	<legis-body>
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quell Unnecessary, Intentional, and Encroaching Telephone Calls Act of 2015</short-title></quote> or the <quote><short-title>QUIET Act</short-title></quote>.</text> </section><section id="id67475C2511BC425BA8CF41ECF9A283E5" section-type="subsequent-section"><enum>2.</enum><header>Commercial robocalls</header> <subsection id="id7F77EE67EE214C3C8CB389E1FE69F99F"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113A">Chapter 113A</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id182126449F09481C9233D203FAED362C" style="USC">
					<section id="id4605F7C0387C439AB5B829CB503E4D7B"><enum>2328.</enum><header>Commercial
				robocalls</header>
 <subsection id="id2F46A317FA9748D38ADFB54D488BDAB3"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="idEDF56CC72BC0475B8BA1EC67DF056B9E"><enum>(1)</enum><text>the term <term>automatic telephone dialing system</term> has the meaning given the term in section 227(a) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(a)</external-xref>);</text>
 </paragraph><paragraph id="id364990630B4D4E5A92AFE55DCABD20FB"><enum>(2)</enum><text>the term <term>commercial robocall</term> means a telephone call made for the purpose of soliciting or encouraging the purchase or rental of, or investment or enrollment in, property, goods, or services, using an automatic telephone dialing system or an artificial or prerecorded voice;</text>
 </paragraph><paragraph id="id22F17F996A764E9D85F85B72BCC34205"><enum>(3)</enum><text>the term <term>prior express written consent</term> means, with respect to the recipient of a commercial robocall, an agreement in writing that—</text>
 <subparagraph id="id1AF5E5B772534C989B9F51DF4A3CC45A"><enum>(A)</enum><text>includes the signature of the recipient;</text>
 </subparagraph><subparagraph id="idFE7A0445DE764FEAB93DF8CBE728E1C9"><enum>(B)</enum><text>clearly authorizes the seller to initiate or cause to be initiated to the recipient a commercial robocall;</text>
 </subparagraph><subparagraph id="id611DA8FA84D04574ADE7DFE052953248"><enum>(C)</enum><text>includes the telephone number to which the recipient authorizes the commercial robocall to be initiated; and</text>
 </subparagraph><subparagraph id="idE4556885F3A448A9BAFC9B9F6D0CCE80"><enum>(D)</enum><text>includes a clear and conspicuous disclosure informing the recipient that—</text>
 <clause id="id91D13991692443E0822C00321640CCF3"><enum>(i)</enum><text>by executing the agreement, the recipient authorizes the seller to initiate or cause to be initiated to the recipient a commercial robocall; and</text>
 </clause><clause id="idf9bab155ad454d93a0da192589538999"><enum>(ii)</enum><text>the recipient is not required to sign the agreement, directly or indirectly, or agree to enter into the agreement as a condition of purchasing, renting, investing in, or enrolling in any property, goods, or services;</text>
 </clause></subparagraph></paragraph><paragraph id="idA4CAB84B33F741C4BF197700C69A38FF"><enum>(4)</enum><text>the term <term>seller</term> means the person on whose behalf a commercial robocall is initiated; and</text>
 </paragraph><paragraph id="id47db686e44b442e98e4763669359d4ce"><enum>(5)</enum><text>the term <term>signature</term> includes an electronic or digital form of signature, to the extent that the form of signature is recognized as a valid signature under applicable Federal law or State contract law.</text>
							</paragraph></subsection><subsection id="idC5D4376B0C27482F9D8022152223A74C"><enum>(b)</enum><header>Prohibition</header>
							<paragraph id="id00DEE98A5D7D45448D4CC526741A9B7C"><enum>(1)</enum><header>In
 general</header><text>It shall be unlawful for a person within the United States, or a person outside the United States if the recipient is within the United States, to knowingly initiate a commercial robocall without the prior express written consent of the recipient.</text>
 </paragraph><paragraph id="id531D93E50C1E4A33A134B0715844C227"><enum>(2)</enum><header>Exemptions</header><text>Paragraph (1) shall not apply to a telephone call—</text>
 <subparagraph id="id66C2CC3FF4AF4699A9E544C1422E46BE"><enum>(A)</enum><text>that is made for emergency purposes;</text>
 </subparagraph><subparagraph id="id2E2B078C98924D30B7D5990A64BFF5EE"><enum>(B)</enum><text>that is made by or on behalf of a tax-exempt nonprofit organization;</text>
 </subparagraph><subparagraph id="id423940657BA4453FB1EF4E70477B8AB3"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id30967E0554374285821BD74EDEDF6690"><enum>(i)</enum><text>that is made by a provider of commercial mobile radio service, as that term is defined in section 20.3 of title 47, Code of Federal Regulations, or any successor thereto, to subscribers of the service; and</text>
 </clause><clause id="id78F0487045B14D519EF431BD5A118EF1" indent="up1"><enum>(ii)</enum><text>for which the subscribers described in clause (i) are not charged; or</text> </clause></subparagraph><subparagraph id="id59E6B54F8AE84960AD4FFDE35EC9954C"><enum>(D)</enum><text>that delivers a message relating to health care made by, or on behalf of, a covered entity or a business associate of a covered entity, as those terms are defined in section 160.103 of title 45, Code of Federal Regulations, or any successor thereto.</text>
								</subparagraph></paragraph></subsection><subsection id="id15166EDE27EB4361ADC50D68B05CBDE0"><enum>(c)</enum><header>Criminal
 penalties</header><text>Any person who violates this section shall be fined not more than $20,000 per violation, imprisoned for not more than 10 years, or both.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id9D85F1F0CD9A4CDEAE405F6A41F111A2"><enum>(b)</enum><header>Technical and
 conforming amendments</header><text>Part I of title 18, United States Code, is amended—</text>
 <paragraph id="idC3DC3359D0B046409D239F310EB17A59"><enum>(1)</enum><text>in the chapter analysis, by striking the item relating to chapter 113A and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7DB816013A654FC089E2AB1C1CC407AB" style="OLC"><toc><multi-column-toc-entry bold="off" level="section"><toc-enum>113A.
				  </toc-enum><level-header level="section">Telemarketing</level-header><target>2325</target></multi-column-toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block>
 <continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="id9B7993C76A54404992C1227F3BFE19AD"><enum>(2)</enum><text>in chapter 113A—</text>
 <subparagraph id="idA8E37232CF624418893FE47777BDEC19"><enum>(A)</enum><text>in the chapter heading, by striking <quote><header-in-text level="chapter" style="USC">fraud</header-in-text></quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA8E6D0B5B9E40678C76FBF5F4AB41DA"><enum>(B)</enum><text display-inline="yes-display-inline">in the table of sections, by adding at the end the following:</text>
