		<official-title>To require auto dealers to fix outstanding safety recalls before selling or leasing a used
			 passenger motor vehicle.</official-title>

 <section id="id88F6E2880C3C49608687A30BF398A602" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Used Car Safety Recall Repair Act</short-title></quote>.</text> </section><section id="idAD5E1D8396FF450F9DC99F42D753A2D5" section-type="subsequent-section"><enum>2.</enum><header>Used passenger motor vehicle consumer protection</header><text display-inline="no-display-inline">Section 30120 of title 49, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id1515B0739DC8413CB9D297E3887FF58F" style="OLC">
 <subsection id="id46AAB668C6424D39B7776979D2AE9D2B"><enum>(k)</enum><header>Limitation on Sale or Lease of Used Passenger Motor Vehicles</header><paragraph commented="no" display-inline="yes-display-inline" id="idC39C20857B4148A38027D924F7230C26"><enum>(1)</enum><text>A dealer may not sell or lease a used passenger motor vehicle until any defect or noncompliance determined under section 30118 with respect to the vehicle has been remedied.</text>
 </paragraph><paragraph id="id90BF2C9664A44B26B36F25DD061CDAE4" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply if—</text> <subparagraph id="id56F2379C369545E49A6C8FE5BF908876"><enum>(A)</enum><text>the recall information regarding a used passenger motor vehicle was not accessible at the time of sale or lease using the means established by the Secretary under section 31301 of the Moving Ahead for Progress in the 21st Century Act (<external-xref legal-doc="usc" parsable-cite="usc/49/30166">49 U.S.C. 30166</external-xref> note); or</text>
 </subparagraph><subparagraph id="idC4AD8A8821744C1981907E3FE73C942D"><enum>(B)</enum><text>notification of the defect or noncompliance is required under section 30118(b), but enforcement of the order is set aside in a civil action to which 30121(d) applies.</text>
 </subparagraph></paragraph><paragraph id="idAB2702EE3C984075913AA2344B5E8B71" indent="up1"><enum>(3)</enum><text>Notwithstanding section 30102(a)(1), in this subsection—</text> <subparagraph id="id1A380A84E4DC4741A12B42ADC32397B7"><enum>(A)</enum><text>the term <term>dealer</term> means a person that has sold at least 10 motor vehicles to 1 or more consumers during the most recent 12-month period; and</text>
 </subparagraph><subparagraph id="id7B2019D5F2A24422818FE49CA0B67415"><enum>(B)</enum><text>the term <term>used passenger motor vehicle</term> means a motor vehicle that has previously been purchased other than for resale.</text> </subparagraph></paragraph><paragraph id="idD62BE0BA0BC34105BAE79990F7E70EAB" indent="up1"><enum>(4)</enum><text>By rule, the Secretary may exempt the auctioning of a used passenger motor vehicle from the requirements under paragraph (1) to the extent that the exemption does not harm public safety.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" display-inline="no-display-inline" id="id516D774C541048FA8416CC1AA7239496"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on that date that is 18 months after the date of the enactment of this Act.</text>
