			 nursing home care, adult day health care, or other extended care services,
			 and for other purposes.</official-title></form>

 <section id="id3554E7902AFD466897D5A0FC1CB5109B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Access to Extended Care Act of 2015</short-title></quote>.</text> </section><section id="idB59D698D54FA4D41B99E33AA50BBBA52" section-type="subsequent-section"><enum>2.</enum><header>Treatment of agreements for nursing home care, adult day health care, or other extended care services from Department of Veterans Affairs</header> <subsection id="idE02B011846414CBBB78A447AA59C3B27"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subparagraph (B) of section 1720(c)(1) of title 38, United States Code, is amended by adding after the period at the end the following: <quote>Any such agreement shall not be treated as a Federal contract for the acquisition of goods or services and is not subject to any provision of law governing Federal contracts for the acquisition of goods or services. Title 41 shall not apply to any such agreement.</quote>.</text>
 </subsection><subsection id="idE71DDDA9857F4794B9D22C18F53C1497"><enum>(b)</enum><header>Requirements</header><text>Such section is amended by adding at the end the following new subparagraphs:</text> <quoted-block display-inline="no-display-inline" id="id26C2B1C29B5540218CA544C3D1FDBA2A" style="OLC"> <subparagraph id="idaa7fdfc3c5e84c99a945131e5bb44ecc" indent="up2"><enum>(C)</enum><text>Any agreement entered into under subparagraph (A) with a provider described in that subparagraph shall include provisions that are necessary to ensure the safety and quality of care furnished to veterans pursuant to such agreement, including the following:</text>
 <clause id="ide86ced8d63d64c6d942efcececfa994f"><enum>(i)</enum><text>Requirements as to the licensing and credentialing of medical professionals of the provider, as applicable.</text>
 </clause><clause id="id30a8bda0308e4810bc02cf1748682ba2"><enum>(ii)</enum><text>Review by the Department of medical records of the provider.</text> </clause><clause id="id832b092b7f11400aa2186a62865dcd73"><enum>(iii)</enum><text>Visits by employees of the Department to assess facilities and practices of the provider on an unannounced basis.</text>
 </clause><clause id="idb5245acd54be47d397af716c9e563eee"><enum>(iv)</enum><text>Review by the Department of staffing levels for medical professionals and support personnel of the provider.</text>
 </clause><clause id="id9634252f5f6143b5af35ad587d168275"><enum>(v)</enum><text>Such other provisions as the Secretary considers necessary to ensure the safety and quality of care furnished to veterans.</text>
 </clause></subparagraph><subparagraph id="id30164e0add204bdbb3918028f6fa62c3" indent="up2"><enum>(D)</enum><text>The failure of a provider with which the Secretary has entered into an agreement under subparagraph (A) to comply with a provision of such agreement described in subparagraph (C) may result in the termination of such agreement by the Department.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="id21997C2132F74CB6AAF1A22C56466B1B"><enum>3.</enum><header>Exemption of agreements entered into by Secretary of Veterans Affairs for nursing home care, adult
			 day health care, or other extended care services from the application of
 certain labor laws</header><text display-inline="no-display-inline">Section 6702(b) of title 41, United States Code, is amended—</text> <paragraph commented="no" id="id526D183C6DEE456F8D0A3A9417B2656C"><enum>(1)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph commented="no" id="id9AD6B89DC3A347739099A95FFCCF6843"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph commented="no" id="idAB3376EF39144E3C9B0DC044F4B51474"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id86982D3A08374E9C9A835183DB22D40F" style="OLC">
 <paragraph commented="no" id="id2BC288F2F2AF4EED918C3DA2218CF2B6"><enum>(8)</enum><text>an agreement to furnish nursing home care, adult day health care, or other extended care services under section 1720 of title 38.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
