 <section id="idA740D522BEBE47F1AE245805075C6C58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Albuquerque Indian School Land Transfer Act</short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="HEC6691B61B88493996AD041737AEC266" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id007F30AC029C4D4E85DAAD07A665D210"><enum>(1)</enum><header>19 Pueblos</header><text>The term <term>19 Pueblos</term> means the New Mexico Indian Pueblos of—</text>
 <subparagraph id="id51440c2efa1d4ddf8bcb50d52ea1bce6"><enum>(A)</enum><text>Acoma;</text> </subparagraph><subparagraph id="idf522b2d259a648eab63bc9cff1d91041"><enum>(B)</enum><text>Cochiti;</text>
 </subparagraph><subparagraph id="idb16f244a4d73411590eeaeb5f405c860"><enum>(C)</enum><text>Isleta;</text> </subparagraph><subparagraph id="id54ef96d160e34b1e8e9b8cc2e760a207"><enum>(D)</enum><text>Jemez;</text>

 </subparagraph><subparagraph id="id39d29182694f4c62a478d22b8df72643"><enum>(R)</enum><text>Zia; and</text> </subparagraph><subparagraph id="id50b5d84d4da24d799e5fe0dd592e64c2"><enum>(S)</enum><text>Zuni.</text>
 </subparagraph></paragraph><paragraph id="id4D82210C4F9B4A85A384FCF6D6219075"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>The Town of Albuquerque Grant, Bernalillo County, within Township 10 North, Range 3 East, of the New Mexico Principal Meridian, New Mexico—Metes and Bounds Survey</quote> and dated August 12, 2011.</text>
 </paragraph><paragraph id="idE2BC48B964984849B197EAE274C78903"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means Secretary of the Interior.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idFA5D16E344CD421981B8FA4E05D11B0D" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Land taken into trust for benefit of 19
			 Pueblos</header>
			<subsection commented="no" display-inline="no-display-inline" id="H4B402C78677A4CBC9CF361E4BE175D13"><enum>(a)</enum><header display-inline="yes-display-inline">Action by Secretary</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HA203327A0EF749FE8131ED0037C7D440"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall take into trust all right, title, and interest of the United States in and to the Federal land described in subsection (b) for the benefit of the 19 Pueblos immediately after the Secretary determines that the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) have been satisfied regarding the trust acquisition of the Federal land.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H940D2B9CF01C4C80BF833BE55997764C"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H50F5DC57DF1644C9B0831E68F13DE1DB"><enum>(A)</enum><text display-inline="yes-display-inline">take such action as the Secretary determines to be necessary to document the transfer under paragraph (1); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4C641B556F5F404AACF21534E9CB0389"><enum>(B)</enum><text display-inline="yes-display-inline">appropriately assign each applicable private and municipal utility and service right or agreement.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H68682F12ECFC400B8D3C35DE2F82E8F2"><enum>(b)</enum><header display-inline="yes-display-inline">Description of land</header><text display-inline="yes-display-inline">The Federal land referred to in subsection (a)(1) is the 4 tracts of Federal land, the combined acreage of which is approximately 11.11 acres, that were historically part of the Albuquerque Indian School, more particularly described as follows:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HBA1D406B35B548E0B9F995B3DBF1833"><enum>(1)</enum><header display-inline="yes-display-inline">Abandoned Indian School
 Road</header><text>The approximately 0.83 acres located in sec. 7 and sec. 8 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FB2431018154D42A54BF484DEE6ABC2"><enum>(2)</enum><header display-inline="yes-display-inline">Southern part tract D</header><text>The approximately 6.18 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id484D6C92A91A421684C9719E59CB3DDB"><enum>(3)</enum><header display-inline="yes-display-inline">Tract 1</header><text display-inline="yes-display-inline">The approximately 0.41 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45A8A320C15F42189BC224925BE6612E"><enum>(4)</enum><header>Western part
 tract B</header><text>The approximately 3.69 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB7E60750CB6C45EA94FFB606B1425C3"><enum>(c)</enum><header display-inline="yes-display-inline">Survey</header><text display-inline="yes-display-inline">The Secretary shall conduct a survey of the Federal land to be transferred consistent with subsection (b) and may make minor corrections to the survey and legal description of the Federal land described in subsection (b) as the Secretary determines to be necessary to correct clerical, typographical, and surveying errors.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H97E3A69F48674AD88B4824FEF6A2F15"><enum>(d)</enum><header display-inline="yes-display-inline">Use of land</header><text display-inline="yes-display-inline">The Federal land taken into trust under subsection (a) shall be used for the educational, health, cultural, business, and economic development of the 19 Pueblos.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HD961A3E50905482B9EDBF47FB0E05D38"><enum>(e)</enum><header display-inline="yes-display-inline">Limitations and conditions</header><text display-inline="yes-display-inline">The Federal land taken into trust under subsection (a) shall remain subject to any private or municipal encumbrance, right-of-way, restriction, easement of record, or utility service agreement in effect on the date of enactment of this Act.</text>
			</subsection><subsection id="id3d3ec6e8a15d43219b84d616e662fe6a"><enum>(f)</enum><header>Bureau of Indian Affairs use</header>
 <paragraph id="id9D9EA3CEB11945969649386777CD3778"><enum>(1)</enum><header>In general</header><text>The 19 Pueblos shall allow the Bureau of Indian Affairs to continue to use the land taken into trust under subsection (a) for the facilities and purposes as in existence on the date of enactment of this Act, in accordance with paragraph (2).</text>
 </paragraph><paragraph id="id5B1CD99FA32C4772B05227ED290A6B6B"><enum>(2)</enum><header>Requirements</header><text>The use by the Bureau of Indian Affairs under paragraph (1) shall—</text> <subparagraph id="idCCF9F7D7D08E4C2B8D8DE8FBF6789362"><enum>(A)</enum><text>be free of any rental charge; and</text>
 </subparagraph><subparagraph id="idB83C6425BFEB4B1E8A145B8C296F79A1"><enum>(B)</enum><text>continue until such time as the Secretary determines there is no further need for the existing Bureau of Indian Affairs facilities.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H5588236ECEA349F48E83003650B7C93D" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Effect of other laws</header>
 <subsection commented="no" display-inline="no-display-inline" id="HB2BA6B186F3946A6B6D0326B09F5AFE9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), Federal land taken into trust under section 3(a) shall be subject to Federal laws relating to Indian land.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H3BE07194A3BB450CB6427B05EE1E720"><enum>(b)</enum><header display-inline="yes-display-inline">Gaming</header><text display-inline="yes-display-inline">No class I gaming, class II gaming, or class III gaming (as defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)) shall be carried out on the Federal land taken into trust under section 3(a).</text></subsection></section></legis-body></bill>
