			 other purposes.</official-title></form><legis-body><section commented="no" display-inline="no-display-inline" id="H186ACB38B41B407B9C233154BC069072" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Little Shell Tribe of Chippewa Indians Restoration Act of 2015</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H3161CBEBD899490FA8E8ADD8D2E785D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="H7B2D8E1868F74719938F24ACDD22A8FA"><enum>(1)</enum><text display-inline="yes-display-inline">the Little Shell Tribe of Chippewa Indians
			 is a political successor to signatories of the Pembina Treaty of 1863,
			 under
			 which a large area of land in the State of North Dakota was ceded to the
			 United
			 States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6AB695D3ACF24EBEB0FEC9B310F5E1C"><enum>(2)</enum><text display-inline="yes-display-inline">the Turtle Mountain Band of Chippewa of
			 North Dakota and the Chippewa-Cree Tribe of the Rocky Boy’s Reservation of
			 Montana, which also are political successors to the signatories of the
			 Pembina
			 Treaty of 1863, have been recognized by the Federal Government as distinct
			 Indian tribes;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9B424EF7D894F4FA355F828DC18A96C"><enum>(3)</enum><text display-inline="yes-display-inline">the members of the Little Shell Tribe
			 continue to live in the State of Montana, as their ancestors have for more
			 than
			 100 years since ceding land in the State of North Dakota as described in
			 paragraph (1);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H518FAC3F4B2442F4B4FB250E8278B6"><enum>(4)</enum><text display-inline="yes-display-inline">in the 1930s and 1940s, the Tribe
			 repeatedly petitioned the Federal Government for reorganization under the
			 Act
			 of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>) (commonly known as the <quote>Indian
			 Reorganization Act</quote>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB51BBECC57C64E858A51CAC61A84F698"><enum>(5)</enum><text display-inline="yes-display-inline">Federal agents who visited the Tribe and
			 Commissioner of Indian Affairs John Collier attested to the responsibility
			 of
			 the Federal Government for the Tribe and members of the Tribe, concluding
			 that
			 members of the Tribe are eligible for, and should be provided with, trust
			 land,
			 making the Tribe eligible for reorganization under the Act of June 18,
			 1934 (25
			 U.S.C. 461 et seq.) (commonly known as the <quote>Indian Reorganization
			 Act</quote>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE1A34E9967234BFEB5AC1FD1A00CE6AB"><enum>(6)</enum><text display-inline="yes-display-inline">due to a lack of Federal appropriations
			 during the Depression, the Bureau of Indian Affairs lacked adequate
			 financial
			 resources to purchase land for the Tribe, and the members of the Tribe
			 were
			 denied the opportunity to reorganize;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB35E2CC3F89248E399EEFF44A4E0885E"><enum>(7)</enum><text display-inline="yes-display-inline">in spite of the failure of the Federal
			 Government to appropriate adequate funding to secure land for the Tribe as
			 required for reorganization under the Act of June 18, 1934 (25 U.S.C. 461
			 et
			 seq.) (commonly known as the <quote>Indian Reorganization Act</quote>), the
			 Tribe continued to exist as a separate community, with leaders exhibiting
			 clear
			 political authority;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D1849194CE142179B767D306E1E0339"><enum>(8)</enum><text display-inline="yes-display-inline">the Tribe, together with the Turtle
			 Mountain Band of Chippewa of North Dakota and the Chippewa-Cree Tribe of
			 the
			 Rocky Boy’s Reservation of Montana, filed 2 law suits under the Act of
			 August
			 13, 1946 (60 Stat. 1049) (commonly known as the <quote>Indian Claims Commission
			 Act</quote>), to petition for additional compensation for land ceded to the
			 United States under the Pembina Treaty of 1863 and the McCumber Agreement
			 of
			 1892;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C8C574959E1465281FD94424B172633"><enum>(9)</enum><text display-inline="yes-display-inline">in 1971 and 1982, pursuant to Acts of
			 Congress, the tribes received awards for the claims described in paragraph
			 (8);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1BE44F2399241BC90182B665156AF9D"><enum>(10)</enum><text display-inline="yes-display-inline">in 1978, the Tribe submitted to the Bureau
			 of Indian Affairs a petition for Federal recognition, which is still
			 pending as
			 of the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1DE41EC5DBDE47EE9000DAC4D2893EA"><enum>(11)</enum><text display-inline="yes-display-inline">the Federal Government, the State of
			 Montana, and the other federally recognized Indian tribes of the State
			 have had
			 continuous dealings with the recognized political leaders of the Tribe
			 since
			 the 1930s.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HA30B947F63414EFEB6A30561BF78800" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="HD75504FE167D4A4B99B69D610088FAD9"><enum>(1)</enum><header display-inline="yes-display-inline">Member</header><text display-inline="yes-display-inline">The term <term>member</term> means an
			 individual who is enrolled in the Tribe pursuant to section 7.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D36CA881C5B438EB1991F641671B82F"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77B8DE2547C14E97A737DB11427734EE"><enum>(3)</enum><header display-inline="yes-display-inline">Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the
			 Little Shell Tribe of Chippewa Indians of Montana.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HEA23A568043C47E887A7BC11A0977406" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Federal recognition</header><subsection commented="no" display-inline="no-display-inline" id="id244BFB6920CC4033912CE7FB0A1F3987"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Federal recognition is extended to the
			 Tribe.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idEC171FF29AD644109D73DD6826B200E3"><enum>(b)</enum><header display-inline="yes-display-inline">Effect of Federal laws</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act,
			 all Federal laws (including regulations) of general application to Indians
			 and
			 Indian tribes, including the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>)
			 (commonly known as the <quote>Indian Reorganization Act</quote>), shall apply
			 to the Tribe and members.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HF1BFA069F38A479EB1F6332E12A5D092" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Federal services and benefits</header><subsection commented="no" display-inline="no-display-inline" id="HAD42C0531C26455B93ABD421736D4B29"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this
			 Act, the Tribe and each member shall be eligible for all services and
			 benefits
			 provided by the United States to Indians and federally recognized Indian
			 tribes, without regard to—</text><paragraph commented="no" display-inline="no-display-inline" id="idA6347C62C6B14BA39E208049720B1623"><enum>(1)</enum><text display-inline="yes-display-inline">the existence of a reservation for the
			 Tribe; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id787B5FF0197E4764B8F998E304B821FC"><enum>(2)</enum><text display-inline="yes-display-inline">the location of the residence of any member
			 on or near an Indian reservation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAA4DD835CC144E35BA65CD6FAF5700A5"><enum>(b)</enum><header display-inline="yes-display-inline">Service area</header><text display-inline="yes-display-inline">For purposes of the delivery of services
			 and benefits to members, the service area of the Tribe shall be considered
			 to
			 be the area comprised of Blaine, Cascade, Glacier, and Hill Counties in
			 the
			 State of Montana.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H25EB8D531C754060B6509257F100FA61" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Reaffirmation of rights</header><subsection commented="no" display-inline="no-display-inline" id="id543397EE352B4CA29C398C0585023C03"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this Act diminishes any right or
			 privilege of the Tribe or any member that existed before the date of
			 enactment
			 of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6B3EC77E8E584245989D49118E0B2D2A"><enum>(b)</enum><header display-inline="yes-display-inline">Claims of Tribe</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act,
			 nothing in this Act alters or affects any legal or equitable claim of the
			 Tribe
			 to enforce any right or privilege reserved by, or granted to, the Tribe
			 that
			 was wrongfully denied to, or taken from, the Tribe before the date of
			 enactment
			 of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HAA822E67F4F444BB83BEA73E89A014AE" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Membership roll</header><subsection commented="no" display-inline="no-display-inline" id="idD95CE3CBBAFA4C9AA9AAF8A474350747"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As a condition of receiving recognition,
			 services, and benefits pursuant to this Act, the Tribe shall submit to the
			 Secretary, by not later than 18 months after the date of enactment of this
			 Act,
			 a membership roll consisting of the name of each individual enrolled as a
			 member of the Tribe.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id91E0F2B97C9C42E3A57C336CC7A28256"><enum>(b)</enum><header display-inline="yes-display-inline">Determination of membership</header><text display-inline="yes-display-inline">The qualifications for inclusion on the
			 membership roll of the Tribe shall be determined in accordance with
			 sections 1
			 through 3 of article 5 of the constitution of the Tribe dated September
			 10,
			 1977 (including amendments to the constitution).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idF9A6D40792744E20B696494CC40473BC"><enum>(c)</enum><header display-inline="yes-display-inline">Maintenance of roll</header><text display-inline="yes-display-inline">The Tribe shall maintain the membership
			 roll under this section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H8DBC8F9E53C44A87AF8F0236B523D12F" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Transfer of land</header><subsection commented="no" display-inline="no-display-inline" id="H4BC40D1E14624B9EAFCFDA4BCD875CC2"><enum>(a)</enum><header display-inline="yes-display-inline">Homeland</header><text display-inline="yes-display-inline">The Secretary shall acquire, for the
			 benefit of the Tribe, trust title to 200 acres of land within the service
			 area
			 of the Tribe to be used for a tribal land base.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF07093C8533D425BBC54F84368CC507"><enum>(b)</enum><header display-inline="yes-display-inline">Additional land</header><text display-inline="yes-display-inline">The Secretary may acquire additional land
			 for the benefit of the Tribe pursuant to section 5 of the Act of June 18,
			 1934
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/465">25 U.S.C. 465</external-xref>) (commonly known as the <quote>Indian Reorganization
			 Act</quote>).</text></subsection></section></legis-body></bill>
