		<section id="id02263AC37DBB444A8B8A91FF46AB7DB3" section-type="section-one"><enum>1.</enum><header>Port performance freight statistics program</header>
 <subsection id="idFB923CA1A1CE48F0AA2F21C62BC81931"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/63">Chapter 63</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3BB5490A058547838C067DCC03848EEE" style="USC">
					<section id="id04AAF0A2E74B4A64AA507822A26EB4D0"><enum>6314.</enum><header>Port performance freight statistics program</header>
 <subsection id="idEC93AA69277245F6897DD7D947852C21"><enum>(a)</enum><header>In general</header><text>The Director shall establish, on behalf of the Secretary, a port performance statistics program to provide nationally consistent measures of performance of the Nation’s top 25 ports by tonnage, top 25 ports by 20-foot equivalent unit, and top 25 ports by dry bulk.</text>
						</subsection><subsection id="idBBD65F9890204AC6A5C3829068EE14FD"><enum>(b)</enum><header>Annual reports</header>
 <paragraph id="id172DA8E52BFC4B5BB719544749B335AA"><enum>(1)</enum><header>Port capacity and throughput</header><text>Not later than January 15 of each year, the Director shall submit an annual report to Congress that includes statistics on capacity and throughput at these ports.</text>
 </paragraph><paragraph id="id49B783DA932D4B98A7721AAA7F37A4E1"><enum>(2)</enum><header>Port performance indicators</header><text>The Director shall require each United States port authority referred to in subsection (a) that receives Federal assistance or is subject to Federal regulation to submit an annual report to the Bureau of Transportation Statistics that includes statistics on capacity and throughput, including—</text>
 <subparagraph id="idF4028DA951944CBDBA538078F4079286"><enum>(A)</enum><text>the volume of inbound and outbound cargo to include containers, break bulk, vehicles, and dry and liquid bulk;</text>
 </subparagraph><subparagraph id="id47CBF030EE4940C290B4DF7B52C790FF"><enum>(B)</enum><text>the average number of lifts per hour of containers by crane;</text> </subparagraph><subparagraph id="id4A897AB634B44C7395E45CDD07B5312B"><enum>(C)</enum><text>the average vessel unload rate;</text>
 </subparagraph><subparagraph id="id3C9E8A46427B43BAB15F35DC87CE6F2E"><enum>(D)</enum><text>the average vessel load rate;</text> </subparagraph><subparagraph id="idE58C89ED7D344F0A94E032817249500E"><enum>(E)</enum><text>the average vessel turn time;</text>
 </subparagraph><subparagraph id="idAA0DCEEB57544866A01889B70C405DBB"><enum>(F)</enum><text>port transit time;</text> </subparagraph><subparagraph id="id5E38CDB2A82445C3BC03DEDF8EB9A71A"><enum>(G)</enum><text>the average cargo dwell time;</text>
 </subparagraph><subparagraph id="id1287AD3179BD4BA18F16153AA647B6E5"><enum>(H)</enum><text>the average container dwell time;</text> </subparagraph><subparagraph id="id03ECE7A77AD6448CB3591A9975C68930"><enum>(I)</enum><text>port storage capacity and utilization;</text>
 </subparagraph><subparagraph id="id32F7D82AA0104124A8EB065566F7FD16"><enum>(J)</enum><text>the average wait time for trucks inside a port complex;</text> </subparagraph><subparagraph id="id63132EEC714741DFA207519C6F00BE6E"><enum>(K)</enum><text>the average truck time at ports; and</text>
 </subparagraph><subparagraph id="id1C3B79DB288240758B50B37E31BA8F88"><enum>(L)</enum><text>the average rail delay at ports.</text> </subparagraph></paragraph></subsection><subsection id="idDCCB59954AB348929386B730912DE49C"><enum>(c)</enum><header>Recommendations</header><text>The Director shall obtain recommendations for specifications for port performance measures, to identify standard data elements for measuring port performance, from—</text>
 <paragraph id="idCC6CB408BD61483BADFD5D92B12283CF"><enum>(1)</enum><text>operating administrations of the Department of Transportation;</text> </paragraph><paragraph id="id4190BF212450450A85876D5AEFD8AC19"><enum>(2)</enum><text>the Coast Guard;</text>
 </paragraph><paragraph id="idE5DE51C0064647338649BF75BDFE891D"><enum>(3)</enum><text>the Maritime Administration;</text> </paragraph><paragraph id="idAB0F448D329E408C92E471B51DA89166"><enum>(4)</enum><text>the Marine Transportation System National Advisory Council;</text>
 </paragraph><paragraph id="id4CD4CD51833B4C8EA191441374AC948C"><enum>(5)</enum><text>the Army Corps of Engineers;</text>
 </paragraph><paragraph id="id50348697DCED48A9A08A3B09C680B025"><enum>(6)</enum><text>the Saint Lawrence Seaway Development Corporation; and</text>
 </paragraph><paragraph id="idFD8AAF62400847D4AD9C26D36D213D83"><enum>(7)</enum><text>the Advisory Committee on Supply Chain Competitiveness.</text>
 </paragraph></subsection><subsection id="id0EE50C5F41AA4D53BE5A5785D5D40B28"><enum>(d)</enum><header>Access to data</header><text>The Director shall ensure that the statistics compiled under this section are readily accessible to the public, consistent with applicable security constraints and confidentiality interests.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id9F26D0C390AA4E1AA58FACB12420E1D5"><enum>(b)</enum><header>Prohibition on certain disclosures</header><text>Section 6307(b)(1) of title 49, United States Code, is amended by inserting <quote>or section 6314(b)</quote> after <quote>section 6302(b)(3)(B)</quote> each place it appears.</text> </subsection><subsection id="id998F8D8B1B98468A9238E17223110537"><enum>(c)</enum><header>Copies of reports</header><text>Section 6307(b)(2)(A) of title 49, United States Code, is amended by inserting <quote>or section 6314(b)</quote> after <quote>section 6302(b)(3)(B)</quote>.</text>
 </subsection><subsection id="idA1BA3193A55B4FE89ED4B05C620B361E"><enum>(d)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/63">chapter 63</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="id3EB194B2917747A3BC0375B1EC73BAC3" section-type="subsequent-section"><enum>2.</enum><header>Monthly reports on performance at United States ports</header>
 <subsection id="id8b00b026ef22486ba85099b7c020d9f8"><enum>(a)</enum><header>In general</header><text>Not later than 1 year before the expiration date of a maritime labor agreement for a United States port, 3 months before the expiration date of the maritime labor agreement, and monthly thereafter, the Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that includes port performance indicators at the affected port. If multiple ports are affected by the expiration of the maritime labor agreement, the Secretary of Transportation shall submit a report for each affected port.</text>
 </subsection><subsection id="idfbe2c046a4d741d68fad12f32004f121"><enum>(b)</enum><header>Contents</header><text>Each report required under subsection (a) shall include, for the affected port during the previous month—</text>
 <paragraph id="id0267EEFCF1FD4560BAE91F3BD78E9A5C"><enum>(1)</enum><text>the performance indicators listed under section 6314(b)(2) of title 49, United States Code;</text> </paragraph><paragraph id="id93052811b36c4c4594923f637581ae52"><enum>(2)</enum><text>the number and type of vessels awaiting berthing, including average wait time;</text>
 </paragraph><paragraph id="id91525e2fcefe4a0886135866a5ad7e69"><enum>(3)</enum><text>the number of cancelled vessel calls;</text> </paragraph><paragraph id="idbc3ce9c99d3744e8ad9248701708ee8b"><enum>(4)</enum><text>an estimate of the economic impact associated with any delays both at the port and across the national economy; and</text>
 </paragraph><paragraph id="idb47b5de2717c48f291ead3efff2eac7f"><enum>(5)</enum><text>an estimate of the amount of time required to clear any congestion.</text> </paragraph></subsection><subsection id="id3a71833c04974478ba56778062887a78"><enum>(c)</enum><header>Effective period</header><text>The Secretary of Transportation, in consultation with the Secretary of Commerce and the Secretary of Labor, shall submit a report required under subsection (a) for an affected port until the date that a new maritime labor agreement for the port is agreed to by all of the parties to that maritime labor agreement.</text>
 </subsection><subsection id="id3B2D624E5F3F4787A54D0903FD45A477"><enum>(d)</enum><header>Definition of maritime labor agreement</header><text>In this section, the term <term>maritime labor agreement</term> has the meaning given such term in section 40102 of title 46, United States Code.</text></subsection></section></legis-body></bill>
