		<official-title>To amend title 10, United States Code, relating to enlistment and consequences of certain service
			 in the Armed Forces, and for other purposes.</official-title>

 <section id="id9D12507019DC4E3289DC8154A8D96CCC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Enlistment Opportunity Act of 2015</short-title></quote>.</text> </section><section id="id5C4039AC1E94425F9BD94964369B389B" section-type="subsequent-section"><enum>2.</enum><header>Qualifications for enlistment in the Armed Forces</header> <subsection id="H6907FE4EAC3B410EAF257BBB739D2F7E"><enum>(a)</enum><header>Additional qualified persons</header><text display-inline="yes-display-inline">Paragraph (1) of subsection (b) of section 504 of title 10, United States Code, is amended—</text>
 <paragraph id="H41A165F58EA0488A802D885F7E096A75"><enum>(1)</enum><text>by redesignating subparagraph (C) as subparagraph (E); and</text>
 </paragraph><paragraph id="H45A1339644D046FBA2EC8100FE37387B"><enum>(2)</enum><text>by inserting after subparagraph (B) the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HCBD7941A0E694307B78BAAF3A0E1A478" style="OLC">
 <subparagraph id="HF3693822B1564D96BC446B8462DED134" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">An alien who, at the time of enlistment in an armed force, has resided continuously in a lawful status in the United States for at least two years.</text>
 </subparagraph><subparagraph id="H77D8A05C418E491A9E6B7D033C31E97B" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">A person who, at the time of enlistment in an armed force, possesses an employment authorization document issued by United States Citizenship and Immigration Services under the requirements of the Department of Homeland Security policy entitled <quote>Deferred Action for Childhood Arrivals</quote> (DACA).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF293BB177A334A42B8CF5F89D011C6ED"><enum>(b)</enum><header>Admission to
 Permanent Residence of Certain Enlistees</header><text>Such section is further amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HACA19E191DC5461D80A4D8FD19B872A4" style="OLC">
					<subsection id="H4FAB09F8AE4A49D8A72E9A3685DC95C9"><enum>(c)</enum><header>Admission to
 permanent residence of certain enlistees</header><paragraph commented="no" display-inline="yes-display-inline" id="HBF6CEB658C8D448AAB349FE849EE050D"><enum>(1)</enum><text display-inline="yes-display-inline">A person described in subsection (b) who, at the time of enlistment in an armed force, is not a citizen or other national of the United States or lawfully admitted for permanent residence shall be adjusted to the status of an alien lawfully admitted for permanent residence under the provisions of section 249 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1259">8 U.S.C. 1259</external-xref>), except that the alien need not—</text>
 <subparagraph id="HCD7979B636AE4A539C49035C2D493F2E" indent="up1"><enum>(A)</enum><text>establish that he or she entered the United States prior to January 1, 1972; and</text>
 </subparagraph><subparagraph id="H783D6C325E634031A703F7B946914175" indent="up1"><enum>(B)</enum><text>comply with section 212(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="HB4E364C761424C9C85B811E01D8A4F43" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall rescind the lawful permanent resident status of a person whose status was adjusted under paragraph (1) if the person is separated from the armed forces under other than honorable conditions before the person served for a period or periods aggregating five years. Such grounds for rescission are in addition to any other provided by law. The fact that the person was separated from the armed forces under other than honorable conditions shall be proved by a duly authenticated certification from the armed force in which the person last served. The service of the person in the armed forces shall be proved by duly authenticated copies of the service records of the person.</text>
 </paragraph><paragraph id="H779C9472B80F47949C76B0AD12CDAE80" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to alter the process prescribed by sections 328, 329, and 329A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1439">8 U.S.C. 1439</external-xref>, 1440, 1440–1) by which a person may naturalize through service in the armed forces.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H92D7AF4BCF95488DAFF93FBFD9EE98F8"><enum>(c)</enum><header>Clerical
			 amendments</header>

 heading</header><text display-inline="yes-display-inline">The heading of such section is amended to read as follows:</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idDAB43E79691E4A00952FE06851C4259D" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Treatment of certain persons as having
			 satisfied English and civics, good moral character, and honorable service
			 and
			 discharge requirements for naturalization</header>
			<subsection commented="no" display-inline="no-display-inline" id="H8510955E462241918AB7405925ED512C"><enum>(a)</enum><header display-inline="yes-display-inline">Immigration and Nationality
 Act</header><text display-inline="yes-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after section 329A (<external-xref legal-doc="usc" parsable-cite="usc/8/1440-1">8 U.S.C. 1440–1</external-xref>) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF359DB405B0B4175A69255B7413C32CB" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H565EE428186743AEAA5A1BBB4DE44740" section-type="subsequent-section"><enum>329B.</enum><header display-inline="yes-display-inline">Persons who have received an award for
				engagement in active combat or active participation in combat</header>
						<subsection commented="no" display-inline="no-display-inline" id="HA4811CA5AD794AF68322449DE6DA1E02"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id3DF887EAA80E4F6DBC79CF1A309E6D33"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of naturalization and continuing citizenship under the following provisions of law, a person who has received an award described in subsection (b) shall be treated—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H8726D2689B1C4D6783D3CB7F8915890B"><enum>(A)</enum><text display-inline="yes-display-inline">as having satisfied the requirements under sections 312(a) and 316(a)(3), and subsections (b)(3), (c), and (e) of section 328; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H39BA84FC4DE641D1AD907DCA0A1E6C97"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), under sections 328 and 329—</text>
 <clause commented="no" display-inline="no-display-inline" id="id1CFB4D0FBBB14FB091ABB885307A1206"><enum>(i)</enum><text display-inline="yes-display-inline">as having served honorably in the Armed Forces for (in the case of section 328) a period or periods aggregating 1 year; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idBA5ED8CD4CAC4DE9B012AA99A58BF8F5"><enum>(ii)</enum><text display-inline="yes-display-inline">if separated from such service, as having been separated under honorable conditions.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFBAD0FBF5BB436E90FFC451AC333E10"><enum>(2)</enum><header display-inline="yes-display-inline">Revocation</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1)(B), any person who separated from the Armed Forces under other than honorable conditions may be subject to revocation of citizenship under section 328(f) or 329(c) if the other requirements under such section are met.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H35B76A061DCA49AA8ACD691CFFAC4F6F"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">This section shall apply with respect to the following awards from the Armed Forces of the United States:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H7B9F18234D8540D39D29223C36B26568"><enum>(1)</enum><text display-inline="yes-display-inline">The Combat Infantryman Badge from the Army.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEA854533DF964575AC00A11BD165316C"><enum>(2)</enum><text display-inline="yes-display-inline">The Combat Medical Badge from the Army.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H673B93E1E108425AAB371796923AF915"><enum>(3)</enum><text display-inline="yes-display-inline">The Combat Action Badge from the Army.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE04A75E0D1FE41C9A014DCD63D336F5B"><enum>(4)</enum><text display-inline="yes-display-inline">The Combat Action Ribbon from the Navy, the Marine Corps, or the Coast Guard.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4A36407F4BFA45E1B26128D4386C3045"><enum>(5)</enum><text display-inline="yes-display-inline">The Air Force Combat Action Medal.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H353EC7D61D4249499A0BB419E44D3F2C"><enum>(6)</enum><text display-inline="yes-display-inline">Any other award that the Secretary of Defense determines to be an equivalent award for engagement in active combat or active participation in combat.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HF1A8B0D16D2C40B6A84C2753548070E3"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 329A the following:</text>
