 <subsection id="idFB923CA1A1CE48F0AA2F21C62BC81931"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/63">Chapter 63</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

					<section id="id04AAF0A2E74B4A64AA507822A26EB4D0"><enum>6314.</enum><header>Port performance freight statistics program</header>
 <subsection id="idEC93AA69277245F6897DD7D947852C21"><enum>(a)</enum><header>In general</header><text>The Director shall establish, on behalf of the Secretary, a port performance statistics program to provide nationally consistent measures of performance of the Nation’s top 25 ports by tonnage, top 25 ports by 20-foot equivalent unit, and top 25 ports by dry bulk.</text>
						</subsection><subsection id="idBBD65F9890204AC6A5C3829068EE14FD"><enum>(b)</enum><header>Annual reports</header>
 <paragraph id="id172DA8E52BFC4B5BB719544749B335AA"><enum>(1)</enum><header>Port capacity and throughput</header><text>Not later than January 15 of each year, the Director shall submit an annual report to Congress that includes statistics on capacity and throughput at these ports.</text>
 </paragraph><paragraph id="id49B783DA932D4B98A7721AAA7F37A4E1"><enum>(2)</enum><header>Port performance indicators</header><text>The Director shall require each United States port authority referred to in subsection (a) that receives Federal assistance or is subject to Federal regulation to submit an annual report to the Bureau of Transportation Statistics that includes statistics on capacity and throughput, including—</text>
 <subparagraph id="idF4028DA951944CBDBA538078F4079286"><enum>(A)</enum><text>the volume of inbound and outbound cargo to include containers, break bulk, vehicles, and dry and liquid bulk;</text>
 </subparagraph><subparagraph id="id47CBF030EE4940C290B4DF7B52C790FF"><enum>(B)</enum><text>the average number of lifts per hour of containers by crane;</text> </subparagraph><subparagraph id="id4A897AB634B44C7395E45CDD07B5312B"><enum>(C)</enum><text>the average vessel unload rate;</text>
 </subparagraph><subparagraph id="id3C9E8A46427B43BAB15F35DC87CE6F2E"><enum>(D)</enum><text>the average vessel load rate;</text> </subparagraph><subparagraph id="idE58C89ED7D344F0A94E032817249500E"><enum>(E)</enum><text>the average vessel turn time;</text>
 </subparagraph><subparagraph id="idAA0DCEEB57544866A01889B70C405DBB"><enum>(F)</enum><text>port transit time;</text> </subparagraph><subparagraph id="id5E38CDB2A82445C3BC03DEDF8EB9A71A"><enum>(G)</enum><text>the average cargo dwell time;</text>
 </subparagraph><subparagraph id="id1287AD3179BD4BA18F16153AA647B6E5"><enum>(H)</enum><text>the average container dwell time;</text> </subparagraph><subparagraph id="id03ECE7A77AD6448CB3591A9975C68930"><enum>(I)</enum><text>port storage capacity and utilization;</text>
 </subparagraph><subparagraph id="id32F7D82AA0104124A8EB065566F7FD16"><enum>(J)</enum><text>the average wait time for trucks inside a port complex;</text> </subparagraph><subparagraph id="id63132EEC714741DFA207519C6F00BE6E"><enum>(K)</enum><text>the average truck time at ports; and</text>
 </subparagraph><subparagraph id="id1C3B79DB288240758B50B37E31BA8F88"><enum>(L)</enum><text>the average rail delay at ports.</text> </subparagraph></paragraph></subsection><subsection id="idDCCB59954AB348929386B730912DE49C"><enum>(c)</enum><header>Recommendations</header><text>The Director shall obtain recommendations for specifications for port performance measures, to identify standard data elements for measuring port performance, from—</text>
 <paragraph id="idCC6CB408BD61483BADFD5D92B12283CF"><enum>(1)</enum><text>operating administrations of the Department of Transportation;</text> </paragraph><paragraph id="id4190BF212450450A85876D5AEFD8AC19"><enum>(2)</enum><text>the Coast Guard;</text>
 </paragraph><paragraph id="idE5DE51C0064647338649BF75BDFE891D"><enum>(3)</enum><text>the Maritime Administration;</text> </paragraph><paragraph id="idAB0F448D329E408C92E471B51DA89166"><enum>(4)</enum><text>the Marine Transportation System National Advisory Council;</text>
 </paragraph><paragraph id="id4CD4CD51833B4C8EA191441374AC948C"><enum>(5)</enum><text>the Army Corps of Engineers;</text>
 </paragraph><paragraph id="id50348697DCED48A9A08A3B09C680B025"><enum>(6)</enum><text>the Saint Lawrence Seaway Development Corporation; and</text>
 </paragraph><paragraph id="idFD8AAF62400847D4AD9C26D36D213D83"><enum>(7)</enum><text>the Advisory Committee on Supply Chain Competitiveness.</text>
 </paragraph></subsection><subsection id="id0EE50C5F41AA4D53BE5A5785D5D40B28"><enum>(d)</enum><header>Access to data</header><text>The Director shall ensure that the statistics compiled under this section are readily accessible to the public, consistent with applicable security constraints and confidentiality interests.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id9F26D0C390AA4E1AA58FACB12420E1D5"><enum>(b)</enum><header>Prohibition on certain disclosures</header><text>Section 6307(b)(1) of title 49, United States Code, is amended by inserting <quote>or section 6314(b)</quote> after <quote>section 6302(b)(3)(B)</quote> each place it appears.</text> </subsection><subsection id="id998F8D8B1B98468A9238E17223110537"><enum>(c)</enum><header>Copies of reports</header><text>Section 6307(b)(2)(A) of title 49, United States Code, is amended by inserting <quote>or section 6314(b)</quote> after <quote>section 6302(b)(3)(B)</quote>.</text>

			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id3EB194B2917747A3BC0375B1EC73BAC3" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Monthly reports on performance at United States ports</header>
 <subsection id="id8b00b026ef22486ba85099b7c020d9f8"><enum>(a)</enum><header>In general</header><text>Not later than 1 year before the expiration date of a maritime labor agreement for a United States port, 3 months before the expiration date of the maritime labor agreement, and monthly thereafter, the Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that includes port performance indicators at the affected port. If multiple ports are affected by the expiration of the maritime labor agreement, the Secretary of Transportation shall submit a report for each affected port.</text>
 </subsection><subsection id="idfbe2c046a4d741d68fad12f32004f121"><enum>(b)</enum><header>Contents</header><text>Each report required under subsection (a) shall include, for the affected port during the previous month—</text>
 <paragraph id="id0267EEFCF1FD4560BAE91F3BD78E9A5C"><enum>(1)</enum><text>the performance indicators listed under section 6314(b)(2) of title 49, United States Code;</text> </paragraph><paragraph id="id93052811b36c4c4594923f637581ae52"><enum>(2)</enum><text>the number and type of vessels awaiting berthing, including average wait time;</text>
 </paragraph><paragraph id="id91525e2fcefe4a0886135866a5ad7e69"><enum>(3)</enum><text>the number of cancelled vessel calls;</text> </paragraph><paragraph id="idbc3ce9c99d3744e8ad9248701708ee8b"><enum>(4)</enum><text>an estimate of the economic impact associated with any delays both at the port and across the national economy; and</text>
 </paragraph><paragraph id="idb47b5de2717c48f291ead3efff2eac7f"><enum>(5)</enum><text>an estimate of the amount of time required to clear any congestion.</text> </paragraph></subsection><subsection id="id3a71833c04974478ba56778062887a78"><enum>(c)</enum><header>Effective period</header><text>The Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report required under subsection (a) for an affected port until the date that a new maritime labor agreement for the port is agreed to by all of the parties to that maritime labor agreement.</text>
 </subsection><subsection id="id3B2D624E5F3F4787A54D0903FD45A477"><enum>(d)</enum><header>Definition of maritime labor agreement</header><text>In this section, the term <term>maritime labor agreement</term> has the meaning given such term in section 40102 of title 46, United States Code.</text></subsection></section></legis-body> <legis-body display-enacting-clause="no-display-enacting-clause"> <section changed="added" committee-id="SSCM00" id="id75d687a3-88b7-4405-be2e-04b4f1b9e4e4" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Port Performance Act</short-title></quote>.</text>
 </section><section changed="added" committee-id="SSCM00" id="id874016787867411D9F8DC59CD72BDF9C" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="id42f3cd925f4542cc8f7312e8414b98a1"><enum>(1)</enum><text>America’s ports play a critical role in the Nation’s transportation supply chain network.</text>
 </paragraph><paragraph id="id2A1DBE03CC78499EA678853163E9869C"><enum>(2)</enum><text>Reliable and efficient movement of goods through the Nation’s ports ensures that American goods are available to customers throughout the world.</text>
 </paragraph><paragraph id="id3E49E57F86FB4AA69630356626F4D3D5"><enum>(3)</enum><text>Breakdowns in the transportation supply chain network, particularly at the Nation’s ports, can result in tremendous economic losses for agriculture, businesses, and retailers that rely on timely shipments.</text>
 </paragraph><paragraph id="idB24C4E89C1844C619254F4843C3642E4"><enum>(4)</enum><text>A clear understanding of port productivity and throughput would help—</text> <subparagraph id="id06341EF641814FC8AE44B9607775A95B"><enum>(A)</enum><text>to identify freight bottlenecks;</text>
 </subparagraph><subparagraph id="id7613D7A1B8024A17BDF179DDD0FE08C1"><enum>(B)</enum><text>to indicate performance and trends over time; and</text> </subparagraph><subparagraph id="id41C3465C404E4C17BBF76ED729BD77A4"><enum>(C)</enum><text>to inform investment decisions.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SSCM00" id="id8AD47066A63A4C5287D1D6B1BDA68862" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Port performance freight statistics program</header>
 <subsection id="idb692b100-6139-4e0c-b988-2fdec490715d"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/63">Chapter 63</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

 <subsection id="id7f995db2-ecbb-4b68-8a5c-24513fd509fa"><enum>(a)</enum><header>In general</header><text>The Director shall establish, on behalf of the Secretary, a port performance statistics program to provide nationally consistent measures of performance of—</text>
 <paragraph id="id73CA2AF0333243C9A2CF91F411FFB297"><enum>(1)</enum><text>the Nation’s top 25 ports by tonnage;</text>
 </paragraph><paragraph id="id061A1E38B95242249115C359D14EFA68"><enum>(2)</enum><text>the Nation’s top 25 ports by 20-foot equivalent unit; and</text> </paragraph><paragraph id="id52FD65A0869C465C96058939C440B5E3"><enum>(3)</enum><text>the Nation’s top 25 ports by dry bulk.</text>
							</paragraph></subsection><subsection id="idbc82dab3-465c-4712-9505-a92f9b32a75b"><enum>(b)</enum><header>Annual reports</header>
 <paragraph id="idbc985748-089c-4662-9c9d-cd72c8e4c443"><enum>(1)</enum><header>Port capacity and throughput</header><text>Not later than January 15 of each year, the Director shall submit an annual report to Congress that includes statistics on capacity and throughput at the ports described in subsection (a).</text>
 </paragraph><paragraph id="id38e818d0-b0c2-4918-8e93-d78c34a56308"><enum>(2)</enum><header>Port performance measures</header><text>The Director shall collect monthly port performance measures for each of the United States ports referred to in subsection (a) that receives Federal assistance or is subject to Federal regulation to submit an annual report to the Bureau of Transportation Statistics that includes monthly statistics on capacity and throughput as applicable to the specific configuration of the port, including—</text>
 <subparagraph id="id1478ca94-d494-4899-a2eb-621ab3157ff6"><enum>(A)</enum><text>the total capacity of inbound and outbound cargo, including containers, break bulk, vehicles, and dry and liquid bulk;</text>
 </subparagraph><subparagraph id="id556BB4F621F0406E940FEC2DCEA85CA4"><enum>(B)</enum><text>the total volume of inbound and outbound cargo, including containers, break bulk, vehicles, and dry and liquid bulk;</text>
 </subparagraph><subparagraph id="id2d77b41f-abf7-4047-86a6-cd01b11fbe60"><enum>(C)</enum><text>the average number of lifts per hour of containers by crane;</text> </subparagraph><subparagraph id="id47af267a-c7ce-43d5-9398-b234841a78a4"><enum>(D)</enum><text>the average vessel turn time by vessel type;</text>
 </subparagraph><subparagraph id="idfb8802a0-63fe-4502-b4a2-567a7fa613ac"><enum>(E)</enum><text>the average cargo or container dwell time;</text> </subparagraph><subparagraph id="id36356594-f521-49f3-9491-64d215f044d3"><enum>(F)</enum><text>port storage capacity and utilization;</text>
 </subparagraph><subparagraph id="id0d8754a0-042b-422b-a766-42dd4100c9bb"><enum>(G)</enum><text>the average truck time at ports;</text> </subparagraph><subparagraph id="id6ba4adf7-ae2a-4d1b-aaeb-0c84be692c35"><enum>(H)</enum><text>the average rail time at ports; and</text>
 </subparagraph><subparagraph id="id91912B9FF14A40FFB8BEBC88CFD678DA"><enum>(I)</enum><text>any additional metrics, as determined by the Director after receiving recommendations from the working group established under subsection (c).</text>
								</subparagraph></paragraph></subsection><subsection id="ide9d4b998-7ea3-4742-a69c-171a7f39abde"><enum>(c)</enum><header>Recommendations</header>
 <paragraph id="idA55CC920293A4AB7BAA7B3BF853B8051"><enum>(1)</enum><header>In general</header><text>The Director shall obtain recommendations for—</text> <subparagraph id="id337E0C7D66904DD39359CD4C9F454571"><enum>(A)</enum><text>specifications and data measurements for the port performance measures listed in subsection (b)(2);</text>
 </subparagraph><subparagraph id="id8E2A5CD55AF14B2DB34134BD3EF9AC2E"><enum>(B)</enum><text>additionally needed data elements for measuring port performance; and</text>
 </subparagraph><subparagraph id="idB62DD6F22BA34AC699132C90286591E6"><enum>(C)</enum><text>a process for the Department of Transportation to collect timely and consistent data, including identifying safeguards to protect proprietary information described in subsection (b)(2).</text>
 </subparagraph></paragraph><paragraph id="idC5F46746EF7544319D0C2ABFDF94F01F"><enum>(2)</enum><header>Working group</header><text>Not later than 60 days after the date of the enactment of this Act, the Director shall commission a working group composed of—</text>
 <subparagraph id="idd18336db-b04e-40ff-835f-7de25f9ecdc6"><enum>(A)</enum><text>operating administrations of the Department of Transportation;</text> </subparagraph><subparagraph id="id8c5be3ea-2100-4693-859c-630152bd487e"><enum>(B)</enum><text>the Coast Guard;</text>
 </subparagraph><subparagraph id="idb63ced36-773c-4a33-ae5d-6f96d6f34547"><enum>(C)</enum><text>the Federal Maritime Commission;</text> </subparagraph><subparagraph id="idFE64C920DC3541CA95E5311039B32228"><enum>(D)</enum><text>U.S. Customs and Border Protection;</text>
 </subparagraph><subparagraph id="idb4eb4790-3687-40ba-9cff-9d3a0ddf03d7"><enum>(E)</enum><text>the Marine Transportation System National Advisory Council;</text>
 </subparagraph><subparagraph id="id573943d4-a71a-45e5-95d3-e955d448dcb7"><enum>(F)</enum><text>the Army Corps of Engineers;</text>
 </subparagraph><subparagraph id="id11135046-8da7-4f4e-9ada-e23348a83e13"><enum>(G)</enum><text>the Saint Lawrence Seaway Development Corporation;</text>
 </subparagraph><subparagraph id="id84082764-5fbf-4da3-840e-f90cc8dffa18"><enum>(H)</enum><text>the Advisory Committee on Supply Chain Competitiveness;</text>
 </subparagraph><subparagraph id="idF3A02C97F63F43ABA56AD3FE74A65082"><enum>(I)</enum><text>1 representative from the rail industry;</text> </subparagraph><subparagraph id="id6DE1E6D9C13347F1A867C0F359A22747"><enum>(J)</enum><text>1 representative from the trucking industry;</text>
 </subparagraph><subparagraph id="id9E31D7A3DC814D77A7A8A0F455422251"><enum>(K)</enum><text>1 representative from the port management industry;</text> </subparagraph><subparagraph id="idC6891E9921B84208934C7D28D7E9E555"><enum>(L)</enum><text>1 representative from the maritime shipping industry;</text>
 </subparagraph><subparagraph id="idF024E8252E354AE8A87D6078FD989F52"><enum>(M)</enum><text>1 representative from the maritime labor industry;</text> </subparagraph><subparagraph id="idA1ACC3242C024B8688AD2F8C4021CB29"><enum>(N)</enum><text>representatives of the National Freight Advisory Committee of the Department; and</text>
 </subparagraph><subparagraph id="idE595C8F2F8F94BC08A3968A13FC8F283"><enum>(O)</enum><text>representatives of the Transportation Research Board of the National Academies.</text> </subparagraph></paragraph><paragraph id="id47F30435BA2D474AA7AE837182BC3924"><enum>(3)</enum><header>Recommendations</header><text>Not later than 1 year after the date of the enactment of this Act, the working group commissioned under this subsection shall submit its recommendations to the Director.</text>

 <subsection id="id9905afcb-0a8a-4aa6-ac11-2c377180ae16"><enum>(a)</enum><header>In general</header><text>Not later than 1 year before the expiration date of a maritime labor agreement that applies to facilities of a United States port, 3 months before the expiration date of the maritime labor agreement, and monthly thereafter until a new agreement is agreed to, the Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that includes port performance indicators at the affected port. If multiple ports are affected by the expiration of the maritime labor agreement, the Secretary of Transportation shall submit a report for each affected port.</text>
 </subsection><subsection id="id0cec548c-c3bc-434f-a228-70e69343c338"><enum>(b)</enum><header>Contents</header><text>Each report required under subsection (a) shall include, for the affected port during the previous month—</text>
 <paragraph id="idbc5e5e1a-d27c-4319-8a47-f8262aec5559"><enum>(1)</enum><text>the performance indicators listed under section 6314(b)(2) of title 49, United States Code;</text> </paragraph><paragraph id="id97bfcf95-7261-4f4b-8ab9-d6d4f5091b3f"><enum>(2)</enum><text>the number and type of vessels awaiting berthing, including average wait time;</text>
 </paragraph><paragraph id="id24150e4b-d5c7-42e3-a203-4b26bf86aea9"><enum>(3)</enum><text>the number of cancelled vessel calls;</text> </paragraph><paragraph id="id948fd6b3-ad3d-4c15-bc42-2166a07b5884"><enum>(4)</enum><text>an estimate of the economic impact associated with any delays both at the port and across the national economy;</text>
 </paragraph><paragraph id="ided2e9f66-34d0-4ccf-99ab-fe7d05fa5bf2"><enum>(5)</enum><text>an estimate of the amount of time required to clear any congestion;</text> </paragraph><paragraph id="id51652619C8E44E14B0082B728A43D34B"><enum>(6)</enum><text>the average number of positions ordered and filled; and</text>
 </paragraph><paragraph id="idC13B96CA423E4C36BB1FF3E0EB6E5C0F"><enum>(7)</enum><text>any other factors that might have created delays, including weather, equipment maintenance or failures, or infrastructure development or repair.</text>
 </paragraph></subsection><subsection id="id2248af73-8eb8-4c75-95c0-36917a45b2f6"><enum>(c)</enum><header>Effective period</header><text>The Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report required under subsection (a) for an affected port until the date on which a new maritime labor agreement that applies to the facilities of the port is agreed to by all of the parties to that maritime labor agreement.</text>
