	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="idfd563753-7aff-4161-9cd1-77b64c1ba8ca" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Driver Privacy Act of 2015</short-title></quote>.</text> </section><section id="id043f5bbd-dc0e-4e10-8017-1c67956ed1fe" section-type="subsequent-section"><enum>2.</enum><header>Limitations on data retrieval from vehicle event data recorders</header> <subsection commented="no" display-inline="no-display-inline" id="idef7a2629-7219-414c-b2f3-9b85e2e88551"><enum>(a)</enum><header display-inline="yes-display-inline">Ownership of data</header><text display-inline="yes-display-inline">Any data retained by an event data recorder (as defined in section 563.5 of title 49, Code of Federal Regulations), regardless of when the motor vehicle in which it is installed was manufactured, is the property of the owner, or, in the case of a leased vehicle, the lessee of the motor vehicle in which the event data recorder is installed.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="iddc012606-0a26-4a61-b3d1-ea47253ed8eb"><enum>(b)</enum><header display-inline="yes-display-inline">Privacy</header><text display-inline="yes-display-inline">Data recorded or transmitted by an event data recorder described in subsection (a) may not be accessed by a person other than an owner or a lessee of the motor vehicle in which the event data recorder is installed unless—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idfa7cf92e-2145-4655-b1f9-7971750e56d1"><enum>(1)</enum><text display-inline="yes-display-inline">a court or other judicial or administrative authority having jurisdiction—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3cf3f0a7-697c-4610-b992-45c99b60de38"><enum>(A)</enum><text display-inline="yes-display-inline">authorizes the retrieval of the data; and</text>
 </subparagraph><subparagraph id="idce405687-4b2c-4d67-82f1-014325f64463"><enum>(B)</enum><text>to the extent that there is retrieved data, the data is subject to the standards for admission into evidence required by that court or other administrative authority;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id552b5484-cafc-4da5-b0ee-33dd29afdad9"><enum>(2)</enum><text display-inline="yes-display-inline">an owner or a lessee of the motor vehicle provides written, electronic, or recorded audio consent to the retrieval of the data for any purpose, including the purpose of diagnosing, servicing, or repairing the motor vehicle, or by agreeing to a subscription that describes how data will be retrieved and used;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67c03671-1d06-496b-b972-ec9c9157f1a8"><enum>(3)</enum><text display-inline="yes-display-inline">the data is retrieved pursuant to an investigation or inspection authorized under section 1131(a) or 30166 of title 49, United States Code, and the personally identifiable information of an owner or a lessee of the vehicle and the vehicle identification number is not disclosed in connection with the retrieved data, except that the vehicle identification number may be disclosed to the certifying manufacturer;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc263e30-c435-4c51-8937-937eb352b4e7"><enum>(4)</enum><text display-inline="yes-display-inline">the data is retrieved for the purpose of determining the need for, or facilitating, emergency medical response in response to a motor vehicle crash; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48c7fe84-833b-46f9-8b62-0cc4a2d971e9"><enum>(5)</enum><text display-inline="yes-display-inline">the data is retrieved for traffic safety research, and the personally identifiable information of an owner or a lessee of the vehicle and the vehicle identification number is not disclosed in connection with the retrieved data.</text>
				</paragraph></subsection></section><section id="idf1a8ff01-fa16-45fc-98cf-24ba066897f0" section-type="subsequent-section"><enum>3.</enum><header>Vehicle event data recorder study</header>
 <subsection commented="no" display-inline="no-display-inline" id="ided81001d-9fd1-4c13-8e48-565da6ba1ca4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Administrator of the National Highway Traffic Safety Administration shall submit to Congress a report that contains the results of a study conducted by the Administrator to determine the amount of time event data recorders installed in passenger motor vehicles should capture and record for retrieval vehicle-related data in conjunction with an event in order to provide sufficient information to investigate the cause of motor vehicle crashes.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id15c6731c-8402-46af-ba4b-c32bbb2d4d72"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 2 years after submitting the report required under subsection (a), the Administrator shall promulgate regulations to establish the appropriate period during which event data recorders installed in passenger motor vehicles may capture and record for retrieval vehicle-related data to the time necessary to provide accident investigators with vehicle-related information pertinent to crashes involving such motor vehicles.</text></subsection></section></legis-body></bill>
