 </subsection></section><section id="id745e4c45-8c12-48fb-947d-84125edb9ce4"><enum>2.</enum><header>Office of Native American Programs</header><text display-inline="no-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/25/4102">25 U.S.C. 4102</external-xref>) is amended—</text> <paragraph id="idB78A1582B39245B5BE38E7B99B9809D3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6A56465CB1444AFEBBD2BC372D8825E0" style="OLC">

 <subsection id="id9C0787DEF30F45C5ADB826FF0FCFFBDD"><enum>(b)</enum><header>Establishment of Office of Assistant Secretary</header><text>The head of the Office of Native American Programs shall be the Assistant Secretary, to be appointed by the President, by and with the advice and consent of the Senate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><title id="idc1baba4c-31a4-4554-b25a-792d95bb11d2"><enum>I</enum><header>Block grants and grant requirements</header>
 <section id="idEF9920B516C949A6AEC7BF1C1E56B169"><enum>101.</enum><header>Treatment of program income and labor standards</header><text display-inline="no-display-inline">Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/25/4114">25 U.S.C. 4114</external-xref>) is amended—</text> <paragraph id="id98bbb061-b0ff-418b-8192-b9ba0c970fe1"><enum>(1)</enum><text>in subsection (a), by striking paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idfa0adab5-1a62-4c28-a851-75ba7f254da1" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idcb2bd95a-1f5c-4593-957f-25773aac56b1"><enum>(1)</enum><header display-inline="yes-display-inline">Authority to retain</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id4e677507-3d8b-48b6-abc6-a16f8d2402ec"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, a recipient may retain any program income that is realized from any grant amounts under this Act if—</text>
 <clause commented="no" display-inline="no-display-inline" id="id2d8090d8-1d9a-49db-8ba3-d5402e2ba720"><enum>(i)</enum><text>the income was realized after the initial disbursement of the grant amounts received by the recipient; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idcd5b3626-2d7c-47b3-8b74-5272e279974b"><enum>(ii)</enum><text>the recipient has agreed that the recipient will utilize the income for housing related activities in accordance with this Act.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9cc1d76c-f7fb-4494-92a8-145673adab3c"><enum>(B)</enum><header>Requirements</header><text>Any income that is realized by a recipient from program income shall—</text> <clause commented="no" display-inline="no-display-inline" id="id8d10f773-f1d7-430c-9ae5-01c6a4d4158c"><enum>(i)</enum><text>be considered nonprogram income; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id893f669b-d9ef-4835-8a1a-adff435ec1af"><enum>(ii)</enum><text>have no restrictions on use.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id4f6842c5-6056-4cc5-bdcd-fb561e6e3ede"><enum>(2)</enum><text>in subsection (b), by striking paragraph (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5e9f03a7-fe93-4b68-8184-957ded16d261" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id743501be-c249-4b46-80ff-697da757fd4e"><enum>(3)</enum><header display-inline="yes-display-inline">Application of tribal laws</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="idb2f49807-3290-436f-91df-f2d65edb0a9a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any contract or agreement for assistance, sale, or lease pursuant to this Act, if that contract or agreement is otherwise covered by 1 or more laws or regulations adopted by an Indian tribe that requires the payment of not less than prevailing wages, as determined by the Indian tribe.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1481f2a8-8c27-4c4e-adaf-3c2e87622587"><enum>(B)</enum><header>Wages</header><text display-inline="yes-display-inline">The prevailing wages described in subparagraph (A) shall apply to the administration of all Federal funding for projects funded in part by funds authorized under this Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="idf37a44c4-b569-40cf-88e1-45a1fdba6382"><enum>102.</enum><header>Environmental review</header><text display-inline="no-display-inline">Section 105 (<external-xref legal-doc="usc" parsable-cite="usc/25/4115">25 U.S.C. 4115</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idf6c1b780-80ec-4c8a-af43-e51a5ad9d218" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id0aac66d9-bf3b-46b6-b43d-db37b4f4ab8f"><enum>(e)</enum><header display-inline="yes-display-inline">Environmental review</header> <paragraph commented="no" display-inline="no-display-inline" id="id2F976DCD37E242548982F82B1B353430"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law or use of any other source of funding for the project, compliance with the environmental review requirements of this section shall satisfy any other applicable environmental review requirement under any other Federal law (including regulations) required to be carried out by any agency involved in the project.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDC7DA43B9C714AD2B969E843D8F048FA"><enum>(2)</enum><header>Coordination with other agencies</header><text>The Secretary shall coordinate compliance with any environmental review requirements with all impacted Federal agencies and Indian tribes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id42d79cb4-b12a-41a5-a1a9-4842f7bad577"><enum>103.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 108 (<external-xref legal-doc="usc" parsable-cite="usc/25/4117">25 U.S.C. 4117</external-xref>) is amended in the first sentence by striking <quote>2009 through 2013</quote> and inserting <quote>2016 through 2020</quote>.</text> </section></title><title id="id49742432-a883-4780-9be6-6e61ac77b6df"><enum>II</enum><header>Affordable housing activities</header> <section id="H0EA957CD863945FDA2F80BC4B93E4735"><enum>201.</enum><header>Program requirements</header><text display-inline="no-display-inline">Section 203(a) (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(a)</external-xref>) is amended—</text>
 <paragraph id="HEE6A733361CC4B98B7B0992AC16DDD43"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>;</text> </paragraph><paragraph id="idF0D97FD21B3449F79F6F685E6ABE3639"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3);</text>
 </paragraph><paragraph id="H55FE8F941CE74626AD408669A41481EA"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block display-inline="no-display-inline" id="H46CDDCDDF12046E38076C78B8771AA1D" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="HF4ABFEC409D1492285730E47CCE6BA8A"><enum>(2)</enum><header>Application of tribal policies</header><text display-inline="yes-display-inline">Paragraph (3) shall not apply if—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id55B6C4D61F994AEA9C27EF42BA12761E"><enum>(A)</enum><text display-inline="yes-display-inline">the recipient has a written policy governing rents and homebuyer payments charged for dwelling units; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9F2BC7AFFCD4142A4F3FFE8CE21EAE6"><enum>(B)</enum><text display-inline="yes-display-inline">that policy includes a provision governing maximum rents or homebuyer payments<added-phrase reported-display-style="italic">, including tenant protections</added-phrase>.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id6B6667E5D1ED470B87F8E41CA7E5584A"><enum>(4)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>In the case of</quote> and inserting <quote>In the absence of a written policy governing rents and homebuyer payments, in the case of</quote>.</text>
 </paragraph></section><section id="HEB409191693A4CC5B7125246B602FE99"><enum>202.</enum><header>Homeownership or lease-to-own low-income requirement and income targeting</header><text display-inline="no-display-inline">Section 205 (<external-xref legal-doc="usc" parsable-cite="usc/25/4135">25 U.S.C. 4135</external-xref>) is amended—</text> <paragraph id="H946C5A2E2E9F40BE91B45B71993F56F5"><enum>(1)</enum><text>in subsection (a)(1)—</text>
 <subparagraph id="H83560CE862454C77B7F2828C2C095A73"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text> </subparagraph><subparagraph id="HF8DCB63AB40247C78B2451F652F2D7BE"><enum>(B)</enum><text>by adding at the end the following:</text>

 <subparagraph id="H1A045497A2D940208F607DFC4C12F3BD"><enum>(E)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of this paragraph, in the case of rental housing that is made available to a current rental family for conversion to a homebuyer or a lease-purchase unit, that the current rental family can purchase through a contract of sale, lease-purchase agreement, or any other sales agreement, is made available for purchase only by the current rental family, if the rental family was a low-income family at the time of their initial occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8E2F338842FC48D5ADB4CC611577272E"><enum>(2)</enum><text>in subsection (c)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id6AF2F1BA9A3443D492036E29F5CC65EC"><enum>(A)</enum><text>by striking <quote>The provisions</quote> and inserting the following:</text>

 <paragraph commented="no" display-inline="no-display-inline" id="idC4729A37CF3048EC9C7D4B2DDE2FC127"><enum>(2)</enum><header>Applicability to improvements</header><text>The provisions of subsection (a)(2) regarding binding commitments for the remaining useful life of property shall not apply to improvements of privately owned homes if the cost of the improvements do not exceed 10 percent of the maximum total development cost for the home.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></section><section id="idd1f94e02-2688-4042-9595-e6bc2f90d65c"><enum>203.</enum><header>Lease requirements and tenant selection</header><text display-inline="no-display-inline">Section 207 (<external-xref legal-doc="usc" parsable-cite="usc/25/4137">25 U.S.C. 4137</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id673e8180-7777-47a2-9e7d-168e1fd55a66" style="OLC"> <subsection id="id3d0eb521-2b09-49fe-b5ab-825c856f7ea0"><enum>(c)</enum><header>Notice of termination</header><text display-inline="yes-display-inline">The notice period described in subsection (a)(3) shall apply to projects and programs funded in part by amounts authorized under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="idba49d227-0d3b-465f-b377-1a29bf71189d"><enum>204.</enum><header>Self-determined housing activities for tribal communities</header><text display-inline="no-display-inline">Subtitle B of title II (<external-xref legal-doc="usc" parsable-cite="usc/25/4145">25 U.S.C. 4145 et seq.</external-xref>) is repealed.</text> </section><section id="ida6235aaf-ae12-4df9-b89f-5f680682e631"><enum>205.</enum><header>Total development cost maximum project cost</header><text display-inline="no-display-inline">Affordable housing (as defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)) that is developed, acquired, or assisted under the block grant program established under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>) shall not exceed by more than 20 percent, without prior approval of the Secretary of Housing and Urban Development, the total development cost maximum cost for all housing assisted under an affordable housing activity, including development and model activities.</text>

			<section display-inline="no-display-inline" id="HBA5DC90FA91F4CF494C4CC9D87A26395"><enum>301.</enum><header>Effect of undisbursed block grant amounts on annual allocations</header>
 <subsection id="H5A0B7E11B93B45208A5C262C8A696046"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Title III (<external-xref legal-doc="usc" parsable-cite="usc/25/4151">25 U.S.C. 4151 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H3159B98C7B564252AF2A4533E1B5B090" style="OLC"> <section id="H5BA8E4351A184119972E2B4734331F2D"><enum>303.</enum><header>Effect of undisbursed grant amounts on annual allocations</header> <subsection id="H458899D5124A4D78859ED3C1365C9540"><enum>(a)</enum><header>Notification of obligated, undisbursed grant amounts</header><text display-inline="yes-display-inline">Subject to subsection (d), if on <deleted-phrase reported-display-style="strikethrough">January 1, 2018, or on any January 1</deleted-phrase> <added-phrase reported-display-style="italic">October 1, 2017, or on any October 1</added-phrase> thereafter, the total amount of undisbursed block grants for a recipient in the line of credit control <deleted-phrase reported-display-style="strikethrough">system of the Department of Housing and Urban Development is greater than 3 times the formula allocation the recipient would otherwise receive under this Act for the fiscal year during which January 1 occurs</deleted-phrase> <added-phrase reported-display-style="italic">system (or a successor system) of the Department of Housing and Urban Development is greater than the sum of the initial allocations for the previous 3 fiscal years</added-phrase>, the Secretary shall—</text>
 <paragraph id="HC861B37A740344F4A0E0D480DD8DB246"><enum>(1)</enum><text>not later than <deleted-phrase reported-display-style="strikethrough">January 31</deleted-phrase> <added-phrase reported-display-style="italic">October 31</added-phrase> of that year, notify the Indian tribe allocated the grant amounts, and any tribally designated housing entity for the Indian tribe, of the undisbursed amounts; and</text>
 </paragraph><paragraph id="H6F88617E8F1A477AA2B9C304077EE284"><enum>(2)</enum><text display-inline="yes-display-inline">require the recipient for the Indian tribe, not later than 30 days after the Secretary provides notification pursuant to paragraph (1)—</text>
 <subparagraph id="HAC96270FFF1146AD90976A4897671460"><enum>(A)</enum><text display-inline="yes-display-inline">to notify the Secretary in writing of the reasons why the recipient has not requested the disbursement of the amounts; and</text>
 </subparagraph><subparagraph id="H97A0755CA02242AABF8D45A266F26E22"><enum>(B)</enum><text display-inline="yes-display-inline">to demonstrate to the satisfaction of the Secretary that the recipient has the capacity to spend Federal funds in an effective manner, which may include evidence of the timely expenditure of amounts previously distributed to the recipient under this Act.</text>
 </subparagraph></paragraph></subsection><subsection changed="deleted" id="HF092D73C150D4F76991628992E86C0A9" reported-display-style="strikethrough"><enum>(b)</enum><header>Allocation amount</header><text display-inline="yes-display-inline">Notwithstanding sections 301 and 302, the allocation for a recipient for a fiscal year described in subsection (a) shall be an amount equal to the difference between—</text>
 <paragraph id="id3FD08F9CD8A4433AB3997DFFDF10C4C2"><enum>(1)</enum><text display-inline="yes-display-inline">the amount initially calculated according to the formula; minus</text> </paragraph><paragraph id="id28D4BED0C93545EE9C1A693E40B016B9"><enum>(2)</enum><text display-inline="yes-display-inline">an amount equal to the difference between—</text>
 <subparagraph id="id2133353635174F2EAED0503208DFA7D7"><enum>(A)</enum><text display-inline="yes-display-inline">the total amount of undisbursed block grants for the recipient in the line of credit control system of the Department of Housing and Urban Development on January 1 of the fiscal year; and</text>
 </subparagraph><subparagraph id="id5B21D57882C8457CAAC876FE9EBCBF2C"><enum>(B)</enum><text display-inline="yes-display-inline">3 times the initial formula amount for the fiscal year.</text> </subparagraph></paragraph></subsection><subsection changed="added" id="id8740AA102C10454992ABF65A500F8496" reported-display-style="italic"><enum>(b)</enum><header>Allocation amount</header><text display-inline="yes-display-inline">Notwithstanding sections 301 and 302, the allocation for a recipient for a fiscal year described in subsection (a) shall be the greater of—</text>
 <paragraph id="id3555BE8DCC2A47A6AB24BEFD1A811476"><enum>(1)</enum><text display-inline="yes-display-inline">an amount equal to the difference between—</text> <subparagraph id="id33E135891BD74FBEB569543722CAA942"><enum><added-phrase reported-display-style="italic">(A)</added-phrase></enum><text display-inline="yes-display-inline">the amount initially calculated according to the formula; minus</text>
 </subparagraph><subparagraph id="idDDCB55B66AFE413E96FBAC77BF2B0156"><enum>(B)</enum><text>an amount equal to the difference between—</text> <clause id="idFAF527F6531049F7B45A076BBE58E6D4"><enum><added-phrase reported-display-style="italic">(i)</added-phrase></enum><text>the total amount of undisbursed block grants for the recipient in the line of credit control system (or a successor system) of the Department of Housing and Urban Development on October 1 of the fiscal year; and</text>
 </clause><clause id="id9E4B13FA014749BCBDD78E6070CA8321"><enum><added-phrase reported-display-style="italic">(ii)</added-phrase></enum><text display-inline="yes-display-inline">the sum of the initial allocations for the previous 3 fiscal years; or</text> </clause></subparagraph></paragraph><paragraph id="id7908C7AEFEC24F05ACE59F675E632738"><enum><added-phrase reported-display-style="italic">(2)</added-phrase></enum><text>the amount that the recipient would otherwise receive under section 302(d).</text>
 </paragraph></subsection><subsection id="HBA9A2A83C9FE454E9C63CF62C683901C"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any grant amounts not allocated to a recipient pursuant to subsection (b) shall be <deleted-phrase reported-display-style="strikethrough"></deleted-phrase>allocated<deleted-phrase reported-display-style="strikethrough"></deleted-phrase> <deleted-phrase reported-display-style="strikethrough">in accordance with sections 301 and 302</deleted-phrase><deleted-phrase reported-display-style="strikethrough">.</deleted-phrase> <added-phrase reported-display-style="italic">under the needs component of the formula.</added-phrase></text>
 </subsection><subsection id="H00889B6A54824E758E4F323F0FDC319C"><enum>(d)</enum><header>Inapplicability</header><text>Subsections (a) and (b) shall not apply to an Indian tribe with respect to any fiscal year for which the amount allocated for the Indian tribe for block grants under this Act is less than $5,000,000.</text>
 </subsection><subsection id="HB3997564665A443EABB1BAA2003360BE"><enum>(e)</enum><header>Effect</header><text>Nothing in this section—</text> <paragraph id="id93FF4B8BBA9943AD9B80BCD72A518D1C"><enum>(1)</enum><text>requires the promulgation of any regulation; or</text>
 </paragraph><paragraph id="id91D32CC6599C4C229588201B91C6E78A"><enum>(2)</enum><text>confers hearing rights under this section or any other provision of this Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H81946347422C454497B39B82B9F99ADD"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101</external-xref> note) is amended by inserting after the item relating to section 302 the following:</text>

 <section id="id60fa4018-f693-4486-ac49-18bf041983d3"><enum>401.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Section 407 (<external-xref legal-doc="usc" parsable-cite="usc/25/4167">25 U.S.C. 4167</external-xref>) is amended—</text> <paragraph id="id34e81ecf-a1f9-40ad-b998-e35dc23b1536"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>Congress</quote> and inserting <quote>Committee on Indian Affairs and the Committee on Banking, Housing and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives</quote>; and</text>

				</paragraph></section></title><title id="idd372c652-889c-446a-9824-64ebcf0b5134"><enum>V</enum><header>Other housing assistance for Native Americans</header>
 <section id="id00ebe099-b0f4-4b03-8037-3aaf053fef3c"><enum>501.</enum><header>HUD-Veterans Affairs Supportive Housing program for Native American Veterans</header><text display-inline="no-display-inline">Section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idc8b37f43-4a7d-484f-814c-063567e2a549" style="OLC">
					<subparagraph id="HA661F281A4B54B7B9B3FF9E9C2EC9CA6"><enum>(D)</enum><header>Native American veterans</header>
 <clause id="H03B0239CED5141CA840035A73DB60F69"><enum>(i)</enum><header>Authority</header><text display-inline="yes-display-inline">Of the funds made available for rental assistance under this subsection for fiscal year 2015 and each fiscal year thereafter, the Secretary shall set aside 5 percent for a supported housing and rental assistance program modeled on the HUD-Veterans Affairs Supportive Housing program, to be administered in conjunction with the Department of Veterans Affairs, for the benefit of homeless Native American veterans and veterans at risk of homelessness.</text>
 </clause><clause id="HC9F3ED041C5049F1AC442C294426FB70"><enum>(ii)</enum><header>Recipients</header><text>Funds made available under clause (i) shall be made available to recipients eligible to receive block grants under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>).</text>
 </clause><clause id="HEFEC8D11658F4714BCD7B06B0B6C580A"><enum>(iii)</enum><header>Funding criteria</header><text>Funds made available under clause (i) shall be awarded based on need, administrative capacity, and any other funding criteria established by the Secretary in a notice published in the Federal Register, after consultation with the Secretary of Veterans Affairs, by a date sufficient to provide for implementation of the program under this subparagraph in accordance with clause (i).</text>
 </clause><clause id="H26292E3373904ECCBD49AF44372A64D1"><enum>(iv)</enum><header>Program requirements</header><text>Funds made available under clause (i) shall be administered by block grant recipients in accordance with the program requirements of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) in lieu of any program requirements of this Act.</text>
 </clause><clause id="H76580492AFF44DBE9A7F779CED6EFB03"><enum>(v)</enum><header>Waiver</header><text>The Secretary may waive, or specify alternative requirements for any provision of any law or regulation that the Secretary administers in connection with the use of funds made available under this subparagraph, on a finding by the Secretary that a waiver or alternative requirement is necessary—</text>
 <subclause id="id4D152B47921044BBB25097EAF26DCBBE"><enum>(I)</enum><text>to promote administrative efficiency;</text> </subclause><subclause id="id4FE7EAF613BB4040B43475713B70D6BD"><enum>(II)</enum><text>to eliminate delay;</text>
 </subclause><subclause id="id894946BE14D34145B0F29074838D2F1C"><enum>(III)</enum><text>to consolidate or eliminate duplicative or ineffective requirements or criteria; or</text> </subclause><subclause id="id054D57304BFA491B8F35103944C36EEC"><enum>(IV)</enum><text>to otherwise provide for the effective delivery and administration of the supportive housing and rental assistance program described in clause (i) with respect to Native American veterans.</text>
 </subclause></clause><clause id="HC0445DA1295441F6A4CD4CE259A3A505"><enum>(vi)</enum><header>Consultation</header><text>Not later than a date that is sufficient to provide for implementation of the program under this subparagraph in accordance with clause (i), the Secretary and the Secretary of Veterans Affairs shall jointly consult with block grant recipients and any other appropriate tribal organizations to ensure—</text>
 <subclause id="H3936A64480E54048A0D7436339E131A2"><enum>(I)</enum><text>that block grant recipients administering funds made available under clause (i) are able to effectively coordinate with providers of supportive services provided in connection with the supportive housing and rental assistance program described in that clause; and</text>
 </subclause><subclause id="HD5742F51DF2D452980574341AAB7CBCF"><enum>(II)</enum><text>the effective delivery of supportive services to Native American veterans that are homeless or at risk of homelessness and eligible to receive assistance under this subparagraph.</text>
 </subclause></clause><clause id="H0245B5359E064AF99DB17C51A18EFC45"><enum>(vii)</enum><header>Notice</header><text>After providing to Indian tribes and tribally designated housing agencies opportunity for comment and consultation, the Secretary shall establish the requirements and criteria for the supportive housing and rental assistance program described in clause (i) by final notice published in the Federal Register.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id9416bb5c-c8ef-43cd-ab61-6d296a3d71ff"><enum>502.</enum><header>99-year leasehold interest in trust or restricted lands for housing purposes</header><text display-inline="no-display-inline">Section 702 (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211</external-xref>) is amended—</text> <paragraph id="id067F6552D21E438C82E4577FB6070884"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by inserting <quote>(in effect before, on, or after the date of enactment of this section)</quote> after <quote>law</quote>; and</text>
 </paragraph><paragraph id="id1859d3b72a774380bbfaf19ad621aa27"><enum>(2)</enum><text>by striking <quote>50 years</quote> each place it appears and inserting <quote>99 years</quote>.</text> </paragraph></section><section id="id83b3b325-d2d0-4ac9-a271-73a0d2a403f4"><enum>503.</enum><header>Training and technical assistance</header><text display-inline="no-display-inline">Section 703 (<external-xref legal-doc="usc" parsable-cite="usc/25/4212">25 U.S.C. 4212</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id261C8FD802214BD5A4EF42FC6656A19A" style="OLC">
 <section id="id97542EECE38541DEA46861D7EF0244E1"><enum>703.</enum><header>Training and technical assistance</header><text display-inline="no-display-inline">The Secretary shall make available for assistance, to be awarded on a competitive basis, for a national or regional organization representing Native American housing interests for providing training and technical assistance to Indian housing authorities and tribally designated housing entities such sums as may be necessary for each fiscal year.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H954D80D03FEB492FBF6B874FF6B10776"><enum>504.</enum><header>Loan guarantees for Indian housing</header><text display-inline="no-display-inline">Section 184(i)(5) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(i)(5)) is amended—</text>
 <paragraph id="H3AB9FEB819FE41B997DB6BC670E088A5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting after the period at the end of the first sentence <quote>There are authorized to be appropriated for those costs $12,200,000 for each of fiscal years 2016 through 2020.</quote>; and</text>
 </paragraph><paragraph id="HCA085B92DBEB402196722660AF0B2E40"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>2008 through 2012</quote> and inserting <quote>2016 through 2020</quote>.</text> </paragraph></section></title><title id="H00C7E008C3624D8BAD60B9A7FDAED22D"><enum>VI</enum><header>Demonstration program for alternative privatization authority for Native American housing</header> <section id="H8DDF91DFC53046C6A250894B214EF20C"><enum>601.</enum><header>Demonstration program</header><text display-inline="no-display-inline">At the end of the Act, add the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9CF950AC23AF45D8975B913C1AA4B6C4" style="OLC">
					<title id="H30497888C4C44950BEA39D26D075A544"><enum>IX</enum><header>Demonstration program for alternative privatization authority for Native American housing</header>
 <section id="HFE744634CB9F44B18E918ED8ECDB0972"><enum>901.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HD61ABA8AC2384DBC997248B426362A1F"><enum>(1)</enum><header>Affordable housing</header><text>The term <quote>affordable housing</quote> has the meaning given the term in section 4.</text>
 </paragraph><paragraph id="HC2C14BB2992440FC8CCFC5B5A72CA961"><enum>(2)</enum><header>Housing infrastructure</header><text display-inline="yes-display-inline">The term <quote>housing infrastructure</quote> means basic facilities, services, systems, and installations necessary or appropriate for the functioning of a housing community, including facilities, services, systems, and installations for water, sewage, power, communications, and transportation.</text>
 </paragraph><paragraph id="H5B7EDC7BC4E543DCADEBF7FAD96623A7"><enum>(3)</enum><header>Long-term lease</header><text>The term <quote>long-term lease</quote> means an agreement between a participating Indian tribe and a member of the participating Indian tribe that authorizes the member—</text>
 <subparagraph id="id6F6272FFF04B4F39A2D45CEB02AD5A77"><enum>(A)</enum><text>to occupy a specific plot of tribal land for 50 or more years; and</text> </subparagraph><subparagraph id="id38788A387E924F7990E24A81BB6057AF"><enum>(B)</enum><text>to request renewal of the agreement at least once.</text>
 </subparagraph></paragraph><paragraph id="HEDC37BACE9B74DBCB1EA7580864C6623"><enum>(4)</enum><header>Participating Indian tribe</header><text>The term <quote>participating Indian tribe</quote> means an Indian tribe for which a final plan under section 905 for participation in the demonstration program under this title has been approved by the Secretary under section 906.</text>
							</paragraph></section><section id="H9F5C979FF44243F19A3FB2860C8DF35E"><enum>902.</enum><header>Authority</header>
 <subsection id="H4B415954E3D541468282480FDC7C0A69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other authority provided in this Act for the construction, development, maintenance, and operation of housing for Indian families, the Secretary shall provide a participating Indian tribe having a final plan approved pursuant to section 906 with the authority to exercise the activities provided under this title and the plan for the acquisition and development of housing to meet the needs of members of the participating Indian tribe.</text>
 </subsection><subsection id="H318A8AD531734B299A95904A24426239"><enum>(b)</enum><header>Inapplicability</header><text>Except as otherwise specifically provided in this title, titles I through IV, VI, and VII shall not apply to the use of funds by a participating Indian tribe during any period during which the Indian tribe is participating in the demonstration program under this title.</text>
 </subsection><subsection id="H1CEA9BAE650A48598CED1CA59E25DD52"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The following provisions of titles I through VIII shall apply to the demonstration program under this title and amounts made available under the demonstration program under this title:</text>
 <paragraph id="H16DDC4A7B69B49A7958B422309E6F526"><enum>(1)</enum><text>Subsections (d) and (e) of section 101 (relating to tax exemption).</text> </paragraph><paragraph id="HDC0C4DBB9AA34AFE89A9D95B014DAA4E"><enum>(2)</enum><text>Section 101(j) (relating to Federal supply sources).</text>
 </paragraph><paragraph id="H4AD2965A71924130824DCFBEF0DB0E35"><enum>(3)</enum><text>Section 101(k) (relating to tribal preference in employment and contracting).</text> </paragraph><paragraph id="HD6CF95D249564615BA9C98841A9DB238"><enum>(4)</enum><text>Section 104 (relating to treatment of program income and labor standards).</text>
 </paragraph><paragraph id="H135FAFDAEB094D428DD0D22E28C864BA"><enum>(5)</enum><text>Section 105 (relating to environmental review).</text> </paragraph><paragraph id="H9F79F2724F604CB3B237601251381DAC"><enum>(6)</enum><text>Section 201(b) (relating to eligible families), except as otherwise provided in this title.</text>
 </paragraph><paragraph id="HD1ECC0DD794C48F6B43227606F6F5620"><enum>(7)</enum><text>Section 203(g) (relating to a de minimis exemption for procurement of goods and services).</text> </paragraph><paragraph id="H52D3814AF3A04C0589E3B71A670326B6"><enum>(8)</enum><text>Section 702 (relating to 99-year leasehold interests in trust or restricted lands for housing purposes).</text>
								</paragraph></subsection></section><section id="H08D1FC073FAC44808EC6E85C82BC536F"><enum>903.</enum><header>Participating tribes</header>
 <subsection id="H9C06B37A5FFF413BAF841E6CFE535F29"><enum>(a)</enum><header>Request To participate</header><text display-inline="yes-display-inline">To be eligible to participate in the demonstration program under this title, an Indian tribe shall submit to the Secretary a notice of intention to participate during the 60-day period beginning on the date of enactment of this title, in such form and such manner as the Secretary shall require.</text>
 </subsection><subsection id="H01FAFC65BD4C4ED4A38BF7763AB3D9B2"><enum>(b)</enum><header>Cooperative agreement</header><text>On approval under section 906 of the final plan of an Indian tribe for participation in the demonstration program under this title, the Secretary shall enter into a cooperative agreement with the participating Indian tribe that provides the Indian tribe with the authority to carry out activities under the demonstration program.</text>
 </subsection><subsection id="H7A1856C5366A4EA5ACB138E7EEC50000"><enum>(c)</enum><header>Limitation</header><text>The Secretary shall not approve more than 20 Indian tribes for participation in the demonstration program under this title.</text>
							</subsection></section><section id="HAC909A35F0EE46EA8C0E72E4496FFB78"><enum>904.</enum><header>Request for quotes and selection of investor partner</header>
 <subsection id="H531DA883810C4A119DCE979A7F5F3309"><enum>(a)</enum><header>Request for quotes</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Indian tribe submits notice under section 903(a), the Indian tribe shall—</text>
 <paragraph id="H1D359D93ECC849A8B9A7BF1402BE2112"><enum>(1)</enum><text>obtain assistance from a qualified entity in assessing the housing needs, including the affordable housing needs, of the Indian tribe; and</text>
 </paragraph><paragraph id="HA2E929ED0A7048EF81F96CDF551C12D0"><enum>(2)</enum><text>release a request for quotations from entities interested in partnering with the Indian tribe in designing and carrying out housing activities sufficient to meet the housing needs of the Indian tribe as identified pursuant to paragraph (1).</text>
								</paragraph></subsection><subsection id="H1D25A6797E3544E08075106423992F02"><enum>(b)</enum><header>Selection of investor partner</header>
 <paragraph id="H425BEE1CC2FF4EAD92863A6BBBEB0283"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 18 months after the date of enactment of this title, an Indian tribe requesting to participate in the demonstration program under this title shall—</text>
 <subparagraph id="H8527BCF10DDD428EB955C2D8976C990A"><enum>(A)</enum><text>select an investor partner from among the entities that have responded to the request of the Indian tribe for quotations under subsection (a)(2); and</text>
 </subparagraph><subparagraph id="H06D14E20D46B42548473CEF65E7286CB"><enum>(B)</enum><text>together with that investor partner, establish and submit to the Secretary a final plan that meets the requirements described in section 905.</text>
 </subparagraph></paragraph><paragraph id="H19A9F83994E849B7B98264259407796D"><enum>(2)</enum><header>Exceptions</header><text>The Secretary may extend the period under paragraph (1) for any Indian tribe that—</text> <subparagraph id="H0CDF934D7738420DB95F8CBEC4D0AA54"><enum>(A)</enum><text>has not received any satisfactory quotation in response to the request released pursuant to subsection (a)(2); or</text>
 </subparagraph><subparagraph id="H769A781187E447A7B7B112F816CE47DB"><enum>(B)</enum><text>has any other satisfactory reason, as determined by the Secretary, for failure to select an investor partner.</text>
 </subparagraph></paragraph></subsection></section><section id="HC973D9C7155E4B13929433973A9BF034"><enum>905.</enum><header>Final plan</header><text display-inline="no-display-inline">A final plan of an Indian tribe for participation in the demonstration program under this title shall—</text>
 <paragraph id="HB507FD466A974E37AAF5E16344DDBBA3"><enum>(1)</enum><text>be developed by the Indian tribe and the investor partner of the Indian tribe selected under section 904(b)(1)(A);</text>
 </paragraph><paragraph id="H4975D9CD24F843E2B45E3FB4AC9393B0"><enum>(2)</enum><text>identify the qualified entity that assisted the Indian tribe in assessing the housing needs of the Indian tribe;</text>
 </paragraph><paragraph id="HB79650B3E86D45E184ED30156AB1E799"><enum>(3)</enum><text>set forth a detailed description of the projected housing needs, including affordable housing needs, of the Indian tribe, which shall include—</text>
 <subparagraph id="H326F99340EDA42F8B017C643E0A9EEC9"><enum>(A)</enum><text>a description of those projected housing needs over—</text> <clause id="idF665FD107BA94A51842313F2C2DF2C71"><enum>(i)</enum><text>the 2-year period following the date of submission of the final plan; and</text>
 </clause><clause id="id98A2AE3394684CDA850344B94D081BD5"><enum>(ii)</enum><text>the period that is the earlier-ending period of—</text> <subclause id="idE3B7DDFEA0B54818897E074B87F04FE0"><enum>(I)</enum><text>the 5-year period following the expiration of the 2-year period described in clause (i); and</text>
 </subclause><subclause id="id01048934942043B9935F91E50EC2AD45"><enum>(II)</enum><text>the period ending on the date on which those projected housing needs are met; and</text> </subclause></clause></subparagraph><subparagraph id="H23FE950FA89042638A3CBB1AC3A5F996"><enum>(B)</enum><text>the same information that would be required under section 102 to be included in an Indian housing plan for the Indian tribe, as modified by the Secretary to take consideration of the requirements of the demonstration program under this title;</text>
 </subparagraph></paragraph><paragraph id="H28F3AFD581044A5986B258BEF6F4E78A"><enum>(4)</enum><text display-inline="yes-display-inline">provide for specific housing activities sufficient to meet the housing needs of the Indian tribe, including affordable housing needs, as identified pursuant to paragraph (3) within the time periods referred to in that paragraph, which shall include—</text>
 <subparagraph id="H044DE25E896749CD980516E33F605143"><enum>(A)</enum><text display-inline="yes-display-inline">development of affordable housing;</text> </subparagraph><subparagraph id="H070610ACD2414B35A3BA6A861B04530C"><enum>(B)</enum><text>development of conventional homes for rental, lease-to-own, or sale, which may be combined with affordable housing developed pursuant to subparagraph (A);</text>
 </subparagraph><subparagraph id="H07F4320FC3B642A48C0E779D96E7EC74"><enum>(C)</enum><text>development of housing infrastructure, including housing infrastructure sufficient to serve affordable housing developed under the final plan; and</text>
 </subparagraph><subparagraph id="HF8123F1B788F4313801FA2CD97BBEA52"><enum>(D)</enum><text>investments by the investor partner, the Indian tribe, members of the Indian tribe, and financial institutions and other outside investors necessary to provide financing for the development of housing under the final plan and for mortgages for members of Indian tribes purchasing that housing;</text>
 </subparagraph></paragraph><paragraph id="HA04423528AA7484F87A86FD2A5FCD283"><enum>(5)</enum><text>provide that the Indian tribe will agree to provide long-term leases to members of the Indian tribe sufficient for lease-to-own arrangements for, and sale of, the housing developed pursuant to paragraph (4);</text>
 </paragraph><paragraph id="HBB185B9C47EF4E18A92B124D4BA7215D"><enum>(6)</enum><text>provide that the Indian tribe—</text> <subparagraph id="HE557507478654834AA08A63DF5948EBB"><enum>(A)</enum><text display-inline="yes-display-inline">will be liable for delinquencies under mortgage agreements for housing developed under the final plan that are financed under the final plan and entered into by members of the Indian tribe; and</text>
 </subparagraph><subparagraph id="H7894DB23CF7643699A6A521E71C524FA"><enum>(B)</enum><text>shall, on foreclosure under a mortgage described in subparagraph (A), take possession of the housing and have the responsibility for making the housing available to other members of the Indian tribe;</text>
 </subparagraph></paragraph><paragraph id="HF7A08155337F4203AF5AD4DA2BF25B80"><enum>(7)</enum><text>provide for sufficient protections, as determined by the Secretary, to ensure that the Indian tribe and the Federal Government are not liable for the acts of the investor partner or of any contractors;</text>
 </paragraph><paragraph id="HF494528D58EB43CFA42184631D0A054C"><enum>(8)</enum><text>provide that the Indian tribe shall have sole final approval of the design and location of housing developed under the final plan; and</text>
 </paragraph><paragraph id="H7D05611BFD9545AFB2F7414A584211C7"><enum>(9)</enum><text>set forth—</text> <subparagraph id="id5E1BD80C844E4425A0FF775D90BFB1FC"><enum>(A)</enum><text>specific deadlines and schedules for activities to be carried out under the final plan;</text>
 </subparagraph><subparagraph id="idD40D15337E884CE490C39DFF2E151D73"><enum>(B)</enum><text>the responsibilities of the Indian tribe and the investor partner;</text> </subparagraph><subparagraph id="HC7C549AA8BF746E7A174CE97AE6AAFFE"><enum>(C)</enum><text>specific terms and conditions—</text>
 <clause id="idD28D5B2435394E36922E341A77B60703"><enum>(i)</enum><text>for return on investment by the investor partner and other investors under the plan; and</text> </clause><clause id="idA9C3562E051C4249A7287CDD6E8CF44C"><enum>(ii)</enum><text>to provide that the Indian tribe shall pledge grant amounts allocated for the Indian tribe pursuant to title III for that return on investment;</text>
 </clause></subparagraph><subparagraph id="H775229C2338B49819B9EA48B58E33E28"><enum>(D)</enum><text display-inline="yes-display-inline">the terms of a cooperative agreement on the operation and management of the current assistance housing stock and current housing stock for the Indian tribe assisted under titles I through VIII;</text>
 </subparagraph><subparagraph id="HDBAF074F97DD41D98BEC0EDE68C188D8"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id263121A985804658A4F18EF75BE19D34"><enum>(i)</enum><text>any plans for the sale of the affordable housing of the Indian tribe under section 906; and</text> </clause><clause id="id959369A24BF240DD96D14E678DD936AB" indent="up1"><enum>(ii)</enum><text>if those plans are included, additional plans sufficient to meet the requirements of section 906 regarding meeting future affordable housing needs of the Indian tribe;</text>
 </clause></subparagraph><subparagraph id="HBD682E538AB5462386F226289FAB0A8F"><enum>(F)</enum><text>terms for enforcement of the final plan, including an agreement regarding jurisdiction of any actions under or to enforce the final plan, including a waiver of immunity; and</text>
 </subparagraph><subparagraph id="H37FE4B72C8A14598ABD30E825561A420"><enum>(G)</enum><text>any other information determined appropriate by the Indian tribe and the investor partner.</text> </subparagraph></paragraph></section><section id="HFCD813967DEF4873A29F8C9040EC2207"><enum>906.</enum><header>HUD review and approval of plan</header> <subsection id="HAF525EB8924D4D89A8C12576FBC140CA"><enum>(a)</enum><header>In general</header> <paragraph id="idBD78991775D74A6486EF55C040CD708F"><enum>(1)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 90 days after the date of submission by an Indian tribe of a final plan under section 905 to the Secretary, the Secretary shall—</text>
 <subparagraph id="idDCD0501E0AC54A238F7EC0E397F066A0"><enum>(A)</enum><text display-inline="yes-display-inline">review the plan and the process by which the Indian tribe solicited requests for quotations from investors and selected the investor partner under section 904(b)(1); and</text>
 </subparagraph><subparagraph id="id19E46081D3834169AD386B13D68FDC11"><enum>(B)</enum><text display-inline="yes-display-inline">approve or disapprove the plan in accordance with paragraphs (2) and (3).</text> </subparagraph></paragraph><paragraph id="HC16ABA35067A4F1499B5DAB88E43A58B"><enum>(2)</enum><header>Approval</header> <subparagraph id="idC0D0A7BE76344DF39DAD4F93220FE817"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">After the review described in paragraph (1), the Secretary shall approve the plan, unless the Secretary determines that—</text>
 <clause id="id1C8FF3994AB3434A87FD9832653E2506"><enum>(i)</enum><text display-inline="yes-display-inline">the assessment of the housing needs of the Indian tribe by the qualified entity, or as set forth in the plan pursuant to section 905(3), is inaccurate or insufficient;</text>
 </clause><clause id="id3E67135432A443508AF6E08A22ECB735"><enum>(ii)</enum><text display-inline="yes-display-inline">the process established by the Indian tribe to solicit requests for quotations and select an investor partner was insufficient or negligent; or</text>
 </clause><clause id="idFC15EFEB191C4C45AAE43B04547C20D4"><enum>(iii)</enum><text display-inline="yes-display-inline">the plan is insufficient to meet the housing needs of the Indian tribe, as identified in the plan pursuant to section 905(3).</text>
 </clause></subparagraph><subparagraph id="id82EAE05E34EA46509CE1A2873BE88E8B"><enum>(B)</enum><header>Opportunity for revision</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), the Secretary shall approve a plan determined insufficient under subparagraph (A), on the condition that the Indian tribe and the investor partner make such revisions to the plan as the Secretary may require to meet the needs of the Indian tribe for affordable housing.</text>
 </subparagraph></paragraph><paragraph id="idF868342894AB45DB971778CFE593FF7A"><enum>(3)</enum><header>Disapproval</header><text display-inline="yes-display-inline">The Secretary may disapprove the plan only if—</text> <subparagraph id="id7762C54775A24A729C869DA1E4133CFA"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines that the plan fails to meet the minimal housing standards and requirements of this Act; and</text>
 </subparagraph><subparagraph id="id6670274C075849CD8977EA8FA4694F9D"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary notifies the Indian tribe of the elements requiring the disapproval.</text> </subparagraph></paragraph></subsection><subsection id="H01F65E2CB7D340E0989489FA19AE200E"><enum>(b)</enum><header>Action upon disapproval</header> <paragraph id="H0E9AFDDD21F042E49AE5F71084387317"><enum>(1)</enum><header>Resubmission of plan</header><text display-inline="yes-display-inline">Subject to paragraph (2), in the case of any disapproval of a final plan of an Indian tribe under subsection (a)(3), the Secretary shall allow the tribe, for a period of 180 days beginning on the date of the notification to the tribe of the disapproval, to resubmit a revised plan for approval.</text>
 </paragraph><paragraph id="H4BFE9AD0B78A4684A2C49176A2CB959A"><enum>(2)</enum><header>Limitation</header><text>If the final plan for an Indian tribe is resubmitted pursuant to paragraph (1) and the Secretary disapproves the plan a second time, the Indian tribe—</text>
 <subparagraph id="id4910F46B24CD49D096252AADD48BB4C1"><enum>(A)</enum><text>may not thereafter resubmit the plan; and</text> </subparagraph><subparagraph id="id2389EF0BCC2C489FB281686A1A980482"><enum>(B)</enum><text>shall be ineligible to participate in the demonstration program under this title.</text>
 </subparagraph></paragraph></subsection><subsection id="H23003CACECEA46AB9F72BD4B32B6FCBF"><enum>(c)</enum><header>Tribal authority over housing design and location</header><text>The Secretary may not disapprove a final plan under section 905 or condition approval of that plan based on the design or location of any housing to be developed or assisted under the plan.</text>
 </subsection><subsection id="HE5AF5B0ECC234C35B623B22517998053"><enum>(d)</enum><header>Failure To notify</header><text>If the Secretary does not notify an Indian tribe submitting a final plan of approval, conditional approval, or disapproval of the plan before the expiration of the period referred to in subsection (a)(1), the plan shall be deemed approved for purposes of this title.</text>
							</subsection></section><section id="H82C84419B59948BD8EE1DE86D21A0F12"><enum>907.</enum><header>Treatment of allocation</header>
 <subsection id="id11D122DC399046379344DE52FAF6B9E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts otherwise allocated for a participating Indian tribe under title III—</text> <paragraph id="id51CEFF91D5604F8C9F3DFB7569E8D23A"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be made available to the participating Indian tribe under titles I through VIII; and</text>
 </paragraph><paragraph id="idCBB9EE3E2F5340AE9E81018F3F039DEE"><enum>(2)</enum><text display-inline="yes-display-inline">shall only be available for the participating Indian tribe, on request by the participating Indian tribe and approval by the Secretary, for the purposes described in subsections (b) through (e).</text>
 </paragraph></subsection><subsection id="H498FE5BA0FBD4A88A8B081012B503113"><enum>(b)</enum><header>Return on investment</header><text>The Secretary may use the amounts described in subsection (a) to ensure the payment of any amounts pledged by a participating Indian tribe pursuant to section 905(9)(C) for return on the investment made by the investor partner or other investors.</text>
 </subsection><subsection id="H6F6CADD6AD664107970CFEAD0AD8111A"><enum>(c)</enum><header>Administrative expenses</header><text>The Secretary may provide to a participating Indian tribe, on the request of the participating Indian tribe, not greater than 10 percent of any annual allocation made under title III for the participating Indian tribe during that fiscal year for the administrative costs of the participating Indian tribe in carrying out the requirements of sections 904 and 905.</text>
 </subsection><subsection id="H343CA966588F410C9C4FF52CD4562780"><enum>(d)</enum><header>Housing infrastructure costs</header><text>A participating Indian tribe may use the amounts described in subsection (a) for housing infrastructure costs associated with providing affordable housing for the participating Indian tribe under the final plan.</text>
 </subsection><subsection id="H201F1CCDEB0645269923A674577ECB95"><enum>(e)</enum><header>Maintenance; tenant services</header><text>A participating Indian tribe may use the amounts described in subsection (a) for maintenance of affordable housing for the participating Indian tribe and for the eligible affordable housing activities described in paragraphs (3), (4), and (5) of section 202.</text>
 </subsection></section><section id="H839D8DF617D44092B17951E092449E06"><enum>908.</enum><header>Resale of affordable housing</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, a participating Indian tribe may, in accordance with the provisions of the final plan of the participating Indian tribe approved pursuant to section 906, resell any affordable housing developed with assistance made available under this Act for use other than as affordable housing, on the condition that the tribe provides such assurances as the Secretary determines are appropriate to ensure that the participating Indian tribe—</text>
 <paragraph id="H2CD3C198A3D6471782DEC420B2CE2FC9"><enum>(1)</enum><text>is meeting the need for affordable housing of the participating Indian tribe;</text> </paragraph><paragraph id="H834D9950C90C470095FE5050D6E2D4E8"><enum>(2)</enum><text>will provide affordable housing in the future sufficient to meet future affordable housing needs; and</text>
 </paragraph><paragraph id="H8F488BF226F44E82AF49E52224B4484A"><enum>(3)</enum><text>will use any proceeds only—</text> <subparagraph id="id5389B72E47AD4B49AB400F788119CC8E"><enum>(A)</enum><text>to meet those future affordable housing needs; or</text>
 </subparagraph><subparagraph id="id8320F2168ECC4D39A853DCDC7971F2B6"><enum>(B)</enum><text>in accordance with section 907.</text> </subparagraph></paragraph></section><section id="H0B68929E1F084A24B14AB8FE85D838FE"><enum>909.</enum><header>Reports, audits, and compliance</header> <subsection id="HF2E0B48406D94D0C8F5DE5D1D9786CAD"><enum>(a)</enum><header>Annual reports by tribe</header><text display-inline="yes-display-inline">Each participating Indian tribe shall submit to the Secretary annually a report—</text>
 <paragraph id="idA221C8EF3786419EB89F592BEE1454B6"><enum>(1)</enum><text display-inline="yes-display-inline">describing the progress of the participating Indian tribe in complying with, and meeting the deadlines and schedules set forth in, the approved final plan for the participating Indian tribe; and</text>
 </paragraph><paragraph id="idBD0ED96F3AD0467CB74A86A43F4785AA"><enum>(2)</enum><text display-inline="yes-display-inline">containing such other information as the Secretary may require.</text> </paragraph></subsection><subsection id="H36728AD6BDF749EDAE73E9A7F82A7F93"><enum>(b)</enum><header>Reports to Congress</header><text>The Secretary shall submit to Congress annually a report describing the activities and progress of the demonstration program under this title, including—</text>
 <paragraph id="H8629DCF85B9642628939CCC36533ECAC"><enum>(1)</enum><text>a summary of the information in the reports submitted under subsection (a);</text> </paragraph><paragraph id="H273ED466FF2B4F6DB01869CF9618058D"><enum>(2)</enum><text>the number of Indian tribes that have selected an investor partner pursuant to a request for quotations under section 904;</text>
 </paragraph><paragraph id="HB7FBC7F8A32F4246A7F2EFF0F6EF2AA6"><enum>(3)</enum><text display-inline="yes-display-inline">for each tribe applying for participation in the demonstration program the final plan of which was disapproved under section 906(a)(3), a detailed description and explanation of—</text>
 <subparagraph id="id8D188711FF6642C9AE36FB96163035CB"><enum>(A)</enum><text display-inline="yes-display-inline">the reasons for the disapproval; and</text> </subparagraph><subparagraph id="id78F1F52ECA994A309C7D590D4D457863"><enum>(B)</enum><text display-inline="yes-display-inline">all actions taken by the Indian tribe to eliminate the reasons for disapproval, and an identification of whether the tribe has re-submitted a final plan;</text>
 </subparagraph></paragraph><paragraph id="H2B5372977B964B9D8881A32A905BB2F7"><enum>(4)</enum><text>an identification, by participating Indian tribe, of any amounts requested and approved for use under section 907; and</text>
 </paragraph><paragraph id="H2539C326B24E45DC9E4F4A345EB0FF3B"><enum>(5)</enum><text>an identification of any participating Indian tribes that have terminated participation in the demonstration program and the circumstances of the terminations.</text>
 </paragraph></subsection><subsection id="H4E13D5F9895541738885FBF90F53265E"><enum>(c)</enum><header>Audits</header><text>The Secretary shall provide for audits among participating Indian tribes to ensure implementation and compliance with the final plans for the participating Indian tribes, including on-site visits with participating Indian tribes and requests for documentation appropriate to ensure the compliance.</text>
							</subsection></section><section id="HF8B407D392AD410CBFD65747FA7B5314"><enum>910.</enum><header>Termination of tribal participation</header>
 <subsection id="H4199C51B0801449ABD30127E148D14DA"><enum>(a)</enum><header>Termination of participation</header><text display-inline="yes-display-inline">A participating Indian tribe may terminate participation in the demonstration program under this title at any time, subject to this section.</text>
							</subsection><subsection id="H3AD971F9B63D42E2931DFA303F9A34DD"><enum>(b)</enum><header>Effect on existing obligations</header>
 <paragraph id="H01CB5543CC2444308AD72C49E41022DF"><enum>(1)</enum><header>No automatic termination</header><text display-inline="yes-display-inline">Termination by a participating Indian tribe in the demonstration program under this section shall not terminate any obligations of the Indian tribe under agreements entered into under the demonstration program with the investor partner of the Indian tribe or any other investors or contractors.</text>
 </paragraph><paragraph id="H588FF37C0970483FB7D5D30AA7844FE7"><enum>(2)</enum><header>Authority to mutually terminate agreements</header><text>Nothing in this title prevents an Indian tribe that terminates participation in the demonstration program and any party with which the Indian tribe has entered into an agreement from mutually agreeing to terminate that agreement.</text>
 </paragraph></subsection><subsection id="HEEF83E30E7224C69A757513367E10325"><enum>(c)</enum><header>Receipt of remaining grant amounts</header><text>The Secretary shall provide for grants to be made in accordance with, and subject to the requirements of, this Act for any amounts remaining after use pursuant to section 907 from the allocation under title III for an Indian tribe that terminates participation in the demonstration program.</text>
 </subsection><subsection id="H3F5A4498B9FC4E42BF5896ADAA432285"><enum>(d)</enum><header>Costs and obligations</header><text>The Secretary shall not be liable for any obligations or costs incurred by an Indian tribe during its participation in the demonstration program under this title.</text>
 </subsection></section><section id="H70A785FAD64341619997C70DAAA139A8"><enum>911.</enum><header>Final report</header><text display-inline="no-display-inline">Not later 5 years after the date of enactment of this title, the Secretary shall submit to Congress a final report describing the effectiveness of the demonstration program, which shall include—</text>
 <paragraph id="HF0C6AC8F4EC94E3AA3442A7E3404214A"><enum>(1)</enum><text>an assessment of the success under the demonstration program of participating Indian tribes in meeting the housing needs of the participating Indian tribe, including affordable housing needs, on tribal land;</text>
 </paragraph><paragraph id="H6A075A66593042D096D47E3AC8353BD0"><enum>(2)</enum><text>recommendations for any improvements to the demonstration program; and</text> </paragraph><paragraph id="H2F680A3A8E2C446DA232588841AE38B1"><enum>(3)</enum><text>a determination of whether the demonstration program should be expanded into a permanent program available for Indian tribes to opt into at any time and, if so, recommendations for that expansion, including any legislative actions necessary to expand the program.</text>
 </paragraph></section><section id="HCFF3DF686D404649BEA202E895F958F3"><enum>912.</enum><header>Notice</header><text display-inline="no-display-inline">The Secretary shall establish any requirements and criteria necessary to carry out the demonstration program under this title by notice published in the Federal Register.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
