 <section commented="no" display-inline="no-display-inline" id="id12463d69-dec7-4732-a5f9-af291400cd4e" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recognize, Assist, Include, Support, and Engage Family Caregivers Act of 2015</short-title></quote> or the <quote><short-title>RAISE Family Caregivers Act</short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="idb00c77b9-d490-49cf-9ff0-25d588438afe" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="idac0a75d7-e2b3-4569-b593-823526ae2942"><enum>(1)</enum><header display-inline="yes-display-inline">Advisory Council</header><text display-inline="yes-display-inline">The term <term>Advisory Council</term> means the Family Caregiving Advisory Council convened under section 4.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d8ead49-9d3e-4d21-a5b2-93fb3fbf8e61"><enum>(2)</enum><header display-inline="yes-display-inline">Family caregiver</header><text display-inline="yes-display-inline">The term <term>family caregiver</term> means an adult family member or other individual who has a significant relationship with, and who provides a broad range of assistance to, an individual with a chronic or other health condition, disability, or functional limitation.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1128ca4a-e234-4978-aa32-986c777fe445"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96136151-d538-4554-b352-c07674641625"><enum>(4)</enum><header display-inline="yes-display-inline">Strategy</header><text display-inline="yes-display-inline">The term <term>Strategy</term> means the National Family Caregiving Strategy established, maintained, and updated under section 3.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idcb113620-dc05-4d35-8ae4-ee6b20253772" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">National Family Caregiving Strategy</header>
 <subsection commented="no" display-inline="no-display-inline" id="ide09d1126-1cb7-424f-a761-28c7b79fe4b4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the heads of other appropriate Federal agencies, shall develop, maintain, and periodically update a National Family Caregiving Strategy.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id9d24d0f6-c2fc-46f8-9ad9-2c053e8c6d1f"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The Strategy shall identify specific actions that Federal, State, and local governments, communities, health care, long-term services and supports and other providers, employers, and others can take to recognize and support family caregivers in a manner that reflects their diverse needs, including with respect to the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ida3b1f0e0-498d-42da-b87b-f2ee3f36a399"><enum>(1)</enum><text display-inline="yes-display-inline">Promoting greater adoption of person- and family-centered care in all health and long-term services and supports settings, with the person receiving services and supports and the family caregiver (as appropriate) at the center of care teams.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1866443-c7a0-44c2-b397-a67059adaf16"><enum>(2)</enum><text display-inline="yes-display-inline">Assessment and service planning (including care transitions and coordination) involving family caregivers and care recipients.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0117178-09d2-49d1-a72c-8a724d1730c6"><enum>(3)</enum><text display-inline="yes-display-inline">Training and other supports.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a7c575c-7874-45a8-9421-a5ca7378f6b4"><enum>(4)</enum><text display-inline="yes-display-inline">Information, education, referral, and care coordination, including hospice, palliative care, and advance planning services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id925d4cbe-16c7-4684-a96c-5225b2bb4096"><enum>(5)</enum><text display-inline="yes-display-inline">Respite options.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae605c20-9005-4dbe-99c9-89f4983c64d2"><enum>(6)</enum><text display-inline="yes-display-inline">Financial security.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcfb2869b-880e-42f2-9191-ad0415dab3d8"><enum>(7)</enum><text display-inline="yes-display-inline">Workplace policies and supports that allow family caregivers to remain in the workforce.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf1554b4d-f85e-4653-965f-17ddc438224b"><enum>(c)</enum><header display-inline="yes-display-inline">Responsibilities of the Secretary</header><text display-inline="yes-display-inline">The Secretary, in carrying out this section, shall be responsible for the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idee804a68-cac8-434c-89a0-b45aa3508f57"><enum>(1)</enum><text display-inline="yes-display-inline">Collecting and making publicly available information, including evidence-based or promising practices and innovative models (both domestically and internationally) regarding the provision of care by family caregivers or support for family caregivers.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf49092f5-2c26-494c-bc6d-6a2cdf43d834"><enum>(2)</enum><text display-inline="yes-display-inline">Coordinating Federal Government programs and activities to recognize and support family caregivers while ensuring maximum effectiveness and avoiding unnecessary duplication.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb84e615b-4f4a-4a35-bfff-daf0407f7560"><enum>(3)</enum><text display-inline="yes-display-inline">Providing technical assistance, such as best practices and information sharing, to State or local efforts, as appropriate, to support family caregivers.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc00cb5c-c734-4d46-a94f-ae639fae0f82"><enum>(4)</enum><text display-inline="yes-display-inline">Addressing disparities in recognizing and supporting family caregivers and meeting the needs of the diverse family caregiving population.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3701ae03-758d-46e2-841e-66a9975b8113"><enum>(5)</enum><text display-inline="yes-display-inline">Assessing all Federal programs regarding family caregivers, including with respect to funding levels.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf98ec428-bb4d-4306-8148-93df8f4e0791"><enum>(d)</enum><header display-inline="yes-display-inline">Initial strategy; updates</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id133dca84-81a3-4fc6-b372-9fabb2fa7b44"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of enactment of this Act, develop, publish, and submit to Congress the initial Strategy incorporating the items addressed in the Advisory Council's report in section 4(d)(2) and other priority actions for recognizing and supporting family caregivers; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideb708257-732f-49ec-a7d1-f20305002c72"><enum>(2)</enum><text display-inline="yes-display-inline">not less than every 2 years, update, republish, and submit to Congress the Strategy, taking into account the most recent annual report submitted under section 4(d)(1)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id041ecaac-241c-4796-a836-1adad4ca11a3"><enum>(A)</enum><text display-inline="yes-display-inline">to reflect new developments, challenges, opportunities, and solutions; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b167e88-21f8-481a-9d15-20f597272cf5"><enum>(B)</enum><text display-inline="yes-display-inline">to assess progress in implementation of the Strategy and, based on the results of such assessment, recommend priority actions for such implementation.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2d69794a-1def-48c6-8340-f0e0927b91bc"><enum>(e)</enum><header display-inline="yes-display-inline">Process for public input</header><text display-inline="yes-display-inline">The Secretary shall establish a process for public input to inform the development of, and updates to, the Strategy, including a process for the public to submit recommendations to the Advisory Council and an opportunity for public comment on the proposed Strategy.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="iddd10453e-414e-434a-9883-9f13371c565a"><enum>(f)</enum><header display-inline="yes-display-inline">No preemption</header><text display-inline="yes-display-inline">Nothing in this Act preempts any authority of a State or local government to recognize or support family caregivers.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ida8444703-08e9-41a3-b64c-ba3f72feae60" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Family Caregiving Advisory Council</header>
 <subsection commented="no" display-inline="no-display-inline" id="id5049d250-8564-4647-b475-3b8049a3774c"><enum>(a)</enum><header display-inline="yes-display-inline">Convening</header><text display-inline="yes-display-inline">The Secretary shall convene a Family Caregiving Advisory Council to provide advice to the Secretary on recognizing and supporting family caregivers.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id3deec571-138b-45a0-9f64-f93d5270e784"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ida0d8929f-df1b-4f31-b84c-7ee0202a615e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The members of the Advisory Council shall consist of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2580c8e8-92fe-403a-a70e-df5061a7a640"><enum>(A)</enum><text display-inline="yes-display-inline">the appointed members under paragraph (2); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf9eee2a5-08cf-49ef-8835-fc294282d632"><enum>(B)</enum><text display-inline="yes-display-inline">the Federal members under paragraph (3).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ddbdc6d-c8e7-472d-ae2c-979d819ca33a"><enum>(2)</enum><header display-inline="yes-display-inline">Appointed members</header><text display-inline="yes-display-inline">In addition to the Federal members under paragraph (3), the Secretary shall appoint not more than 15 members of the Advisory Council who are not representatives of Federal departments or agencies and who shall include at least one representative of each of the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id184c27b4-1b91-4993-93af-46ea81320d39"><enum>(A)</enum><text display-inline="yes-display-inline">Family caregivers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id064d924a-c198-49b3-a1d5-af67698a48ca"><enum>(B)</enum><text display-inline="yes-display-inline">Older adults with long-term services and supports needs, including older adults facing disparities.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8780520-8609-4266-8a59-e6def8e715f8"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals with disabilities.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca628cad-73c5-40fe-9c0e-0cbb751543f2"><enum>(D)</enum><text display-inline="yes-display-inline">Advocates for family caregivers, older adults with long-term services and supports needs, and individuals with disabilities.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2937b2d4-47a3-4fd2-85b7-707ac8102d70"><enum>(E)</enum><text display-inline="yes-display-inline">Health care and social service providers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56ead17d-f97c-4801-9021-5583e0b45b7d"><enum>(F)</enum><text display-inline="yes-display-inline">Long-term services and supports providers.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id593fe989-da0c-4c2f-82d0-adcdff454d05"><enum>(G)</enum><text display-inline="yes-display-inline">Employers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0aab1b30-814e-4150-b672-923e96d763f3"><enum>(H)</enum><text display-inline="yes-display-inline">Paraprofessional workers.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4140e04-6975-44c6-8376-4476f8f06a4b"><enum>(I)</enum><text display-inline="yes-display-inline">State and local officials.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda379809-c239-4784-9718-2d31e836b945"><enum>(J)</enum><text display-inline="yes-display-inline">Accreditation bodies.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c2efcf6-ce17-4219-b498-8ab4daaffe62"><enum>(K)</enum><text display-inline="yes-display-inline">Relevant industries.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id198086bc-aa0a-4562-bc89-cf9dc4726395"><enum>(L)</enum><text display-inline="yes-display-inline">Veterans.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58fb2a58-0a1b-4fee-8fdb-6568f1e2b1d3"><enum>(M)</enum><text display-inline="yes-display-inline">As appropriate, other experts in family caregiving.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc5174ef8-c896-4f97-b2d1-6089b72db4eb"><enum>(3)</enum><header display-inline="yes-display-inline">Federal members</header><text display-inline="yes-display-inline">The Federal members of the Advisory Council, who shall be nonvoting members, shall consist of the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idf1176216-3f64-4c79-be42-c0f989764fab"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator of the Centers for Medicare &amp; Medicaid Services (or the Administrator's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida8430282-2c9a-4061-b576-7992a33d5e77"><enum>(B)</enum><text display-inline="yes-display-inline">The Administrator of the Administration for Community Living (or the Administrator's designee who has experience in both aging and disability).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided4b9e87-eba2-4555-9b4b-5adb5705d97f"><enum>(C)</enum><text display-inline="yes-display-inline">The Assistant Secretary for the Administration for Children and Families (or the Assistant Secretary's designee).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd46a608a-c769-426c-83a7-630244945ad0"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary of Veterans Affairs (or the Secretary's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ca38809-2037-4b03-9215-449f3416a11e"><enum>(E)</enum><text display-inline="yes-display-inline">The Secretary of Labor (or the Secretary's designee).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5d3d6dd-a78c-4350-a8d4-614a7a62d1d4"><enum>(F)</enum><text display-inline="yes-display-inline">The Secretary of the Treasury (or the Secretary's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51a9fb23-2341-4980-acce-9c477ca20087"><enum>(G)</enum><text display-inline="yes-display-inline">The National Coordinator for Health Information Technology (or the National Coordinator's designee).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77969D84EC7C4D5EAC1B5DE012DCAABF"><enum>(H)</enum><text display-inline="yes-display-inline">The Administrator of the Small Business Administration (or the Administrator's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC7E3AA895D5F4F8E8D95C6AA87EB9B97"><enum>(I)</enum><text display-inline="yes-display-inline">The Chief Executive Officer of the Corporation for National and Community Service (or the Chief Executive Officer's designee).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5182da88-b3bb-4f61-b7c6-af5f80843fa0"><enum>(J)</enum><text display-inline="yes-display-inline">The heads of other Federal departments or agencies (or their designees), as appointed by the Secretary or the Chair of the Advisory Council.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25559ea8-6c68-4c60-bf4e-e856eba3908a"><enum>(4)</enum><header display-inline="yes-display-inline">Diverse representation</header><text display-inline="yes-display-inline">The Secretary shall ensure that the membership of the Advisory Council reflects the diversity of family caregivers and individuals receiving services and supports.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id446ece81-c1ca-4b26-853f-224a54a3b586"><enum>(c)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Advisory Council shall meet quarterly during the 1-year period beginning on the date of enactment of this Act and at least three times during each year thereafter. Meetings of the Advisory Council shall be open to the public.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0ca65cb3-72b8-4a96-9243-19d5ecc7c597"><enum>(d)</enum><header display-inline="yes-display-inline">Advisory Council annual reports</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id97064972-f1e5-4f7d-8d14-9f0232589c8c"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, and annually thereafter, the Advisory Council shall submit to the Secretary and Congress a report concerning the development, maintenance, and updating of the Strategy and the implementation thereof, including a description of the outcomes of the recommendations and priorities under paragraph (2), as appropriate. Such report shall be made publicly available by the Advisory Council.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68f875a5-e150-4a09-a7ca-0897988e29df"><enum>(2)</enum><header display-inline="yes-display-inline">Initial report</header><text display-inline="yes-display-inline">The Advisory Council's initial report under paragraph (1) shall include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id1835a29e-2d82-43b4-ab13-1b9e3f239c8d"><enum>(A)</enum><text display-inline="yes-display-inline">an inventory and assessment of all federally funded efforts to recognize and support family caregivers and the outcomes of such efforts, including analyses of the extent to which federally funded efforts are reaching family caregivers and gaps in such efforts;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e26bcd4-376b-491c-aae8-8fbdff3d42d7"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations for priority actions—</text> <clause commented="no" display-inline="no-display-inline" id="idf68052b7-bff1-4b5f-bf46-7ed79cd3e1c0"><enum>(i)</enum><text display-inline="yes-display-inline">to improve and better coordinate programs; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0cd0a093-a33d-415b-8827-fec799713f71"><enum>(ii)</enum><text display-inline="yes-display-inline">to deliver services based on the performance, mission, and purpose of a program while eliminating redundancies and ensuring the needs of family caregivers are met;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b63b815-a066-4d63-9f57-a2e525b9dfb7"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations to reduce the financial impact and other challenges of caregiving on family caregivers; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0cb45eb-489d-46d5-822f-ab8cecc31b5c"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation of how family caregiving impacts the Medicare program, and Medicaid program, and other Federal programs.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF7E6F84E5E0E46E7A9E21C4EAD55C20E"><enum>(e)</enum><header display-inline="yes-display-inline">Nonapplicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Council.</text> <pagebreak></pagebreak></subsection></section><section commented="no" display-inline="no-display-inline" id="ida8db1ee5-a70a-4a56-b579-cb434fef24da" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Sunset provision</header><text display-inline="no-display-inline">The authority and obligations established by this Act shall terminate on December 31, 2025.</text></section></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20151208">Passed the Senate December 8, 2015.</attestation-date><attestor display="yes">Julie E.
