<distribution-code display="yes">II</distribution-code><congress>114th CONGRESS</congress><session>1st Session</session><legis-num>S. 61</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20150107">January 7, 2015</action-date><action-desc><sponsor name-id="S299">Mr. Vitter</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the conveyance of certain National Forest System land in the State of Louisiana.</official-title></form><legis-body id="H09C62BCB309F480BBBE8D1FDCD5BF345" style="OLC"><section id="id6E8D04107AA344A2BF6BA8CD012F0835" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kisatchie National Forest Land Conveyance Act</short-title></quote>.</text></section><section id="HC3CC357C072B42A0B016AF9F81724346"><enum>2.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that it is in the public interest to authorize the conveyance of certain Federal land in the Kisatchie National Forest in the State of Louisiana for market value consideration.</text></section><section id="H45C55586D7774FD29A0CB72B023C0AAB"><enum>3.</enum><header> Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H322EF60FAF9F444CB63B76053BAED947"><enum>(1)</enum><header>Collins camp properties</header><text display-inline="yes-display-inline">The term <quote>Collins Camp Properties</quote> means Collins Camp Properties, Inc., a corporation incorporated under the laws of the State.</text></paragraph><paragraph id="HF5F3AC49534649108CE2A8ACFC801A94"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph><paragraph id="id78B98B95F7624E69AD79CE8E35D21154"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means the State of Louisiana.</text></paragraph></section><section id="H2FC357075B1C416EA0C6170A101B241A"><enum>4.</enum><header>Authorization of conveyances</header><subsection id="H64E47FD99978474D99796ED10765A536"><enum>(a)</enum><header>Authorization</header><paragraph id="idB62370B6DF604AD1ABE7323A0849BADD"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and subsection (b), the Secretary may convey the Federal land described in paragraph (2) by quitclaim deed at public or private sale, including competitive sale by auction, bid, or other methods.</text></paragraph><paragraph id="HA12F8CA525BF44EABC3DC90B0C513C3F"><enum>(2)</enum><header>Description of land</header><text>The Federal land referred to in paragraph (1) consists of—</text><subparagraph id="id91DD613743E342DAA5A99C37315C0801"><enum>(A)</enum><text>all Federal land within sec. 9, T. 10 N., R. 5 W., Winn Parish, Louisiana; and</text></subparagraph><subparagraph id="H8D963DF0F25B44CDB1C5E623A2ECD167"><enum>(B)</enum><text>a 2.16-acre parcel of Federal land located in the SW¼ of sec. 4, T. 10 N., R. 5 W., Winn Parish, Louisiana, as depicted on a certificate of survey dated March 7, 2007, by Glen L. Cannon, P.L.S. 4436.</text></subparagraph></paragraph></subsection><subsection id="H24D22DC9C5B34F5B86278AC620601D10"><enum>(b)</enum><header>First right of purchase</header><text>Subject to valid existing rights and section 6, during the 1-year period beginning on the date of enactment of this Act, on the provision of consideration by the Collins Camp Properties to the Secretary, the Secretary shall convey, by quitclaim deed, to Collins Camp Properties all right, title and interest of the United States in and to—</text><paragraph id="H2C1E8486B56E4E9495D9775BFF62FA26"><enum>(1)</enum><text>not more than 47.92 acres of Federal land comprising the Collins Campsites within sec. 9, T. 10 N., R. 5 W., in Winn Parish, Louisiana, as generally depicted on a certificate of survey dated February 28, 2007, by Glen L. Cannon, P.L.S. 4436; and</text></paragraph><paragraph id="H5C44B0EC03B4482885906DED58A9B392"><enum>(2)</enum><text>the parcel of Federal land described in subsection (a)(2)(B).</text></paragraph></subsection><subsection id="H3D36D1778B424674A648F5B2DD5A1772"><enum>(c)</enum><header>Terms and conditions</header><text>The Secretary may—</text><paragraph id="idFF769727F8DF4BCD9EDE7FB713261279"><enum>(1)</enum><text>configure the Federal land to be conveyed under this Act—</text><subparagraph id="id3881033D12824A96B708852A5F62FF97"><enum>(A)</enum><text>to maximize the marketability of the conveyance; or</text></subparagraph><subparagraph id="id5053660CA58D4FA7BDBEF45A5EECE6D0"><enum>(B)</enum><text>to achieve management objectives; and</text></subparagraph></paragraph><paragraph id="id1DBB6BFBF3E346E19F3BFEFB9B8818EF"><enum>(2)</enum><text>establish any terms and conditions for the conveyances under this Act that the Secretary determines to be in the public interest.</text></paragraph></subsection><subsection id="HA1812B59105D49778ABEDD39AAC03375"><enum>(d)</enum><header>Consideration</header><text>Consideration for a conveyance of Federal land under this Act shall be—</text><paragraph id="id69DC24E2BA144627BA22BEBB97A1F62B"><enum>(1)</enum><text>in the form of cash; and</text></paragraph><paragraph id="id37778053A28646B2B957CA1F2D052F07"><enum>(2)</enum><text>in an amount equal to the market value of the Federal land being conveyed, as determined under subsection (e).</text></paragraph></subsection><subsection id="H298F1DEE4301454C9F1E5361237C9F1E"><enum>(e)</enum><header>Market value</header><text>The market value of the Federal land conveyed under this Act shall be determined—</text><paragraph id="idFD3E43C331DA48558E859E197CFA08F6"><enum>(1)</enum><text>in the case of Federal land conveyed under subsection (b), by an appraisal that is—</text><subparagraph id="idCC512CFC33EE4A0894E07DE0BD340051"><enum>(A)</enum><text>conducted in accordance with the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="idC9EE85E704414CC4B3FCA3813F9D285D"><enum>(B)</enum><text>approved by the Secretary; or</text></subparagraph></paragraph><paragraph id="id878F845A48664F26B302B6D4CD110F73"><enum>(2)</enum><text>if conveyed by a method other than the methods described in subsection (b), by competitive sale.</text></paragraph></subsection><subsection id="HA0AFE51410F04C7E9217C2F578EC8BE2"><enum>(f)</enum><header>Hazardous substances</header><paragraph id="idAE618F62355B44FBB68D4EA800A165AA"><enum>(1)</enum><header>In general</header><text>In any conveyance of Federal land under this Act, the Secretary shall meet disclosure requirements for hazardous substances, but shall otherwise not be required to remediate or abate the substances.</text></paragraph><paragraph id="id62CE4A511468484CAB7307D7508ED494"><enum>(2)</enum><header>Effect</header><text>Nothing in this section otherwise affects the application of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) to the conveyances of Federal land.</text></paragraph></subsection></section><section id="H6B0E03AF2A9147BC8C6631D6243ADB64"><enum>5.</enum><header>Proceeds from the sale of land</header><subsection id="HE183A5E23E484A0394832E0E99502928"><enum>(a)</enum><header>Deposit of receipts</header><text>The Secretary shall deposit the proceeds of a conveyance of Federal land under section 4 in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>).</text></subsection><subsection id="HDDB3B3257B754060BF99DDF0BE4AD387"><enum>(b)</enum><header>Use of funds</header><text>Amounts deposited under subsection (a) shall be available to the Secretary until expended, without further appropriation, for the acquisition of land and interests in land in the Kisatchie National Forest in the State.</text></subsection></section><section id="HED3EA44FEF094A8BA7ECFE2DE178D504"><enum>6.</enum><header>Administration</header><subsection id="H3C6449089D4A42C29C4F75B1468E3171"><enum>(a)</enum><header>Costs</header><text>As a condition of a conveyance of Federal land to Collins Camp Properties under section 4, the Secretary shall require Collins Camp Properties to pay at closing—</text><paragraph id="id71CA7B0C247A45579F6A1FC9EE79FC16"><enum>(1)</enum><text>reasonable appraisal costs; and</text></paragraph><paragraph id="idE91E03EDD7CC4BD8915D6DBB9864EABE"><enum>(2)</enum><text>the cost of any administrative and environmental analyses required by law (including regulations).</text></paragraph></subsection><subsection id="H7B90D6400C9A42EE814683A9F2972203"><enum>(b)</enum><header>Permits</header><paragraph id="id1654F79D12E2444DB873A577896761B1"><enum>(1)</enum><header>In general</header><text>An offer by Collins Camp Properties for the acquisition of the Federal land under section 4 shall be accompanied by a written statement from each holder of a Forest Service special use authorization with respect to the Federal land that specifies that the holder agrees to relinquish the special use authorization on the conveyance of the Federal land to Collins Camp Properties.</text></paragraph><paragraph id="id27E1E255B2294D7B8FEB65204A2EBD0C"><enum>(2)</enum><header>Special use authorizations</header><text>If any holder of a special use authorization described in paragraph (1) fails to provide a written authorization in accordance with that paragraph, the Secretary shall require, as a condition of the conveyance, that Collins Camp Properties administer the special use authorization according to the terms of the special use authorization until the date on which the special use authorization expires.</text></paragraph></subsection></section></legis-body></bill>
