which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type display="yes">A BILL</legis-type><official-title display="yes">To extend and expand the Medicaid emergency psychiatric demonstration project.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Emergency Psychiatric Care Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id211B6B9853AB46F6B7B7ACD3E154B72E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Extension and expansion of medicaid emergency psychiatric demonstration project</header><subsection commented="no" display-inline="no-display-inline" id="id63D691534E8643E2A5BA4D20A1792BE5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (d) of section 2707 of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id5B18FD877AA243E8AAC7E8DF6F0233A1" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ide9cadae0244e4a669815cfa02662f61c"><enum>(d)</enum><header display-inline="yes-display-inline">Length of demonstration project</header><paragraph commented="no" display-inline="no-display-inline" id="id8febdd1d122f4ce4af390101753efad8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), the demonstration project established under this section shall be conducted for a period of 3 consecutive years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd119bf619840406baa9f382376e81867"><enum>(2)</enum><header display-inline="yes-display-inline">Temporary extension of participation eligibility for selected States</header><subparagraph commented="no" display-inline="no-display-inline" id="idE1CD31E1AA434C0F89847EEA6A4C6982"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), a State selected as an eligible State to participate in the demonstration project on or prior to March 13, 2012, shall, upon the request of the State, be permitted to continue to participate in the demonstration project through the date described in subparagraph (B) if—</text><clause commented="no" display-inline="no-display-inline" id="id16ce54debf2241e09ef0c1b1c527dc52"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines that the continued participation of the State in the demonstration project is not expected to increase spending under title XIX of the Social Security Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida28461f78414479aa0aa047a95ba89df"><enum>(ii)</enum><text display-inline="yes-display-inline">the Chief Actuary of the Centers for Medicare &amp; Medicaid Services certifies that such extension for that State is projected to reduce (or is projected not to result in any increase in) net program spending under title XIX of the Social Security Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idED6FF14B2DC54E93B2075B093D6C7B76"><enum>(B)</enum><header display-inline="yes-display-inline">Date described</header><text display-inline="yes-display-inline">The date described in this subparagraph is the earlier of—</text><clause commented="no" display-inline="no-display-inline" id="id991C9F8ABDCC4882B91CFF02D8FC41BB"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which Secretary submits the recommendations required under subsection (f)(3); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idED07399451AE4EE795342C86BE1E52C6"><enum>(ii)</enum><text display-inline="yes-display-inline">September 30, 2016.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47ab238a49394a209d72ec039fd4cb37"><enum>(3)</enum><header display-inline="yes-display-inline">Extension and expansion of demonstration project</header><subparagraph commented="no" display-inline="no-display-inline" id="id02f9081ef2434c418a288f03b40ab059"><enum>(A)</enum><header display-inline="yes-display-inline">Additional extension</header><text display-inline="yes-display-inline">Taking into account the recommendations submitted to Congress pursuant to subsection (f)(3), the Secretary may, if the Secretary determines that extension and expansion of the demonstration project satisfies the criteria for the temporary extension under subparagraphs (A) and (B) of paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="id485D686517E3427A92464593910CBC85"><enum>(i)</enum><text display-inline="yes-display-inline">extend the demonstration project through December 31, 2019; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idF1B7ED43A39A44F38410CD0CA7AA87CB"><enum>(ii)</enum><text display-inline="yes-display-inline">permit any eligible State participating in the demonstration project as of the date such recommendations are submitted to continue to participate in the project.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7445FB0B178F4EF2B292D880B4F0D377"><enum>(B)</enum><header display-inline="yes-display-inline">Option for expansion to additional States</header><text display-inline="yes-display-inline">Taking into account the recommendations submitted to Congress pursuant to subsection (f)(3), the Secretary may expand (including on a nationwide basis) the number of eligible States participating in the demonstration project during the extension period established under subparagraph (A) if, with respect to any new eligible State—</text><clause commented="no" display-inline="no-display-inline" id="idDBF2F85BA1FD48899251682276EAD3F6"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines that the participation of the State in the demonstration project is not expected to increase spending under title XIX of the Social Security Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id86EBEAB9E1EC41289EA15F09DE0A247B"><enum>(ii)</enum><text display-inline="yes-display-inline">the Chief Actuary of the Centers for Medicare &amp; Medicaid Services certifies that the participation of the State in the demonstration project is projected to reduce (or is projected not to result in any increase in) net program spending under title XIX of the Social Security Act.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CDE4EAA17AE4BCF8D6F8BF2322A67D7"><enum>(4)</enum><header display-inline="yes-display-inline">Authority to ensure budget neutrality</header><text display-inline="yes-display-inline">The Secretary annually shall review each participating State’s demonstration project expenditures to ensure compliance with the requirements of paragraphs (2)(A), (2)(B), (3)(B)(i), and (3)(B)(ii) (as applicable). If the Secretary determines with respect to a State's participation in the demonstration project that the State's net program spending under title XIX of the Social Security Act has increased as a result of the State's participation in the project, the Secretary shall treat the demonstration project excess expenditures of the State as an overpayment under title XIX of the Social Security Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id792009557F7D4FE992358AA5740C066B"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Subsection (e) of section 2707 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3D48DBFE394944A986633F4A09B300C8"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Limitations on Federal</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEDEE57F3DB26439886256780182732A5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idEA2805168DBC4FEEAE29D37B261A08B7"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">5-year</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id177E633DE5B24F82A5FAA87C3C3C61B3"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>through December 31, 2015</quote> and inserting <quote>until expended</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf340869e8512414ea587bedf55ad2e39"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (3);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0463746BE5447E19BA7CC5BD563B8D7"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) and (5) as paragraphs (3) and (4), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D7B6EEE11694C5AB0BA8373E2AE639E"><enum>(5)</enum><text display-inline="yes-display-inline">in paragraph (3) (as so redesignated), by striking <quote>and the availability of funds</quote> and inserting <quote>(other than States deemed to be eligible States through the application of subsection (c)(4))</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4453bf4fcb294aeaa28ac606f47b4469"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (4) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idFA89B0DACB21451FB29F37D805457F31"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence—</text><clause commented="no" display-inline="no-display-inline" id="id4D8495F4D2B646909EECEC67228E6255"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>(other than a State deemed to be an eligible State through the application of subsection (c)(4))</quote> after <quote>eligible State</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idF102B24F66FD4483B5962D53ABF8C12E"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>paragraph (4)</quote> and inserting <quote>paragraph (3)</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8EB7C6A867AB4BF090C8809F11984AAA"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after the first sentence the following <quote>In addition to any payments made to an eligible State under the preceding sentence, the Secretary shall, during any period in effect under paragraph (2) or (3) of subsection (d), or during any period in which a law described in subsection (f)(4)(C) is in effect, pay each eligible State (including any State deemed to be an eligible State through the application of subsection (c)(4)), an amount each quarter equal to the Federal medical assistance percentage of expenditures in the quarter during such period for medical assistance described in subsection (a). Payments made to States under this paragraph shall be considered to have been made under, and are subject to, the requirements of section 1903 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>).</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ADB51D9125F400EA8A1BE506F1776DA"><enum>(c)</enum><header display-inline="yes-display-inline">Recommendations to congress</header><text display-inline="yes-display-inline">Subsection (f) of section 2707 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idc225b86b8b524278b5cc2fb70b04d750" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id98dd32c88208407cb23e34e62a6df9b3"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendation to congress regarding extension and expansion of project</header><text display-inline="yes-display-inline">Not later than September 30, 2016, the Secretary shall submit to Congress and make available to the public recommendations based on an evaluation of the demonstration project, including the use of appropriate quality measures, regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB0D54FF922D848E5AEEB953C8D4DF290"><enum>(A)</enum><text display-inline="yes-display-inline">whether the demonstration project should be continued after December 31, 2016; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D6EEE86313A4218965C5BFA8AB7CA93"><enum>(B)</enum><text display-inline="yes-display-inline">whether the demonstration project should be expanded (including on a nationwide basis).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6EA1E90293547998E2C63A76D858F62"><enum>(4)</enum><header display-inline="yes-display-inline">Recommendation to congress regarding permanent extension and nationwide expansion</header><subparagraph commented="no" display-inline="no-display-inline" id="id37C6305C8C3340538F63A4AD461DFBAB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 1, 2019, the Secretary shall submit to Congress and make available to the public recommendations based on an evaluation of the demonstration project, including the use of appropriate quality measures, regarding—</text><clause commented="no" display-inline="no-display-inline" id="idCA7D3E350ED24D88937A62577BC44176"><enum>(i)</enum><text display-inline="yes-display-inline">whether the demonstration project should be permanently continued after December 31, 2019, in 1 or more States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4088C18947D44BD09CB340D2608A0B0D"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the demonstration project should be expanded (including on a nationwide basis).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66671040C89A4D61B25E26442DF31B8F"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Any recommendation submitted under subparagraph (A) to permanently continue the project in a State, or to expand the project to 1 or more other States (including on a nationwide basis) shall include a certification from the Chief Actuary of the Centers for Medicare &amp; Medicaid Services that permanently continuing the project in a particular State, or expanding the project to a particular State (or all States) is projected to reduce (or is projected not to result in any increase in) net program spending under title XIX of the Social Security Act. If the Secretary determines with respect to a State's participation in the demonstration project that net program spending under title XIX of such Act has increased as a result of the project, the Secretary shall treat the demonstration project excess expenditures of the State as an overpayment under title XIX of the Social Security Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAEE4A8E66CE94C16B37C8F705507CA92"><enum>(C)</enum><header display-inline="yes-display-inline">Congressional approval required</header><text display-inline="yes-display-inline">The Secretary shall not permanently continue the demonstration project in any State after December 31, 2019, or expand the demonstration project to any additional State after December 31, 2019, unless Congress enacts a law approving either or both such actions.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F5533CC50464C96A71EA03B425CB7D3"><enum>(5)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not otherwise appropriated, there is appropriated to the Centers for Medicare &amp; Medicaid Services Program Management Account to carry out this subsection, $100,000 for fiscal year 2015, to remain available until expended.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idD5466C3A658A4409A0872CD993A9B7D9"><enum>(d)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 2707 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id93882bbc686043f1987c4f95f9c3db2e"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id53205EBFB2AA43DD978136FC4166CB2B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>An eligible State</quote> and inserting <quote>Except as otherwise provided in paragraph (4), an eligible State</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c08d9d05c0d4abea5445e8077584a86"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>A State shall</quote> and inserting <quote>Except as otherwise provided in paragraph (4), a State shall</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab527137e55a4b559d9a99b860c29fe2"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id6d8d4c2f5bb74f51a279312997a84afe" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idc710f831f72b428abc1e4bf9b28d2274"><enum>(4)</enum><header display-inline="yes-display-inline">Nationwide availability</header><text display-inline="yes-display-inline">In the event that the Secretary makes a recommendation pursuant to subsection (f)(4) that the demonstration project be expanded on a national basis, any State that has submitted or submits an application pursuant to paragraph (2) shall be deemed to have been selected to be an eligible State to participate in the demonstration project.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4EE5D754B48344C9A6482B9D4071E603"><enum>(2)</enum><text display-inline="yes-display-inline">in the heading for subsection (f), by striking <quote><header-in-text level="subsection" style="OLC">and report</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, report, and recommendations</header-in-text></quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id687fc4b3cbeb4c8ba62c6c271d32745b"><enum>(e)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
