			 navigable waters, and for other purposes.</official-title></form>
	<legis-body>
 <section id="id849319FD15184653850D3F4E94FFAC87" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sensible Environmental Protection Act of 2015</short-title></quote>.</text>
		</section><section id="HC5F1E60820F144FABE5143A294C315B0" section-type="subsequent-section"><enum>2.</enum><header>Use of authorized
			 pesticides; discharges of pesticides; report</header>
			<subsection id="id3563713C65564AFDB076D5400EEC6553"><enum>(a)</enum><header>Use of
 authorized pesticides</header><text display-inline="yes-display-inline">Section 3(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136a">7 U.S.C. 136a(f)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEB3FC76262C347D5B117909ED652E853" style="OLC">
					<paragraph commented="no" id="HAADEE929A4F34D2FBA6EDD21C0E74FAD"><enum>(5)</enum><header>Use of
 authorized pesticides</header><text display-inline="yes-display-inline">Except as provided in section 402(s) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>), the Administrator or a State shall not require a permit under that Act for a discharge from a point source into navigable waters of—</text>
 <subparagraph commented="no" id="id8C18CCBF4F2341949F54C55D412391D8"><enum>(A)</enum><text display-inline="yes-display-inline">a pesticide authorized for sale, distribution, or use under this Act; or</text>
 </subparagraph><subparagraph commented="no" id="id9656570D605E42CDA48B0867C8724836"><enum>(B)</enum><text display-inline="yes-display-inline">the residue of the pesticide, resulting from the application of the pesticide.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H64C452B9ABA74D418D2F8FB8183E19AC"><enum>(b)</enum><header>Discharges of
 pesticides</header><text display-inline="yes-display-inline">Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H320D99D65F744971B7DBFE3AE9A20723" style="OLC">
					<subsection id="HC86E024F90784A89B3F354AD179A9528"><enum>(s)</enum><header>Discharges of
				pesticides</header>
						<paragraph id="HFC77B4BFA35C43EA81A99DC0E37625E9"><enum>(1)</enum><header>No permit
 requirement</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a permit shall not be required by the Administrator or a State under this Act for a discharge from a point source into navigable waters of—</text>
 <subparagraph id="idFEB5CAD6300E4C6B94F073CB694BDFF7"><enum>(A)</enum><text display-inline="yes-display-inline">a pesticide authorized for sale, distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>); or</text>
 </subparagraph><subparagraph id="idFE4F3AAADAD449C389935746EFAF25DE"><enum>(B)</enum><text display-inline="yes-display-inline">the residue of the pesticide, resulting from the application of the pesticide.</text>
 </subparagraph></paragraph><paragraph id="H8FC2A1EA386E42DCB0E68BA39E557A60"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to the following discharges of a pesticide or pesticide residue:</text>
 <subparagraph id="HE59CB086556A4E9B8B70A56A710B5872"><enum>(A)</enum><text display-inline="yes-display-inline">A discharge resulting from the application of a pesticide in violation of a provision of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>) relevant to protecting water quality if—</text>
 <clause id="H15807AF25672452BB17000D0EDBDBD82"><enum>(i)</enum><text display-inline="yes-display-inline">the discharge would not have occurred without the violation; or</text>
 </clause><clause id="H09ABCF4F66F54068AD71240A792378D4"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of pesticide or pesticide residue in the discharge is greater than would have occurred without the violation.</text>
 </clause></subparagraph><subparagraph commented="no" id="HCA2066D774754695AC7D24DB9E9B9467"><enum>(B)</enum><text display-inline="yes-display-inline">Stormwater discharges subject to regulation under subsection (p).</text>
 </subparagraph><subparagraph commented="no" id="H11C811AF92D64AB6AAC7E74AF174837A"><enum>(C)</enum><text display-inline="yes-display-inline">The following discharges subject to regulation under this section:</text>
 <clause commented="no" id="H662EB3852DF14767B269FA6099EC340F"><enum>(i)</enum><text>Manufacturing or industrial effluent.</text>
 </clause><clause commented="no" id="H1A72A01C86CA477B9EDFE22760BBD8C8"><enum>(ii)</enum><text>Treatment works effluent.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H1E113A9B5FFF4CBE9DED8C213C154BDD"><enum>(iii)</enum><text>Discharges incidental to the normal operation of a vessel, including a discharge resulting from ballasting operations or vessel biofouling prevention.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id4F4796BC47364C8DBA1634955F83DFD0"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency, in consultation with the Secretary of Agriculture, shall submit a report to the Committee on Environment and Public Works and the Committee on Agriculture of the Senate and the Committee on Transportation and Infrastructure and the Committee on Agriculture of the House of Representatives that includes—</text>
 <paragraph id="idd258af4fcb6b4b9aba173adc9770a8f0"><enum>(1)</enum><text>the status of intra-agency coordination between the Office of Water and the Office of Pesticide Programs of the Environmental Protection Agency regarding streamlining information collection, standards of review, and data use relating to water quality impacts from the registration and use of pesticides;</text>
 </paragraph><paragraph id="id4afebc1d60e7433f9c793531a233000f"><enum>(2)</enum><text>an analysis of the effectiveness of current regulatory actions relating to pesticide registration and use aimed at protecting water quality; and</text>
 </paragraph><paragraph id="id93cb9dfe4760426394c48aa714bbe126"><enum>(3)</enum><text>any recommendations on how the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>) can be modified to better protect water quality and human health.</text></paragraph></subsection></section></legis-body></bill>
