			 certain structures that are located in areas having special flood hazards
			 and are substantially damaged by fire, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H80DEE2A3C1BF4F1FB348EE4BF3A06D11" style="OLC">
 <section id="H0DEE1C3C37B340109D6AF0522789F5B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire-Damaged Home Rebuilding Act of 2015</short-title></quote>.</text>
		</section><section commented="no" id="H5895B2940CCA4E469E73FC22D5089229"><enum>2.</enum><header>Requirements for
 State and local land use controls</header><text display-inline="no-display-inline">Section 1315(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4022">42 U.S.C. 4022(a)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H07076B2B236D44069F691B27AC1897ED" style="OLC">
				<paragraph commented="no" id="H75707B2659E2409687FDCD99A24BFED8"><enum>(3)</enum><header>Allowable local
				variances for certain residential structures</header>
 <subparagraph commented="no" id="idEC08A88B3CB7402F8383D829029F5527"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text>
 <clause commented="no" id="id5FCCF37B69544816B65B08BBCBE14A73"><enum>(i)</enum><text>the term <term>covered area</term> means an area having special flood hazards that—</text>
 <subclause commented="no" id="idBD0A67D69CFD46ED880D62E4662BBAF6"><enum>(I)</enum><text display-inline="yes-display-inline">is or will be protected by a levee system—</text>
 <item commented="no" id="id9845FF30523F4A78B27FD824F7AC47BE"><enum>(aa)</enum><text display-inline="yes-display-inline">that meets or will meet the requirements established under section 65.10 of title 44, Code of Federal Regulations, or any successor thereto; and</text>
 </item><item commented="no" id="id8CF3F60895494A158112DB5AD9B87D14"><enum>(bb)</enum><text display-inline="yes-display-inline">with respect to which adequate progress toward the repair, replacement, or construction of the levee system has been made, provided that such prog­ress is acceptable to the local floodplain manager; and</text>
 </item></subclause><subclause commented="no" id="id88C88DC3689D46619B34CC416A887102"><enum>(II)</enum><text display-inline="yes-display-inline">absent the protection provided by the levee system, is subject to significant base flood elevations of not less than a reasonable height, as determined by the Administrator;</text>
 </subclause></clause><clause commented="no" id="id318AA8CA812240F4A9E2AD58694A0C65"><enum>(ii)</enum><text>the term <term>eligible structure</term> means a residential structure that—</text>
 <subclause commented="no" id="id27B44FEA743F4DFB8B1BB9B49C0FBB2D"><enum>(I)</enum><text display-inline="yes-display-inline">is located in a covered area; and</text> </subclause><subclause commented="no" id="id99A604339D4F4EA6BA13D779A4E63BB4"><enum>(II)</enum><text display-inline="yes-display-inline">is substantially damaged by a fire or other disaster, not including a flood; and</text>
 </subclause></clause><clause commented="no" id="id8EB0F6ABC1164B5CB1F43C75C66D3E6E"><enum>(iii)</enum><text>the term <term>substantially damaged</term>, with respect to a structure, means a structure that incurs substantial damage, as that term is defined in section 59.1 of title 44, Code of Federal Regulations, or any successor thereto.</text>
						</clause></subparagraph><subparagraph commented="no" id="HFF88209B9B534C8A93199E8CC18A2496"><enum>(B)</enum><header>Authorization
 for variances</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the adequate land use and control measures required to be adopted in an area (or subdivision thereof) pursuant to paragraph (1) may permit an appropriate State or local authority to grant a variance described in subparagraph (C).</text>
					</subparagraph><subparagraph commented="no" id="idA0B880E93F8F4EE7ADB217A8F0A33A4E"><enum>(C)</enum><header>Requirements
 for variances</header><text display-inline="yes-display-inline">A variance described in this subparagraph is a variance from compliance with the adequate land use and control measures required to be adopted in an area (or subdivision thereof) pursuant to paragraph (1) that allows for the repair and restoration of an eligible structure to its predamaged condition without elevation of the structure, after an appropriate State or local authority determines that—</text>
 <clause commented="no" id="H917D037763934318909AF611A2DFF88A"><enum>(i)</enum><text>the repaired and restored structure will be located on the same site as the structure was located before being substantially damaged by a fire or other disaster, not including a flood;</text>
 </clause><clause commented="no" id="id743315A22F014EDC81CE19D19589C29A"><enum>(ii)</enum><text>the footprint of the repaired and restored structure will not exceed the footprint of the original structure;</text>
 </clause><clause commented="no" id="idEEA32917C0794EEF8260AD0E012FFED6"><enum>(iii)</enum><text>the number of floors of the repaired and restored structure will not exceed the number of floors of the original structure;</text>
 </clause><clause commented="no" id="H61771872934B459E8AB5BF645A6451FA"><enum>(iv)</enum><text display-inline="yes-display-inline">no claims payments have been made under flood insurance coverage under this title for damages to or loss of the structure;</text>
 </clause><clause commented="no" id="H70656694FF6541B5AF024BF86B130059"><enum>(v)</enum><text>the owner of the structure has owned the structure continually from before the time of the damage described in clause (i); and</text>
 </clause><clause commented="no" id="HA1227510DF014576AE2BC976A405B2AA"><enum>(vi)</enum><text>the repair and restoration of the structure is for the purpose of occupancy by the owner of the structure.</text>
						</clause></subparagraph><subparagraph commented="no" id="idA44783086CC2452DABB40E57D45C735C"><enum>(D)</enum><header>Maximum number
 of variances</header><text>During any calendar year, an appropriate State or local authority may not grant more than 10 variances in accordance with this paragraph for a covered area.</text>
 </subparagraph><subparagraph commented="no" id="id2F9D4E9EF0464751BB292711D862ED7F"><enum>(E)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Administrator may not—</text> <clause commented="no" id="id81DEE378593B4752BE6D5CF8F359EF58"><enum>(i)</enum><text display-inline="yes-display-inline">find that land use and control measures are inadequate or inconsistent with the comprehensive criteria for land management and use under section 1361 because the land use and control measures permit the granting of a variance in accordance with this paragraph; or</text>
 </clause><clause commented="no" id="id7719961CA9734122A8BAAB6F8E0031E6"><enum>(ii)</enum><text display-inline="yes-display-inline">suspend an area (or subdivision thereof) from participation in the national flood insurance program or place an area (or subdivision thereof) on probation under the national flood insurance program because the area has adopted land use and control measures that permit the granting of a variance in accordance with this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF99BC28F70AE46E9B371A135A5434294"><enum>3.</enum><header>Premium
 rates</header><text display-inline="no-display-inline">Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2F63AA48A5DA497FB3CFF3D0A8FFF965" style="OLC">
				<subsection id="HB63FCE20F4E647529B282FE18296C1D1"><enum>(n)</enum><header>Prohibition on
				lowering premium rate for structures rebuilt pursuant to certain
 variances</header><text>Notwithstanding any other provision of this title, after the repair and restoration of a residential structure pursuant to a variance granted in accordance with section 1315(a)(3), the chargeable premium rate for the structure may not be lower than the rate that otherwise would apply to the structure if the structure had not been substantially damaged by a fire or other disaster, not including a flood, and repaired and restored pursuant to the variance.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
