			 non-employees, and for other purposes.</official-title></form>

 <section id="H8C6CB9BC6BF9492C9C58A32195AC1745" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Payroll Fraud Prevention Act of 2015</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H4DAF7725D9E34714AC8D9DBCCADCF5A1"><enum>2.</enum><header>Classification of
			 employees and non-employees</header>
 <subsection id="idC2CF479361594E1993BEF4EAB1710F47"><enum>(a)</enum><header>Definitions</header><text>Section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8056A9693F5C4C00B6B107872688C8AC" style="OLC">
 <subsection id="id7A8E231B9AD2401F8310208F5EBC6A00"><enum>(z)</enum><text><term>Non-employee</term> means an individual who—</text>
 <paragraph id="idEB5E8A9E8F79473C85478E276DFF3098"><enum>(1)</enum><text>a person has engaged, in the course of the trade or business of the person, for the performance of labor or services; and</text>
 </paragraph><paragraph id="idFC5052581BBB4A8CAD8B6516B355259B"><enum>(2)</enum><text>is not an employee of the person.</text>
 </paragraph></subsection><subsection id="id50AF7E2B6D894BDA8AC0B47E4A28ED23"><enum>(aa)</enum><text><term>Covered individual</term> when used with respect to an employer or other person means—</text>
 <paragraph id="id37E28AB8AB4D4E51A93B178C0A4682ED"><enum>(1)</enum><text>an employee of the employer; or</text>
 </paragraph><paragraph id="id4982A3D16D144C9F8220921E81AE1B3A"><enum>(2)</enum><text>a non-employee of the person (including a person who is an employer)—</text>
 <subparagraph id="id16BA9B7E15E24FE7892D045AE73F6393"><enum>(A)</enum><text>whom the person has engaged, in the course of the trade or business of the person, for the performance of labor or services; and</text>
 </subparagraph><subparagraph id="id9B0DD21225754C9DB813B5EAC6DFD4BF"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idDADA6E688FC9445BB7033169435FB7CB"><enum>(i)</enum><text>with respect to whom the person is required to file an information return under <external-xref legal-doc="usc" parsable-cite="usc/26/6041A">section 6041A(a)</external-xref> of the Internal Revenue Code of 1986; or</text>
 </clause><clause id="IDb604261e00474618a91fd2323a766569" indent="up1"><enum>(ii)</enum><text>who is providing labor or services to the person through an entity that is a trust, estate, partnership, association, company, or corporation (as such terms are used in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(1)</external-xref> of the Internal Revenue Code of 1986) if—</text>
 <subclause id="id400A312858BA495FABED7387BDD4349B"><enum>(I)</enum><text>such individual has an ownership interest in the entity;</text>
 </subclause><subclause id="idC285E570A15A4C2CA544033E565CE06C"><enum>(II)</enum><text>creation or maintenance of such entity is a condition for the provision of such labor or services to the person; and</text>
 </subclause><subclause id="id785D2F714FC5410B82A39C2680EB3AF6"><enum>(III)</enum><text>the person would be required to file an information return for the entity under <external-xref legal-doc="usc" parsable-cite="usc/26/6041A">section 6041A(a)</external-xref> of the Internal Revenue Code of 1986 if the entity was an individual.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H75074709490146849F0644F97B5F00A4"><enum>(b)</enum><header>Classification
 as employees</header><text display-inline="yes-display-inline">Section 11(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>) is amended—</text>
 <paragraph id="HE15CBC7DA08540AC9C281B1300AA78A2"><enum>(1)</enum><text>by striking <quote>(c) Every employer subject to any provision of this Act or of any order issued under this Act</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id74FF9A8850964F93BB8394B9B944B036" style="OLC">
						<subsection id="idEF81027E995A4557AF110A3820CECF6F"><enum>(c)</enum><header>Recordkeeping;
				classification; notice</header>
 <paragraph id="id8B3D1A0E4CD242DEAE4403C10707A4B7"><enum>(1)</enum><header>Recordkeeping</header><text>Every person subject to any provision of this Act or of any order issued under this Act</text></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HE08105CAF129480F8FDA02895F4C4CA0"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBD2DA83B67754591B380AAFF12FF6DB1" style="OLC">
						<paragraph id="idD679391ACE5C4160996B8E724A4EFE42"><enum>(2)</enum><header>Classification</header>
							<subparagraph id="idD1ECCF141B1F4D3FA9CA2328BD463591"><enum>(A)</enum><header>In
 general</header><text>Every person (including every employer and enterprise), who employs any employee engaged in commerce or in the production of goods for commerce or engages any non-employee engaged in commerce or in the production of goods for commerce, shall—</text>
 <clause id="idE6182AAE2A2A4BA3B989A199446F8F97"><enum>(i)</enum><text>accurately classify each covered individual as an employee or a non-employee (as the case may be);</text>
 </clause><clause id="idA61368E6770348DDB1620CB1C668E9B2"><enum>(ii)</enum><text>provide, to each covered individual, a written notice that—</text>
 <subclause id="idDEAE48B62A694A2FADFC6F8DE7438E08"><enum>(I)</enum><text>informs the covered individual of the classification of such individual, by the person submitting the notice, as an employee or a non-employee;</text>
 </subclause><subclause id="id62DCC3C0851A4C668CBCC46132034325"><enum>(II)</enum><text>includes a statement directing such individual to the Department of Labor website established under section 3 of the <short-title>Payroll Fraud Prevention Act of 2015</short-title>, or other appropriate resources, for the purpose of providing further information about the legal rights of an employee;</text>
 </subclause><subclause id="id45A8A7271B8A443CAD00F6D4D9243E85"><enum>(III)</enum><text>includes the address and telephone number for the applicable local office of the Department of Labor; and</text>
 </subclause><subclause id="id6E80A3F8D1E242A1B286B875928CA094"><enum>(IV)</enum><text>includes for each covered individual classified as a non-employee by the person providing the notice, the following statement: <quote>Your rights to wage, hour, and other labor protections depend upon your proper classification as an employee or a non-employee. If you have any questions or concerns about how you have been classified or suspect that you may have been misclassified, contact the U.S. Department of Labor.</quote>; and</text>
 </subclause></clause><clause id="id24FE284D9CC740D1AA82A43F58E8F024"><enum>(iii)</enum><text>maintain a copy of such notice as a required record under paragraph (1).</text>
								</clause></subparagraph><subparagraph id="HE6831F654BBE4BBD899055F79D15C4B"><enum>(B)</enum><header>Timing of
				notice</header>
								<clause id="id2F431330DD3344A9987A03D1BD2629CA"><enum>(i)</enum><header>In
 general</header><text display-inline="yes-display-inline">The notice described in subparagraph (A)(ii) shall be provided, at a minimum, to each covered individual not later than 6 months after the date of enactment of the <short-title>Payroll Fraud Prevention Act of 2015</short-title>, and thereafter—</text>
 <subclause id="idC4F4FFC5E494485E9D5D1AD1ED854B76"><enum>(I)</enum><text display-inline="yes-display-inline">for each new employee, upon employment; and</text>
 </subclause><subclause id="id5D68E170CB4742E4AF9BD9CF422787AE"><enum>(II)</enum><text display-inline="yes-display-inline">for each new non-employee, upon commencement of the labor or services provided by the non-employee.</text>
									</subclause></clause><clause id="idB8955C4D70484FEFB46089DDCB3BEEDD"><enum>(ii)</enum><header>Change in
 status</header><text display-inline="yes-display-inline">Each person required to provide a notice under subparagraph (A)(ii) to a covered individual shall also provide such notice to such individual upon changing the status of such individual as an employee or a non-employee.</text>
								</clause></subparagraph><subparagraph commented="no" id="id459CF788CD2B437786AE019FFE405E1C"><enum>(C)</enum><header>Presumption</header>
								<clause commented="no" id="idAC457D0BAD7C487AA1C78DCF226B6D24"><enum>(i)</enum><header>In
 general</header><text display-inline="yes-display-inline">For purposes of this Act and the regulations or orders issued under this Act, a covered individual to whom a person is required to provide a notice under subparagraph (A)(ii) shall be presumed to be an employee of the person if the person has not provided the individual with such notice within the time required under subparagraph (B).</text>
 </clause><clause commented="no" id="id734D617785764CBD92957DE37421CDC9"><enum>(ii)</enum><header>Rebuttal</header><text>The presumption under clause (i) shall be rebutted only through the presentation of clear and convincing evidence that a covered individual described in such subparagraph is not an employee of the person.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA55DA293007347B9A5843F32DC597605"><enum>(c)</enum><header>Special
 prohibited acts</header><text>Section 15(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/215">29 U.S.C. 215(a)</external-xref>) is amended—</text>
 <paragraph id="id8BD660BF9B914E0DBE105FC9C4A23655"><enum>(1)</enum><text>by striking paragraph (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0A76134175BA4F208FA263FABD82FB07" style="OLC">
 <paragraph id="ID04c8c8f26d224a788ec2ac6d85472319"><enum>(3)</enum><text>to discharge or in any other manner discriminate against any covered individual (including an employee) because such individual has—</text>
 <subparagraph id="id48B75A2744D8420C8FF5C1429D080F8E"><enum>(A)</enum><text>opposed any practice, filed any petition or complaint, or instituted or caused to be instituted any proceeding—</text>
 <clause id="id5537BB545FEE46948B56ABB6D57FE1F7"><enum>(i)</enum><text>under or related to this Act (including concerning the status of a covered individual as an employee or a non-employee for purposes of this Act); or</text>
 </clause><clause id="idF407427C259A46B094FC4D69169E8285"><enum>(ii)</enum><text>concerning the status of a covered individual as an employee or a non-employee for employment tax purposes within the meaning of subtitle C of the Internal Revenue Code of 1986;</text>
 </clause></subparagraph><subparagraph id="IDa4b0d97b95864ad2a1ee3f2fdc45c5ae"><enum>(B)</enum><text>testified or is about to testify in any proceeding described in subparagraph (A); or</text>
 </subparagraph><subparagraph id="id6493CE652DBF42668B697DFECA0C4550"><enum>(C)</enum><text>served, or is about to serve, on an industry committee;</text></subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id732C6688EA43448A9FA252697A26EB3E"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id890E732608374831A912EB7161BF3590"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id34CCB4CA8B824191A82CB9CC50106D05" style="OLC">
 <paragraph id="H6D3973F1B8874688AB12742E9C602386"><enum>(6)</enum><text display-inline="yes-display-inline">to wrongly classify an employee of the person as a non-employee in accordance with section 11(c)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H615C31DA2C1A415FBBBC6B8272F8A108"><enum>(d)</enum><header>Special penalty
			 for certain misclassification, recordkeeping, and notice
 violations</header><text display-inline="yes-display-inline">Section 16 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216</external-xref>) is amended—</text>
 <paragraph id="H9EAA3C65647F47F3B8FFF3DDF1851A3"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="id533072762D8D43BF9C2CCCE60A91581C"><enum>(A)</enum><text>in the sixth sentence, by striking <quote>any employee</quote> each place the term occurs and inserting <quote>any covered individual</quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8BFBF3F1DB3341ED97B1CE9ED0EDA721"><enum>(B)</enum><text>in the fourth sentence—</text>
 <clause commented="no" display-inline="no-display-inline" id="id9070AD178562406AB418AF8E656CB8AF"><enum>(i)</enum><text>by striking <quote>employees</quote> and inserting <quote>covered individual</quote>; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id122BE01DFF58487CB498FE847EEF6AF4"><enum>(ii)</enum><text>by striking <quote>he gives his consent</quote> and inserting <quote>such covered individual consents</quote>;</text> </clause></subparagraph><subparagraph id="HBCCE3D885ADE44E795748CC5BEC1FBC1"><enum>(C)</enum><text>in the third sentence—</text>
 <clause id="id9A28504CF2BB4FDDBA63D9F5D5222EFF"><enum>(i)</enum><text>by striking <quote>either of the preceding sentences</quote> and inserting <quote>any of the preceding sentences</quote>;</text>
 </clause><clause id="idD3653E8BA73E4133ACCF3A7ECD1CFD94"><enum>(ii)</enum><text>by striking <quote>one or more employees</quote> and inserting <quote>one or more covered individuals</quote>; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id9F1C996B757746CBB1F2F7EB2F0A5B5B"><enum>(iii)</enum><text>by striking <quote>in behalf of himself or themselves and other employees</quote> and inserting <quote>on behalf of such covered individual or individuals and other covered individuals</quote>; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73927A5690EE4A59B0AC28FE7F0067D0"><enum>(D)</enum><text>by inserting after the first sentence the following: <quote>Such liquidated damages are doubled (subject to section 11 of the Portal-to-Portal Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/260">29 U.S.C. 260</external-xref>)) where, in addition to violating the provisions of section 6 or 7, the employer has violated the provisions of section 15(a)(6) with respect to such employee or employees.</quote>; and</text>
 </subparagraph></paragraph><paragraph id="id73F1B43A069344D8BAC5A7A8E58DB717"><enum>(2)</enum><text>in subsection (e), by striking paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB960B06117944A5C852F92F3020BE251" style="OLC">
 <paragraph id="id3274A473EBCD4AEB9CDB65F15DED48EC" indent="up1"><enum>(2)</enum><text>Any person who violates section 6, 7, 11(c), or 15(a)(6) shall be subject to a civil penalty, for each employee or other individual who was the subject of such a violation, in an amount—</text>
 <subparagraph id="id7158D6EAAB5A46C88B01DE9807FEA092"><enum>(A)</enum><text>not to exceed $1,100; or</text> </subparagraph><subparagraph id="id2C60626AA9044950A0C709CE3F943C95"><enum>(B)</enum><text>in the case of a person who has repeatedly or willfully committed such violation, not to exceed $5,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H34B9201CA9404AECB71F5164AFBDA468"><enum>3.</enum><header>Employee rights
 website</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Labor shall establish a single webpage on the Department of Labor website that summarizes in plain language the rights of employees and non-employees under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>), including the rights described in the amendments made by section 2.</text>
		</section><section commented="no" id="HEDF9DC16F80343D4B7C34F008C33967F" section-type="subsequent-section"><enum>4.</enum><header>Misclassification of
			 employees for unemployment compensation purposes</header>
			<subsection commented="no" id="H8AA4579D91DD481B00588CE73C265EF1"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Section 303(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(a)</external-xref>) is amended—</text>
 <paragraph commented="no" id="H463BA1CF48C04AF8B5621700036769B2"><enum>(1)</enum><text>in paragraph (11)(B), by striking the period and inserting <quote>; and</quote>;</text> </paragraph><paragraph commented="no" id="id93CCB360E5AC450EB80BAFD8BB8882FA"><enum>(2)</enum><text>in paragraph (12), by striking the period and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph commented="no" id="H4FA5982813044C5FA4A09B1DD5A4F570"><enum>(3)</enum><text>by adding after paragraph (12) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H01E1C7A11F0241398C30C1C14EF18717" style="traditional">
 <paragraph commented="no" id="HA01DFA53F888411993319382DDC0DAD9"><enum>(13)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFF48896033FE44849766DA8D95D29509"><enum>(A)</enum><text display-inline="yes-display-inline">Such auditing and investigative procedures as may be necessary to identify employers that have not registered under the State law or that are paying unreported wages, where these actions or omissions by the employers have the effect of excluding employees from unemployment compensation coverage; and</text>
 </subparagraph><subparagraph id="HD92A80C3F8434E3790E992E983C91113" indent="up1"><enum>(B)</enum><text>the making of quarterly reports to the Secretary of Labor (in such form as the Secretary of Labor may require) describing the results of the procedures under subparagraph (A); and</text>
 </subparagraph></paragraph><paragraph id="HEEEA339EC88345439160C2A3DED1D578"><enum>(14)</enum><text>the establishment of administrative penalties for misclassifying employees, or paying unreported wages to employees without proper recordkeeping, for unemployment compensation purposes.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBD1F5CA9ACA84010BE0407DC8342FD25"><enum>(b)</enum><header>Review of
 auditing programs</header><text>The Secretary of Labor shall include, in the Department of Labor's system for measuring the performance of States in conducting unemployment compensation tax audits, a specific measure of the effectiveness of States in identifying the underreporting of wages and the underpayment of unemployment compensation contributions (including the effectiveness of States in identifying instances of such underreporting or underpayments despite the absence of cancelled checks, original time sheets, or other similar documentation).</text>
			</subsection><subsection commented="no" id="H0504B69F363F421CB028E1A1D55E78F7"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph commented="no" id="HFAD05AA5D7B64154A538C781113B71FD"><enum>(1)</enum><header>In
 general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the amendments made by subsection (a) shall take effect 12 months after the date of enactment of this Act.</text>
 </paragraph><paragraph commented="no" id="H7FB1DCD60DEB4D85008C96085E4C9D5B"><enum>(2)</enum><header>Exception</header><text>If the Secretary of Labor finds that legislation is necessary for the unemployment compensation law of a State to comply with the amendments made by subsection (a), such amendments shall not apply with respect to such law until the later of—</text>
 <subparagraph commented="no" id="HA0F11A55DCE84C56903C3FFDE05CD461"><enum>(A)</enum><text>the day after the close of the first regular session of the legislature of such State that begins after the date of enactment of this Act; or</text>
 </subparagraph><subparagraph commented="no" id="H2AE94868FB2049ACBA2D8D8323D533DE"><enum>(B)</enum><text>12 months after the date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HEA9A4419FE984E0EBA02007700862910"><enum>(d)</enum><header>Definition of
 State</header><text>For purposes of this section, the term <term>State</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/3306">section 3306(j)</external-xref> of the Internal Revenue Code of 1986.</text>
			</subsection></section><section commented="no" id="H43BFEAE000A943DAAE153DC67CB3D83E"><enum>5.</enum><header>Department of
			 Labor coordination, referral, and regulations</header>
			<subsection commented="no" id="idAD8305D0831E45DC9DC1D00BC6AE66BF"><enum>(a)</enum><header>Coordination
 and referral</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any office, administration, or division of the Department of Labor that, while in the performance of its official duties, obtains information regarding the misclassification by a person subject to the provisions of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>), or any order issued under such Act of any individual regarding whether such individual is an employee or a non-employee engaged in the performance of labor or services for purposes of section 6 or 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref>, 207), or in records required under section 11(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>), shall report such information to the Wage and Hour Division of the Department of Labor. The Wage and Hour Division may report such information to the Internal Revenue Service as the Wage and Hour Division considers appropriate.</text>
 </subsection><subsection commented="no" id="idD31EC14751824D698651DAE7BA7F8DFA"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Labor shall promulgate regulations to carry out this Act and the amendments made by this Act.</text>
			</subsection></section><section id="H5AE7300EE2E9474385A272B453A0E78D"><enum>6.</enum><header>Targeted
 audits</header><text display-inline="no-display-inline">The audits of employers subject to the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) that are conducted by the Wage and Hour Division of the Department of Labor shall include certain industries with frequent incidence of misclassifying employees as non-employees, as determined by the Secretary of Labor.</text></section></legis-body></bill>
