			 who have a service-connected disability to receive both disability
			 compensation from the Department of Veterans Affairs for their disability
			 and either retired pay by reason of their years of military service or
			 Combat-Related Special Compensation, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short
 title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Retired Pay Restoration Act of 2015</short-title></quote>.</text></section><section id="HD91CC545B2754B1C8FEF38E0D0D89D9F"><enum>2.</enum><header>Eligibility for
			 payment of both retired pay and veterans’ disability compensation for
			 certain
			 military retirees with compensable service-connected disabilities</header><subsection id="H1BEB925D44454C7AB6E4947CF08401C"><enum>(a)</enum><header>Extension of
			 concurrent receipt authority to retirees with service-Connected
			 disabilities
			 rated less than 50 percent</header><paragraph id="H4A775FF3A1A046B6B9D0F797E62DDC01"><enum>(1)</enum><header>Repeal of 50
 percent requirement</header><text>Section 1414 of title 10, United States Code, is amended by striking paragraph (2) of subsection (a).</text></paragraph><paragraph id="H3D36DDD4D22D4D1F944BC583A5FB4697"><enum>(2)</enum><header>Computation</header><text>Paragraph (1) of subsection (c) of such section is amended by adding at the end the following new subparagraph:</text><quoted-block id="H169D1143F180412EA4719B3B48157604" style="USC"><subparagraph id="H97A011707EF84A398D75CFBE5F75A48C"><enum>(G)</enum><text>For a month for which the retiree receives veterans’ disability compensation for a disability rated as 40 percent or less or has a service-connected disability rated as zero percent, $0.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H77C4FFB70E344452A33BCB4152CE3514"><enum>(b)</enum><header>Clerical
 amendments</header><paragraph display-inline="no-display-inline" id="H419A1609DD6F401C8EB89F43968F7990"><enum>(1)</enum><text>The heading of section 1414 of such title is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H7D3F4A4A5AF0464787AA2D9E49518271" style="USC"><section id="H971BAF5751824ABA9F776FC54F12964C"><enum>1414.</enum><header>Members
				eligible for retired pay who are also eligible for veterans’
			 disability
				compensation: concurrent payment of retired pay and disability
 compensation</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFD49F80CF5E046FFB6805DAC701EB3D7"><enum>(2)</enum><text>The item relating to such section in the table of sections at the beginning of chapter 71 of such title is amended to read as follows:</text><quoted-block id="HCEB1CC3F5AE1401B8248C4DE711831AA" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">1414. Members eligible for retired pay who
				are also eligible for veterans’ disability compensation: concurrent
			 payment of
				retired pay and disability
				compensation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEDC9F0BEE7CB4EF6800430F295F05B5F"><enum>(c)</enum><header>Effective
 date</header><text>The amendments made by this section shall take effect on January 1, 2016, and shall apply to payments for months beginning on or after that date.</text></subsection></section><section id="HB1B77B6A61814B9193386BE1FDF28745"><enum>3.</enum><header>Coordination of
			 service eligibility for combat-related special compensation and concurrent
			 receipt</header><subsection id="H5042B165CF524CE28224B59338BBD0D1"><enum>(a)</enum><header>Amendments To
			 standardize similar provisions</header><paragraph id="HAD48BECCB993473CB2EC1B8949BC7D7F"><enum>(1)</enum><header>Qualified
 retirees</header><text>Subsection (a) of section 1414 of title 10, United States Code, as amended by section 2(a), is amended—</text><subparagraph id="H00C124EF021844E9ACFB752B74091500"><enum>(A)</enum><text>by striking <quote>a member or</quote> and all that follows through <quote>retiree’)</quote> and inserting <quote>a qualified retiree</quote>; and</text></subparagraph><subparagraph id="HBA0EF1F19F6340C2B08B4E59BF48DBEC"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="HFBFA39440EC8471B9181FF00EF5E6591" style="OLC"><paragraph id="H70243EB208A34141A4BFEC749521A1F" indent="down1"><enum>(2)</enum><header>Qualified
 retirees</header><text>For purposes of this section, a qualified retiree, with respect to any month, is a member or former member of the uniformed services who—</text><subparagraph id="HD066CAA09E8347CEA36EC2829E1B6A5"><enum>(A)</enum><text>is entitled to retired pay (other than by reason of section 12731b of this title); and</text></subparagraph><subparagraph id="HB70B92E4DB274A31B545075800F08E00"><enum>(B)</enum><text>is also entitled for that month to veterans’ disability compensation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEE14E391D1E041A6005C782FBB5F8506"><enum>(2)</enum><header>Disability
 retirees</header><text>Paragraph (2) of subsection (b) of section 1414 of such title is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="idB888976CED72456787E94E89E6AA5225" style="OLC"><paragraph id="idE8AAFB16E9E74A8BA69F99E2FC23778D"><enum>(2)</enum><header>Special rule
 for retirees with fewer than 20 years of service</header><text>The retired pay of a qualified retiree who is retired under chapter 61 of this title with fewer than 20 years of creditable service is subject to reduction by the lesser of—</text><subparagraph id="id1DF3A3D67CCD47CE8E271656E34E0138"><enum>(A)</enum><text>the amount of the reduction under sections 5304 and 5305 of title 38; or</text></subparagraph><subparagraph id="idCD38F78D89434610B47B4CC84EEB01BE"><enum>(B)</enum><text>the amount (if any) by which the amount of the member’s retired pay under such chapter exceeds the amount equal to 2½ percent of the member’s years of creditable service multiplied by the member’s retired pay base under section 1406(b)(1) or 1407 of this title, whichever is applicable to the member.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD72CA8FFEAC94050918E8C0747C04CBD"><enum>(b)</enum><header>Effective
 date</header><text>The amendments made by this section shall take effect on January 1, 2016, and shall apply to payments for months beginning on or after that date.</text></subsection></section></legis-body></bill>
