 <paragraph id="idaac556e81cb042b999687fb4db93b9dc"><enum>(1)</enum><text>greenhouse gases are accumulating in the atmosphere at a rate that may cause average temperatures to rise 8 degrees Fahrenheit or more;</text>
 </paragraph><paragraph id="id0C71E02FC342405EAEB329D6940052DA"><enum>(2)</enum><text>the expected rise in average temperatures poses a risk of—</text> <subparagraph id="id8FA3CEB6F9B94CF793BFC9E6B8D42838"><enum>(A)</enum><text>increasing global average air and ocean temperatures;</text>
 </subparagraph><subparagraph id="id4B19A5B450704228A535A2DC26D44C51"><enum>(B)</enum><text>widespread melting of snow and ice; and</text> </subparagraph><subparagraph id="id964AD8A330E64F65AD0C5FB88A57E235"><enum>(C)</enum><text>rising global average sea level;</text>
 </subparagraph></paragraph><paragraph id="id883a8409a8d948828f1b9be2af7e3e6c"><enum>(3)</enum><text>the overwhelming majority of the scientific community is clear that climate change is—</text> <subparagraph id="idC5F5963D62494801AB7D63DF43850A0D"><enum>(A)</enum><text>real;</text>
 </subparagraph><subparagraph id="idFA7956B639CA4DB3B4FCF2D4D21FBBAE"><enum>(B)</enum><text>caused by human activity; and</text> </subparagraph><subparagraph id="id63522BD2247B46BCA097C3AF30DABF89"><enum>(C)</enum><text>already causing devastating problems in the United States and around the world; and</text>
 </subparagraph></paragraph><paragraph id="idecbcf66042494ff09312fabe0b5d5d5e"><enum>(4)</enum><text>mandatory steps will be required to move aggressively to transform the energy system of the United States away from fossil fuels to energy efficiency and sustainable energy.</text>
 </paragraph></subsection><subsection id="id3218077754394138842893AFFFEB2102"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> <paragraph id="id8FD726B1CDB14E70AB95E9AF92D34707"><enum>(1)</enum><text>to reduce, in conjunction with other laws, emissions of carbon pollution to ensure that the contribution of the United States to global climate change is lower than the level required to keep global average temperature increases below 2 degrees Celsius;</text>
 </paragraph><paragraph id="id401BFAB050E14DACB92A40915B34F251"><enum>(2)</enum><text>to implement solutions that acknowledge the intersections of environmental degradation that perpetuate racial, social, and economic inequities;</text>
 </paragraph><paragraph id="id4FEF926D7073423CBDA91FDE65FB381E"><enum>(3)</enum><text>to protect the lives of low-income, minority, and tribal communities and reinvest in those communities;</text>
 </paragraph><paragraph id="id14536DEE6E224CF29C2714828F114F1C"><enum>(4)</enum><text>to empower communities to prepare for, and react to, the impacts of climate change that are already being experienced by communities; and</text>
 </paragraph><paragraph id="idD63ED8A1624C44ABB2FAF68B0F5C714B"><enum>(5)</enum><text>to demonstrate to the international community a commitment by the Government of the United States to aggressively reduce carbon pollution emissions.</text>
 </paragraph></subsection></section><section id="id53dd4690ec6a4d159a3cd07fabb235d6"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States that—</text> <paragraph id="id325EE15AEF9E4C94A76F05B4DFAD082C"><enum>(1)</enum><text display-inline="yes-display-inline">the Government of the United States should lead the international community in an aggressive transition away from fossil fuels and toward sustainable energy;</text>
 </paragraph><paragraph id="idE1A5FAB973914466A8BD932108C390D2"><enum>(2)</enum><text>the Government of the United States should tax carbon pollution to capture the price on the atmosphere and motivate significant reductions in emissions; and</text>
 </paragraph><paragraph id="idB78E8D110AC945B98A141383FD9B2C85"><enum>(3)</enum><text>the transition away from fossil fuels shall focus on climate justice, which requires solutions that consider—</text>
 <subparagraph id="id89F33FD1D9104C2C98DB75581FECDAB2"><enum>(A)</enum><text>the needs of workers; and</text> </subparagraph><subparagraph id="id93805E3354E04AD680A0FEE2504D8463"><enum>(B)</enum><text>the manners in which the causes and effects of climate change disproportionately impact low-income and minority communities.</text>
 </subparagraph></paragraph></section><section id="idCD5E51A1F85D4B9B9F94F8347D30A667"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that Congress agrees with the opinion of virtually the entire worldwide scientific community that—</text>
 <paragraph id="id6005caecc05b49b4a32f9d7a8e9ce55c"><enum>(1)</enum><text>climate change is real;</text> </paragraph><paragraph id="id4ed0dbdba703413caef5004ca8e3522a"><enum>(2)</enum><text>climate change is caused by human activities;</text>
 </paragraph><paragraph id="id1239bbb445e04a08a1f49a165779b37a"><enum>(3)</enum><text>climate change has already caused devastating problems in the United States and around the world;</text> </paragraph><paragraph id="idbaf2350152824e7095a5df1df432be67"><enum>(4)</enum><text>a brief window of opportunity exists before the United States and the entire planet suffer irreparable harm; and</text>
 </paragraph><paragraph id="id23d9a8dc6f5b47a58f953ca221334196"><enum>(5)</enum><text>it is imperative that the United States transform the energy system of the United States away from fossil fuels and toward energy efficiency and sustainable energy as rapidly as possible.</text>
 </paragraph></section><section commented="no" id="idED39455947B3475A9A4920C2A775D17F"><enum>5.</enum><header>Definition of Administrator</header><text display-inline="no-display-inline">In this Act, the term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </section><title id="id70B7F6A4A31A4DF6A387890142999289" style="OLC"><enum>I</enum><header>Achieving emissions reductions</header> <section id="idfb65447f847a47bab63eb4f8c3fc51ed"><enum>101.</enum><header>Carbon pollution fee</header> <subsection commented="no" display-inline="no-display-inline" id="H20BEFA5DE00947ACB552282D1D6B0005"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF233465E9B1943E2A21F9F0D7F6A6CDD" style="OLC">
						<part id="id6F8C2422DB12491082EBB2FBDB7F708B"><enum>E<?LEXA-Enum E?></enum><header>Emissions reductions</header>
 <section id="idBAC2229C0BD74331A390AB261F903198"><enum>194.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> <paragraph id="H4BE1316825AB49BAA3E34E7E4700B340"><enum>(1)</enum><header>Carbon polluting substance</header><text>The term <term>carbon polluting substance</term> means coal (including lignite and peat), petroleum and any petroleum product, or natural gas that—</text>
 <subparagraph id="id52FFD0C1E63F43D3B6CC235172EE90B8"><enum>(A)</enum><text>when combusted or otherwise used, will release greenhouse gas emissions; and</text>
 </subparagraph><subparagraph id="idEE70FF3223D14E5294520C0808C2D3AF"><enum>(B)</enum><text>is—</text> <clause id="id0C687FC2228140F29E2DC3748E7B0545"><enum>(i)</enum><text>extracted, manufactured, or produced in the United States; or</text>
 </clause><clause id="id48BB712D283A4ABA9B5D84AC1F89EC64"><enum>(ii)</enum><text>imported into the United States for consumption, use, or warehousing.</text>
										</clause></subparagraph></paragraph><paragraph id="HCD84DF51550344059FDC7D2D6282EDA6"><enum>(2)</enum><header>Carbon
 pollution-intensive good</header><text display-inline="yes-display-inline">The term <term>carbon pollution-intensive good</term> means a good that is (as identified by the Administrator, by rule) iron, steel, a steel mill product (including pipe and tube), aluminum, cement, glass (including flat, container, and specialty glass and fiberglass), pulp, paper, a chemical, or an industrial ceramic.</text>
 </paragraph><paragraph id="id25308BECD96C48F1BE6ECA2848B798C2"><enum>(3)</enum><header>Rate of inflation</header><text>The term <term>rate of inflation</term> means the cost-of-living adjustment determined under <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1(f)(3)</external-xref> of the Internal Revenue Code of 1986 for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2017</quote> for <quote>calendar year 1992</quote> in subparagraph (B) of that section.</text>
 </paragraph><paragraph id="idda1b080b771f4a6d86004e496ba9d626"><enum>(4)</enum><header>Substantially equivalent measure</header><text>The term <term>substantially equivalent measure</term> means a fee or other regulatory requirement that imposes a cost on manufacturers of carbon pollution-intensive goods located outside the United States approximately equal to the cost imposed by the fee under this part on manufacturers of comparable carbon pollution-intensive goods located in the United States.</text>
 </paragraph></section><section id="id3804A1744ED44A7DA1157AE7E357E171"><enum>195.</enum><header>Emissions reductions targets</header><text display-inline="no-display-inline">It is the policy of the United States that greenhouse gas emissions from all sectors of the United States economy should not exceed—</text>
 <paragraph id="id8dcadd88b1694f989d20a3bdb363dec1"><enum>(1)</enum><text>5,800,000,000 tons in 2020;</text> </paragraph><paragraph id="id2a073c355e084b23a1267109cedd5887"><enum>(2)</enum><text>3,700,000,000 tons in 2030;</text>
 </paragraph><paragraph id="id2c3e85a369ad49e4ab7f545e05000794"><enum>(3)</enum><text>2,500,000,000 tons in 2040; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31B30C5C9E664C4A90197AA8344A3205"><enum>(4)</enum><text>1,260,000,000 tons in 2050.</text>
								</paragraph></section><section id="idd03c3365078b4b7dba46f4777fe0acb9"><enum>196.</enum><header>Carbon pollution fee</header>
 <subsection id="idBB468E237EFF4DE9A4D74EFD9930D1B9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury, in consultation with the Administrator, shall impose on any manufacturer, producer, or importer of a carbon polluting substance a fee in accordance with this section.</text>
								</subsection><subsection id="id067506bd397d45598902712ec5f622d4"><enum>(b)</enum><header>Amount</header>
 <paragraph id="id836fee3b352047eb9fe9f33cd5dc5eb7"><enum>(1)</enum><header>In general</header><text>The amount of the carbon pollution fee imposed under subsection (a) on any carbon polluting substance shall be assessed per ton of carbon dioxide content (including carbon dioxide equivalent content of methane) of the carbon polluting substance, as determined by the Secretary of the Treasury, in consultation with the Administrator and the Secretary of Energy.</text>
 </paragraph><paragraph id="id99c0903d665045ccab3a420709494ba0"><enum>(2)</enum><header>Fractional part of ton</header><text>In the case of a fraction of a ton of a carbon polluting substance, the fee imposed under subsection (a) shall be the same fraction of the amount of the fee imposed on a whole ton of the carbon polluting substance.</text>

 <subparagraph id="idF56F0ED8A7E14A258C34C58EBC1572D2"><enum>(A)</enum><text>the amount in effect for the preceding calendar year; and</text> </subparagraph><subparagraph id="idF94621B692BB48C88238E0D7D5E91EEA"><enum>(B)</enum><text>the product (rounded to the nearest dollar) obtained by multiplying—</text>
 <clause id="id111897D3DC5A4206B4B752E5435AAA64"><enum>(i)</enum><text>the amount described in subparagraph (A); and</text> </clause><clause id="id3597DBCCD78140A193FBD320EE1C9D9E"><enum>(ii)</enum><text>5 percent, plus the rate of inflation.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id7fddba99627c476091f4581869cf4cf6"><enum>(c)</enum><header>Single imposition of fee</header><text>No fee shall be imposed under subsection (a) with respect to a carbon polluting substance if the person that would be liable for the fee establishes that a prior fee imposed under that subsection has been imposed with respect to that carbon polluting substance.</text>
 </subsection><subsection id="id68fd16a279fd4506b4647ae8b34c4c22"><enum>(d)</enum><header>Limitations</header><text>No fee shall be imposed against a person under subsection (a) if during the calendar year, in accordance with such regulations as the Secretary of the Treasury, in consultation with the Administrator, may prescribe—</text>
 <paragraph id="id0aa99559eed546b08df906579051dda5"><enum>(1)</enum><text>for a calendar year before calendar year 2036, the person uses a carbon polluting substance as a feedstock so that the carbon associated with that carbon polluting substance will not be emitted; or</text>
 </paragraph><paragraph id="id68734975090a4202bb8da8192f038154"><enum>(2)</enum><text>a fee under subsection (a) was paid with respect to another carbon polluting substance that is used by the person in the manufacture or production of the applicable carbon polluting substance.</text>
									</paragraph></subsection></section><section id="id73A5123960EA407BB5D78378F1EE28BB"><enum>197.</enum><header>Interagency Climate Council</header>
 <subsection id="idcd849ffcfc6045fba9359139aa4c0ce2"><enum>(a)</enum><header>Establishment</header><text>There is established a council, to be known as the <quote>Interagency Climate Council</quote> (referred to in this section as the <quote>Council</quote>).</text> </subsection><subsection id="id6673BC9A59F74B1CB9225061D459FC85"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of—</text>
 <paragraph id="id9CC4FA141D144013A614597E21ADD121"><enum>(1)</enum><text>the Administrator, who shall be the Chairperson;</text> </paragraph><paragraph id="id57809526553B4C3CBF5BFA961323BDC7"><enum>(2)</enum><text>the Secretary of the Treasury;</text>
 </paragraph><paragraph id="idEA1D1ECB28E74DEE882AE2B1DD781CDB"><enum>(3)</enum><text>the Secretary of Energy;</text> </paragraph><paragraph id="id3EA389C1186141C5848C2C0E3B1FB356"><enum>(4)</enum><text>the Secretary of Transportation;</text>
 </paragraph><paragraph id="id1147062fb3c145bb857c1038b26e41ea"><enum>(5)</enum><text>the Secretary of Commerce;</text> </paragraph><paragraph id="id9fe4b9b807aa4daba223fa707d5f2201"><enum>(6)</enum><text>the Secretary of the Interior;</text>
 </paragraph><paragraph id="id7dafc115d4174f3ab829c9847b7dda47"><enum>(7)</enum><text>the Secretary of Agriculture;</text> </paragraph><paragraph id="idadd45a93f8fa433ab1d4898f518495ec"><enum>(8)</enum><text>the Director of the Office of Science and Technology Policy;</text>
 </paragraph><paragraph id="id2551890529c14774bc451856e81aa3c3"><enum>(9)</enum><text>the Director of the Office of Management and Budget; and</text>
 </paragraph><paragraph id="idEF954E8C0B804C58A269DF2B36DA0FC8"><enum>(10)</enum><text>the Chairperson of the Council of Environmental Quality.</text> </paragraph></subsection><subsection id="id872f021d5ae7460991b5faa4848300c5"><enum>(c)</enum><header>Activities</header> <paragraph id="id725247C0E8F1498998AB66C43B295D17"><enum>(1)</enum><header>Efficacy assessment</header><text>Beginning in 2020 and every 3 years thereafter, the Council shall assess the efficacy of Federal, State, and local actions in effect as of the date of the assessment, including Federal statutory or regulatory policies and policies established by the <short-title>Climate Protection and Justice Act of 2015</short-title>, in achieving the greenhouse gas emissions reduction targets described in section 195.</text>
 </paragraph><paragraph id="id5AC2981CB4F9409DB56D51A070B6763E"><enum>(2)</enum><header>Reduction opportunities</header><text>The Council shall identify and evaluate potential greenhouse gas emissions reductions opportunities in all sectors of the economy, including opportunities for the promulgation under this Act of new or updated regulations for stationary and mobile sources.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBDD7DD0B62994E839EC775B1879ECBC1"><enum>(d)</enum><header>Regulations</header><text>If the Council finds, in carrying out an assessment under subsection (c)(1), that the United States has not met any emissions reductions target described in section 195, or if there is substantial risk that the United States may not meet an emissions reduction target described in that section, the Administrator shall, not later than 2 years after the date of the assessment by the Council, promulgate final regulations under this Act to update existing regulations or establish new regulations relating to a sector of the economy identified by the Council, with sufficient stringency and coverage to ensure that the United States meets the emissions reductions target.</text>
								</subsection></section><section id="id95601B3A49EF476790FF631AC6799A87"><enum>198.</enum><header>Savings provisions</header>
 <subsection id="id39566805508143E0B118DC5E817AAB59"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of other provisions of this Act, nothing in this part shall—</text> <paragraph id="id615B0B4352974E5B850C6609160CD54A"><enum>(1)</enum><text display-inline="yes-display-inline">affect the regulatory status of carbon dioxide or any other greenhouse gas; or</text>
 </paragraph><paragraph id="id12CF28A488EC4BCFBE85FF3B4363F1C9"><enum>(2)</enum><text display-inline="yes-display-inline">limit regulatory authority relating to carbon dioxide or any other greenhouse gas.</text> </paragraph></subsection><subsection id="idA0329C4F161440E0B610BC54BBB38A8A"><enum>(b)</enum><header>No preemption</header><text display-inline="yes-display-inline">Nothing in this chapter shall preempt or limit State or local actions to address climate change.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id4C476F3286E5431F89784766DB59BB26"><enum>(b)</enum><header>Technical
 amendments</header><text>Title IV of the Clean Air Act (relating to noise pollution) (<external-xref legal-doc="usc" parsable-cite="usc/42/7641">42 U.S.C. 7641 et seq.</external-xref>) is—</text>
 <paragraph id="idf99cfe5572bd4255a0fca5b65e4ea793"><enum>(1)</enum><text>amended by redesignating sections 401 through 403 as sections 701 through 703, respectively; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id554a1192fa7d4cdeb93281ea72a1d1a6"><enum>(2)</enum><text>redesignated as title VII and moved to appear at the end of that Act.</text>
					</paragraph></subsection></section><section commented="no" id="idfae65f4770ed496aa2695859595913bf"><enum>102.</enum><header>Carbon Fee Rebate Program</header>
 <subsection commented="no" id="idc502068d777c4ce49ca02549f2ff7615"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="id8ED705743112451997B25D9E8FFEBBB7"><enum>(1)</enum><header>Eligible dividend recipient</header><text>The term <term>eligible dividend recipient</term> includes—</text>
 <subparagraph commented="no" id="ide075c625b977470488b71c9b99a77c8f"><enum>(A)</enum><text>a citizen of the United States;</text> </subparagraph><subparagraph commented="no" id="id82efb40dd63f4caeab338a9c2c393a48"><enum>(B)</enum><text>a lawful permanent resident of the United States;</text>
 </subparagraph><subparagraph commented="no" id="id3c139bbdc6e641e0b0c2092bd77aeffa"><enum>(C)</enum><text>an individual whom the President may designate as meeting the requirements for deferred action described in the Department of Homeland Security memorandum entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States As Children</quote> (dated June 15, 2012);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9c9f589c5974b2e9fce758a95a15069"><enum>(D)</enum><text>an individual whom the President may designate as meeting the requirements for deferred action described in the Department of Homeland Security memorandum entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States As Children and with Respect to Certain Individuals Who Are the Parents of U.S. Citizens or Permanent Residents</quote> (dated November 20, 2014);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id904D8004758146079227AA6F3029DD0D"><enum>(E)</enum><text>an asylee;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12B835D2E4BD4C1497C6D9BE70858959"><enum>(F)</enum><text>a refugee; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C90F8205FD34DEE8F2AD8937F062212"><enum>(G)</enum><text>any other individual designated by the President.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2AF05A615DCC4774A93E3977E4A65344"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Carbon Fee Rebate Fund established by subsection (c)(1).</text>
 </paragraph></subsection><subsection commented="no" id="id83A286FEC2F84CC9A1EB4D35C84B25A8"><enum>(b)</enum><header>Office of Climate Dividend</header><text>There is established an office within the Department of the Treasury, to be known as the <quote>Office of Climate Dividend</quote>, which shall administer the distribution of carbon fee rebates under subsection (d).</text>
				</subsection><subsection id="idCA2C748A75FB4EC4A21399EAACBC0219"><enum>(c)</enum><header>Carbon Fee Rebate Fund</header>
 <paragraph id="idF468394C45294C8DABB486B289DC261B"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund, to be known as the <quote>Carbon Fee Rebate Fund</quote>.</text> </paragraph><paragraph id="idC5E32EE2E6194051AD68F34A25AD6D45"><enum>(2)</enum><header>Deposits to Fund</header><text>For each fiscal year, there shall be deposited in the Fund, amounts collected from fees imposed under section 196 of the Clean Air Act.</text>
 </paragraph><paragraph id="id98831F9066B14E1DB2D89F4D2E3D626F"><enum>(3)</enum><header>Expenditures</header><text>Amounts deposited in the Fund shall be available without appropriation for the purposes described in subsection (d).</text>
					</paragraph></subsection><subsection id="idB2552D99B01E40E691C385ACCEEFF32E"><enum>(d)</enum><header>Carbon Fee Rebate Program</header>
 <paragraph id="idD8D4E7F6A67D41A4BB2532929933B4CF"><enum>(1)</enum><header>In general</header><text>On a quarterly basis, the Secretary of the Treasury shall remit from the Fund to each eligible dividend recipient a carbon fee dividend, which, except as provided in paragraph (3), shall be in an amount equal to—</text>
 <subparagraph id="id2596D9AA5B934DED8FF737B6D8065BF9"><enum>(A)</enum><text>the receipts from the fee imposed under section 196 of the Clean Air Act for the preceding quarter, divided by</text>
 </subparagraph><subparagraph id="id0425A31AE95D469E917F8BC8E28E462F"><enum>(B)</enum><text>the number of eligible dividend recipients on the last day of the preceding quarter.</text>
 </subparagraph></paragraph><paragraph id="id89BE760E670249AB9F9A587C274B05A2"><enum>(2)</enum><header>Regulations</header><text>The Secretary of the Treasury shall promulgate regulations governing the dispersal of funds under paragraph (1), including—</text>
 <subparagraph id="idF0E59257841A429C9BA5B198F7AC4DF5"><enum>(A)</enum><text>procedures for the identification and maintenance of an accurate list of eligible dividend recipients;</text>
 </subparagraph><subparagraph id="id8413DC0E6A8A41788D7834E3120CE28C"><enum>(B)</enum><text>the disbursement of funds to individuals under the age of 18 years; and</text> </subparagraph><subparagraph id="id22191FEE6FA04AC49BCB2EC148F19987"><enum>(C)</enum><text>the use of electronic means for transfers of funds, to the maximum extent practicable.</text>
						</subparagraph></paragraph><paragraph commented="no" id="idAFC6CB208CEB4EDFA351A8B43CCF058A"><enum>(3)</enum><header>Phase out of carbon tax dividend for high income households</header>
 <subparagraph commented="no" id="id8E15E1DE805D46CF8B8115F7ECF73A50"><enum>(A)</enum><header>In general</header><text>The amount of the carbon fee dividend for any eligible dividend recipient under paragraph (1) (determined without regard to this paragraph) shall be reduced by the amount determined under subparagraph (B).</text>
 </subparagraph><subparagraph commented="no" id="idEB8CC75FBBA44340815D2958E2E48FE9"><enum>(B)</enum><header>Amount of reduction</header><text>The amount determined under this subparagraph is the amount which bears the same ratio to the amount which would be paid under paragraph (1) as—</text>
 <clause commented="no" id="id28312E1494914491820AB84D2D177D04"><enum>(i)</enum><text>the excess of—</text> <subclause commented="no" id="idE0030D3BFB614720B9DE8CF8BFCDF501"><enum>(I)</enum><text>the eligible individual's adjusted gross income for the most recent taxable year, over</text>
 </subclause><subclause commented="no" id="idA4562DCC73A84034A0581604E40F376F"><enum>(II)</enum><text>the $100,000, bears to</text> </subclause></clause><clause commented="no" id="id1CBD0B22E24B4641927CF80154D46221"><enum>(ii)</enum><text>the phaseout range.</text>
 </clause></subparagraph><subparagraph id="id5271B0E9ECAE43BB96F44DFFF0F9373E"><enum>(C)</enum><header>Phaseout range</header><text>For purposes of subparagraph (B), the phaseout range is—</text> <clause commented="no" id="id91B6313B4A3A4B01AB9C281CA7A30DC3"><enum>(i)</enum><text>in the case of an eligible taxpayer who filed a joint return, $10,000,</text>
 </clause><clause commented="no" id="idB9C62759B7694E65A35C5A643CEB021C"><enum>(ii)</enum><text>in the case of an eligible taxpayer who filed as a head of household, $8,000, and</text> </clause><clause commented="no" id="idDAED2CF357DA40FEAD66343383701EB4"><enum>(iii)</enum><text>in the case of any other eligible taxpayer, $5,000.</text>
							</clause></subparagraph><subparagraph commented="no" id="id15ECCE55F0064ABEADEF55D10CC6ED9E"><enum>(D)</enum><header>Inflation adjustment</header>
 <clause id="ida2a5648c5c9e4d0983fbd679eb10106e"><enum>(i)</enum><header>In general</header><text>In the case of any calendar year beginning after 2017, the $100,000 amount in subparagraph (B)(i)(II) shall be increased by an amount equal to—</text>
 <subclause id="id54c2b73336564414a87c89f43899a905"><enum>(I)</enum><text>such dollar amount, multiplied by</text> </subclause><subclause id="id23613c7187af459287279ecec0806b19"><enum>(II)</enum><text>the cost-of-living adjustment determined under <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1(f)(3)</external-xref> of the Internal Revenue Code of 1986, by substituting <quote>2016</quote> for <quote>1992</quote> in subparagraph (B) thereof.</text>
 </subclause></clause><clause id="id2740681D28E94CE98F1A307C5910A7C4"><enum>(ii)</enum><header>Inflation adjustment</header><text>The amount of any increase under clause (i) shall be rounded to the nearest multiple of $5,000.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CE41A32DCD14EFB8AD394D9C299B249"><enum>(E)</enum><header>Definitions</header><text>Any term used in this paragraph which is also used in the Internal Revenue Code of 1986 shall have the meaning given such term under such Code.</text>
						</subparagraph></paragraph></subsection></section></title><title id="id298A75BF805D4A128260966013548FB7" style="OLC"><enum>II</enum><header>Protecting vulnerable people of the United States from the impacts of climate change</header>
			<subtitle id="id9A6A2BF67B4346E19C96EB0831353C22" style="OLC"><enum>A</enum><header>Ensuring climate justice for all</header>
 <section id="idA08DA6AE40CB456B95DA331F3B22B764"><enum>201.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="idFA55FF9502894922A7B421F673458B5D"><enum>(1)</enum><text display-inline="yes-display-inline">minority and low-income communities in the United States are disproportionately affected by the causes of climate change because—</text>
 <subparagraph id="idA64E43AD9D0A479DB61641563251B437"><enum>(A)</enum><text display-inline="yes-display-inline">according to a 2012 study by the National Association for the Advancement of Colored People—</text> <clause id="id50FF7E1EB9DC410BA717C4104748D27F"><enum>(i)</enum><text display-inline="yes-display-inline">the nearly 6,000,000 people in the United States who live within 3 miles of a coal power plant have an average per capita annual income of $18,400, which is lower than the national average of $21,587; and</text>
 </clause><clause id="idB62BE5DD5DCB4925A596594E6F5577FC"><enum>(ii)</enum><text display-inline="yes-display-inline">among the people who live within 3 miles of a coal power plant, 39 percent are people of color, while people of color comprise only 36 percent of the total population of the United States;</text>
 </clause></subparagraph><subparagraph id="idE8ADB7C90D1E4A6DB85AA999BFC8CC53"><enum>(B)</enum><text display-inline="yes-display-inline">82.3 percent of Native Americans and Alaska Natives live within 50 miles of major sources of NO and NO<subscript>2</subscript> and 65.8 percent of Native Americans and Alaska Natives live within 25 miles of PM–10 point sources; and</text>
 </subparagraph><subparagraph id="id06FC74BEF64D470BB4876E1E41211300"><enum>(C)</enum><text display-inline="yes-display-inline">the Centers for Disease Control and Prevention has found that—</text> <clause id="id98B0E3EDD456412EA3783080C8C9AAE7"><enum>(i)</enum><text display-inline="yes-display-inline">African-Americans are 2 to 3 times more likely to die from asthma than any other racial or ethnic group;</text>
 </clause><clause id="idFA8C23D8CC4D4313887C720F20E5074F"><enum>(ii)</enum><text display-inline="yes-display-inline">African-American and Hispanic children visit emergency departments for asthma care more often than Caucasian children;</text>
 </clause><clause id="id10EE0DCDE81243D883E7176642B3A5E9"><enum>(iii)</enum><text display-inline="yes-display-inline">more than 1 in 4 African-American adults cannot afford routine doctor visits;</text> </clause><clause id="idB15A7EC017B94D11B36D82A1527611E3"><enum>(iv)</enum><text display-inline="yes-display-inline">nearly 1 in 7 Hispanic adults cannot afford routine doctor visits;</text>
 </clause><clause id="id0E4DE7DA0F47439D8ADCF67C157897A4"><enum>(v)</enum><text display-inline="yes-display-inline">Hispanic individuals are 30 percent more likely to visit the hospital for asthma; and</text> </clause><clause id="id9DF61EA0A513471CB9CEF50347DC7F20"><enum>(vi)</enum><text display-inline="yes-display-inline">Hispanic children are 40 percent more likely to die from asthma than Caucasian children; and</text>
 </clause></subparagraph></paragraph><paragraph id="idC290F19F690445749CBEDE6A9D0EE50F"><enum>(2)</enum><text display-inline="yes-display-inline">minority and low-income people of the United States are disproportionately affected by the impacts of climate change because—</text>
 <subparagraph id="idF0D5B57FAF8E47DD904DC30FDD268AC0"><enum>(A)</enum><text display-inline="yes-display-inline">hurricanes disproportionately impact low-income and minority communities, and regarding Hurricane Katrina in 2005—</text>
 <clause id="idE21DEF3D420148EBBE3371ED648D0494"><enum>(i)</enum><text display-inline="yes-display-inline">after the hurricane, people of color were much less likely to return to the homes in New Orleans from which those individuals were evacuated;</text>
 </clause><clause id="id70C574C45FC941AA98413E1B165C287C"><enum>(ii)</enum><text display-inline="yes-display-inline">according to the Bureau of Labor and Statistics, only 54 percent of African-Americans who were evacuated during Hurricane Katrina returned to New Orleans, compared to 82 percent of Caucasian evacuees;</text>
 </clause><clause id="id922A8B537CAA48B9AB346DBEC80294F0"><enum>(iii)</enum><text>the damage occurred in areas—</text> <subclause id="id1BAAD924B8564EA890FD37217A7D4FC1"><enum>(I)</enum><text>with populations that were 45.8 percent African-American, compared to undamaged areas with populations that were 26.4 percent African-American; and</text>
 </subclause><subclause id="idBE73C18165DB49B181A851F2CF7C84F7"><enum>(II)</enum><text>in which 20.9 percent of the households had incomes below the poverty line, compared to undamaged areas in which 15.3 percent of the households had incomes below the poverty line;</text>
 </subclause></clause><clause id="id77231A70B421462C87030BE089E3C0EF"><enum>(iv)</enum><text>African-Americans are estimated to have accounted for approximately 44 percent of the Hurricane Katrina victims;</text>
 </clause><clause id="id2A805C482C4F469FB16FFD1A95218FC8"><enum>(v)</enum><text><fraction>1/5</fraction> of the individuals displaced by Hurricane Katrina were likely to have been poor, and 30 percent of those individuals had incomes that were below 150 percent of the poverty line; and</text>
 </clause><clause id="idA2C88E1D534F473A877960FCAD6E0590"><enum>(vi)</enum><text>nearly <fraction>1/2</fraction> of all individuals aged 65 or older who live in flooded or damage-affected areas report having a disability, and 26 percent of those individuals report having 2 or more types of disabilities;</text>
 </clause></subparagraph><subparagraph id="idF632F1602C8440499A03390E4CC22170"><enum>(B)</enum><text>extreme weather disproportionately impacts low-income and minority communities, and regarding Hurricane Sandy in 2012—</text>
 <clause id="id485DD0C8E1A54F428CB192BF3DC17406"><enum>(i)</enum><text>80,000 residents living in low-income housing lost power, heat, and hot water for more than 2 weeks in the middle of winter;</text>
 </clause><clause id="id29D23C19BE274F16AEE5A732FFE7525C"><enum>(ii)</enum><text>1 in 5 public housing units and almost 1 in 7 affordable rental housing units were damaged;</text> </clause><clause id="id53BCD7DEBC7F44FDAF91F733FC5D053B"><enum>(iii)</enum><text>in contrast to the effects of Hurricane Sandy on low-income communities, Wall Street went back to business with the lights on and stock tickers running only 2 days after Hurricane Sandy hit New York City;</text>
 </clause><clause id="id5ECB6F8F0DA24135AC8A23A518DF70F1"><enum>(iv)</enum><text>55 percent of the victims of Hurricane Sandy in New York City were very-low-income renters, with incomes that averaged $18,000 per year;</text>
 </clause><clause id="id33C486D3E0DC40CBAA7F91F457CE2794"><enum>(v)</enum><text>67 percent of recipients of assistance from the Federal Emergency Management Agency were low-income individuals; and</text>
 </clause><clause id="id3CE835D2B0C14DD7B4F5E5C5CC38AA2B"><enum>(vi)</enum><text>the median rent paid by households affected by Hurricane Sandy has increased $200 per month since the date Hurricane Sandy hit New York City;</text>
 </clause></subparagraph><subparagraph id="idDA058CB79C1B4116BE0C1DF3F61563BC"><enum>(C)</enum><text>heat waves disproportionately impact low-income and minority communities because—</text> <clause id="id04CA8745ECED4BF58BD50D65D6888BD5"><enum>(i)</enum><text>African-Americans are 52 percent more likely than Caucasians to live in dense, urban neighborhoods that may be 22 degrees Fahrenheit hotter than rural neighborhoods, which increases the risk of health complications for African-Americans, including death from heat-related complications;</text>
 </clause><clause id="idDA120449512F49EBB46CDF083324D5A9"><enum>(ii)</enum><text>although access to air conditioning lowers the risk of mortality from heat-related health complications by 80 percent, 1 in 5 low-income households has no access to air conditioning;</text>
 </clause><clause id="id96138CA4D81443B4B7F971235D700A3D"><enum>(iii)</enum><text>in 2011 and 2012, drought and heat waves affected communities with median incomes that were 5 percent lower than the national average;</text>
 </clause><clause id="id9BC4B5F911124F758EF39EDF7C53FCC3"><enum>(iv)</enum><text>heat waves—</text> <subclause id="id21CC33A09A4646EA91B43AAE5E228CDC"><enum>(I)</enum><text>cause more deaths in the United States than all other weather events combined; and</text>
 </subclause><subclause id="id3E4091B59DCA42C2A432C3DA7D3D242E"><enum>(II)</enum><text>are particularly dangerous for Hispanic people, who are disproportionately likely to have low incomes;</text>
 </subclause></clause><clause id="id4BEFE618381C463BB09E26592463CFA0"><enum>(v)</enum><text>the number of unhealthy <quote>red alert</quote> air quality days in more than 12 cities in the eastern United States—</text> <subclause id="id4B77660C5CD648C19FE08E1B0F0B6521"><enum>(I)</enum><text>will likely double due to increased ozone formation caused by rising temperatures; and</text>
 </subclause><subclause id="id1632ECD7007548BE855DA1352530EABF"><enum>(II)</enum><text>will increase rates of asthma complications for Hispanic people, who are also at risk for cardiovascular conditions; and</text>
 </subclause></clause><clause id="idEEA9E45AC97A423A989F01004B1CB32D"><enum>(vi)</enum><text>by the end of the 21st century, climate change is projected to triple the average number of extremely hot days in the United States, the consequences of which—</text>
 <subclause id="idBD509AB0021A411AAF59885C712D0436"><enum>(I)</enum><text>include—</text> <item id="id224611B7F2774B35BDA42D4A9283B4C4"><enum>(aa)</enum><text>thousands of premature deaths annually by 2100;</text>
 </item><item id="id20FEEC48F40A49A68A60F510338166D4"><enum>(bb)</enum><text>nearly 2,000,000,000 lost labor hours per year; and</text> </item><item id="id9924355314FF4F3E975B29F6C499C7E9"><enum>(cc)</enum><text>over $100,000,000,000 in lost wages annually; and</text>
 </item></subclause><subclause id="idF37CF3B1F7E94989BF901201C02AB3FD"><enum>(II)</enum><text>disproportionately burden Hispanic people, who comprise—</text> <item id="id88F8C547BF404738AF0EA5F12F8ED2C7"><enum>(aa)</enum><text>42 percent of construction laborers; and</text>
 </item><item id="id12A686EE47F9417E9F76EE48AD3210A3"><enum>(bb)</enum><text>approximately 75 percent of agricultural field workers;</text> </item></subclause></clause></subparagraph><subparagraph id="id476CF2B67B1C45EBA7682284F495F9BD"><enum>(D)</enum><text>floods disproportionately impact low-income and minority communities, for example—</text>
 <clause id="id80490018F4B44E908EC796DDAB4EC581"><enum>(i)</enum><text>in 2011 and 2012, floods affected communities with median incomes that were 14 percent lower than the national average; and</text>
 </clause><clause id="id551AE66118504E3FACEAC00140F4CF55"><enum>(ii)</enum><text>in June 2011, extreme Missouri River rain runoff hit record highs and caused $1,500,000,000 in damages, including damages in communities in Arkansas and Mississippi with median incomes that were 23 percent and 30 percent lower, respectively, than the national average;</text>
 </clause></subparagraph><subparagraph id="idF7F8DBD158FD4D41B5F052B3898D3AB6"><enum>(E)</enum><text>tornadoes disproportionately impact low-income and minority communities—</text> <clause id="id4A20EE0A52FD4124966A2F70FB04D6BC"><enum>(i)</enum><text>because even though mobile homes comprise only 8 percent of housing in the United States, <fraction>1/2</fraction> of all fatalities during tornadoes are fatalities of individuals who reside in mobile homes; and</text>
 </clause><clause id="id5D32EB8069C14A49B5EE99571DA405A1"><enum>(ii)</enum><text>with the deadliest tornado in the history of the United States having occurred in Joplin, Missouri, a community with—</text>
 <subclause id="idB5C89A86EDD74362BF9F5B5C24D28633"><enum>(I)</enum><text>a median income that is 29 percent lower than the national average; and</text>
 </subclause><subclause id="id471530D5553749758DE44D9D70C6FDEA"><enum>(II)</enum><text>a 20-percent poverty rate;</text> </subclause></clause></subparagraph><subparagraph id="idE954A213C40B4E0D99292FAC2A3F2956"><enum>(F)</enum><text>wildfires disproportionately impact low-income and minority communities, for example—</text>
 <clause id="id9AB674CF5AB04C28A81C386397AA86C9"><enum>(i)</enum><text>the Ash Creek Fire devastated an Indian reservation on which—</text> <subclause id="id0F48781332C746AABD4AF35C390A9984"><enum>(I)</enum><text><fraction>1/3</fraction> of the families live below the poverty line; and</text>
 </subclause><subclause id="idB7EC8698F4DA4BB4829E6E6FC7283CBC"><enum>(II)</enum><text><fraction>2/3</fraction> of the adults are unemployed; and</text> </subclause></clause><clause id="id4FDBEAF1CACE44D09193DD9DFBC0F07D"><enum>(ii)</enum><text>the most destructive wildfire in Texas history destroyed almost 1,700 homes in Bastrop, a community with 14 percent of households at, or below, the poverty line;</text>
 </clause></subparagraph><subparagraph id="id71A39D1D4952468586B4AC698B62BB85"><enum>(G)</enum><text>droughts disproportionately impact low-income and minority communities because—</text> <clause id="id9245DCB7AD4E4C078C366AB586914BC7"><enum>(i)</enum><text>droughts are expected to increase the prices of fruits and vegetables by roughly 3 percent in 2015, which increases the economic burden of nutrition on low-income families;</text>
 </clause><clause id="id241AF2498B67417DA01D3C57C425B768"><enum>(ii)</enum><text>in California, farmworkers, of whom 92 percent identify as Latino and <fraction>3/4</fraction> earn less than 200 percent of the Federal poverty level, are projected to experience significant employment difficulties related to drought;</text>
 </clause><clause id="idEFF1487BD18745C49E4EB509E7D48D01"><enum>(iii)</enum><text>all of the Indian tribes in the State of Arizona and several Indian tribes in the States of New Mexico, Colorado, Utah, Nevada, and California have Indian reservations (as defined in section 3 of the Indian Financing Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/25/1452">25 U.S.C. 1452</external-xref>)) within the Colorado River watershed, which is predicted to be reduced by approximately 45 percent by 2050; and</text>
 </clause><clause id="idB1CFA72C46594BB6B62C24F6158574A9"><enum>(iv)</enum><text>approximately 30 percent of the people of the Navajo Nation—</text> <subclause id="id0F761F5E25DB44328C98C4FFF4FBA992"><enum>(I)</enum><text>are not served by municipal water systems; and</text>
 </subclause><subclause id="id1F508E2D26454618A7EA06242E7E9B9E"><enum>(II)</enum><text>risk severe water shortages due to worsening droughts caused by climate change; and</text> </subclause></clause></subparagraph><subparagraph id="id459B65054E7248DEB9BA5BB2D8A76063"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="id6143EDDCC3624184932D9FA6D3489E48"><enum>(i)</enum><text>sea level rise and erosion disproportionately impact low-income and minority communities;</text>
 </clause><clause id="idFFE07DD1426541BE8FBB959DAF4A2AF0" indent="up1"><enum>(ii)</enum><text>in 2008, the Comptroller General of the United States found that more than 86 percent of the 216 Alaska Native villages are already subject to flooding and erosion caused by increasing temperatures due to climate change; and</text>
 </clause><clause id="idD82D4AB088754FCF906F517453999A64" indent="up1"><enum>(iii)</enum><text>the land under the village of Newtok, Alaska, is eroding at the rate of 72 feet per year, which may require the village to move.</text>
 </clause></subparagraph></paragraph></section><section id="id9253F2C66A1749AFA0A8DD3D50D24A0C"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="id8BE39291B78F463A867371D088C8E57E"><enum>(1)</enum><header>Climate impacts</header><text>The term <term>climate impacts</term>—</text>
 <subparagraph id="idF86ACF8FB4B044D7802A77697C5D17B3"><enum>(A)</enum><text>means the damage to the health of human and natural environments, habitats, and the economy caused by factors including erratic climate and weather extremes due to excess carbon pollution in the atmosphere; and</text>
 </subparagraph><subparagraph id="id26DA5AB1BC7E4BB5A448051A8AC4A500"><enum>(B)</enum><text>includes—</text> <clause id="id112D0598DF1C4507A41B4888C9247708"><enum>(i)</enum><text>the increased frequency of—</text>
 <subclause id="id243858CAA5044150AE18801A6BF3E6B6"><enum>(I)</enum><text>extreme weather such as hurricanes, tornadoes, and snow storms;</text> </subclause><subclause id="id9A6AED0DA59B4E9F8619DF2B242178CE"><enum>(II)</enum><text>floods;</text>
 </subclause><subclause id="idF338955E3598481BA6392F4B655ED9C5"><enum>(III)</enum><text>wildfires;</text> </subclause><subclause id="id503CC128990142AB8DE2778AD313AEFA"><enum>(IV)</enum><text>droughts;</text>
 </subclause><subclause id="id08A0A333C47742CCA90C866067951B1C"><enum>(V)</enum><text>disease; and</text> </subclause><subclause id="idF381D94F86C64AB1A6CC959909F4874B"><enum>(VI)</enum><text>heat waves;</text>
 </subclause></clause><clause id="id2C6E333219DA4FCABE92DA1C7C41B3DD"><enum>(ii)</enum><text>sea level rise;</text> </clause><clause id="id766FC53A9D99405DB9692E3DDF1E04CA"><enum>(iii)</enum><text>ocean acidification; and</text>
 </clause><clause id="idD192869BB40643239B405F0D871DA4A5"><enum>(iv)</enum><text>altered—</text> <subclause id="idCA42EC665252483BA708CB79C49DBC94"><enum>(I)</enum><text>ecosystems and habitats; and</text>
 </subclause><subclause id="idB561A8BBEC6441C5B567AA804A27B858"><enum>(II)</enum><text>soil health and crop availability.</text> </subclause></clause></subparagraph></paragraph><paragraph id="idBF2C1966C60C461980F2332F6FCB5E76"><enum>(2)</enum><header>Climate justice resiliency project</header><text>The term <term>climate justice resiliency project</term> means a project, plan, fund, or other proposal to mitigate climate impacts on a climate resiliency hotspot community.</text>
 </paragraph><paragraph id="idAF352E2669284D44B445A16FA7B034AC"><enum>(3)</enum><header>Climate resiliency hotspot community</header><text>The term <term>climate resiliency hotspot community</term> means a community that is—</text> <subparagraph id="id411915E7535646BF9F721A34C4C5EC1B"><enum>(A)</enum><text>likely to experience climate impacts;</text>
 </subparagraph><subparagraph id="idEB6023F59115413283A748C65173EC14"><enum>(B)</enum><text>traditionally unable to afford the management or mitigation of climate impacts; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2FBBFD91EB95474B84BB0F099AB56E03"><enum>(C)</enum><text>likely to receive a high score in the report described in section 204(h).</text>
 </subparagraph></paragraph><paragraph id="idA72685348C254DBFAFF96CB8D5A3799A"><enum>(4)</enum><header>Council</header><text>The term <term>Council</term> means the Climate Justice Resiliency Council established by section 203(a).</text> </paragraph><paragraph id="id9C8CE691D1CB4181930C5C0F6CBE4FBE"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
 <subparagraph id="idAC89F661FCFF4504B0F8971B18F583E5"><enum>(A)</enum><text>a State;</text> </subparagraph><subparagraph id="idA7F454423039483294D2301DA13EDE64"><enum>(B)</enum><text>an Indian tribe;</text>
 </subparagraph><subparagraph id="id56D0B7617DD34E55B3D9684C78847008"><enum>(C)</enum><text>a territory;</text> </subparagraph><subparagraph id="idEDE1970CF0334CDD95218ED4A7D36AC3"><enum>(D)</enum><text>a municipality;</text>
 </subparagraph><subparagraph id="id5811994A2DA7499BA540C9EC867836A5"><enum>(E)</enum><text>a county;</text> </subparagraph><subparagraph id="id1C55F5EFBD8646B0A8450060A5681CD2"><enum>(F)</enum><text>a locality;</text>
 </subparagraph><subparagraph id="id74C805E6F4484751B1F85FB2FA249617"><enum>(G)</enum><text>a native Hawaiian community; and</text> </subparagraph><subparagraph id="id8FEABB8E7BFA4B53B60BBFC513036E55"><enum>(H)</enum><text>a nonprofit community organization.</text>
 </subparagraph></paragraph><paragraph id="id110A5D41B4194F829E16D5FA2BFA9311"><enum>(6)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
					</paragraph></section><section id="id3B7A3431E861461D91947148B80A7D5A"><enum>203.</enum><header>Climate Justice Resiliency Council</header>
 <subsection id="id922535ED4C5D4F5492CDDF497DEA07A0"><enum>(a)</enum><header>Establishment</header><text>There is established within the Environmental Protection Agency, a council to be known as the <quote>Climate Justice Resiliency Council</quote>.</text> </subsection><subsection id="id88271E6612F74E93A8DB9C6BA242A04F"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of—</text>
 <paragraph id="id3520293B9044449FA24097C838F2F243"><enum>(1)</enum><text>the Administrator, who shall serve as the Chairperson of the Council;</text> </paragraph><paragraph id="id94D727FA5CA64F1DB2EF7A5FC4A03D61"><enum>(2)</enum><text>the Secretary of Health and Human Services;</text>
 </paragraph><paragraph id="id6D31A6D4B63746C3B79947A1EB32000B"><enum>(3)</enum><text>the Secretary of Housing and Urban Development;</text> </paragraph><paragraph id="idBCD9BA8D65A84098A3C256FC26D388D0"><enum>(4)</enum><text>the Secretary of Agriculture;</text>
						</paragraph><paragraph id="idFED371FB75C446E89A99F9BDB2D0D5B5"><enum>(5)</enum>
 <text>the Secretary of Transportation;</text> </paragraph><paragraph id="idA4EC287C83D0412881998AD281DF10D3"><enum>(6)</enum><text>the Director of the Office of Science and Technology Policy;</text>
 </paragraph><paragraph id="id66E9E544EF48410D8CC35FFB005E0C89"><enum>(7)</enum><text>the Secretary of Energy;</text> </paragraph><paragraph id="idF4031BC8A1834818ACFA5F9121C4D15E"><enum>(8)</enum><text>the Secretary of Labor; and</text>
 </paragraph><paragraph id="id8461BA2A87A349B2A0013692A48110EF"><enum>(9)</enum><text>the Secretary of the Interior.</text> </paragraph></subsection><subsection id="id68AEBDAA01AF4EA59D6CDE20E2EF5A0D"><enum>(c)</enum><header>Activities</header><text>The Administrator, in consultation with the Council, may promulgate regulations to carry out the Climate Justice Resiliency Grant Program under section 204.</text>
					</subsection></section><section id="id03BA79FDA9EF41818D9C0F21D95319C6"><enum>204.</enum><header>Climate Justice Resiliency Grant Program</header>
 <subsection id="idA9924D00771E46FB8B9B81832AB63560"><enum>(a)</enum><header>In general</header><text>The Administrator, in consultation with the Council, shall establish a Climate Justice Resiliency Grant Program to provide block grants to eligible entities with the goal of promoting climate justice resiliency projects described in subsection (f).</text>
					</subsection><subsection id="id5FF8CFC09A6B43488CA77C8E65BCF6DF"><enum>(b)</enum><header>Environmental justice study</header>
 <paragraph id="idD5FE5BD606854356B0DB86EAC0C4AF0A"><enum>(1)</enum><header>In general</header><text>To facilitate administration of grants under this section, not later than 1 year after the date of enactment of this Act, the Council shall conduct a county-by-county or equivalent regional or tribal environmental justice study to identify climate resiliency hotspot communities.</text>
 </paragraph><paragraph id="idFB5D186892EA4119B0CBFB69964790E0"><enum>(2)</enum><header>Requirements</header><text>The study described in paragraph (1)—</text> <subparagraph id="id1EA90D58BDC445FF81D305F28C218B60"><enum>(A)</enum><text>shall be conducted in consultation with—</text>
 <clause id="id8170CA25725644798EB243837CB7CD75"><enum>(i)</enum><text>climate resiliency hotspot communities; and</text> </clause><clause id="id707D6E89624B434D9BA7FA080C4966D3"><enum>(ii)</enum><text>communities that are likely to receive a high score in the report described in subsection (h);</text>
 </clause></subparagraph><subparagraph id="idAE652C6421424AE095F1B56B5B4F7CBD"><enum>(B)</enum><text>shall identify localities based on geographical proximity to climate impacts, socioeconomic, public health, and environmental hazard criteria; and</text>
 </subparagraph><subparagraph id="id1268C13DCF0B4EB2B342259DF0443CAD"><enum>(C)</enum><text>may include an area—</text> <clause id="id0B4D84E24BD5492BBB1A32FA92488394"><enum>(i)</enum><text>that is disproportionately affected by climate impacts or other hazards that lead to negative public health effects, exposure, or environmental degradation;</text>
 </clause><clause id="idF5CD05E46957466EA103692961F052EA"><enum>(ii)</enum><text>with a concentration of individuals who have—</text> <subclause id="id99A622E43BF147A3B70088B40F47F59D"><enum>(I)</enum><text>a low income;</text>
 </subclause><subclause id="id76F2FEDE2CFF4084A8A787CCEC553BF5"><enum>(II)</enum><text>high unemployment;</text> </subclause><subclause id="idAEE908DAAA9444DA9C7BA0061B5CB9A3"><enum>(III)</enum><text>a low level of homeownership;</text>
 </subclause><subclause id="id58620A21AA4A4AA28EFC272D0BF4A4C2"><enum>(IV)</enum><text>a high rent burden;</text> </subclause><subclause id="id7AFE16AD019C4005B34043187B23B244"><enum>(V)</enum><text>a low level of educational attainment; or</text>
 </subclause><subclause id="id3ED56EA94A9540FFA86880E0F3816620"><enum>(VI)</enum><text>a disproportionate health burden; or</text> </subclause></clause><clause id="id49222D33666D431CB74068688D80F8CA"><enum>(iii)</enum><text>with a climate-sensitive population.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="id9F5E5519A9CC4050835F1209637B50D7"><enum>(c)</enum><header>Eligibility for grant funds</header>
						<paragraph id="id429078DD2F0F45AC8E91D149B0E45BA1"><enum>(1)</enum><header>Multi-year plan</header>
 <subparagraph id="idD89CE8D8C3E24F8CB1FCFF0549F32386"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Council a plan for a climate justice resiliency investment for not less than 5 years that describes climate justice resiliency projects to be prioritized based on the study carried out under subsection (b).</text>
 </subparagraph><subparagraph id="idF440C783601A4F4384E74B94FBEDA43B"><enum>(B)</enum><header>Contents</header><text>The multi-year plan described in subparagraph (A) shall include—</text>
 <clause id="id0F648DCCF94D4E42B90F63901173A158"><enum>(i)</enum><text>a description of—</text> <subclause id="id120B12BA351A423C8C303E35C02852E9"><enum>(I)</enum><text>the proposed climate justice resiliency project; and</text>
 </subclause><subclause id="idDF5647F34D3D4E60A640A2C1323F02A1"><enum>(II)</enum><text>the climate resiliency hotspot communities intended to benefit from the proposed climate justice resiliency project;</text>
 </subclause></clause><clause id="id024D82E0718D4492AD25784E85EB5A15"><enum>(ii)</enum><text>the expected climate resiliency improvement benefits; and</text> </clause><clause id="id9B4399F8C51948DB8B5B682DBF72D0B3"><enum>(iii)</enum><text>a funding level request.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idEFCBA7C78C6447749A14A071B3C0FF04"><enum>(d)</enum><header>Application process</header><text>The Council shall establish application requirements for participation in the Climate Justice Resiliency Grant Program.</text>
 </subsection><subsection id="id391EC1554F8D42BC890515F6B3351395"><enum>(e)</enum><header>Grant funds</header><text>The Administrator, in consultation with the Council, shall award to eligible entities grant funds commensurate with the duration and scope of the proposed climate justice resiliency project.</text>
					</subsection><subsection id="idC6B0AB3BF1714D238439032339820462"><enum>(f)</enum><header>Climate justice resiliency projects</header>
 <paragraph id="id06DDE15086E54E90B1A5B87AFDF73A59"><enum>(1)</enum><header>In general</header><text>An eligible entity may use grant funds made available in accordance with subsection (a) for a climate justice resiliency project, including—</text>
 <subparagraph id="idF25E1DBEFBE54B2F88C16009052EDEA2"><enum>(A)</enum><text>a project relating to—</text> <clause id="idD62BCC59D5AA4A3D89F9A7DF31DA03E8"><enum>(i)</enum><text>climate impact disaster adaptation and planning;</text>
 </clause><clause id="idD40EF925EF5A4C2EBD658356BB49E26D"><enum>(ii)</enum><text>wetland restoration;</text> </clause><clause id="idDB230106C2A941BC81AC2CD7500ABBBA"><enum>(iii)</enum><text>mine reclamation;</text>
 </clause><clause id="idF589FE2AC4F9498189AF855769E01DA8"><enum>(iv)</enum><text>a seawall, levee, or other coastal flood mitigation effort;</text> </clause><clause id="idCA00B33EE4ED41D287243F40E17FD6D3"><enum>(v)</enum><text>the development of—</text>
 <subclause id="id63CB41388FBE49B788D1DF54F45C76A7"><enum>(I)</enum><text>a community evacuation plan;</text> </subclause><subclause id="id5EC53D6C72094BED9E3D0FC42DF65909"><enum>(II)</enum><text>resources for safe and complete evacuation;</text>
 </subclause><subclause id="id6A730BA328484870A3F1021BA984349B"><enum>(III)</enum><text>a community plan for returning after an evacuation; or</text> </subclause><subclause id="id4F0F506A3CE44276A80D2A53A2CCACAF"><enum>(IV)</enum><text>a plan and funding for the relocation of Indian tribes in the event of a climate impact disaster;</text>
 </subclause></clause><clause id="id6B1F12BEAA6846F5833693B24358CFFB"><enum>(vi)</enum><text>brownfields redevelopment;</text> </clause><clause id="id4E64CBB41F134A13979CD6A4E158402C"><enum>(vii)</enum><text>rural water and waste disposal;</text>
 </clause><clause id="id313DD8F88F794ADEADCE049D50A128E7"><enum>(viii)</enum><text>lead and asbestos hazard reduction in homes with high flood, hurricane, or sea level rise exposure risk;</text>
 </clause><clause id="id5CE3DD3FDB834AB2A4141CC8C6DEBAD2"><enum>(ix)</enum><text>flood mapping, planning, and adaptation;</text> </clause><clause id="id40D90E415A5F41AE9D644674B3D97E77"><enum>(x)</enum><text>public transportation;</text>
 </clause><clause id="idBC9CED2E26F64E5D96D9DCF2E892DC61"><enum>(xi)</enum><text>vehicle traffic emissions exposure reduction;</text> </clause><clause id="id41AF4928A79E409BA6FF33329B69768C"><enum>(xii)</enum><text>a road or bridge that facilitates disaster evacuation;</text>
 </clause><clause id="id72C1F542C57F4C24854B9F9B5FCE2698"><enum>(xiii)</enum><text>a local food cooperative or market;</text> </clause><clause id="id8CB6F16A9CD247E5B36BCBDB1BA02358"><enum>(xiv)</enum><text>public sewage;</text>
 </clause><clause id="idFEA69C7663E64851ADCD0839EA4E7564"><enum>(xv)</enum><text>broadband Internet;</text> </clause><clause id="id160314FAD1C94AEABF6379FC7D9E19FF"><enum>(xvi)</enum><text>a microgrid;</text>
 </clause><clause id="idCDD9DA9AE8F84163BB301AFDEFA7E46B"><enum>(xvii)</enum><text>air conditioning units for low-income housing; or</text> </clause><clause id="id8C6D8692D51E4E609F6EA96CFB8FFE17"><enum>(xviii)</enum><text>emergency communication infrastructure;</text>
 </clause></subparagraph><subparagraph id="id2D8F7E2AFD874137B92FC6BE38CDDDB7"><enum>(B)</enum><text>a fund established to assist evacuees to return home after an evacuation; or</text> </subparagraph><subparagraph id="idDCB31F04EC5F43B38B133336DF07600C"><enum>(C)</enum><text>a disaster loan.</text>
 </subparagraph></paragraph><paragraph id="idD30898C9F4ED48C981E79D1CA9EE8444"><enum>(2)</enum><header>Exclusions</header><text>An eligible entity shall not use funds made available in accordance with subsection (a) for an activity relating to—</text>
 <subparagraph id="idC2318BF62F8C4AF6A3C263AD8A895593"><enum>(A)</enum><text>the generation of electricity;</text> </subparagraph><subparagraph id="id73E9AB51EC4C4610A96EBDAE193E11D4"><enum>(B)</enum><text>carbon capture or sequestration; or</text>
 </subparagraph><subparagraph id="idEA4A6D798193481080E0183F0E74B557"><enum>(C)</enum><text>a highway.</text> </subparagraph></paragraph></subsection><subsection id="idBD80C72F74FD4B1EB8D3487881006852"><enum>(g)</enum><header>Cost-Sharing requirement</header><text>The Council—</text>
 <paragraph id="id26A413868BB84DB9B59E5E3B21D50B3D"><enum>(1)</enum><text>shall require eligible entities that receive funds under this section to enter into a cost-sharing agreement for, at a minimum, 20 percent of the total cost of the proposed climate justice resiliency project; and</text>
 </paragraph><paragraph id="id4DB796328D7F492B856366665785FC50"><enum>(2)</enum><text>may, at the discretion of the Council, waive the cost-sharing requirement described in paragraph (1).</text>
 </paragraph></subsection><subsection id="idE3B7F9061A4D408DA87060A8E3D09263"><enum>(h)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of enactment of this Act, the Council shall submit to the appropriate committees of Congress a report that describes—</text>
 <paragraph id="id3FCE2AF88FA74A9D922ED9E4EEB56857"><enum>(1)</enum><text>in detail the manner in which this section has been carried out; and</text> </paragraph><paragraph id="id8B6C56CB71F94394A77F0710E58EEC24"><enum>(2)</enum><text>the results of the study carried out under subsection (b), including a score for each locality studied based on the level of climate impacts experienced by the locality.</text>
 </paragraph></subsection><subsection id="idE84E74E5327045D0864125B31E840B0B"><enum>(i)</enum><header>Funding</header><text>Notwithstanding any other provision of law, on October 1, 2016, and on each October 1 thereafter, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Administrator for the cost of grants to carry out this section $20,000,000,000, to remain available until expended.</text>
					</subsection></section><section id="id18F07995A284430E9B3E9FC736729866"><enum>205.</enum><header>Low-income and municipal energy efficiency</header>
					<subsection id="id52E8EEE2F16E4FFE9CD513F9617549DB"><enum>(a)</enum><header>Weatherization Assistance Program</header>
 <paragraph id="id82EC6F3F704F45AFAAAAD937379AB28C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Part A of title IV of the Energy Conservation and Production Act is amended by striking section 422 (<external-xref legal-doc="usc" parsable-cite="usc/42/6872">42 U.S.C. 6872</external-xref>) and inserting the following:</text>

 <section id="id317CAF6D1AA14990A37749824C1134D1" section-type="subsequent-section"><enum>211.</enum><header>Ending toxic air pollution from incinerators</header><text display-inline="no-display-inline">Section 129(g) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7429">42 U.S.C. 7429(g)</external-xref>) is amended—</text>
 <paragraph id="id5E0E59ED9B8C4E419A3F618CFDBBF15D"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), (4), (5), and (6) as paragraphs (7), (5), (1), (4), and (2), respectively;</text>

 </clause><clause id="idD79AE3317B984C77A9AA9618C60E3376"><enum>(iv)</enum><text>paper;</text> </clause><clause id="idE120ABE0197A4AFBAEC2E9C14D52B76E"><enum>(v)</enum><text>paper or cardboard recycling residuals, including—</text>
 <subclause id="id83C12588D0814BE38BABD872CDE6AD04"><enum>(I)</enum><text>paper-derived fuel cubes;</text> </subclause><subclause id="idDBF651E6250E4A7F9BB061B937DE8910"><enum>(II)</enum><text>paper fines; and</text>
 </subclause><subclause id="id8111568B1B49410C994C559A159F5E58"><enum>(III)</enum><text>paper and cardboard rejects;</text> </subclause></clause><clause id="id890F165D568B489EB23BC41D3C361BCB"><enum>(vi)</enum><text>construction and demolition debris;</text>
 </clause><clause id="id5B983BC71523457BA189F962B6468AD8"><enum>(vii)</enum><text>animal—</text> <subclause id="id8F87C54ABB694D779166081F5C329F31"><enum>(I)</enum><text>manure; and</text>
 </subclause><subclause id="idD852B39DA1C44E4AB86CF6E0698BE9BE"><enum>(II)</enum><text>bedding material;</text> </subclause></clause><clause id="id04D804F95EE14BB7AE2ED0C08EB1579A"><enum>(viii)</enum><text>any plastic;</text>
 </clause><clause id="id1DCE9AAE353644FBB04CF6341124DBB1"><enum>(ix)</enum><text>non-hazardous solvents;</text> </clause><clause id="id621C1D1E12124840AF911CB976B13922"><enum>(x)</enum><text>residue from wet and dry pollution control systems;</text>
 </clause><clause id="id9066F075713F43BF8ADA6C8ED1CE537B"><enum>(xi)</enum><text>automotive shredder residue or fluff;</text> </clause><clause id="id6472344B092E47CDB0A087492685422D"><enum>(xii)</enum><text>wood, including railroad ties and utility poles, that is—</text>
 <subclause id="id05EB880523B244D789D99290F3C249B4"><enum>(I)</enum><text>creosote-treated;</text> </subclause><subclause id="idED961BC8B402467E91E0339D40BE99FC"><enum>(II)</enum><text>borate-treated;</text>
 </subclause><subclause id="id739589A5ED87465EAB6C06E7E38976A1"><enum>(III)</enum><text>sap-stained; or</text> </subclause><subclause id="id9779B0FA74B94CB4A8643C85852736FD"><enum>(IV)</enum><text>otherwise treated;</text>
 </subclause></clause><clause id="idC48BEC9A2CFE498AA4CC30FA3283B22E"><enum>(xiii)</enum><text>any material derived or processed from any material described in clauses (i) through (xii); and</text> </clause><clause id="id68FA7394FA2D47E49D348877C7941234"><enum>(xiv)</enum><text>any material derived or processed from municipal waste.</text>
 </clause></subparagraph><subparagraph id="id3D1080BBD0AB4E7DA0856583615FC869"><enum>(B)</enum><header>Regulatory definition</header><text>The Administrator shall ensure that all regulations of the Administrator define the term <quote>solid waste</quote> in a manner consistent with subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section></subtitle></title><title id="id9DF991B6BF964C4EA57DF3F435A31D72" style="OLC"><enum>III</enum><header>Protecting and enhancing United States manufacturing</header> <section id="id8FA091B30DE94542834EF9805AC55749"><enum>301.</enum><header>Carbon equivalency fee border adjustments for carbon pollution-intensive goods</header> <subsection id="idc999a0abc8fe471ab55c988b71c2966f"><enum>(a)</enum><header>In general</header><text>There is imposed on each person importing a carbon pollution-intensive good into the United States a fee in an amount that is equal to the cost that a producer of a good that is comparable to the carbon pollution-intensive good (as determined by the Secretary of the Treasury, in consultation with the Administrator, the Secretary of State, and the Secretary of Energy) and is produced in the United States incurs as a result of—</text>
 <paragraph commented="no" id="id3e8f93cbcdc64545a227bbf2c61a2b86"><enum>(1)</enum><text>any fee imposed under section 196 of the Clean Air Act, as added by section 101 of this Act—</text> <subparagraph commented="no" id="id4D5BD3246B5743F38ED8C002545849B3"><enum>(A)</enum><text>paid by the producer of the comparable good with respect to a carbon-polluting substance used in the production of the comparable good; or</text>
 </subparagraph><subparagraph commented="no" id="idF0CB7FA85D35417D90C9FD6C3B2C462B"><enum>(B)</enum><text>paid by a person that imported a carbon-polluting substance used in the production of the comparable good; and</text>
 </subparagraph></paragraph><paragraph id="id38370370f0cd4420b23d8e2aa3210b82"><enum>(2)</enum><text>any fee imposed under this subsection paid by a person that imported a carbon pollution-intensive good that was used in the production of the comparable good.</text>
					</paragraph></subsection><subsection id="id0a66b32bcd454b5aaeec9b31c071c396"><enum>(b)</enum><header>Determination of fee amount</header>
 <paragraph id="id680F621260DC4737BA359A9DB0669439"><enum>(1)</enum><header>In general</header><text>In determining the amount of the fee imposed under subsection (a) with respect to a carbon pollution-intensive good, the Secretary of the Treasury shall—</text>
 <subparagraph id="id44610144186944779a2811dffc8615c7"><enum>(A)</enum><text>determine the amount of the fee annually; and</text> </subparagraph><subparagraph id="idC63749E89FA14D16B71A0FD5C3F183AA"><enum>(B)</enum><text>determine different amounts for such goods—</text>
 <clause id="id47D37D2929CC47F989D975D442ACE178"><enum>(i)</enum><text>based on class of good and country of origin; and</text> </clause><clause id="id1C1754677984482EB6EB2A2046C24134"><enum>(ii)</enum><text>taking into account the quantity of greenhouse gas emissions released during the process of manufacturing such goods and transporting such goods from the country of origin to the United States.</text>
 </clause></subparagraph></paragraph><paragraph id="ide4768cf2690143ca89842bb9fb88b1db"><enum>(2)</enum><header>Petitions for adjustment</header><text>The Secretary of the Treasury shall establish a process for petitioning for adjustment of the fee imposed under subsection (a).</text>
 </paragraph></subsection><subsection id="id8535f3e0a4064c3f90e2728c5075de26"><enum>(c)</enum><header>Termination</header><text>The fee imposed under subsection (a) shall cease to apply with respect to goods imported from a country at such time as, and to the extent that—</text>
 <paragraph id="id8ebcb20e0368412fa80ea9a9f53e11bc"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD96C4F6F52984380BD9EBE6A2502D48F"><enum>(A)</enum><text>in the case of a country that adopts and ratifies an international agreement requiring countries that emit greenhouse gases and produce carbon pollution-intensive goods for exportation to adopt substantially equivalent measures, that agreement takes effect; or</text>
 </subparagraph><subparagraph id="id25ADC48636544772AA3CDE34FD1DF18C" indent="up1"><enum>(B)</enum><text>in the case of a country that has not adopted and ratified such an agreement, the country has implemented substantially equivalent measures, as determined by the President; and</text>
 </subparagraph></paragraph><paragraph id="id7c092d21cbbb418ab86a1a35733f475b"><enum>(2)</enum><text>the Secretary of the Treasury determines that the application of the fee with respect to imports from that country is no longer appropriate.</text>
 </paragraph></subsection><subsection id="idBC6F7ED855534B5597E409602F052580"><enum>(d)</enum><header>Regulations</header><text>The Secretary of the Treasury, in consultation with the Administrator, the Secretary of Commerce, and the Secretary of Energy, shall prescribe such regulations as are necessary to carry out this section.</text>
 </subsection><subsection id="id0896FDD421674805B66A04F49D268299"><enum>(e)</enum><header>Definitions</header><text>In this section, the terms <term>carbon pollution-intensive good</term> and <term>substantially equivalent measure</term> have the meanings given those terms in section 194 of the Clean Air Act, as added by section 101 of this Act.</text>
				</subsection></section><section id="idFB4735CA027E4B5EBDAC85523163C85B"><enum>302.</enum><header>Carbon equivalency fee fund</header>
 <subsection id="ide9544e444e3e491b8da6caac75fb9287"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a fund, to be known as the <quote>Carbon Equivalency Fee Fund</quote> (in this section referred to as the <quote>Fund</quote>).</text> </subsection><subsection id="id06c3e37afcc6455ba1ce73d08315a043"><enum>(b)</enum><header>Deposits to fund</header><text>In each fiscal year, there shall be deposited in the Fund amounts collected from fees imposed under section 301(a).</text>
 </subsection><subsection id="id798516c8c3f34012aa53768172af6780"><enum>(c)</enum><header>Expenditures</header><text>Amounts deposited in the Fund shall be available without further appropriation in a fiscal year, as follows:</text>
 <paragraph id="id3660b618195140148020fe76eee2ff3d"><enum>(1)</enum><text>The lesser of $150,000,000, or 5 percent of amounts in the Fund, shall be made available to the Secretary of Commerce for the Hollings Manufacturing Extension Partnership under section 25 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k</external-xref>).</text>
 </paragraph><paragraph id="ide19f8f3aad69457a886def83450a0fd2"><enum>(2)</enum><text>Twenty percent of such amounts shall be made available to the Secretary of Energy, to be used, in consultation with the Secretary of Commerce, for activities of the Advanced Manufacturing Office of the Office of Energy Efficiency and Renewable Energy.</text>
 </paragraph><paragraph id="id31c71ebe1de545ec831927eb2fa7929f"><enum>(3)</enum><text>Thirty percent of such amounts shall be made available to the Secretary of Energy for the State Energy Program, to be used exclusively by energy offices of States and territories to promote energy efficiency projects at industrial facilities within the jurisdiction of such States and territories.</text>
 </paragraph><paragraph id="id0063afb57208438591ca73c768ec0011"><enum>(4)</enum><text>Any of such amounts remaining after distributions under paragraphs (1), (2), and (3) shall be made available to the Secretary of Energy for industrial energy efficiency programs authorized under part E of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6341">42 U.S.C. 6341 et seq.</external-xref>) or subtitle D of title IV of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; 121 Stat. 1623).</text>
					</paragraph></subsection></section></title><title id="idAB30B9D0B1274E5C947EE070B0AAC0E4" style="OLC"><enum>IV</enum><header>Protecting agriculture and enhancing farm opportunities</header>
 <section id="idA3F2FFF6209D4FE697F87EB667BD88FD"><enum>401.</enum><header>Rural Energy for America Program</header><text display-inline="no-display-inline">Section 9007(g) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107(g)</external-xref>) is amended—</text>
 <paragraph id="id6644D7A5657945FBB1907677BC1DA423"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="idA216C7062C2B4B88AA6E66F6AA369C81"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text>
 </subparagraph><subparagraph id="idF76938551FD6416584D63B50CF89A786"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>year 2014 and each fiscal year thereafter.</quote> and inserting <quote>years 2014 and 2015; and</quote>; and</text> </subparagraph><subparagraph id="idD4621ABC9AE44C4293F419B6ED476C82"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6B6666249D414A6FB9E0D04DEAEB3B6C" style="OLC">
 <subparagraph id="id7134D531B4304DA888A24507196F0AFC"><enum>(F)</enum><text>$500,000,000 for fiscal year 2016 and each fiscal year thereafter.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="id7C3AF3E690B4470DAEACCEF7EF00465C"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text>
 </paragraph><paragraph id="idF24CFD6B0BDA4B449656816319F2AB7E"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="idE3DF0657BABE42578DC8CC81CA4241F7" style="OLC"> <paragraph id="id0C09C1274AA9444EB5C387619094A96C"><enum>(3)</enum><header>Biodigester funding</header><text>Of the funds made available for each fiscal year under paragraph (1)(F), not less than $30,000,000 shall be used to support the deployment of biodigesters—</text>
 <subparagraph id="id63A62125BF3141E5BBDA91FFBA471586"><enum>(A)</enum><text>as part of a manure management strategy to reduce methane emissions; and</text>
 </subparagraph><subparagraph id="id6294F980FE6B4BA79FCCBB3AF9B0BA50"><enum>(B)</enum><text>in a manner that includes safeguards to maintain or improve local air quality.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="id4A4DE7AB10F34E6BA92AC9A02FF5A65E"><enum>402.</enum><header>Soil quality improvement</header><text display-inline="no-display-inline">Chapter 2 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3838">16 U.S.C. 3838 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id86D76351B1814D469751180BD918FE1B" style="OLC">
					<subchapter id="id65706CA1298B45CB9EA9248CB3A21D6C" style="OLC"><enum>C</enum><header>Soil quality improvement program</header>
						<section id="idABD3171BC1204EF895CF03598C7DD6F8"><enum>1238H.</enum><header>Soil Quality Improvement Program</header>
							<subsection id="idD988614AB2034136BE6E7AC1402B45AD"><enum>(a)</enum><header>No-Till farm equipment grant and loan program</header>
 <paragraph id="idCA78A3FFDD64442F9F61927993A23607"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish, in the Natural Resources Conservation Service, a program to provide grants and loans to agricultural producers with the goal, not later than January 1, 2026, of increasing to 50 percent the total percent of farmed acres in the United States under continuous no-till cultivation.</text>
 </paragraph><paragraph id="id27CED4CFD85D4C48B6E808F46E58B604"><enum>(2)</enum><header>Grants</header><text>The Secretary shall use not less than 20 percent of the funds made available for the program established under paragraph (1) to make grants.</text>
 </paragraph><paragraph id="id4813C0472DA74CE197E1FCAB7CD74A90"><enum>(3)</enum><header>Purchase or lease of equipment</header><text>An agricultural producer may use funds made available under this section to finance or otherwise incentivize the purchase or lease of equipment necessary to carry out continuous no-till cultivation, as determined by the Secretary.</text>
 </paragraph><paragraph id="idA6B3DC0E3BE04F66BF0F85F40E670E64"><enum>(4)</enum><header>Education and outreach</header><text>In establishing the program under this section, the Secretary shall include an education and outreach program, carried out by the Secretary in coordination with—</text>

 </subparagraph><subparagraph id="id6D3FF5CA3C1C4EBB84AD03606929BDA0"><enum>(E)</enum><text>the Soil and Water Conservation Society; and</text> </subparagraph><subparagraph id="id56DF4CBE76774A78B58E2008315C2B4C"><enum>(F)</enum><text>the Agricultural Tri-Societies.</text>
 </subparagraph></paragraph></subsection><subsection id="idCC8155D2327E4360B636A227E99181B0"><enum>(b)</enum><header>Report on soil carbon uptake</header><text>Not later than 1 year after the date of enactment of this subchapter, the Secretary shall publish a report that includes—</text>
 <paragraph id="id183D74A3A6414038938B63D122802F24"><enum>(1)</enum><text>methodologies and protocols for tracking practices (including conservation tillage, continuous no-till cultivation, and the use of cover crops) that increase the uptake of carbon into soils, including—</text>
 <subparagraph id="id66500B608C3E460BA6727BF9533B8C92"><enum>(A)</enum><text>the use of satellite-based and other remote sensing technologies; and</text> </subparagraph><subparagraph id="id1B4371318D044DE2BD1ED637DBF0920F"><enum>(B)</enum><text>methods for monitoring net carbon transfer rates between soils and the atmosphere, including biogeochemical process models; and</text>
 </subparagraph></paragraph><paragraph id="idB0F5BC6ED26245EC8A464EE8CEB4CB9E"><enum>(2)</enum><text>an assessment of—</text> <subparagraph id="id6CC7DB7B47EE41CA80114C66C47644D2"><enum>(A)</enum><text>carbon stocks in United States soils as of the date of the report;</text>
 </subparagraph><subparagraph id="id1D3B36E55ADE479CAEB8071168B92DD8"><enum>(B)</enum><text>the potential for United States soils as a reservoir for carbon;</text> </subparagraph><subparagraph id="id117460F080C045279E3809E7BAB12E48"><enum>(C)</enum><text>the net mass transfer rate of carbon between soils and the atmosphere on agricultural land and rangeland, including—</text>
 <clause id="id04E91B6A1A2F49DDA3737ED17B1122A0"><enum>(i)</enum><text>conservation tillage land;</text> </clause><clause id="idF22B59C5059C490FA7CFA0740E51AAAC"><enum>(ii)</enum><text>no-till cultivated land; and</text>
 </clause><clause id="id0CED0BF83231483CB19A124A8DA30921"><enum>(iii)</enum><text>land on which cover crops are used in rotation; and</text> </clause></subparagraph><subparagraph id="id84CE114922CB4F5399007B9EA9980BBD"><enum>(D)</enum><text>rangeland management practices that increase soil carbon sequestration.</text>
 </subparagraph></paragraph></subsection><subsection id="id3879E3169D6944CB9DC3E24231ED2E3A"><enum>(c)</enum><header>Environmental quality incentives program</header><text>The Chief of the Natural Resources Conservation Service shall carry out a soil carbon uptake initiative within the environmental quality incentives program established under chapter 4 of this subtitle to foster the adoption and sustained use of practices that increase the amount and the rate of carbon uptake in soils.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id7AB0FFB0A8994474A58227CC64BE4885"><enum>(d)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $300,000,000 for fiscal year 2016 and each fiscal year thereafter, to remain available until expended.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idE8511644FC68481088190D9C1DC38CF4"><enum>403.</enum><header>Nitrous oxide emissions reductions</header>
 <subsection id="idB2C43A378D494DA1896ACC1D6479D86C"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="idB6163934863842F1AA924982A599A2D9"><enum>(1)</enum><text>fertilizer is a significant cost input in many agricultural operations;</text>
 </paragraph><paragraph id="idCE256092CAE64EB585310980DB02D993"><enum>(2)</enum><text>opportunities exist for agricultural producers—</text> <subparagraph id="id7C72CB1A50F440288FB224E1ACBD3CEA"><enum>(A)</enum><text>to reduce the amount of fertilizer inputs; and</text>
 </subparagraph><subparagraph id="id8FE0D3E54CF2426186DEC16033591F16"><enum>(B)</enum><text>to increase the efficiency of fertilizer use through the development of more effective fertilizer application protocols that maximize the uptake of fertilizer by crops while maintaining or increasing yields; and</text>
 </subparagraph></paragraph><paragraph id="idF9B0884CE25542F68647FD7DCEC881E6"><enum>(3)</enum><text>improving the application of nitrogen fertilizers at the correct rate, in the correct manner, at the correct time, and in the correct place will provide significant benefits to the environment, including reductions of—</text>
 <subparagraph id="id6AFAF53C7EEA4EE9B9F103A72DE1FE4B"><enum>(A)</enum><text>nitrogen runoff, which will improve water quality; and</text> </subparagraph><subparagraph id="idF1D9541DBF85436AA995C58B1AA7DCBB"><enum>(B)</enum><text>emissions of nitrous oxide, a powerful greenhouse gas associated with climate change.</text>
 </subparagraph></paragraph></subsection><subsection id="idA5927DC79B8B4F7D943AD011EFE66861"><enum>(b)</enum><header>Nitrous oxide emissions reductions</header><text>Chapter 5 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb et seq.</external-xref>) is amended by adding at the end the following:</text>

						<section id="id5FCA23287CAF460BA1D8FCE09417DDDD"><enum>1240S.</enum><header>Nitrous oxide emissions reductions</header>

								<paragraph id="id75F67BC8AEBD4F4EA70EDD38C97D0473"><enum>(1)</enum><header>Federally  funded research data</header>
 <subparagraph id="idF914D861D212428A97510B423E5765C4"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall make available all relevant data relating to fertilizer application in a format that is—</text>
 <clause id="id65C182072CC145DFA70A81D12B1093E5"><enum>(i)</enum><text>aggregated so as not to divulge proprietary or confidential business information; and</text> </clause><clause id="id2A168AD9692149DCB300B7C534404A39"><enum>(ii)</enum><text>searchable and accessible to the public, including, to the maximum extent possible, all federally funded research data, including data of—</text>
 <subclause id="idDBE6DA780B93450D9576A62315749AF1"><enum>(I)</enum><text>the Department of Agriculture; and</text> </subclause><subclause id="id8BD384FABAC74A1CA5A215813F657413"><enum>(II)</enum><text>land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)).</text>
 </subclause></clause></subparagraph><subparagraph id="id33BAFA5DB87B4A43AB25A3B333919C01"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to the release of data or information in a format that may divulge proprietary or confidential business information.</text>
 </subparagraph></paragraph><paragraph id="id684A0527DE594BFD892BBA5BE74D43E8"><enum>(2)</enum><header>Non-federally funded research data</header><text>The Secretary shall develop incentives to encourage the sharing of non-federally funded research data relating to fertilizer application, including data from—</text>
 <subparagraph id="idC351B730392F42E4A87F468F7D6A8449"><enum>(A)</enum><text>research funded through a State program; and</text> </subparagraph><subparagraph id="id50118DAAF4AD443B8592947C5488846E"><enum>(B)</enum><text>independent or privately held research.</text>
									</subparagraph></paragraph></subsection><subsection id="idC0BA0B30CEB34CAC87984AAFBCBA5990"><enum>(b)</enum><header>Nitrogen uptake pilot program</header>
 <paragraph id="idF81E35B26A3847B8923EAF1355A11281"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish and carry out a 5-year pilot program for the development and optimization of nitrogen fertilizer application rates, timing, location, and formulation for—</text>
 <subparagraph id="id617E5C49332A455BA3982706B7A786F3"><enum>(A)</enum><text>corn;</text> </subparagraph><subparagraph id="id6E893C7846E44D7AA8E375655FEC1965"><enum>(B)</enum><text>soybeans;</text>
 </subparagraph><subparagraph id="id506648E04C7848F2AB118A6F10CF5DB8"><enum>(C)</enum><text>wheat;</text> </subparagraph><subparagraph id="id9CF35BF448404B498D4181E4303357B5"><enum>(D)</enum><text>barley;</text>
 </subparagraph><subparagraph id="idBB0CC8573BFD47AD9A342420C270183E"><enum>(E)</enum><text>cotton;</text> </subparagraph><subparagraph id="id128B05DCC29142E9B5927F280D13ADFE"><enum>(F)</enum><text>oats;</text>
 </subparagraph><subparagraph id="idD4F6C72E5B9B476BBA23BD6011C5503B"><enum>(G)</enum><text>sorghum;</text> </subparagraph><subparagraph id="idF57DC549315C41DABD41093AEEC3A4AF"><enum>(H)</enum><text>rice; and</text>
 </subparagraph><subparagraph id="id0F2FAB080B5249D8A0BAA4B8A1FDEF8F"><enum>(I)</enum><text>potatoes.</text> </subparagraph></paragraph><paragraph id="idC4CB744AD32C4B01958F8BCF9D6F067F"><enum>(2)</enum><header>Requirements</header><text>The pilot program described in paragraph (1) shall—</text>
 <subparagraph id="idC5A6B3189DC746F4833A27241C35C429"><enum>(A)</enum><text>consist of projects in a diverse range of—</text> <clause id="idE8E0BA4EBB6447DF9CC2E76100BE2513"><enum>(i)</enum><text>geographies;</text>
 </clause><clause id="id3EBC8A6E39134F59BFF02132310DF85B"><enum>(ii)</enum><text>soil types;</text> </clause><clause id="idB113FBC2B8624F708886F593E7E87F11"><enum>(iii)</enum><text>drainage conditions;</text>
 </clause><clause id="idF134C093833E4036933D964427D159E0"><enum>(iv)</enum><text>tillage practices; and</text> </clause><clause id="idDBB3906CC917455E959933F4DCC4069D"><enum>(v)</enum><text>climatic conditions; and</text>
 </clause></subparagraph><subparagraph id="id6C16C93E0B8B4C078E98DDE81B45DE5E"><enum>(B)</enum><text>consider—</text> <clause id="id1519420F619F4C8B8C06FF33D23F176B"><enum>(i)</enum><text>the effect of crop rotation;</text>
 </clause><clause id="id968D7D24C0164CF1BA4BCD8D6DFFA98D"><enum>(ii)</enum><text>the use of cover crops;</text> </clause><clause id="id58F31DE23E3B45FA9080272B11326752"><enum>(iii)</enum><text>the use of soil amendments; and</text>
 </clause><clause id="idFBC62ADD51654032AFECA452482BA0FD"><enum>(iv)</enum><text>any other factor that the Secretary determines to be appropriate—</text> <subclause id="id721BCC7459614BF7B8E10DCE9D3F716A"><enum>(I)</enum><text>to enhance the optimization of fertilizer application practices that reduce the generation of nitrous oxide and leached nitrogen; and</text>
 </subclause><subclause id="idD9BF434E8B00471E9409129B1AAF6160"><enum>(II)</enum><text>to support high agricultural yields.</text> </subclause></clause></subparagraph></paragraph></subsection><subsection id="idB6EDC84D6E624231BD1E6EB683BAD2B2"><enum>(c)</enum><header>Environmental quality incentives program</header><text>The Chief of the Natural Resources Conservation Service shall carry out a nitrous oxide reduction initiative within the environmental quality incentives program established under chapter 4 of this subtitle to foster the adoption and continued use of fertilizer application protocols that reduce the production of nitrous oxide associated with the use of nitrogen fertilizer.</text>
 </subsection><subsection commented="no" id="id9D90E660F6514A99AD70FA2CD01BADB8"><enum>(d)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $150,000,000 for fiscal year 2016 and each fiscal year thereafter, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection id="id8F04BC17A05642B794C0A6160467618A"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>) is amended—</text> <paragraph id="id824d880f18964ddb849dbbbdc139e1df"><enum>(1)</enum><text>in paragraph (17)(C)—</text>

 </paragraph><paragraph id="id8c35bc08332b48e78ac9d504038b33d7"><enum>(31)</enum><header>Demand response energy resource</header><text>The term <term>demand response energy resource</term> means a resource bid into an organized wholesale market or sold to an electricity utility service provider that includes—</text>
 <subparagraph id="idd86f653f0e6d4257a9c3c0144e4cb5d8"><enum>(A)</enum><text>a direct load control program that provides the ability for power companies to cycle air conditioners and water heaters on and off during periods of peak demand in exchange for a financial incentive and lower electric bills; or</text>
 </subparagraph><subparagraph id="id4d50863352064c48b37a1b8b1c870fd3"><enum>(B)</enum><text>time-of-use pricing that—</text> <clause id="id862787DD8B4A4406878D9920AEA761A3"><enum>(i)</enum><text>may account for locational benefit;</text>
 </clause><clause id="id7780B08103294D36B32EAADFF325B853"><enum>(ii)</enum><text>is provided on an unbundled basis after—</text>
 <subclause id="id5F86703617374CE38A4A1AF9047994FC"><enum>(I)</enum><text>accounting for the 2-way valuation of time-of-use rates; and</text> </subclause><subclause id="id56783CA3F9B448C48239E64306C8355E"><enum>(II)</enum><text>progressing to real-time pricing; and</text>
 </subclause></clause><clause id="idC3D8C71C515446DF914195CC21F6FEF5"><enum>(iii)</enum><text>is provided for—</text> <subclause id="id9f060a74f7be47d79e3d314e2780fe49"><enum>(I)</enum><text>energy sold to an electric utility;</text>
 </subclause><subclause id="id80870bed66d64efc842d3c10bf793043"><enum>(II)</enum><text>energy purchased from an electric utility;</text> </subclause><subclause id="id4d69745363b54d73a014f6c5ca1d56e3"><enum>(III)</enum><text>capacity;</text>
 </subclause><subclause id="id2b94a6b56b9d4ea0a5abf5fed063b73d"><enum>(IV)</enum><text>energy conservation;</text> </subclause><subclause id="id85c7473cf0084d79bc18b335a79bc93b"><enum>(V)</enum><text>demand-side management or demand response;</text>
 </subclause><subclause id="id90c50c0691a1419abf1379c00effa0be"><enum>(VI)</enum><text>peak monthly demand; or</text> </subclause><subclause id="id1d51cb5ea4d84edda1f73824331c741b"><enum>(VII)</enum><text>the provision of ancillary services.</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="id53A30444293E46B08A6EB2AB6D79EA27"><enum>(32)</enum><header>Electric utility service</header><text>The term <term>electric utility service</term> means the safe and reliable provision of end-use electricity.</text> </paragraph><paragraph id="ida20cb6fbf08c4bceb5557bee5e07d54a"><enum>(33)</enum><header>Organized market</header><text>The term <term>organized market</term> means an auction-based day-ahead and real-time wholesale market—</text>
 <subparagraph id="id17D70A01FA1E469BAB5826C691170D1B"><enum>(A)</enum><text>in which a single entity may—</text> <clause id="idE92B804993F544AF8227EE5B59BC9CA3"><enum>(i)</enum><text>receive 1 or more offers to sell, or bids to buy, electric energy or ancillary services from 1 or more sellers, or buyers, respectively; and</text>
 </clause><clause id="idDEE265E179CE496C958CD4576BBDB5A8"><enum>(ii)</enum><text>determine which sales and purchases are completed, and at what prices, based on formal rules contained in tariffs approved by the Commission; and</text>
 </clause></subparagraph><subparagraph id="id2E806F7322574880940AB769C06EED6B"><enum>(B)</enum><text>the prices of which are used by transmission organizations for establishing transmission usage charges set by the Federal Energy Regulatory Commission.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id79bed72a9f824e96bd7e7f2bc4bec186"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5384DE93B9A1463B8C7FA98556FA0625" style="OLC">
 <section id="idD870CCB0C83A4B8DA0C08CC07A0B93B4"><enum>34.</enum><header>Wholesale demand response</header><text display-inline="no-display-inline">The Commission shall require that sellers and aggregators of demand response energy resources be permitted to participate in any organized market on terms that are—</text>
 <paragraph id="idA604DD816C6D4FFFB2B4F5AFD1BE76AF"><enum>(1)</enum><text display-inline="yes-display-inline">comparable to terms applicable to sellers of electric capacity or energy; and</text>
 </paragraph><paragraph id="id5AAE6B6A32FD43478B5292A5AA31894F"><enum>(2)</enum><text display-inline="yes-display-inline">just, reasonable, and not unduly discriminatory.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="ide0b6a8a990514a37948bd2eb87f9d3c7"><enum>502.</enum><header>General right to neutrality of interconnection</header>
 <subsection id="id55743AC95BB04BBAB199A3DACBDB16C4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Public Utility Regulatory Policies Act of 1978 is amended by inserting after section 4 (<external-xref legal-doc="usc" parsable-cite="usc/16/2603">16 U.S.C. 2603</external-xref>) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idFCB9953C11CC4ABBAB2CE5A8F1028067" style="OLC">
						<section id="id608B1748E95B45BBB05BA4B2B346E4D7"><enum>5.</enum><header>General right to neutrality of interconnection</header>
 <subsection id="idFD80D6CC163D44AE9C0BB8D25F29BE37"><enum>(a)</enum><header>In general</header><text>Demand response energy resources (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)) shall have a general right of interconnection under this Act on terms comparable to the terms available to a seller of electric capacity or energy.</text>
 </subsection><subsection id="idA38BE02BD0AB4D6E9CC9E185FF3F3A32"><enum>(b)</enum><header>Rate and fees</header><text>All rates and fees for interconnection of demand response energy resources under this Act, regardless of whether the demand response energy resource is a qualifying facility—</text>
 <paragraph id="idA4757D97EF604517A34C99424EE77CCD"><enum>(1)</enum><text>shall be just and reasonable;</text> </paragraph><paragraph id="id3252931D6E324DB399ACBE4F96EE1C2E"><enum>(2)</enum><text>shall provide for the 2-way benefit, as required by the Federal Energy Regulatory Commission, for the demand response energy resource and the electricity grid;</text>
 </paragraph><paragraph id="id462676E1AF5A4C3790D4EABC1EAE4772"><enum>(3)</enum><text>shall not exceed the actual cost of service, including reasonable return on investment; and</text> </paragraph><paragraph id="idC6FEE59F9C9F47BC92754A01F565F0D2"><enum>(4)</enum><text>shall not be punitive.</text>
 </paragraph></subsection><subsection id="id7F1DB42076CF4881A219D53D3587F265"><enum>(c)</enum><header>Timeframes</header><text>Timeframes for interconnection of demand response energy resources under this Act, regardless of whether the demand response energy resource is a qualifying facility, shall be well-defined, expeditious, not unduly protracted, and comparable to the timeframes available to a seller of electric capacity or energy.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="iddd9389f13a5e4a759f7fbfb2e52c9032"><enum>(b)</enum><header>Improved interconnection standards for demand response energy resources</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB0FFCE3FB7E943818EAC92E63A426FB6" style="OLC">
 <paragraph id="id8F0C073EC5BF4287B221F53D398EEF87"><enum>(20)</enum><header>Demand response energy resources</header><text display-inline="yes-display-inline">Each State regulatory authority or nonregulated electric utility shall consider requiring that demand response energy resources (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)) be eligible to receive just and reasonable energy and rate treatment for—</text>
 <subparagraph id="id2a2db7808fe6435b978dc951d791e11a"><enum>(A)</enum><text>the societal value of demand response energy resources; and</text> </subparagraph><subparagraph id="ida6e58f0d353143c0b26054b86ebf5e5d"><enum>(B)</enum><text>any other benefits of demand response energy resources that the State regulatory authority or nonregulated electric utility considers to be appropriate.</text>
 </subparagraph></paragraph><paragraph id="id70080695553f447bba969c7b63b3e7ee"><enum>(21)</enum><header>Improved interconnections standards for demand response energy resources</header><text>Each State regulatory authority or nonregulated electric utility, acting under State authority in a State that has determined not to establish standards under paragraph (20), shall consider—</text>
 <subparagraph id="id8032b9cc309e4ad9957617808cabf853"><enum>(A)</enum><text>removing discriminatory rate barriers for demand response energy resources by setting rates that exceed the incremental cost of alternative electric energy for purchases from any demand response energy resource (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)) that is, under this Act, a qualifying facility interconnected with—</text>
 <clause id="id737bb7b4bf544e0cbbb1bb2db3a416f5"><enum>(i)</enum><text>the rates to be established at the full retail rate; and</text> </clause><clause id="id591ca65cb7f448d18f7448369537c8e9"><enum>(ii)</enum><text>fixed monthly charges for residential electricity bills to be established at a charge of not more than 10 dollars per month, with optional reevaluations by the State authority of the amount of charge to be considered on a periodic basis;</text>
 </clause></subparagraph><subparagraph id="id08e65a0a67e34cd39f63b2531f50a2bb"><enum>(B)</enum><text>making any demand response energy resource project exempt from filing requirements with the Commission;</text>
 </subparagraph><subparagraph id="id55274239fc134bc2bc6c01f15f19060e"><enum>(C)</enum><text>ensuring that any requirements considered under this paragraph would not affect the purchase obligation under section 210 for demand response energy resource facilities; and</text>
 </subparagraph><subparagraph id="idea5422c04bd343c0aaffb0277dcf05b0"><enum>(D)</enum><text>requiring that all rates and fees for interconnection of demand response facilities—</text> <clause id="id2a258ebe66e249eea5fd9d433f5cf1f8"><enum>(i)</enum><text>shall be just and reasonable;</text>
 </clause><clause id="id1794e01146954925802876f3a3073ccc"><enum>(ii)</enum><text>shall provide for the benefit of the demand response energy resource to the electricity grid and benefit of the electricity grid to the demand response energy resource; and</text>
 </clause><clause id="id858416bb880a4adba412d7cba9e55f16"><enum>(iii)</enum><text>shall not exceed the actual cost of service.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section></title></legis-body> </bill>
