			 and the Travel Act, to provide for the use for conservation purposes of
			 amounts from civil penalties, fines, forfeitures, and restitution under
 such statutes based on such violations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildlife Trafficking Enforcement Act of 2015</short-title></quote>.</text></section><section id="id84A7DECBF22E42EB95AA54A70CC30D82" section-type="subsequent-section"><enum>2.</enum><header>Wildlife trafficking violations as predicate offenses under racketeering and money laundering statutes</header><subsection id="idC1B56D564FF74BAD95281A64A4EEA913"><enum>(a)</enum><header>Travel Act</header><text>Section 1952 of title 18, United States Code, is amended—</text><paragraph id="id863423DFD337428594ED88FF0129BCFB"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id8933A6ADF74A41B18B2B1F01DDBA3C62"><enum>(A)</enum><text>by striking <quote>or (3)</quote> and inserting <quote>(3)</quote>; and</text></subparagraph><subparagraph id="idFD9249AA69E34715A08D90E740BB456E"><enum>(B)</enum><text>by striking <quote>of this title and (ii)</quote> and inserting the following: <quote>of this title, or (4) any act that is a criminal violation of section 9(a)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(a)(1)</external-xref>), section 2203 of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>), or section 7(a) of the Rhinoceros and Tiger Conservation Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/5305a">16 U.S.C. 5305a(a)</external-xref>), if the endangered or threatened species of fish or wildlife, products, items, or substances involved in the violation and relevant conduct, as applicable, have a total value of more than $10,000 and (ii)</quote>; and</text></subparagraph></paragraph><paragraph id="idC09937A2813D4FDD922EEFAF0E90A86F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idA4B4F08A61FE4ED99B419F27035BED37" style="OLC"><subsection id="id1CA29195265540DFA170F097A228CF46"><enum>(e)</enum><header>Use of amounts from fines, forfeitures, and restitution relating to wildlife trafficking violations</header><paragraph id="id373C63A982864C5A966132895DBC8FCB"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the Secretary of the Interior and the Secretary of Commerce, for use in accordance with paragraph (2), the amounts received as fines, forfeitures of property or assets, or restitution to the Federal Government for any violation under this section that is based on an unlawful activity described in subsection (b)(i)(4).</text></paragraph><paragraph id="id109EC367FCA8474995CB41B8E0112AA2"><enum>(2)</enum><header>Funds</header><text>Of the amounts transferred under paragraph (1), the Secretary of the Interior and the Secretary of Commerce shall use such amounts as each Secretary determines necessary for the benefit of the species impacted by the applicable violation, to the extent practicable, by depositing the amounts into any fund that is created or authorized under Federal law for conservation purposes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id558F1AD201DC4DFD91F344182AAE75FE"><enum>(b)</enum><header>Money laundering</header><text>Section 1956 of title 18, United States Code, is amended—</text><paragraph id="id96198E1AED1243BE9CA772AB4BBCC39C"><enum>(1)</enum><text>in subsection (c)(7)—</text><subparagraph id="idB8DFC3EE04B34C7393E3370B0E57AF1A"><enum>(A)</enum><text>in subsection (E), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="idE5C42DDA16C94E409E7B1126F3CEEA80"><enum>(B)</enum><text>in subsection (F), by adding <quote>or</quote> at the end; and</text></subparagraph><subparagraph id="id3CA848AA40524CDE82AAA1CDBF9734CD"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idA635182F03D448A4AD8E395D534A9C29" style="OLC"><subparagraph id="id54E469DE62964D90BF400F2F9573F290"><enum>(G)</enum><text>any act that is a criminal violation of section 9(a)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(a)(1)</external-xref>), section 2203 of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>), or section 7(a) of the Rhinoceros and Tiger Conservation Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/5305a">16 U.S.C. 5305a(a)</external-xref>), if the endangered or threatened species of fish or wildlife, products, items, or substances involved in the violation and relevant conduct, as applicable, have a total value of more than $10,000;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idC164C82D8F874453B4A218AF6F01EB24"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idFE311815E75F4843B7C5356AE4DC9060" style="OLC"><subsection id="id7FBCF9B188344DA6B0E920264AE21D57"><enum>(j)</enum><header>Use of amounts from civil penalties, fines, forfeitures, and restitution relating to wildlife trafficking violations</header><paragraph id="id375BBF215EB44BF680732B3C532BF9EC"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the Secretary of the Interior and the Secretary of Commerce, for use in accordance with paragraph (2), the amounts received as civil penalties, fines, forfeitures of property or assets, or restitution to the Federal Government for any violation under this section that is based on specified unlawful activity described in subsection (c)(7)(G).</text></paragraph><paragraph id="idEF74EE427CCB4176A70FC8626CE207CC"><enum>(2)</enum><header>Funds</header><text>Of the amounts transferred under paragraph (1), the Secretary of the Interior and the Secretary of Commerce shall use such amounts as each Secretary determines necessary for the benefit of the species impacted by the applicable violation, to the extent practicable, by depositing the amounts into any fund that is created or authorized under Federal law for conservation purposes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA7AEB1A147EF49F39B97E3FA21EC6ABC"><enum>(c)</enum><header>RICO</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/96">Chapter 96</external-xref> of title 18, United States Code, is amended—</text><paragraph id="id3F52412E79BC45D5942910E0A4BADDD4"><enum>(1)</enum><text>in section 1961(1)—</text><subparagraph id="id21A6D79C14114D0C8096605826CFB16D"><enum>(A)</enum><text>by striking <quote>or (G)</quote> and inserting <quote>(G)</quote>; and</text></subparagraph><subparagraph id="id2A90047E50BB432BAB9F2F1F4FF35483"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, or (H) any act that is a criminal violation of section 9(a)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(a)(1)</external-xref>), section 2203 of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>), or section 7(a) of the Rhinoceros and Tiger Conservation Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/5305a">16 U.S.C. 5305a(a)</external-xref>), if the endangered or threatened species of fish or wildlife, products, items, or substances involved in the violation and relevant conduct, as applicable, have a total value of more than $10,000</quote>; and</text></subparagraph></paragraph><paragraph id="idD788D6BE6BA94A74B900CF11874A8AC6"><enum>(2)</enum><text>in section 1963, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id6FE70A54ED7240F5B73BA7985307ED8C" style="OLC"><subsection id="id531AD623765A481F9BA212BDCA1A8AA9"><enum>(n)</enum><header>Use of amounts from fines, forfeitures, and restitution relating to wildlife trafficking violations</header><paragraph id="id1332D6C43FB34590A94890D8FDDA5D29"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the Secretary of the Interior and the Secretary of Commerce, for use in accordance with paragraph (2), the amounts received as fines, forfeitures of property or assets, or restitution to the Federal Government for any violation of section 1962 that is based on racketeering activity described in section 1961(1)(H).</text></paragraph><paragraph id="idE3BDA3274F5E4E0984C5D26BC16D71EE"><enum>(2)</enum><header>Funds</header><text>Of the amounts transferred under paragraph (1), the Secretary of the Interior and the Secretary of Commerce shall use such amounts as each Secretary determines necessary for the benefit of the species impacted by the applicable violation, to the extent practicable, by depositing the amounts into any fund that is created or authorized under Federal law for conservation purposes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id212F7A352DA24FF09E8D96E0264EC03F"><enum>(d)</enum><header>Technical and conforming amendments</header><paragraph id="idF686BA46FDF74C15A98DBA6780F45023"><enum>(1)</enum><header>Use of amounts from fines</header><text>Section 1402(b)(1)(A) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601(b)(1)(A)</external-xref>) is amended—</text><subparagraph id="idEFC92ADE0B134CCCA6E370D3A2CA3DCA"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="id22E11AD8D7174A0CAB9B6B1761CDB951"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idE081CC2AE3E4442A9748750A9559271E" style="OLC"><clause id="id151520AAEADD43D39E849E0F975C0BB2"><enum>(iii)</enum><text>sections 1952(e), 1956(j), and 1963(n) of title 18, United States Code; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id00FFE88C3B45430790C1AF773D8B9394"><enum>(2)</enum><header>Use of amounts from forfeitures</header><text>Section 524(c)(4)(A) of title 28, United States Code, is amended by inserting before <quote>or the Postmaster General</quote> the following: <quote>the Secretary of the Treasury pursuant to section 1952(e), 1956(j), or 1963(n) of title 18,</quote>.</text></paragraph></subsection></section></legis-body></bill>
