			 and entities.</official-title></form>
	<legis-body id="HBBE76DD971D341F3B78D05F0393A3251" style="OLC">
 <section id="H0FAA76D23C0D42A1B19AB1B4CCC533E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Volunteer Organization Protection Act of 2015</short-title></quote>.</text> </section><section id="H98D4F31D41804C73925015B0236909FB"><enum>2.</enum><header>Liability protection for organization or entity</header><text display-inline="no-display-inline">The Volunteer Protection Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14501">42 U.S.C. 14501 et seq.</external-xref>) is amended—</text>
 <paragraph id="H2153C4A16521467B9718132948A9F39A"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/42/14502">42 U.S.C. 14502</external-xref>)—</text> <subparagraph id="id5D25C7096FA1459E83DA9E26B7137F9D"><enum>(A)</enum><text>in subsection (a), by inserting after <quote>relating to volunteers</quote> the following: <quote>or volunteer nonprofit organizations</quote>; and</text>
 </subparagraph><subparagraph id="H9ECE7FF429E6416089433335150B19DD"><enum>(B)</enum><text>in subsection (b), in the matter preceding paragraph (1), by inserting after <quote>against a volunteer</quote> the following: <quote>or a volunteer nonprofit organization</quote>;</text> </subparagraph></paragraph><paragraph id="H542A86C37F6547DD8825A39041C04F9B"><enum>(2)</enum><text>in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/42/14503">42 U.S.C. 14503</external-xref>)—</text>
 <subparagraph id="id60F3D14BE4E94FD39DBFF5F1FE9D1889"><enum>(A)</enum><text>in the heading, by inserting <quote><header-in-text level="section" style="OLC">and volunteer nonprofit organizations</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">volunteers</header-in-text></quote>;</text> </subparagraph><subparagraph id="HA73429B293A643219E3A93842E7A9F79"><enum>(B)</enum><text>by striking subsection (c) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF21BCF13D1D64C879583B4819A03834F" style="OLC">
						<subsection id="HD5B72CA2164847A2BA1D27DB5F89753C"><enum>(c)</enum><header>Liability protection for organization or entity</header>
 <paragraph id="HBD547F481978420885085FCCFB442EB3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No volunteer nonprofit organization shall be liable for harm caused by an act or omission of a volunteer on behalf of the organization unless—</text>
 <subparagraph id="HA345ACD5B7D14760AAC176D6FAB26550"><enum>(A)</enum><text display-inline="yes-display-inline">the organization would be liable for the act or omission under generally applicable laws governing the direct or vicarious liability of organizations; and</text>
 </subparagraph><subparagraph id="H30ACC44143DC487B8E01DD873114BF37"><enum>(B)</enum><text display-inline="yes-display-inline">the organization itself has expressly authorized the specific conduct constituting the act or omission.</text>
 </subparagraph></paragraph><paragraph id="H2E14C65E82814E96A23A753D02856175"><enum>(2)</enum><header>Government request or authorization</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), no volunteer nonprofit organization shall be liable for harm caused by an act or omission of the organization or of a volunteer acting on behalf of the organization if—</text>
 <subparagraph id="HCA1C254624254F6484929463D43DD0CA"><enum>(A)</enum><text display-inline="yes-display-inline">the organization or the volunteer engaged in the act or omission at the request of or pursuant to an authorization by the Federal Government, a State government, or any agency or subdivision thereof; and</text>
 </subparagraph><subparagraph id="HD938299476FF416682B00E6BBB2D8916"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id36975B8D6E9E4A5494A6E14439FBC4D3"><enum>(i)</enum><text>the requesting or authorizing governmental entity would have been immune from suit or from liability in damages if the entity had engaged in the act or omission itself or through an employee, agent, or independent contractor; or</text>
 </clause><clause id="id903A42A540AC474F8D21EA8B8A8AC8D0" indent="up1"><enum>(ii)</enum><text>any governmental employee, agent, or contractor who had engaged in the act or omission on behalf of the requesting or authorizing governmental entity would have been immune from suit or from liability in damages by virtue of immunity extended to individual governmental actors.</text>
 </clause></subparagraph></paragraph><paragraph id="HA4AB2A8174C94B8A9FA07434A79FC46C"><enum>(3)</enum><header>Rule of construction</header><text>Except as provided in paragraphs (1) and (2), nothing in this section shall be construed to affect the liability of any nonprofit organization or governmental entity with respect to harm caused to any person.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H58D4F078BAF04A9CB3F7C62DA32EAF50"><enum>(C)</enum><text>in subsection (d)—</text> <clause id="id45AF7EE49BE74AEBB32D594006BDA470"><enum>(i)</enum><text>by striking paragraph (2); and</text>
 </clause><clause id="idD09545D74EB94423A96543D2669B285B"><enum>(ii)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively;</text>
 </clause></subparagraph><subparagraph id="H93F87E5EFB0745BF80AC85A09C30530C"><enum>(D)</enum><text>in subsection (e)(1)—</text> <clause id="id2338DAA9FAD546D581C1C1F7910AB128"><enum>(i)</enum><text>by striking <quote>against a volunteer</quote> and inserting the following:</text>
						<quoted-block display-inline="yes-display-inline" id="id994CC1A3BF4C4DE3B27B8EDBB1822E16" style="OLC">
 <text>against—</text><subparagraph id="id501D719D63A34380A0005660980B15B3"><enum>(A)</enum><text>a volunteer</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </clause><clause id="id26401CAF31294F93B2B4E550FEF3EC20"><enum>(ii)</enum><text>by striking the period at the end and inserting the following:</text>
						<quoted-block display-inline="yes-display-inline" id="id120A94C15C104F4B94AFFF16732C30F4" style="OLC">
 <text>; or</text><subparagraph id="idD6A20315A37F40F1BD026E4346C3FEAE"><enum>(B)</enum><text>a volunteer nonprofit organization in an action brought for harm based on the action of a volunteer acting within the scope of the volunteer’s responsibilities to the organization unless the claimant establishes by clear and convincing evidence that the organization itself expressly authorized the volunteer’s action and did so with a conscious, flagrant indifference to the rights or safety of the individual harmed.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H14762E1E9915454BA27DAA822EED3F33"><enum>(E)</enum><text display-inline="yes-display-inline">in subsection (f)(1), by inserting <quote>or of a volunteer nonprofit organization</quote> after <quote>liability of a volunteer</quote>;</text> </subparagraph></paragraph><paragraph id="HE8BF5423AADD4E59B1940E74DE256D40"><enum>(3)</enum><text>in section 5 (<external-xref legal-doc="usc" parsable-cite="usc/42/14504">42 U.S.C. 14504</external-xref>)—</text>
 <subparagraph id="H2848C22A6D29491C9D6AC685B3B86C01"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="HCF7CB334ED5844059535D1EC54F56237"><enum>(i)</enum><text>by inserting <quote>or a volunteer nonprofit organization</quote> after <quote>action against a volunteer</quote>; and</text>
 </clause><clause id="HA4F19097E2AD48FC95FA9E0EBC359770"><enum>(ii)</enum><text>by inserting <quote>or volunteer nonprofit organization</quote> after <quote>liability of the volunteer</quote>; and</text> </clause></subparagraph><subparagraph id="HB42142AC65B645D99C533A6F1D38C17A"><enum>(B)</enum><text>in subsection (b)—</text>
 <clause id="H45E2A8857FE64EAD98B9909919BB2832"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>or a volunteer nonprofit organization</quote> after <quote>who is a volunteer</quote>; and</text> </clause><clause id="H79588CDD3E134EC19B39CE777067F893"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>or a volunteer nonprofit organization</quote> after <quote>who is a volunteer</quote>; and</text>
 </clause></subparagraph></paragraph><paragraph id="H454D4618E99E42DB8B6907213FCBE97E"><enum>(4)</enum><text>in section 6 (<external-xref legal-doc="usc" parsable-cite="usc/42/14505">42 U.S.C. 14505</external-xref>)—</text> <subparagraph id="id09D026952486439E82AC08AE3D1220B5"><enum>(A)</enum><text>by striking <quote>For purposes of this Act</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—For purposes of this Act</quote>; and</text>
 </subparagraph><subparagraph id="id2350F41889F34C62968879E89B27C758"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HF8FC6BA74F8B416F948FE658E7064539" style="OLC"> <subsection id="H86DC3F3849EC48F69A37C0D10963FFD6"><enum>(b)</enum><header>Volunteer nonprofit organizations</header> <paragraph id="idFDA2323A2DA84B16920227B734B6E4D4"><enum>(1)</enum><header>Qualification as a volunteer nonprofit organization</header> <subparagraph id="id9E12CAD1CA334BAC8A55FF434D54AA29"><enum>(A)</enum><header>Actions conducted through volunteers</header><text>A nonprofit organization that conducts substantially all of its activities solely through the actions of volunteers or of independent contractors is a volunteer nonprofit organization for purposes of this Act.</text>
 </subparagraph><subparagraph id="idF4FA8050C5084537883B50241CCCA9AC"><enum>(B)</enum><header>Organization with no employees</header><text>A nonprofit organization that has no employees is conclusively presumed to be a volunteer nonprofit organization for purposes of this Act.</text>
								</subparagraph><subparagraph id="HDAEB4F44A3DD41359657E029E725D646"><enum>(C)</enum><header>Local affiliated organizations with no employees</header>
 <clause id="id3D83877B90124715A4220B665A8C711A"><enum>(i)</enum><header>Presumption</header><text display-inline="yes-display-inline">A nonprofit organization is presumed to be a volunteer nonprofit organization for purposes of this Act if the primary office and the majority of the employees of the organization function primarily to provide support to local affiliated organizations that do not have employees and that act in furtherance of the organization’s nonprofit mission.</text>
 </clause><clause id="id375BE04B4A984E07AF899D5272AA796C"><enum>(ii)</enum><header>Rebuttal</header><text display-inline="yes-display-inline">The presumption under clause (i) may be rebutted only by clear and convincing evidence that the board of the nonprofit organization expressly authorized the employees of the nonprofit organization to assert active control over the local affiliated organization with respect to the act or omission in question.</text>
 </clause></subparagraph><subparagraph id="H59B829ACD67745AA9837A29F84813AA4"><enum>(D)</enum><header>Public charities; private foundations; social welfare organizations</header><text display-inline="yes-display-inline">A nonprofit organization is a volunteer nonprofit organization for purposes of this Act if the organization—</text>
 <clause id="id379A1F429151452AAF8E9C1BE0839983"><enum>(i)</enum><text display-inline="yes-display-inline">has fewer than 50 employees;</text> </clause><clause id="id62421B9DCE1748D19D27FECC25B6E32F"><enum>(ii)</enum><text display-inline="yes-display-inline">has annual gross receipts of less than $200,000; and</text>
 </clause><clause id="id4393B5993BC44F91A382141E7FCB05FF"><enum>(iii)</enum><text display-inline="yes-display-inline">is—</text> <subclause id="H6171466B18EA4B2E9217C616CBA82DE8"><enum>(I)</enum><text display-inline="yes-display-inline">an organization described in paragraph (1), (2), or (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/509">section 509(a)</external-xref> of the Internal Revenue Code of 1986 that is exempt from taxation under section 501(a) of such Code;</text>
 </subclause><subclause id="HB1448B9931524494A3BB5006CEA3BC7C"><enum>(II)</enum><text display-inline="yes-display-inline">a private foundation, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/509">section 509</external-xref> of the Internal Revenue Code of 1986, that is exempt from taxation under section 501(a) of such Code; or</text>
 </subclause><subclause id="HC8F82F0ECA304DF49C1E7AF59A5068A6"><enum>(III)</enum><text display-inline="yes-display-inline">an organization operated exclusively for the promotion of social welfare that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(4)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HAECEEC1865244FA4ABA9F5B01B42E684"><enum>(2)</enum><header>Acts by a volunteer nonprofit organization</header>
 <subparagraph id="id64B511A9D9AB4CB4A950555BF844786B"><enum>(A)</enum><header>Governing documents of organization</header><text display-inline="yes-display-inline">A volunteer nonprofit organization acts <quote>itself</quote> for purposes of this Act only if the person or body that is authorized by the governing documents of the organization to act in the name of and on behalf of the organization expressly acts in accordance with those documents.</text>
 </subparagraph><subparagraph id="idE360D827966C482D9BF939397294B81B"><enum>(B)</enum><header>Applicable State law</header><text display-inline="yes-display-inline">If the governing documents of a volunteer nonprofit organization do not identify the person or body that is authorized to act in the name of and on behalf of the organization, the organization acts <quote>itself</quote> for purposes of this Act only if the person or body whose action is required under the applicable State law in order to bind the organization acts strictly in accordance with that State law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
