			 receive FBI background checks prior to being hired, and for other
 purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safety for Our Schoolchildren Act of 2015</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idDB0A8C8449EC4AB5860ED97D979AD181" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Background checks for public school
 employees</header><subsection commented="no" display-inline="no-display-inline" id="idC5AFADD7A05642C18EEC4145A5A6DFE3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id15F105B07E7F48D6B3B6D93867A04A30" style="OLC"><part commented="no" id="id390BD1C08F694FE18E2375155073ECEE" level-type="subsequent"><enum>D</enum><header display-inline="yes-display-inline">Background checks for public school
 employees</header><section commented="no" display-inline="no-display-inline" id="id680ED73A40A04C2992764B6C29171A73" section-type="subsequent-section"><enum>4401.</enum><header display-inline="yes-display-inline">Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id3210F9A30F204DDB992D0234E509304E"><enum>(a)</enum><header display-inline="yes-display-inline">Crime of violence</header><text display-inline="yes-display-inline">The term <term>crime of violence</term> has the meaning given the term in section 924(c)(3) of title 18, United States Code.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id36E3E0D31AA44E6D9CD0659F22484BA6"><enum>(b)</enum><header display-inline="yes-display-inline">Drunk driving</header><text display-inline="yes-display-inline">The term <term>drunk driving</term> means driving while intoxicated or driving under the influence of alcohol.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id11334ACBB48749F78829BACDF19F3530"><enum>(c)</enum><header display-inline="yes-display-inline">FBI background check</header><text display-inline="yes-display-inline">The term <term>FBI background check</term> means a criminal history background check as described in section 231 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13041">42 U.S.C. 13041</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id189707948175441D9253201E4BDC71ED"><enum>(d)</enum><header display-inline="yes-display-inline">School employee</header><text display-inline="yes-display-inline">The term <term>school employee</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id1AB010A7D7524F4CBBCE7B35F94B4DA5"><enum>(1)</enum><text display-inline="yes-display-inline">an employee of a local educational agency or State educational agency who works in a public school or has a job duty that results in exposure to students, including administrators, teachers, substitute teachers, custodians, cafeteria workers, and school bus drivers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23F97EC85FC14EF0988A7412F6D6AE97"><enum>(2)</enum><text display-inline="yes-display-inline">an employee of a company, or a subsidiary of a company, that has a contract with a local educational agency or State educational agency who works in a public school or has a job duty that results in exposure to students.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id87AA2210E2264BB2BB17454060A7D036"><enum>(e)</enum><header display-inline="yes-display-inline">Serious moving violation</header><text display-inline="yes-display-inline">The term <term>serious moving violation</term> means a driving violation that is a felony, as determined by State law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id87CB78B3963240C0905B85435962831E"><enum>(f)</enum><header display-inline="yes-display-inline">Sexual predator</header><text display-inline="yes-display-inline">The term <term>sexual predator</term> means an individual 18 years of age or older who has been convicted of, or pled guilty to, a sexual offense against a minor.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id1D61EB071F2F43EFB5866EB8C5EA7EBB" section-type="subsequent-section"><enum>4402.</enum><header display-inline="yes-display-inline">Background checks for public school
 employees</header><subsection commented="no" display-inline="no-display-inline" id="id0C04F3E41F834BCD9444188A2F2437D9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A local educational agency or State educational agency that receives Federal funds shall obtain an FBI background check on an individual prior to making an offer of employment as a school employee with such agency to such individual.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idA412B695CBCE40599077C54F6EE9851C"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition against employment of felons or
 violent criminals</header><text display-inline="yes-display-inline">A local educational agency or State educational agency that receives Federal funds may not make an offer of employment to an individual for a position as a school employee with such agency if such individual has been convicted of a crime of violence or other felony.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idD1A4644147754917800C0CE5DF9324E4"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting sexual predators</header><text display-inline="yes-display-inline">A local educational agency or State educational agency that receives information from an FBI background check that an individual who has applied for employment with such agency as a school employee is a sexual predator shall report to local law enforcement that such individual has so applied.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id717D2767295E454BA9352977CF164B24"><enum>(d)</enum><header display-inline="yes-display-inline">Transportation</header><text display-inline="yes-display-inline">A local educational agency or State educational agency that receives Federal funds may not make an offer of employment to an individual for a position as a school bus driver if such individual has been convicted of, or pled guilty to, drunk driving or a serious moving violation.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id3D6A38E29ABF410E8A37BB7AB673F3BD" section-type="subsequent-section"><enum>4403.</enum><header display-inline="yes-display-inline">Loss of Federal funds for failure to
 comply</header><subsection commented="no" display-inline="no-display-inline" id="id8E15C9007D374311AC4D153CA0AE804C"><enum>(a)</enum><header display-inline="yes-display-inline">State educational agencies</header><paragraph commented="no" display-inline="no-display-inline" id="idE5B73CD3759E43A7BBF80ABBC870A10C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a State educational agency fails to take an action required under this part or takes an action prohibited under this part for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2D08A5A2F33945D7B5F8057D4F9130CA"><enum>(A)</enum><text display-inline="yes-display-inline">6 months or less, the Secretary shall withhold from such agency 50 percent of the amount of funds such agency has allocated for planning and administrative use under section 2113(d); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0265697457924C4B8850B32678775EBC"><enum>(B)</enum><text display-inline="yes-display-inline">longer than 6 months but not longer than 12 months, the Secretary shall withhold from such agency 100 percent of the amount of funds such agency has allocated for planning and administrative use under section 2113(d).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ED2C92D47594D068599671524FEE9EC"><enum>(2)</enum><header display-inline="yes-display-inline">Loss of title II administrative
 funds</header><text display-inline="yes-display-inline">If a State educational agency fails to take an action required under this part or takes an action prohibited under this part for longer than 12 months, the Secretary shall withhold from such agency the amount of funds such agency has allocated for planning and administrative use under title II.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2821809ED1CE42BD8856FE1F34592BF3"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibition against reallocation</header><subparagraph commented="no" display-inline="no-display-inline" id="id5B4FBD515CA64FFF9DFBDA33CA5B30D3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency that fails to take an action under this part or takes an action prohibited under this part as described in paragraph (1) or (2) may not reallocate Federal funds provided for teacher development under title II for planning and administrative use by the agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDE6FD3BC1AB450EA875621AD2ED912D"><enum>(B)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">The Secretary shall withhold all Federal funds under title II to a State educational agency if such agency reallocates funds as prohibited under subparagraph (A) until such agency restores the funds for teacher development.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB84391725B2D44D7827C848FCD99DA9A"><enum>(b)</enum><header display-inline="yes-display-inline">Local educational agencies</header><text display-inline="yes-display-inline">If a local educational agency fails to take an action required under this part or takes an action prohibited under this part, the local educational agency shall not be eligible to receive a subgrant or any additional funds under section 2121.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id91D6A746577440FB8C6013BCE9AD2E8B"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">The table of contents in section 2 of the Elementary and Secondary Education Act of 1965 is amended by inserting after the item relating to section 4304 the following:</text><quoted-block display-inline="no-display-inline" id="id9b746658-4471-47bd-aad6-31a3c5bf28c0" style="OLC"><toc><toc-entry bold="off" idref="id390BD1C08F694FE18E2375155073ECEE" level="part">Part D—Background checks for public school employees</toc-entry><toc-entry bold="off" idref="id680ED73A40A04C2992764B6C29171A73" level="section">Sec. 4401. Definitions.</toc-entry><toc-entry bold="off" idref="id1D61EB071F2F43EFB5866EB8C5EA7EBB" level="section">Sec. 4402. Background checks for public school
