 title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnant Women Health and Safety Act</short-title></quote>.</text></section><section id="id603D0CBE4EE7450C9F874DCBC5166F54"><enum>2.</enum><header>Requirement for
 physicians relating to the performance of abortions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idFCD8ED1164C54B34AF1192510EB619E9" style="USC"><section id="IDDFFB0B5238FA417999D0866194AA95FB"><enum>1532.</enum><header>Prohibition
 on certain procedures</header><subsection id="id280A4C2815614DEEB310EB84616D24C0"><enum>(a)</enum><header>Definition</header><text>As used in this section, the term <term>physician</term> means a doctor of medicine or osteopathy legally authorized to practice medicine and surgery by the State in which the doctor performs such activity, or any other individual legally authorized by the State to perform abortions.</text></subsection><subsection id="idD88F9B59D4EE4F58ADD0AB9A817E4B20"><enum>(b)</enum><header>Offense</header><text>A physician who, in or affecting interstate or foreign commerce, knowingly performs an abortion and, in doing so, fails to comply with subsection (c), shall be fined under this title or imprisoned not more than 2 years, or both.</text></subsection><subsection id="idD0B3A3C89B734818ACFF08908B5B3232"><enum>(c)</enum><header>Requirements</header><text>A physician who performs an abortion shall—</text><paragraph id="idB48E054BA5E84F138854A3CFF05C07DC"><enum>(1)</enum><text>have admitting privileges at a hospital to which the physician can travel in one hour or less (determined on the basis of starting at the principal medical office of the physician and traveling to the hospital) and under the average conditions of travel for the physician; and</text></paragraph><paragraph id="ID84438019f4804eaf80d5ca245aecc68a"><enum>(2)</enum><text>at the time of the abortion, notify the patient involved of the hospital location where the patient can receive follow-up care by the physician if complications resulting from the abortion arise.</text></paragraph></subsection><subsection id="idDA143B6967EC4668AF3F7638C6D18CC7"><enum>(d)</enum><header>Applicability</header><text>This section—</text><paragraph id="id21A432B19DDA40A68F31B89C3955A7A8"><enum>(1)</enum><text>shall not apply to an abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself; and</text></paragraph><paragraph id="idC40012A514DB450EBF7F3F26E56B9922"><enum>(2)</enum><text>shall apply to any individual who is not a physician or not otherwise legally authorized by the State to perform abortions, but who nevertheless directly performs an abortion.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9F2204CAD9A34F4EB2884B697E2822B0"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">A woman upon whom a procedure described in subsection (b) is performed may not be prosecuted under this section, for a conspiracy to violate this section, or for an offense under section 2, 3, or 4 of this title based on a violation of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2AA661F7D53C41429633A18B23969E2E"><enum>3.</enum><header>Requirement of
			 abortion clinics</header><subsection id="idE30B95FB91C94428BA9312C269B449F2"><enum>(a)</enum><header>In
 general</header><text>Each abortion clinic that receives any Federal funds or assistance shall—</text><paragraph id="idB34FCF2E6BD042888611515A2F7061F2"><enum>(1)</enum><text>be licensed by the State in which it is located; and</text></paragraph><paragraph id="idAD3AD36757A448F8BAD1AF5244315265"><enum>(2)</enum><text>be in compliance with the requirements existing on the date of enactment of this Act for ambulatory surgery centers under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>), except for any requirement relating to a certificate of public need for State licensing purposes.</text></paragraph></subsection><subsection id="id5EB9EED14EB647E5A9DFB80D34CCD4FF"><enum>(b)</enum><header>Waiver</header><text>For purposes of complying with subsection (a)(2) with respect to an abortion clinic, a State board of health may waive the application of certain structural requirements (as determined appropriate by the Secretary of Health and Human Services).</text></subsection><subsection id="idCA00BA39F3504F56889EA2551FF20DEC"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>abortion clinic</term> means a facility other than a hospital or an ambulatory surgery center, in which 25 or more first trimester abortions are performed during any 12-month period.</text></subsection></section></legis-body></bill>
