 <section id="id9054F8AEC1384D249D61FA13A0C20ED8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Targeted Employment Areas Improvement Act</short-title></quote>.</text> </section><section id="idF2F8FCB25B0E40419DDD144DEC0AEA1D" section-type="subsequent-section"><enum>2.</enum><header>Targeted employment areas</header><text display-inline="no-display-inline">Section 203(b)(5)(B) (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(5)(B)</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idEA8ADD27A4044DF38CB4C9B66F23D864" style="OLC">
				<subparagraph id="id6a72981db35143f59a301135125a3176"><enum>(B)</enum><header>Set aside for targeted employment areas</header>
 <clause id="id5d6ee1ca40414830803f904135c3eeca"><enum>(i)</enum><header>In general</header><text>Not fewer than 5,000 of the visas made available under this paragraph in each fiscal year shall be reserved for qualified immigrants who invest in a new commercial enterprise described in subparagraph (A) that—</text>
 <subclause id="id51529bb42ec6450baf9720088f4b485a"><enum>(I)</enum><text>is investing such capital in a targeted employment area; and</text> </subclause><subclause id="id6398529643bf4e15a4bd6fa8b2ecc2da"><enum>(II)</enum><text>will create employment in such targeted employment area.</text>
						</subclause></clause><clause id="id0f7c99712af64f1a882c9605025797c3"><enum>(ii)</enum><header>Duration of targeted employment area designation</header>
 <subclause id="id39DF215E63BB4957A1F0E06FBD659334"><enum>(I)</enum><header>In general</header><text>A designation of a high unemployment area as a targeted employment area—</text> <item id="idFE19B048764748B5B3D8B32436D437B7"><enum>(aa)</enum><text>shall be valid for 5 years; and</text>
 </item><item id="idEE288C4AA2834C35A7F50993150CFE95"><enum>(bb)</enum><text>may be renewed for additional 5-year periods if the area continues to meet the definition of high unemployment area under clause (iii).</text>
 </item></subclause><subclause id="id1A1B4A590D09455E8D0AFDF15CBB49D8"><enum>(II)</enum><header>Effect of designation expiration</header><text>An investor who makes the required investment under this paragraph in a targeted employment area shall not be required to increase the amount of such investment upon the expiration of such designation.</text>
 </subclause></clause><clause id="id4be45afd01674a659689f5f7c49671d7"><enum>(iii)</enum><header>Definitions</header><text>In this subparagraph:</text> <subclause id="idd969dfc1b10a49e692ebc7174f302772"><enum>(I)</enum><header>High unemployment area</header><text>The term <term>high unemployment area</term> means an area that—</text>
 <item id="id9FFD6534DAA24BAF9CCF366F0DBBD20B"><enum>(aa)</enum><text>consists of a census tract, or a group of census tracts that are economically integrated in light of commuter flow patterns based on Federal data sets, with an unemployment rate that is at least 150 percent of the national average unemployment rate; or</text>
 </item><item id="id2B83FE9E0FCD4A50A67C601CCFA0090E"><enum>(bb)</enum><text>is within the boundaries established for purposes of—</text> <subitem id="id4CB97E0062DA49BDA2779DC7C91F2711"><enum>(AA)</enum><text>a Federal or State economic development incentive program, including any area designated by the Federal Government or a State as an enterprise zone, a renewal community, a promise zone, or an empowerment zone; or</text>
 </subitem><subitem id="idA844AA2728794ECCBE79A81DC0164482"><enum>(BB)</enum><text>any Federal or State program designed to create jobs, start small businesses, or revitalize neighborhoods.</text>
 </subitem></item></subclause><subclause id="id0445db5ccc1b4b34bdedeb041dacbea2"><enum>(II)</enum><header>Rural area</header><text>The term <term>rural area</term> means—</text> <item id="idB3E2A96CEAF64962BBC0101D6B284E9A"><enum>(aa)</enum><text>any area other than an area within a metropolitan statistical area unless it is a town on the outer boundary of a metropolitan statistical area with a population of 20,000 or fewer residents (based on the most recent decennial census of the United States);</text>
 </item><item id="id49F2C1B246E34F03989FFF289A38EABE"><enum>(bb)</enum><text>any city or town having a population of fewer than 20,000 residents (based on the most recent decennial census of the United States) that is located within a State having a population of fewer than 1,500,000 residents (based on such census); or</text>
 </item><item id="id7045FD166F334AA5915F8B105CE0DFFF"><enum>(cc)</enum><text>any area located in a census tract of a metropolitan statistical area if the census tract has a population density of fewer than 500 people per square mile (based on such census).</text>
 </item></subclause><subclause id="id874261d4c69b4e02a35e6735a0578b63"><enum>(III)</enum><header>Targeted employment area</header><text>The term <term>targeted employment area</term> means a rural area, any community adversely affected by a recommendation by the Defense Base Closure and Realignment Commission, or a high unemployment area.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
