		<official-title>To promote exploration for geothermal resources, and for other
			 purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Geothermal Exploration Opportunities Act of 2015</short-title></quote>.</text>
 </section><section id="idD956608CBC1F4C34B3E9CE5599B26EF8"><enum>2.</enum><header>Geothermal exploration test projects</header><text display-inline="no-display-inline">The Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idB64859B46EFC47FE8DA33647242E9FC0" style="OLC">
				<section id="idF9818053102A4F8A9E55DB630643E90A"><enum>30.</enum><header>Geothermal exploration test projects</header>
 <subsection id="idEE3946088E0D431C98E2CD8B33BBA71E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id8C49B34648A94513AA87E5D2BFD6A5DB"><enum>(1)</enum><header>Covered land</header><text>The term <quote>covered land</quote> means land that is—</text>
 <subparagraph id="idA4277596BE5143A4B92FA5EF76CDCDDE"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id8015748D31F14D4AAE5A6BC754488679"><enum>(i)</enum><text>public land administered by the Secretary; or</text> </clause><clause id="id5B6FC7CF171E49699615BAB2E72FE82A" indent="up1"><enum>(ii)</enum><text>National Forest System land administered by the Secretary of Agriculture; and</text>
 </clause></subparagraph><subparagraph id="id04C96993ED35440581D2B8D088240D2C"><enum>(B)</enum><text>not excluded from the development of geothermal energy under—</text> <clause id="id925CA86DA9F0452F93FD572E4C2E49AC"><enum>(i)</enum><text>a final land use plan established under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text>
 </clause><clause id="id462BF93C21A841F8A1B2A99E1FC559D0"><enum>(ii)</enum><text>a final land and resource management plan established under the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>); or</text>
 </clause><clause id="id00BF2172CFE440918096B3D7C1E82801"><enum>(iii)</enum><text>any other applicable law.</text> </clause></subparagraph></paragraph><paragraph id="id72F1E980336948E998198018ED26255A"><enum>(2)</enum><header>Secretary concerned</header><text>The term <quote>Secretary concerned</quote> means—</text>
 <subparagraph id="idA230DA7D1AE64ED5A8965B11429FD3C2"><enum>(A)</enum><text>the Secretary of Agriculture (acting through the Chief of the Forest Service), with respect to National Forest System land; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F5D46B4D2C44FA1BE152FE16CD9D388"><enum>(B)</enum><text>the Secretary, with respect to land managed by the Bureau of Land Management (including land held for the benefit of an Indian tribe).</text>
							</subparagraph></paragraph></subsection><subsection id="idE8BAECE4E98D4F2F9EEFB9E72F6F0AB9"><enum>(b)</enum><header>NEPA review of geothermal exploration test projects</header>
 <paragraph id="id1E236B9319D94986B4919D63B3A79228"><enum>(1)</enum><header>In general</header><text>An eligible activity described in paragraph (2) carried out on covered land shall be considered an action categorically excluded from the requirements for an environmental assessment or an environmental impact statement under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or section 1508.4 of title 40, Code of Federal Regulations (or a successor regulation) if—</text>
 <subparagraph id="id38AE734441464C5B8931BFFA2A14A51D"><enum>(A)</enum><text>the action is for the purpose of geothermal resource exploration operations; and</text> </subparagraph><subparagraph id="idD148716156874F728E13F35DECAE75AA"><enum>(B)</enum><text>the action is conducted pursuant to this Act.</text>
 </subparagraph></paragraph><paragraph id="id9F75F4877C57407FAC9F514D55B76704"><enum>(2)</enum><header>Eligible activity</header><text>An eligible activity referred to in paragraph (1) is—</text> <subparagraph id="id6bf0fe99999349039b7c283bff23d182"><enum>(A)</enum><text>a geophysical exploration activity that does not require drilling, including a seismic survey;</text>
 </subparagraph><subparagraph id="idE8FC785B27C649EFB82C8B9A50687DBA"><enum>(B)</enum><text>the drilling of a well to test or explore for geothermal resources on land leased by the Secretary concerned for the development and production of geothermal resources that—</text>
 <clause id="idB5843EF8E7C64BF6BFC17763736F9B8C"><enum>(i)</enum><text>is carried out by the holder of the lease;</text> </clause><clause id="id0B755A566DD941B281E0D1A7A2D96927"><enum>(ii)</enum><text>causes—</text>
 <subclause id="id2F37332900374E7DA832FD29FE8EAB15"><enum>(I)</enum><text>fewer than 5 acres of soil or vegetation disruption at the location of each geothermal exploration well; and</text>
 </subclause><subclause id="idBBAF28EED66F4F8F82149CD6736DBCF2"><enum>(II)</enum><text>not more than an additional 5 acres of soil or vegetation disruption during access or egress to the project site;</text>
 </subclause></clause><clause id="id6E56859C5AD64E6BB5EE8A27FBDDA503"><enum>(iii)</enum><text>is completed in fewer than 90 days, including the removal of any surface infrastructure from the project site; and</text>
 </clause><clause id="id035897EC6CD343D984462D5AAC7A2E68"><enum>(iv)</enum><text>requires the restoration of the project site not later than 3 years after the date of completion of the project to approximately the condition that existed at the time the project began, unless—</text>
 <subclause commented="no" id="id0382FE370881410B9014026B8CE6F6E9"><enum>(I)</enum><text>the project site is subsequently used as part of energy development on the lease; or</text> </subclause><subclause commented="no" id="idE28CE262CD744769984854FE0192FA7A"><enum>(II)</enum><text>the project—</text>
 <item commented="no" id="idB5FAD2001B414C6C8FAD17D46B6CBA78"><enum>(aa)</enum><text>yields geothermal resources; and</text> </item><item commented="no" id="id2A6FB81377CB440F9CCD54AE9B0A75C3"><enum>(bb)</enum><text>the use of the geothermal resources will be carried out under another geothermal generation project in existence at the time of the discovery of the geothermal resources; or</text>
 </item></subclause></clause></subparagraph><subparagraph commented="no" id="idDB77088EFD0140108D53EC616F0CE75F"><enum>(C)</enum><text>the drilling of a well to test or explore for geothermal resources on land leased by the Secretary concerned for the development and production of geothermal resources that—</text>
 <clause commented="no" id="id89437BBA61E743EFA64CFE6412D865E9"><enum>(i)</enum><text>causes an individual surface disturbance of fewer than 5 acres if—</text> <subclause commented="no" id="id6BF43660FF604F41A30AE9DE22050A7D"><enum>(I)</enum><text>the total surface disturbance on the leased land is not more than 150 acres; and</text>
 </subclause><subclause commented="no" id="idC9E94D819D69447297878A49627C3E61"><enum>(II)</enum><text>a site-specific analysis has been prepared under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text>
 </subclause></clause><clause commented="no" id="id131005f699cf48e2805786d172ee4365"><enum>(ii)</enum><text>involves the drilling of a geothermal well at a location or well pad site at which drilling has occurred within 5 years before the date of spudding the well; or</text>
 </clause><clause commented="no" id="idF37188A9CC104582AA46997FE309A787"><enum>(iii)</enum><text>involves the drilling of a geothermal well in a developed field for which—</text> <subclause commented="no" id="idB127A3AB6C0D4EF88CF2E1550CE86817"><enum>(I)</enum><text>an approved land use plan or any environmental document prepared under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) analyzed the drilling as a reasonably foreseeable activity; and</text>
 </subclause><subclause commented="no" id="id6AAED41009CE43F3AC55B4700C84EF58"><enum>(II)</enum><text>the land use plan or environmental document was approved within 10 years before the date of spudding the well.</text>
 </subclause></clause></subparagraph></paragraph><paragraph commented="no" id="idA5D79DC3717E422BAD940239BD80201E"><enum>(3)</enum><header>Limitation based on extraordinary circumstances</header><text>The categorical exclusion established under paragraph (1) shall be subject to extraordinary circumstances in accordance with the Departmental Manual, 516 DM 2.3A(3) and 516 DM 2, Appendix 2 (or successor provisions).</text>
						</paragraph></subsection><subsection commented="no" id="id5D8E47739BE94BA1B35000EC4B71BD0C"><enum>(c)</enum><header>Notice of intent; review and determination</header>
 <paragraph commented="no" id="idEABF7FC0857840B09BA9D418AD99B9EF"><enum>(1)</enum><header>Requirement to provide notice</header><text>Not later than 30 days before the date on which drilling begins, a leaseholder intending to carry out an eligible activity shall provide notice to the Secretary concerned.</text>
 </paragraph><paragraph commented="no" id="id402B1469D9454231BFCAD9886873DC70"><enum>(2)</enum><header>Review of project</header><text>Not later than 10 days after receipt of a notice of intent provided under paragraph (1), the Secretary concerned shall—</text>
 <subparagraph commented="no" id="id7A9B0EDCB4494182ACBE3210CB0FE8CF"><enum>(A)</enum><text>review the project described in the notice and determine whether the project is an eligible activity; and</text>
 </subparagraph><subparagraph commented="no" id="id101A8F43DBD44245A88F9E4F3E6AC5A7"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id512022BF4E5D46C2A7B21CED1F2526EB"><enum>(i)</enum><text>if the project is an eligible activity, notify the leaseholder that under subsection (b), the project is considered a categorical exclusion under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and section 1508.4 of title 40, Code of Federal Regulations (or a successor regulation); or</text>
 </clause><clause commented="no" id="id8F403B3677924C9CB5CC82FDCDEDA2C5" indent="up1"><enum>(ii)</enum><text>if the project is not an eligible activity—</text> <subclause commented="no" id="id736CD180E5FD466E96C09370AC603843"><enum>(I)</enum><text>notify the leaseholder that section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) applies to the project;</text>
 </subclause><subclause commented="no" id="id3E8CC8CA865748F1ADF20DC862F2C5C0"><enum>(II)</enum><text>include in that notification clear and detailed findings on any deficiencies in the project that prevent the application of subsection (b) to the project; and</text>
 </subclause><subclause commented="no" id="idCEEDF1B619D14DE9A765AD7A1B0F402D"><enum>(III)</enum><text>provide an opportunity to the leaseholder to remedy the deficiencies described in the notification before the date on which the leaseholder plans to begin the project under paragraph (1).</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body>
