 <section changed="deleted" committee-id="SSCM00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Nicotine Poisoning Prevention Act of 2015</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSCM00" id="idFE0283FC864342179163369DBD0EFE84" reported-display-style="strikethrough"><enum>2.</enum><header>Child safety packaging for liquid nicotine containers</header>
 <subsection id="id0184016B2A27436F92F3FE4AA2A2835D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7D0BAD8A22A5436CAF4C1A2F0EB88C55"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Consumer Product Safety Commission.</text>
 </paragraph><paragraph id="idB0420CC342564175AF8F16CF03376539"><enum>(2)</enum><header>Liquid nicotine container</header><text>The term <term>liquid nicotine container</term> means a consumer product, as defined in section 3(a)(5) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)</external-xref>) notwithstanding subparagraph (B) of such section, that consists of a container that—</text>
 <subparagraph id="idC2D2229DC21E4BE698C6A4DAF0BE7414"><enum>(A)</enum><text>has an opening from which nicotine in a solution or other form is accessible and can flow freely through normal and foreseeable use by a consumer; and</text>
 </subparagraph><subparagraph id="id0C0D8A05AF704B2382D5ADFF2A7801E2"><enum>(B)</enum><text>is used to hold soluble nicotine in any concentration.</text> </subparagraph></paragraph><paragraph id="id1BF60E214FA34F898EA3372BC054B442"><enum>(3)</enum><header>Nicotine</header><text>The term <term>nicotine</term> means any form of the chemical nicotine, including any salt or complex, regardless of whether the chemical is naturally or synthetically derived.</text>
 </paragraph><paragraph id="id5AB5FAE8BB7D4A2D86B6E6E7DB344B96"><enum>(4)</enum><header>Special packaging</header><text>The term <term>special packaging</term> has the meaning given such term in section 2 of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1471">15 U.S.C. 1471</external-xref>).</text>
				</paragraph></subsection><subsection id="id559B29B57B0E48239712EFF935B77223"><enum>(b)</enum><header>Required use of special packaging for liquid nicotine containers</header>
				<paragraph id="idB9E5023697A5444C839F449CEDBCC676"><enum>(1)</enum><header>Rulemaking</header>
 <subparagraph id="idF112DBE1758D4B67856653EA7ACE6EE0"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 3(a)(5)(B) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)(B)</external-xref>) or section 2(f)(2) of the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1261">15 U.S.C. 1261(f)(2)</external-xref>), not later than 1 year after the date of the enactment of this Act, the Commission shall promulgate a rule requiring special packaging for liquid nicotine containers.</text>
 </subparagraph><subparagraph id="idFF0152D427354817BBE0D0A80592E934"><enum>(B)</enum><header>Amendments</header><text>The Commission may promulgate such amendments to the rule promulgated under subparagraph (A) as the Commission considers appropriate.</text>
 </subparagraph></paragraph><paragraph id="idD822152CF9154D1D8EF4DF447FE83B80"><enum>(2)</enum><header>Expedited process</header><text>The Commission shall promulgate the rules under paragraph (1) in accordance with section 553 of title 5, United States Code.</text>
 </paragraph><paragraph id="idE30E29152C6642B5BAC052F0766A8078"><enum>(3)</enum><header>Inapplicability of certain rulemaking requirements</header><text>The following provisions shall not apply to a rulemaking under paragraph (1):</text> <subparagraph id="id5F450D35C6DE40219A278F54D9C0DF01"><enum>(A)</enum><text>Sections 7 and 9 of the Consumer Product Safety Act (15 U.S.C. 2056 and 2058).</text>
 </subparagraph><subparagraph id="id1CB108072FD540CBAD7775DFA3B93E2E"><enum>(B)</enum><text>Section 3 of the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1262">15 U.S.C. 1262</external-xref>).</text> </subparagraph><subparagraph id="idB0BA98FDD3854F36B1CCF056C0D689C1"><enum>(C)</enum><text>Subsections (b) and (c) of section 3 of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1472">15 U.S.C. 1472</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idA66F7E5F16264AA48AC21CC823CF9FF2"><enum>(4)</enum><header>Savings clause</header><text>Nothing in this section shall be construed to limit or diminish the authority of the Food and Drug Administration to regulate the manufacture, marketing, sale, or distribution of liquid nicotine, liquid nicotine containers, electronic cigarettes, or similar products that contain or dispense liquid nicotine.</text>
 </paragraph><paragraph id="id2E4D8945F6D24EF798AEFAE0D2F1A4A3"><enum>(5)</enum><header>Enforcement</header><text>A rule promulgated under paragraph (1) shall be treated as a standard applicable to a household substance established under section 3(a) of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1472">15 U.S.C. 1472(a)</external-xref>).</text></paragraph></subsection></section></legis-body>

		</section><section changed="added" committee-id="SSCM00" id="idBA5672C5142F4678BEAFA90AD86946FC" reported-display-style="italic"><enum>2.</enum><header>Child safety packaging for liquid nicotine containers</header>
 <subsection id="idC7D06C6516304A5BA8239D85147382B3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id9A77A6FE10134C3081CADA700E65EFAB"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Consumer Product Safety Commission.</text>
				</paragraph><paragraph id="idA76A6D9DCF1C46F8BA2A09157F3C2630"><enum>(2)</enum><header>Liquid nicotine container</header>
 <subparagraph id="id0F11394098EB45028CF323259DF8CBA0"><enum>(A)</enum><header>In general</header><text>The term <term>liquid nicotine container</term> means a consumer product, as defined in section 3(a)(5) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)</external-xref>) notwithstanding subparagraph (B) of such section, that consists of a container that—</text>
 <clause id="id96D86CDAA15549A68960883B81CF1066"><enum>(i)</enum><text>has an opening from which nicotine in a solution or other form is accessible and can flow freely through normal and foreseeable use by a consumer; and</text>
 </clause><clause id="idA5A3238BD14540BEB39689E8E1C7CF24"><enum>(ii)</enum><text>is used to hold soluble nicotine in any concentration.</text> </clause></subparagraph><subparagraph id="id9252C5EA87C248D7BEA2FEDF6CC5D8EA"><enum>(B)</enum><header>Exclusions</header><text>The term <term>liquid nicotine container</term> does not include nicotine in a solution or other form in a sealed, pre-filled, disposable container inserted directly into an electronic cigarette or other similar device, so long as the nicotine in the container is inaccessible or cannot flow freely out of such container or electronic cigarette or other similar device through normal and foreseeable use by a consumer.</text>
 </subparagraph></paragraph><paragraph id="id3BB4C579508C4CF0B359E5107B93E06D"><enum>(3)</enum><header>Nicotine</header><text>The term <term>nicotine</term> means any form of the chemical nicotine, including any salt or complex, regardless of whether the chemical is naturally or synthetically derived.</text>
 </paragraph><paragraph id="id37A039E26EFB4653B43D30DBEE7F9234"><enum>(4)</enum><header>Special packaging</header><text>The term <term>special packaging</term> has the meaning given such term in section 2 of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1471">15 U.S.C. 1471</external-xref>).</text>
				</paragraph></subsection><subsection id="id088A4F1CE34446F3BC7D7A7630C42623"><enum>(b)</enum><header>Required use of special packaging for liquid nicotine containers</header>
				<paragraph id="id9109B8F7C8E64A43AEEFC40A203B9E8C"><enum>(1)</enum><header>Rulemaking</header>
 <subparagraph id="id51D74D8AC51144FEB0C3300E589541C9"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 3(a)(5)(B) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)(B)</external-xref>) or section 2(f)(2) of the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1261">15 U.S.C. 1261(f)(2)</external-xref>), not later than 1 year after the date of enactment of this Act, the Commission shall promulgate a rule requiring special packaging for liquid nicotine containers.</text>
 </subparagraph><subparagraph id="idBC2A590058FB46E6A04FBBED33DCD0D8"><enum>(B)</enum><header>Amendments</header><text>The Commission may promulgate such amendments to the rule promulgated under subparagraph (A) as the Commission considers appropriate.</text>
 </subparagraph></paragraph><paragraph id="idBCB6E79D7A594A98B63EA45F0E76B05F"><enum>(2)</enum><header>Expedited process</header><text>The Commission shall promulgate the rule under paragraph (1) in accordance with section 553 of title 5, United States Code.</text>
 </paragraph><paragraph id="id94EAF4BA2F454465A90967C802B2780F"><enum>(3)</enum><header>Inapplicability of certain rulemaking requirements</header><text>The following provisions shall not apply to a rulemaking under paragraph (1):</text> <subparagraph id="idF4AD5C6AB6E84143BADDD0BFE9131F24"><enum>(A)</enum><text>Sections 7 and 9 of the Consumer Product Safety Act (15 U.S.C. 2056 and 2058).</text>
 </subparagraph><subparagraph id="id638D14D21ABD44B49B87F34FC47D9523"><enum>(B)</enum><text>Section 3 of the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1262">15 U.S.C. 1262</external-xref>).</text> </subparagraph><subparagraph id="idC26DC55FE60D42A5812BDA910250B0DE"><enum>(C)</enum><text>Subsections (b) and (c) of section 3 of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1472">15 U.S.C. 1472</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id971BE56D14BA4593A5E0901C9EC9FD7A"><enum>(4)</enum><header>Savings clause</header><text>Nothing in this section shall be construed to limit or diminish the authority of the Food and Drug Administration to regulate the manufacture, marketing, sale, or distribution of liquid nicotine, liquid nicotine containers, electronic cigarettes, or similar products that contain or dispense liquid nicotine.</text>
 </paragraph><paragraph id="id3DAC9AF2BAF94AB58D4095B9494B19E1"><enum>(5)</enum><header>Enforcement</header><text>A rule promulgated under paragraph (1) shall be treated as a standard applicable to a household substance established under section 3(a) of the Poison Prevention Packaging Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/1472">15 U.S.C. 1472(a)</external-xref>).</text>
 </paragraph></subsection><subsection id="idB74E5E11EFD248D49062777571555926"><enum>(c)</enum><header>Reporting requirements</header><text>Not later than 3 years after the date of enactment of this Act, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report detailing the rule and requirements promulgated under this Act and any enforcement actions taken thereunder.</text>
