 <legis-body><section id="id5FCCC0138DBE4ED891E5FC6EB11A2CB4" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id274957613C3A4BE7AEE958B11D5E0AF1"><enum>(1)</enum><header>Illegal border activities</header><text display-inline="yes-display-inline">The term <term>illegal border activities</term> means the illegal trafficking or smuggling of an individual or controlled substances or activities to further a Federal crime relating to United States immigration, customs, controlled substances, agriculture, monetary instruments, or other border controls.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD142BC24E7F948F9AF603778EFB19511"><enum>(2)</enum><header display-inline="yes-display-inline">Southern border</header><text display-inline="yes-display-inline">The term <term>Southern border</term> means the international border between the United States and Mexico.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6180930978A4471B6685889E9AC8471"><enum>(3)</enum><header>UAS</header><text display-inline="yes-display-inline">The term <term>UAS</term> means unmanned aircraft systems.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id3DB4CF1A203A4B4ABA7C8EDE79F55239"><enum>2.</enum><header>Persistent surveillance along the Southern border</header><subsection commented="no" display-inline="no-display-inline" id="id9B011FB24DF94ED79C908F5D3DA25CDD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Department of Homeland Security shall fully utilize surveillance and detection capabilities developed or used by the various Federal departments and agencies for the purpose of enhancing the functioning and operational capability to conduct continuous and integrated manned or unmanned, monitoring, sensing, or surveillance of 100 percent of Southern border mileage or the immediate vicinity of the Southern border.</text></subsection><subsection id="idf00a38267cb74617aebb3db05a669f95"><enum>(b)</enum><header>Procurement of additional unmanned aircraft systems</header><paragraph id="id96C792EDA1444EBEBC90582D6EF1668C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not procure any additional UAS until after the Secretary provides Congress with written certification that the Department of Homeland Security successfully operated its current fleet of UAS at least 23,000 hours during the preceding calendar year.</text></paragraph><paragraph id="idD9E2C4A58CF342828689D225A77F544E"><enum>(2)</enum><header>Exemption</header><text display-inline="yes-display-inline">The limitation set forth in paragraph (1) shall not apply to the procurement of unmanned aircraft that do not weigh more than 150 pounds.</text></paragraph></subsection><subsection id="id5DD0E32BD246465587B2205D2B747190"><enum>(c)</enum><header>Use of best available radar and surveillance technology</header><text display-inline="yes-display-inline">The Department of Homeland Security shall use the best available radar and surveillance technology—</text><paragraph id="id28F393548AF3469898EAFB0EE01591C3"><enum>(1)</enum><text display-inline="yes-display-inline">to increase awareness of illegal border activities along the Southern border; and</text></paragraph><paragraph id="id7B066BBAF3DA446884DF5BB205409BC3"><enum>(2)</enum><text display-inline="yes-display-inline">to identify gaps in surveillance capabilities.</text></paragraph></subsection></section><section id="id4b6a621a157f465787198552e9c4d7c1"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, and biannually thereafter, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that contains, for the reporting period—</text><paragraph id="id035A3C57D02A4D859FF7EE780DEA5438"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of UAS hours required to provide persistent surveillance along the Southern border;</text></paragraph><paragraph id="id842520c752f544c8b5ee8f9db45756ca"><enum>(2)</enum><text>the total number of UAS flight hours planned in support of any Federal or State department or agency;</text></paragraph><paragraph id="id020c5dfad9c04e6b87727987005d5347"><enum>(3)</enum><text>the number of planned UAS flight hours in support of the goal referred to in paragraph (1);</text></paragraph><paragraph id="ideec7e69c6b704a45ae05f8cf3e7b4a1d"><enum>(4)</enum><text>the number of hours in which UAS were flown in support of the goal referred to in paragraph (1);</text></paragraph><paragraph id="id8c6bc81230ac461cafef61cc22245459"><enum>(5)</enum><text>the number of planned UAS flight hours in support of the goal referred to in paragraph (1) that were cancelled before takeoff, including the reason for such cancellations;</text></paragraph><paragraph id="id97C85451F1444132BDFE29A68F87B30D"><enum>(6)</enum><text display-inline="yes-display-inline">performance measures regarding—</text><subparagraph id="id55E8E93718CB421F8C7F25F3DB6B60D6"><enum>(A)</enum><text display-inline="yes-display-inline">the number of hours flown by the current fleet of UAS operated by the Department of Homeland Security;</text></subparagraph><subparagraph id="idADE454DB6C6F4B1AB4FD6F66BEC3FABA"><enum>(B)</enum><text display-inline="yes-display-inline">the number of subjects detected though the use of UAS;</text></subparagraph><subparagraph id="id915657DB059345C2B2B362B49EBF5777"><enum>(C)</enum><text display-inline="yes-display-inline">the number of apprehensions assisted by the use of UAS; and</text></subparagraph><subparagraph id="id413FBFBDD41A455AAFCD1491775B2696"><enum>(D)</enum><text display-inline="yes-display-inline">the number and quantity of illicit drug seizures assisted by the use of UAS; and</text></subparagraph></paragraph><paragraph id="id6E10E8BA34574C65A3603A2AB1C30BB0"><enum>(7)</enum><text display-inline="yes-display-inline">all accumulated cost associated with the Unmanned Aircraft System Program within the Department of Homeland Security, including—</text><subparagraph id="idAC7F4C5BB8264ACF8F83260D260C619B"><enum>(A)</enum><text display-inline="yes-display-inline">salaries of pilots; and</text></subparagraph><subparagraph id="id5B23644D996D4C409B970DDF19A89CB6"><enum>(B)</enum><text display-inline="yes-display-inline">costs associated with radar and surveillance technology.</text></subparagraph></paragraph></section><section id="id8CEA87C8F2A442B9A2941CECA252232D"><enum>4.</enum><header>Interagency collaboration</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall consult with the Secretary of Defense to identify the best practices used by the Department of Defense that could also be used by the Department of Homeland Security to improve the security of the Southern border by enhancing wide aerial surveillance and fulfilling the requirements set forth in section 2.</text></section><section id="idF6411C6951094399BB00E9D04E459B80"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act shall be repealed on the date that is 5 years after the date of the enactment of this Act.</text> </section></legis-body> </bill>
