 </subsection></section><section id="H5A56415DF5714CD0B40EF552D6C5CB8E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idA54EC2A515984938A087311F96BAC005"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <quote>appropriate committees of Congress</quote> means—</text>
 <subparagraph id="id50C04A9817F44C708184B7404B934A94"><enum>(A)</enum><text>the congressional intelligence committees;</text> </subparagraph><subparagraph id="id9ECBFD74DCE84BF791DCDBFD723BBF47"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Foreign Relations of the Senate; and</text>
 </subparagraph><subparagraph id="id0DFDFB91EC73412ABD62C9E7AF835164"><enum>(C)</enum><text>the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CEE6A76F072484E825BB878B11E2B0B"><enum>(2)</enum><header display-inline="yes-display-inline">Congressional intelligence committees</header><text display-inline="yes-display-inline">The term <term>congressional intelligence committees</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H10251FB5E7C24608842207888A5193A7"><enum>(A)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the Senate; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDCD85ADA16EC4D7B83A8940756599F86"><enum>(B)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on Intelligence of the House of Representatives.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84D0B5ECB4F74016AF75C58E6BFED95A"><enum>(3)</enum><header display-inline="yes-display-inline">Intelligence community</header><text display-inline="yes-display-inline">The term <term>intelligence community</term> has the meaning given that term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>).</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="HD8120139C8A14F50BF7FB8C258C815DC"><enum>3.</enum><header>Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text>
		</section><title id="H1769A5A7A051443D8B321F2AA0E2608D"><enum>I</enum><header>Intelligence activities</header>
 <section id="H1B93DF4B783B48799BDED3649166123B"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are hereby authorized to be appropriated for fiscal year 2016 for the conduct of the intelligence and intelligence-related activities of the following elements of the United States Government:</text>
 <paragraph id="H1BAB8FC3DC23409A8868A3081874383D"><enum>(1)</enum><text>The Office of the Director of National Intelligence.</text> </paragraph><paragraph id="HE37F91AEA3EE49A89F5D1093497D2964"><enum>(2)</enum><text>The Central Intelligence Agency.</text>
 </paragraph><paragraph id="HD074D9494ED147ABBDF527326CA3A975"><enum>(3)</enum><text>The Department of Defense.</text> </paragraph><paragraph id="HD8357D7930144985AD9A03B6805FC652"><enum>(4)</enum><text>The Defense Intelligence Agency.</text>
 </paragraph><paragraph id="H3000427D13D343FAB8E4BF0A681309DF"><enum>(5)</enum><text>The National Security Agency.</text> </paragraph><paragraph id="H8E9E29266E854E119602A39E080EB2CE"><enum>(6)</enum><text>The Department of the Army, the Department of the Navy, and the Department of the Air Force.</text>

				</paragraph></section><section id="HAE1626A1AE5B4B2EA47BBBD6B2614FC2"><enum>102.</enum><header>Classified Schedule of Authorizations</header>
 <subsection id="HE12374FC26B64DF6B688DAEEF333587A"><enum>(a)</enum><header>Specifications of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 101 and, subject to section 103, the authorized personnel ceilings as of September 30, 2016, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 101, are those specified in the classified Schedule of Authorizations prepared to accompany the bill S. 1705 of the One Hundred Fourteenth Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H6066920C223C4A8A99EFA6D37278BC4D"><enum>(b)</enum><header>Availability of classified Schedule of Authorizations</header>
 <paragraph id="HE24336DFAEF84802BAADDDC571743701"><enum>(1)</enum><header>Availability</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President.</text>
 </paragraph><paragraph id="H9A55C9F2EE2D46CF8013055D743C465D"><enum>(2)</enum><header>Distribution by the President</header><text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified Schedule of Authorizations, or of appropriate portions of the Schedule, within the executive branch.</text>
 </paragraph><paragraph id="H0DDA6E34B6A348BFB2C57824741B237F"><enum>(3)</enum><header>Limits on disclosure</header><text>The President shall not publicly disclose the classified Schedule of Authorizations or any portion of such Schedule except—</text>
 <subparagraph id="HA1FE03F9D64646C28673E5125345BC12"><enum>(A)</enum><text>as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/50/3306">50 U.S.C. 3306(a)</external-xref>);</text>
 </subparagraph><subparagraph id="H8196B691B45F40F48D30146D32798B91"><enum>(B)</enum><text>to the extent necessary to implement the budget; or</text> </subparagraph><subparagraph id="HFC1F182722E24365B0C2C48AD55FBE69"><enum>(C)</enum><text>as otherwise required by law.</text>
						</subparagraph></paragraph></subsection></section><section id="H73290DAAECAB4215A443BC3EB7E06BE4"><enum>103.</enum><header>Personnel ceiling adjustments</header>
 <subsection id="HE66F75DE95E341BC94C92B7710472F51"><enum>(a)</enum><header>Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2016 by the classified Schedule of Authorizations referred to in section 102(a) if the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions, except that the number of personnel employed in excess of the number authorized under such section may not, for any element of the intelligence community, exceed 3 percent of the number of civilian personnel authorized under such Schedule for such element.</text>
 </subsection><subsection id="HC646DC2286994DCD8084E1F0970DD3B3"><enum>(b)</enum><header>Treatment of certain personnel</header><text display-inline="yes-display-inline">The Director of National Intelligence shall establish guidelines that govern, for each element of the intelligence community, the treatment under the personnel levels authorized under section 102(a), including any exemption from such personnel levels, of employment or assignment in—</text>
 <paragraph id="H85301FF8E52945228D6D6F52E9FEC3AC"><enum>(1)</enum><text display-inline="yes-display-inline">a student program, trainee program, or similar program;</text> </paragraph><paragraph id="HF4DA2E5AC2EC4710B22FDC617374AA30"><enum>(2)</enum><text>a reserve corps or as a reemployed annuitant; or</text>
 </paragraph><paragraph id="H75BC991732674D8EB2311CD71528DBA7"><enum>(3)</enum><text>a detail, joint duty, or long term, full-time training.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9F977ECF68D2453492E84B5995792B96"><enum>(c)</enum><header>Notice to congressional intelligence committees</header><text>The Director of National Intelligence shall notify the congressional intelligence committees in writing at least 15 days prior to each exercise of an authority described in subsection (a).</text>
				</subsection></section><section id="HBFEB9B6849D04A4A8EFE05EBAE5C9639"><enum>104.</enum><header>Intelligence Community Management Account</header>
 <subsection id="HE23FE1C105204A6B9541EFE2B2B476FD"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2016 the sum of $520,073,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2017.</text>
 </subsection><subsection id="HAD993854452045A890C4A9A792054E22"><enum>(b)</enum><header>Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 785 positions as of September 30, 2015. Personnel serving in such elements may be permanent employees of the Office of the Director of National Intelligence or personnel detailed from other elements of the United States Government.</text>
				</subsection><subsection id="H28C8432D64E64E52B01B79047913C9A0"><enum>(c)</enum><header>Classified authorizations</header>
 <paragraph id="HC4410BFAC84C400C85EF0A7F337122D7"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Community Management Account for fiscal year 2015 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts for advanced research and development shall remain available until September 30, 2017.</text>
 </paragraph><paragraph id="H89D54A5675C14E699894FDA72DD174B6"><enum>(2)</enum><header>Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2016, there are authorized such additional personnel for the Community Management Account as of that date as are specified in the classified Schedule of Authorizations referred to in section 102(a).</text>
					</paragraph></subsection></section></title><title id="HC27359AA087A4A549520F9D51A9EC2C7"><enum>II</enum><header>Central Intelligence Agency Retirement and Disability System</header>
 <section id="HEA862C25AE134CD3832BEEF569E37F56"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2016 the sum of $514,000,000.</text>
			</section></title><title id="HB6C9826C386E40C0867D76FD154C7822"><enum>III</enum><header>General intelligence community matters</header>
 <section id="H8A55F1FE1EE645DAA04FA740771F6C26"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text>
 </section><section commented="no" display-inline="no-display-inline" id="id44738AEBD5A64D2FAE43F4F28480BC64" section-type="subsequent-section"><enum>302.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id02C82460EE4B45CB8C39856A8DAC72AB" section-type="subsequent-section"><enum>303.</enum><header>Notification of appointment and separation of senior level personnel of the intelligence community</header>
 <subsection id="idaa203644f176478ba6855a4705ccfc93"><enum>(a)</enum><header>Requirement to notify</header><text>The Director of National Intelligence shall establish a policy to ensure that the head of each appropriate element of the intelligence community shall notify the appropriate committees of Congress, on a quarterly basis, of each appointment of an individual to or separation from a senior level position during the previous 3-month period.</text>
 </subsection><subsection id="id22922344eff445deb63719f71ecb380a"><enum>(b)</enum><header>Senior level position defined</header><text>For the purpose of this section, the term <term>senior level position</term> shall include positions in the Senior National Intelligence Service, the Senior Intelligence Service, the Senior Executive Service, the Defense Intelligence Senior Executive Service, a Defense Intelligence Senior Leader, or similar position within the intelligence community.</text>
 </subsection><subsection id="idfc7ec22d749f4b8085aca665e7cd56c4"><enum>(c)</enum><header>Notification of appointment</header><text>A notification of the appointment of an individual to a senior level position required by subsection (a) shall include the following:</text>
 <paragraph id="id473bbcc584a44b57bec5ab7f475ef163"><enum>(1)</enum><text>A summary of the significant previous employment and accomplishments of the individual, such as a career biography and any academic degrees earned.</text>
 </paragraph><paragraph id="idd11a4275d9d541fbbded89ac0c6bc6b3"><enum>(2)</enum><text>Any other information appropriate to demonstrate that the individual is well-qualified to meet the needs of the intelligence community and that there is no significant and credible information to suggest that the individual is unfit or unqualified for such a position.</text>
 </paragraph></subsection><subsection id="id0f2a8d16f1b34a61aab31675ad30fb2b"><enum>(d)</enum><header>Notification of separation</header><text>A notification of a separation of an individual from a senior level position required by subsection (a) shall include the effective date of the separation.</text>
				</subsection></section></title><title id="id40C8F61E93CF4B069B78FE0EDEF70804"><enum>IV</enum><header>Matters relating to elements of the intelligence community</header>
			<subtitle id="id337F52F0051F4425BCF8F4910847AD73" style="OLC"><enum>A</enum><header>Director of National Intelligence</header>
				<section id="id98FA3CDB42364424AC5D1709548A46CC"><enum>401.</enum><header>Appointment and confirmation of the National Counterintelligence Executive</header>
 <text display-inline="no-display-inline">Section 902(a) of the Counterintelligence Enhancement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/50/3382">50 U.S.C. 3382</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id48FE068B9BCF4A3CB8F7BCDFFB151B74" style="OLC">
 <subsection id="idDF8D1D64D0274EA8B23EF3D94286DAF7"><enum>(a)</enum><header>Establishment</header><paragraph commented="no" display-inline="yes-display-inline" id="idAFA5572370BC4B73BF6A7AC4348AB470"><enum>(1)</enum><text>There shall be a National Counterintelligence Executive who shall be appointed by the President, by and with the advice and consent of the Senate.</text>
 </paragraph><paragraph id="idC9A746C5D625486E8595DA99EB64414A" indent="up1"><enum>(2)</enum><text>The President shall make an initial appointment of the National Counterintelligence Executive under paragraph (1) not later than one year after the date of the enactment of the Intelligence Authorization Act for Fiscal Year 2016.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HF36933F817484694AB9E8A2AF0A6502A"><enum>402.</enum><header>Inclusion of Inspector General of the Intelligence Community in Council of Inspectors General on
 Integrity and Efficiency</header><text display-inline="no-display-inline">Section 11(b)(1)(B) of the Inspector General Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/452">Public Law 95–452</external-xref>; 5 U.S.C. App.) is amended by striking <quote>Office of the Director of National Intelligence</quote> and inserting <quote>Intelligence Community</quote>.</text>
 </section><section display-inline="no-display-inline" id="H2BB98A4779B247AA8FF703DB09027831" section-type="subsequent-section"><enum>403.</enum><header>Provision of information and assistance to Inspector General of the Intelligence Community</header><text display-inline="no-display-inline">Section 103H(j)(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(j)(4)</external-xref>) is amended—</text> <paragraph id="HBC415F34468A485B81088CEB4984104E"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>any department, agency, or other element of the United States Government</quote> and inserting <quote>any Federal, State (as defined in section 804), or local governmental agency or unit thereof</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04B0D0347A7B4003AF113FF2197EE9AB"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>from a department, agency, or element of the Federal Government</quote> before <quote>under subparagraph (A)</quote>.</text> </paragraph></section></subtitle><subtitle id="id734FDC01944D49C383D7B3B5C11298E7" style="OLC"><enum>B</enum><header>Central Intelligence Agency</header> <section id="id509E838020D1414A8875C593BD32A773"><enum>411.</enum><header>Analytic objectivity review</header> <subsection id="idDCF653BB1B6D421E8454D2E5FAA9D7E7"><enum>(a)</enum><header>Assessment</header><text>The Director of National Intelligence shall assign the Chief of the Analytic Integrity and Standards Group, in consultation with the Senior Analytic Service at the Central Intelligence Agency, to conduct a review of finished intelligence products produced by the Central Intelligence Agency to assess whether the reorganization of the Agency, announced publicly on March 6, 2015, has resulted in any loss of analytic objectivity.</text>
 </subsection><subsection id="id76D0847443B945088B2440E5479382CE"><enum>(b)</enum><header>Submission</header><text>Not later than March 6, 2017, the Director of National Intelligence shall submit to the congressional intelligence committees, in writing, the results of the review required under subsection (a), including—</text>
 <paragraph id="id3A5721BE345D477C90B05AD7D279F9E8"><enum>(1)</enum><text>an assessment comparing a representative sample of finished intelligence products produced by the Central Intelligence Agency before the reorganization and a representative sample of such finished intelligence products produced after the reorganization, with a focus on the analytic standard of objectivity;</text>
 </paragraph><paragraph id="idF08EE9C84B0242B28BB19B8AE5B2EF22"><enum>(2)</enum><text>an assessment comparing the historical results of anonymous surveys of Central Intelligence Agency analysts and customers conducted before the reorganization and the results of such anonymous surveys conducted after the reorganization, with a focus on the analytic standard of objectivity;</text>
 </paragraph><paragraph id="id452BBCFD76A14D029B720ABE85EF3D2F"><enum>(3)</enum><text>a metrics-based evaluation measuring the effect that the reorganization’s integration of operational, analytic, support, technical, and digital personnel and capabilities into Mission Centers has had on analytic objectivity; and</text>
 </paragraph><paragraph id="id733B622AF3D44E4894A1467BF637E704"><enum>(4)</enum><text>any recommendations for ensuring that Central Intelligence Agency analysts perform their functions with objectivity, are not unduly constrained, and are not influenced by the force of preference for a particular policy.</text>
						</paragraph></subsection></section><section id="HDDC8F5441495427EB6EECA44BF9D967C"><enum>412.</enum><header>Authorities of the Inspector General for the Central Intelligence Agency</header>
 <subsection id="H957A5B31D34249A5AFEAB7D78BB7C3C5"><enum>(a)</enum><header>Information and assistance</header><text display-inline="yes-display-inline">Paragraph (9) of section 17(e) of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3517">50 U.S.C. 3517(e)(9)</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HE449CCBFC1214D41B3D5BD85998F2D3A" style="OLC">
							<paragraph id="H2619B0FAA0454A1BB295A410E179DBB1" indent="up1"><enum>(9)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H004F2D20C42244ABB6FFA76C1F931DA6"><enum>(A)</enum><text display-inline="yes-display-inline">The Inspector General may request such information or assistance as may be necessary for carrying out the duties and responsibilities of the Inspector General provided by this section from any Federal, State, or local governmental agency or unit thereof.</text>
 </subparagraph><subparagraph id="H60F6D092F3A645519474D6898174394C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Upon request of the Inspector General for information or assistance from a department or agency of the Federal Government, the head of the department or agency involved, insofar as practicable and not in contravention of any existing statutory restriction or regulation of such department or agency, shall furnish to the Inspector General, or to an authorized designee, such information or assistance.</text>
 </subparagraph><subparagraph id="HE10C8459D3C94615A0850275C190605C" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to provide any new authority to the Central Intelligence Agency to conduct intelligence activity in the United States.</text>
 </subparagraph><subparagraph id="H2EF625F3819F44EC8FFC4AE35274D5F6" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In this paragraph, the term State means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and any territory or possession of the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H02DDA1CFC76447BC9C255AEA2DD19774"><enum>(b)</enum><header>Technical amendments relating to selection of employees</header><text display-inline="yes-display-inline">Paragraph (7) of such section (<external-xref legal-doc="usc" parsable-cite="usc/50/3517">50 U.S.C. 3517(e)(7)</external-xref>) is amended—</text> <paragraph id="H7AEBEAA418904BCAB77F688888FA6A70"><enum>(1)</enum><text>by inserting <quote>(A)</quote> before <quote>Subject to applicable law</quote>; and</text>

 </clause><clause commented="no" display-inline="no-display-inline" id="H8B62D13DD876479687A4558C7B42AADB"><enum>(ii)</enum><text display-inline="yes-display-inline">all other personnel decisions concerning personnel permanently assigned to the Office of Inspector General, including selection and appointment to the Senior Intelligence Service, but excluding all security-based determinations that are not within the authority of a head of other Central Intelligence Agency offices.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section></subtitle></title><title id="id6F825B362309405091D824B90AE4AAB1"><enum>V</enum><header>Matters relating to foreign countries</header>
			<subtitle id="idCBD2C821EBD64A38B2094E778225015C" style="OLC"><enum>A</enum><header>Matters relating to Russia</header>
				<section id="idC5998C48011641C9A9B6C0A6D3E9A0EC" section-type="subsequent-section"><enum>501.</enum><header>Notice of deployment or transfer of Club-K container missile system by the Russian Federation</header>
 <subsection id="id11B214359C324B96BCDD6FD5EACE8393"><enum>(a)</enum><header>Notice to Congress</header><text>The Director of National Intelligence shall submit to the appropriate committees of Congress written notice if the intelligence community receives intelligence that the Russian Federation has—</text>
 <paragraph id="id459DBDAA0F904886AE91960573B5A47F"><enum>(1)</enum><text>deployed, or is about to deploy, the Club-K container missile system through the Russian military; or</text>
 </paragraph><paragraph id="idD006911C4E7B4CE5801D39E697CFB1CA"><enum>(2)</enum><text>transferred or sold, or intends to transfer or sell, the Club-K container missile system to another state or non-state actor.</text>
 </paragraph></subsection><subsection id="id4FEAEA5FDF9B4EAD954EEC48E24B128D"><enum>(b)</enum><header>Notice to congressional intelligence committees</header><text display-inline="yes-display-inline">Not later than 30 days after the date that a notice is submitted under subsection (a), the Director of National Intelligence shall submit to the congressional intelligence committees a written update regarding any intelligence community engagement with a foreign partner on the deployment and impacts of a deployment of the Club-K container missile system to any potentially impacted nation.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="id50353998A8D2486B981EFF3E86581312" section-type="subsequent-section"><enum>502.</enum><header>Assessment on the funding of political parties and nongovernmental organizations by the Russian
 Federation</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate committees of Congress an intelligence community assessment on the funding of political parties and nongovernmental organizations in former Soviet States and Europe by the Russian Federation and the Russian Federation security and intelligence services since January 1, 2006. Such assessment shall include the country involved, the entity funded, the security service involved, and the intended impact.</text>
				</section><section id="H3C5B02B3B113426F8113902AEFB33887" section-type="subsequent-section"><enum>503.</enum><header>Assessment on the use of political assassinations as a form of statecraft by the Russian Federation</header>
 <subsection id="idA23CF9460AB842038C92D31B062B0EFB"><enum>(a)</enum><header>Requirement for assessment</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate committees of Congress an intelligence community assessment on the use of political assassinations as a form of statecraft by the Russian Federation since January 1, 2000.</text>
 </subsection><subsection id="id7E3E423D54974EA883C8325797B78D76"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">The assessment required by subsection (a) shall include—</text> <paragraph id="id289B36745B72416D9E50A3DBCDA404FF"><enum>(1)</enum><text display-inline="yes-display-inline">a list of Russian politicians, businessmen, dissidents, journalists, current or former government officials, foreign heads-of-state, foreign political leaders, foreign journalists, members of nongovernmental organization, and other relevant individuals that the intelligence community assesses were assassinated by Russian Security Services, or agents of such Services, since January 1, 2000; and</text>
 </paragraph><paragraph id="id5534691B91EA416F8462B42C000EFAE9"><enum>(2)</enum><text display-inline="yes-display-inline">for each individual described in paragraph (1), the country in which the assassination took place, the means used, associated individuals and organizations, and other background information related to the assassination of the individual.</text>
						</paragraph></subsection></section></subtitle><subtitle id="idD9A60D48B5E44E86A8D11CF5D0EEA89D" style="OLC"><enum>B</enum><header>Matters relating to other countries</header>
				<section id="id5446f07bd3e14ed5be1e47276168066e"><enum>511.</enum><header>Report on resources and collection posture with regard to the South China Sea and East China Sea</header>
 <subsection id="id68ff9abb43ef4d74b194c9598cf4c643"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees an intelligence community assessment on the resources utilized for collection efforts and the collection posture of the intelligence community with regard to the South China Sea and East China Sea.</text>
 </subsection><subsection id="id4848edf8d8ee45cbb6a21a5f809d6006"><enum>(b)</enum><header>Elements</header><text>The intelligence community assessment required by subsection (a) shall provide detailed information related to United States intelligence collection with regard to the South China Sea and East China Sea, to include—</text>
 <paragraph id="ida057baa8ce004d1a897e38f2e9046ef6"><enum>(1)</enum><text>a review of intelligence community collection activities and a description of these activities, to include the lead agency, key partners, purpose of collection activity, annual funding and personnel, the manner in which the collection is conducted, and types of information collected;</text>
 </paragraph><paragraph id="id3cdfffbeb4f742c3869d7fe26b7b9db1"><enum>(2)</enum><text>an explanation of how the intelligence community prioritizes and coordinates collection activities focused on the region; and</text>
 </paragraph><paragraph id="idbeff3841868c4599be942eb177441eb8"><enum>(3)</enum><text>a description of any collection and resourcing gaps and efforts being made to address them.</text> </paragraph></subsection></section><section id="idd774f1876f9b4167a3f4d0160a504dfd"><enum>512.</enum><header>Replacement of locally employed staff serving at United States diplomatic facilities in Cuba</header> <subsection id="idCDC45038011047B09A41AF19DF9E5578"><enum>(a)</enum><header>Employment requirement</header> <paragraph id="idDF89CC2A2B8B46F683D7E14F962E7E55"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided under paragraph (2), the Secretary of State shall ensure that, not later than 1 year after the date of the enactment of this Act, every supervisory position at a United States diplomatic facility in Cuba is occupied by a citizen of the United States who has been subjected to, and has passed, a thorough background check.</text>
 </paragraph><paragraph id="id4655EC99570C464E8224B595E26C5B92"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary of State may extend the deadline under paragraph (1) for up to 1 year by providing advance written notification and justification of such extension to the appropriate congressional committees.</text>
 </paragraph><paragraph id="idB320DC9133FB41F299B1AE0F70B2D53C"><enum>(3)</enum><header>Progress report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the appropriate congressional committees that describes the progress made toward meeting the requirement under paragraph (1).</text>
 </paragraph></subsection><subsection id="id6bba8204d48846739d4e40b4d90ed8c6"><enum>(b)</enum><header>Plan for reduced use of locally employed staff</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in coordination with other appropriate Federal agencies, shall submit a plan to the appropriate congressional committees for reducing the reliance on locally employed staff in United States diplomatic facilities in Cuba that includes cost estimates, timelines, and numbers of employees to be replaced.</text>
 </subsection><subsection id="id57d6a8992bf3493e909e480b13851f18"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="id2A9885CC50F54E889A1C6D1FE8DECDEE"><enum>(1)</enum><text>the congressional intelligence committees;</text>
 </paragraph><paragraph id="id468E1C27BD3145BAB3A994AC192DAEEB"><enum>(2)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations and </committee-name>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>; and</text> </paragraph><paragraph id="id5B1124D3BA89449D907A6E1AEBFE607D"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs</committee-name> and the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text>
						</paragraph></subsection></section><section id="id2b267d179505492b92406c76949831af"><enum>513.</enum><header>Inclusion of  sensitive compartmented information facilities in United States diplomatic facilities
			 in Cuba</header>
 <subsection id="idd380bbc1c90d4a1bad38b0381fdf2418"><enum>(a)</enum><header>Restricted access space requirement</header><text>Each United States diplomatic facility that, after the date of the enactment of this Act, is constructed in, or undergoes a construction upgrade in Cuba shall be constructed to include a sensitive compartmented information facility.</text>
 </subsection><subsection id="id8a5356a243834f4c9b0184dad2f76a78"><enum>(b)</enum><header>National security waiver</header><text>The Secretary of State may waive the requirement under subsection (a) if the Secretary—</text> <paragraph id="id01A47C331C234431B37388CD72C198A5"><enum>(1)</enum><text>determines that such waiver is in the national security interest of the United States; and</text>
 </paragraph><paragraph id="id3971FD8747DC4AB58090686041EABA2A"><enum>(2)</enum><text>submits a written justification for such waiver to the relevant congressional committees not later than 180 days before exercising such waiver.</text>
 </paragraph></subsection><subsection id="idDED388FFBDFD423193323BB09E847BA7"><enum>(c)</enum><header>Relevant congressional committees defined</header><text>In this section, the term <term>relevant congressional committees</term> means—</text> <paragraph id="idCA3CD614B97647B7A990BD12809EDB38"><enum>(1)</enum><text>the appropriate committees of Congress;</text>
 </paragraph><paragraph id="id2CBC8C1E3DE14F84A2110F1111C14A9F"><enum>(2)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>; and</text> </paragraph><paragraph id="id456DD35F259744A8BCC99F4DE7EDB054"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text>
						</paragraph></subsection></section><section id="idAB55A57EBC8843FE9C969FB38BE20F24"><enum>514.</enum><header>Report on use by Iran of funds made available through sanctions relief</header>
 <subsection id="id1CA03241373E48A7AD668A3147031321"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">At the times specified in subsection (b), the Director of National Intelligence, in consultation with the Secretary of the Treasury, shall submit to the appropriate congressional committees a report assessing the following:</text>
 <paragraph id="id14542862960244158b004abe30dbdace"><enum>(1)</enum><text>The monetary value of any direct or indirect forms of sanctions relief that Iran has received since the Joint Plan of Action first entered into effect.</text>
 </paragraph><paragraph id="ided210090d54c40a8ac8485cecb2a5509"><enum>(2)</enum><text>How Iran has used funds made available through sanctions relief, including the extent to which any such funds have facilitated the ability of Iran—</text>
 <subparagraph id="id09895F1F1BCB4718A9E774DFE35A9479"><enum>(A)</enum><text>to provide support for—</text> <clause id="id9a2fdd901e07433ca71b1d840e768815"><enum>(i)</enum><text>any individual or entity designated for the imposition of sanctions for activities relating to international terrorism pursuant to an Executive order or by the Office of Foreign Assets Control of the Department of the Treasury on or before the enactment of this Act;</text>
 </clause><clause id="id7bc00ee72164427390c361c7eab433d2"><enum>(ii)</enum><text>any organization designated by the Secretary of State as a foreign terrorist organization under section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>) on or before the enactment of this Act; or</text>
 </clause><clause id="idbc43aaeb5c3640a89a2490a95b10cd06"><enum>(iii)</enum><text>any other terrorist organization, including Hamas, Hezbollah, Palestinian Islamic Jihad, or the regime of Bashar al-Assad in Syria;</text>
 </clause></subparagraph><subparagraph id="idf2c9b996f2f14a3794c2a0253f0a3a64"><enum>(B)</enum><text>to advance the efforts of Iran or any other country to develop nuclear weapons or ballistic missiles overtly or covertly; or</text>
 </subparagraph><subparagraph id="id4ea203a1320d48ff912c64839dc855d4"><enum>(C)</enum><text>to commit any violation of the human rights of the people of Iran.</text> </subparagraph></paragraph><paragraph id="idedf65574edd34474ab65ab45bbdd31bc"><enum>(3)</enum><text>The extent to which any senior officials of the Government of Iran have diverted any funds from sanctions relief into their personal accounts.</text>
						</paragraph></subsection><subsection id="idC8106B8797A34FEB840DAF0E600908BE"><enum>(b)</enum><header>Submission to Congress</header>
 <paragraph id="id0A5331F1DCAC4074A974BC50D987F648"><enum>(1)</enum><header>In general</header><text>The Director shall submit the report required by subsection (a) to the appropriate congressional committees—</text>
 <subparagraph id="idCAE9C04D027444968EB931D0A36FA0CE"><enum>(A)</enum><text>not later than 180 days after the date of the enactment of this Act and every 180 days thereafter while the Joint Plan of Action is in effect; and</text>
 </subparagraph><subparagraph id="id5AF96BD87ED14B67ABE3F1AC84283919"><enum>(B)</enum><text>not later than one year after a subsequent agreement with Iran relating to Iran's nuclear program takes effect and annually thereafter while that agreement remains in effect.</text>
 </subparagraph></paragraph><paragraph id="idDDBBA3849F484D078884E23C436ADB9C"><enum>(2)</enum><header>Nonduplication</header><text>The Director may submit the information required by subsection (a) with a report required to be submitted to Congress under another provision of law if—</text>
 <subparagraph id="idC8405ED5E9394119A4D316D1A704999A"><enum>(A)</enum><text>the Director notifies the appropriate congressional committees of the intention of the Director to do so before submitting that report; and</text>

 <subparagraph id="id718011ED490D47909685EF229A1423F1"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Finance, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text>
 </subparagraph><subparagraph id="id826BAC026DC2401C8557F038CA0447F3"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Ways and Means, and the Permanent Select Committee on Intelligence of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph id="idE5083F845A87482791A45E539AA9B99F"><enum>(2)</enum><header>Joint Plan of Action</header><text>The term <term>Joint Plan of Action</term> means the Joint Plan of Action, signed at Geneva November 24, 2013, by Iran and by France, Germany, the Russian Federation, the People’s Republic of China, the United Kingdom, and the United States, and all implementing materials and agreements related to the Joint Plan of Action, including the technical understandings reached on January 12, 2014, the extension thereto agreed to on July 18, 2014, and the extension thereto agreed to on November 24, 2014.</text>
						</paragraph></subsection></section></subtitle></title><title id="id9C2A9195A39448E1A4D1A716BA1401E7"><enum>VI</enum><header>General provisions</header>
			<section commented="no" id="idf9672a1cd29541dd8b314e3b301c95a1"><enum>601.</enum><header>Intelligence oversight exception for contractual non-disclosure provisions</header>
 <subsection commented="no" id="id14b0a7f5236a4dd9b727a04a40f6e165"><enum>(a)</enum><header>In general</header><text>No provision of an intelligence contract that prohibits the disclosure of information may be construed to prohibit an element of the intelligence community from providing information to the congressional intelligence committees.</text>
 </subsection><subsection commented="no" id="idCF7E2538282A40848C57A9DE17ECC700"><enum>(b)</enum><header>Intelligence contract defined</header><text>In this section, the term <quote>intelligence contract</quote> means a contract entered into by an element of the intelligence community.</text> </subsection><subsection commented="no" id="id715083db9d36429d896c2c00e9d4e15d"><enum>(c)</enum><header>Limitation on liability</header><text>No cause of action shall lie in any court against an element of the intelligence community or an officer, employee, or contractor of such element that provides information pursuant to subsection (a).</text>
 </subsection><subsection commented="no" id="id27c43b3b152e48fd92fd624ba960474d"><enum>(d)</enum><header>Construction</header><text>Nothing in this section may be construed to modify the requirements of section 5.403 of title 48, Code of Federal Regulations (related to requests from Members of Congress).</text>
				</subsection></section><section commented="no" id="idBBB2D016779C4CCAAE5738748111A9A6"><enum>602.</enum><header>Notification of changes to retention of call detail record policies</header>
 <subsection commented="no" id="id2c82a23fc5f6442ea3971526eade30bc"><enum>(a)</enum><header>Requirement To retain</header><text>Not later than 15 days after learning that an electronic communication service provider that generates call detail records in the ordinary course of business has changed its policy on the retention of such call detail records to result in a retention period of less than 18 months, the Director of National Intelligence shall provide written notification of such change to the congressional intelligence committees.</text>
 </subsection><subsection commented="no" id="idbd69f66b33f24a53966bd0dd7128ded0"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="idE7199A1983CE4C82B8FCEFB6859F89DF"><enum>(1)</enum><header>Call detail record</header><text>The term <term>call detail record</term>—</text>
 <subparagraph commented="no" id="id8714B26F931249728050EDDBBDA605EB"><enum>(A)</enum><text>means session-identifying information (including an originating or terminating telephone number, an International Mobile Subscriber Identity number, or an International Mobile Station Equipment Identity number), a telephone calling card number, or the time or duration of a call; and</text>
 </subparagraph><subparagraph commented="no" id="idEDCDF43F093C47788FCC01981B14A2B6"><enum>(B)</enum><text>does not include—</text> <clause commented="no" id="idBEEBDB78072B45DFAA9D657A5C7753E2"><enum>(i)</enum><text>the contents (as defined in section 2510(8) of title 18, United States Code) of any communication;</text>
 </clause><clause commented="no" id="id467E9547FD1945B8A8D6E3890770156B"><enum>(ii)</enum><text>the name, address, or financial information of a subscriber or customer; or</text> </clause><clause commented="no" id="id90D093CCD1B04B2B969DAEEF6BEBC4D8"><enum>(iii)</enum><text>cell site location or global positioning system information.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="idF8AF48F9D66F4365B302C4EF63553F8B"><enum>(2)</enum><header>Electronic communication service</header><text>The term <term>electronic communication service</term> has the meaning given that term in section 2510 of title 18, United States Code.</text> </paragraph></subsection></section><section id="id74E5C7B16F84430886009C81E4C2336B"><enum>603.</enum><header>Requirement to report terrorist activities and the unlawful distribution of information relating to explosives</header> <subsection id="id55F3A083DD63453DB50768F7A2D8F92F"><enum>(a)</enum><header>Duty To report</header><text>Whoever, while engaged in providing an electronic communication service or a remote computing service to the public through a facility or means of interstate or foreign commerce, obtains actual knowledge of any terrorist activity, including the facts or circumstances described in subsection (c) shall, as soon as reasonably possible, provide to the appropriate authorities the facts or circumstances of the alleged terrorist activities.</text>
 </subsection><subsection id="id466F63A1269D4B258CE67A1555E26058"><enum>(b)</enum><header>Attorney General determination</header><text>The Attorney General shall determine the appropriate authorities under subsection (a).</text> </subsection><subsection id="id0F339A2BA7364B72B964CDDC4695C561"><enum>(c)</enum><header>Facts or circumstances</header><text>The facts or circumstances described in this subsection, include any facts or circumstances from which there is an apparent violation of section 842(p) of title 18, United States Code, that involves distribution of information relating to explosives, destructive devices, and weapons of mass destruction.</text>
 </subsection><subsection id="idFCC5565C34D345F081DEA615AFEF5497"><enum>(d)</enum><header>Protection of privacy</header><text>Nothing in this section may be construed to require an electronic communication service provider or a remote computing service provider—</text>
 <paragraph id="id5C6123AEFCB4472AA00306C86C50C207"><enum>(1)</enum><text>to monitor any user, subscriber, or customer of that provider; or</text> </paragraph><paragraph id="idD5B38C5A79C8469EAEC9618FD6703E4D"><enum>(2)</enum><text>to monitor the content of any communication of any person described in paragraph (1).</text>
					</paragraph></subsection></section><section id="id2670C5FC8FBA4F0CA53827B93342C60B"><enum>604.</enum>
 <header>Broadening the scope of the Office of the Director of National Intelligence tradecraft review</header><text display-inline="no-display-inline">Section 1019(b)(2)(A) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3364">50 U.S.C. 3364(b)(2)(A)</external-xref>) is amended by striking <quote>and incorporate, where appropriate, alternative analyses; and</quote> and inserting <quote>incorporate, where appropriate, alternative analyses, and explain how substantially similar, contemporaneous intelligence products are distinct in terms of source material, timeframe, methodology, or other distinguishing analytic characteristic; and</quote>.</text>
			</section><section id="id4f99411e20d549d98914cabc552de3ba"><enum>605.</enum><header>Strategy for comprehensive interagency review of the United States national security overhead
			 satellite architecture</header>
 <subsection id="idc69e7f16e59647cf99c1ca20d3d09fd3"><enum>(a)</enum><header>Requirement for strategy</header><text>The Director of National Intelligence shall collaborate with the Secretary of Defense and the Chairman of the Joint Chiefs of Staff to develop a strategy, with milestones and benchmarks, to ensure that there is a comprehensive interagency review of policies and practices for planning and acquiring national security satellite systems and architectures, including the capabilities of commercial systems and partner countries, consistent with the National Space Policy issued on June 28, 2010. Such strategy shall, where applicable, account for the unique missions and authorities vested in the Department of Defense and the intelligence community.</text>
 </subsection><subsection id="id5a08c6dd77f34d6bab26b93d85b330a5"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall ensure that the United States national security overhead satellite architecture—</text>
 <paragraph id="id4b0722d8b1a243daa683d3dea754a7e1"><enum>(1)</enum><text>meets the needs of the United States in peace time and is resilient in war time;</text> </paragraph><paragraph id="id9973517c8f924817be94a325ac734182"><enum>(2)</enum><text>responsibly stewards the taxpayers’ dollars;</text>
 </paragraph><paragraph id="id3771770b3ce9464db16a351714d9ad89"><enum>(3)</enum><text>accurately takes into account cost and performance tradeoffs;</text> </paragraph><paragraph id="idf71a2a5f0d9a4db38509773a880a44dc"><enum>(4)</enum><text>meets realistic requirements;</text>
 </paragraph><paragraph id="id608fd24e85094d0f82c810703f349f99"><enum>(5)</enum><text>produces excellence, innovation, competition, and a robust industrial base;</text> </paragraph><paragraph id="id65d40475215343d5a5696e5d15b2626f"><enum>(6)</enum><text>aims to produce innovative satellite systems in less than 5 years that are able to leverage common, standardized design elements and commercially available technologies;</text>
 </paragraph><paragraph id="id08501e86411548958dc01cf48fb40fa0"><enum>(7)</enum><text>takes advantage of rapid advances in commercial technology, innovation, and commercial-like acquisition practices;</text>
 </paragraph><paragraph id="id7553b9593f194bb099ef5df1b520953f"><enum>(8)</enum><text>is open to innovative concepts such as distributed, disaggregated architectures that could allow for better resiliency, reconstitution, replenishment, and rapid technological refresh; and</text>
 </paragraph><paragraph id="id8772b896379040d6860a1f0b988298e5"><enum>(9)</enum><text>emphasizes deterrence and recognizes the importance of offensive and defensive space control capabilities.</text>
 </paragraph></subsection><subsection id="idebfd1bb12d874c95917a4f9708ccf955"><enum>(c)</enum><header>Report on strategy</header><text>Not later than February 28, 2016, the Director of National Intelligence, the Secretary of Defense, and the Chairman of the Joint Chiefs of Staff shall submit to the congressional intelligence committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives a report on the strategy required by subsection (a).</text>
 </subsection></section><section id="id598192667F2F41AAB70D0803523526A1"><enum>606.</enum><header>Unauthorized dealings in special nuclear material</header><text display-inline="no-display-inline">Section 57b.(2) of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077(b)(2)</external-xref>) is amended in the first sentence in the proviso by inserting <quote>the Director of National Intelligence,</quote> after <quote>Commerce,</quote>.</text>
			</section><section id="id4da4c765f68348bd8b8e37b54416300f"><enum>607.</enum><header>Enhancing government personnel security programs</header>
 <subsection id="id2c69bbf393894ebabf8ec3f2d24d7e8c"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id3c8e3900e59445d4967fb3f909957451"><enum>(1)</enum><header>Covered individual</header><text>The term <quote>covered individual</quote> means an individual who has been determined eligible for access to classified information or eligible to hold a sensitive position.</text>
 </paragraph><paragraph id="idd55c303cfbd64ec0812ff04194bc5c1c"><enum>(2)</enum><header>Periodic reinvestigations</header><text>The term <quote>periodic reinvestigations</quote> means investigations conducted periodically, with a frequency as required by the Director of National Intelligence, for the purpose of updating a previously completed background investigation.</text>
					</paragraph></subsection><subsection id="id337d8db7cb374ba4ac4033444e7f28d6"><enum>(b)</enum><header>Resolution of backlog of overdue periodic reinvestigations</header>
 <paragraph id="idaf680afcbbcc44aebadc18489f8516ab"><enum>(1)</enum><header>In general</header><text>The Director of National Intelligence shall develop and implement a plan to eliminate the backlog of overdue periodic reinvestigations of covered individuals.</text>
 </paragraph><paragraph id="id2e209f9828044934bc8069bbee6a10c5"><enum>(2)</enum><header>Requirements</header><text>The plan developed under paragraph (1) shall—</text> <subparagraph id="id60452d404c404b6bb0eec886251690f6"><enum>(A)</enum><text>use a risk-based approach to—</text>
 <clause id="id0dfd517a50634d18b3f3e2861ca5bf4a"><enum>(i)</enum><text>identify high-risk populations; and</text> </clause><clause id="idfdfede0362454ea1af9e4e09da975ba1"><enum>(ii)</enum><text>prioritize reinvestigations that are due or overdue to be conducted; and</text>
 </clause></subparagraph><subparagraph id="id420bdacfa14d4a5db5bd1ca9883576cc"><enum>(B)</enum><text>use random automated record checks of covered individuals that shall include all covered individuals in the pool of individuals subject to a one-time check.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc80e411806714d9fb3de710fdfe6301d"><enum>(c)</enum><header>Enhanced security clearance programs</header><text>Part III of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4551D714D3EC4B7D9193C88A47FE2D68" style="OLC"> <subpart id="idd2274c8f76fd49e4bf47c73a6e2dc216"><enum>J</enum><header>Enhanced personnel security programs</header> <chapter id="id680e128812c64c8e944e87019b161f3e"><enum>110</enum><header>Enhanced personnel security programs</header><toc><toc-entry level="section">Sec. </toc-entry><toc-entry level="section">11001. Enhanced personnel security programs.</toc-entry></toc> <section id="id85A5FA029EE44EAAB332D8C4F17BD542"><enum>11001.</enum><header>Enhanced personnel security programs</header> <subsection id="id719cca69338f4e7f896bf6ee12be1dab"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="idca938ab4dd894b7ba44fe61d3740f628"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given that term in section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>);</text>
 </paragraph><paragraph id="id64f4dbd1115c4546ac553162d4603e58"><enum>(2)</enum><text>the term <term>consumer reporting agency</term> has the meaning given that term in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>);</text> </paragraph><paragraph id="id976b659b0f2242cba54f84e32041ef7d"><enum>(3)</enum><text>the term <term>covered individual</term> means an individual who has been determined eligible for access to classified information or eligible to hold a sensitive position;</text>
 </paragraph><paragraph id="id3e18fa4941b74470ac2a019896e8191c"><enum>(4)</enum><text>the term <term>enhanced personnel security program</term> means a program implemented by an agency at the direction of the Director of National Intelligence under subsection (b); and</text>
 </paragraph><paragraph id="idCAADAA35A1104910881475EEAC00ADBE"><enum>(5)</enum><text>the term <term>periodic reinvestigations</term> means investigations conducted periodically, with a frequency as required by the Director of National Intelligence, for the purpose of updating a previously completed background investigation.</text>
 </paragraph></subsection><subsection id="id1a257abc780f453882cb6439d1a1824b"><enum>(b)</enum><header>Enhanced Personnel Security Program</header><text>The Director of National Intelligence shall direct each agency to implement a program to provide enhanced security review of covered individuals—</text>
 <paragraph id="idf76787a938854f1b88cb7dcea709e15a"><enum>(1)</enum><text>in accordance with this section; and</text> </paragraph><paragraph id="idee4d1f9fe3af420a8227a014c755672b"><enum>(2)</enum><text>not later than the earlier of—</text>
 <subparagraph id="idf7773c1741e4446d8edd686b78e3547a"><enum>(A)</enum><text>the date that is 5 years after the date of enactment of the <short-title>Intelligence Authorization Act for Fiscal Year 2016</short-title>; or</text> </subparagraph><subparagraph id="id1e2bff022f9044bb913da7ba484b49cd"><enum>(B)</enum><text>the date on which the backlog of overdue periodic reinvestigations of covered individuals is eliminated, as determined by the Director of National Intelligence.</text>
											</subparagraph></paragraph></subsection><subsection id="id0927378d32c54f20a3cf0097364709ee"><enum>(c)</enum><header>Comprehensiveness</header>
 <paragraph id="idd976c26a54fd43bf98e4ade47c559fb1"><enum>(1)</enum><header>Sources of information</header><text>The enhanced personnel security program of an agency shall integrate relevant information from various sources, including government, publicly available, and commercial data sources, consumer reporting agencies, social media, and such other sources as determined by the Director of National Intelligence.</text>
 </paragraph><paragraph id="id713dd7cefb784e34850a10923b8a4093"><enum>(2)</enum><header>Types of information</header><text>Information obtained and integrated from sources described in paragraph (1) may include—</text> <subparagraph id="ideb71638aad1b416d94c39ffeea96df4f"><enum>(A)</enum><text>information relating to any criminal or civil legal proceeding;</text>
 </subparagraph><subparagraph id="id1bee2f84523744e19dd6f4e2f90312fa"><enum>(B)</enum><text>financial information relating to the covered individual, including the credit worthiness of the covered individual;</text>
 </subparagraph><subparagraph id="id22204a701d29434495f85a7340edf5e7"><enum>(C)</enum><text>public information, including news articles or reports, that includes relevant security or counterintelligence information about the covered individual;</text>
 </subparagraph><subparagraph id="id2e002adfe8e64af2888fd5184a9456c2"><enum>(D)</enum><text>publicly available electronic information, to include relevant security or counterintelligence information on any social media website or forum, that may suggest ill intent, vulnerability to blackmail, compulsive behavior, allegiance to another country, change in ideology, or any other information that may suggest the covered individual lacks good judgment, reliability or trustworthiness; and</text>
 </subparagraph><subparagraph id="idbb535b1990734bd8a9872a9fffd29942"><enum>(E)</enum><text>data maintained on any terrorist or criminal watch list maintained by any agency, State or local government, or international organization.</text>
											</subparagraph></paragraph></subsection><subsection id="id1c9a65710b2d45ffa562e75cbcfb680c"><enum>(d)</enum><header>Reviews of covered individuals</header>
										<paragraph id="id405113bcdb5f4a5c848f23f2da87e4d1"><enum>(1)</enum><header>Reviews</header>
 <subparagraph id="idec1f7aba124442f7873c79504c2c19dd"><enum>(A)</enum><header>In general</header><text>The enhanced personnel security program of an agency shall require that, not less than 2 times every 5 years, the head of the agency shall conduct or request the conduct of automated record checks and checks of information from sources under subsection (c) to ensure the continued eligibility of each covered individual employed by the agency or a contractor of the agency, unless more frequent reviews of automated record checks and checks of information from sources under subsection (c) are conducted on the covered individual.</text>
 </subparagraph><subparagraph id="id73dc6b9ece3f453fad7f4c49898a624e"><enum>(B)</enum><header>Scope of reviews</header><text>Except for a covered individual who is subject to more frequent reviews to ensure the continued eligibility of the covered individual, the reviews under subparagraph (A) shall consist of random or aperiodic checks of covered individuals, such that each covered individual is subject to at least 2 reviews during the 5-year period beginning on the date on which the agency implements the enhanced personnel security program of an agency, and during each 5-year period thereafter.</text>
 </subparagraph><subparagraph id="idf75b5b1fba2c41b9918c8d906f8b33ef"><enum>(C)</enum><header>Individual reviews</header><text>A review of the information relating to the continued eligibility of a covered individual under subparagraph (A) may not be conducted until after the end of the 120-day period beginning on the date the covered individual receives the notification required under paragraph (3).</text>
 </subparagraph></paragraph><paragraph id="idb3f97fb598c84d1a9e30ad3d68ae5a65"><enum>(2)</enum><header>Results</header><text>The head of an agency shall take appropriate action if a review under paragraph (1) finds relevant information that may affect the continued eligibility of a covered individual.</text>
 </paragraph><paragraph id="ida0e9fca88f954644b92e3fce8a79f923"><enum>(3)</enum><header>Information for covered individuals</header><text>The head of an agency shall ensure that each covered individual employed by the agency or a contractor of the agency is adequately advised of the types of relevant security or counterintelligence information the covered individual is required to report to the head of the agency.</text>
 </paragraph><paragraph id="idc13d3161a18b4bdfb92616d550cfadae"><enum>(4)</enum><header>Limitation</header><text>Nothing in this subsection shall be construed to affect the authority of an agency to determine the appropriate weight to be given to information relating to a covered individual in evaluating the continued eligibility of the covered individual.</text>
 </paragraph><paragraph id="idD198F983B1DB40E2A9FE4205ADFBF6C2"><enum>(5)</enum><header>Guidance for minor financial or mental health issues</header><text>The Director of National Intelligence shall issue guidance defining minor financial or mental health issues, in accordance with this section and any direction from the President.</text>
 </paragraph><paragraph id="id3BE09799F66C4AC9B4A8194A6CB1FDD3"><enum>(6)</enum><header>Authority of the President</header><text>Nothing in this subsection shall be construed as limiting the authority of the President to direct or perpetuate periodic reinvestigations of a more comprehensive nature or to delegate the authority to direct or perpetuate such reinvestigations.</text>
										</paragraph></subsection><subsection id="id054d2203860944f1893d95836b275874"><enum>(e)</enum><header>Audit</header>
 <paragraph id="ida358179c6a4a4d16a4d9599ef725ed6b"><enum>(1)</enum><header>In general</header><text>Beginning 2 years after the date of implementation of the enhanced personnel security program of an agency under subsection (b), the Inspector General of the agency shall conduct at least 1 audit to assess the effectiveness and fairness, which shall be determined in accordance with performance measures and standards established by the Director of National Intelligence, to covered individuals of the enhanced personnel security program of the agency.</text>
 </paragraph><paragraph id="id86f2b4f26db3406eb237c369baa5ece9"><enum>(2)</enum><header>Submissions to the DNI</header><text>The results of each audit conducted under paragraph (1) shall be submitted to the Director of National Intelligence to assess the effectiveness and fairness of the enhanced personnel security programs across the Federal Government.</text></paragraph></subsection></section></chapter></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id616FFBDB35844A6286010AE2544C7944"><enum>(d)</enum><header>Technical and conforming amendment</header><text>The table of chapters for part III of title 5, United States Code, is amended by adding at the end following:</text>
