		<official-title>To amend title 23, United States Code, to reform the surface transportation project delivery
			 program. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surface Transportation Project Delivery Program Improvement Act</short-title></quote>.</text>
		</section><section id="id2A77E57197EA4DD7BF01303DE1FE92D0"><enum>2.</enum><header>Surface transportation project delivery program improvement</header>
 <subsection id="id87F93F75D1BC48809D5095B32A530903"><enum>(a)</enum><header>Written agreement</header><text>Section 327(c) of title 23, United States Code, is amended—</text> <paragraph id="id7BF68D9BE8CF488984E6F3063BAFC2BC"><enum>(1)</enum><text>in paragraph (3)(A), by inserting <quote>, and is solely responsible and liable for carrying out those responsibilities</quote> after <quote>subsection (a)</quote>; and</text>
 </paragraph><paragraph id="id64AF61E7AC23475D9E2B57CC23C8B2EF"><enum>(2)</enum><text>in paragraph (4), by inserting <quote>reasonably</quote> before <quote>considers necessary</quote>.</text> </paragraph></subsection><subsection id="id59FA9465C91F4BBFA084689A5046514E"><enum>(b)</enum><header>Effect of assumption of responsibility</header><text>Section 327(e) of title 23, United States Code, is amended—</text>
 <paragraph id="id5895DF6E5ECF454D8C0A4561EA2FCBF8"><enum>(1)</enum><text>by inserting <quote>and without further approval of</quote> after <quote>in lieu of</quote>; and</text> </paragraph><paragraph id="idB289E188577E413AB6845C561AB2AC67"><enum>(2)</enum><text>by inserting <quote>(including the defense of any civil action under subsection (d))</quote> after <quote>assumed under subsection (a)(2)</quote>.</text>
 </paragraph></subsection><subsection id="id1D065FD041B3465F8CF1A3A24A21B85A"><enum>(c)</enum><header>Audits</header><text>Section 327(g) of title 23, United States Code, is amended—</text> <paragraph id="id6B9A4D701454414CA461265665CBEB87"><enum>(1)</enum><text>in paragraph (1), by striking <quote>shall conduct</quote> and all that follows through the end of subparagraph (B) and inserting the following: “shall—</text>
					<quoted-block display-inline="no-display-inline" id="idA0DA3ECFF7734A73B54F730068C4E474" style="OLC">
 <subparagraph id="id74E4F9470A0D4006BC9CEEF03EFDECF5"><enum>(A)</enum><text>not later than 180 days after the date of execution of an assignment agreement under this section, meet with the State to review implementation of the assignment agreement and discuss plans for the first annual audit;</text>
 </subparagraph><subparagraph id="id71CBA9DB0FC9477E9D4E9FE078923AA1"><enum>(B)</enum><text>conduct annual audits during each of the first 4 years of State participation; and</text> </subparagraph><subparagraph id="idC514797A34E04558A600654F6DA60BE3"><enum>(C)</enum><text>ensure that the time period for completing an annual audit, from initiation to completion (including public comment and responses to those comments), does not exceed 180 days.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id3B03BD77A79F490ABC18D0D8367BC540"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idC7BF3A27FDCE4C31A47B5EA253C18A51" style="OLC"> <paragraph id="id4C4246D16EB44253B613EFABC0C281ED"><enum>(3)</enum><header>Audit team</header> <subparagraph id="id8535A9F741FB41A8A2C6D588C2315E6A"><enum>(A)</enum><header>In general</header><text>An audit conducted under paragraph (1) shall be carried out by an audit team determined by the Secretary, in consultation with the State, in accordance with subparagraph (B).</text>
 </subparagraph><subparagraph id="id8C08459C622448A4B296991AE2E093B3"><enum>(B)</enum><header>Consultation</header><text>Consultation with the State under subparagraph (A) shall include a reasonable opportunity for the State to review and provide comments on the proposed members of the audit team.</text>
							</subparagraph><subparagraph id="id14AD041293874C4DBB9B15AFF5E01FB4"><enum>(C)</enum><header>State designation</header>
 <clause id="idB3592D6AD4AA43088939539930288D5B"><enum>(i)</enum><header>In general</header><text>On request by the State, the audit team shall include not less than 1 member designated by the State, in consultation with the Secretary.</text>
 </clause><clause id="idB9CAEBD30C744771B955F6F6EAB13939"><enum>(ii)</enum><header>Criteria</header><text>A member designated by the State under clause (i) may be any person with relevant expertise and experience who is not an employee of the Secretary or of the State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id9BE4D65CE6244E46ABA8A6A6E54D0CC2"><enum>(d)</enum><header>Capacity building</header><text>Section 327 of title 23, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idEF8B85D2154F45CE8DDE00CAA51BB881" style="OLC"> <subsection id="idE35AB74EA7F94E2792FE4B610F49E2C8"><enum>(k)</enum><header>Capacity building</header><text>The Secretary, in cooperation with the American Association of State Highway and Transportation Officials, shall carry out education, training, peer exchange, and other initiatives, as appropriate—</text>
 <paragraph id="id4C90D37339344A8AA7F8D5F83B201904"><enum>(1)</enum><text>to assist States in developing the capacity to participate in the assignment program under this section; and</text>
 </paragraph><paragraph id="id48970C17CD974A5E9CADE53594C408C3"><enum>(2)</enum><text>to promote information sharing and collaboration among States that are participating in the program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
