 stewardship end result contracting projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stewardship End Result Contracting Improvement Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7B7A3CB2501A43B29A399E6EAA1BDA99" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Stewardship
 end result contracting projects</header><subsection commented="no" display-inline="no-display-inline" id="id30315D54A5394596A1CD11DF3F0AA9DA"><enum>(a)</enum><header display-inline="yes-display-inline">Cancellation ceilings</header><text display-inline="yes-display-inline">Section 604(d) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1951450653FC4EC5B94D7AAE1ADA74C7"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5), (6), and (7) as paragraphs (6), (7), and (8), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA27165B7B3FE4016834D64E78AD5F3C3"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the following:</text><quoted-block display-inline="no-display-inline" id="id955EB0823F494F04AC0088F19EAD639C" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="ide1a6a2440767401dacea08b166ea90b1"><enum>(5)</enum><header display-inline="yes-display-inline">Cancellation ceilings</header><subparagraph commented="no" display-inline="no-display-inline" id="ide5ae67b94b6447b6b70087e9705a6593"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Chief and the Director may obligate funds to cover any potential cancellation or termination costs for an agreement or contract under subsection (b) in stages that are economically or programmatically viable.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50ce024294454870b6f64b8f07c52b36"><enum>(B)</enum><header display-inline="yes-display-inline">Notice</header><clause commented="no" display-inline="no-display-inline" id="id0131EE4659B341B4B3843D8F75761928"><enum>(i)</enum><header display-inline="yes-display-inline">Submission to
 congress</header><text display-inline="yes-display-inline">Not later than 30 days before entering into a multiyear agreement or contract under subsection (b) that includes a cancellation ceiling in excess of $25,000,000, but does not include proposed funding for the costs of cancelling the agreement or contract up to the cancellation ceiling established in the agreement or contract, the Chief and the Director shall submit to the Committees on Energy and Natural Resources and Agriculture, Nutrition, and Forestry of the Senate and the Committees on Natural Resources and Agriculture of the House of Representatives a written notice that includes—</text><subclause commented="no" display-inline="no-display-inline" id="idf61711245e724a868efcc5b8f4d42a68"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idB2D70BF8999341B1B85CAD12DECA57E0"><enum>(aa)</enum><text display-inline="yes-display-inline">the cancellation ceiling amounts proposed for each program year in the agreement or contract; and</text></item><item commented="no" display-inline="no-display-inline" id="id21C79C3D5FAD42DC93C0BF9D0E1C0138" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">the reasons for the cancellation ceiling amounts proposed under item (aa);</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idafa47818187a44f09496e5e9c52411af"><enum>(II)</enum><text display-inline="yes-display-inline">the extent to which the costs of contract cancellation are not included in the budget for the agreement or contract; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id66fe0dac78e94724842ce184bc7aa20a"><enum>(III)</enum><text display-inline="yes-display-inline">a financial risk assessment of not including budgeting for the costs of agreement or contract cancellation.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idcc332dc1822f498c84eb702da7af1c73"><enum>(ii)</enum><header display-inline="yes-display-inline">Transmittal to
 OMB</header><text display-inline="yes-display-inline">At least 14 days before the date on which the Chief and Director enter into an agreement or contract under subsection (b), the Chief and Director shall transmit to the Director of the Office of Management and Budget a copy of the written notice submitted under clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBA55F5EC98D4BE1A9CF2870DCDBFE81"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6) (as redesignated by paragraph (1)), by striking <quote>, the Chief may</quote> and inserting <quote>and section 2(a)(1) of the Act of July 31, 1947 (commonly known as the <quote>Materials Act of 1947</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/30/602">30 U.S.C. 602(a)(1)</external-xref>), the Chief and the Director may</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC078A6DDF6A44C3984FDABB8AAC2E733"><enum>(b)</enum><header display-inline="yes-display-inline">Excess offset value</header><text display-inline="yes-display-inline">Section 604(g)(2) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c(g)(2)</external-xref>) is amended, by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id9657531962F3413084C6903B9806F648" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id9698726c978f49aeaa03aa0b4e2c0b66"><enum>(A)</enum><text display-inline="yes-display-inline">use the excess to satisfy any outstanding liabilities for cancelled agreements or contracts; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id749537467a3c46ec835e71de96adac91"><enum>(B)</enum><text display-inline="yes-display-inline">if there are no outstanding liabilities under subparagraph (A), apply the excess to other authorized stewardship projects.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idEA2EEF58B09947BA85BE98C8A860EFCC"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Section 604(i) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c(i)</external-xref>) is amended, by striking <quote>Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives</quote> and inserting <quote>Committees on Energy and Natural Resources and Agriculture, Nutrition, and Forestry of the Senate and the Committees on Natural Resources and Agriculture of the House of Representatives</quote>.</text></subsection></section></legis-body></bill>
