	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id7C7039101E944E35BCC9B121967A9BBB" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Return of bonuses awarded to employees of Department of Veterans Affairs for performance they
			 misrepresented</header>
 <subsection commented="no" display-inline="no-display-inline" id="id62CE048CB02E457D9C1D67411749316C"><enum>(a)</enum><header display-inline="yes-display-inline">Investigations</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Inspector General of the Department of Veterans Affairs submits to Congress a report described in subsection (b), the Secretary of Veterans Affairs shall identify each employee of the Department of Veterans Affairs who—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id93FF406CA9F343E1AEB1EA56A726B583"><enum>(1)</enum><text display-inline="yes-display-inline">during any of fiscal years 2011 through 2014—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id0F06FE5FA15E49B49A7D6A0759920E8C"><enum>(A)</enum><text display-inline="yes-display-inline">contributed to the purposeful omission of the name of one or more veterans waiting for health care from an electronic wait list for a medical facility of the Department identified by the Inspector General in such report; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA39E2A7A33384620836D447D49CEE5D4"><enum>(B)</enum><text display-inline="yes-display-inline">was the supervisor of an employee of the Department, or was a supervisor of that supervisor, at any level, who contributed to a purposeful omission as described in subparagraph (A) and knew, or reasonably should have known, that the employee contributed to such purposeful omission; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78959972B7364E00823F7121E18A0AD8"><enum>(2)</enum><text display-inline="yes-display-inline">received a bonus in part because of such omission.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id03D35DBC747C44E08853861784C897D3"><enum>(b)</enum><header display-inline="yes-display-inline">Reports described</header><text display-inline="yes-display-inline">A report described in this subsection is a report that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id0021C4C4D48645F19487679C0CA76CD1"><enum>(1)</enum><text display-inline="yes-display-inline">was submitted to Congress by the Inspector General;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC3BC64631C948A899B0A1341DEE1703"><enum>(2)</enum><text display-inline="yes-display-inline">is based on investigations carried out by the Inspector General in calendar year 2014; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3BC150B47F5940C08BCE6BC0336016A8"><enum>(3)</enum><text display-inline="yes-display-inline">identifies medical facilities of the Department at which scheduling practices in use, or formerly in use, did not comply with scheduling policies and procedures of the Department.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id38E9AA2E091644CEBE4F5E936919EDA7"><enum>(c)</enum><header display-inline="yes-display-inline">Identification</header><text display-inline="yes-display-inline">The Secretary shall identify employees contributing to an omission described in subsection (a)(1) without regard to whether the employee knowingly contributed to such omission or contributed to such omission for the purpose of receiving a bonus.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1673E00E41FB47459E8E4B0D8C108467"><enum>(d)</enum><header display-inline="yes-display-inline">Repayment</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id50760EDA9C14493CA0C056D0782C6FB6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each employee identified under subsection (a) who received a bonus as described in such subsection, the Secretary shall, after notice and an opportunity for a hearing, issue an order directing the employee to repay the amount of such bonus.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30173B9C2FB14D6F85E430E35F23E170"><enum>(2)</enum><header display-inline="yes-display-inline">Hearings</header><text display-inline="yes-display-inline">A hearing under this subsection shall be conducted in accordance with regulations relating to hearings promulgated by the Secretary under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA3CCEB2B7D3B4687891D85A8D398006C"><enum>(3)</enum><header display-inline="yes-display-inline">Appeal</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id9CEC3B0501A14F28B5B38360F450FDF2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An employee against whom an order is issued under paragraph (1) may appeal to the Merit Systems Protection Board under section 7701 of title 5, United States Code.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAEC423FDA4814E5F91D888D83BD3A5DF"><enum>(B)</enum><header display-inline="yes-display-inline">Scope of review</header><text display-inline="yes-display-inline">A review of an appeal by the Merit Systems Protection Board under subparagraph (A) shall be based on the record established through the appellant’s hearing conducted under paragraph (2).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5e02f06818d4c4886fba6375e2cf904"><enum>(C)</enum><header display-inline="yes-display-inline">Standard of review</header><text display-inline="yes-display-inline">The Merit Systems Protection Board shall set aside an order issued under paragraph (1) if the issuing of the order was clearly erroneous or the result of a denial of procedural due process.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSVA00" id="id5227ec52aca740c3a3a8dbfbdc2c7e6b" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Prohibition on award of bonuses to employees subject of adverse findings</header>
 <subsection id="ida755e68b330b4bae8b945d5b1219604c"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id4705071BC454424A894FCD8FA4DCC9FA" reported-display-style="italic" style="USC">
					<section id="id53ae408a491d47bbb3740fda4fa36bd5"><enum>714.</enum><header>Prohibition on award of bonuses to employees subject of adverse findings</header>
 <subsection id="id74121f601a874ae68224b0b2d3b19aa4"><enum>(a)</enum><header>Prohibition</header><paragraph commented="no" display-inline="yes-display-inline" id="id8A620CF8E7734A0087E946AFD02B9FE6"><enum>(1)</enum><text>Notwithstanding any other provision of law, in a case in which the Secretary makes an adverse finding relating to an employee of the Department, the Secretary may not award a bonus to such employee until the earlier of—</text>
 <subparagraph changed="added" committee-id="SSVA00" id="id9CA817EEF34841E7BE4A27C587011020" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the date that is five years after the end of the fiscal year in which the adverse finding was made; or</text>
 </subparagraph><subparagraph changed="added" committee-id="SSVA00" id="id50562355AD3D4951AF71801D8AE63360" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the date that the finding is found to have been made in error.</text> </subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id1F0DE655E21F4306A68F4B151331A581" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary may base an adverse finding under paragraph (1) on an investigation by, determination of, or information provided by the Inspector General of the Department or another senior ethics official of the Department or the Comptroller General of the United States in connection with the carrying out by such official of an activity, authority, or function under a provision of law other than this section.</text>
 </paragraph></subsection><subsection id="id0f8e826767d8474c90fa5d16a80fea10"><enum>(b)</enum><header>Previously awarded bonuses</header><text>If the Secretary makes an adverse finding relating to an employee under subsection (a), the Secretary, after notice and an opportunity for a hearing, shall issue an order directing the employee to repay the amount of any bonus awarded to the employee during the year during which the adverse finding is made, unless such finding is found to have been made in error.</text>
 </subsection><subsection id="id1d0c1ad3e3fb4f4bb01b6d8f6f167919"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id28967cb3089b491b9a12043cb4fa2b48"><enum>(1)</enum><text>The term <term>adverse finding</term> relating to an employee means a determination that the conduct of the employee—</text>
 <subparagraph id="id3f84e2c9590c454ea791d5912b9eca28"><enum>(A)</enum><text>violated a policy of the Department for which the employee may be removed or suspended; or</text> </subparagraph><subparagraph id="idf6ced212c5204c2dbb8ee93c564ebabc"><enum>(B)</enum><text>violated a law for which the employee may be imprisoned for more than 1 year.</text>
 </subparagraph></paragraph><paragraph id="id001ffb5c9b284f82879b5f1ea16e4917"><enum>(2)</enum><text>The term <term>bonus</term> means any bonus or cash award, including—</text> <subparagraph id="ida33c5f0100f149efa71027c426c38863"><enum>(A)</enum><text>an award under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5;</text>
 </subparagraph><subparagraph id="id02fe6e141aad43b6a7b72f691c1f23ee"><enum>(B)</enum><text>an award under section 5384 of such title; and</text> </subparagraph><subparagraph id="id08511edc99144712aff0644bc26f00ab"><enum>(C)</enum><text>a retention bonus under section 5754 of such title.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id52e294c457134b61a871d67f531fcae9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

			 Veterans Affairs</header>
 <subsection id="H0D505A26C0EF40CDB71FB45D51C3CA49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, as amended by section 1, is further amended by adding at the end the following new section:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="H588AE5ED91A5422081FBE3FD64B0B22E" reported-display-style="italic" style="USC">
 <section id="H167146572EB94970AB9BAAEE356101F1"><enum>715.</enum><header>Record of reprimands and admonishments</header><text display-inline="no-display-inline">If any employee of the Department receives a reprimand or admonishment, the Secretary shall retain a copy of such reprimand or admonishment in the permanent record of the employee as long as the employee is employed by the Department.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H265C3456CDED4D6688F5C5869DCB6416"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter, as amended by section 1, is further amended by adding at the end the following new item:</text>
