			 protections and disclosures for students and co-signers with respect to
			 student loans, and for other purposes.</official-title></form>

		<section id="H5A71AF417E2046C782DF2136B121B406" section-type="section-one"><enum>1.</enum><header>Short title;
			 Findings</header>
			<subsection id="H98EB2BA3C54A4E0F9EEC887CC135031E"><enum>(a)</enum><header>Short
 title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Christopher Bryski Student Loan Protection Act</short-title></quote> or <quote><short-title>Christopher’s Law</short-title></quote>.</text>
 </subsection><subsection id="H33610973A4014FDC95B1F5455FD21054"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text>
 <paragraph id="H5365D5654CF0414DBE8181A534D81F47"><enum>(1)</enum><text display-inline="yes-display-inline">According to the Bureau of Consumer Financial Protection (hereafter referred to as the <quote>CFPB</quote>) Student Loan Ombudsman:</text> <subparagraph id="HB402486346EE4C138215FF38042C81B5"><enum>(A)</enum><text><quote>The CFPB received more than 3,100 private student loan complaints and approximately 1,100 debt collection complaints related to student loans between October 1, 2014, and March 31, 2015.</quote>.</text>
 </subparagraph><subparagraph id="H2F4E5D3081EB4EB4B6AB8FA9A95126AF"><enum>(B)</enum><text><quote>Co-signers complain that information about discharge or alternative arrangements in the case of death of the primary borrower is not readily available and that decisions are made on a case-by-case basis, giving co-signers little understanding of how the process works, or if they will be successful.</quote>.</text>
 </subparagraph><subparagraph id="HA25C910AE69645E9AC4FD1C7F562A92F"><enum>(C)</enum><text><quote>The complaints and input received by the CFPB resemble many of the same issues experienced by mortgage borrowers, such as improper application of payments, untimeliness in error resolution, and inability to contact appropriate personnel in times of hardship.</quote>.</text>
 </subparagraph><subparagraph id="HA53EA0339F0C43849559A2905AF5D322"><enum>(D)</enum><text><quote>The difference between federal and private student loans in periods of disability was not well-understood.</quote>.</text>
 </subparagraph></paragraph><paragraph id="H02CFF88181F54BB6A6DB3487EF2A2DA9"><enum>(2)</enum><text>An estimated 1,700,000 people sustain a traumatic brain injury each year, with older adolescents aged 15 to 19 years old more likely to sustain a traumatic brain injury than other age groups.</text>
 </paragraph><paragraph id="HE6569454D6F44B54A802225019170549"><enum>(3)</enum><text display-inline="yes-display-inline">It has been estimated that the annual incidence of spinal cord injury, not including those who die at the scene of an accident, is approximately 40 cases per 1,000,000 people in the United States or approximately 12,000 new cases each year. These injuries can lead to permanent disability or loss of movement and can prohibit the victim from engaging in any substantial gainful activity.</text>
 </paragraph><paragraph id="HF1CB9987EE944A6D9FE31E5E4337417B"><enum>(4)</enum><text display-inline="yes-display-inline">According to the CFPB, more than 90 percent of new private student loans are co-signed.</text> </paragraph><paragraph id="id2242024980564827b832bddbbf46ce94"><enum>(5)</enum><text>According to the CFPB, private student loan companies provide co-signer release to less than 1 percent of eligible borrowers.</text>
				</paragraph></subsection></section><section id="H6476F3EDF05043768F268D42FA5C0E75"><enum>2.</enum><header>Additional
			 student loan protections</header>
			<subsection id="HC5BC88DF3A554C73AF457C020956C54A"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Section 140 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCCF4E2D986A5483A91C968727D112379" style="OLC">
					<subsection id="H6500428B52674EDAA43B4188BDEFB481"><enum>(g)</enum><header>Additional
				protections relating to borrower or co-Signer
			 of a
				private education loan</header>
						<paragraph id="H92CD975EBFA54BABBFC61BB10DC121A5"><enum>(1)</enum><header>Clear and
 conspicuous description of borrower’s and co-signer’s obligation</header><text display-inline="yes-display-inline">In the case of any private educational lender who extends a private education loan, the lender shall clearly and conspicuously describe, in writing, the co-signer’s obligations with respect to the loan, including the effect the death, disability, or inability to engage in any substantial gainful activity of the borrower or any co-signer would have on any such obligation, in language that the Bureau determines would give a reasonable person a reasonable understanding of the obligation being assumed by becoming a co-signer for the loan.</text>
						</paragraph><paragraph id="idCB93C18840F5457A9B7C29FE9FA97379"><enum>(2)</enum><header>Prohibition on automatic default with respect to a performing loan</header>
							<subparagraph id="id227672F888044CD7A686523638782A47"><enum>(A)</enum><header>Death,
 disability, or bankruptcy of co-signer</header><text>If a private education loan includes a co-signer, a private educational lender may not take any adverse action (including declaring a default, accelerating any loan obligation, increasing the interest rate, or altering any obligations under the private education loan in a way that is adverse to the borrower) against the borrower based on the death, disability, or inability to engage in any substantial gainful activity or bankruptcy of a co-signer.</text>
 </subparagraph><subparagraph id="id4e5062e9099b4037be8676595fe50929"><enum>(B)</enum><header>Death, disability, or bankruptcy of borrower</header><text>If a private education loan includes a co-signer, a private educational lender may not take any adverse action (including declaring a default, accelerating any loan obligation, increasing the interest rate, or altering any obligations under the private education loan in a way that is adverse to any co-signer) against the co-signer based on the death, disability, or inability to engage in any substantial gainful activity, or bankruptcy of the borrower.</text>
							</subparagraph></paragraph><paragraph id="id058999DE3BBC4C36AF3C28A6C8E2D2F0"><enum>(3)</enum><header>Co-signer release</header>
							<subparagraph id="id551FC9FAECA347F5982F70C3B059F3C9"><enum>(A)</enum><header>Requirements for automatic release of co-signer</header>
 <clause id="id3C4383AFF24F409DBF5BFB1B34ECEB12"><enum>(i)</enum><header>Criteria established by the Bureau</header><text>Not later than 180 days after the date of enactment of this subsection, the Bureau shall establish criteria, which if met by the borrower of a private education loan, the private educational lender or servicer of the private education loan shall promptly release any co-signer from the obligations of the co-signer under the loan without requiring any action on behalf of the borrower.</text>
 </clause><clause id="idDEDD29E8257D4216B80DC3BDBF0AA3EF"><enum>(ii)</enum><header>Criteria established by lender</header><text>A private educational lender may establish criteria for automatic release that are different from the criteria described in clause (i) if the criteria established by the lender are not more restrictive with respect to the borrower or any co-signer of the private education loan than the criteria established under clause (i).</text>
 </clause></subparagraph><subparagraph id="id022508E49FF34F5181BFDEF0CBC45FEE"><enum>(B)</enum><header>Disclosure of criteria for co-signer release</header><text>A private educational lender shall—</text> <clause id="id6FB9C3C5BA2341A5BCF70D292896E9BD"><enum>(i)</enum><text>include in the promissory note of a private education loan the criteria under which a co-signer may be released from the obligation of the co-signer under a private education loan under this subparagraph; and</text>
 </clause><clause id="idE0853348B39B4126B9F40280E0933281"><enum>(ii)</enum><text>disclose to the borrower and any co-signer at the time the private education loan is consummated, clearly and conspicuously, the criteria under which a co-signer may be released from the obligation of the co-signer under a private education loan.</text>
 </clause></subparagraph><subparagraph id="idC8DE161B337748FCB8EA6DD29FDF3BE1"><enum>(C)</enum><header>Modifications to criteria</header><text>The private educational lender, or servicer of a private education loan, as applicable, may not modify the criteria under which a co-signer may be released from the obligation of the co-signer under a private education loan if the modification would be adverse to the borrower without the consent of the borrower and applicable co-signer.</text>
 </subparagraph><subparagraph id="idADD4B90B9B1A4C659872FDC328016BBB"><enum>(D)</enum><header>Notification on release</header><text>A private educational lender, or servicer, as applicable, shall promptly notify the borrower and any co-signers for a private education loan if a co-signer is released from the obligations of the co-signer under the private education loan under this subparagraph.</text>
 </subparagraph><subparagraph id="idB9E73AEBD220481CA2F4660521F5CDC0"><enum>(E)</enum><header>Modification of evaluation of creditworthiness, credit standing, or credit capacity</header><text>In determining whether the criteria for a co-signer release are met, a private educational lender or servicer of a private education loan, as applicable, may not evaluate the creditworthiness, credit standing, or credit capacity of the borrower or a co-signer of the private education loan using a standard that would be more adverse to the borrower or co-signer, as applicable, than the standard the private educational lender used to evaluate the creditworthiness, credit standing, or credit capacity of the borrower or co-signer on the date on which the private education loan was consummated.</text>
							</subparagraph></paragraph><paragraph id="HA61BC14DB7694E769D5BC6769C48131E"><enum>(4)</enum><header>Designation of
 individual to act on behalf of the borrower</header><text display-inline="yes-display-inline">In the case of any private educational lender who extends a private education loan, the lender shall provide the borrower an option to designate an individual to have the legal authority to act on behalf of the borrower with respect to the private education loan in the event of the borrower’s death, disability, or inability to engage in any substantial gainful activity.</text>
 </paragraph><paragraph id="HF048107A72104132B5E640882FDC5E98"><enum>(5)</enum><header>Counseling</header><text display-inline="yes-display-inline">In the case of any private educational lender who extends a private education loan, the lender shall ensure that the borrower, and any co-signer, receives comprehensive information on the terms and conditions of the loan and of the responsibilities the borrower has with respect to such loan, including the information described under subparagraphs (H), (I), (K), (L), (M), and (N) of section 485(l)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(l)(2)</external-xref>).</text>
						</paragraph><paragraph id="HD3CF445404A046C98F1496FD4DDCDE53"><enum>(6)</enum><header>Model
 form</header><text>The Bureau shall publish a model form under section 105 for describing a co-signer’s obligation for purposes of paragraph (1).</text>
						</paragraph><paragraph id="HD418828A2F3641239D866868CF528453"><enum>(7)</enum><header>Definition of
				death, disability, or inability to engage in any substantial
			 gainful
 activity</header><text display-inline="yes-display-inline">For the purposes of this subsection with respect to a borrower or co-signer, the term <term>death, disability, or inability to engage in any substantial gainful activity</term>—</text>
 <subparagraph id="HB2F6CDE7554B41F4A1D22D4CC816C1DD"><enum>(A)</enum><text>means any condition described in section 437(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(a)</external-xref>); and</text>
 </subparagraph><subparagraph id="HA8FBCB7EE58849BC93DBF901CA9A717D"><enum>(B)</enum><text display-inline="yes-display-inline">shall be interpreted by the Bureau in such a manner as to conform with the regulations prescribed by the Secretary of Education under section 437(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(a)</external-xref>) to the fullest extent practicable, including safeguards to prevent fraud and abuse.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE5B6D30E5E9449528224F10E3FA0F64D"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Subsection (a) of section 140 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(a)</external-xref>) is amended—</text>
 <paragraph id="H8A58E965986E485DA20B83558CAD0767"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (8) as paragraphs (2) through (9), respectively; and</text>
 </paragraph><paragraph id="H6E6078AFF0FF4222B20C678037BDC6B8"><enum>(2)</enum><text>by inserting before paragraph (2) (as redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB2198BC78E2D413F98188D3ECCBEB5A6" style="OLC">
 <paragraph id="H26929D4266284121AC61F450D2D32EB6"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>co-signer</term>—</text> <subparagraph id="H5FCABB220FCB498789F5FF7F143D3BBE"><enum>(A)</enum><text>means any individual who is liable for the obligation of another without compensation, regardless of how designated in the contract or instrument;</text>
 </subparagraph><subparagraph id="H775AF7D7026C405C94398AA6477C75CE"><enum>(B)</enum><text>includes any person whose signature is requested as condition to grant credit or to forbear on collection; and</text>
 </subparagraph><subparagraph id="H02065B8058A443E29CFF60EE3EF883B5"><enum>(C)</enum><text>does not include a spouse of an individual referred to in subparagraph (A) whose signature is needed to perfect the security interest in the loan;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HCB333243FB594606AA7FF64400B073DE"><enum>(c)</enum><header>Rulemaking</header><text>Not later than the end of the 1-year period following the date of the enactment of this Act, the Bureau of Consumer Financial Protection shall issue regulations to carry out section 140(g) of the Truth in Lending Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H2739B0B7709741FDAD7DBEE6E56FCA30" section-type="subsequent-section"><enum>3.</enum><header>Federal student
			 loans</header>
			<subsection id="HB0418F53CF9245628385895E80004244"><enum>(a)</enum><header>Counseling
 information</header><text display-inline="yes-display-inline">Section 485(l)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(l)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3EC15B18A2454388AA2294B5C1CE155E" style="OLC">
 <subparagraph commented="no" id="H90FBBD4D89D140AEB05A5D70A2AD5A38"><enum>(L)</enum><text display-inline="yes-display-inline">Information on the conditions required to discharge the loan due to the death, disability, or inability to engage in any substantial gainful activity of the borrower in accordance with section 437(a).</text>
 </subparagraph><subparagraph id="HD408C83F320C427EB2825823D95C7DF9"><enum>(M)</enum><text display-inline="yes-display-inline">Any repayment, refinance, deferment, forbearance, or forgiveness opportunities available to the borrower, or co-signer, in the event of either individual’s death, disability, or inability to engage in any substantial gainful activity.</text>
 </subparagraph><subparagraph id="H635E780A9F2942149B3BE4DAF604950B"><enum>(N)</enum><text>The effect that the death, disability, or inability to engage in any substantial gainful activity of the borrower would have on the obligations of the borrower and any co-signer of the loan.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H66684C57C4074064BB4513BB852696BC"><enum>(b)</enum><header>Designation of
 individual To act on behalf of the borrower</header><text>Section 484 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091</external-xref>) is amended—</text>
 <paragraph id="id1C53867F6B2A4C67B7D247704F0AB528"><enum>(1)</enum><text>in subsection (a), by striking paragraph (4) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0D1A6F3930394F53B05F7448ED8FFA0E" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="ID06AB2A4248674E6B9BEAB47412B2D739"><enum>(4)</enum><text display-inline="yes-display-inline">file with the Secretary, as part of the original financial aid application process, a certification, which need not be notarized, but which—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id39C7708027BB45098F8FA8D2BE5B1182"><enum>(A)</enum><text display-inline="yes-display-inline">shall include—</text> <clause commented="no" display-inline="no-display-inline" id="ID44DB06B36EAD46CDB3E291A605F99C00"><enum>(i)</enum><text>a statement of educational purpose stating that the money attributable to such grant, loan, or loan guarantee will be used solely for expenses related to attendance or continued attendance at such institution; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ID7145C3AB833E4544B190EDC1E14C6969"><enum>(ii)</enum><text>such student's social security number; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B40681A417A42E6B4767008C4996B38"><enum>(B)</enum><text>may include a designation by such student of an individual who shall have the legal authority to act on behalf of the student with respect to any loan to the student under this title in the event of the student’s death, disability, or inability to engage in any substantial gainful activity;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idCD83CDA1620C4FA282A86A537D800546"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4859996EEDCD4E04AC784959596151DC" style="OLC"> <subsection id="id6A90182C5250457AA9C3A5083559AB08"><enum>(u)</enum><header>Option To designate individual To act on behalf of the borrower in clear and conspicuous manner</header><text>The option for a student to make a designation described in subsection (a)(4)(B) shall be provided in a clear and conspicuous manner to the student.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="id300E8691A526405D99538ADB7C5C2954"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or an amendment made by this Act, shall be construed to adversely affect the eligibility of a student to receive any grant, loan, or work assistance under part C or part G of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/2751">42 U.S.C. 2751 et seq.</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088 et seq.</external-xref>) based on a designation, or lack thereof, under section 484(a)(4)(B) of that Act, as added by section 3(b) of this Act.</text>
