	<legis-body>
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Robocall and Call Spoofing Enforcement Improvements Act of 2015</short-title></quote>.</text>
		</section><section id="id673E6B9500684077AECC02584DD884EA"><enum>2.</enum><header>Enforcement authority relating to non-licensee robocallers</header>
 <subsection id="id5FFC3CCE57964DBAA3A5DA817E6302AE"><enum>(a)</enum><header>Authority To impose forfeitures without first issuing citations</header><text>Section 503(b)(5) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(5)</external-xref>) is amended in the second sentence—</text>
 <paragraph id="idC41D751AFBFA4D7BAC151A12B78D7059"><enum>(1)</enum><text>by striking <quote>or in the case of</quote> and inserting <quote>in the case of</quote>; and</text> </paragraph><paragraph id="id5052B1D05AE94286BB475621EF22CE40"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>, or if the person involved is engaging in violations of section 227(b)(1) of this title</quote>.</text>
 </paragraph></subsection><subsection id="idEFD9BAF0A6F44D688C75E9594052303A"><enum>(b)</enum><header>Expansion of statute of limitations</header><text>Section 503(b)(6)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(6)(B)</external-xref>) is amended—</text> <paragraph id="idE6CF5BB5479947C682B497E450CF20D1"><enum>(1)</enum><text>by striking <quote>occurred more than 1 year</quote> and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="id230C5FFDA3CB4604BA6F583E0049042D" style="OLC">
 <text>occurred—</text><clause id="id5B00DAE08C07497EAE558AD79E80223D"><enum>(i)</enum><text>except as provided in clause (ii), more than 1 year</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="idC4D51F749BA4424A8FC947FD73E1B0C8"><enum>(2)</enum><text>by striking <quote>liability.</quote> and inserting <quote>liability; or</quote>; and</text>
 </paragraph><paragraph id="id58941779106D4553BC7184C51709A140"><enum>(3)</enum><text>by inserting after clause (i), as designated, the following:</text> <quoted-block display-inline="no-display-inline" id="id71AAA4E314FA47FAA3AE7E4C26BD5FE7" style="OLC"> <clause id="id4A2E312D595C4C49AD12F6DF0F59CAE5"><enum>(ii)</enum><text>in the case of a violation of section 227(b)(1) of this title, more than 3 years prior to the date of issuance of the required notice or notice of apparent liability.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id80C234B494CF4FC8B953FE5157693F3C"><enum>(c)</enum><header>Increase in maximum forfeiture</header><text>Section 503(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(2)</external-xref>) is amended—</text> <paragraph id="id10BAE242D30F422FAAA99563D3F0F5C5"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>or (C)</quote> and inserting <quote>(C), (F), or (G)</quote>; and</text>
 </paragraph><paragraph id="idF876B9F25D6B480B905B79A18993B58B"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id10AA5CF8A16A41CAA67DC3C40F779663" style="OLC"> <subparagraph id="idDCD121656B144E13BD4B39D766792462" indent="up2"><enum>(G)</enum><text>If the violator does not hold, and is not an applicant for, a license, permit, certificate, or other authorization issued by the Commission—</text>
 <clause id="id6ECFD4DC81CB4D118150D65D7485BF8E"><enum>(i)</enum><text>the amount of any forfeiture penalty determined under this subsection for a violation of section 227(b)(1) of this title shall not exceed $25,000 for each violation or each day of a continuing violation; and</text>
 </clause><clause id="id9C6B1D5A0CC34104B96E377F842E938F"><enum>(ii)</enum><text>there shall be no limit on the total amount assessed for any continuing violation of section 227(b)(1) of this title.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idB66D860F1EE2425592A084147CDBD046"><enum>3.</enum><header>Amendments to Truth in Caller ID Act of 2009</header>
 <subsection id="H8B65D444097549CDB40FEC5FAC3B8BE0"><enum>(a)</enum><header>Communications from outside United States</header><text display-inline="yes-display-inline">Section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>) is amended by inserting <quote>or any person outside the United States if the recipient is within the United States,</quote> after <quote>United States,</quote>.</text> </subsection><subsection id="H9E9624C35B6B4A03BA4035EDBEFFDB57"><enum>(b)</enum><header>Clarification of definition of <quote>IP-Enabled voice service</quote></header><text>Section 227(e)(8)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)(C)</external-xref>) is amended by striking <quote>has the meaning</quote> and all that follows and inserting the following: <quote>means the provision of real-time voice communications offered to the public, or such class of users as to be effectively available to the public, transmitted using Internet protocol, or a successor protocol, (whether part of a bundle of services or separately) with interconnection capability such that the service can originate traffic to, or terminate traffic from, the public switched telephone network, or a successor network.</quote>.</text>
			</subsection><subsection id="H3ECB4FF0FF274F539679A9269EC95A23"><enum>(c)</enum><header>Spoofing service</header>
 <paragraph id="H27CAD6EB8D634FF8BBFD72D29E92BBF5"><enum>(1)</enum><header>In general</header><text>Section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) is amended—</text> <subparagraph id="HE9909B01C571472EB3BE0F6D4BBDBAC3"><enum>(A)</enum><text>by striking paragraph (4);</text>
 </subparagraph><subparagraph id="H6059295C9272499B8D0B4964F57DF4BC"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4);</text> </subparagraph><subparagraph id="H8A8B1D4610874B61A58C0C053FD0BD6B"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5B44F8A7EA574B219785E74A89C5B614" style="OLC">
							<paragraph commented="no" id="HC328EA5F839D42EEB452FE752B3809E2"><enum>(3)</enum><header>Spoofing services</header>
 <subparagraph commented="no" id="id56D0E1E39DCC45F9AFAFAFDA31806308"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A provider of a spoofing service shall take such steps as the Commission may prescribe to verify that a person does not use the service in violation of this subsection.</text>
 </subparagraph><subparagraph commented="no" id="idF272891ADA794A778ADA822F81530DC0"><enum>(B)</enum><header>Recordkeeping and reporting</header><text display-inline="yes-display-inline">The Commission shall impose reasonable recordkeeping and reporting obligations on a provider of a spoofing service, and shall adopt any other regulation that the Commission determines necessary, to prevent or investigate violations of this subsection.</text>
 </subparagraph><subparagraph commented="no" id="id31F20AAD87C341239234CAC3703B9271"><enum>(C)</enum><header>Subpoena authority</header><text>Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/121">chapter 121</external-xref> of title 18, United States Code, for purposes of enforcing this subsection, the Commission may by subpoena require a provider of a spoofing service to disclose to the Commission the caller identification information transmitted by a subscriber to or customer of the spoofing service.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HD899E0B697B543C4B495CFCE318D3A4D"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (8), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id79C7292F5D0345B6BF9E18C4347A3BAB" style="OLC"> <subparagraph id="H050396622C134C8C985C2C90AAAE5325"><enum>(D)</enum><header>Spoofing service</header><text display-inline="yes-display-inline">The term <term>spoofing service</term> means a service that substitutes, or permits a user to substitute, another name or any number (including a telephone number, pseudo-number, or other number) for display as the caller identification information for a call or text message.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B5C9FAC650547F7A243162007442908"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>), as amended by subsection (a), is amended by striking <quote>paragraph (3)(B)</quote> and inserting <quote>paragraph (4)(B)</quote>.</text>
 </paragraph></subsection><subsection id="HC003286D63324DE395719EE47BBFF918"><enum>(d)</enum><header>Text messaging service</header><text>Section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>) is amended—</text> <paragraph id="HA9A3CC6660F648B08658E54866EDA616"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>(including a text message sent using a text messaging service)</quote> before the period at the end;</text>
 </paragraph><paragraph id="HB8E70799A37A4471BF5553F14D0E0194"><enum>(2)</enum><text display-inline="yes-display-inline">in the first sentence of subparagraph (B), by inserting <quote>(including a text message sent using a text messaging service)</quote> before the period at the end; and</text> </paragraph><paragraph id="HC17CA5DBC172421999B502985EF2E8EC"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC645AEC1C3A0401C9AE53499170AAF77" style="OLC">
 <subparagraph commented="no" id="H1C35AF3305884D9A93442EFD23FC3F6E"><enum>(E)</enum><header>Text message</header><text display-inline="yes-display-inline">The term <term>text message</term>—</text> <clause commented="no" id="id53E308B1FEC4485DA5DC5E09661AB423"><enum>(i)</enum><text display-inline="yes-display-inline">means a real-time or near real-time message consisting of text, images, sounds, or other information that is transmitted from or received by a device that is identified as the transmitting or receiving device by means of a telephone number;</text>
 </clause><clause commented="no" id="H8B1E0A0C05634589AA2FFA9113E3E5F8"><enum>(ii)</enum><text>includes a short message service (commonly referred to as <term>SMS</term>) message, an enhanced message service (commonly referred to as <term>EMS</term>) message, and a multimedia message service (commonly referred to as <term>MMS</term>) message; and</text>
 </clause><clause commented="no" id="H7A0CD5E8A91F49FAA57291EAE42A1BB9"><enum>(iii)</enum><text>does not include a real-time, 2-way voice or video communication.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H81E9B4B3F3C747218C6F3F1AEBC7AD6E"><enum>(F)</enum><header>Text messaging service</header><text>The term <term>text messaging service</term> means a service that permits the transmission or receipt of a text message, including a service provided as part of or in connection with a telecommunications service or an IP-enabled voice service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id70CAC48CB8A7446CB62DF541B1529417"><enum>(e)</enum><header>Savings clause</header><text>Section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFEAF5CE6AD664278A94C1E308A5CA524" style="OLC">
 <paragraph id="idD5785DE4E9E9431E91F65913C09FC828"><enum>(10)</enum><header>Savings clause</header><text>Nothing in this subsection shall be construed to—</text> <subparagraph id="id3F1BB132232544E896AC319640DED456"><enum>(A)</enum><text>modify or limit the authority of the Commission under the Telephone Consumer Protection Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/243">Public Law 102–243</external-xref>; 105 Stat. 2394), the amendments made by that Act, or the CAN–SPAM Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7701">15 U.S.C. 7701 et seq.</external-xref>), as of the day before the date of enactment of the <short-title>Robocall and Call Spoofing Enforcement Improvements Act of 2015</short-title>, to interpret the term <term>call</term> to include a text message; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA5839A5B6CE44E3B839042C694AD6284"><enum>(B)</enum><text>modify, limit, or otherwise affect any rule or order adopted by the Commission in connection with the Telephone Consumer Protection Act of 1991, the amendments made by that Act, or the CAN–SPAM Act of 2003.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H510C3BFF930D4CC68A164B6F502F2954"><enum>(f)</enum><header>Regulations</header>
 <paragraph id="HA879B4607DF64CA6ACFF6B1BB84CAE7B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227(e)(4)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(4)(A)</external-xref>), as redesignated by subsection (c), is amended by striking <quote>Not later than 6 months after the date of enactment of the Truth in Caller ID Act of 2009, the Commission</quote> and inserting <quote>The Commission</quote>.</text>
 </paragraph><paragraph id="HCE975A649000429FB117440276975606"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Federal Communications Commission shall prescribe regulations to implement the amendments made by this section.</text>
 </paragraph></subsection><subsection id="H9506FD35F666438BAC91C933CBCFDEAF"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date on which the Federal Communications Commission prescribes regulations to implement the amendments made by this section.</text>
 </subsection></section><section id="idF84243A70B29485095ED66AE4A4C67D9"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id85F1C4AD91B9456792FFD48E387E40C7"><enum>(1)</enum><text display-inline="yes-display-inline">telecommunications carriers have the legal authority to offer consumers services that block or filter robocalls; and</text>
 </paragraph><paragraph id="id5AB5B9B6F384476180EFB40C8F164E87"><enum>(2)</enum><text display-inline="yes-display-inline">the Federal Government, including the Federal Communications Commission and the Federal Trade Commission, should encourage telecommunications carriers to develop and implement the services described in paragraph (1).</text></paragraph></section></legis-body></bill>
