 </section><section commented="no" display-inline="no-display-inline" id="id9ad6c373f3fd44b3819b45b5a8b19688" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" display-inline="no-display-inline" id="id7911fd65ce084ae385699ee0c08f6980"><enum>(1)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 3502 of title 44, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b1a48cd17ba422f98aa745056575a58"><enum>(2)</enum><header display-inline="yes-display-inline">Antitrust laws</header><text display-inline="yes-display-inline">The term <term>antitrust laws</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idc3da4df80b934190b5ee9de137e98984"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 1 of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12</external-xref>);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fa842a0015f461fb591330c423aac91"><enum>(B)</enum><text display-inline="yes-display-inline">includes section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) to the extent that section 5 of that Act applies to unfair methods of competition; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25203abac7d0401389183dac69df376d"><enum>(C)</enum><text display-inline="yes-display-inline">includes any State law that has the same intent and effect as the laws under subparagraphs (A) and (B).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73d59805f1de41f2983959af41913db8"><enum>(3)</enum><header display-inline="yes-display-inline">Appropriate Federal entities</header><text display-inline="yes-display-inline">The term <term>appropriate Federal entities</term> means the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="idF2B782B5CA5444B18DB0BA1AA1D5EF0B"><enum>(A)</enum><text display-inline="yes-display-inline">The Department of Commerce.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id168A3396E35C401388D0E7DC6120A196"><enum>(B)</enum><text display-inline="yes-display-inline">The Department of Defense.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB18405C9B6E64BEAB6C544ADCC279E57"><enum>(C)</enum><text display-inline="yes-display-inline">The Department of Energy.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id722BF882414B4583B6C3936BB661A0FB"><enum>(D)</enum><text display-inline="yes-display-inline">The Department of Homeland Security.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63DD26950DE34A82A15FD96C6256EE19"><enum>(E)</enum><text display-inline="yes-display-inline">The Department of Justice.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id638639FC6F944B4AB1E96A2856B3826B"><enum>(F)</enum><text display-inline="yes-display-inline">The Department of the Treasury.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8905AE36D3BB4022B7C5D89803ED5818"><enum>(G)</enum><text display-inline="yes-display-inline">The Office of the Director of National Intelligence.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f2156fd7ef24e388e053ee6abb27400"><enum>(4)</enum><header display-inline="yes-display-inline">Cybersecurity purpose</header><text display-inline="yes-display-inline">The term <term>cybersecurity purpose</term> means the purpose of protecting an information system or information that is stored on, processed by, or transiting an information system from a cybersecurity threat or security vulnerability.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49e2ceedee2b406085fd7419f68b9911"><enum>(5)</enum><header display-inline="yes-display-inline">Cybersecurity threat</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id75183C81810A47BCBB1FA22846039F2F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>cybersecurity threat</term> means an action, not protected by the First Amendment to the Constitution of the United States, on or through an information system that may result in an unauthorized effort to adversely impact the security, availability, confidentiality, or integrity of an information system or information that is stored on, processed by, or transiting an information system.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id048A10E53E624CF28551B1402C687163"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>cybersecurity threat</term> does not include any action that solely involves a violation of a consumer term of service or a consumer licensing agreement.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d3983bb450040588baa2b4c13f3f224"><enum>(6)</enum><header display-inline="yes-display-inline">Cyber threat indicator</header><text display-inline="yes-display-inline">The term <term>cyber threat indicator</term> means information that is necessary to describe or identify—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id9839151608aa4fcbb91b2080ae58c5b9"><enum>(A)</enum><text display-inline="yes-display-inline">malicious reconnaissance, including anomalous patterns of communications that appear to be transmitted for the purpose of gathering technical information related to a cybersecurity threat or security vulnerability;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde6f1ae882a8414ca47c746997e96427"><enum>(B)</enum><text display-inline="yes-display-inline">a method of defeating a security control or exploitation of a security vulnerability;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41f50ebb0ec048f3baef7497bd877901"><enum>(C)</enum><text display-inline="yes-display-inline">a security vulnerability, including anomalous activity that appears to indicate the existence of a security vulnerability;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc20c1bf328d84bf59b11c9c820f5152e"><enum>(D)</enum><text display-inline="yes-display-inline">a method of causing a user with legitimate access to an information system or information that is stored on, processed by, or transiting an information system to unwittingly enable the defeat of a security control or exploitation of a security vulnerability;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbde7ef0cbdf94756ac82b859bdb91c6f"><enum>(E)</enum><text display-inline="yes-display-inline">malicious cyber command and control;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb338fdbf73540cb8e7ae602c8886422"><enum>(F)</enum><text display-inline="yes-display-inline">the actual or potential harm caused by an incident, including a description of the information exfiltrated as a result of a particular cybersecurity threat;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc7c214c9a5f4630a5de4a6a7cca5814"><enum>(G)</enum><text display-inline="yes-display-inline">any other attribute of a cybersecurity threat, if disclosure of such attribute is not otherwise prohibited by law; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29bfdc551bc543d5a4fd4c47dc352ed9"><enum>(H)</enum><text display-inline="yes-display-inline">any combination thereof.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1203198c8bc0424f800e4e47f0a91512"><enum>(7)</enum><header display-inline="yes-display-inline">Defensive measure</header> <subparagraph commented="no" display-inline="no-display-inline" id="idE520C00A63F74C50B05F966818B84E31"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>defensive measure</term> means an action, device, procedure, signature, technique, or other measure applied to an information system or information that is stored on, processed by, or transiting an information system that detects, prevents, or mitigates a known or suspected cybersecurity threat or security vulnerability.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16C68EFAC95D46509212D799EAA9431F"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>defensive measure</term> does not include a measure that destroys, renders unusable, provides unauthorized access to, or substantially harms an information system or data on an information system not belonging to—</text>
 <clause commented="no" display-inline="no-display-inline" id="idFC370EE17C19419C84F5A048BA6D4D9B"><enum>(i)</enum><text display-inline="yes-display-inline">the private entity operating the measure; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idD2315551DF8E4C659C8CAAEA1A7A76C4"><enum>(ii)</enum><text display-inline="yes-display-inline">another entity or Federal entity that is authorized to provide consent and has provided consent to that private entity for operation of such measure.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34eb4bd570ed4bb3ac5d3bdae53a5fdf"><enum>(8)</enum><header display-inline="yes-display-inline">Entity</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2866E0CAD376460D9A88810630760C50"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this paragraph, the term <term>entity</term> means any private entity, non-Federal government agency or department, or State, tribal, or local government (including a political subdivision, department, or component thereof).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3987878577f047da89256c30cd3d81a6"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>entity</term> includes a government agency or department of the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, and any other territory or possession of the United States.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd52d556a0f2e44bb88afcc81bd90ce0f"><enum>(C)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>entity</term> does not include a foreign power as defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id275198b1338644fba3e7f3e1315f2f27"><enum>(9)</enum><header display-inline="yes-display-inline">Federal entity</header><text display-inline="yes-display-inline">The term <term>Federal entity</term> means a department or agency of the United States or any component of such department or agency.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id867ca89f79d444b69cbe8153a1a85ecc"><enum>(10)</enum><header display-inline="yes-display-inline">Information system</header><text display-inline="yes-display-inline">The term <term>information system</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id06DF2B5CFAA54295B55238E4DA6EAB3B"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 3502 of title 44, United States Code; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D111ECF60B745F282D232B4C6986E74"><enum>(B)</enum><text display-inline="yes-display-inline">includes industrial control systems, such as supervisory control and data acquisition systems, distributed control systems, and programmable logic controllers.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf9a16b5e40e463ca138fd546ab928cb"><enum>(11)</enum><header display-inline="yes-display-inline">Local government</header><text display-inline="yes-display-inline">The term <term>local government</term> means any borough, city, county, parish, town, township, village, or other political subdivision of a State.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id255d0e47cba3478d89fee5757d0bb58d"><enum>(12)</enum><header display-inline="yes-display-inline">Malicious cyber command and control</header><text display-inline="yes-display-inline">The term <term>malicious cyber command and control</term> means a method for unauthorized remote identification of, access to, or use of, an information system or information that is stored on, processed by, or transiting an information system.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11ed2a58b56446b09f35ecb40ca47bfb"><enum>(13)</enum><header display-inline="yes-display-inline">Malicious reconnaissance</header><text display-inline="yes-display-inline">The term <term>malicious reconnaissance</term> means a method for actively probing or passively monitoring an information system for the purpose of discerning security vulnerabilities of the information system, if such method is associated with a known or suspected cybersecurity threat.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf67bb949fcb445aca2a003c831f0ce13"><enum>(14)</enum><header display-inline="yes-display-inline">Monitor</header><text display-inline="yes-display-inline">The term <term>monitor</term> means to acquire, identify, or scan, or to possess, information that is stored on, processed by, or transiting an information system.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c568a5fa8834920b74beda78edcf77f"><enum>(15)</enum><header display-inline="yes-display-inline">Private entity</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id0E7F7023274F4BE9AD0AD2B964AEE9DC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this paragraph, the term <term>private entity</term> means any person or private group, organization, proprietorship, partnership, trust, cooperative, corporation, or other commercial or nonprofit entity, including an officer, employee, or agent thereof.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88B4A4D7938A4519A26B500815CC3F01"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>private entity</term> includes a State, tribal, or local government performing electric or other utility services.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f1fb3365c6241c59b4d531682c565f0"><enum>(C)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>private entity</term> does not include a foreign power as defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fc26e5c0fdb47dca1959b170081bf59"><enum>(16)</enum><header display-inline="yes-display-inline">Security control</header><text display-inline="yes-display-inline">The term <term>security control</term> means the management, operational, and technical controls used to protect against an unauthorized effort to adversely affect the confidentiality, integrity, and availability of an information system or its information.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95985de5ebd54d19a6dc01958ff098fa"><enum>(17)</enum><header display-inline="yes-display-inline">Security vulnerability</header><text display-inline="yes-display-inline">The term <term>security vulnerability</term> means any attribute of hardware, software, process, or procedure that could enable or facilitate the defeat of a security control.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ff0154c145d47d898d82584e5b887a0"><enum>(18)</enum><header display-inline="yes-display-inline">Tribal</header><text display-inline="yes-display-inline">The term <term>tribal</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="ide272b572449646ad8add7175c744bf49" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Sharing of information by the Federal Government</header> <subsection commented="no" display-inline="no-display-inline" id="id60DEB92652994092B3BD9A557EBF9C00"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Consistent with the protection of classified information, intelligence sources and methods, and privacy and civil liberties, the Director of National Intelligence, the Secretary of Homeland Security, the Secretary of Defense, and the Attorney General, in consultation with the heads of the appropriate Federal entities, shall develop and promulgate procedures to facilitate and promote—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id17178d7f14d5447ba2cf74d8d0754f8d"><enum>(1)</enum><text display-inline="yes-display-inline">the timely sharing of classified cyber threat indicators in the possession of the Federal Government with cleared representatives of relevant entities;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa37297793944613b57d44e7ef4a28ba"><enum>(2)</enum><text display-inline="yes-display-inline">the timely sharing with relevant entities of cyber threat indicators or information in the possession of the Federal Government that may be declassified and shared at an unclassified level;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id587c88ae4a724f7486685d3cb9d2d393"><enum>(3)</enum><text display-inline="yes-display-inline">the sharing with relevant entities, or the public if appropriate, of unclassified, including controlled unclassified, cyber threat indicators in the possession of the Federal Government;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5691FEB935454D38A0876D8C496F1A0D"><enum>(4)</enum><text display-inline="yes-display-inline">the sharing with entities, if appropriate, of information in the possession of the Federal Government about cybersecurity threats to such entities to prevent or mitigate adverse effects from such cybersecurity threats; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id349AF55CD1594016B61E0230D02758A0"><enum>(5)</enum><text display-inline="yes-display-inline">the periodic sharing, through publication and targeted outreach, of cybersecurity best practices that are developed based on ongoing analysis of cyber threat indicators and information in possession of the Federal Government, with attention to accessibility and implementation challenges faced by small business concerns (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id922aa5c9ab7642759ccea3085ddfaef9"><enum>(b)</enum><header display-inline="yes-display-inline">Development of procedures</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idf200c18b8c8d46d59fcd156a08154542"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The procedures developed and promulgated under subsection (a) shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8af1c5fbcf7b4b17a1b8602c5488a029"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the Federal Government has and maintains the capability to share cyber threat indicators in real time consistent with the protection of classified information;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide44e737d03e74500a0988f66f4f15a0c"><enum>(B)</enum><text display-inline="yes-display-inline">incorporate, to the greatest extent practicable, existing processes and existing roles and responsibilities of Federal and non-Federal entities for information sharing by the Federal Government, including sector specific information sharing and analysis centers;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD4D680545DBB4D0683C44A982BA470C8"><enum>(C)</enum><text display-inline="yes-display-inline">include procedures for notifying, in a timely manner, entities that have received a cyber threat indicator from a Federal entity under this title that is known or determined to be in error or in contravention of the requirements of this title or another provision of Federal law or policy of such error or contravention;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21bf0801e7ab4ecc98bf54f5623308e7"><enum>(D)</enum><text display-inline="yes-display-inline">include requirements for Federal entities sharing cyber threat indicators or defensive measures to implement and utilize security controls to protect against unauthorized access to or acquisition of such cyber threat indicators or defensive measures;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8731035ee9cb4b3799150b4faa2a49dc"><enum>(E)</enum><text display-inline="yes-display-inline">include procedures that require a Federal entity, prior to the sharing of a cyber threat indicator—</text> <clause commented="no" display-inline="no-display-inline" id="id62c309c20c714affa1590f20773434b5"><enum>(i)</enum><text display-inline="yes-display-inline">to review such cyber threat indicator to assess whether such cyber threat indicator contains any information that such Federal entity knows at the time of sharing to be personal information or information that identifies a specific person not directly related to a cybersecurity threat and remove such information; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id95bb868c37d54dae8b139a0172961aab"><enum>(ii)</enum><text display-inline="yes-display-inline">to implement and utilize a technical capability configured to remove any personal information or information that identifies a specific person not directly related to a cybersecurity threat; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66A6D90CF0B54767A585FDF2C976CFA1"><enum>(F)</enum><text display-inline="yes-display-inline">include procedures for notifying, in a timely manner, any United States person whose personal information is known or determined to have been shared by a Federal entity in violation of this Act.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88f37ed9ddcf415c91085b6d0cf60d5d"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In developing the procedures required under this section, the Director of National Intelligence, the Secretary of Homeland Security, the Secretary of Defense, and the Attorney General shall coordinate with appropriate Federal entities, including the Small Business Administration and the National Laboratories (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>)), to ensure that effective protocols are implemented that will facilitate and promote the sharing of cyber threat indicators by the Federal Government in a timely manner.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01034de7deaa45c1a3883845c6a94e5f"><enum>(c)</enum><header display-inline="yes-display-inline">Submittal to Congress</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of National Intelligence, in consultation with the heads of the appropriate Federal entities, shall submit to Congress the procedures required by subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idc220a261d0c34c7ea5df4103764ca4a6" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Authorizations for preventing, detecting, analyzing, and mitigating cybersecurity threats</header>
				<subsection commented="no" display-inline="no-display-inline" id="idd550b0c82d524ff9a8d38985eb37851e"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization for monitoring</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idDB27390EFA5F41FF97FDAA4AEF62CD72"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a private entity may, for cybersecurity purposes, monitor—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id74adfb4028e94cc29bdf57ae9d35de27"><enum>(A)</enum><text display-inline="yes-display-inline">an information system of such private entity;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id045a1dc05ec34ea7b419984c9b3b5ba0"><enum>(B)</enum><text display-inline="yes-display-inline">an information system of another entity, upon the authorization and written consent of such other entity;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94d8a7d84c304e979aa66f69894ec07e"><enum>(C)</enum><text display-inline="yes-display-inline">an information system of a Federal entity, upon the authorization and written consent of an authorized representative of the Federal entity; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd1537e93404445dba2655931b805c747"><enum>(D)</enum><text display-inline="yes-display-inline">information that is stored on, processed by, or transiting an information system monitored by the private entity under this paragraph.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9450ca4516e84034a89ab975eb457ebe"><enum>(2)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id44B1BC0D3D6A4F55887FD75883BD64F0"><enum>(A)</enum><text display-inline="yes-display-inline">to authorize the monitoring of an information system, or the use of any information obtained through such monitoring, other than as provided in this title; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CDDD5F642C340789ABB4B2FDC71EDA9"><enum>(B)</enum><text display-inline="yes-display-inline">to limit otherwise lawful activity.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5024fba425fd40c6a8c34e8139619def"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization for operation of defensive measures</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idD6133CA490934BC59B9909539483DDAB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a private entity may, for cybersecurity purposes, operate a defensive measure that is applied to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id1b1394c2ffe242f8b323473c77cc80a9"><enum>(A)</enum><text display-inline="yes-display-inline">an information system of such private entity in order to protect the rights or property of the private entity;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75de45e29dc94653ae72747204a7338e"><enum>(B)</enum><text display-inline="yes-display-inline">an information system of another entity upon written consent of such entity for operation of such defensive measure to protect the rights or property of such entity; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd819986e1f004dbb9b7d9673cb573516"><enum>(C)</enum><text display-inline="yes-display-inline">an information system of a Federal entity upon written consent of an authorized representative of such Federal entity for operation of such defensive measure to protect the rights or property of the Federal Government.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id710EC71FC0D64DE3AD3F53AB74EEE36D"><enum>(2)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idDE240D7CDF844BBCA901A8278CD1355C"><enum>(A)</enum><text display-inline="yes-display-inline">to authorize the use of a defensive measure other than as provided in this subsection; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA2583FDFA80C4F45A19D485861996849"><enum>(B)</enum><text display-inline="yes-display-inline">to limit otherwise lawful activity.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15b2286059ea465fa50995c1c53ac62d"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization for sharing or receiving cyber threat indicators or defensive measures</header> <paragraph commented="no" display-inline="no-display-inline" id="idC45ACCCE3F664AF69548C7905E7D17BC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2) and notwithstanding any other provision of law, an entity may, for a cybersecurity purpose and consistent with the protection of classified information, share with, or receive from, any other entity or the Federal Government a cyber threat indicator or defensive measure.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD048C56DEE8245F38BDCC9FD4C52578C"><enum>(2)</enum><header display-inline="yes-display-inline">Lawful restriction</header><text display-inline="yes-display-inline">An entity receiving a cyber threat indicator or defensive measure from another entity or Federal entity shall comply with otherwise lawful restrictions placed on the sharing or use of such cyber threat indicator or defensive measure by the sharing entity or Federal entity.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06E7B35EA8F44AA58B27CFDCDADC64A3"><enum>(3)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idAA3CB71E5CD84159986B359496DA9FC6"><enum>(A)</enum><text display-inline="yes-display-inline">to authorize the sharing or receiving of a cyber threat indicator or defensive measure other than as provided in this subsection; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61F53768004A4DF682C350E52E60506F"><enum>(B)</enum><text display-inline="yes-display-inline">to limit otherwise lawful activity.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id587f30812c154c47b7a72dbcec9a83bd"><enum>(d)</enum><header display-inline="yes-display-inline">Protection and use of information</header> <paragraph commented="no" display-inline="no-display-inline" id="ida6094e1f362e4307a556581d7abffd60"><enum>(1)</enum><header display-inline="yes-display-inline">Security of information</header><text display-inline="yes-display-inline">An entity monitoring an information system, operating a defensive measure, or providing or receiving a cyber threat indicator or defensive measure under this section shall implement and utilize a security control to protect against unauthorized access to or acquisition of such cyber threat indicator or defensive measure.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida331bc57ccbf4bffa8e657c0f8299c41"><enum>(2)</enum><header display-inline="yes-display-inline">Removal of certain personal information</header><text display-inline="yes-display-inline">An entity sharing a cyber threat indicator pursuant to this title shall, prior to such sharing—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idffbb5dad7c244f64899b96629f8a37c9"><enum>(A)</enum><text display-inline="yes-display-inline">review such cyber threat indicator to assess whether such cyber threat indicator contains any information that the entity knows at the time of sharing to be personal information or information that identifies a specific person not directly related to a cybersecurity threat and remove such information; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31dc63ccd4284240949250e9b1b14b6e"><enum>(B)</enum><text display-inline="yes-display-inline">implement and utilize a technical capability configured to remove any information contained within such indicator that the entity knows at the time of sharing to be personal information or information that identifies a specific person not directly related to a cybersecurity threat.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id542108e23505448ebfa58823faea2ec2"><enum>(3)</enum><header display-inline="yes-display-inline">Use of cyber threat indicators and defensive measures by entities</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id09F209BD772541E796D9836514D9D478"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Consistent with this title, a cyber threat indicator or defensive measure shared or received under this section may, for cybersecurity purposes—</text>
 <clause commented="no" display-inline="no-display-inline" id="idc7c7d3fbd4f0412e8c4e336a500ae1f6"><enum>(i)</enum><text display-inline="yes-display-inline">be used by an entity to monitor or operate a defensive measure that is applied to—</text> <subclause commented="no" display-inline="no-display-inline" id="id60A8B29F396E4C7D9D433D8632EBEECF"><enum>(I)</enum><text display-inline="yes-display-inline">an information system of the entity; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idF3F0A12330BD44378A414F60D968A41E"><enum>(II)</enum><text display-inline="yes-display-inline">an information system of another entity or a Federal entity upon the written consent of that other entity or that Federal entity; and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida926c3ac486045348f9ca3330247567c"><enum>(ii)</enum><text display-inline="yes-display-inline">be otherwise used, retained, and further shared by an entity subject to—</text> <subclause commented="no" display-inline="no-display-inline" id="id528040E3BA254ABB8108F6D333ACCB68"><enum>(I)</enum><text display-inline="yes-display-inline">an otherwise lawful restriction placed by the sharing entity or Federal entity on such cyber threat indicator or defensive measure; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id894F10C7053347A984E81725DEB7A5FD"><enum>(II)</enum><text display-inline="yes-display-inline">an otherwise applicable provision of law.</text> </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D4D0386EC12402AA790E18E135BDFBA"><enum>(B)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed to authorize the use of a cyber threat indicator or defensive measure other than as provided in this section.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide531a9590589423083371385be37d52b"><enum>(4)</enum><header display-inline="yes-display-inline">Use of cyber threat indicators by  State, tribal, or local government</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idf28a4ddfd8d94413afa3ff626be9263a"><enum>(A)</enum><header display-inline="yes-display-inline">Law enforcement use</header>
 <clause commented="no" display-inline="no-display-inline" id="id4B21ADA28A5D4F6F962ECD3A88A5D785"><enum>(i)</enum><header display-inline="yes-display-inline">Prior written consent</header><text display-inline="yes-display-inline">Except as provided in clause (ii), a cyber threat indicator shared with a State, tribal, or local government under this section may, with the prior written consent of the entity sharing such indicator, be used by a State, tribal, or local government for the purpose of preventing, investigating, or prosecuting any of the offenses described in section 105(d)(5)(A)(vi).</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA1B35615DC7E4F378B4A5F70BC410325"><enum>(ii)</enum><header display-inline="yes-display-inline">Oral consent</header><text display-inline="yes-display-inline">If exigent circumstances prevent obtaining written consent under clause (i), such consent may be provided orally with subsequent documentation of the consent.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85179ad1c3184c86b2d5ab0249a086e0"><enum>(B)</enum><header display-inline="yes-display-inline">Exemption from disclosure</header><text display-inline="yes-display-inline">A cyber threat indicator shared with a State, tribal, or local government under this section shall be—</text>
 <clause commented="no" display-inline="no-display-inline" id="idEFD5B8F6BCBD4719892C94B7EE07DEF3"><enum>(i)</enum><text display-inline="yes-display-inline">deemed voluntarily shared information; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id01453FCD88A94F66B47EEC1C78660123"><enum>(ii)</enum><text display-inline="yes-display-inline">exempt from disclosure under any State, tribal, or local law requiring disclosure of information or records.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id689e729395e8448fbcdbac024ac4c65f"><enum>(C)</enum><header display-inline="yes-display-inline">State, tribal, and local regulatory authority</header>
 <clause commented="no" display-inline="no-display-inline" id="id1F0817CB4A9B4A3BB6C7B6DE89205F83"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), a cyber threat indicator or defensive measure shared with a State, tribal, or local government under this title shall not be directly used by any State, tribal, or local government to regulate, including an enforcement action, the lawful activity of any entity, including an activity relating to monitoring, operating a defensive measure, or sharing of a cyber threat indicator.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id1D203FF03AC7488BBD26DBA7DF1F5448"><enum>(ii)</enum><header display-inline="yes-display-inline">Regulatory authority specifically relating to prevention or mitigation of cybersecurity threats</header><text display-inline="yes-display-inline">A cyber threat indicator or defensive measure shared as described in clause (i) may, consistent with a State, tribal, or local government regulatory authority specifically relating to the prevention or mitigation of cybersecurity threats to information systems, inform the development or implementation of a regulation relating to such information systems.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idca6ef7800a0749e3846b9957943213ef"><enum>(e)</enum><header display-inline="yes-display-inline">Antitrust exemption</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idBB17B5D2F92B400194DE548260A909BA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in section 108(e), it shall not be considered a violation of any provision of antitrust laws for 2 or more private entities to exchange or provide a cyber threat indicator, or assistance relating to the prevention, investigation, or mitigation of a cybersecurity threat, for cybersecurity purposes under this title.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF128322AFA864B8997221B30E09358C6"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Paragraph (1) shall apply only to information that is exchanged or assistance provided in order to assist with—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id0d54aaad820143f08a40e5483d25bc97"><enum>(A)</enum><text display-inline="yes-display-inline">facilitating the prevention, investigation, or mitigation of a cybersecurity threat to an information system or information that is stored on, processed by, or transiting an information system; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61ba9e5953bd4c018f2f39fbf1110345"><enum>(B)</enum><text display-inline="yes-display-inline">communicating or disclosing a cyber threat indicator to help prevent, investigate, or mitigate the effect of a cybersecurity threat to an information system or information that is stored on, processed by, or transiting an information system.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id544c084bb95644d484d2f897c79da9cd"><enum>(f)</enum><header display-inline="yes-display-inline">No right or benefit</header><text display-inline="yes-display-inline">The sharing of a cyber threat indicator with an entity under this title shall not create a right or benefit to similar information by such entity or any other entity.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id7aa014d8219640b0be5ba8486e0f5776" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Sharing of cyber threat indicators and defensive measures with the Federal Government</header>
				<subsection commented="no" display-inline="no-display-inline" id="idF4A427F16FBF41B48FE2A9275581CB4B"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement for policies and procedures</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id562B6AE8A3424E2B8264ED2FBB5D083E"><enum>(1)</enum><header display-inline="yes-display-inline">Interim policies and procedures</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Attorney General and the Secretary of Homeland Security shall, in coordination with the heads of the appropriate Federal entities, develop and submit to Congress interim policies and procedures relating to the receipt of cyber threat indicators and defensive measures by the Federal Government.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A7F0128D1154A88A3A6245172D0B6C6"><enum>(2)</enum><header display-inline="yes-display-inline">Final policies and procedures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General and the Secretary of Homeland Security shall, in coordination with the heads of the appropriate Federal entities, promulgate final policies and procedures relating to the receipt of cyber threat indicators and defensive measures by the Federal Government.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B662B7751CE4C79BFACB082FD05A044"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements concerning policies and procedures</header><text display-inline="yes-display-inline">Consistent with the guidelines required by subsection (b), the policies and procedures developed and promulgated under this subsection shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id46848b1ab370433983dc66be06250f83"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that cyber threat indicators shared with the Federal Government by any entity pursuant to section 104(c) through the real-time process described in subsection (c) of this section—</text>
 <clause commented="no" display-inline="no-display-inline" id="id83525bef716841da9ec642a5ee837ab0"><enum>(i)</enum><text display-inline="yes-display-inline">are shared in an automated manner with all of the appropriate Federal entities;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id08EC58872EE74AC59B44A269C6C76705"><enum>(ii)</enum><text display-inline="yes-display-inline">are only subject to a delay, modification, or other action due to controls established for such real-time process that could impede real-time receipt by all of the appropriate Federal entities when the delay, modification, or other action is due to controls—</text>
 <subclause commented="no" display-inline="no-display-inline" id="idAB26146BDBEF455887DAA86ACDB49FCB"><enum>(I)</enum><text display-inline="yes-display-inline">agreed upon unanimously by all of the heads of the appropriate Federal entities;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id7D5EFDE8418F4F6CAE6AFA079875C72F"><enum>(II)</enum><text display-inline="yes-display-inline">carried out before any of the appropriate Federal entities retains or uses the cyber threat indicators or defensive measures; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idE2C54F505A454BB782FB1A883321B7FE"><enum>(III)</enum><text display-inline="yes-display-inline">uniformly applied such that each of the appropriate Federal entities is subject to the same delay, modification, or other action; and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd29644ade3514e2b997145512e9572af"><enum>(iii)</enum><text display-inline="yes-display-inline">may be provided to other Federal entities;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20fee7f3d5e14cefac3d26ea24bbb426"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that cyber threat indicators shared with the Federal Government by any entity pursuant to section 104 in a manner other than the real time process described in subsection (c) of this section—</text>
 <clause commented="no" display-inline="no-display-inline" id="idE55D02C30F6B449CA568E5E566248803"><enum>(i)</enum><text display-inline="yes-display-inline">are shared as quickly as operationally practicable with all of the appropriate Federal entities;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id2A18CB52D7D7440EA25D33E62AEB9118"><enum>(ii)</enum><text display-inline="yes-display-inline">are not subject to any unnecessary delay, interference, or any other action that could impede receipt by all of the appropriate Federal entities; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id9105D63B7406406293D11A9F56C1B975"><enum>(iii)</enum><text display-inline="yes-display-inline">may be provided to other Federal entities;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd90508deb253401085cf9a53076dca5f"><enum>(C)</enum><text display-inline="yes-display-inline">consistent with this title, any other applicable provisions of law, and the fair information practice principles set forth in appendix A of the document entitled <quote>National Strategy for Trusted Identities in Cyberspace</quote> and published by the President in April, 2011, govern the retention, use, and dissemination by the Federal Government of cyber threat indicators shared with the Federal Government under this title, including the extent, if any, to which such cyber threat indicators may be used by the Federal Government; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id390c6fb37dbe4361b3c04bc619ea9b51"><enum>(D)</enum><text display-inline="yes-display-inline">ensure there are—</text> <clause commented="no" display-inline="no-display-inline" id="id5BAEAFAF49CC494D8D32E42EA1068FC6"><enum>(i)</enum><text display-inline="yes-display-inline">audit capabilities; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6A2DDD66B1D547C9BF0F40F537C87B1B"><enum>(ii)</enum><text display-inline="yes-display-inline">appropriate sanctions in place for officers, employees, or agents of a Federal entity who knowingly and willfully conduct activities under this title in an unauthorized manner.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4B0BCB34ADC4EF48C7B755302EA2ED6"><enum>(4)</enum><header display-inline="yes-display-inline">Guidelines for entities sharing cyber threat indicators with Federal Government</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id16F4106B844649B4871F4053B8280A89"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Attorney General and the Secretary of Homeland Security shall develop and make publicly available guidance to assist entities and promote sharing of cyber threat indicators with Federal entities under this title.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B00AC3DF5BF40548922813537E20ABC"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The guidelines developed and made publicly available under subparagraph (A) shall include guidance on the following:</text>
 <clause commented="no" display-inline="no-display-inline" id="ide466af24f4904150957a01bf01091527"><enum>(i)</enum><text display-inline="yes-display-inline">Identification of types of information that would qualify as a cyber threat indicator under this title that would be unlikely to include personal information or information that identifies a specific person not directly related to a cyber security threat.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idffdd60b0dbe84828aa33290e88ca24e8"><enum>(ii)</enum><text display-inline="yes-display-inline">Identification of types of information protected under otherwise applicable privacy laws that are unlikely to be directly related to a cybersecurity threat.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idf6328d9fb9fd499bb6e4e21a74aea344"><enum>(iii)</enum><text display-inline="yes-display-inline">Such other matters as the Attorney General and the Secretary of Homeland Security consider appropriate for entities sharing cyber threat indicators with Federal entities under this title.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc4e88348b4f741e6b631cee57276b7e3"><enum>(b)</enum><header display-inline="yes-display-inline">Privacy and civil liberties</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id6680ED1E23CF4C0DBCA0BE106858360F"><enum>(1)</enum><header display-inline="yes-display-inline">Guidelines of Attorney General</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Attorney General shall, in coordination with heads of the appropriate Federal entities and in consultation with officers designated under section 1062 of the National Security Intelligence Reform Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ee-1">42 U.S.C. 2000ee–1</external-xref>), develop, submit to Congress, and make available to the public interim guidelines relating to privacy and civil liberties which shall govern the receipt, retention, use, and dissemination of cyber threat indicators by a Federal entity obtained in connection with activities authorized in this title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19A864680EA146A497F39CE15D4606D7"><enum>(2)</enum><header display-inline="yes-display-inline">Final guidelines</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="idC611CA124C374C0E8CED941F42B47AA6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General shall, in coordination with heads of the appropriate Federal entities and in consultation with officers designated under section 1062 of the National Security Intelligence Reform Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ee-1">42 U.S.C. 2000ee–1</external-xref>) and such private entities with industry expertise as the Attorney General considers relevant, promulgate final guidelines relating to privacy and civil liberties which shall govern the receipt, retention, use, and dissemination of cyber threat indicators by a Federal entity obtained in connection with activities authorized in this title.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE071952D990A4562A6A4D6CD572AC577"><enum>(B)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">The Attorney General shall, in coordination with heads of the appropriate Federal entities and in consultation with officers and private entities described in subparagraph (A), periodically, but not less frequently than once every two years, review the guidelines promulgated under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd38b114fb48e4ed286601bc98d9b5b46"><enum>(3)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">The guidelines required by paragraphs (1) and (2) shall, consistent with the need to protect information systems from cybersecurity threats and mitigate cybersecurity threats—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idF48AF86D46C14BB39F9797A98D64B1CB"><enum>(A)</enum><text display-inline="yes-display-inline">limit the effect on privacy and civil liberties of activities by the Federal Government under this title;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53B7C21C00D340ED97D9CA6E1C0E483E"><enum>(B)</enum><text display-inline="yes-display-inline">limit the receipt, retention, use, and dissemination of cyber threat indicators containing personal information or information that identifies specific persons, including by establishing—</text>
 <clause commented="no" display-inline="no-display-inline" id="id09B4555D69A24398BAA6734C3628DB34"><enum>(i)</enum><text display-inline="yes-display-inline">a process for the timely destruction of such information that is known not to be directly related to uses authorized under this title; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id4F35A6A92ECE45BD890898FC67DE3EAA"><enum>(ii)</enum><text display-inline="yes-display-inline">specific limitations on the length of any period in which a cyber threat indicator may be retained;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29f3959c54434f549d88de486a12cb6e"><enum>(C)</enum><text display-inline="yes-display-inline">include requirements to safeguard cyber threat indicators containing personal information or information that identifies specific persons from unauthorized access or acquisition, including appropriate sanctions for activities by officers, employees, or agents of the Federal Government in contravention of such guidelines;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8aaff28200b0440ca7a02c65394da273"><enum>(D)</enum><text display-inline="yes-display-inline">include procedures for notifying entities and Federal entities if information received pursuant to this section is known or determined by a Federal entity receiving such information not to constitute a cyber threat indicator;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc07b89ca741e4f2281bc8787da22148c"><enum>(E)</enum><text display-inline="yes-display-inline">protect the confidentiality of cyber threat indicators containing personal information or information that identifies specific persons to the greatest extent practicable and require recipients to be informed that such indicators may only be used for purposes authorized under this title; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0205777B9F4D49918D54B32D4F394712"><enum>(F)</enum><text display-inline="yes-display-inline">include steps that may be needed so that dissemination of cyber threat indicators is consistent with the protection of classified and other sensitive national security information.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddb705fe5b65947b59c9bbda071afefb5"><enum>(c)</enum><header display-inline="yes-display-inline">Capability and process within the Department of Homeland Security</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id2ab86b40a5f14172826c12a273f89e21"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security, in coordination with the heads of the appropriate Federal entities, shall develop and implement a capability and process within the Department of Homeland Security that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id44ee3aafbad94167bb404d110a404054"><enum>(A)</enum><text display-inline="yes-display-inline">shall accept from any entity in real time cyber threat indicators and defensive measures, pursuant to this section;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf6edbc862e14bceaba148302772d046"><enum>(B)</enum><text display-inline="yes-display-inline">shall, upon submittal of the certification under paragraph (2) that such capability and process fully and effectively operates as described in such paragraph, be the process by which the Federal Government receives cyber threat indicators and defensive measures under this title that are shared by a private entity with the Federal Government through electronic mail or media, an interactive form on an Internet website, or a real time, automated process between information systems except—</text>
 <clause commented="no" display-inline="no-display-inline" id="ida4a6d3b6de884ddab47f2822a897566d"><enum>(i)</enum><text display-inline="yes-display-inline">consistent with section 104, communications between a Federal entity and a private entity regarding a previously shared cyber threat indicator to describe the relevant cybersecurity threat or develop a defensive measure based on such cyber threat indicator; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idb2889f4a630c4f3b9835f013a90cc94a"><enum>(ii)</enum><text display-inline="yes-display-inline">communications by a regulated entity with such entity's Federal regulatory authority regarding a cybersecurity threat;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74228c1b10af4e2f9a04458781c9c40b"><enum>(C)</enum><text display-inline="yes-display-inline">ensures that all of the appropriate Federal entities receive in an automated manner such cyber threat indicators shared through the real-time process within the Department of Homeland Security;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4658dd957f3a451396385a71f177d8ef"><enum>(D)</enum><text display-inline="yes-display-inline">is in compliance with the policies, procedures, and guidelines required by this section; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4949F76333004EDE93160983224E2179"><enum>(E)</enum><text display-inline="yes-display-inline">does not limit or prohibit otherwise lawful disclosures of communications, records, or other information, including—</text>
 <clause commented="no" display-inline="no-display-inline" id="id55E5D410080648D28DABF980329B77EB"><enum>(i)</enum><text display-inline="yes-display-inline">reporting of known or suspected criminal activity, by an entity to any other entity or a Federal entity;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id68AE287726F0478F9DC5A27D149B5894"><enum>(ii)</enum><text display-inline="yes-display-inline">voluntary or legally compelled participation in a Federal investigation; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id168293381BA84B839BE416B24E19B827"><enum>(iii)</enum><text display-inline="yes-display-inline">providing cyber threat indicators or defensive measures as part of a statutory or authorized contractual requirement.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAFB54A8154BE419DA4A0CAD5731005AD"><enum>(2)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">Not later than 10 days prior to the implementation of the capability and process required by paragraph (1), the Secretary of Homeland Security shall, in consultation with the heads of the appropriate Federal entities, certify to Congress whether such capability and process fully and effectively operates—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idE28D93148B224B7EB6FBD70BD45B5EFE"><enum>(A)</enum><text display-inline="yes-display-inline">as the process by which the Federal Government receives from any entity a cyber threat indicator or defensive measure under this title; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id106A6D13128D42E7A712537DB02031CD"><enum>(B)</enum><text display-inline="yes-display-inline">in accordance with the policies, procedures, and guidelines developed under this section.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbd76c0a3411466f8f187c461899c97a"><enum>(3)</enum><header display-inline="yes-display-inline">Public notice and access</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure there is public notice of, and access to, the capability and process developed and implemented under paragraph (1) so that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id47F653902340407FAEE2C7315991BE04"><enum>(A)</enum><text display-inline="yes-display-inline">any entity may share cyber threat indicators and defensive measures through such process with the Federal Government; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB444C4C8BD244E7F92BDD05092FF1D06"><enum>(B)</enum><text display-inline="yes-display-inline">all of the appropriate Federal entities receive such cyber threat indicators and defensive measures in real time with receipt through the process within the Department of Homeland Security.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida17d6de9ed734287a44a64a020d061c6"><enum>(4)</enum><header display-inline="yes-display-inline">Other Federal entities</header><text display-inline="yes-display-inline">The process developed and implemented under paragraph (1) shall ensure that other Federal entities receive in a timely manner any cyber threat indicators and defensive measures shared with the Federal Government through such process.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17557069211545e79a2c9620f921f153"><enum>(5)</enum><header display-inline="yes-display-inline"> Report on development and implementation</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id000B97E78A814FE9B0A3212896692326"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report on the development and implementation of the capability and process required by paragraph (1), including a description of such capability and process and the public notice of, and access to, such process.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7161E1CA5F5C4E928692BCC57B3EF178"><enum>(B)</enum><header display-inline="yes-display-inline">Classified annex</header><text display-inline="yes-display-inline">The report required by subparagraph (A) shall be submitted in unclassified form, but may include a classified annex.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddae8dc75074c4b98a7e132d8a744a408"><enum>(d)</enum><header display-inline="yes-display-inline">Information shared with or provided to the Federal Government</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id9065ee798e41498595da5b9d27c8ae9a"><enum>(1)</enum><header display-inline="yes-display-inline">No waiver of privilege or protection</header><text display-inline="yes-display-inline">The provision of cyber threat indicators and defensive measures to the Federal Government under this title shall not constitute a waiver of any applicable privilege or protection provided by law, including trade secret protection.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3C35A115EA704CA284C8019913B6B668"><enum>(2)</enum><header display-inline="yes-display-inline">Proprietary information</header><text display-inline="yes-display-inline">Consistent with section 104(c)(2), a cyber threat indicator or defensive measure provided by an entity to the Federal Government under this title shall be considered the commercial, financial, and proprietary information of such entity when so designated by the originating entity or a third party acting in accordance with the written authorization of the originating entity.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fca19fc3add4e38a5ca2ffccfbd3920"><enum>(3)</enum><header display-inline="yes-display-inline">Exemption from disclosure</header><text display-inline="yes-display-inline">Cyber threat indicators and defensive measures provided to the Federal Government under this title shall be—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id49C6040B9979451B9B6B4D7CF55200C4"><enum>(A)</enum><text display-inline="yes-display-inline">deemed voluntarily shared information and exempt from disclosure under section 552 of title 5, United States Code, and any State, tribal, or local law requiring disclosure of information or records; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1DC432B22621405FB766EA876DBB4E21"><enum>(B)</enum><text display-inline="yes-display-inline">withheld, without discretion, from the public under section 552(b)(3)(B) of title 5, United States Code, and any State, tribal, or local provision of law requiring disclosure of information or records.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30c7cf5b0901423dbc881bbf1162920d"><enum>(4)</enum><header display-inline="yes-display-inline">Ex parte communications</header><text display-inline="yes-display-inline">The provision of a cyber threat indicator or defensive measure to the Federal Government under this title shall not be subject to a rule of any Federal agency or department or any judicial doctrine regarding ex parte communications with a decision-making official.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59233618d29b4833b1ac319f6f6d7d44"><enum>(5)</enum><header display-inline="yes-display-inline">Disclosure, retention, and use</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id7E37CEEA30DD42F1825FC17937D572A2"><enum>(A)</enum><header display-inline="yes-display-inline">Authorized activities</header><text display-inline="yes-display-inline">Cyber threat indicators and defensive measures provided to the Federal Government under this title may be disclosed to, retained by, and used by, consistent with otherwise applicable provisions of Federal law, any Federal agency or department, component, officer, employee, or agent of the Federal Government solely for—</text>
 <clause commented="no" display-inline="no-display-inline" id="idaf06042c50e74e5b8ec0b1f7075b3287"><enum>(i)</enum><text display-inline="yes-display-inline">a cybersecurity purpose;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id714D97D6684546FCABFA22F119FBA152"><enum>(ii)</enum><text display-inline="yes-display-inline">the purpose of identifying a cybersecurity threat, including the source of such cybersecurity threat, or a security vulnerability;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id49EB5D715F2D4FCF9B3A9365699A2EA5"><enum>(iii)</enum><text display-inline="yes-display-inline">the purpose of identifying a cybersecurity threat involving the use of an information system by a foreign adversary or terrorist;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id54ee3cb88baf42a59f100f8506f4deda"><enum>(iv)</enum><text display-inline="yes-display-inline">the purpose of responding to, or otherwise preventing or mitigating, an imminent threat of death, serious bodily harm, or serious economic harm, including a terrorist act or a use of a weapon of mass destruction;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idFCF9D140F9974FF9BA081A55CA28CB3D"><enum>(v)</enum><text display-inline="yes-display-inline">the purpose of responding to, or otherwise preventing or mitigating, a serious threat to a minor, including sexual exploitation and threats to physical safety; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idb506d03ef20e4285a387fe03f8dfa7a2"><enum>(vi)</enum><text display-inline="yes-display-inline">the purpose of preventing, investigating, disrupting, or prosecuting an offense arising out of a threat described in clause (iv) or any of the offenses listed in—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id4A52A1ABCE76493CA28CEC9E07FBA367"><enum>(I)</enum><text display-inline="yes-display-inline">sections 1028 through 1030 of title 18, United States Code (relating to fraud and identity theft);</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id91767279A0FA4C4E8CCB83722B6335F0"><enum>(II)</enum><text display-inline="yes-display-inline">chapter 37 of such title (relating to espionage and censorship); and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id65F3C175E2CA45BFABDD54FF80033130"><enum>(III)</enum><text display-inline="yes-display-inline">chapter 90 of such title (relating to protection of trade secrets).</text>
 </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0eac03d62bf34dd5a15a96712a4cc176"><enum>(B)</enum><header display-inline="yes-display-inline">Prohibited activities</header><text display-inline="yes-display-inline">Cyber threat indicators and defensive measures provided to the Federal Government under this title shall not be disclosed to, retained by, or used by any Federal agency or department for any use not permitted under subparagraph (A).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0bbc2ab9a8ea4195be0389994d9b23de"><enum>(C)</enum><header display-inline="yes-display-inline">Privacy and civil liberties</header><text display-inline="yes-display-inline">Cyber threat indicators and defensive measures provided to the Federal Government under this title shall be retained, used, and disseminated by the Federal Government—</text>
 <clause commented="no" display-inline="no-display-inline" id="id1089c9a8162f46c2be9642433e38162a"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with the policies, procedures, and guidelines required by subsections (a) and (b);</text> </clause><clause commented="no" display-inline="no-display-inline" id="id962b067ce7d74e71a0d4f63b58879412"><enum>(ii)</enum><text display-inline="yes-display-inline">in a manner that protects from unauthorized use or disclosure any cyber threat indicators that may contain personal information or information that identifies specific persons; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id2307b2e7658a4d15994b310064ebb505"><enum>(iii)</enum><text display-inline="yes-display-inline">in a manner that protects the confidentiality of cyber threat indicators containing personal information or information that identifies a specific person.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f06afa647834a7886338b680abe67b2"><enum>(D)</enum><header display-inline="yes-display-inline">Federal regulatory authority</header>
 <clause commented="no" display-inline="no-display-inline" id="idAA84E14692C74F77AAAB3CFFE3DAF905"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), cyber threat indicators and defensive measures provided to the Federal Government under this title shall not be directly used by any Federal, State, tribal, or local government to regulate, including an enforcement action, the lawful activities of any entity, including activities relating to monitoring, operating defensive measures, or sharing cyber threat indicators.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id07E20EBBCF3F4F5AA36A56400049B089"><enum>(ii)</enum><header display-inline="yes-display-inline">Exceptions</header>
 <subclause commented="no" display-inline="no-display-inline" id="idCBF33B278D07494EB1B9BFABF96E564E"><enum>(I)</enum><header display-inline="yes-display-inline">Regulatory authority specifically relating to prevention or mitigation of cybersecurity threats</header><text display-inline="yes-display-inline">Cyber threat indicators and defensive measures provided to the Federal Government under this title may, consistent with Federal or State regulatory authority specifically relating to the prevention or mitigation of cybersecurity threats to information systems, inform the development or implementation of regulations relating to such information systems.</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id176DA9CF7D734C1BA1BE3C1FCD1D2534"><enum>(II)</enum><header display-inline="yes-display-inline">Procedures developed and implemented under this title</header><text display-inline="yes-display-inline">Clause (i) shall not apply to procedures developed and implemented under this title.</text> </subclause></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc6842ed051194cfda77e2d250867c1f7" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Protection from liability</header> <subsection commented="no" display-inline="no-display-inline" id="idA56F9B9D8920425C821356A66C4BB593"><enum>(a)</enum><header display-inline="yes-display-inline">Monitoring of information systems</header><text display-inline="yes-display-inline">No cause of action shall lie or be maintained in any court against any private entity, and such action shall be promptly dismissed, for the monitoring of information systems and information under section 104(a) that is conducted in accordance with this title.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id97dc00b638b84749a0fd175d94c3925e"><enum>(b)</enum><header display-inline="yes-display-inline">Sharing or receipt of cyber threat indicators</header><text display-inline="yes-display-inline">No cause of action shall lie or be maintained in any court against any entity, and such action shall be promptly dismissed, for the sharing or receipt of cyber threat indicators or defensive measures under section 104(c) if—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idFBE18C0605034B43A0780EBF456D16AC"><enum>(1)</enum><text display-inline="yes-display-inline">such sharing or receipt is conducted in accordance with this title; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0130D4E9A3E84202B4265D8C7E5F925D"><enum>(2)</enum><text display-inline="yes-display-inline">in a case in which a cyber threat indicator or defensive measure is shared with the Federal Government, the cyber threat indicator or defensive measure is shared in a manner that is consistent with section 105(c)(1)(B) and the sharing or receipt, as the case may be, occurs after the earlier of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2F9C00725094490D93F8202AE7AC183A"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the interim policies and procedures are submitted to Congress under section 105(a)(1) and guidelines are submitted to Congress under section 105(b)(1); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6F3642FC5ED546E5A26CD56AD35A7D7B"><enum>(B)</enum><text display-inline="yes-display-inline">the date that is 60 days after the date of the enactment of this Act.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1a00df004fff47cfabd2fc8e4aeb6824"><enum>(c)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id2628A749FBAE4BFDBDEA971ED403810C"><enum>(1)</enum><text display-inline="yes-display-inline">to require dismissal of a cause of action against an entity that has engaged in gross negligence or willful misconduct in the course of conducting activities authorized by this title; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35E92FB4FEFC403BBF909950A67987A4"><enum>(2)</enum><text display-inline="yes-display-inline">to undermine or limit the availability of otherwise applicable common law or statutory defenses.</text> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id17447f6b123447758c2de795a3e321f1" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Oversight of Government activities</header> <subsection commented="no" display-inline="no-display-inline" id="idE4EF5DD3988D413E95B568BCE925A888"><enum>(a)</enum><header display-inline="yes-display-inline">Biennial report on implementation</header> <paragraph commented="no" display-inline="no-display-inline" id="idF7792866F1EF4DBEB79FFDEB07596A81"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and not less frequently than once every 2 years thereafter, the heads of the appropriate Federal entities shall jointly submit and the Inspector General of the Department of Homeland Security, the Inspector General of the Intelligence Community, the Inspector General of the Department of Justice, the Inspector General of the Department of Defense, and the Inspector General of the Department of Energy, in consultation with the Council of Inspectors General on Financial Oversight, shall jointly submit to Congress a detailed report concerning the implementation of this title during—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id9FA9885375434BF7A23340163DBDD17E"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of the first report submitted under this paragraph, the most recent 1-year period; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA982B1666984B4EBA758DD5ACF32BE6"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of any subsequent report submitted under this paragraph, the most recent 2-year period.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4AE32785598848C698AD7EF79DA8CE26"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include, for the period covered by the report, the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id3852b6f274374eb1b3ab4dbe0f227301"><enum>(A)</enum><text display-inline="yes-display-inline">An assessment of the sufficiency of the policies, procedures, and guidelines required by section 105 in ensuring that cyber threat indicators are shared effectively and responsibly within the Federal Government.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf97d8842dde7429ab273a8a72d7d6be6"><enum>(B)</enum><text display-inline="yes-display-inline">An evaluation of the effectiveness of real-time information sharing through the capability and process developed under section 105(c), including any impediments to such real-time sharing.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef4a7c10103c4ba1ba2f4f5827eb90e6"><enum>(C)</enum><text display-inline="yes-display-inline">An assessment of the sufficiency of the procedures developed under section 103 in ensuring that cyber threat indicators in the possession of the Federal Government are shared in a timely and adequate manner with appropriate entities, or, if appropriate, are made publicly available.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ef99b7506ed4725b88bcf3b26878353"><enum>(D)</enum><text display-inline="yes-display-inline">An assessment of whether cyber threat indicators have been properly classified and an accounting of the number of security clearances authorized by the Federal Government for the purposes of this title.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e05ebad3c344f0b892ecf0f0e47085b"><enum>(E)</enum><text display-inline="yes-display-inline">A review of the type of cyber threat indicators shared with the appropriate Federal entities under this title, including the following:</text>
 <clause commented="no" display-inline="no-display-inline" id="idA9DD27B7A3B84637809C549E8DB0C597"><enum>(i)</enum><text display-inline="yes-display-inline">The number of cyber threat indicators received through the capability and process developed under section 105(c).</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id25C3FFAFA7A34E33A8D253CB05C2B9DC"><enum>(ii)</enum><text display-inline="yes-display-inline">The number of times that information shared under this title was used by a Federal entity to prosecute an offense consistent with section 105(d)(5)(A).</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id2B4083E2628F425192F0F93F9BE56929"><enum>(iii)</enum><text display-inline="yes-display-inline">The degree to which such information may affect the privacy and civil liberties of specific persons.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idD7E07621B03342FC8520747A004FD6AD"><enum>(iv)</enum><text display-inline="yes-display-inline">A quantitative and qualitative assessment of the effect of the sharing of such cyber threat indicators with the Federal Government on privacy and civil liberties of specific persons, including the number of notices that were issued with respect to a failure to remove personal information or information that identified a specific person not directly related to a cybersecurity threat in accordance with the procedures required by section 105(b)(3)(D).</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5FF176C4EBD94EBC9CEF41B2EA547A0A"><enum>(v)</enum><text display-inline="yes-display-inline">The adequacy of any steps taken by the Federal Government to reduce such effect.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08fc3a9133104c3baf7a38569b754d58"><enum>(F)</enum><text display-inline="yes-display-inline">A review of actions taken by the Federal Government based on cyber threat indicators shared with the Federal Government under this title, including the appropriateness of any subsequent use or dissemination of such cyber threat indicators by a Federal entity under section 105.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5b648c83f0d43b287b7d668eaef001c"><enum>(G)</enum><text display-inline="yes-display-inline">A description of any significant violations of the requirements of this title by the Federal Government.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b2f1d8433814428ade548d97c87f735"><enum>(H)</enum><text display-inline="yes-display-inline">A summary of the number and type of entities that received classified cyber threat indicators from the Federal Government under this title and an evaluation of the risks and benefits of sharing such cyber threat indicators.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9554f38981740998167f6db541366b4"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) may include recommendations for improvements or modifications to the authorities and processes under this title.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b279b70a56247d7850d2652285cfd28"><enum>(4)</enum><header display-inline="yes-display-inline">Form of report</header><text display-inline="yes-display-inline">Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id55db35d3c60146b0a1634ae21599f03f"><enum>(b)</enum><header display-inline="yes-display-inline">Reports on privacy and civil liberties</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idad3dfb9c95a84fe59cb725fad2904849"><enum>(1)</enum><header display-inline="yes-display-inline">Biennial report from Privacy and Civil Liberties Oversight Board</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act and not less frequently than once every 2 years thereafter, the Privacy and Civil Liberties Oversight Board shall submit to Congress and the President a report providing—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idaa62163796c9482b8d7ab37fd5499661"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of the effect on privacy and civil liberties by the type of activities carried out under this title; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fa6087e051045f88990a26df97743ed"><enum>(B)</enum><text display-inline="yes-display-inline">an assessment of the sufficiency of the policies, procedures, and guidelines established pursuant to section 105 in addressing concerns relating to privacy and civil liberties.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf317d62d98b45e69576eac9305b0ae9"><enum>(2)</enum><header display-inline="yes-display-inline">Biennial report of Inspectors general</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id138051056BAB4C1FBC824C06F277BF28"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act and not less frequently than once every 2 years thereafter, the Inspector General of the Department of Homeland Security, the Inspector General of the Intelligence Community, the Inspector General of the Department of Justice, the Inspector General of the Department of Defense, and the Inspector General of the Department of Energy shall, in consultation with the Council of Inspectors General on Financial Oversight, jointly submit to Congress a report on the receipt, use, and dissemination of cyber threat indicators and defensive measures that have been shared with Federal entities under this title.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1DE9148571C74CC188D42FB66C2AA983"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under subparagraph (A) shall include the following:</text> <clause commented="no" display-inline="no-display-inline" id="id86dcdbef4fe841e4b4b3d4d0443f316b"><enum>(i)</enum><text display-inline="yes-display-inline">A review of the types of cyber threat indicators shared with Federal entities.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id1bfef3fef3304ab4956bd39b515c6b8a"><enum>(ii)</enum><text display-inline="yes-display-inline">A review of the actions taken by Federal entities as a result of the receipt of such cyber threat indicators.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0ce37ba80e424fbe86b4ffc95a320f43"><enum>(iii)</enum><text display-inline="yes-display-inline">A list of Federal entities receiving such cyber threat indicators.</text> </clause><clause commented="no" display-inline="no-display-inline" id="id04c26c1c89424bc094682760a4d80fea"><enum>(iv)</enum><text display-inline="yes-display-inline">A review of the sharing of such cyber threat indicators among Federal entities to identify inappropriate barriers to sharing information.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f4b2fd399fc4ae3a2aa5d7a721809f4"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">Each report submitted under this subsection may include such recommendations as the Privacy and Civil Liberties Oversight Board, with respect to a report submitted under paragraph (1), or the Inspectors General referred to in paragraph (2)(A), with respect to a report submitted under paragraph (2), may have for improvements or modifications to the authorities under this title.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20850f3c5d8943dbaf14895d0e9d513e"><enum>(4)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">Each report required under this subsection shall be submitted in unclassified form, but may include a classified annex.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id898778e8394a4fe4ad6887b0a43e323a" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Construction and preemption</header>
 <subsection commented="no" display-inline="no-display-inline" id="id01094e3d32d84751adb549236c55ae3c"><enum>(a)</enum><header display-inline="yes-display-inline">Otherwise lawful disclosures</header><text display-inline="yes-display-inline">Nothing in this title shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="id421AB63E624143778D2CFBF8B71AE4CF"><enum>(1)</enum><text display-inline="yes-display-inline">to limit or prohibit otherwise lawful disclosures of communications, records, or other information, including reporting of known or suspected criminal activity, by an entity to any other entity or the Federal Government under this title; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69BDBAC8799C49E3A821441D08D5455B"><enum>(2)</enum><text display-inline="yes-display-inline">to limit or prohibit otherwise lawful use of such disclosures by any Federal entity, even when such otherwise lawful disclosures duplicate or replicate disclosures made under this title.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3b0460af5e864c82b35f384a55e46052"><enum>(b)</enum><header display-inline="yes-display-inline">Whistle blower protections</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to prohibit or limit the disclosure of information protected under section 2302(b)(8) of title 5, United States Code (governing disclosures of illegality, waste, fraud, abuse, or public health or safety threats), section 7211 of title 5, United States Code (governing disclosures to Congress), section 1034 of title 10, United States Code (governing disclosure to Congress by members of the military), section 1104 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3234">50 U.S.C. 3234</external-xref>) (governing disclosure by employees of elements of the intelligence community), or any similar provision of Federal or State law.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id0428049fd23d498f8726928467ba72c4"><enum>(c)</enum><header display-inline="yes-display-inline">Protection of sources and methods</header><text display-inline="yes-display-inline">Nothing in this title shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="id1e77f6c5be6d4bc498e4f3d0b548e80a"><enum>(1)</enum><text display-inline="yes-display-inline">as creating any immunity against, or otherwise affecting, any action brought by the Federal Government, or any agency or department thereof, to enforce any law, executive order, or procedure governing the appropriate handling, disclosure, or use of classified information;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a648a7f478445af8fae3a8818867252"><enum>(2)</enum><text display-inline="yes-display-inline">to affect the conduct of authorized law enforcement or intelligence activities; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id831996503a3b455fa9d4ea31cca7b6ea"><enum>(3)</enum><text display-inline="yes-display-inline">to modify the authority of a department or agency of the Federal Government to protect classified information and sources and methods and the national security of the United States.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id52d5f3a83ecc471f90bd1edf09a99d23"><enum>(d)</enum><header display-inline="yes-display-inline">Relationship to other laws</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to affect any requirement under any other provision of law for an entity to provide information to the Federal Government.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id09bd6b0d51e1459c9e5ec1a3f437a4b7"><enum>(e)</enum><header display-inline="yes-display-inline">Prohibited conduct</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to permit price-fixing, allocating a market between competitors, monopolizing or attempting to monopolize a market, boycotting, or exchanges of price or cost information, customer lists, or information regarding future competitive planning.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id0368eef2178849c7aefb212bd9af543b"><enum>(f)</enum><header display-inline="yes-display-inline">Information sharing relationships</header><text display-inline="yes-display-inline">Nothing in this title shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="id9e1f9b73e5644e58ab28bb21ae4bc802"><enum>(1)</enum><text display-inline="yes-display-inline">to limit or modify an existing information sharing relationship;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a330e2010a04e84b09fc175f1b6e19a"><enum>(2)</enum><text display-inline="yes-display-inline">to prohibit a new information sharing relationship;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66bcf9a068a140b99eb5fcb43fc1756e"><enum>(3)</enum><text display-inline="yes-display-inline">to require a new information sharing relationship between any entity and another entity or a Federal entity; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d383d9defeb4873879900d9607d47ed"><enum>(4)</enum><text display-inline="yes-display-inline">to require the use of the capability and process within the Department of Homeland Security developed under section 105(c).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE5357ED55B784464B28AD07F58B503D4"><enum>(g)</enum><header display-inline="yes-display-inline">Preservation of contractual obligations and rights</header><text display-inline="yes-display-inline">Nothing in this title shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="id1971448dd2694a959980eee0f37b4fa7"><enum>(1)</enum><text display-inline="yes-display-inline">to amend, repeal, or supersede any current or future contractual agreement, terms of service agreement, or other contractual relationship between any entities, or between any entity and a Federal entity; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDC7096C89EA747C4935C7F2A8A8FE619"><enum>(2)</enum><text display-inline="yes-display-inline">to abrogate trade secret or intellectual property rights of any entity or Federal entity.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfc76defb0e374ca2af80fae94395eab1"><enum>(h)</enum><header display-inline="yes-display-inline">Anti-tasking restriction</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to permit a Federal entity—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id9799dd6d733545b8893b4b08126ca85c"><enum>(1)</enum><text display-inline="yes-display-inline">to require an entity to provide information to a Federal entity or another entity;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id707a8c0eeb50482fa43ad91ebae21779"><enum>(2)</enum><text display-inline="yes-display-inline">to condition the sharing of cyber threat indicators with an entity on such entity’s provision of cyber threat indicators to a Federal entity or another entity; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEC05A50E34E14EA392E8C2073F545B48"><enum>(3)</enum><text display-inline="yes-display-inline">to condition the award of any Federal grant, contract, or purchase on the provision of a cyber threat indicator to a Federal entity or another entity.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id166289c7280b426692f84d11fc89245f"><enum>(i)</enum><header display-inline="yes-display-inline">No liability for non-participation</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to subject any entity to liability for choosing not to engage in the voluntary activities authorized in this title.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id8f83fea1bb424982a443ed0a45348031"><enum>(j)</enum><header display-inline="yes-display-inline">Use and retention of information</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to authorize, or to modify any existing authority of, a department or agency of the Federal Government to retain or use any information shared under this title for any use other than permitted in this title.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0ebbc5ec18b344fc9a62946d240cd1aa"><enum>(k)</enum><header display-inline="yes-display-inline">Federal preemption</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id1b518304a8e341f297ae1fd88a7016b5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This title supersedes any statute or other provision of law of a State or political subdivision of a State that restricts or otherwise expressly regulates an activity authorized under this title.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd735561560c94aac89a78e67e5d83c14"><enum>(2)</enum><header display-inline="yes-display-inline">State law enforcement</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to supersede any statute or other provision of law of a State or political subdivision of a State concerning the use of authorized law enforcement practices and procedures.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC2B69684B97946DB95AE520587D3BC3A"><enum>(l)</enum><header display-inline="yes-display-inline">Regulatory authority</header><text display-inline="yes-display-inline">Nothing in this title shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="id3554DA6E85034573813908982840758B"><enum>(1)</enum><text display-inline="yes-display-inline">to authorize the promulgation of any regulations not specifically authorized by this title;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86067F7520B4499B866349D8F1DF6E0E"><enum>(2)</enum><text display-inline="yes-display-inline">to establish or limit any regulatory authority not specifically established or limited under this title; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64A7E6012A344CA385F6955A5BDB056E"><enum>(3)</enum><text display-inline="yes-display-inline">to authorize regulatory actions that would duplicate or conflict with regulatory requirements, mandatory standards, or related processes under another provision of Federal law.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0A1A27EF81FF4CB4991EB890DD9B3E79"><enum>(m)</enum><header display-inline="yes-display-inline">Authority of Secretary of Defense To respond to cyber attacks</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to limit the authority of the Secretary of Defense to develop, prepare, coordinate, or, when authorized by the President to do so, conduct a military cyber operation in response to a malicious cyber activity carried out against the United States or a United States person by a foreign government or an organization sponsored by a foreign government or a terrorist organization.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HC8808302347C" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Report on cybersecurity threats</header>
 <subsection commented="no" display-inline="no-display-inline" id="id319c98d8c890488ea2b4da1fc36a1a28"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence, in coordination with the heads of other appropriate elements of the intelligence community, shall submit to the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives a report on cybersecurity threats, including cyber attacks, theft, and data breaches.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idAABD4A36414A4923948A0D6AAA4D1E81"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="id9b1e0e0223d344a2bcc1f35ff5ca139d"><enum>(1)</enum><text display-inline="yes-display-inline">An assessment of the current intelligence sharing and cooperation relationships of the United States with other countries regarding cybersecurity threats, including cyber attacks, theft, and data breaches, directed against the United States and which threaten the United States national security interests and economy and intellectual property, specifically identifying the relative utility of such relationships, which elements of the intelligence community participate in such relationships, and whether and how such relationships could be improved.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28a5353763b44f3eb432e2cb164ced1f"><enum>(2)</enum><text display-inline="yes-display-inline">A list and an assessment of the countries and nonstate actors that are the primary threats of carrying out a cybersecurity threat, including a cyber attack, theft, or data breach, against the United States and which threaten the United States national security, economy, and intellectual property.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id828caee5365c4b249cbfed9a1266ffc5"><enum>(3)</enum><text display-inline="yes-display-inline">A description of the extent to which the capabilities of the United States Government to respond to or prevent cybersecurity threats, including cyber attacks, theft, or data breaches, directed against the United States private sector are degraded by a delay in the prompt notification by private entities of such threats or cyber attacks, theft, and breaches.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb66f1fd645c04a44857613c169a72508"><enum>(4)</enum><text display-inline="yes-display-inline">An assessment of additional technologies or capabilities that would enhance the ability of the United States to prevent and to respond to cybersecurity threats, including cyber attacks, theft, and data breaches.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide21f74c3df7a4c5094f37035251cb41e"><enum>(5)</enum><text display-inline="yes-display-inline">An assessment of any technologies or practices utilized by the private sector that could be rapidly fielded to assist the intelligence community in preventing and responding to cybersecurity threats.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2396F12617E54CD688A194B9691CF0B4"><enum>(c)</enum><header display-inline="yes-display-inline">Additional report</header><text display-inline="yes-display-inline">At the time the report required by subsection (a) is submitted, the Director of National Intelligence shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report containing the information required by subsection (b)(2).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id902c7f7e1ff04b75acd854275f832d2e"><enum>(d)</enum><header display-inline="yes-display-inline">Form of report</header><text display-inline="yes-display-inline">The report required by subsection (a) shall be made available in classified and unclassified forms.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idA121043EDE794607B8B50F6A369A0B95"><enum>(e)</enum><header display-inline="yes-display-inline">Intelligence community defined</header><text display-inline="yes-display-inline">In this section, the term <term>intelligence community</term> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="idd1aad41644974051a07957b0cab75563" section-type="subsequent-section"><enum>110.</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="no-display-inline">Section 941(c)(3) of the National Defense Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/239">Public Law 112–239</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2224">10 U.S.C. 2224</external-xref> note) is amended by inserting at the end the following: <quote>The Secretary may share such information with other Federal entities if such information consists of cyber threat indicators and defensive measures and such information is shared consistent with the policies and procedures promulgated by the Attorney General and the Secretary of Homeland Security under section 105 of the <short-title>Cybersecurity Information Sharing Act of 2015</short-title>.</quote>.</text>

 <section commented="no" display-inline="no-display-inline" id="idF5E5C115ECA74868B359608C943A0551" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Federal Cybersecurity Enhancement Act of 2015</short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="id86C13F8EF018432185CD9A8C12328A80" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title—</text> <paragraph commented="no" display-inline="no-display-inline" id="id2673D6CDA0BC4084AFBFFA2486F3871E"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the meaning given the term in section 3502 of title 44, United States Code;</text>

 <paragraph commented="no" display-inline="no-display-inline" id="id6cec1332df5243cb9962f9881a4f1223"><enum>(1)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Director of the Office of Management and Budget, shall develop and implement an intrusion assessment plan to identify and remove intruders in agency information systems.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6bfc71a984994034a9faa0f20ef6e6ea"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The intrusion assessment plan required under paragraph (1) shall not apply to the Department of Defense, a national security system, or an element of the intelligence community.</text></paragraph></subsection></section><after-quoted-block>; </after-quoted-block></quoted-block>

 <subsection commented="no" display-inline="no-display-inline" id="idBF5E65F4A6014074AFEE3DE53A420AA8"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="id6076F1F9D3AB4A9A95EFBC892B3E202D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the meaning given that term in section 3502 of title 44, United States Code;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id709FD18BC0EE4D20ABFBC11320FA4F7D"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>agency information</term> means information collected or maintained by or on behalf of an agency;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF35A9471D0244DF1A467FF269C39E00B"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>agency information system</term> has the meaning given the term in section 228; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80DE6432B03F498FA359FE8B98883B98"><enum>(4)</enum><text display-inline="yes-display-inline">the terms <term>cybersecurity risk</term> and <term>information system</term> have the meanings given those terms in section 227.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2AE9BBE3B6594D93A8304CB70B14E2CF"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header> <paragraph commented="no" display-inline="no-display-inline" id="id58B7B3EFF40E49F889372A335096ABD0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall deploy, operate, and maintain, to make available for use by any agency, with or without reimbursement—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id9095cdb8620a4ed89192bb9b78e9d24d"><enum>(A)</enum><text display-inline="yes-display-inline">a capability to detect cybersecurity risks in network traffic transiting or traveling to or from an agency information system; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id585bd50465e742e4a1f22ee8d26d51a3"><enum>(B)</enum><text display-inline="yes-display-inline">a capability to prevent network traffic associated with such cybersecurity risks from transiting or traveling to or from an agency information system or modify such network traffic to remove the cybersecurity risk.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25F34699A25148AA99C90A92E5597C1E"><enum>(2)</enum><header display-inline="yes-display-inline">Regular improvement</header><text display-inline="yes-display-inline">The Secretary shall regularly deploy new technologies and modify existing technologies to the intrusion detection and prevention capabilities described in paragraph (1) as appropriate to improve the intrusion detection and prevention capabilities.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id48ac7881edd7411aa42c5330292feb4b"><enum>(c)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">In carrying out subsection (b), the Secretary—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7c27eb0a61974c6f86df85a7b0d30565"><enum>(1)</enum><text display-inline="yes-display-inline">may access, and the head of an agency may disclose to the Secretary or a private entity providing assistance to the Secretary under paragraph (2), information transiting or traveling to or from an agency information system, regardless of the location from which the Secretary or a private entity providing assistance to the Secretary under paragraph (2) accesses such information, notwithstanding any other provision of law that would otherwise restrict or prevent the head of an agency from disclosing such information to the Secretary or a private entity providing assistance to the Secretary under paragraph (2);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0edb5a3d7504231934b833ae5837e0b"><enum>(2)</enum><text display-inline="yes-display-inline">may enter into contracts or other agreements with, or otherwise request and obtain the assistance of, private entities to deploy and operate technologies in accordance with subsection (b);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee92f108c7e64062a1eaea9d6faf268d"><enum>(3)</enum><text display-inline="yes-display-inline">may retain, use, and disclose information obtained through the conduct of activities authorized under this section only to protect information and information systems from cybersecurity risks;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcad97d0ea79e40ea999f11b1ad8498c3"><enum>(4)</enum><text display-inline="yes-display-inline">shall regularly assess through operational test and evaluation in real world or simulated environments available advanced protective technologies to improve detection and prevention capabilities, including commercial and non-commercial technologies and detection technologies beyond signature-based detection, and utilize such technologies when appropriate;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE51E30ECF7441B58DE8B322D32E21D3"><enum>(5)</enum><text display-inline="yes-display-inline">shall establish a pilot to acquire, test, and deploy, as rapidly as possible, technologies described in paragraph (4);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd1d27e2cde540a79d9684cc8e822856"><enum>(6)</enum><text display-inline="yes-display-inline">shall periodically update the privacy impact assessment required under section 208(b) of the E-Government Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf67c8242b2d4c58a012a16f47d24078"><enum>(7)</enum><text display-inline="yes-display-inline">shall ensure that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4c1f3a22d5144a1a8abb9edbd5614538"><enum>(A)</enum><text display-inline="yes-display-inline">activities carried out under this section are reasonably necessary for the purpose of protecting agency information and agency information systems from a cybersecurity risk;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d2db55a0ff5418d9cb7ab82af9fb2d8"><enum>(B)</enum><text display-inline="yes-display-inline">information accessed by the Secretary will be retained no longer than reasonably necessary for the purpose of protecting agency information and agency information systems from a cybersecurity risk;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc45595a049c841738a10ff49087e48e7"><enum>(C)</enum><text display-inline="yes-display-inline">notice has been provided to users of an agency information system concerning access to communications of users of the agency information system for the purpose of protecting agency information and the agency information system; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8561b45ed5be473baf4413873bb84b71"><enum>(D)</enum><text display-inline="yes-display-inline">the activities are implemented pursuant to policies and procedures governing the operation of the intrusion detection and prevention capabilities.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc30086ab58b64861bb1e69d599045868"><enum>(d)</enum><header display-inline="yes-display-inline">Private entities</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idf43e407097d24b33956d6c3d92c7571b"><enum>(1)</enum><header display-inline="yes-display-inline">Conditions</header><text display-inline="yes-display-inline">A private entity described in subsection (c)(2) may not—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idaccc35542ff54507a2f796d1aa42617c"><enum>(A)</enum><text display-inline="yes-display-inline">disclose any network traffic transiting or traveling to or from an agency information system to any entity without the consent of the Department or the agency that disclosed the information under subsection (c)(1); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b65c6ab78314666861b68075eca668d"><enum>(B)</enum><text display-inline="yes-display-inline">use any network traffic transiting or traveling to or from an agency information system to which the private entity gains access in accordance with this section for any purpose other than to protect agency information and agency information systems against cybersecurity risks or to administer a contract or other agreement entered into pursuant to subsection (c)(2) or as part of another contract with the Secretary.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id713548701c444d868df242c2d337f30d"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on liability</header><text display-inline="yes-display-inline">No cause of action shall lie in any court against a private entity for assistance provided to the Secretary in accordance with this section and any contract or agreement entered into pursuant to subsection (c)(2).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF710E01DBFD346E8ACCD3D0E88DCE4C2"><enum>(3)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in paragraph (2) shall be construed to authorize an Internet service provider to break a user agreement with a customer without the consent of the customer.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8ecf7225bd6043f5b1cde47a1c543fdc"><enum>(e)</enum><header display-inline="yes-display-inline">Attorney General review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Attorney General shall review the policies and guidelines for the program carried out under this section to ensure that the policies and guidelines are consistent with applicable law governing the acquisition, interception, retention, use, and disclosure of communications.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id890c6f0c90c44c64ab8fd9de4459c08d"><enum>(b)</enum><header display-inline="yes-display-inline">Prioritizing advanced security tools</header><text display-inline="yes-display-inline">The Director and the Secretary, in consultation with appropriate agencies, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idB87E6B1793F54AF29EFA768CFC1D2807"><enum>(1)</enum><text display-inline="yes-display-inline">review and update governmentwide policies and programs to ensure appropriate prioritization and use of network security monitoring tools within agency networks; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B90469052274F018B32A389CBA882FD"><enum>(2)</enum><text display-inline="yes-display-inline">brief appropriate congressional committees on such prioritization and use.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4867C86C3B164AF8BE57264C44D598C0"><enum>(c)</enum><header display-inline="yes-display-inline">Agency responsibilities</header> <paragraph commented="no" display-inline="no-display-inline" id="id10315EA04D9F4A64A4B5317A076E983B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idC496352CC9A24AF09E60BA4650CD75E8"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act or 2 months after the date on which the Secretary makes available the intrusion detection and prevention capabilities under section 230(b)(1) of the Homeland Security Act of 2002, as added by subsection (a), whichever is later, the head of each agency shall apply and continue to utilize the capabilities to all information traveling between an agency information system and any information system other than an agency information system; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F2A9FAA844848A48756ACE6F5EF79F4"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 6 months after the date on which the Secretary makes available improvements to the intrusion detection and prevention capabilities pursuant to section 230(b)(2) of the Homeland Security Act of 2002, as added by subsection (a), the head of each agency shall apply and continue to utilize the improved intrusion detection and prevention capabilities.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF92F1F4881B4B4DBEFDF93312A7F779"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The requirements under paragraph (1) shall not apply to the Department of Defense, a national security system, or an element of the intelligence community.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24D850EF1F9B4D83B96BE9295ECFF257"><enum>(3)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection only, the term <term>agency information system</term> means an information system owned or operated by an agency.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8708C6193DA4152B439CA9EB6D9D7A9"><enum>(4)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to limit an agency from applying the intrusion detection and prevention capabilities under section 230(b)(1) of the Homeland Security Act of 2002, as added by subsection (a), at the discretion of the head of the agency or as provided in relevant policies, directives, and guidelines.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE14612F7F85046B88C989027C52269EC"><enum>(d)</enum><header display-inline="yes-display-inline">Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> note) is amended by striking the items relating to the first section designated as section 226, the second section designated as section 226 (relating to the national cybersecurity and communications integration center), section 227, and section 228 and inserting the following:</text>

				<subsection commented="no" display-inline="no-display-inline" id="id349cd0473fb54154876663862bad5837"><enum>(a)</enum><header display-inline="yes-display-inline">Advanced network security tools</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idD89B63CBFA7F4054B10F88142CC4A4BA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall include in the Continuous Diagnostics and Mitigation Program advanced network security tools to improve visibility of network activity, including through the use of commercial and free or open source tools, to detect and mitigate intrusions and anomalous activity.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6653e1e7f104bfc90129499101bc7e3"><enum>(2)</enum><header display-inline="yes-display-inline">Development of plan</header><text display-inline="yes-display-inline">The Director shall develop and implement a plan to ensure that each agency utilizes advanced network security tools, including those described in paragraph (1), to detect and mitigate intrusions and anomalous activity.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ided6595bfe8b14c5da02c76922dee84e6"><enum>(b)</enum><header display-inline="yes-display-inline">Improved metrics</header><text display-inline="yes-display-inline">The Secretary, in collaboration with the Director, shall review and update the metrics used to measure security under section 3554 of title 44, United States Code, to include measures of intrusion and incident detection and response times.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id867b11e2b8dd493599f8ea0f9b0d696a"><enum>(c)</enum><header display-inline="yes-display-inline">Transparency and accountability</header><text display-inline="yes-display-inline">The Director, in consultation with the Secretary, shall increase transparency to the public on agency cybersecurity posture, including by increasing the number of metrics available on Federal Government performance websites and, to the greatest extent practicable, displaying metrics for department components, small agencies, and micro agencies.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id0A731E28507046258C3166D6BB40DC94"><enum>(d)</enum><header display-inline="yes-display-inline">Maintenance of technologies</header><text display-inline="yes-display-inline">Section 3553(b)(6)(B) of title 44, United States Code, is amended by inserting <quote>, operating, and maintaining</quote> after <quote>deploying</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="id1DB9713BD22C410D9C96ADCDD6F6436C"><enum>(e)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The requirements under this section shall not apply to the Department of Defense, a national security system, or an element of the intelligence community.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id21efee13c23440b0811ad274b624b397" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Federal cybersecurity requirements</header>
 <subsection commented="no" display-inline="no-display-inline" id="idb956e16ea69f4a408558d8ae7bbabdf4"><enum>(a)</enum><header display-inline="yes-display-inline">Implementation of federal cybersecurity standards</header><text display-inline="yes-display-inline">Consistent with section 3553 of title 44, United States Code, the Secretary, in consultation with the Director, shall exercise the authority to issue binding operational directives to assist the Director in ensuring timely agency adoption of and compliance with policies and standards promulgated under section 11331 of title 40, United States Code, for securing agency information systems.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0f440e58f79347f597a902a224ea1e96"><enum>(b)</enum><header display-inline="yes-display-inline">Cybersecurity requirements at agencies</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ide4219ec6687f4bb1bd51329fd3834a0e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Consistent with policies, standards, guidelines, and directives on information security under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, and the standards and guidelines promulgated under section 11331 of title 40, United States Code, and except as provided in paragraph (2), not later than 1 year after the date of the enactment of this Act, the head of each agency shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id1e90a12e31f843ef95159871f2cd1700"><enum>(A)</enum><text display-inline="yes-display-inline">identify sensitive and mission critical data stored by the agency consistent with the inventory required under the first subsection (c) (relating to the inventory of major information systems) and the second subsection (c) (relating to the inventory of information systems) of section 3505 of title 44, United States Code;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41dac44c19534c9288e0e48df57cbe33"><enum>(B)</enum><text display-inline="yes-display-inline">assess access controls to the data described in subparagraph (A), the need for readily accessible storage of the data, and individuals' need to access the data;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc5b3aade42b492cb17909c81691c06e"><enum>(C)</enum><text display-inline="yes-display-inline">encrypt or otherwise render indecipherable to unauthorized users the data described in subparagraph (A) that is stored on or transiting agency information systems;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6fc9a99ac42b45e0bf69381bd150b6a8"><enum>(D)</enum><text display-inline="yes-display-inline">implement a single sign-on trusted identity platform for individuals accessing each public website of the agency that requires user authentication, as developed by the Administrator of General Services in collaboration with the Secretary; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0aa2285c4822494a9a93500a416cdcd4"><enum>(E)</enum><text display-inline="yes-display-inline">implement identity management consistent with section 504 of the Cybersecurity Enhancement Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/274">Public Law 113–274</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/7464">15 U.S.C. 7464</external-xref>), including multi-factor authentication, for—</text>
 <clause commented="no" display-inline="no-display-inline" id="id21f9d71ef5114f9abdcc83c43dc9d807"><enum>(i)</enum><text display-inline="yes-display-inline">remote access to an agency information system; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id292541e0e5964679a36675fc5507022d"><enum>(ii)</enum><text display-inline="yes-display-inline">each user account with elevated privileges on an agency information system.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1ffea8896a948d5a92bb3010828a274"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The requirements under paragraph (1) shall not apply to an agency information system for which—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfa33ab4e3bd946338edb2696bf20dc0f"><enum>(A)</enum><text display-inline="yes-display-inline">the head of the agency has personally certified to the Director with particularity that—</text>
 <clause commented="no" display-inline="no-display-inline" id="id90c02b86ce274b8b979f3f7f75be023e"><enum>(i)</enum><text display-inline="yes-display-inline">operational requirements articulated in the certification and related to the agency information system would make it excessively burdensome to implement the cybersecurity requirement;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id60d9b42902dd45b5bc392466b04fa73b"><enum>(ii)</enum><text display-inline="yes-display-inline">the cybersecurity requirement is not necessary to secure the agency information system or agency information stored on or transiting it; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6e77b556a991442884f3e7dafc84e480"><enum>(iii)</enum><text display-inline="yes-display-inline">the agency has taken all necessary steps to secure the agency information system and agency information stored on or transiting it; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7bf9f76df7043999b80f45356677475"><enum>(B)</enum><text display-inline="yes-display-inline">the head of the agency or the designee of the head of the agency has submitted the certification described in subparagraph (A) to the appropriate congressional committees and the agency’s authorizing committees.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3bf1c84c536945839b722a1656c39811"><enum>(3)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to alter the authority of the Secretary, the Director, or the Director of the National Institute of Standards and Technology in implementing subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code. Nothing in this section shall be construed to affect the National Institute of Standards and Technology standards process or the requirement under section 3553(a)(4) of such title or to discourage continued improvements and advancements in the technology, standards, policies, and guidelines used to promote Federal information security.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF0DB257810C3418FA0D0A232A27E5DC9"><enum>(c)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The requirements under this section shall not apply to the Department of Defense, a national security system, or an element of the intelligence community.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idE98CA081137049CC87BF3C6B18F625E1" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Assessment; reports</header>
 <subsection commented="no" display-inline="no-display-inline" id="idacabf89fa6aa4f53aa72b76c272b70a8"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="id4ddfdd3d7b01447597315ef2c9bcf021"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>intrusion assessments</term> means actions taken under the intrusion assessment plan to identify and remove intruders in agency information systems;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8895ef7ae65d486fb7326cbb7c162761"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>intrusion assessment plan</term> means the plan required under section 228(b)(1) of the Homeland Security Act of 2002, as added by section 203(a) of this Act; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb440e54e2a0643319a48c7e47368169d"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>intrusion detection and prevention capabilities</term> means the capabilities required under section 230(b) of the Homeland Security Act of 2002, as added by section 203(a) of this Act.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idec063aaf35bb4c9eaf13ff3ee1319a47"><enum>(b)</enum><header display-inline="yes-display-inline">Third party assessment</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Government Accountability Office shall conduct a study and publish a report on the effectiveness of the approach and strategy of the Federal Government to securing agency information systems, including the intrusion detection and prevention capabilities and the intrusion assessment plan.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idb10c596d49d74da48474162bcc6ab9c9"><enum>(c)</enum><header display-inline="yes-display-inline">Reports to Congress</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idcea5a269c7ee459fafca7e13562d2ef1"><enum>(1)</enum><header display-inline="yes-display-inline">Intrusion detection and prevention capabilities</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id38cbb55632434032af2a30d43b8a7a63"><enum>(A)</enum><header display-inline="yes-display-inline">Secretary of Homeland Security report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to the appropriate congressional committees a report on the status of implementation of the intrusion detection and prevention capabilities, including—</text>
 <clause commented="no" display-inline="no-display-inline" id="id15d8681a761a42ef98b033ac7cf9d9c8"><enum>(i)</enum><text display-inline="yes-display-inline">a description of privacy controls;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id36b16132f5bd41399650043ed7f6e9f7"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of the technologies and capabilities utilized to detect cybersecurity risks in network traffic, including the extent to which those technologies and capabilities include existing commercial and non-commercial technologies;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idc2759225983f4f4291387e04dd1ce81d"><enum>(iii)</enum><text display-inline="yes-display-inline">a description of the technologies and capabilities utilized to prevent network traffic associated with cybersecurity risks from transiting or traveling to or from agency information systems, including the extent to which those technologies and capabilities include existing commercial and non-commercial technologies;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id751a9e3715ad420b8cc703dccecd9dfd"><enum>(iv)</enum><text display-inline="yes-display-inline">a list of the types of indicators or other identifiers or techniques used to detect cybersecurity risks in network traffic transiting or traveling to or from agency information systems on each iteration of the intrusion detection and prevention capabilities and the number of each such type of indicator, identifier, and technique;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idd512ec7e063a4f49bf7b98588b33395b"><enum>(v)</enum><text display-inline="yes-display-inline">the number of instances in which the intrusion detection and prevention capabilities detected a cybersecurity risk in network traffic transiting or traveling to or from agency information systems and the number of times the intrusion detection and prevention capabilities blocked network traffic associated with cybersecurity risk; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3D6D19E724264687A03797E17AF13E12"><enum>(vi)</enum><text display-inline="yes-display-inline">a description of the pilot established under section 230(c)(5) of the Homeland Security Act of 2002, as added by section 203(a) of this Act, including the number of new technologies tested and the number of participating agencies.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca5fb27f079d43f1b4eeadbd6ab5bb6b"><enum>(B)</enum><header display-inline="yes-display-inline">OMB report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, and annually thereafter, the Director shall submit to Congress, as part of the report required under section 3553(c) of title 44, United States Code, an analysis of agency application of the intrusion detection and prevention capabilities, including—</text>
 <clause commented="no" display-inline="no-display-inline" id="id7f8edd660fc44725ad1dfc5ee2ce28ed"><enum>(i)</enum><text display-inline="yes-display-inline">a list of each agency and the degree to which each agency has applied the intrusion detection and prevention capabilities to an agency information system; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idf7a48c8f730c4dee8fbe90308b9b24a2"><enum>(ii)</enum><text display-inline="yes-display-inline">a list by agency of—</text> <subclause commented="no" display-inline="no-display-inline" id="id8C7DA083698B4C9F85734565BD3419E6"><enum>(I)</enum><text display-inline="yes-display-inline">the number of instances in which the intrusion detection and prevention capabilities detected a cybersecurity risk in network traffic transiting or traveling to or from an agency information system and the types of indicators, identifiers, and techniques used to detect such cybersecurity risks; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id3F0EAAA499AD4C738C48220496F0CDF3"><enum>(II)</enum><text display-inline="yes-display-inline">the number of instances in which the intrusion detection and prevention capabilities prevented network traffic associated with a cybersecurity risk from transiting or traveling to or from an agency information system and the types of indicators, identifiers, and techniques used to detect such agency information systems.</text>
								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2694312433544ba4b8b5441cf31e05cf"><enum>(2)</enum><header display-inline="yes-display-inline">OMB report on development and implementation of intrusion assessment plan, advanced internal
 defenses, and Federal cybersecurity best practices</header><text display-inline="yes-display-inline">The Director shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id7aafd20e5684443f83d13be44fff7ac5"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 6 months after the date of enactment of this Act, and 30 days after any update thereto, submit the intrusion assessment plan to the appropriate congressional committees;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0ece71f199e04142a20c41db9ad7f405"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, and annually thereafter, submit to Congress, as part of the report required under section 3553(c) of title 44, United States Code—</text>
 <clause commented="no" display-inline="no-display-inline" id="idCC6ECD6EB2C745D28DF8E8020F46F1EF"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the implementation of the intrusion assessment plan;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3C224127FCEC48BD8523D0E102817DA8"><enum>(ii)</enum><text display-inline="yes-display-inline">the findings of the intrusion assessments conducted pursuant to the intrusion assessment plan;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id7dc453f6e05c4bd89031a4de77320f41"><enum>(iii)</enum><text display-inline="yes-display-inline">advanced network security tools included in the Continuous Diagnostics and Mitigation Program pursuant to section 204(a)(1);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id92916342261a4c7981faa31a23b48f76"><enum>(iv)</enum><text display-inline="yes-display-inline">the results of the assessment of the Secretary of best practices for Federal cybersecurity pursuant to section 205(a); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idfcf7bee5940d4ad3846dae45a3e7a758"><enum>(v)</enum><text display-inline="yes-display-inline">a list by agency of compliance with the requirements of section 205(b); and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf12e180f1bde4bb9a3468bc135bdf172"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, submit to the appropriate congressional committees—</text>
 <clause commented="no" display-inline="no-display-inline" id="id9453d3d143a947a097980f0b0b28cebd"><enum>(i)</enum><text display-inline="yes-display-inline">a copy of the plan developed pursuant to section 204(a)(2); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idbffcc3a8557343619c54563dff472645"><enum>(ii)</enum><text display-inline="yes-display-inline">the improved metrics developed pursuant to section 204(b).</text>
							</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idcfd62630c37549d797ec8d610edcae77" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Termination</header>
 <subsection commented="no" display-inline="no-display-inline" id="idB314B56F204A47D299CCA5DB066D0244"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authority provided under section 230 of the Homeland Security Act of 2002, as added by section 203(a) of this Act, and the reporting requirements under section 206(c) shall terminate on the date that is 7 years after the date of enactment of this Act.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id8BAB76D5FDF2448ABF2FBBB27D812E0C"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (a) shall be construed to affect the limitation of liability of a private entity for assistance provided to the Secretary under section 230(d)(2) of the Homeland Security Act of 2002, as added by section 203(a) of this Act, if such assistance was rendered before the termination date under subsection (a) or otherwise during a period in which the assistance was authorized.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idb44bf9fcfa1b463d9522db4ebd959a62" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Identification of information systems relating to national security</header>
 <subsection commented="no" display-inline="no-display-inline" id="idD8789F3160304EBBAEA8BF9726BEFC35"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c), not later than 180 days after the date of enactment of this Act—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id9BCF8EC0E24645A7AEB56F843CF96C4E"><enum>(1)</enum><text display-inline="yes-display-inline">the Director of National Intelligence and the Director of the Office of Management and Budget, in coordination with the heads of other agencies, shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8EB9F4FE0ABE437F8DCD43B95F66ED30"><enum>(A)</enum><text display-inline="yes-display-inline">identify all unclassified information systems that provide access to information that may provide an adversary with the ability to derive information that would otherwise be considered classified;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6988503247B4488197D6FCCFBDF4F594"><enum>(B)</enum><text display-inline="yes-display-inline">assess the risks that would result from the breach of each unclassified information system identified in subparagraph (A); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1330F1BA12948A9AD9A8B1D33DFD7B9"><enum>(C)</enum><text display-inline="yes-display-inline">assess the cost and impact on the mission carried out by each agency that owns an unclassified information system identified in subparagraph (A) if the system were to be subsequently designated as a national security system; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34FCAB42F9D644718430154A4FA015BF"><enum>(2)</enum><text display-inline="yes-display-inline">the Director of National Intelligence and the Director of the Office of Management and Budget shall submit to the appropriate congressional committees, the Select Committee on Intelligence of the Senate, and the Permanent Select Committee on Intelligence of the House of Representatives a report that includes the findings under paragraph (1).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2D80FB59CF2D4F5091816A317C918E96"><enum>(b)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report submitted under subsection (a)(2) shall be in unclassified form, and shall include a classified annex.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idF68A73FC1F6C4A608503792F9CFC0DA4"><enum>(c)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The requirements under subsection (a)(1) shall not apply to the Department of Defense, a national security system, or an element of the intelligence community.</text></subsection><subsection id="id6ED09DC2A302467C902815A777BEA740"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to designate an information system as a national security system.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id7EDA3A5EA84F41649C2875244DACC181" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">Direction to agencies</header>
 <subsection commented="no" display-inline="no-display-inline" id="id5E5EA15FE2384D939ED0D7B1780C41A0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3553 of title 44, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id0C6DCF39E8DD4935B521D4D6B713A2D9" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id6039cff1fa0b4ade97c0b8249a63704a"><enum>(h)</enum><header display-inline="yes-display-inline">Direction to agencies</header> <paragraph commented="no" display-inline="no-display-inline" id="id0d3eb4c743004d8898b8eb69e41891fe"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header> <subparagraph commented="no" display-inline="no-display-inline" id="id5a84dc76cc394980a596ff7afd332c23"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), in response to a known or reasonably suspected information security threat, vulnerability, or incident that represents a substantial threat to the information security of an agency, the Secretary may issue an emergency directive to the head of an agency to take any lawful action with respect to the operation of the information system, including such systems used or operated by another entity on behalf of an agency, that collects, processes, stores, transmits, disseminates, or otherwise maintains agency information, for the purpose of protecting the information system from, or mitigating, an information security threat.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97a2123c499f4f6ba50498206c3c0fac"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The authorities of the Secretary under this subsection shall not apply to a system described subsection (d) or to a system described in paragraph (2) or (3) of subsection (e).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id105e4d1a271841aa9b8e872f1bd1d866"><enum>(2)</enum><header display-inline="yes-display-inline">Procedures for use of authority</header><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idffdae9422a464c1cb0ad2c6338b71f22"><enum>(A)</enum><text display-inline="yes-display-inline">in coordination with the Director, establish procedures governing the circumstances under which a directive may be issued under this subsection, which shall include—</text>
 <clause commented="no" display-inline="no-display-inline" id="idca659fd5e1614fd98dec2b8d67fae2eb"><enum>(i)</enum><text display-inline="yes-display-inline">thresholds and other criteria;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id76c46fe842a3474681c8478d8c73d590"><enum>(ii)</enum><text display-inline="yes-display-inline">privacy and civil liberties protections; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3090C345206F4FAD85B9A54C78DEAE13"><enum>(iii)</enum><text display-inline="yes-display-inline">providing notice to potentially affected third parties;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a7f565183314ff0b88676c53c330a4b"><enum>(B)</enum><text display-inline="yes-display-inline">specify the reasons for the required action and the duration of the directive;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id639a9941677740a28447e08ecce6d7b0"><enum>(C)</enum><text display-inline="yes-display-inline">minimize the impact of a directive under this subsection by—</text> <clause commented="no" display-inline="no-display-inline" id="idff7ea475aa0b4f659b0713cbf3c635b3"><enum>(i)</enum><text display-inline="yes-display-inline">adopting the least intrusive means possible under the circumstances to secure the agency information systems; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id932184b923ac4b5493c04053b22c4c77"><enum>(ii)</enum><text display-inline="yes-display-inline">limiting directives to the shortest period practicable;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id737a3369ef5d42408a0ca4b384d51e96"><enum>(D)</enum><text display-inline="yes-display-inline">notify the Director and the head of any affected agency immediately upon the issuance of a directive under this subsection;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idebbad247c12a4204bfc8e745c36e8302"><enum>(E)</enum><text display-inline="yes-display-inline">consult with the Director of the National Institute of Standards and Technology regarding any directive under this subsection that implements standards and guidelines developed by the National Institute of Standards and Technology;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2c331315d60c4682a0cbd94c3da3ed62"><enum>(F)</enum><text display-inline="yes-display-inline">ensure that directives issued under this subsection do not conflict with the standards and guidelines issued under section 11331 of title 40;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7B3D933DAF1A4C7BB9973C27E0CE676C"><enum>(G)</enum><text display-inline="yes-display-inline">consider any applicable standards or guidelines developed by the National Institute of Standards and issued by the Secretary of Commerce under section 11331 of title 40; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d70fc501590418c8075be0831dbd3bb"><enum>(H)</enum><text display-inline="yes-display-inline">not later than February 1 of each year, submit to the appropriate congressional committees a report regarding the specific actions the Secretary has taken pursuant to paragraph (1)(A).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51CFC7902875462EA7A4A0FF333D25FD"><enum>(3)</enum><header display-inline="yes-display-inline">Imminent threats</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id513588ba0ae74e2f8dc42a5ad779f3be"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 3554, the Secretary may authorize the intrusion detection and prevention capabilities under section 230(b)(1) of the Homeland Security Act of 2002 for the purpose of ensuring the security of agency information systems, if—</text>
 <clause commented="no" display-inline="no-display-inline" id="id729d7d53147a42b598ad789aaa3742c9"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines there is an imminent threat to agency information systems;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id53f19776a08e4c7d938ea30b9f51ced7"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary determines a directive under subsection (b)(2)(C) or paragraph (1)(A) is not reasonably likely to result in a timely response to the threat;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id93ed76bf6e9c4d6aafa722b80acbcd0f"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary determines the risk posed by the imminent threat outweighs any adverse consequences reasonably expected to result from the use of protective capabilities under the control of the Secretary;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idde5ceb9baf214bf0af63a6e4088ddd6a"><enum>(iv)</enum><text display-inline="yes-display-inline">the Secretary provides prior notice to the Director, and the head and chief information officer (or equivalent official) of each agency to which specific actions will be taken pursuant to subparagraph (A), and notifies the appropriate congressional committees and authorizing committees of each such agencies within seven days of taking an action under this subsection of—</text>
 <subclause commented="no" display-inline="no-display-inline" id="idf555ce17d52a434093679d4b05d21010"><enum>(I)</enum><text display-inline="yes-display-inline">any action taken under this subsection; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id02bae612ce104240b946512e27507787"><enum>(II)</enum><text display-inline="yes-display-inline">the reasons for and duration and nature of the action;</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idb75e03de1dfa4f1ca76abb29ccba4b3b"><enum>(v)</enum><text display-inline="yes-display-inline">the action of the Secretary is consistent with applicable law; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idc4b4e2834e864e9081d6fb062223a9ce"><enum>(vi)</enum><text display-inline="yes-display-inline">the Secretary authorizes the use of protective capabilities in accordance with the advance procedures established under subparagraph (C).</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide554d6fd910744b1803dfa537ba8aa3b"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation on delegation</header><text display-inline="yes-display-inline">The authority under this subsection may not be delegated by the Secretary.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9559db46a0644248bfeb975bf95edfce"><enum>(C)</enum><header display-inline="yes-display-inline">Advance procedures</header><text display-inline="yes-display-inline">The Secretary shall, in coordination with the Director, and in consultation with the heads of Federal agencies, establish procedures governing the circumstances under which the Secretary may authorize the use of protective capabilities subparagraph (A). The Secretary shall submit the procedures to Congress.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id050e1871132a41a98b44b18ba78fae75"><enum>(4)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The Secretary may direct or authorize lawful action or protective capability under this subsection only to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idb235a6b35f1e49c096befd0411e03c79"><enum>(A)</enum><text display-inline="yes-display-inline">protect agency information from unauthorized access, use, disclosure, disruption, modification, or destruction; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3fe29e909ffb45608f840d3515bc2ff0"><enum>(B)</enum><text display-inline="yes-display-inline">require the remediation of or protect against identified information security risks with respect to—</text>
 <clause commented="no" display-inline="no-display-inline" id="idd51367d2bd4d4ee995cf76744cacdad7"><enum>(i)</enum><text display-inline="yes-display-inline">information collected or maintained by or on behalf of an agency; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="id8f935773ed004d0e980470733017848b"><enum>(ii)</enum><text display-inline="yes-display-inline">that portion of an information system used or operated by an agency or by a contractor of an agency or other organization on behalf of an agency.</text>
 </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7A9AE264DEBF4847AF418F77ABBBB755"><enum>(i)</enum><header display-inline="yes-display-inline">Annual report to Congress</header><text display-inline="yes-display-inline">Not later than February 1 of each year, the Director shall submit to the appropriate congressional committees a report regarding the specific actions the Director has taken pursuant to subsection (a)(5), including any actions taken pursuant to section 11303(b)(5) of title 40.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3F22104DBB394491B342F3E1ED4821A3"><enum>(j)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="idDCC396CC4E044D309E6C47447664F17C"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Appropriations and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4438b2ec45344999b0733f83c996e19"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Appropriations, the Committee on Homeland Security, the Committee on Oversight and Government Reform, and the Committee on Science, Space, and Technology of the House of Representatives.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3bc51451a375448d8ad19f4ed9f863ec"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 3554(a)(1)(B) of title 44, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idF78A6EB1E36741F5B5E6094C951C3933"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>and</quote> at the end; and</text>

					</paragraph></subsection></section></title><title commented="no" id="id689e47c5f987468cabf12bc48bc090e7" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Federal cybersecurity workforce assessment</header>
 <section commented="no" display-inline="no-display-inline" id="id7dc3b19174744990bf7191f5da534355" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Federal Cybersecurity Workforce Assessment Act of 2015</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="ide154ca90223a4fd08407ae507723f3b6" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>

 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48dbd0b0daab41f4970ebd518fc3f286"><enum>(3)</enum><header display-inline="yes-display-inline">Roles</header><text display-inline="yes-display-inline">The term <term>roles</term> has the meaning given the term in the National Initiative for Cybersecurity Education's Cybersecurity Workforce Framework.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idac67cb21ee4c44ef99490f717c651328" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">National cybersecurity workforce measurement initiative</header>
 <subsection commented="no" display-inline="no-display-inline" id="ideea36d9bc1c54276a56e26eef4d85672"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The head of each Federal agency shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="idd91bd12810b8434bacb2c0e9656d545f"><enum>(1)</enum><text display-inline="yes-display-inline">identify all positions within the agency that require the performance of cybersecurity or other cyber-related functions; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6f20de299954f3c8341fdbff50799ea"><enum>(2)</enum><text display-inline="yes-display-inline">assign the corresponding employment code, which shall be added to the National Initiative for Cybersecurity Education's National Cybersecurity Workforce Framework, in accordance with subsection (b).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4bf14a95bce04ee3b5db6f3e3261bdfc"><enum>(b)</enum><header display-inline="yes-display-inline">Employment codes</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ide4d0cd213f2149ab9c1d69443e27d79a"><enum>(1)</enum><header display-inline="yes-display-inline">Procedures</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id6fc065d5cfa5432497bafeaf006bf41b"><enum>(A)</enum><header display-inline="yes-display-inline">Coding structure</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Commerce, acting through the National Institute of Standards and Technology, shall update the National Initiative for Cybersecurity Education's Cybersecurity Workforce Framework to include a corresponding coding structure.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id467573a73ac74055b627b10a9f2994c4"><enum>(B)</enum><header display-inline="yes-display-inline">Identification of civilian cyber personnel</header><text display-inline="yes-display-inline">Not later than 9 months after the date of enactment of this Act, the Director, in coordination with the Director of the National Institute of Standards and Technology and the Director of National Intelligence, shall establish procedures to implement the National Initiative for Cybersecurity Education's coding structure to identify all Federal civilian positions that require the performance of information technology, cybersecurity, or other cyber-related functions.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92c76c1c2c95468ca59fef0e05fb522e"><enum>(C)</enum><header display-inline="yes-display-inline">Identification of noncivilian cyber personnel</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary of Defense shall establish procedures to implement the National Initiative for Cybersecurity Education's coding structure to identify all Federal noncivilian positions that require the performance of information technology, cybersecurity, or other cyber-related functions.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30ee9a1cef95449f8c05709c26f83e7e"><enum>(D)</enum><header display-inline="yes-display-inline">Baseline assessment of existing cybersecurity workforce</header><text display-inline="yes-display-inline">Not later than 3 months after the date on which the procedures are developed under subparagraphs (B) and (C), respectively, the head of each Federal agency shall submit to the appropriate congressional committees of jurisdiction a report that identifies—</text>
 <clause commented="no" display-inline="no-display-inline" id="id2728cd084252421eafbe6ddf6a5c010d"><enum>(i)</enum><text display-inline="yes-display-inline">the percentage of personnel with information technology, cybersecurity, or other cyber-related job functions who currently hold the appropriate industry-recognized certifications as identified in the National Initiative for Cybersecurity Education's Cybersecurity Workforce Framework;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6d80717751ec404992cf631ad2c06a94"><enum>(ii)</enum><text display-inline="yes-display-inline">the level of preparedness of other civilian and noncivilian cyber personnel without existing credentials to take certification exams; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id2746f85ef29c4c288ec6f841725fc89f"><enum>(iii)</enum><text display-inline="yes-display-inline">a strategy for mitigating any gaps identified in clause (i) or (ii) with the appropriate training and certification for existing personnel.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22817e059f054bd98929611f9f4b8977"><enum>(E)</enum><header display-inline="yes-display-inline">Procedures for assigning codes</header><text display-inline="yes-display-inline">Not later than 3 months after the date on which the procedures are developed under subparagraphs (B) and (C), respectively, the head of each Federal agency shall establish procedures—</text>
 <clause commented="no" display-inline="no-display-inline" id="id1754442aad0841d1a6cf323f2f034d7a"><enum>(i)</enum><text display-inline="yes-display-inline">to identify all encumbered and vacant positions with information technology, cybersecurity, or other cyber-related functions (as defined in the National Initiative for Cybersecurity Education's coding structure); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id437c44a092a44469b267d2d15e9504b3"><enum>(ii)</enum><text display-inline="yes-display-inline">to assign the appropriate employment code to each such position, using agreed standards and definitions.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5201f5fbef674897ae9151d48ac89104"><enum>(2)</enum><header display-inline="yes-display-inline">Code assignments</header><text display-inline="yes-display-inline">Not later than 1 year after the date after the procedures are established under paragraph (1)(E), the head of each Federal agency shall complete assignment of the appropriate employment code to each position within the agency with information technology, cybersecurity, or other cyber-related functions.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id58180fad56e64578ac92b6710e842c09"><enum>(c)</enum><header display-inline="yes-display-inline">Progress report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director shall submit a progress report on the implementation of this section to the appropriate congressional committees.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ide1ed0c22abef4cff8d9d5bb2e53cef91" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Identification of cyber-related roles of critical need</header>
 <subsection commented="no" display-inline="no-display-inline" id="idb8c3c0c4c18f4f5a97d9c6db7ad82aec"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date on which the employment codes are assigned to employees pursuant to section 203(b)(2), and annually through 2022, the head of each Federal agency, in consultation with the Director, the Director of the National Institute of Standards and Technology, and the Secretary of Homeland Security, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idd0b968ec28064c7ca7b26174b3ab65d4"><enum>(1)</enum><text display-inline="yes-display-inline">identify information technology, cybersecurity, or other cyber-related roles of critical need in the agency's workforce; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id799c7f2ed85b423087ab10d25e44c97e"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report to the Director that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4a4b7ae6455b427289729dc2aa9e8fd6"><enum>(A)</enum><text display-inline="yes-display-inline">describes the information technology, cybersecurity, or other cyber-related roles identified under paragraph (1); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8152a4f6e4044e3bbe178d3b67365c6"><enum>(B)</enum><text display-inline="yes-display-inline">substantiates the critical need designations.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ac2c1ac70314c388c8508407d2178b9"><enum>(b)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">The Director shall provide Federal agencies with timely guidance for identifying information technology, cybersecurity, or other cyber-related roles of critical need, including—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idea425c60c59c463fb117a236d1e802d4"><enum>(1)</enum><text display-inline="yes-display-inline">current information technology, cybersecurity, and other cyber-related roles with acute skill shortages; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6856496d5e148a7b088bf415344b4cc"><enum>(2)</enum><text display-inline="yes-display-inline">information technology, cybersecurity, or other cyber-related roles with emerging skill shortages.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd681122991df487ba7f98121c3a5fa40"><enum>(c)</enum><header display-inline="yes-display-inline">Cybersecurity needs report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Director, in consultation with the Secretary of Homeland Security, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id54ef42049f454f5a90f6c8ac156655b6"><enum>(1)</enum><text display-inline="yes-display-inline">identify critical needs for information technology, cybersecurity, or other cyber-related workforce across all Federal agencies; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05130c64dcd14444b6df58bbfae2c015"><enum>(2)</enum><text display-inline="yes-display-inline">submit a progress report on the implementation of this section to the appropriate congressional committees.</text>
 </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7d58f202abc44cb981e15f0d1bb3334b" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Government Accountability Office status reports</header><text display-inline="no-display-inline">The Comptroller General of the United States shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id99166e2029bc4151bfd7a2469d38eb29"><enum>(1)</enum><text display-inline="yes-display-inline">analyze and monitor the implementation of sections 303 and 304; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7975558036c8409b9dcc5792c8e6ab50"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of the enactment of this Act, submit a report to the appropriate congressional committees that describes the status of such implementation.</text>
				</paragraph></section></title><title commented="no" id="id64086842562d4b9e82df1ceefbe9eea6" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Other cyber matters</header>
			<section commented="no" display-inline="no-display-inline" id="ida4f4833409b14f89880ac57668e1d397" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Study on mobile device security</header>
 <subsection commented="no" display-inline="no-display-inline" id="id8e003a5d6f02461483b5c9f24305111c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Director of the National Institute of Standards and Technology, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id0d258c31839b418a86a7648aa7e93f6f"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study on threats relating to the security of the mobile devices of the Federal Government; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f6c2e81c4744ee4aae70d1ac222667e"><enum>(2)</enum><text display-inline="yes-display-inline">submit an unclassified report to Congress, with a classified annex if necessary, that contains the findings of such study, the recommendations developed under paragraph (3) of subsection (b), the deficiencies, if any, identified under (4) of such subsection, and the plan developed under paragraph (5) of such subsection.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id586f7f973f3c4bf288495799fdec532c"><enum>(b)</enum><header display-inline="yes-display-inline">Matters studied</header><text display-inline="yes-display-inline">In carrying out the study under subsection (a)(1), the Secretary, in consultation with the Director of the National Institute of Standards and Technology, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idb2c12278ba784896835614ec444d7243"><enum>(1)</enum><text display-inline="yes-display-inline">assess the evolution of mobile security techniques from a desktop-centric approach, and whether such techniques are adequate to meet current mobile security challenges;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7b6d73f79c84e489e66cc699d72ea80"><enum>(2)</enum><text display-inline="yes-display-inline">assess the effect such threats may have on the cybersecurity of the information systems and networks of the Federal Government (except for national security systems or the information systems and networks of the Department of Defense and the intelligence community);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id019241453e134ba4bf1e59d6196c4841"><enum>(3)</enum><text display-inline="yes-display-inline">develop recommendations for addressing such threats based on industry standards and best practices;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id365fc5c0b20b47dead6e4ab07a044009"><enum>(4)</enum><text display-inline="yes-display-inline">identify any deficiencies in the current authorities of the Secretary that may inhibit the ability of the Secretary to address mobile device security throughout the Federal Government (except for national security systems and the information systems and networks of the Department of Defense and intelligence community); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba5eb63f78d144f18496a4ca90a6e960"><enum>(5)</enum><text display-inline="yes-display-inline">develop a plan for accelerated adoption of secure mobile device technology by the Department of Homeland Security.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id400023fb9c8e497bbdc80a6028adb4c5"><enum>(c)</enum><header display-inline="yes-display-inline">Intelligence community defined</header><text display-inline="yes-display-inline">In this section, the term <term>intelligence community</term> has the meaning given such term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idecdf95c1b8aa4cc7820a86fd575b4d94" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Department of State international cyberspace policy strategy</header>
 <subsection commented="no" display-inline="no-display-inline" id="id45d6676617884502a09b17c1e3976e44"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall produce a comprehensive strategy relating to United States international policy with regard to cyberspace.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id20881ef8faf140b1b70fee4f4038266e"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The strategy required by subsection (a) shall include the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="id2064896adf174e34aaa34f0b2a357091"><enum>(1)</enum><text display-inline="yes-display-inline">A review of actions and activities undertaken by the Secretary of State to date to support the goal of the President’s International Strategy for Cyberspace, released in May 2011, to <quote>work internationally to promote an open, interoperable, secure, and reliable information and communications infrastructure that supports international trade and commerce, strengthens international security, and fosters free expression and innovation.</quote>.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03ab9c2a9b894283aca1c1ba91f6a9d0"><enum>(2)</enum><text display-inline="yes-display-inline">A plan of action to guide the diplomacy of the Secretary of State, with regard to foreign countries, including conducting bilateral and multilateral activities to develop the norms of responsible international behavior in cyberspace, and status review of existing discussions in multilateral fora to obtain agreements on international norms in cyberspace.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1095882f414464497691c8600112197"><enum>(3)</enum><text display-inline="yes-display-inline">A review of the alternative concepts with regard to international norms in cyberspace offered by foreign countries that are prominent actors, including China, Russia, Brazil, and India.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida50f62a1db584357b64ad79a47ca1eec"><enum>(4)</enum><text display-inline="yes-display-inline">A detailed description of threats to United States national security in cyberspace from foreign countries, state-sponsored actors, and private actors to Federal and private sector infrastructure of the United States, intellectual property in the United States, and the privacy of citizens of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id142e5c2879da435f89ea05158201c8d6"><enum>(5)</enum><text display-inline="yes-display-inline">A review of policy tools available to the President to deter foreign countries, state-sponsored actors, and private actors, including those outlined in Executive Order 13694, released on April 1, 2015.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided30493f4f8e476c8cf41bece3e5eda6"><enum>(6)</enum><text display-inline="yes-display-inline">A review of resources required by the Secretary, including the Office of the Coordinator for Cyber Issues, to conduct activities to build responsible norms of international cyber behavior.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1d1b061c762946d2ac474dc50a378083"><enum>(c)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In preparing the strategy required by subsection (a), the Secretary of State shall consult, as appropriate, with other agencies and departments of the United States and the private sector and nongovernmental organizations in the United States with recognized credentials and expertise in foreign policy, national security, and cybersecurity.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id279db6fb16ba42c2bdecb98d35c22c58"><enum>(d)</enum><header display-inline="yes-display-inline">Form of strategy</header><text display-inline="yes-display-inline">The strategy required by subsection (a) shall be in unclassified form, but may include a classified annex.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id5c223166814f43d5a6787dfdd0de4c7e"><enum>(e)</enum><header display-inline="yes-display-inline">Availability of information</header><text display-inline="yes-display-inline">The Secretary of State shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id49691ebac040447aa72fd29fb95a146f"><enum>(1)</enum><text display-inline="yes-display-inline">make the strategy required in subsection (a) available the public; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id423fe7e528464a97994f07f9913d831b"><enum>(2)</enum><text display-inline="yes-display-inline">brief the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives on the strategy, including any material contained in a classified annex.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idf30675d3f19c4f95810125bb04404490" section-type="subsequent-section"><enum>403.</enum><header display-inline="yes-display-inline">Apprehension and prosecution of international cyber criminals</header>
 <subsection commented="no" display-inline="no-display-inline" id="id35002e4e77e244d28a6cbd813fb6410c"><enum>(a)</enum><header display-inline="yes-display-inline">International cyber criminal defined</header><text display-inline="yes-display-inline">In this section, the term <term>international cyber criminal</term> means an individual—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7db48129d5ed47848321bb3e7932b8d5"><enum>(1)</enum><text display-inline="yes-display-inline">who is believed to have committed a cybercrime or intellectual property crime against the interests of the United States or the citizens of the United States; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34622dbd9b2e4fd2a6f305d2a299ab1a"><enum>(2)</enum><text display-inline="yes-display-inline">for whom—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id12afb597054f4518be7cac5ad7eedd02"><enum>(A)</enum><text display-inline="yes-display-inline">an arrest warrant has been issued by a judge in the United States; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id802091b4d5df4525b428689d8707993d"><enum>(B)</enum><text display-inline="yes-display-inline">an international wanted notice (commonly referred to as a <quote>Red Notice</quote>) has been circulated by Interpol.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide2afb7aaebdd43a99de29fb57d6206a7"><enum>(b)</enum><header display-inline="yes-display-inline">Consultations for noncooperation</header><text display-inline="yes-display-inline">The Secretary of State, or designee, shall consult with the appropriate government official of each country from which extradition is not likely due to the lack of an extradition treaty with the United States or other reasons, in which one or more international cyber criminals are physically present, to determine what actions the government of such country has taken—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idf373aa12ed164757b027a57189b0661e"><enum>(1)</enum><text display-inline="yes-display-inline">to apprehend and prosecute such criminals; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe657105b58246ac831d0933f397161b"><enum>(2)</enum><text display-inline="yes-display-inline">to prevent such criminals from carrying out cybercrimes or intellectual property crimes against the interests of the United States or its citizens.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida21f569f95bb49e99ea240fcd4d84f1d"><enum>(c)</enum><header display-inline="yes-display-inline">Annual report</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id4f88ea71a6184220a71fc448d4bafd78"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State shall submit to the appropriate congressional committees an annual report that includes—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ida4d9330c175b412cb56b72f55d0fa8f5"><enum>(A)</enum><text display-inline="yes-display-inline">the number of international cyber criminals located in other countries, disaggregated by country, and indicating from which countries extradition is not likely due to the lack of an extradition treaty with the United States or other reasons;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd2575aa1e2524617b33db73800d12065"><enum>(B)</enum><text display-inline="yes-display-inline">the nature and number of significant discussions by an official of the Department of State on ways to thwart or prosecute international cyber criminals with an official of another country, including the name of each such country; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b54592c1d7c40cda2be84e481155197"><enum>(C)</enum><text display-inline="yes-display-inline">for each international cyber criminal who was extradited to the United States during the most recently completed calendar year—</text>
 <clause commented="no" display-inline="no-display-inline" id="id089eda3c78a24cfd9a0cc41743a44b32"><enum>(i)</enum><text display-inline="yes-display-inline">his or her name;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id585f323404914783a856dc924b492292"><enum>(ii)</enum><text display-inline="yes-display-inline">the crimes for which he or she was charged;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ide663fe93950a4e1fb587733dfc8e701f"><enum>(iii)</enum><text display-inline="yes-display-inline">his or her previous country of residence; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id31c67c1318d44d7aaa029541e8b87f0e"><enum>(iv)</enum><text display-inline="yes-display-inline">the country from which he or she was extradited into the United States.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id925ebccbb1b04468a51c1aad92e25b72"><enum>(2)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report required by this subsection shall be in unclassified form to the maximum extent possible, but may include a classified annex.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d9010855d664273b9b73d4b34b71ad5"><enum>(3)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>appropriate congressional committees</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id9df8e1311aba4c0999b87c19d3a20618"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Appropriations, the Committee on Homeland Security and Governmental Affairs, the Committee on Banking, Housing, and Urban Affairs, the Select Committee on Intelligence, and the Committee on the Judiciary of the Senate; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id533888ed114e4099a011a9a3df5effa3"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Appropriations, the Committee on Homeland Security, the Committee on Financial Services, the Permanent Select Committee on Intelligence, and the Committee on the Judiciary of the House of Representatives.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idd7ccfd617ffc40549505d6e3c8959d0e" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Enhancement of emergency services</header>
 <subsection commented="no" display-inline="no-display-inline" id="id4303f0dc96b046a7bc6aff49205f1f9f"><enum>(a)</enum><header display-inline="yes-display-inline">Collection of data</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Homeland Security, acting through the National Cybersecurity and Communications Integration Center, in coordination with appropriate Federal entities and the Director for Emergency Communications, shall establish a process by which a Statewide Interoperability Coordinator may report data on any cybersecurity risk or incident involving any information system or network used by emergency response providers (as defined in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)) within the State.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id8e8568f54d46435ebbbdf24f80b382eb"><enum>(b)</enum><header display-inline="yes-display-inline">Analysis of data</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Homeland Security, acting through the Director of the National Cybersecurity and Communications Integration Center, in coordination with appropriate entities and the Director for Emergency Communications, and in consultation with the Director of the National Institute of Standards and Technology, shall conduct integration and analysis of the data reported under subsection (a) to develop information and recommendations on security and resilience measures for any information system or network used by State emergency response providers.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3c3e5034292e4fd09fddba70b047bdc1"><enum>(c)</enum><header display-inline="yes-display-inline">Best practices</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id90b0be2377bd45408498a6cc15441e68"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Using the results of the integration and analysis conducted under subsection (b), and any other relevant information, the Director of the National Institute of Standards and Technology shall, on an ongoing basis, facilitate and support the development of methods for reducing cybersecurity risks to emergency response providers using the process described in section 2(e) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/272">15 U.S.C. 272(e)</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id188fed90d4d8479fa743f44b4e352c78"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Director of the National Institute of Standards and Technology shall submit a report to Congress on the methods developed under paragraph (1) and shall make such report publically available on the website of the National Institute of Standards and Technology.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5C100FF7FDA44F92B632506D5704A76E"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to—</text> <paragraph commented="no" display-inline="no-display-inline" id="id3e75cf37c6f4413ab6f52d8e632bf845"><enum>(1)</enum><text display-inline="yes-display-inline">require a State to report data under subsection (a); or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbc7ddd97f8147a29090dabfcee9aaf8"><enum>(2)</enum><text display-inline="yes-display-inline">require an entity to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id9bcc03e75bc64a07aa2b1e7a058184e2"><enum>(A)</enum><text display-inline="yes-display-inline">adopt a recommended measure developed under subsection (b); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8510bae64b75438b86c2f498c6d205ba"><enum>(B)</enum><text display-inline="yes-display-inline">follow the best practices developed under subsection (c).</text> </subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9d4d6969369a4054a8bb7e0880c6555b" section-type="subsequent-section"><enum>405.</enum><header display-inline="yes-display-inline">Improving cybersecurity in the health care industry</header> <subsection commented="no" display-inline="no-display-inline" id="idc0604f12a4a74b69b8a0de128a9230a0"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id21d3f94517bf49d097945df55e91f462"><enum>(1)</enum><header display-inline="yes-display-inline">Business associate</header><text display-inline="yes-display-inline">The term <term>business associate</term> has the meaning given such term in section 160.103 of title 45, Code of Federal Regulations.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b448504eb9249cab6ea478759738773"><enum>(2)</enum><header display-inline="yes-display-inline">Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> has the meaning given such term in section 160.103 of title 45, Code of Federal Regulations.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id859b4058933d452c915ac9287b5ab341"><enum>(3)</enum><header display-inline="yes-display-inline">Health care clearinghouse; health care provider; health plan</header><text display-inline="yes-display-inline">The terms <term>health care clearinghouse</term>, <term>health care provider</term>, and <term>health plan</term> have the meanings given the terms in section 160.103 of title 45, Code of Federal Regulations.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f90d8572d6c41c1a93c981906568420"><enum>(4)</enum><header display-inline="yes-display-inline">Health care industry stakeholder</header><text display-inline="yes-display-inline">The term <term>health care industry stakeholder</term> means any—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id184dda9dacdf4e7f90a36ea200f4eb93"><enum>(A)</enum><text display-inline="yes-display-inline">health plan, health care clearinghouse, or health care provider;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28c08d2ab6214fd5baac6ba212347e95"><enum>(B)</enum><text display-inline="yes-display-inline">patient advocate;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba2cbe9bb0324a2f83270ce48767663c"><enum>(C)</enum><text display-inline="yes-display-inline">pharmacist;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2b1b3b7a4186483a9d80e161e80b4579"><enum>(D)</enum><text display-inline="yes-display-inline">developer of health information technology;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide631b2f5e59746c89e8dfdd7fccb8ced"><enum>(E)</enum><text display-inline="yes-display-inline">laboratory;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33e2f790e78247bba959ccda0c509d08"><enum>(F)</enum><text display-inline="yes-display-inline">pharmaceutical or medical device manufacturer; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4af68b624564420db8400fb4b6e13710"><enum>(G)</enum><text display-inline="yes-display-inline">additional stakeholder the Secretary determines necessary for purposes of subsection (d)(1), (d)(3), or (e).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d41b194377346218d39b01ea512b8b6"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf8ec655b99fa4b0d8ac46134358db272"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit, to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, a report on the preparedness of the health care industry in responding to cybersecurity threats.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id72b231775bec450db04251b05179a2bd"><enum>(c)</enum><header display-inline="yes-display-inline">Contents of report</header><text display-inline="yes-display-inline">With respect to the internal response of the Department of Health and Human Services to emerging cybersecurity threats, the report shall include—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idb0bbba31f25a4f15a90372e6facee81e"><enum>(1)</enum><text display-inline="yes-display-inline">a clear statement of the official within the Department of Health and Human Services to be responsible for leading and coordinating efforts of the Department regarding cybersecurity threats in the health care industry; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d658d3fa94b49f8bc7048fb265acb41"><enum>(2)</enum><text display-inline="yes-display-inline">a plan from each relevant operating division and subdivision of the Department of Health and Human Services on how such division or subdivision will address cybersecurity threats in the health care industry, including a clear delineation of how each such division or subdivision will divide responsibility among the personnel of such division or subdivision and communicate with other such divisions and subdivisions regarding efforts to address such threats.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id705e529ac21249eeb9f50d08c73d162d"><enum>(d)</enum><header display-inline="yes-display-inline">Health care industry cybersecurity task force</header><paragraph id="idd73c3fc08f0443c6898b01c358548830"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary, in consultation with the Director of the National Institute of Standards and Technology and the Secretary of Homeland Security, shall convene health care industry stakeholders, cybersecurity experts, and any Federal agencies or entities the Secretary determines appropriate to establish a task force to—</text>
 <subparagraph id="idae472b5298294c038d3c8e5568e1a055"><enum>(A)</enum><text>analyze how industries, other than the health care industry, have implemented strategies and safeguards for addressing cybersecurity threats within their respective industries;</text>
 </subparagraph><subparagraph id="id2caf1c2b8eb144119ce9a2651599b182"><enum>(B)</enum><text>analyze challenges and barriers private entities (notwithstanding section 102(15)(B), excluding any State, tribal, or local government) in the health care industry face securing themselves against cyber attacks;</text>
 </subparagraph><subparagraph id="idb74dd90fb08e40bbb66df80cd2346e3d"><enum>(C)</enum><text>review challenges that covered entities and business associates face in securing networked medical devices and other software or systems that connect to an electronic health record;</text>
 </subparagraph><subparagraph id="id09fecd9720aa4693adf5017d9c4c32b7"><enum>(D)</enum><text>provide the Secretary with information to disseminate to health care industry stakeholders for purposes of improving their preparedness for, and response to, cybersecurity threats affecting the health care industry;</text>
 </subparagraph><subparagraph id="idb6b700e1966f46c1bacef31073b969b7"><enum>(E)</enum><text>establish a plan for creating a single system for the Federal Government to share information on actionable intelligence regarding cybersecurity threats to the health care industry in near real time, requiring no fee to the recipients of such information, including which Federal agency or other entity may be best suited to be the central conduit to facilitate the sharing of such information; and</text>
 </subparagraph><subparagraph id="iddc26ef43a67e42d4987776f5d3f729d6"><enum>(F)</enum><text>report to Congress on the findings and recommendations of the task force regarding carrying out subparagraphs (A) through (E).</text>
 </subparagraph></paragraph><paragraph id="id43bfecaa3aec40a69b365f10cea367ca"><enum>(2)</enum><header>Termination</header><text>The task force established under this subsection shall terminate on the date that is 1 year after the date of enactment of this Act.</text>
 </paragraph><paragraph id="id6447ad3cc5204720a9e0c5cb4f976a86"><enum>(3)</enum><header>Dissemination</header><text>Not later than 60 days after the termination of the task force established under this subsection, the Secretary shall disseminate the information described in paragraph (1)(D) to health care industry stakeholders in accordance with such paragraph.</text>
 </paragraph><paragraph id="idEE368487F5BE47DA8E1FB594511A3D72"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to limit the antitrust exemption under section 104(e) or the protection from liability under section 106.</text>
					</paragraph></subsection><subsection id="ide3f7ffdf751248ed9cf3a919484e1000"><enum>(e)</enum><header>Cybersecurity framework</header>
 <paragraph id="id636739D532004940ABC83D9BCE516088"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish, through a collaborative process with the Secretary of Homeland Security, health care industry stakeholders, the National Institute of Standards and Technology, and any Federal agency or entity the Secretary determines appropriate, a single, voluntary, national health-specific cybersecurity framework that—</text>
 <subparagraph id="idf760354221e144a7b5e43b5c7ba6e204"><enum>(A)</enum><text>establishes a common set of voluntary, consensus-based, and industry-led standards, security practices, guidelines, methodologies, procedures, and processes that serve as a resource for cost-effectively reducing cybersecurity risks for a range of health care organizations;</text>
 </subparagraph><subparagraph id="id855dd45d235d4a55b0f6afb1c8ae0bb6"><enum>(B)</enum><text>supports voluntary adoption and implementation efforts to improve safeguards to address cybersecurity threats;</text>
 </subparagraph><subparagraph id="idD28DBBEB2388449B8C153AF6F509FF6E"><enum>(C)</enum><text>is consistent with the security and privacy regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note) and with the Health Information Technology for Economic and Clinical Health Act (title XIII of division A, and title IV of division B, of <external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>), and the amendments made by such Act; and</text>
 </subparagraph><subparagraph id="id3a5c10e0074a4eca8ef5b61708614d47"><enum>(D)</enum><text>is updated on a regular basis and applicable to the range of health care organizations described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id60368d4d67a5497cae3d23d000479914"><enum>(2)</enum><header>Limitation</header><text>Nothing in this subsection shall be interpreted as granting the Secretary authority to—</text> <subparagraph id="id1cf0a9cbb1f641b6ac7c138707a4a7a1"><enum>(A)</enum><text>provide for audits to ensure that health care organizations are in compliance with the voluntary framework under this subsection; or</text>
 </subparagraph><subparagraph id="ida5301938c493466192e6bcacb6b3c21e"><enum>(B)</enum><text>mandate, direct, or condition the award of any Federal grant, contract, or purchase on compliance with such voluntary framework.</text>
 </subparagraph></paragraph><paragraph id="id68B97592FC82447D97109D1B8583355D"><enum>(3)</enum><header>No liability for nonparticipation</header><text>Nothing in this title shall be construed to subject a health care organization to liability for choosing not to engage in the voluntary activities authorized under this subsection.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id5db4193ae3f84cd792173a383f82c3e2" section-type="subsequent-section"><enum>406.</enum><header display-inline="yes-display-inline">Federal computer security</header>
 <subsection commented="no" display-inline="no-display-inline" id="ide7838aabc5a943298e80af4fc841300d"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id6bdc8afe37404ddca53d03ac894f07be"><enum>(1)</enum><header display-inline="yes-display-inline">Covered system</header><text display-inline="yes-display-inline">The term <term>covered system</term> shall mean a national security system as defined in section 11103 of title 40, United States Code, or a Federal computer system that provides access to personally identifiable information.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb32f725041144330b2640a902cc927e4"><enum>(2)</enum><header display-inline="yes-display-inline">Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means an agency that operates a covered system.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf2479ddc18b840ad87b53a5205cb2240"><enum>(3)</enum><header display-inline="yes-display-inline">Logical access control</header><text display-inline="yes-display-inline">The term <term>logical access control</term> means a process of granting or denying specific requests to obtain and use information and related information processing services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfcfd2657ccac4cf3b3255904c160145b"><enum>(4)</enum><header display-inline="yes-display-inline">Multi-factor logical access controls</header><text display-inline="yes-display-inline">The term <term>multi-factor logical access controls</term> means a set of not less than 2 of the following logical access controls:</text> <subparagraph commented="no" display-inline="no-display-inline" id="ideea7ba7a14d24e11a4ff864682f175bd"><enum>(A)</enum><text display-inline="yes-display-inline">Information that is known to the user, such as a password or personal identification number.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37a3109e66e84c7fbd3a0aba14501f16"><enum>(B)</enum><text display-inline="yes-display-inline">An access device that is provided to the user, such as a cryptographic identification device or token.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc896c1ae11e42fc868c4359f11c331b"><enum>(C)</enum><text display-inline="yes-display-inline">A unique biometric characteristic of the user.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99d1dc74cd2946ddaccdaa24190c9ccd"><enum>(5)</enum><header display-inline="yes-display-inline">Privileged user</header><text display-inline="yes-display-inline">The term <term>privileged user</term> means a user who, by virtue of function or seniority, has been allocated powers within a covered system, which are significantly greater than those available to the majority of users.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1378b90a8ec94a0dac3080341bf0de6a"><enum>(b)</enum><header display-inline="yes-display-inline">Inspector General reports on covered systems</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ida4a16f2a97d2446db8bf7d6db93704fd"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 240 days after the date of enactment of this Act, the Inspector General of each covered agency shall submit to the appropriate committees of jurisdiction in the Senate and the House of Representatives a report, which shall include information collected from the covered agency for the contents described in paragraph (2) regarding the Federal computer systems of the covered agency.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18d0cffeb304454cbda1a5cbebf56455"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report submitted by each Inspector General of a covered agency under paragraph (1) shall include, with respect to the covered agency, the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id38999f055c4a4a86900dca0e8e8117be"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the logical access standards used by the covered agency to access a covered system, including—</text>
 <clause commented="no" display-inline="no-display-inline" id="id2b96621bd2144f7e93c53b177b5cf481"><enum>(i)</enum><text display-inline="yes-display-inline">in aggregate, a list and description of logical access controls used to access such a covered system; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0a6eac5380ce4eb888f04a4b618df392"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the covered agency is using multi-factor logical access controls to access such a covered system.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id530208d727e64254b3c5a536f7e5b505"><enum>(B)</enum><text display-inline="yes-display-inline">A description of the logical access controls used by the covered agency to govern access to covered systems by privileged users.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17fed6f4e8b74e6682e2eafdc3f18104"><enum>(C)</enum><text display-inline="yes-display-inline">If the covered agency does not use logical access controls or multi-factor logical access controls to access a covered system, a description of the reasons for not using such logical access controls or multi-factor logical access controls.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56a6de55e9a54dffae5fda0f727d7d23"><enum>(D)</enum><text display-inline="yes-display-inline">A description of the following data security management practices used by the covered agency:</text> <clause commented="no" display-inline="no-display-inline" id="id7680a961881941029d40d6cf068ad324"><enum>(i)</enum><text display-inline="yes-display-inline">The policies and procedures followed to conduct inventories of the software present on the covered systems of the covered agency and the licenses associated with such software.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0910898190fb44729d5b47a99be00aa8"><enum>(ii)</enum><text display-inline="yes-display-inline">What capabilities the covered agency utilizes to monitor and detect exfiltration and other threats, including—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id62e472e34d0c4306bfa475aef86b1637"><enum>(I)</enum><text display-inline="yes-display-inline">data loss prevention capabilities; or</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id62c6169444cf43eb800d4639525fd9a0"><enum>(II)</enum><text display-inline="yes-display-inline">digital rights management capabilities.</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idee42ae19e51f421381d5380dd8b0587d"><enum>(iii)</enum><text display-inline="yes-display-inline">A description of how the covered agency is using the capabilities described in clause (ii).</text> </clause><clause commented="no" display-inline="no-display-inline" id="id1aa3009182ad486ea14470fff7046fe7"><enum>(iv)</enum><text display-inline="yes-display-inline">If the covered agency is not utilizing capabilities described in clause (ii), a description of the reasons for not utilizing such capabilities.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5f1045a2930a45cd96bd24e01d78380e"><enum>(E)</enum><text display-inline="yes-display-inline">A description of the policies and procedures of the covered agency with respect to ensuring that entities, including contractors, that provide services to the covered agency are implementing the data security management practices described in subparagraph (D).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2f918d9c367485ba1575259ae5c4b08"><enum>(3)</enum><header display-inline="yes-display-inline">Existing review</header><text display-inline="yes-display-inline">The reports required under this subsection may be based in whole or in part on an audit, evaluation, or report relating to programs or practices of the covered agency, and may be submitted as part of another report, including the report required under section 3555 of title 44, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea7adf76a8344c1c9e9c16be5397a888"><enum>(4)</enum><header display-inline="yes-display-inline">Classified information</header><text display-inline="yes-display-inline">Reports submitted under this subsection shall be in unclassified form, but may include a classified annex.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id74627a1c6d6244e794a750365191a2c8" section-type="subsequent-section"><enum>407.</enum><header display-inline="yes-display-inline">Strategy to protect critical infrastructure at greatest risk</header>
 <subsection commented="no" display-inline="no-display-inline" id="id6f5c230a712a444c8265affd9bff1975"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id2a5a2fbf219b4443b47de88db6a07251"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate agency</header><text display-inline="yes-display-inline">The term <term>appropriate agency</term> means, with respect to a covered entity—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ideee8f3a5d83647d3a6ffb24d80720028"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), the applicable sector-specific agency; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idff50bddb6058431d9dac1fca4c7a181f"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a covered entity that is regulated by a Federal entity, such Federal entity.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6db572a4e537490a82c101da3ca4cdcd"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate agency head</header><text display-inline="yes-display-inline">The term <term>appropriate agency head</term> means, with respect to a covered entity, the head of the appropriate agency.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e26a3ba172b430e98eb1de48fb783aa"><enum>(3)</enum><header display-inline="yes-display-inline">Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means an entity identified pursuant to section 9(a) of Executive Order 13636 of February 12, 2013 (78 Fed. Reg. 11742), relating to identification of critical infrastructure where a cybersecurity incident could reasonably result in catastrophic regional or national effects on public health or safety, economic security, or national security.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd67fe521623c4ad9adf1bcacfc1a18c8"><enum>(4)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id327a588dafef42c3891d65cbd04e4a60"><enum>(A)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the Senate;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id444111d700ce4ba4b29014a7b3c1f4f0"><enum>(B)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on Intelligence of the House of Representatives;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52fcbbb365714fdca0ee6b851e7feffe"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad31197bf5534f4daf520a5301837e43"><enum>(D)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fb458cb0f954dceb723f4451b7cec19"><enum>(E)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural Resources of the Senate;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf51917c20e1e46aeb7b330fbdbdcfe43"><enum>(F)</enum><text display-inline="yes-display-inline">the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="idF33B0F00E46F48D69B9B247C081DE996"><enum>(G)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ef570a008514afcb243bede585dfb87"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Department of Homeland Security.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1d4c476270414a61a88efd36dbcf2067"><enum>(b)</enum><header display-inline="yes-display-inline">Status of existing cyber incident reporting</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id5A42DBCF2F174BB7921CA9328C245A58"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No later than 120 days after the date of the enactment of this Act, the Secretary, in conjunction with the appropriate agency head (as the case may be), shall submit to the appropriate congressional committees describing the extent to which each covered entity reports significant intrusions of information systems essential to the operation of critical infrastructure to the Department of Homeland Security or the appropriate agency head in a timely manner.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A26BE210D06437385339E0AE6D0D380"><enum>(2)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report submitted under paragraph (1) may include a classified annex.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9492e1e0a012430da253e55b52c34447"><enum>(c)</enum><header display-inline="yes-display-inline">Mitigation strategy required for critical infrastructure at greatest risk</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ide18cd4117aa14d0081c5ab258dfeeb62"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No later than 180 days after the date of the enactment of this Act, the Secretary, in conjunction with the appropriate agency head (as the case may be), shall conduct an assessment and develop a strategy that addresses each of the covered entities, to ensure that, to the greatest extent feasible, a cyber security incident affecting such entity would no longer reasonably result in catastrophic regional or national effects on public health or safety, economic security, or national security.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab44523afffa46ebbc147ee746864997"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The strategy submitted by the Secretary with respect to a covered entity shall include the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id71a18ec5e4ca4c4aa06c52e7668506be"><enum>(A)</enum><text display-inline="yes-display-inline">An assessment of whether each entity should be required to report cyber security incidents.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb3a186000c234dc78007a2eb983ce682"><enum>(B)</enum><text display-inline="yes-display-inline">A description of any identified security gaps that must be addressed.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf7b323c2feb4b3da01e6717a6835622"><enum>(C)</enum><text display-inline="yes-display-inline">Additional statutory authority necessary to reduce the likelihood that a cyber incident could cause catastrophic regional or national effects on public health or safety, economic security, or national security.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6019B340AC84AA8AA36A7C4F337CB52"><enum>(3)</enum><header display-inline="yes-display-inline">Submittal</header><text display-inline="yes-display-inline">The Secretary shall submit to the appropriate congressional committees the assessment and strategy required by paragraph (1).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF6DAD6CB18D428CB630015A9C82318E"><enum>(4)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The assessment and strategy submitted under paragraph (3) may each include a classified annex.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id985B78CE9FE14F17BC8CFD24DC9CD12C" section-type="subsequent-section"><enum>408.</enum><header display-inline="yes-display-inline">Stopping the fraudulent sale of financial information of people of the United States</header><text display-inline="no-display-inline">Section 1029(h) of title 18, United States Code, is amended by striking <quote>title if—</quote> and all that follows through <quote>therefrom.</quote> and inserting <quote>title if the offense involves an access device issued, owned, managed, or controlled by a financial institution, account issuer, credit card system member, or other entity organized under the laws of the United States, or any State, the District of Columbia, or other Territory of the United States.</quote>.</text>
			</section><section id="id85599D72E7364B1CA77D988D6F262C6E"><enum>409.</enum><header>Effective period</header>
 <subsection id="id5C098048FEEB455D93C5A55B1CF5E5E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act and the amendments made by this Act shall be in effect during the 10-year period beginning on the date of the enactment of this Act.</text>
 </subsection><subsection id="idD4AEDA836CC048949B88FACAB2917D86"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">With respect to any action authorized by this Act or information obtained pursuant to an action authorized by this Act, which occurred before the date on which the provisions referred to in subsection (a) cease to have effect, the provisions of this Act shall continue in effect.</text>
