			 outpatient department procedures that utilize drugs as supplies, and for
			 other purposes.</official-title></form>
	<legis-body id="H83A6AE57C5A049DC8FF19FFE40AF5CA1" style="OLC">
 <section id="H4F426DE167004B77849C358D3D8E880C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Equal Access to Treatments Act of 2015</short-title></quote>.</text> </section><section id="HEAD63539D65B4CF9BE7C58DF7091AE11"><enum>2.</enum><header>Payment under the Medicare program for outpatient department procedures that utilize drugs as supplies</header><text display-inline="no-display-inline">Section 1833(t)(2)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(t)(2)(G)</external-xref>) is amended by striking <quote>shall</quote> and all that follows and inserting the following:</text>
			<quoted-block display-inline="yes-display-inline" id="H5E9F914EEA0B46BB8DBB2B8372B9BA51" style="OLC">
 <text>shall—</text><clause id="HD533E9F1749049A4B5726B92BC53481E"><enum>(i)</enum><text display-inline="yes-display-inline">create additional groups of covered OPD services that classify separately those procedures that utilize contrast agents from those that do not;</text>
 </clause><clause id="H82ECA92401194624AAF7D5EFED85F4ED"><enum>(ii)</enum><text display-inline="yes-display-inline">create and implement, for services furnished after the date of the enactment of this clause and in a budget neutral manner, additional groups of covered OPD services that classify separately those procedures that utilize a drug (other than contrast agents, diagnostic ra­di­o­phar­ma­ceu­ti­cals, or anesthesia drugs) that both—</text>
 <subclause id="H63E62C509BF845618A45FD7E469E7E37"><enum>(I)</enum><text>has a cost above the drug packaging threshold; and</text> </subclause><subclause id="H75D093A42BFB47778E07C9B2F3CDE0FF"><enum>(II)</enum><text>functions as a supply when used in a diagnostic test or procedure;</text>
					</subclause><continuation-text continuation-text-level="clause">from those that do not; and</continuation-text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
