 <section id="id07F86443CBA2474D8D71E772B3D0EDCB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defend America Act of 2015</short-title></quote>.</text> </section><section id="id3c98801ee7d84a62b6d2a4b64d4be4eb"><enum>2.</enum><header>Definitions</header> <subsection id="idECE6F8E6242F4E39817085FBFE53FC5D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act:</text>
 <paragraph id="id5b218807cea84630b8fa2f9a986be8b2"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="idbe897b5205c74fd8a10bf50a91aba65d"><enum>(A)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text>
 </subparagraph><subparagraph id="id4d68645aa19545ebbc3a2111d92980f8"><enum>(B)</enum><text>the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>;</text> </subparagraph><subparagraph id="id1b76ce0c7a584c99afabea84e39bd6e9"><enum>(C)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text>
 </subparagraph><subparagraph id="idfdd7ebbb54054c52b03ce1554e63859b"><enum>(D)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text> </subparagraph><subparagraph id="id6ba9d496369b4740aed5d98d253e48ad"><enum>(E)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text>
 </subparagraph><subparagraph id="id58a5f6736d0d47538e23d27ad09ac3cb"><enum>(F)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text> </subparagraph><subparagraph id="id163e04200d434fefa769e4b010ba8736"><enum>(G)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text>
 </subparagraph><subparagraph id="id37897d7239264b409c9f980f2bffb9fb"><enum>(H)</enum><text>the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>;</text> </subparagraph><subparagraph id="id5c082b798af64ff8899fe72e0f0dd081"><enum>(I)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text>
 </subparagraph><subparagraph id="id46490febccd548d2a41c0e1ad9ee49d4"><enum>(J)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>;</text> </subparagraph><subparagraph id="idfadeb85d545f427981d91b2e09152aab"><enum>(K)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEFCA983C8C214296B33BA988B9F6B25F"><enum>(L)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text> </subparagraph></paragraph><paragraph id="id8cb6ead79ce94bacb90d027deb5aa6d3"><enum>(2)</enum><header>Covered alien</header><text>The term <term>covered alien</term> means any alien who—</text>
 <subparagraph id="id886E0910B2AE41D690B24178558AC597"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id3023D851B8DE4939A683F6C260B5468F"><enum>(i)</enum><text>is applying for admission to the United States as a refugee; and</text> </clause><clause id="id60A86FECBA9C43109342C32B4567BBC8" indent="up1"><enum>(ii)</enum><text>is a national or resident of Iraq or Syria;</text>
 </clause><clause id="idC5D23E16221B4502AF7BBBAE92695FE9" indent="up1"><enum>(iii)</enum><text>has no known nationality and whose last habitual residence was in Iraq or in Syria; or</text> </clause><clause id="id1FA4951B28824CE88E21F9E3D88D8532" indent="up1"><enum>(iv)</enum><text>has been present in Iraq or in Syria at any time on or after March 1, 2011.</text>
 </clause></subparagraph><subparagraph id="id974ffeb2bc974596a2a8ca8e70299f88"><enum>(B)</enum><text>is not a citizen of Iraq who—</text> <clause id="id5168c9d7707b426a9dcf2501da6e1a71"><enum>(i)</enum><text>is or was employed by or on behalf of the United States Government in Iraq on or after March 20, 2003, for not less than 1 year; and</text>
 </clause><clause id="id73214b615b1b4520b2476d3ec625e052"><enum>(ii)</enum><text>provided faithful and valuable service to the United States Government, which is documented in a positive recommendation or evaluation described in subsection (c), from the employer’s senior supervisor in the United States Government or from a more senior person if the employee’s senior supervisor cannot be located;</text>
 </clause></subparagraph><subparagraph id="idf6185e00b7974609ab24044164b01a02"><enum>(C)</enum><text>is not the spouse or child of an alien described in subparagraph (B); and</text> </subparagraph><subparagraph id="id4241117aa46c415da0dfc05711f79a84"><enum>(D)</enum><text>is not an infant child without living parents who is younger than 4 years of age, as certified under procedures promulgated by the Secretary of State under subsection (b).</text>
 </subparagraph></paragraph><paragraph id="id402D4E3BDE014959911718DF9CC79743"><enum>(3)</enum><header>Foreign terrorist organization</header><text>The term <term>foreign terrorist organization</term> is a foreign organization that is designated as a foreign terrorist organization by the Secretary of State in accordance with section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>).</text>
				</paragraph></subsection><subsection id="idE26D5701CB014EEBBF8ED136BE880699"><enum>(b)</enum><header>Certification</header>
 <paragraph id="id236FEE35F999489B9C38420484CC79E7"><enum>(1)</enum><header>In general</header><text>The Secretary of State shall promulgate regulations establishing procedures for certifying that an alien is an alien child without living parents who is younger than 4 years of age.</text>
 </paragraph><paragraph id="id4E2C1A47701B4ED1A265DE9D4B9BD350"><enum>(2)</enum><header>Submission</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of State shall submit the regulations promulgated under paragraph (1) to the appropriate congressional committees.</text>
 </paragraph><paragraph id="idF1EC0110E7E647248EB1D6CA752353AA"><enum>(3)</enum><header>Implementation</header><text>Not earlier than 90 days after the submission of regulations under paragraph (2), the Secretary of State shall implement such regulations.</text>
 </paragraph></subsection><subsection id="idceeb706272b84f549aabd9b67f7ad817"><enum>(c)</enum><header>Approval by Chief of Mission required</header><text>Each recommendation or evaluation required under subparagraph (B)(ii) shall be accompanied by approval from the appropriate Chief of Mission, or the designee of the appropriate Chief of Mission, who shall conduct a risk assessment of the alien and an independent review of records maintained by the United States Government or hiring organization or entity to confirm the alien’s employment and faithful and valuable service to the United States Government before the alien is exempted from definition of covered alien under subsection (a)(2)(B).</text>
			</subsection></section><section id="idd4b12fb6234945d88aca841183ffd679"><enum>3.</enum><header>Enhanced screening measures for covered aliens</header>
			<subsection id="id6e1bd3e363b24efdab0d41a44044c32c"><enum>(a)</enum><header>Temporary suspension of admissions</header>
 <paragraph id="id7a15f1a6c6cd4fbda49131216200622a"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law—</text> <subparagraph id="id400e1e645d6d45d0b2fb8ff1e67bf642"><enum>(A)</enum><text>a covered alien may not be admitted to the United States as a refugee under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) or under any other provision of law;</text>
 </subparagraph><subparagraph id="id6771626ad40e4a3ea4fffd0db7e750aa"><enum>(B)</enum><text>no Federal funds may be expended to process applications for covered aliens to be admitted as refugees; and</text>
 </subparagraph><subparagraph id="id0dba93a2566a458bacdbb65d5e4c866b"><enum>(C)</enum><text>no Federal funds may be expended by the Secretary of State or the Secretary of Health and Human Services to resettle covered aliens in the United States.</text>
 </subparagraph></paragraph><paragraph id="ideb46e9a007094b4591d3111d045c8501"><enum>(2)</enum><header>Effective period</header><text>Paragraph (1) shall be in effect until the date that is 30 days after the date on which the President submits, to the appropriate congressional committees, a certification that the provisions under subsections (b) through (g) have been carried out.</text>
				</paragraph></subsection><subsection id="id8df755775d7846a6a9582ecf3a3522b7"><enum>(b)</enum><header>Background investigation</header>
 <paragraph id="id94FE6D0974D542D5ADFC621E22743BEF"><enum>(1)</enum><header>In general</header><text>In addition to any screenings conducted by the Department of State or the Department of Homeland Security, the Director of the Federal Bureau of Investigation shall take all actions necessary to ensure that each covered alien receives a thorough background investigation before such alien is admitted to the United States as a refugee.</text>
 </paragraph><paragraph id="id0D28B64FDFA84B26B1A1161AFF6F76AD"><enum>(2)</enum><header>FBI certification</header><text>A covered alien may not be admitted to the United States as a refugee until after the Director of the Federal Bureau of Investigation certifies to the Secretary of Homeland Security and the Director of National Intelligence that such alien has received a background investigation that is sufficient to determine whether such alien—</text>
 <subparagraph id="id7B34A824F1E44ADCB71459824E565A4C"><enum>(A)</enum><text>is a threat to the security of the United States; and</text> </subparagraph><subparagraph id="id62D14A6F5C88499BA76D61190065BF72"><enum>(B)</enum><text>has provided support to any foreign terrorist organization, which may include publishing or otherwise engaging in social media to promote or otherwise support a foreign terrorist organization.</text>
 </subparagraph></paragraph></subsection><subsection id="id32400149e66b49d89176ca8b70241d34"><enum>(c)</enum><header>Certification by unanimous concurrence</header><text>A covered alien may only be admitted to the United States after the Secretary of Homeland Security, with the unanimous concurrence of the Director of the Federal Bureau of Investigation and the Director of National Intelligence, certifies to the appropriate congressional committees that the covered alien—</text>
 <paragraph id="id95B3C428C75F4438BB5C7C0EC6418AA2"><enum>(1)</enum><text>is not a threat to the security of the United States; and</text>
 </paragraph><paragraph id="id069F199025974BFA9872FA47B057478C"><enum>(2)</enum><text>has not provided support to any foreign terrorist organization, including by publishing or otherwise engaging in social media to promote or otherwise support a foreign terrorist organization.</text>
 </paragraph></subsection><subsection id="id807135570131439fa3a4fc6586d367f4"><enum>(d)</enum><header>Inspector General review of certifications</header><text>The Inspector General of the Department of Homeland Security shall—</text> <paragraph id="id34964BC16BD74DAFA3E08E620DB93093"><enum>(1)</enum><text>conduct a risk-based review of all certifications made under subsection (c) during each fiscal year; and</text>
 </paragraph><paragraph id="id8EDB19E17A064D50B6ED72977B482A22"><enum>(2)</enum><text>not later than October 30 of each year, submit a report, in unclassified form with classified annexes, to the appropriate congressional committees that—</text>
 <subparagraph id="idA95808621B4C4381A751751CDE0E8B6C"><enum>(A)</enum><text>describes the findings of the review conducted under paragraph (1);</text>
 </subparagraph><subparagraph id="id572DF8D4919C4BFB86212606DFE78E09"><enum>(B)</enum><text>includes an assessment of the data sets and vetting procedures used by the Department of Homeland Security; and</text>
 </subparagraph><subparagraph id="idab86d832a5dc40eab8489282b6d3035f"><enum>(C)</enum><text>includes an assessment of the Department of Homeland Security’s access to information and data sets controlled, administered, or maintained by other agencies or departments that are necessary to conduct a thorough screening of covered aliens.</text>
 </subparagraph></paragraph></subsection><subsection id="id6ee66e4eb6eb4c548fe4b8e3143d5947"><enum>(e)</enum><header>Quarterly report</header><text>The Secretary of Homeland Security shall submit a quarterly report to the appropriate congressional committees that includes, for the quarter immediately preceding the date of the report—</text>
 <paragraph id="idBE31AF909BED46D99FBEC72CCD931A6C"><enum>(1)</enum><text>the total number of applications for admission with regard to which a certification under subsection (c) was made;</text>
 </paragraph><paragraph id="id99049963D3D3454FA55625304D9B890F"><enum>(2)</enum><text>the number of covered aliens with regard to whom such a certification was not made; and</text> </paragraph><paragraph id="id57D6D4A1C0424BB39A2344067CF740B6"><enum>(3)</enum><text>for each covered alien with regard to whom a certification under subsection (c) was not made, the justification for the nonconcurrence of each department or agency.</text>
 </paragraph></subsection><subsection id="id76e5e7de64af4bb8839543bce183dfa4"><enum>(f)</enum><header>Annual Comptroller General evaluation</header><text>The Comptroller General of the United States shall—</text> <paragraph id="id20F08EE7559F420DA1D81678388C6E3C"><enum>(1)</enum><text>annually evaluate all the certifications made under subsections (b) and (c); and</text>
 </paragraph><paragraph id="id256BE897F967435AB15056FF7C1DE736"><enum>(2)</enum><text>not later than October 30 of each year, submit to the appropriate congressional committees a report, in unclassified form with classified annexes, that includes—</text>
 <subparagraph id="id3E248D3FCF064C8CA01C8D82A09CCEB3"><enum>(A)</enum><text>the findings of the evaluations under paragraph (1);</text>
 </subparagraph><subparagraph id="id7308fb0f2d054d9a91a553aefe675d75"><enum>(B)</enum><text>an assessment of the data sets and vetting procedures used by the Federal Bureau of Investigation and the Department of Homeland Security;</text>
 </subparagraph><subparagraph id="id67aab0da426b4e09bd1216e361984d8e"><enum>(C)</enum><text>an assessment of the Federal Government’s access to the information and data sets necessary to conduct a thorough screening of covered aliens; and</text>
 </subparagraph><subparagraph id="id56e295cdbce24beb93ac495cbb1cfb7a"><enum>(D)</enum><text>a detailed list of covered aliens who—</text> <clause id="id62EB3E59CA2445E89B11310A82D1852A"><enum>(i)</enum><text>were admitted pursuant to this Act; and</text>
 </clause><clause id="idB1E31A9AE5554832910212B56B0469FA"><enum>(ii)</enum><text>during the previous fiscal year—</text> <subclause id="id0b847736fc234bd797f978e8945ae801"><enum>(I)</enum><text>were indicted for criminal misconduct and are awaiting trial, with a description of the pending charges;</text>
 </subclause><subclause id="id87592c28a352405b99d10d86aae5a5a8"><enum>(II)</enum><text>had pending criminal charges against them dismissed, with a description of the charges;</text> </subclause><subclause id="idbc2e925a5e5547e38d62f5fc934add46"><enum>(III)</enum><text>were acquitted of criminal misconduct at trial, with a description of the charges;</text>
 </subclause><subclause id="idf97c32135bc34b37be112e6f1b06838f"><enum>(IV)</enum><text>were convicted of, or pled guilty to, criminal misconduct, with a list of the charges and the sentence;</text>
 </subclause><subclause id="idc8d9b93ed48d4fcd913384a13ba383ae"><enum>(V)</enum><text>were listed on the Terrorist Screening Center’s Terrorist Screening Database (TSDB); or</text> </subclause><subclause id="id5E182030287F4E9187D2C5CB87111076"><enum>(VI)</enum><text>were listed on the National Counterterrorism Center’s Terrorist Identities Datamart Environment (TIDE).</text>
 </subclause></clause></subparagraph></paragraph></subsection><subsection id="id950ba6176a104331bbc3a2fb4eb75126"><enum>(g)</enum><header>Report on additional enhanced measures</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Director of the Federal Bureau of Investigation, the Director of National Intelligence, and the Secretary of State, shall submit a report to the appropriate congressional committees that—</text>
 <paragraph id="idC3495CC619CE409B978C7D3789164F34"><enum>(1)</enum><text>identifies plans for additional enhanced measures for the purposes of improving the screening conducted by the United States Government on any covered alien seeking to be admitted as a refugee to the United States, including any enhanced screening to determine whether such alien—</text>
 <subparagraph id="id8C870D30CF2A46F6B0A6AE0A0B90824B"><enum>(A)</enum><text>has any links to terrorism-related social media; or</text> </subparagraph><subparagraph id="idB5FFC915D7E44BE5A7BCF824E716DC96"><enum>(B)</enum><text>has provided support to any foreign terrorist organization;</text>
 </subparagraph></paragraph><paragraph id="id2866456004704b0a9cdcb4153b9518c8"><enum>(2)</enum><text>describes the changes made to the refugee program by the Department of Homeland Security in response to the infiltration of 2 Al-Qaeda in Iraq-linked terrorists into the United States and their resettlement in Bowling Green, Kentucky, through the Iraqi refugee program in 2009; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77D7ED30A3C844CD8784BDF38903720D"><enum>(3)</enum><text>indicates if the Secretary of Homeland Security is aware of any former or current known terrorists who have been admitted to the United States as refugees.</text>
 </paragraph></subsection></section><section id="idd3b07227912a46db96ef9f9f6a0bee7a"><enum>4.</enum><header>State notification</header><text display-inline="no-display-inline">Section 412(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1522">8 U.S.C. 1522(b)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id575BC3D02AC240F192778EF6024E8A1F" style="OLC">
 <paragraph id="id6B56947099AB4E7DB314238969F65172" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">Before a refugee is resettled in a State, the Secretary of State shall provide the Governor of such State, or the Governor’s designee, with respect to the refugee—</text>
 <subparagraph id="id036C498B391148289EAEBD6400694D7E"><enum>(A)</enum><text display-inline="yes-display-inline">the full, legal name;</text> </subparagraph><subparagraph id="id3B220FB30EA0430D83BA0F353D3F80B2"><enum>(B)</enum><text display-inline="yes-display-inline">a physical description, including biometric information;</text>
 </subparagraph><subparagraph id="id5215ACC3AD7B486C97D86D85A5B6376C"><enum>(C)</enum><text display-inline="yes-display-inline">relevant biographical information;</text> </subparagraph><subparagraph id="id41F9ECE303E74AB2B17EF440B6C93362"><enum>(D)</enum><text display-inline="yes-display-inline">the country of origin; and</text>
 </subparagraph><subparagraph id="id12D60D31C0F04786BE9679B097353BBE"><enum>(E)</enum><text display-inline="yes-display-inline">any prior citizenship.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="id7d27eecba82b4a48ad5a2e26e18b0862"><enum>5.</enum><header>Inadmissibility for use of social media to promote terrorism</header> <subsection id="idF95F04DD514B4DC2ABB4AD99B93A3542"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212(a)(3)(B)(i)(VII) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)(VII)</external-xref>) is amended by inserting <quote>, including through the use of social media</quote> before the semicolon at the end.</text>
 </subsection><subsection id="id2D39750D427747F3B84D04FD35DEF4A6"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of State, shall issue regulations, in accordance with section 553 of title 5, United States Code, to ensure that no alien applying for an immigrant visa under section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) or for adjustment of status under section 245 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1155">8 U.S.C. 1155</external-xref>) is admitted if the alien has violated section 212(a)(3)(B)(i)(VII) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)(VII)</external-xref>), as amended by subsection (a).</text>
 </subsection><subsection id="id8257C03AE81D4C83BF9128C7D8431708"><enum>(c)</enum><header>Effective date</header><text>The regulations issued under subsection (b) shall take effect on the date that is 30 days after the date on which such regulations are published in the Federal Register.</text>
			</subsection></section><section id="idCB07E2E888884082A9233EAFD074E84C"><enum>6.</enum><header>Visa Waiver Program security</header>
 <subsection id="H08612F0B55D740DFB5E0444D57EE7E13"><enum>(a)</enum><header>Restriction on use of visa waiver program for aliens who travel to certain countries</header><text display-inline="yes-display-inline">Section 217(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(a)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF59CE3CAFC4047F3ACC3F74611E6462D" style="OLC">
					<paragraph id="HA7C44E74A720490BAF3ECAA5FD134031"><enum>(12)</enum><header>Not present in Iraq, Syria, or any other country or area of concern</header>
 <subparagraph id="H6224D9927C6E4656A67E8CCA0C23F1A9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraphs (B) and (C)—</text> <clause id="HE6EDAB8ADCB2415CB9BDD3BDFE4DD5C0"><enum>(i)</enum><text display-inline="yes-display-inline">the alien has not been present, at any time on or after March 1, 2011—</text>
 <subclause id="H9A5B8D99A2D64936888165D178FC6A52"><enum>(I)</enum><text>in Iraq or Syria;</text> </subclause><subclause id="H82E27AF9E3F64C70AB595B3868D08998"><enum>(II)</enum><text>in a country that is designated by the Secretary of State under section 6(j) of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/2405">50 U.S.C. 2405</external-xref>) (as continued in effect under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>)), section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>), section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>), or any other provision of law, as a country, the government of which has repeatedly provided support of acts of international terrorism; or</text>
 </subclause><subclause id="HC095CF40DD6548E09D66834ADAD05EAC"><enum>(III)</enum><text>in any other country or area of concern designated by the Secretary of Homeland Security under subparagraph (D); and</text>
 </subclause></clause><clause id="H1AFFA584DE914AACA849F8CA3D2B0FF4"><enum>(ii)</enum><text display-inline="yes-display-inline">regardless of whether the alien is a national of a program country, the alien is not a national of—</text> <subclause id="HCA9FC8D6FD684D2DBB79A30D541C5B37"><enum>(I)</enum><text>Iraq or Syria;</text>
 </subclause><subclause id="HFB0F3873978442E6A95E30BDD5BE6A96"><enum>(II)</enum><text display-inline="yes-display-inline">a country that is designated, at the time the alien applies for admission, by the Secretary of State under section 6(j) of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/2405">50 U.S.C. 2405</external-xref>) (as continued in effect under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>)), section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>), section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>), or any other provision of law, as a country, the government of which has repeatedly provided support of acts of international terrorism; or</text>
 </subclause><subclause id="HCD8E7F8A75CF46DB84FE944934C827C9"><enum>(III)</enum><text>any other country that is designated, at the time the alien applies for admission, by the Secretary of Homeland Security under subparagraph (D).</text>
 </subclause></clause></subparagraph><subparagraph id="H29A7F7B43C6245B6B7934110994B07DF"><enum>(B)</enum><header>Certain military personnel and government employees</header><text display-inline="yes-display-inline">Subparagraph (A)(i) shall not apply to an alien if the Secretary of Homeland Security determines that the alien was present—</text>
 <clause id="H167B865749B542E1B2F7FB50445ABB8E"><enum>(i)</enum><text>in order to perform military service in the armed forces of a program country; or</text> </clause><clause id="H8151FE447F634C2FA76FF52B5E0D3070"><enum>(ii)</enum><text>in order to carry out official duties as a full-time employee of the government of a program country.</text>
 </clause></subparagraph><subparagraph id="HF2E151D2BC2149A0A2E8F3E171E4AF50"><enum>(C)</enum><header>Waiver</header><text>The Secretary of Homeland Security may waive the application of subparagraph (A) with respect to an alien if the Secretary determines that such a waiver is in the law enforcement or national security interests of the United States.</text>
						</subparagraph><subparagraph id="H08B2437539DB4E36B0032AE33C1DBED2"><enum>(D)</enum><header>Countries or areas of concern</header>
 <clause id="H50786F211E6D4E17A4751B3814F609CB"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this paragraph, the Secretary of Homeland Security, in consultation with the Secretary of State and the Director of National Intelligence, shall determine whether the requirement under subparagraph (A) shall apply to any other country or area.</text>
 </clause><clause id="HBDCA9429576A4E479D457DD8EA82A2E2"><enum>(ii)</enum><header>Criteria</header><text>In making a determination under clause (i), the Secretary shall consider—</text> <subclause id="H88C8A2B8EF4143E9B2DD00F0743763A8"><enum>(I)</enum><text display-inline="yes-display-inline">whether the presence of an alien in the country or area increases the likelihood that the alien is a credible threat to the national security of the United States;</text>
 </subclause><subclause id="H4EA5255ADCED41DBAE53DE5F12B8EB6B"><enum>(II)</enum><text>whether a foreign terrorist organization has a significant presence in the country or area; and</text> </subclause><subclause id="H52CA5FFF89854F0EA9986167AA101B8B"><enum>(III)</enum><text>whether the country or area is a safe haven for terrorists.</text>
 </subclause></clause><clause id="H9C37C36CE3AE4F368E645DFC3173AD72"><enum>(iii)</enum><header>Annual review</header><text>The Secretary shall conduct an annual review of any determination made under clause (i).</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE73C11EF005B4305A8DF0BCE3A0DF508"><enum>(E)</enum><header>Report</header><text>Beginning not later than 1 year after the date of the enactment of this paragraph, and annually thereafter, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>, and the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> that describes each instance in which the Secretary exercised the waiver authority under subparagraph (C) during the previous year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ida52351631bed4e11a961293c36b3d072"><enum>(b)</enum><header>Requirements for countries</header>
 <paragraph id="id0F60CB00EA5748BF90D4DFACA3C1105F"><enum>(1)</enum><header>Traveler screening and vetting</header><text>Section 217(c)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)(2)</external-xref>) is amended—</text> <subparagraph id="idEF3BC3FE6EFD414BAAAEDADB6B2BC292"><enum>(A)</enum><text>by redesignating subparagraphs (D), (E), and (F) as subparagraphs (E), (F), and (G), respectively; and</text>
 </subparagraph><subparagraph id="idDCDB45C5BA4C4426AEFEDC2E08C394DC"><enum>(B)</enum><text>by inserting after subparagraph (C) the following:</text> <quoted-block display-inline="no-display-inline" id="idE8C97608573245399CE26F998225FC0F" style="OLC"> <subparagraph id="idCAC84FD14CF5444A88A182F792B1EC4F"><enum>(D)</enum><header>Information sharing agreement</header><text>The government of the country, for travel requiring a passport or other government-issued travel document, screens travelers crossing the country’s borders as early in the vetting process as possible using INTERPOL’s Stolen and Lost Travel Documents databases or other means designated by the Secretary of Homeland Security to determine if travelers crossing the country’s borders are using stolen or lost travel documents.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id15aae58ef1424f5fb9edbe51b1936878"><enum>(2)</enum><header>Reporting lost and stolen passports</header><text>Section 217(c)(2)(E) of such Act, as redesignated by paragraph (1)(A), is amended by striking <quote>within a strict time limit</quote> and inserting <quote>not later than 24 hours after becoming aware of the theft or loss</quote>.</text> </paragraph><paragraph id="id5e09e556714148fa94359789e20326ab"><enum>(3)</enum><header>Implementation of passenger information exchange agreement</header><text>Section 217(c)(2)(G) of such Act, as redesignated by paragraph (1)(A), is amended by inserting before the period at the end the following: <quote>, and fully implements such agreement</quote>.</text>
 </paragraph><paragraph id="id0613de57f8be478aaf913fbac5496647"><enum>(4)</enum><header>INTERPOL screening</header><text>Section 217(c)(2) of such Act, as amended by paragraphs (1) through (3), is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ida2b1dfce7f2749c68399706aa40d13ee" style="OLC">
 <subparagraph id="idbcb16c997578481d8eeae5ca4226542b"><enum>(H)</enum><header>INTERPOL screening</header><text>Not later than 270 days after the date of the enactment of this subparagraph, except in the case of a country in which there is not an international airport, the government of the country certifies to the Secretary of Homeland Security that, to the maximum extent allowed under the laws of the country, it is screening, for unlawful activity, each person who is not a citizen or national of that country who is admitted to or departs that country, by using relevant databases and notices maintained by INTERPOL, or other means designated by the Secretary of Homeland Security. The requirement under this subparagraph shall not apply to travel between countries within the Schengen Zone.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id6840132e3a204600b575de8fea3b4aaa"><enum>(c)</enum><header>Failure To implement or comply with information sharing requirements</header>
 <paragraph id="id35E5F41910764808BF1135BC30CD8EBC"><enum>(1)</enum><header>In general</header><text>If the Secretary of Homeland Security, in consultation with the Secretary of State, determines that a Visa Waiver Program country has not complied with a requirement under subparagraph (D), (E), (F), or (G) of section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>), or any additional requirement determined by the Secretary of Homeland Security, the Secretary may terminate the participation of such country in the Visa Waiver Program.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id677216E157494CB4A45989CE7B18C927"><enum>(2)</enum><header display-inline="yes-display-inline">Redesignation</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with the Secretary of State, may redesignate a terminated country as a Visa Waiver Program country if the Secretary of Homeland Security determines that the government of the country is complying with—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id86FDD83689CC4CECAD3C31020319E713"><enum>(A)</enum><text display-inline="yes-display-inline">all of the requirements set forth in subsection (b), including the amendments made by subsection (b);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2B872BA4CB69449B9153A1A624696DBF"><enum>(B)</enum><text display-inline="yes-display-inline">the information sharing agreement required under section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFEE698BC9B464BEFBDF83CB8E7047E8C"><enum>(C)</enum><text display-inline="yes-display-inline">any additional program requirements determined by the Secretary of Homeland Security.</text>
					</subparagraph></paragraph><paragraph id="id8823ff23149b4fa9a43a9cebf789cd9c"><enum>(3)</enum><header>Notification</header>
 <subparagraph id="id1629BD1C3F1E4FCA91B489D2323FD5F8"><enum>(A)</enum><header>In general</header><text>The Secretary of Homeland Security shall notify Congress—</text> <clause id="ide40ea5a4f98a48ac8c3c7057aca43376"><enum>(i)</enum><text>of any former Visa Waiver Program country that has been terminated from participation in the Visa Waiver Program and the reasons for such termination; and</text>
 </clause><clause id="id185f37adb3934201bfb02a8befe6efdc"><enum>(ii)</enum><text>whether a country described in subparagraph (A) has been deemed eligible for redesignation as a Visa Waiver Program country, including the steps taken by the government of such country to qualify for participation in the Visa Waiver Program.</text>
 </clause></subparagraph><subparagraph id="id8187868e33ad4806bf2d65b6cd83e9aa"><enum>(B)</enum><header>Redesignation</header><text>If Congress has not objected to the redesignation of a country described in paragraph (2) before the date that is 30 days after the notification date under subparagraph (A), the Secretary of Homeland Security may redesignate the country as a Visa Waiver Program country.</text>
 </subparagraph></paragraph></subsection><subsection id="id8d6bb5649caf41729ed7ddf8e6620503"><enum>(d)</enum><header>Federal air marshal agreement</header><text>Section 217(c) of the Immigration and Nationality Act, as amended by subsection (b), is further amended—</text>
 <paragraph id="id747d45988c204bbbbbbaebd02e89b635"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id19887aa196fd49d28d732c71b455c028" style="OLC"> <subparagraph id="id822b280c03344c64984fcf52b380a2c4"><enum>(I)</enum><header>Federal air marshal agreement</header><text>The government of the country enters into, and complies with, an agreement with the United States to assist in the operation of an effective Air Marshal Program.</text>
 </subparagraph><subparagraph id="idc842999f287348d586377f7898c0bb05"><enum>(J)</enum><header>Aviation standards</header><text>The government of the country complies with United States aviation and airport security standards, as determined by the Secretary of Homeland Security.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id7ff0eb4f290c47608dccd9770624c1b2"><enum>(2)</enum><text>in paragraph (9)—</text> <subparagraph id="id4d44cf5b42904fd5b08ff1a35c14b61a"><enum>(A)</enum><text>by striking subparagraph (B); and</text>
 </subparagraph><subparagraph id="id97252c0a0f1d473a89c69ec1cbba0d36"><enum>(B)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (B) and (C), respectively.</text> </subparagraph></paragraph></subsection><subsection id="id384b12a3918a4238b78f5764106b58a0"><enum>(e)</enum><header>Electronic passports</header> <paragraph id="idE7EDFE4D0CE949209EF960F4B9E079D9"><enum>(1)</enum><header>Compliance with international standards</header><text>Not later than October 1, 2016, the government of each Visa Waiver Program country shall certify that the country issues to its citizens machine-readable, electronic passports that comply with the biometric and document identifying standards established by the International Civil Aviation Organization.</text>
 </paragraph><paragraph id="id84271b0594454f28b0e52ef65c486a8d"><enum>(2)</enum><header>Annual report</header><text>Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall submit to Congress a list of all the Visa Waiver Program countries whose governments have certified the regular issuance of machine-readable electronic passports to their citizens.</text>
 </paragraph><paragraph id="idd7df9bc0aaa24523bf430da298fad02d"><enum>(3)</enum><header>Possession of electronic passports</header><text>Not later than April 1, 2016, every citizen or national of a Visa Waiver Program country who is cleared to travel to the United States under the Electronic System for Travel Authorization shall possess, at the time of admission, a valid, unexpired, tamper-resistant, machine-readable passport that incorporates biometric and document authentication identifiers that comply with the standards described in paragraph (1).</text>
 </paragraph></subsection><subsection id="id0b84d8eab590401381667847a392d4e5"><enum>(f)</enum><header>Capacity To identify dangerous individuals</header><text>Section 217(c) of the Immigration and Nationality Act, as amended by this section, is further amended—</text>
 <paragraph id="idA6A84CACDAEA4C65A66B61E9D995CAF7"><enum>(1)</enum><text>in paragraph (3), by striking <quote>after the initial period</quote>; and</text> </paragraph><paragraph id="id321E6E4748764D3E9287CB28E9BCD8BD"><enum>(2)</enum><text>by amending paragraph (4) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idC6DD760E06A24BB185536784D503AD87" style="OLC">
 <paragraph id="id353d0add26e54e38aa0cb04834aa2e72"><enum>(4)</enum><header>Required security considerations for program designation and continuation</header><text>In determining whether a country should be designated as a program country or whether a program country should retain its designation as a program country, the Secretary of Homeland Security shall consider whether the government of the country—</text>
 <subparagraph id="id548ffd57c3af48e1b35810763f73c019"><enum>(A)</enum><text>collects and analyzes the information described in subsection (a)(10), including advance passenger information and passenger name records, and similar information pertaining to flights not bound for the United States, to identify potentially dangerous individuals who may attempt to travel to the United States, and shares such information and the results of such analyses with the Government of the United States;</text>
 </subparagraph><subparagraph id="idBA0E2791D5DE4E73BC47BC37F838035F"><enum>(B)</enum><text>collects and analyzes biometric and other information about individuals other than United States nationals who are applying for asylum, refugee status, or another form of non-refoulment protection in such country, and shares such information and the results of such analyses with the Government of the United States;</text>
 </subparagraph><subparagraph id="id375487B740EC471C8751E9421A33C5A8"><enum>(C)</enum><text>shares intelligence about foreign fighters with the United States and with multilateral organizations, such as INTERPOL and EUROPOL; and</text>
 </subparagraph><subparagraph id="id21ABF467334D47CA9F70BA96CDF92080"><enum>(D)</enum><text>has consistently cooperated with the Government of the United States on counterterrorism initiatives, information sharing, preventing terrorist travel, and extradition to the United States of individuals (including the country’s own nationals) who commit crimes that violate United States law before the date of its designation as a program country, and whether the Secretary of Homeland Security and the Secretary of State believe that such cooperation is likely to continue.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ida8cb6599053c4a96a808870980f04866"><enum>(g)</enum><header>Reporting requirements</header>
 <paragraph id="idf520a771c837479e8a75d1bb04921278"><enum>(1)</enum><header>In general</header><text>Section 217(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)</external-xref>), as amended by this section, is further amended—</text>
 <subparagraph id="ideeabcf31c010484b8248bae8c9bd0a06"><enum>(A)</enum><text>in paragraph (2)(C), by amending clause (iii) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id0945E61274A84FC6AA590BD18C9DA8D7" style="OLC"> <clause id="idCD07FC36FB3B46C5BBB67308524FBFBF"><enum>(iii)</enum><text>submits a written report to the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, and the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> regarding the country’s qualification for designation that includes an explanation of such determination.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id21386f31d6484b9c9f22c59890e5c086"><enum>(B)</enum><text>in paragraph (5)(A)(i)—</text> <clause id="id85ed1e44c28d491cb409c1d8977f241c"><enum>(i)</enum><text>by amending subclause (III) to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="id6365F0D770504BB889EC99383F8D8F08" style="OLC">
 <subclause id="idC299A6B319E941C5B424BA7C4657BAE2"><enum>(III)</enum><text>shall submit a written report to the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, and the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name> regarding the continuation or termination of the country’s designation that includes an explanation of such determination and the effects described in subclause (I);</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause><clause id="id51ce3cb8f7ad4d6e837aacfbde3fb7b0"><enum>(ii)</enum><text>in subclause (IV), by striking the period at the end and inserting <quote>; and</quote>; and</text> </clause><clause id="id5b989e1abd4646799a97605b63e52045"><enum>(iii)</enum><text>by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id1feea0abf70241ee8e4198f4dcfb0a9a" style="OLC">
 <subclause id="id0db76fb37fcf42a7a5ad76af5183ddd0"><enum>(V)</enum><text>shall submit a report to the committees described in subclause (III) that includes an assessment of—</text>
 <item id="id8959AE737B714429AB9D1C7C12ED8FB0"><enum>(aa)</enum><text>the threat to the national security of the United States of the designation of each country designated as a program country;</text>
 </item><item id="idA62C3577DF984E16928F894F8339E399"><enum>(bb)</enum><text>the compliance of the government of each such country with the requirements under subparagraphs (D) and (F) of paragraph (2); and</text>
 </item><item id="idE64734BC0BF5481297AD524D19A7DDA3"><enum>(cc)</enum><text>each such government’s capacity to comply with such requirements.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block> </clause></subparagraph></paragraph><paragraph id="id64a0e698d1b24b44863a7cfefafe8ce0"><enum>(2)</enum><header>Date of submission of first report</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit the first report described in section 217(c)(5)(A)(i)(V) of the Immigration and Nationality Act, as added by paragraph (1).</text>
 </paragraph></subsection><subsection id="idfd77e0e83f1844c997c276f3aba81468"><enum>(h)</enum><header>High risk program countries</header><text>Section 217(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)</external-xref>), as amended by this section, is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idae1537d7d900425ba8582b36094f5c6f" style="OLC">
					<paragraph id="ide13029caca614369b16feefb13a2057f"><enum>(12)</enum><header>Designation of high risk program countries</header>
 <subparagraph id="id4adaa1d61cbc4513a02108cf2d5f42b6"><enum>(A)</enum><header>In general</header><text>The Secretary of Homeland Security, in consultation with the Director of National Intelligence and the Secretary of State, shall annually—</text>
 <clause id="idA5EAB1532F6B462A8FAEAE4F5A564355"><enum>(i)</enum><text>evaluate program countries based on the criteria described in subparagraph (B); and</text>
 </clause><clause id="idD403808818DD4ECEA6116D00E7E298F8"><enum>(ii)</enum><text>identify any program country from which the admission of nationals under the program would, in the Secretary’s determination, present a high risk to the national security of the United States.</text>
 </clause></subparagraph><subparagraph id="idbbaaf4f26a51470c9a73f15860ae4363"><enum>(B)</enum><header>Criteria</header><text>The evaluation of each program country under subparagraph (A)(i) shall include the consideration of—</text>
 <clause id="id1A749C37D1584B29B2C34CEAF683A0F4"><enum>(i)</enum><text>the number of nationals of the country determined to be ineligible to travel to the United States under the program during the previous year;</text>
 </clause><clause id="id9282CED075664334916ADF59D7284762"><enum>(ii)</enum><text>the number of nationals of the country who were identified in United States Government databases related to the identities of known or suspected terrorists during the previous year;</text>
 </clause><clause id="idE4516F85EF0E468EA39208119D8D9264"><enum>(iii)</enum><text>the estimated number of nationals of the country who have traveled to Iraq or Syria at any time on or after March 1, 2011, to engage in terrorism;</text>
 </clause><clause id="id8c4ec4e6476e415ba8fe61ade8a6dcb1"><enum>(iv)</enum><text>the capacity of the country to combat passport fraud;</text> </clause><clause id="id0f3dd4eb8fb6421b939c17876f6b7843"><enum>(v)</enum><text>the level of cooperation of the country with the counter-terrorism efforts of the United States;</text>
 </clause><clause id="id413c64c1606a4830964692c56e0d13d6"><enum>(vi)</enum><text>the adequacy of the border and immigration control of the country; and</text> </clause><clause id="idd88f2555e2214924a7eb3345d499be01"><enum>(vii)</enum><text>any other criteria that the Secretary of Homeland Security determines to be appropriate.</text>
 </clause></subparagraph><subparagraph id="id3a21867ff18547f1aefe0b4bcd2abb81"><enum>(C)</enum><header>Suspension of designation</header><text>The Secretary of Homeland Security, in consultation with the Secretary of State, may suspend the designation of a program country based on a determination under subparagraph (A)(ii) that the country presents a high risk to the national security of the United States until the Secretary determines that the country no longer presents such a risk.</text>
 </subparagraph><subparagraph id="id1018375960674f738c1f1558ad445944"><enum>(D)</enum><header>Report</header><text>Not later than 60 days after the date of the enactment of this paragraph, and annually thereafter, the Secretary of Homeland Security, in consultation with the Director of National Intelligence and the Secretary of State, shall submit a report to the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, and the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate </committee-name>that includes an evaluation and threat assessment of each country determined to present a high risk to the national security of the United States under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id00F31958F5BA42EDA99796016E5187BB"><enum>(i)</enum><header>Enhancements to the Electronic System for Travel Authorization</header>
 <paragraph id="id5be9eaf380ef419da7b7c094fb030be2"><enum>(1)</enum><header>In general</header><text>Section 217(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(h)(3)</external-xref>) is amended—</text> <subparagraph id="id7300f40a94374285aabca9148941ec59"><enum>(A)</enum><text>in subparagraph (C)(i), by inserting <quote>or shorten the period of eligibility under any such determination</quote> after <quote>any such determination</quote>; and</text>
 </subparagraph><subparagraph id="id206f5f64cf694d339cf5a3c0c2fbed8d"><enum>(B)</enum><text>by striking subparagraph (D) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idCD484A58AA30453E9EBC9B280177C1F2" style="OLC"> <subparagraph id="id9ec29a72c7954c589e17cdcfea4fc4be"><enum>(D)</enum><header>Fraud detection</header><text>The Secretary of Homeland Security shall research opportunities to incorporate into the System technology that will detect and prevent fraud and deception in the System.</text>
 </subparagraph><subparagraph id="id511a0965bdfe4641a4ccaea49b631016"><enum>(E)</enum><header>Additional and previous countries of citizenship</header><text>The Secretary of Homeland Security shall—</text> <clause id="id6466A417B9734D008724E09F2526C898"><enum>(i)</enum><text>collect from each applicant for admission under this section information on any additional or previous countries of citizenship of such applicant; and</text>
 </clause><clause id="idF7DE74E16A4348179E0A96D4FF3FFB12"><enum>(ii)</enum><text>take any information collected under clause (i) into account when making determinations regarding the eligibility of the alien for admission under this section.</text>
 </clause></subparagraph><subparagraph id="id309dc8bb52414e5d99a8d57093d553f0"><enum>(F)</enum><header>Report on certain limitations on travel</header><text>Not later than 30 days after the date of the enactment of this subparagraph and annually thereafter, the Secretary of Homeland Security, in consultation with the Secretary of State, shall submit a report to the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, and the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> that describes, for the reporting period—</text>
 <clause id="idDE23D000A5F04EEBA1626794D31BA77A"><enum>(i)</enum><text>the number of individuals who were denied eligibility to travel under the program;</text>
 </clause><clause id="id3481B6DA74FF4B4D9E17B61861D7A343"><enum>(ii)</enum><text>the number of individuals whose eligibility for travel under the program;</text> </clause><clause id="idE5675851BECB4E52943C33D3250A1C44"><enum>(iii)</enum><text>the number of individuals described in clause (i) or (ii) who were determined, under subsection (a)(6), to represent a threat to the national security of the United States; and</text>
 </clause><clause id="idAAB43C3C83E9483EA9E57E9B4734312C"><enum>(iv)</enum><text>the country or countries of citizenship of each such individual described in clause (iii).</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="iddea9e1fabdfe42f7b2db8e3fed3796a1"><enum>(2)</enum><header>Report</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of State, shall submit a report that describes steps to strengthen the electronic system for travel authorization authorized under section 217(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(h)(3)</external-xref>) in order—</text>
 <subparagraph id="id2926A39152AE4542B3FF09AF18B4CDAF"><enum>(A)</enum><text>to better secure the international borders of the United States; and</text>
 </subparagraph><subparagraph id="id61CD292963D6498DBF26FADE3CF668C0"><enum>(B)</enum><text>to prevent terrorists and instruments of terrorism from entering the United States.</text>
 </subparagraph></paragraph></subsection><subsection id="id2ad5ecb1aeaa48239e7a6d3690eb8146"><enum>(j)</enum><header>Provision of assistance to nonprogram countries</header><text>The Secretary of Homeland Security, in consultation with the Secretary of State, shall provide risk-based assistance to each country that does not participate in the visa waiver program to assist each such country with—</text>
 <paragraph id="idc54cd0dae532479c85d08dfc65fc2982"><enum>(1)</enum><text>submitting information to INTERPOL about the theft or loss of passports of citizens or nationals of such country; and</text>
 </paragraph><paragraph id="id4e3663e519344ee7a6d6d5825f49621c"><enum>(2)</enum><text>issuing, and validating at the ports of entry of such country, electronic passports that—</text> <subparagraph id="id3461C17520024E76A216DF8066F0A6E4"><enum>(A)</enum><text>are fraud-resistant;</text>
 </subparagraph><subparagraph id="idB256C0C026F54D77B28981084F1661AC"><enum>(B)</enum><text>contain relevant biographic and biometric information (as determined by the Secretary of Homeland Security); and</text>
 </subparagraph><subparagraph id="id3E6FD81A30C847248857FE9892AA941E"><enum>(C)</enum><text>otherwise satisfy internationally accepted standards for electronic passports.</text>
					</subparagraph></paragraph></subsection><subsection id="id3ba79149d9fa47b685126661cffa1ce1"><enum>(k)</enum><header>Clerical amendments</header>
 <paragraph id="id43497a683fd44449b504779d6ce72027"><enum>(1)</enum><header>Secretary of homeland security</header><text>Section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>), as amended by this section, is further amended by striking <quote>Attorney General</quote> each place such term appears (except in subsection (c)(11)(B)) and inserting <quote>Secretary of Homeland Security</quote>.</text>
 </paragraph><paragraph id="id4039dd46caf94143a29b2ace9b21f782"><enum>(2)</enum><header>Electronic system for travel authorization</header><text>Section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>), as amended this section, is further amended—</text>
 <subparagraph id="id80d1a36e45344f73b4b27c4481b8de4d"><enum>(A)</enum><text>in subsection (a)(11), by striking <quote><header-in-text level="paragraph" style="OLC">electronic travel authorization system</header-in-text></quote> from the paragraph heading and inserting <quote><header-in-text level="paragraph" style="OLC">electronic system for travel authorization</header-in-text></quote>;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd966f4d9581147f99442edce4c0bb330"><enum>(B)</enum><text>in subsection (h)(3)—</text>
 <clause commented="no" display-inline="no-display-inline" id="idDB442B833B8B4EB0A4E2D83D9B5D3610"><enum>(i)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">electronic travel authorization system</header-in-text></quote> from the paragraph heading and inserting <quote><header-in-text level="paragraph" style="OLC">electronic system for travel authorization</header-in-text></quote>; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id99E66011E3924CEEB7A73A5DD4CF4D5E"><enum>(ii)</enum><text>by striking <quote>the alien</quote> and inserting <quote>an alien</quote>; and</text>
 </clause></subparagraph><subparagraph id="id390d4b0b643d49899d701677e55ae582"><enum>(C)</enum><text>by striking <quote>electronic travel authorization system</quote> each place such term appears and inserting <quote>electronic system for travel authorization</quote>;</text> </subparagraph></paragraph></subsection><subsection id="id66534b1e7e364464865238a65b54d0a9"><enum>(l)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
 <paragraph id="id12D095C73ED14FE184FF6D51B67948ED"><enum>(1)</enum><text>the International Civil Aviation Organization, which is the specialized agency of the United Nations responsible for establishing international standards, specifications, and best practices relating to the administration and governance of border controls and inspection formalities, should—</text>
 <subparagraph id="id249608226DA7455EA4C7B2DE6412D1BA"><enum>(A)</enum><text>establish standards for the introduction of electronic passports (referred to in this subsection as <quote>e-passports</quote>); and</text>
 </subparagraph><subparagraph id="idD2B8E20125F746149CDCB03A5969C876"><enum>(B)</enum><text>obligate member countries to utilize e-passports as soon as possible; and</text> </subparagraph></paragraph><paragraph id="idC9A50A8D4C304FE3973291A8721B36B2"><enum>(2)</enum><text>e-passports should be a combined paper and electronic passport that contains biographic and biometric information that can be used to authenticate the identity of travelers through an embedded chip.</text>
 </paragraph></subsection></section><section id="ided0558cdfd3b46b1b8d51f90de6a0ea6"><enum>7.</enum><header>Prioritizing Special Immigrant Visas for Iraqi and Afghan translators</header><text display-inline="no-display-inline">In allocating the resources of the Department of State, the Secretary of State shall prioritize the issuance of special immigrant visas authorized under—</text>
 <paragraph id="idFF0B4899AB124576A8C95A02A02A0808"><enum>(1)</enum><text display-inline="yes-display-inline">section 1059 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note);</text>
 </paragraph><paragraph id="idD3319A7A434E4DC99274DABB2821E20A"><enum>(2)</enum><text display-inline="yes-display-inline">section 1244 of the Refugee Crisis in Iraq Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref> note); and</text> </paragraph><paragraph id="id0FB699858F8B47A296E30C5B170B6674"><enum>(3)</enum><text display-inline="yes-display-inline">section 602 of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note).</text></paragraph></section></legis-body>
