(b), shall report to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate—</text> 
<clause id="HB99213FC6F224F078A33F63B58975443"><enum>(i)</enum><text>the range of proposals advanced in the negotiations with respect to that agreement, that may be in the final agreement, and that could require amendments to title VII of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1671">19 U.S.C. 1671 et seq.</external-xref>) or to chapter 1 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251 et seq.</external-xref>); and</text> </clause> <clause id="HA6333E48B01A4C11B391BB2831A74D9E"><enum>(ii)</enum><text>how these proposals relate to the objectives described in section 2(b)(16).</text> </clause></subparagraph>
<subparagraph id="HEFBD176A0BDE46F69F0FE2AD419410F8"><enum>(B)</enum><header>Resolutions</header>
<clause commented="no" display-inline="yes-display-inline" id="HBDF91696203E4E56A2D182774ED26FAD"><enum>(i)</enum><text>At any time after the transmission of the report under subparagraph (A), if a resolution is introduced with respect to that report in either House of Congress, the procedures set forth in clauses (iii) through (vii) shall apply to that resolution if—</text> <subclause id="H8CCFEE8B099D49DFBEF817FD5910DA3B" indent="up1"><enum>(I)</enum><text>no other resolution with respect to that report has previously been reported in that House of Congress by the Committee on Ways and Means or the Committee on Finance, as the case may be, pursuant to those procedures; and</text> </subclause>
<subclause id="HF5A4B305E92745959C99A49BA525862C" indent="up1"><enum>(II)</enum><text>no procedural disapproval resolution under section 6(b) introduced with respect to a trade agreement entered into pursuant to the negotiations to which the report under subparagraph (A) relates has previously been reported in that House of Congress by the Committee on Ways and Means or the Committee on Finance, as the case may be.</text> </subclause></clause> <clause id="H3C6E8C1FF8D044BCABE263C9AE46D7F7" indent="up1"><enum>(ii)</enum><text>For purposes of this subparagraph, the term <term>resolution</term> means only a resolution of either House of Congress, the matter after the resolving clause of which is as follows: <quote>That the ____ finds that the proposed changes to United States trade remedy laws contained in the report of the President transmitted to Congress on ____ under section 5(b)(3) of the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title> with respect to ____, are inconsistent with the negotiating objectives described in section 2(b)(16) of that Act.</quote>, with the first blank space being filled with the name of the resolving House of Congress, the second blank space being filled with the appropriate date of the report, and the third blank space being filled with the name of the country or countries involved.</text> </clause>
<clause id="H8ECAABF30B354203BEC84CEA9F96A6E7" indent="up1"><enum>(iii)</enum><text>Resolutions in the House of Representatives—</text> <subclause id="H4F8787815E2743D5BB61D46822D72E48"><enum>(I)</enum><text>may be introduced by any Member of the House;</text> </subclause>
<subclause id="HF815D923C7D1496BBCA4CAFCED132515"><enum>(II)</enum><text>shall be referred to the Committee on Ways and Means and, in addition, to the Committee on Rules; and</text> </subclause> <subclause id="HE24763C32D874C1D8DF5B9DF85E283EC"><enum>(III)</enum><text>may not be amended by either Committee.</text> </subclause></clause>
<clause id="H94FE4DF553EB4080BCE456FB77AFC0D5" indent="up1"><enum>(iv)</enum><text>Resolutions in the Senate—</text> <subclause id="H5180F81B58E344878A72560BBBA4A754"><enum>(I)</enum><text>may be introduced by any Member of the Senate;</text> </subclause>
<subclause id="H59C8151663BC4F25B2BCB6622F9401A5"><enum>(II)</enum><text>shall be referred to the Committee on Finance; and</text> </subclause> <subclause id="HD068ED7CCB034BF7B9F12955B72CABAD"><enum>(III)</enum><text>may not be amended.</text> </subclause></clause>
<clause id="H41A4620B7FAA48568BF3D74D82E99A49" indent="up1"><enum>(v)</enum><text>It is not in order for the House of Representatives to consider any resolution that is not reported by the Committee on Ways and Means and, in addition, by the Committee on Rules.</text> </clause> <clause id="H66AF1B894E39457ABD5C084D1E7ACF1A" indent="up1"><enum>(vi)</enum><text>It is not in order for the Senate to consider any resolution that is not reported by the Committee on Finance.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H590CDD853AF047E795A18801FDD14B96" indent="up1"><enum>(vii)</enum><text>The provisions of subsections (d) and (e) of section 152 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192</external-xref>) (relating to floor consideration of certain resolutions in the House and Senate) shall apply to resolutions.</text> </clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H47633BF9ACB944268D147F5D8D8AFD3A"><enum>(4)</enum><header>Advisory committee reports</header><text>The report required under section 135(e)(1) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155(e)(1)</external-xref>) regarding any trade agreement entered into under subsection (a) or (b) of section 3 shall be provided to the President, Congress, and the United States Trade Representative not later than 30 days after the date on which the President notifies Congress under section 3(a)(2) or 6(a)(1)(A) of the intention of the President to enter into the agreement.</text> </paragraph></subsection>
<subsection id="H75B99C9A8AF4420C82D5360C2537DD78"><enum>(c)</enum><header>International Trade Commission assessment</header> 
<paragraph id="H17B1DEE089B34A4999C4B08266C0F63A"><enum>(1)</enum><header>Submission of information to commission</header><text>The President, not later than 90 calendar days before the day on which the President enters into a trade agreement under section 3(b), shall provide the International Trade Commission (referred to in this subsection as the <quote>Commission</quote>) with the details of the agreement as it exists at that time and request the Commission to prepare and submit an assessment of the agreement as described in paragraph (2). Between the time the President makes the request under this paragraph and the time the Commission submits the assessment, the President shall keep the Commission current with respect to the details of the agreement.</text> </paragraph> <paragraph id="HD73B810CDFEB4F47B2082AD294CEC446"><enum>(2)</enum><header>Assessment</header><text>Not later than 105 calendar days after the President enters into a trade agreement under section 3(b), the Commission shall submit to the President and Congress a report assessing the likely impact of the agreement on the United States economy as a whole and on specific industry sectors, including the impact the agreement will have on the gross domestic product, exports and imports, aggregate employment and employment opportunities, the production, employment, and competitive position of industries likely to be significantly affected by the agreement, and the interests of United States consumers.</text> </paragraph>
<paragraph id="H045AC5134E5544C09D9C2D6B466895BD"><enum>(3)</enum><header>Review of empirical literature</header><text>In preparing the assessment under paragraph (2), the Commission shall review available economic assessments regarding the agreement, including literature regarding any substantially equivalent proposed agreement, and shall provide in its assessment a description of the analyses used and conclusions drawn in such literature, and a discussion of areas of consensus and divergence between the various analyses and conclusions, including those of the Commission regarding the agreement.</text> </paragraph> <paragraph id="H8FB14F7FF3814E5087584D9A8496EC8C"><enum>(4)</enum><header>Public availability</header><text>The President shall make each assessment under paragraph (2) available to the public.</text> </paragraph></subsection>
<subsection commented="no" id="H332C145611224AA1A89C0B7DA0C64D5E"><enum>(d)</enum><header>Reports submitted to committees with agreement</header> 
<paragraph commented="no" id="H0C0EC64B19CD4B96BEC7DD6E7F5B0300"><enum>(1)</enum><header>Environmental reviews and reports</header><text>The President shall—</text> <subparagraph commented="no" id="HDA1EFDAE3B364345A1B4EE262029C070"><enum>(A)</enum><text>conduct environmental reviews of future trade and investment agreements, consistent with Executive Order 13141 (64 Fed. Reg. 63169), dated November 16, 1999, and its relevant guidelines; and</text> </subparagraph>
<subparagraph commented="no" id="H4E97033CB9024C2CB32A982DD6B5E8F7"><enum>(B)</enum><text>submit a report on those reviews and on the content and operation of consultative mechanisms established pursuant to section 2(c) to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate at the time the President submits to Congress a copy of the final legal text of an agreement pursuant to section 6(a)(1)(E).</text> </subparagraph></paragraph> <paragraph commented="no" id="H5CA4B981D47848AF9696593C4635D4F7"><enum>(2)</enum><header>Employment impact reviews and reports</header><text>The President shall—</text> 
<subparagraph commented="no" id="H1266294F4B8E4D21B8EDC4D838309871"><enum>(A)</enum><text>review the impact of future trade agreements on United States employment, including labor markets, modeled after Executive Order 13141 (64 Fed. Reg. 63169) to the extent appropriate in establishing procedures and criteria; and</text> </subparagraph> <subparagraph commented="no" id="HB8538F57BADF4D7AAEEB16CC6B1E704E"><enum>(B)</enum><text>submit a report on such reviews to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate at the time the President submits to Congress a copy of the final legal text of an agreement pursuant to section 6(a)(1)(E).</text> </subparagraph></paragraph>
<paragraph commented="no" id="HEA2A8E70E53B40F4A8A87C9F0EF007A8"><enum>(3)</enum><header>Report on labor rights</header><text>The President shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate, on a timeframe determined in accordance with section 4(c)(3)(B)(v)—</text> <subparagraph commented="no" id="H536D261A76FC46259E4502233C0E9A6B"><enum>(A)</enum><text>a meaningful labor rights report of the country, or countries, with respect to which the President is negotiating; and</text> </subparagraph>
<subparagraph commented="no" id="HA2B231CF69C04FD3882E341F6A01B413"><enum>(B)</enum><text>a description of any provisions that would require changes to the labor laws and labor practices of the United States.</text> </subparagraph></paragraph> <paragraph commented="no" id="HB1CF872B8B684B1CA5D780AB9EB5250C"><enum>(4)</enum><header>Public availability</header><text>The President shall make all reports required under this subsection available to the public.</text> </paragraph></subsection>
<subsection id="HF3BB4E3096034506AFBF994A4ACC8302"><enum>(e)</enum><header>Implementation and enforcement plan</header> 
<paragraph id="HD2FFA613F31148BEB3E0AC8C059433CD"><enum>(1)</enum><header>In general</header><text>At the time the President submits to Congress a copy of the final legal text of an agreement pursuant to section 6(a)(1)(E), the President shall also submit to Congress a plan for implementing and enforcing the agreement.</text> </paragraph> <paragraph id="HCE276E4D76F84E939C911A19FFF1730D"><enum>(2)</enum><header>Elements</header><text>The implementation and enforcement plan required by paragraph (1) shall include the following:</text> 
<subparagraph id="H27AE85B99A494604A1F6BD4C961A0E62"><enum>(A)</enum><header>Border personnel requirements</header><text>A description of additional personnel required at border entry points, including a list of additional customs and agricultural inspectors.</text> </subparagraph> <subparagraph id="H98E1405C14144893AA6F194DBC35603D"><enum>(B)</enum><header>Agency staffing requirements</header><text>A description of additional personnel required by Federal agencies responsible for monitoring and implementing the trade agreement, including personnel required by the Office of the United States Trade Representative, the Department of Commerce, the Department of Agriculture (including additional personnel required to implement sanitary and phytosanitary measures in order to obtain market access for United States exports), the Department of Homeland Security, the Department of the Treasury, and such other agencies as may be necessary.</text> </subparagraph>
<subparagraph id="HAABBBDDA5CD849DD86C4D5EECF2579E9"><enum>(C)</enum><header>Customs infrastructure requirements</header><text>A description of the additional equipment and facilities needed by U.S. Customs and Border Protection.</text> </subparagraph> <subparagraph id="HF18BDC2C6CBF485EA813285987C1A353"><enum>(D)</enum><header>Impact on state and local governments</header><text>A description of the impact the trade agreement will have on State and local governments as a result of increases in trade.</text> </subparagraph>
<subparagraph id="HD9326A1E9FE24E488BFDE30205CBAF00"><enum>(E)</enum><header>Cost analysis</header><text>An analysis of the costs associated with each of the items listed in subparagraphs (A) through (D).</text> </subparagraph></paragraph> <paragraph id="H72468648BA724A86A4CE7CBB8E17CD36"><enum>(3)</enum><header>Budget submission</header><text>The President shall include a request for the resources necessary to support the plan required by paragraph (1) in the first budget of the President submitted to Congress under section 1105(a) of title 31, United States Code, after the date of the submission of the plan.</text> </paragraph>
<paragraph commented="no" id="H5741000307A849079FA4F04A53DE8ACB"><enum>(4)</enum><header>Public availability</header><text>The President shall make the plan required under this subsection available to the public.</text> </paragraph></subsection> <subsection id="H9F5511563EB243B398391FED1500AB7D"><enum>(f)</enum><header>Other reports</header> <paragraph id="HE5DDB2935C0C4C578929D9019663B2E0"><enum>(1)</enum><header>Report on penalties</header><text>Not later than one year after the imposition by the United States of a penalty or remedy permitted by a trade agreement to which this Act applies, the President shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report on the effectiveness of the penalty or remedy applied under United States law in enforcing United States rights under the trade agreement, which shall address whether the penalty or remedy was effective in changing the behavior of the targeted party and whether the penalty or remedy had any adverse impact on parties or interests not party to the dispute.</text> </paragraph>
<paragraph id="H78134B5C8A2A4DFB86E30BEDB059DC44"><enum>(2)</enum><header>Report on impact of trade promotion authority</header><text>Not later than one year after the date of the enactment of this Act, and not later than 5 years thereafter, the United States International Trade Commission shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report on the economic impact on the United States of all trade agreements with respect to which Congress has enacted an implementing bill under trade authorities procedures since January 1, 1984.</text> </paragraph> <paragraph id="H4401958F1DA94A71AC5A713C11E87B0B"><enum>(3)</enum><header>Enforcement consultations and reports</header> <subparagraph commented="no" display-inline="yes-display-inline" id="HD2127984D12F477D859CEFB1273EDB9A"><enum>(A)</enum><text>The United States Trade Representative shall consult with the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate after acceptance of a petition for review or taking an enforcement action in regard to an obligation under a trade agreement, including a labor or environmental obligation. During such consultations, the United States Trade Representative shall describe the matter, including the basis for such action and the application of any relevant legal obligations.</text> </subparagraph>
<subparagraph id="H174C41B67B5446EBA0C501F7915E6967" indent="up1"><enum>(B)</enum><text>As part of the report required pursuant to section 163 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2213">19 U.S.C. 2213</external-xref>), the President shall report annually to Congress on enforcement actions taken pursuant to a trade agreement to which the United States is a party, as well as on any public reports issued by Federal agencies on enforcement matters relating to a trade agreement.</text> </subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H5035E3821C5E4E8B8D3B56EC62522172"><enum>(g)</enum><header>Additional coordination with members</header><text>Any Member of the House of Representatives may submit to the Committee on Ways and Means of the House of Representatives and any Member of the Senate may submit to the Committee on Finance of the Senate the views of that Member on any matter relevant to a proposed trade agreement, and the relevant Committee shall receive those views for consideration.</text> </subsection></section>
<section id="H8009592EEB1349C4AFA1FDB7C1D1A785"><enum>6.</enum><header>Implementation of trade agreements</header> 
<subsection id="HFA6BA445E49E4739AADD66A8B4F3867B"><enum>(a)</enum><header>In general</header> 
<paragraph id="H1CC80FE097C949948E61855EAA148E61"><enum>(1)</enum><header>Notification and submission</header><text>Any agreement entered into under section 3(b) shall enter into force with respect to the United States if (and only if)—</text> <subparagraph id="HD8A889F3DFB24F60BDB0C17279BB01BC"><enum>(A)</enum><text>the President, at least 90 calendar days before the day on which the President enters into the trade agreement, notifies the House of Representatives and the Senate of the President’s intention to enter into the agreement, and promptly thereafter publishes notice of such intention in the Federal Register;</text> </subparagraph>
<subparagraph id="ide413cd5f15744a83b4b8f9e4852523ff"><enum>(B)</enum><text>the President, at least 60 days before the day on which the President enters into the agreement, publishes the text of the agreement on a publicly available Internet website of the Office of the United States Trade Representative;</text> </subparagraph> <subparagraph id="HE013E36605B54B72B1EED2D57C1DAB5E"><enum>(C)</enum><text>within 60 days after entering into the agreement, the President submits to Congress a description of those changes to existing laws that the President considers would be required in order to bring the United States into compliance with the agreement;</text> </subparagraph>
<subparagraph id="id8ee40d40426f43908050de121422bd73"><enum>(D)</enum><text>the President, at least 30 days before submitting to Congress the materials under subparagraph (E), submits to Congress—</text> <clause id="idB51E04E0BE94404E932F824AF72A77B3"><enum>(i)</enum><text>a draft statement of any administrative action proposed to implement the agreement; and</text> </clause>
<clause id="idA2945C9FD5F54BD0B6C803D979282B18"><enum>(ii)</enum><text>a copy of the final legal text of the agreement;</text> </clause></subparagraph> <subparagraph id="H7B0933D8F22D4165B4526AA2E536A967"><enum>(E)</enum><text>after entering into the agreement, the President submits to Congress, on a day on which both Houses of Congress are in session, a copy of the final legal text of the agreement, together with—</text> 
<clause id="HA14FC09A742345F896A9A0531D11ABD7"><enum>(i)</enum><text>a draft of an implementing bill described in section 3(b)(3);</text> </clause> <clause id="HD3B2B7CCEDCE49389976860C30541603"><enum>(ii)</enum><text>a statement of any administrative action proposed to implement the trade agreement; and</text> </clause>
<clause id="H6A63C848C9C34D14A3469F3903FBD700"><enum>(iii)</enum><text>the supporting information described in paragraph (2)(A);</text> </clause></subparagraph> <subparagraph id="HF771B157BAD04EDEA599A137FE23E669"><enum>(F)</enum><text>the implementing bill is enacted into law; and</text> </subparagraph>
<subparagraph id="HB414C448575143F6AD305942EBC3C24A"><enum>(G)</enum><text>the President, not later than 30 days before the date on which the agreement enters into force with respect to a party to the agreement, submits written notice to Congress that the President has determined that the party has taken measures necessary to comply with those provisions of the agreement that are to take effect on the date on which the agreement enters into force.</text> </subparagraph></paragraph> <paragraph id="HF4FD6ADDCED446428BCB89B2189E5DF2"><enum>(2)</enum><header>Supporting information</header> <subparagraph id="H96A1959C3DC3406FA5BB3EEA4E569865"><enum>(A)</enum><header>In general</header><text>The supporting information required under paragraph (1)(E)(iii) consists of—</text> 
<clause id="H5A12B99200074720B3EC751BF3EB1425"><enum>(i)</enum><text>an explanation as to how the implementing bill and proposed administrative action will change or affect existing law; and</text> </clause> <clause id="HD19330575AD5441B8994E74F8AF4D6E6"><enum>(ii)</enum><text>a statement—</text> 
<subclause id="H50D08E9C5BDD437DB59648A767ECBF47"><enum>(I)</enum><text>asserting that the agreement makes progress in achieving the applicable purposes, policies, priorities, and objectives of this Act; and</text> </subclause> <subclause id="HF5D15486CCC549B695899E7518FD8823"><enum>(II)</enum><text>setting forth the reasons of the President regarding—</text> 
<item id="H81C089857F904BA98E97660998846A8D"><enum>(aa)</enum><text>how and to what extent the agreement makes progress in achieving the applicable purposes, policies, and objectives referred to in subclause (I);</text> </item> <item id="HB0C0C712AF40447C8769736E78A18DCC"><enum>(bb)</enum><text>whether and how the agreement changes provisions of an agreement previously negotiated;</text> </item>
<item id="H56510DEF35BE4DEA9D8A11D19359B719"><enum>(cc)</enum><text>how the agreement serves the interests of United States commerce; and</text> </item> <item id="H67C91348A8E642D9AB14239F871E6A90"><enum>(dd)</enum><text>how the implementing bill meets the standards set forth in section 3(b)(3).</text> </item></subclause></clause></subparagraph>
<subparagraph id="HE6FAEED1CBC44DECAFBC83D51C61F665"><enum>(B)</enum><header>Public availability</header><text>The President shall make the supporting information described in subparagraph (A) available to the public.</text> </subparagraph></paragraph> <paragraph id="H5D6AE865DCC7449992E5765C2D111AEC"><enum>(3)</enum><header>Reciprocal benefits</header><text>In order to ensure that a foreign country that is not a party to a trade agreement entered into under section 3(b) does not receive benefits under the agreement unless the country is also subject to the obligations under the agreement, the implementing bill submitted with respect to the agreement shall provide that the benefits and obligations under the agreement apply only to the parties to the agreement, if such application is consistent with the terms of the agreement. The implementing bill may also provide that the benefits and obligations under the agreement do not apply uniformly to all parties to the agreement, if such application is consistent with the terms of the agreement.</text> </paragraph>
<paragraph id="HFA95008463AC408C9200402DCF27EF9C"><enum>(4)</enum><header>Disclosure of commitments</header><text>Any agreement or other understanding with a foreign government or governments (whether oral or in writing) that—</text> <subparagraph id="HF2313747BC0A41DFB3FCCB8D08EDC46D"><enum>(A)</enum><text>relates to a trade agreement with respect to which Congress enacts an implementing bill under trade authorities procedures; and</text> </subparagraph>
<subparagraph id="H66D005D9918E43148B502477A93907B7"><enum>(B)</enum><text>is not disclosed to Congress before an implementing bill with respect to that agreement is introduced in either House of Congress,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall not be considered to be part of the agreement approved by Congress and shall have no force and effect under United States law or in any dispute settlement body.</continuation-text></paragraph></subsection> <subsection id="H8D53B2CAB5A843EBA59C6B81C6F6132C"><enum>(b)</enum><header>Limitations on trade authorities procedures</header> <paragraph id="HB493127160A446E9AB79743C2E9DD2CD"><enum>(1)</enum><header>For lack of notice or consultations</header> <subparagraph id="HCFB1A89EA96F4EB9B81921D0D18F6EB8"><enum>(A)</enum><header>In general</header><text>The trade authorities procedures shall not apply to any implementing bill submitted with respect to a trade agreement or trade agreements entered into under section 3(b) if during the 60-day period beginning on the date that one House of Congress agrees to a procedural disapproval resolution for lack of notice or consultations with respect to such trade agreement or agreements, the other House separately agrees to a procedural disapproval resolution with respect to such trade agreement or agreements.</text> </subparagraph>
<subparagraph id="HBEE8FC6BC0B34F4198BB3298A118DE41"><enum>(B)</enum><header>Procedural disapproval resolution</header>
<clause commented="no" display-inline="yes-display-inline" id="HCF46ED5FEE7D460882D12BC373C441E5"><enum>(i)</enum><text>For purposes of this paragraph, the term <term>procedural disapproval resolution</term> means a resolution of either House of Congress, the sole matter after the resolving clause of which is as follows: <quote>That the President has failed or refused to notify or consult in accordance with the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title> on negotiations with respect to ________ and, therefore, the trade authorities procedures under that Act shall not apply to any implementing bill submitted with respect to such trade agreement or agreements.</quote>, with the blank space being filled with a description of the trade agreement or agreements with respect to which the President is considered to have failed or refused to notify or consult.</text> </clause> <clause id="H27AD591E08C040C29DE06463ED9D2423" indent="up1"><enum>(ii)</enum><text>For purposes of clause (i) and paragraphs (3)(C) and (4)(C), the President has <quote>failed or refused to notify or consult in accordance with the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title></quote> on negotiations with respect to a trade agreement or trade agreements if—</text> 
<subclause id="H7C79AB25B2D74DD4816AA1EE39625CEB"><enum>(I)</enum><text>the President has failed or refused to consult (as the case may be) in accordance with sections 4 and 5 and this section with respect to the negotiations, agreement, or agreements;</text> </subclause> <subclause id="H6C73732D5C00411CA5E7B1ACFE1B2923"><enum>(II)</enum><text>guidelines under section 4 have not been developed or met with respect to the negotiations, agreement, or agreements;</text> </subclause>
<subclause id="HEF8F98E9865648AD9C6539EED785CD35"><enum>(III)</enum><text>the President has not met with the House Advisory Group on Negotiations or the Senate Advisory Group on Negotiations pursuant to a request made under section 4(c)(4) with respect to the negotiations, agreement, or agreements; or</text> </subclause> <subclause id="H78606CAB0A6B4B2CBBEC34720E248785"><enum>(IV)</enum><text>the agreement or agreements fail to make progress in achieving the purposes, policies, priorities, and objectives of this Act.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="H3F4EF21B48DC438BB65CBCD3D31738C8"><enum>(2)</enum><header>Procedures for considering resolutions</header>
<subparagraph commented="no" display-inline="yes-display-inline" id="H1576F8762B054D71B29B27E04A1CC6BA"><enum>(A)</enum><text>Procedural disapproval resolutions—</text> <clause id="HC90873DC8D274DA993A7433A97FBF000" indent="up1"><enum>(i)</enum><text>in the House of Representatives—</text> 
<subclause id="H6A954C536B004748B68F005FF425D8A5"><enum>(I)</enum><text>may be introduced by any Member of the House;</text> </subclause> <subclause id="HD22A9114B385425E951DE21A1162F4E9"><enum>(II)</enum><text>shall be referred to the Committee on Ways and Means and, in addition, to the Committee on Rules; and</text> </subclause>
<subclause id="H24BEC257E4E0427B8AA25C5C62602C92"><enum>(III)</enum><text>may not be amended by either Committee; and</text> </subclause></clause> <clause id="HE7B8BA0320064955AF2FF096CE5DC7B1" indent="up1"><enum>(ii)</enum><text>in the Senate—</text> 
<subclause id="H5D8563305BA24BF886BD062B19DB59C1"><enum>(I)</enum><text>may be introduced by any Member of the Senate;</text> </subclause> <subclause id="H5727B58ABBC54D4CA9EF866C3A3654EF"><enum>(II)</enum><text>shall be referred to the Committee on Finance; and</text> </subclause>
<subclause id="H8963AC7406664A4BB9B6907DBC981E0C"><enum>(III)</enum><text>may not be amended.</text> </subclause></clause></subparagraph> <subparagraph id="HE13CAA5C42F7432EBE8F6EC8BE1BAA73" indent="up1"><enum>(B)</enum><text>The provisions of subsections (d) and (e) of section 152 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192</external-xref>) (relating to the floor consideration of certain resolutions in the House and Senate) apply to a procedural disapproval resolution introduced with respect to a trade agreement if no other procedural disapproval resolution with respect to that trade agreement has previously been reported in that House of Congress by the Committee on Ways and Means or the Committee on Finance, as the case may be, and if no resolution described in clause (ii) of section 5(b)(3)(B) with respect to that trade agreement has been reported in that House of Congress by the Committee on Ways and Means or the Committee on Finance, as the case may be, pursuant to the procedures set forth in clauses (iii) through (vii) of such section.</text> </subparagraph>
<subparagraph id="HDAE021FA42BF41B08792C14A6255B392" indent="up1"><enum>(C)</enum><text>It is not in order for the House of Representatives to consider any procedural disapproval resolution not reported by the Committee on Ways and Means and, in addition, by the Committee on Rules.</text> </subparagraph> <subparagraph id="HC7784D2977F34E9AB659ED045705CE00" indent="up1"><enum>(D)</enum><text>It is not in order for the Senate to consider any procedural disapproval resolution not reported by the Committee on Finance.</text> </subparagraph></paragraph>
<paragraph id="id742df88dbb83453ea368670a0e2ed4a9"><enum>(3)</enum><header>Consideration in Senate of consultation and compliance resolution to remove trade authorities procedures</header> 
<subparagraph id="id3d5b673b04f24267a712014d7fe0d8bc"><enum>(A)</enum><header>Reporting of resolution</header><text>If, when the Committee on Finance of the Senate meets on whether to report an implementing bill with respect to a trade agreement or agreements entered into under section 3(b), the committee fails to favorably report the bill, the committee shall report a resolution described in subparagraph (C).</text> </subparagraph> <subparagraph id="id8480cc31673f42399a0d8a17c340721e"><enum>(B)</enum><header>Applicability of trade authorities procedures</header><text>The trade authorities procedures shall not apply in the Senate to any implementing bill submitted with respect to a trade agreement or agreements described in subparagraph (A) if the Committee on Finance reports a resolution described in subparagraph (C) and such resolution is agreed to by the Senate.</text> </subparagraph>
<subparagraph id="id5bfcfd38f8d44e39a7df75f56af6e2d8"><enum>(C)</enum><header>Resolution described</header><text>A resolution described in this subparagraph is a resolution of the Senate originating from the Committee on Finance the sole matter after the resolving clause of which is as follows: <quote>That the President has failed or refused to notify or consult in accordance with the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title> on negotiations with respect to _____ and, therefore, the trade authorities procedures under that Act shall not apply in the Senate to any implementing bill submitted with respect to such trade agreement or agreements.</quote>, with the blank space being filled with a description of the trade agreement or agreements described in subparagraph (A).</text> </subparagraph> <subparagraph id="id66757d5bf07a4cd3aded5b26476dbdb2"><enum>(D)</enum><header>Procedures</header><text>If the Senate does not agree to a motion to invoke cloture on the motion to proceed to a resolution described in subparagraph (C), the resolution shall be committed to the Committee on Finance.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H4F705875243A47058E79ACC0AC5574F7"><enum>(4)</enum><header>Consideration in the House of Representatives of a consultation and compliance resolution</header> 
<subparagraph commented="no" id="H6C342F4AB26243DA988292A68D5252BA"><enum>(A)</enum><header>Qualifications for reporting resolution</header><text>If—</text> <clause commented="no" id="HA4E792A546524592A351BC6E91CFD516"><enum>(i)</enum><text>the Committee on Ways and Means of the House of Representatives reports an implementing bill with respect to a trade agreement or agreements entered into under section 3(b) with other than a favorable recommendation; and</text> </clause>
<clause commented="no" id="H06A5D6EF91C84969AB0D5C4ADEB7C4F8"><enum>(ii)</enum><text display-inline="yes-display-inline">a Member of the House of Representatives has introduced a consultation and compliance resolution on the legislative day following the filing of a report to accompany the implementing bill with other than a favorable recommendation,</text> </clause><continuation-text commented="no" continuation-text-level="subparagraph">then the Committee on Ways and Means shall consider a consultation and compliance resolution pursuant to subparagraph (B).</continuation-text></subparagraph> <subparagraph commented="no" id="H3EFBC713396647B8BA29E94C08704234"><enum>(B)</enum><header>Committee consideration of a qualifying resolution</header> <clause commented="no" display-inline="yes-display-inline" id="HEBFB98CFE905451EB06949467665E529"><enum>(i)</enum><text>Not later than the fourth legislative day after the date of introduction of the resolution, the Committee on Ways and Means shall meet to consider a resolution meeting the qualifications set forth in subparagraph (A).</text> </clause>
<clause commented="no" id="H62F27222C10A43E1A7BEB39C3401A358" indent="up1"><enum>(ii)</enum><text>After consideration of one such resolution by the Committee on Ways and Means, this subparagraph shall not apply to any other such resolution.</text> </clause> <clause commented="no" id="HBE3A7304316F4590B894F331D549DBCB" indent="up1"><enum>(iii)</enum><text>If the Committee on Ways and Means has not reported the resolution by the sixth legislative day after the date of its introduction, that committee shall be discharged from further consideration of the resolution.</text> </clause></subparagraph>
<subparagraph commented="no" id="HD3EBFC17B60F4A8583115CFC7A0EBD06"><enum>(C)</enum><header>Consultation and compliance resolution described</header><text>A consultation and compliance resolution—</text> <clause commented="no" id="H75B323C8087F468F89E3498911818450"><enum>(i)</enum><text>is a resolution of the House of Representatives, the sole matter after the resolving clause of which is as follows: <quote>That the President has failed or refused to notify or consult in accordance with the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 on negotiations with respect to _____ and, therefore, the trade authorities procedures under that Act shall not apply in the House of Representatives to any implementing bill submitted with respect to such trade agreement or agreements.</quote>, with the blank space being filled with a description of the trade agreement or agreements described in subparagraph (A); and</text> </clause>
<clause commented="no" id="HB3AD7C8FDCD64150B7EA7B83B7B3CF4F"><enum>(ii)</enum><text>shall be referred to the Committee on Ways and Means.</text> </clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD13634C47804475D9B4CF7C7EEB9FE8E"><enum>(D)</enum><header>Applicability of trade authorities procedures</header><text display-inline="yes-display-inline">The trade authorities procedures shall not apply in the House of Representatives to any implementing bill submitted with respect to a trade agreement or agreements which are the object of a consultation and compliance resolution if such resolution is adopted by the House.</text> </subparagraph></paragraph>
<paragraph id="H4DBE3137699E409DB8768743E0A6530D"><enum>(5)</enum><header>For failure to meet other requirements</header><text>Not later than December 15, 2015, the Secretary of Commerce, in consultation with the Secretary of State, the Secretary of the Treasury, the Attorney General, and the United States Trade Representative, shall transmit to Congress a report setting forth the strategy of the executive branch to address concerns of Congress regarding whether dispute settlement panels and the Appellate Body of the World Trade Organization have added to obligations, or diminished rights, of the United States, as described in section 2(b)(15)(C). Trade authorities procedures shall not apply to any implementing bill with respect to an agreement negotiated under the auspices of the World Trade Organization unless the Secretary of Commerce has issued such report by the deadline specified in this paragraph.</text> </paragraph></subsection> <subsection id="H8336259FA2C2445082F37FB810FAA26D"><enum>(c)</enum><header>Rules of House of Representatives and Senate</header><text>Subsection (b) of this section, section 3(c), and section 5(b)(3) are enacted by Congress—</text> 
<paragraph id="H218044A206A64A30852507F7032C242C"><enum>(1)</enum><text>as an exercise of the rulemaking power of the House of Representatives and the Senate, respectively, and as such are deemed a part of the rules of each House, respectively, and such procedures supersede other rules only to the extent that they are inconsistent with such other rules; and</text> </paragraph> <paragraph id="H1BA2B9EBB96247189005105739ADE811"><enum>(2)</enum><text>with the full recognition of the constitutional right of either House to change the rules (so far as relating to the procedures of that House) at any time, in the same manner, and to the same extent as any other rule of that House.</text> </paragraph></subsection></section>
<section id="HF17F893F1D5348D2BEF05BC4A2785FAE"><enum>7.</enum><header>Treatment of certain trade agreements for which negotiations have already begun</header> 
<subsection id="H3443467EF532445CA3553ED2DA0989B7"><enum>(a)</enum><header>Certain agreements</header><text>Notwithstanding the prenegotiation notification and consultation requirement described in section 5(a), if an agreement to which section 3(b) applies—</text> <paragraph id="HAE545C22E42A4327B00CF77A2796798A"><enum>(1)</enum><text>is entered into under the auspices of the World Trade Organization,</text> </paragraph>
<paragraph id="H511ADA9BC63B4B82A32047126168EB11"><enum>(2)</enum><text>is entered into with the Trans-Pacific Partnership countries with respect to which notifications have been made in a manner consistent with section 5(a)(1)(A) as of the date of the enactment of this Act,</text> </paragraph> <paragraph id="H3A14CC20CB214BC9AC3AC9E9C242C106"><enum>(3)</enum><text>is entered into with the European Union,</text> </paragraph>
<paragraph id="H08B02D9CE2AF4B078C176E73CF58FA01"><enum>(4)</enum><text>is an agreement with respect to international trade in services entered into with WTO members with respect to which a notification has been made in a manner consistent with section 5(a)(1)(A) as of the date of the enactment of this Act, or</text> </paragraph> <paragraph id="idC2768D9987834EE6AB91336BCDF0C2F4"><enum>(5)</enum><text>is an agreement with respect to environmental goods entered into with WTO members with respect to which a notification has been made in a manner consistent with section 5(a)(1)(A) as of the date of the enactment of this Act,</text> </paragraph><continuation-text continuation-text-level="subsection">and results from negotiations that were commenced before the date of the enactment of this Act, subsection (b) shall apply.</continuation-text></subsection>
<subsection commented="no" id="HC24F29D57BB34246810797B71F22035D"><enum>(b)</enum><header>Treatment of agreements</header><text>In the case of any agreement to which subsection (a) applies, the applicability of the trade authorities procedures to implementing bills shall be determined without regard to the requirements of section 5(a) (relating only to notice prior to initiating negotiations), and any resolution under paragraph (1)(B), (3)(C), or (4)(C) of section 6(b) shall not be in order on the basis of a failure or refusal to comply with the provisions of section 5(a), if (and only if) the President, as soon as feasible after the date of the enactment of this Act—</text> <paragraph commented="no" id="H045CCF69CB4644B3B33C7C76A3B95160"><enum>(1)</enum><text>notifies Congress of the negotiations described in subsection (a), the specific United States objectives in the negotiations, and whether the President is seeking a new agreement or changes to an existing agreement; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3FFA6ADE229A482F9D9A906D944C705A"><enum>(2)</enum><text>before and after submission of the notice, consults regarding the negotiations with the committees referred to in section 5(a)(1)(B) and the House and Senate Advisory Groups on Negotiations convened under section 4(c).</text> </paragraph></subsection></section> <section id="H111F24A8C92A48D1AC82E31883671A9F"><enum>8.</enum><header>Sovereignty</header> <subsection id="H342912D26D1F4639A814123291148562"><enum>(a)</enum><header>United States law To prevail in event of conflict</header><text>No provision of any trade agreement entered into under section 3(b), nor the application of any such provision to any person or circumstance, that is inconsistent with any law of the United States, any State of the United States, or any locality of the United States shall have effect.</text> </subsection>
<subsection id="HA7B827B1DE214031A9B1792EB216E3CD"><enum>(b)</enum><header>Amendments or modifications of United States law</header><text display-inline="yes-display-inline">No provision of any trade agreement entered into under section 3(b) shall prevent the United States, any State of the United States, or any locality of the United States from amending or modifying any law of the United States, that State, or that locality (as the case may be).</text> </subsection> <subsection id="HCA3E4D602F7B4A9C91ACD931A833AFAB"><enum>(c)</enum><header>Dispute settlement reports</header><text display-inline="yes-display-inline">Reports, including findings and recommendations, issued by dispute settlement panels convened pursuant to any trade agreement entered into under section 3(b) shall have no binding effect on the law of the United States, the Government of the United States, or the law or government of any State or locality of the United States.</text> </subsection></section>
<section id="H3BCE4BA264B340A4B2C358826F0C1E0C"><enum>9.</enum><header>Interests of small businesses</header> 
<subsection id="H03F1D788101F422AB8CFEB860093221F"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> <paragraph id="H9E9B8C8AA94E4EB8BD6062FAD7B613A6"><enum>(1)</enum><text display-inline="yes-display-inline">the United States Trade Representative should facilitate participation by small businesses in the trade negotiation process; and</text> </paragraph>
<paragraph id="HB70A91CB5C404C97A406644246BCCA81"><enum>(2)</enum><text display-inline="yes-display-inline">the functions of the Office of the United States Trade Representative relating to small businesses should continue to be reflected in the title of the Assistant United States Trade Representative assigned the responsibility for small businesses.</text> </paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H0A2134510E054F40A154970D3C738E30"><enum>(b)</enum><header>Consideration of small business interests</header><text display-inline="yes-display-inline">The Assistant United States Trade Representative for Small Business, Market Access, and Industrial Competitiveness shall be responsible for ensuring that the interests of small businesses are considered in all trade negotiations in accordance with the objective described in section 2(a)(8).</text> </subsection></section>
<section commented="no" id="H0F8624690B1E474F865C92A55ED6D209"><enum>10.</enum><header>Conforming amendments; application of certain provisions</header> 
<subsection commented="no" id="HF8A46B7A38614C77A104A62777D328C7"><enum>(a)</enum><header>Conforming amendments</header> 
<paragraph commented="no" id="H8DE55496568F492FABDE37BA15EAA74A"><enum>(1)</enum><header>Advice from United States International Trade Commission</header><text>Section 131 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2151">19 U.S.C. 2151</external-xref>) is amended—</text> <subparagraph commented="no" id="H6ECF19E43EB44E9F94F24D1264CAEBD3"><enum>(A)</enum><text>in subsection (a)—</text>

<paragraph commented="no" id="HDF026CBA6AF64AE2AE604550763C2131"><enum>(4)</enum><header>Prerequisites for offers</header><text>Section 134 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2154">19 U.S.C. 2154</external-xref>) is amended by striking <quote>section 2103 of the Bipartisan Trade Promotion Authority Act of 2002</quote> each place it appears and inserting <quote>section 3 of the <short-title>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</short-title></quote>.</text> </paragraph> <paragraph commented="no" id="HFF55B7EC952C4FD6999C566896F8AB19"><enum>(5)</enum><header>Information and advice from private and public sectors</header><text>Section 135 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155</external-xref>) is amended—</text>

<subsection commented="no" id="HDED743E173E14BA19B45D43835F1B761"><enum>(b)</enum><header>Application of certain provisions</header><text display-inline="yes-display-inline">For purposes of applying sections 125, 126, and 127 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2135">19 U.S.C. 2135</external-xref>, 2136, and 2137)—</text> <paragraph commented="no" id="HA9A246A3E858420DA943A176C30B7E8E"><enum>(1)</enum><text>any trade agreement entered into under section 3 shall be treated as an agreement entered into under section 101 or 102 of the Trade Act of 1974 (19 U.S.C. 2111 or 2112), as appropriate; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H253EF7894DC04DD397A9E260B87AB719"><enum>(2)</enum><text>any proclamation or Executive order issued pursuant to a trade agreement entered into under section 3 shall be treated as a proclamation or Executive order issued pursuant to a trade agreement entered into under section 102 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2112">19 U.S.C. 2112</external-xref>).</text> </paragraph></subsection></section> <section id="H49529E0334DD4238994DF0151BAD8683"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HFF9552BE7AE14F9E9F5309BA3356E2CE"><enum>(1)</enum><header>Agreement on agriculture</header><text>The term <term>Agreement on Agriculture</term> means the agreement referred to in section 101(d)(2) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(2)</external-xref>).</text> </paragraph> <paragraph id="HCB4DB1A7416B44ACB3555C4DDD282A2D"><enum>(2)</enum><header>Agreement on safeguards</header><text>The term <term>Agreement on Safeguards</term> means the agreement referred to in section 101(d)(13) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(13)</external-xref>).</text> </paragraph>
<paragraph id="H883C8921A5D54D1FA88EB920F5B5B8AB"><enum>(3)</enum><header>Agreement on subsidies and countervailing measures</header><text>The term <term>Agreement on Subsidies and Countervailing Measures</term> means the agreement referred to in section 101(d)(12) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(12)</external-xref>).</text> </paragraph> <paragraph id="H715D282B64BE4FA99F0429E06186EAEC"><enum>(4)</enum><header>Antidumping agreement</header><text>The term <term>Antidumping Agreement</term> means the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 referred to in section 101(d)(7) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(7)</external-xref>).</text> </paragraph>
<paragraph id="H1E8BC7D678514D37AFCCEC3EE82C4582"><enum>(5)</enum><header>Appellate body</header><text>The term <term>Appellate Body</term> means the Appellate Body established under Article 17.1 of the Dispute Settlement Understanding.</text> </paragraph> <paragraph id="H58B5B03048B6483BBD356412A3F22E74"><enum>(6)</enum><header>Common multilateral environmental agreement</header> <subparagraph id="H74570186961243AB8DFC493DF50E5536"><enum>(A)</enum><header>In general</header><text>The term <term>common multilateral environmental agreement</term> means any agreement specified in subparagraph (B) or included under subparagraph (C) to which both the United States and one or more other parties to the negotiations are full parties, including any current or future mutually agreed upon protocols, amendments, annexes, or adjustments to such an agreement.</text> </subparagraph>
<subparagraph id="H9B9194FDCEBB42638A2C9788CE550FD3"><enum>(B)</enum><header>Agreements specified</header><text>The agreements specified in this subparagraph are the following:</text> <clause id="H7F4CB7A6782E49F1B165A53AD2E3842E"><enum>(i)</enum><text>The Convention on International Trade in Endangered Species of Wild Fauna and Flora, done at Washington March 3, 1973 (27 UST 1087; TIAS 8249).</text> </clause>
<clause id="HA5A7CE4DD4704D55B528ABFD893A8C74"><enum>(ii)</enum><text>The Montreal Protocol on Substances that Deplete the Ozone Layer, done at Montreal September 16, 1987.</text> </clause> <clause id="H11976D5CD46841E29126B394967A3F5A"><enum>(iii)</enum><text>The Protocol of 1978 Relating to the International Convention for the Prevention of Pollution from Ships, 1973, done at London February 17, 1978.</text> </clause>
<clause id="H387BBFAD926448A6A15B5C1253ADB2DA"><enum>(iv)</enum><text>The Convention on Wetlands of International Importance Especially as Waterfowl Habitat, done at Ramsar February 2, 1971 (TIAS 11084).</text> </clause> <clause id="H132E0700602E49EF9140A30E821C11E4"><enum>(v)</enum><text>The Convention on the Conservation of Antarctic Marine Living Resources, done at Canberra May 20, 1980 (33 UST 3476).</text> </clause>

<subparagraph id="H3CE22DE6E183427A933F44845E5A8512"><enum>(C)</enum><header>Additional agreements</header><text>Both the United States and one or more other parties to the negotiations may agree to include any other multilateral environmental or conservation agreement to which they are full parties as a common multilateral environmental agreement under this paragraph.</text> </subparagraph></paragraph> <paragraph id="H2AE431EB44044400BB6F7F6E87ACEBF9"><enum>(7)</enum><header>Core labor standards</header><text>The term <term>core labor standards</term> means—</text> 
<subparagraph id="H0C80B4A4B70D418AB66ABADDB93346A1"><enum>(A)</enum><text>freedom of association;</text> </subparagraph> <subparagraph id="H7A20F96986AE40A7B33ADBE0FE05E2D4"><enum>(B)</enum><text>the effective recognition of the right to collective bargaining;</text> </subparagraph>
<subparagraph id="H506A669538A04E76A2B5BFB39295D7E8"><enum>(C)</enum><text>the elimination of all forms of forced or compulsory labor;</text> </subparagraph> <subparagraph id="H6D99775A1EB2474BA3BC276AE86BD1D3"><enum>(D)</enum><text>the effective abolition of child labor and a prohibition on the worst forms of child labor; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF051D8178A794F618840F274443CA540"><enum>(E)</enum><text>the elimination of discrimination in respect of employment and occupation.</text> </subparagraph></paragraph> <paragraph id="H36019AB5071E4A428CD1DD6CA1A3C513"><enum>(8)</enum><header>Dispute settlement understanding</header><text>The term <term>Dispute Settlement Understanding</term> means the Understanding on Rules and Procedures Governing the Settlement of Disputes referred to in section 101(d)(16) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(16)</external-xref>).</text> </paragraph>
<paragraph id="HC9E6057F2B0D4E369D26E330E0672A0C"><enum>(9)</enum><header>Enabling Clause</header><text>The term <term>Enabling Clause</term> means the Decision on Differential and More Favourable Treatment, Reciprocity and Fuller Participation of Developing Countries (L/4903), adopted November 28, 1979, under GATT 1947 (as defined in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>)).</text> </paragraph> <paragraph id="HB1B8B19F0C574BBCA065D4FEBA85AA3E"><enum>(10)</enum><header>Environmental laws</header><text>The term <term>environmental laws</term>, with respect to the laws of the United States, means environmental statutes and regulations enforceable by action of the Federal Government.</text> </paragraph>
<paragraph id="HCA498E77F6ED4A8C8E0D18A3E6044E86"><enum>(11)</enum><header>GATT 1994</header><text>The term <term>GATT 1994</term> has the meaning given that term in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>).</text> </paragraph> <paragraph id="H040DB89AEFFC40BDAC6FB00CB1B46176"><enum>(12)</enum><header>General Agreement on Trade in Services</header><text>The term <term>General Agreement on Trade in Services</term> means the General Agreement on Trade in Services (referred to in section 101(d)(14) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(14)</external-xref>)).</text> </paragraph>
<paragraph id="H06F146586DD7454E857B3091F4499396"><enum>(13)</enum><header>Government procurement agreement</header><text>The term <term>Government Procurement Agreement</term> means the Agreement on Government Procurement referred to in section 101(d)(17) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(17)</external-xref>).</text> </paragraph> <paragraph id="HDDFC2E53EE5C40298F910248C7CC004C"><enum>(14)</enum><header>ILO</header><text>The term <term>ILO</term> means the International Labor Organization.</text> </paragraph>
<paragraph id="H1915BBA4671A47F981873D3C2025D6B4"><enum>(15)</enum><header>Import sensitive agricultural product</header><text>The term <term>import sensitive agricultural product</term> means an agricultural product—</text> <subparagraph id="H4049B2D61E114DC198DECD6828A02D53"><enum>(A)</enum><text>with respect to which, as a result of the Uruguay Round Agreements, the rate of duty was the subject of tariff reductions by the United States and, pursuant to such Agreements, was reduced on January 1, 1995, to a rate that was not less than 97.5 percent of the rate of duty that applied to such article on December 31, 1994; or</text> </subparagraph>
<subparagraph id="H124646F5A85F449980807A8420995A29"><enum>(B)</enum><text>which was subject to a tariff rate quota on the date of the enactment of this Act.</text> </subparagraph></paragraph> <paragraph id="H7D31203FECD8470AA7BCDBF579832DF1"><enum>(16)</enum><header>Information technology agreement</header><text>The term <term>Information Technology Agreement</term> means the Ministerial Declaration on Trade in Information Technology Products of the World Trade Organization, agreed to at Singapore December 13, 1996.</text> </paragraph>
<paragraph id="HFCF17C64148242EB844D2CCCE5890EDC"><enum>(17)</enum><header>Internationally recognized core labor standards</header><text>The term <term>internationally recognized core labor standards</term> means the core labor standards only as stated in the ILO Declaration on Fundamental Principles and Rights at Work and its Follow-Up (1998).</text> </paragraph> <paragraph id="HF750EB8A48844EFC8FF2F5EDCFD62713"><enum>(18)</enum><header>Labor laws</header><text display-inline="yes-display-inline">The term <term>labor laws</term> means the statutes and regulations, or provisions thereof, of a party to the negotiations that are directly related to core labor standards as well as other labor protections for children and minors and acceptable conditions of work with respect to minimum wages, hours of work, and occupational safety and health, and for the United States, includes Federal statutes and regulations addressing those standards, protections, or conditions, but does not include State or local labor laws.</text> </paragraph>
<paragraph id="H7888C1B3440945CF95933E605AAA4C2B"><enum>(19)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="H7884A742F8DC4120BC9EC7581B90EE72"><enum>(A)</enum><text>a United States citizen;</text> </subparagraph>
<subparagraph id="H1DB3B9578A8B4B0C99526178CF6658A5"><enum>(B)</enum><text>a partnership, corporation, or other legal entity that is organized under the laws of the United States; and</text> </subparagraph> <subparagraph id="H94C6FC0EE4D34093BB7C8C4096D31201"><enum>(C)</enum><text>a partnership, corporation, or other legal entity that is organized under the laws of a foreign country and is controlled by entities described in subparagraph (B) or United States citizens, or both.</text> </subparagraph></paragraph>
<paragraph id="HE32248326C3244D18853795769A64334"><enum>(20)</enum><header>Uruguay round agreements</header><text>The term <term>Uruguay Round Agreements</term> has the meaning given that term in section 2(7) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501(7)</external-xref>).</text> </paragraph> <paragraph id="H2AFB18F893BE47649431EE1AE1F20CBE"><enum>(21)</enum><header>World trade organization; WTO</header><text>The terms <term>World Trade Organization</term> and <term>WTO</term> mean the organization established pursuant to the WTO Agreement.</text> </paragraph>
