		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America Star Act</short-title></quote>.</text>
 </section><section id="id5F6275AC31CF4119A74562C357C70C37"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id7FB705220A93418A843BEF7AEC64BDBD"><enum>(1)</enum><header>America Star company</header><text>The term <term>America Star company</term> means a participating company that is designated as an America Star company under section 3(e).</text>
 </paragraph><paragraph id="id220C9EFA49034B55B9ABB82D12B1A4E4"><enum>(2)</enum><header>America Star program</header><text>The term <term>America Star program</term> means the voluntary program established under this Act.</text> </paragraph><paragraph id="id00E2FD3BEF134F5CB1AE3F54FA5334DA"><enum>(3)</enum><header>Applicant company</header><text>The term <term>applicant company</term> means a company that applies for designation as an America Star company.</text>
 </paragraph><paragraph id="id5258E59379BB4C4681BFB8F867A70C18"><enum>(4)</enum><header>Participating company</header><text>The term <term>participating company</term> means an applicant company that—</text> <subparagraph id="idE8EDEFAEC40C476895B476B7CBE6F526"><enum>(A)</enum><text>meets the application requirements set forth by the Secretary under section 3(b)(1); and</text>
 </subparagraph><subparagraph id="idC3B206D5B7264CB388704FD57DD23E15"><enum>(B)</enum><text>is not ineligible under section 3(b)(2) for participation in the America Star program.</text> </subparagraph></paragraph><paragraph id="id60B4D824E0234730B1056592817DE0CA"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text>
 </paragraph><paragraph id="id80F5869D8DF54E4899F3D01523E62DD6"><enum>(6)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text> </paragraph></section><section id="id0AF797AD8A974363A34EB5F86586A152"><enum>3.</enum><header>America Star program</header> <subsection id="id63FA3C85A223409BBB92D2C02D47D180"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish, within the Department of Labor, a voluntary program to be known as the <quote>America Star program</quote> to annually designate participating companies as America Star companies based on their support for the workforce of the United States during the previous calendar year.</text>
			</subsection><subsection id="id6EE54915838C4AB0BB7F9370085A677E"><enum>(b)</enum><header>Application process</header>
 <paragraph id="id33010B622F6A4E8FA689ECFDCC795A46"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish procedures for companies seeking a designation under this Act to apply for participation in the America Star program for a calendar year, including a deadline for companies to apply for such participation.</text>
 </paragraph><paragraph id="id6E5A65C327824A739890CEC7B3A2E21E"><enum>(2)</enum><header>Ineligibility</header><text>A company shall be ineligible to participate in the America Star program if—</text> <subparagraph id="id9451A1FDEDDD4634964A5023C8019CF7"><enum>(A)</enum><text>the Secretary has determined that such company has committed a serious, repeated, or willful violation, as described in paragraph (3), of a provision under—</text>
 <clause id="id754CABAA1CC442D6AE67B1F0A42DF9E1"><enum>(i)</enum><text>the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>);</text> </clause><clause id="idE9D798CF54864953B2BCF003D520AB74"><enum>(ii)</enum><text>the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>);</text>
 </clause><clause id="id24CB24B680B04B7EBFA9F0F8F326695D"><enum>(iii)</enum><text>the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>);</text> </clause><clause id="id7439F97901AC4F879515D488C5DD97E7"><enum>(iv)</enum><text>the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>);</text>
 </clause><clause id="idF8EED0B9AEFE49C8B027EDAB1BA70CCB"><enum>(v)</enum><text>the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>);</text> </clause><clause id="idCB2BBFF408F74E5E96AA6A113450D706"><enum>(vi)</enum><text>the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/621">29 U.S.C. 621 et seq.</external-xref>); or</text>
 </clause><clause id="idD4DDBFB2859A4FECBF148CE9446B9AFE"><enum>(vii)</enum><text>title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>); or</text> </clause></subparagraph><subparagraph id="idDB9B66E107A14BA0A10DEB564035FFEC"><enum>(B)</enum><text>there is evidence that such company has substantially outsourced, as defined by the Secretary, jobs in the United States to another country during the previous 5 calendar years.</text>
					</subparagraph></paragraph><paragraph id="idB38C9995D1894F56A3B1D022F94DD3B1"><enum>(3)</enum><header>Serious, repeated, or willful violation</header>
 <subparagraph id="idA2E09350C514483896AC217B82DFF7A9"><enum>(A)</enum><header>Serious</header><text>For the purpose of determining whether a violation is serious under paragraph (2)(A), the Secretary shall, with respect to each of the previous 3 calendar years, consider—</text>
 <clause id="idE1B36769CDB949B6B6C96A0886EF3B99"><enum>(i)</enum><text>the number of employees of such company affected by the violation;</text> </clause><clause id="id5040B92A733048C48F14AE07D4FB527A"><enum>(ii)</enum><text>the degree of risk posed or actual harm caused by the violation to the health, safety, or well-being of an employee of such company;</text>
 </clause><clause id="idFCFB407F75EE4BE1A8B7CDCEE2FA5CB4"><enum>(iii)</enum><text>the amount of damages incurred or fines or penalties assessed on account of the violation; and</text> </clause><clause id="id0B2E7102591047F3BFE3804C2A5609E0"><enum>(iv)</enum><text>any other consideration the Secretary determines appropriate.</text>
 </clause></subparagraph><subparagraph id="id2CF67F0E35BD4DCD906FBBC073FDF5BD"><enum>(B)</enum><header>Repeated</header><text>For the purpose of determining whether a violation is repeated under paragraph (2)(A), the Secretary shall consider whether such company has had 1 or more additional violations of the same, or a substantially similar, requirement during any of the previous 3 calendar years.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79A1785D14B34073B814D28B4801A4D9"><enum>(C)</enum><header display-inline="yes-display-inline">Willful</header><text display-inline="yes-display-inline">For the purpose of determining whether a violation is willful under paragraph (2)(A), the Secretary shall consider whether such company knew of, showed reckless disregard for, or acted with plain indifference as to whether the conduct of such company was prohibited by any of the laws listed in paragraph (2)(A) during any of the previous 3 calendar years.</text>
 </subparagraph></paragraph></subsection><subsection id="idF9CDDE112C864AC983E665B1DEC355F7"><enum>(c)</enum><header>Classification groups</header><text>The Secretary shall place each applicant company that meets the requirements under subsection (b) into a classification group based on size and industry.</text>
			</subsection><subsection id="idE7A864C92C9B442CA7D9E02470595161"><enum>(d)</enum><header>Scoring system</header>
 <paragraph id="id22D54899390B4B49A8864A43F73AE723"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with any other relevant Federal agency as determined by the Secretary, shall develop a system to score participating companies based on their performance, during the previous calendar year, in the categories described in paragraph (2), compared to other participating companies within the classification group of such company as determined under subsection (c).</text>
				</paragraph><paragraph id="id1C27CB325C1941A59D641011385B6D22"><enum>(2)</enum><header>Categories</header>
 <subparagraph id="id52E6863259334BB09801632EB95312FB"><enum>(A)</enum><header>In general</header><text>The score that a participating company receives for such company's performance during the previous calendar year shall be based on the following categories:</text>
 <clause id="id13C085E7AAC748CF85A7FA997E4CE709"><enum>(i)</enum><header>Wages</header><text>The ratio of the total annual compensation, including benefits, of the employee receiving the greatest compensation at such participating company compared to the median total annual compensation, including benefits, of all employees at such company, with a higher score for participating companies with a lower such ratio.</text>
 </clause><clause id="id704AE78716A94312BE8319A092CA93C2"><enum>(ii)</enum><header>Made in USA</header><text>The percentage of the products manufactured or sold by such participating company that meet the standards of the Federal Trade Commission for labeling as <quote>Made in USA</quote>, with a higher score for participating companies with a higher such percentage.</text>
 </clause><clause id="idBE573891B29A4F99A96D5B6E034FD9C2"><enum>(iii)</enum><header>Veterans</header><text>The use of veterans employment initiatives to promote employment opportunities at such participating company for veterans, with a higher score for participating companies utilizing more robust initiatives as determined by the Secretary. Such initiatives may include—</text>
 <subclause id="idF84A046B4CD743269286F472A57B65E3"><enum>(I)</enum><text>veterans recruitment and hiring programs;</text> </subclause><subclause id="id9FF4AAFF5ED04913A44FF7F0B662E70C"><enum>(II)</enum><text>job training and counseling programs for veterans;</text>
 </subclause><subclause id="idcc69a4ca8bbb42fd88dcef8095099cda"><enum>(III)</enum><text>internal education programs, for human resources or hiring staff, on the skills veterans attain from serving as veterans and the positive roles veterans can play at such participating company; and</text>
 </subclause><subclause id="idd30e4b6322e34f8eb852d5d3362d65ee"><enum>(IV)</enum><text>mentorship programs involving veterans working at such participating company and unemployed veterans.</text>
 </subclause></clause><clause id="id6F86F1AC16B14BB3BB21E73BEF49F481"><enum>(iv)</enum><header>Additional categories</header><text>For any classification group determined appropriate by the Secretary, the Secretary may add any additional category that such Secretary determines to be representative of overall positive treatment of workers in the United States, including—</text>
 <subclause id="idA76F5EB3B15E430DA4B4E63CAB2C86AA"><enum>(I)</enum><text>the implementation and use of initiatives or practices to promote diversity and employment of women;</text>
 </subclause><subclause id="id3ACEB5387E274AA58B5037A435F6812E"><enum>(II)</enum><text>the demonstration of pay parity for men and women of equivalent levels of employment performing equivalent work; and</text>
 </subclause><subclause id="id06392910FECD4ADE946DD82998CB4249"><enum>(III)</enum><text>the implementation of worker support programs, including—</text> <item id="id013EF4E73B1B4C78828A8F4625C2637D"><enum>(aa)</enum><text>retirement plans;</text>
 </item><item id="id429973003B374C838059014C9E84449A"><enum>(bb)</enum><text>paid family and medical leave insurance;</text> </item><item id="id023ADAA58D7849CC992A51BD8908A1A8"><enum>(cc)</enum><text>development programs, such as job training courses or assistance with attaining a higher education degree; and</text>
 </item><item id="id97C06B4A6CCD45EB89742D98D6CD3FA8"><enum>(dd)</enum><text>work schedule flexibility.</text> </item></subclause></clause></subparagraph><subparagraph id="idD9F59BAC9EB647A28045B4B5157F21D8"><enum>(B)</enum><header>Priority of categories</header><text>In scoring each participating company, the Secretary shall weigh the categories described in subparagraph (A) by offering the greatest number of points for performance under clauses (i), (ii), and (iii) of such subparagraph, with performance under each such clause receiving an equal weight, and the least number of points for performance under clause (iv) of such subparagraph.</text>
					</subparagraph></paragraph></subsection><subsection id="id012289DE92C7481E894BA928BB0CCFBE"><enum>(e)</enum><header>America Star designation</header>
 <paragraph id="id492027594C104BE1BB21A643298C1DD0"><enum>(1)</enum><header>In general</header><text>Upon scoring each participating company, the Secretary shall, if appropriate, designate participating companies, within each classification group receiving the highest, or relatively high, scores or otherwise demonstrating exceptional support for workers in the United States based on performance in the categories under subsection (d)(2).</text>
 </paragraph><paragraph id="idA1DFD714FE1F45A898AB3D6CD53E6C31"><enum>(2)</enum><header>Number of designations</header><text>For each calendar year, the Secretary shall determine the number of participating companies to designate as America Star companies within each classification group determined under subsection (c).</text>
 </paragraph><paragraph id="id4930D0693ACF48CAB4893EDDA1DFB216"><enum>(3)</enum><header>Deadline</header><text>On Labor Day of each calendar year, the Secretary shall announce the companies to be designated as America Star companies.</text>
				</paragraph></subsection><subsection commented="no" id="idA7169AD622914B9085CFFBE955491485"><enum>(f)</enum><header>Marketing; advertising</header>
 <paragraph commented="no" id="id590FFF246C834CBBA99FCA5A5CE0B7A9"><enum>(1)</enum><header>Program</header><text>The Secretary shall annually market the America Star program through a webpage, on the website of the Department of Labor, that includes—</text>
 <subparagraph commented="no" id="id8BDB87E30825469AB8273A14630ADA1B"><enum>(A)</enum><text>general information describing the America Star program;</text> </subparagraph><subparagraph commented="no" id="idE6CBA271E6E643B59D0A32484804E88E"><enum>(B)</enum><text>the relevant information for applying to such program, including the application process, the ineligibility criteria, any deadlines under subsection (b), and how to submit such application; and</text>
					</subparagraph><subparagraph commented="no" id="id5DCD7BFABE4041A8B5A7AA980E9690F6"><enum>(C)</enum>
 <text>a list of companies designated under subsection (e) as America Star companies for each previous calendar year.</text>
					</subparagraph></paragraph><paragraph commented="no" id="idB07E268175724131A0369B88F246607E"><enum>(2)</enum><header>Awards</header>
 <subparagraph commented="no" id="id2A51D6D59EAC4E46BE8A1BDA8E58028B"><enum>(A)</enum><header>In general</header><text>The Secretary shall design a label for designation as an America Star company.</text> </subparagraph><subparagraph commented="no" id="idA6A7602CFB7D4E7A8DE697D40EBD02AC"><enum>(B)</enum><header>Permissible uses</header><text>An America Star company may, subject to subparagraph (C)(i), use a label designed under subparagraph (A) for advertising purposes by displaying such label next to the logo for such company.</text>
					</subparagraph><subparagraph commented="no" id="id57FA6CFA00DC4F43B3D5CA5259B956D3"><enum>(C)</enum><header>Impermissible uses</header>
 <clause commented="no" id="id4E5E68DC4410455D85EC3C155F8F4FC7"><enum>(i)</enum><header>Recipient companies</header><text>An America Star company may not use a label designed under subparagraph (A) to advertise a specific product.</text>
 </clause><clause commented="no" id="idEEDB7D3C41A449A1ABD10C536091C64A"><enum>(ii)</enum><header>Nonrecipient companies</header><text>A company that is not designated as an America Star company under subsection (e) may not use a label designed under subparagraph (A) for any purpose.</text>
						</clause></subparagraph></paragraph><paragraph id="id962A65EA841A4FBEBD25C78470D23AF3"><enum>(3)</enum><header>Enforcement by Federal Trade Commission</header>
 <subparagraph id="id2E3FC6D917D44230AD6AAEB774939E02"><enum>(A)</enum><header>Unfair or deceptive act or practice</header><text>A violation of paragraph (2)(C)(ii) shall be treated as a violation of a rule defining an unfair or deceptive act or practice described under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text>
					</subparagraph><subparagraph id="idDDB1BAFCFE964C27903F88B49EED055A"><enum>(B)</enum><header>Powers of Commission</header>
 <clause id="id9D17A8E586E04D96A1BCEE76EC8A6E0E"><enum>(i)</enum><header>In general</header><text>The Federal Trade Commission shall enforce this subsection in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this subsection.</text>
 </clause><clause id="id3b20dd73626544288956e97c870f081b"><enum>(ii)</enum><header>Privileges and immunities</header><text>Any person who violates this subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text>
 </clause><clause id="id2b6ff4be676947b29093077589ceb2a8"><enum>(iii)</enum><header>Rulemaking</header><text>The Federal Trade Commission may promulgate standards and rules to carry out this subsection in accordance with section 553 of title 5, United States Code.</text></clause></subparagraph></paragraph></subsection></section></legis-body>
