 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Integrated Public Alert and Warning System Modernization Act of 2015</short-title></quote>.</text>
		</section><section id="idB4618FFFAF3B463CB6F677D358C0B800"><enum>2.</enum><header>Integrated public alert and warning system modernization</header>
 <subsection id="HC57A38C657314742BDFAEE2CF22DE5EC"><enum>(a)</enum><header>In general</header><text>Title V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id327505DA9F7349278E3F69F21BAF3C22" style="OLC">
					<section id="id0514802C4FCD4B3E9813C3571B0EDE96"><enum>526.</enum><header>Integrated public alert and warning system modernization</header>
 <subsection id="id4B8BEE4DE28042BABC1DA015E8B89F14"><enum>(a)</enum><header>In general</header><text>To provide timely and effective warnings regarding natural disasters, acts of terrorism, and other man-made disasters or threats to public safety, the Administrator shall—</text>
 <paragraph id="H33BADF0BF6C34C619A572541BB570232"><enum>(1)</enum><text>modernize the integrated public alert and warning system of the United States (in this section referred to as the <quote>public alert and warning system</quote>) to help ensure that under all conditions the President and, except to the extent the public alert and warning system is in use by the President, Federal agencies and State, tribal, and local governments can alert and warn the civilian population in areas endangered by natural disasters, acts of terrorism, and other man-made disasters or threats to public safety; and</text>
 </paragraph><paragraph id="HA75F711CDA824C7C8C0B49CBA9EC3706"><enum>(2)</enum><text>implement the public alert and warning system to disseminate timely and effective warnings regarding natural disasters, acts of terrorism, and other man-made disasters or threats to public safety.</text>
 </paragraph></subsection><subsection id="H843B72B0EF074E11BB93535BFA2811AB"><enum>(b)</enum><header>Implementation requirements</header><text>In carrying out subsection (a), the Administrator shall—</text> <paragraph id="H1CFB41D616B147449FC1E6C2BDE0238B"><enum>(1)</enum><text>establish or adopt, as appropriate, common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system;</text>
 </paragraph><paragraph id="HD866EB6583DE40C6ACAFE12F1DAA4434"><enum>(2)</enum><text>include in the public alert and warning system the capability to adapt the distribution and content of communications on the basis of geographic location, risks, and multiple communication systems and technologies, as appropriate and to the extent technically feasible;</text>
 </paragraph><paragraph id="H25872C51B8E6402DA118D9A20C74B34D"><enum>(3)</enum><text>include in the public alert and warning system the capability to alert, warn, and provide equivalent information to individuals with disabilities, individuals with access and functional needs, and individuals with limited-English proficiency, to the extent technically feasible;</text>
 </paragraph><paragraph id="HF49DED993BDA4C9DBD8B7CE34FF8E54F"><enum>(4)</enum><text>ensure that training, tests, and exercises are conducted for the public alert and warning system, including by—</text>
 <subparagraph id="HCD58D9BEE27F43A2BBD43E4D14903EE2"><enum>(A)</enum><text>incorporating the public alert and warning system into other training and exercise programs of the Department, as appropriate;</text>
 </subparagraph><subparagraph id="HCDEB4DA46D1B4AF2AD6E2043512D2B86"><enum>(B)</enum><text>establishing and integrating into the National Incident Management System a comprehensive and periodic training program to instruct and educate Federal, State, tribal, and local government officials in the use of the Common Alerting Protocol enabled Emergency Alert System; and</text>
 </subparagraph><subparagraph id="H4E4C1ADE807040D3A14E227CDC7F8A8C"><enum>(C)</enum><text>conducting, not less than once every 3 years, periodic nationwide tests of the public alert and warning system;</text>
 </subparagraph></paragraph><paragraph id="HCBA23D1762BF4F81AA0F98E6A33AD156"><enum>(5)</enum><text>to the extent practicable, ensure that the public alert and warning system is resilient and secure and can withstand acts of terrorism and other external attacks;</text>
 </paragraph><paragraph id="H5C6688F97B004B7EAB65F868DA51236E"><enum>(6)</enum><text>conduct public education efforts so that State, tribal, and local governments, private entities, and the people of the United States reasonably understand the functions of the public alert and warning system and how to access, use, and respond to information from the public alert and warning system through a general market awareness campaign;</text>
 </paragraph><paragraph id="H78A56954F8764AEF82FCB052010187B7"><enum>(7)</enum><text>consult, coordinate, and cooperate with the appropriate private sector entities and Federal, State, tribal, and local governmental authorities, including the Regional Administrators and emergency response providers;</text>
 </paragraph><paragraph id="id0A9A36E940C7413A8452C4FFB78521C6"><enum>(8)</enum><text>consult and coordinate with the Federal Communications Commission, taking into account rules and regulations promulgated by the Federal Communications Commission; and</text>
 </paragraph><paragraph id="H7F8EE7B94D0E41E2BBA6FF4D56F1D39E"><enum>(9)</enum><text>coordinate with and consider the recommendations of the Integrated Public Alert and Warning System Subcommittee established under section 2(b) of the <short-title>Integrated Public Alert and Warning System Modernization Act of 2015</short-title>.</text>
 </paragraph></subsection><subsection id="H9D0ED423F208472787D24C121F0F5BC1"><enum>(c)</enum><header>System requirements</header><text>The public alert and warning system shall—</text> <paragraph id="H3732F89681CD4CAF8DCE3C8A42E9367D"><enum>(1)</enum><text>to the extent determined appropriate by the Administrator, incorporate multiple communications technologies;</text>
 </paragraph><paragraph id="H55E7F70AC12540BFA6C83C8A4D311648"><enum>(2)</enum><text>be designed to adapt to, and incorporate, future technologies for communicating directly with the public;</text>
 </paragraph><paragraph id="H8762AB9BA50D4BBE83992960BCFA7332"><enum>(3)</enum><text>to the extent technically feasible, be designed—</text> <subparagraph id="HDCC0758BAC9A4AD4BAD6A68FE38F47F5"><enum>(A)</enum><text>to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, individuals with disabilities, individuals with access and functional needs, and individuals with limited-English proficiency; and</text>
 </subparagraph><subparagraph id="H31650C7BE56D429F9022B7991D42BE1C"><enum>(B)</enum><text>to improve the ability of remote areas to receive alerts;</text> </subparagraph></paragraph><paragraph id="H95EA1F450420408D901ECED373300164"><enum>(4)</enum><text>promote local and regional public and private partnerships to enhance community preparedness and response;</text>
 </paragraph><paragraph id="H13090D3B371B4C278A2B64A85FF4BC31"><enum>(5)</enum><text>provide redundant alert mechanisms where practicable so as to reach the greatest number of people; and</text>
 </paragraph><paragraph id="H37207CFEF7774A81837D5322BE8D1CB0"><enum>(6)</enum><text>to the extent feasible, include a mechanism to ensure the protection of individual privacy.</text> </paragraph></subsection><subsection id="HA382DA7A69EE4B6C99FEF3A5D72DE5D1"><enum>(d)</enum><header>Use of system</header><text>Except to the extent necessary for testing the public alert and warning system, the public alert and warning system shall not be used to transmit a message that does not relate to a natural disaster, act of terrorism, or other man-made disaster or threat to public safety.</text>
						</subsection><subsection id="H27EB9C128B1F4A33B07BD05D6024CBBF"><enum>(e)</enum><header>Performance reports</header>
 <paragraph id="H8001D7EDF98849B0A4A1C8A4ADC2E152"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Integrated Public Alert and Warning System Modernization Act of 2015</short-title>, and annually thereafter through 2018, the Administrator shall make available on the public website of the Agency a performance report, which shall—</text>
 <subparagraph id="H6C6EE830FBB84BC5A262EC25066CAE05"><enum>(A)</enum><text>establish performance goals for the implementation of the public alert and warning system by the Agency;</text>
 </subparagraph><subparagraph id="H3A1D1338F6F941C9B3DF901A8DC438F1"><enum>(B)</enum><text>describe the performance of the public alert and warning system, including—</text> <clause id="H4EFB5AA192E3480FA68FB942E1B7F258"><enum>(i)</enum><text>the type of technology used for alerts and warnings issued under the system;</text>
 </clause><clause id="H8688137C3B0D47B2A20ECBF597755AE0"><enum>(ii)</enum><text>the measures taken to alert, warn, and provide equivalent information to individuals with disabilities, individuals with access and function needs, and individuals with limited-English proficiency; and</text>
 </clause><clause id="HD3D705F7857A401D8F284D3DC7921020"><enum>(iii)</enum><text>the training, tests, and exercises performed and the outcomes obtained by the Agency;</text> </clause></subparagraph><subparagraph id="H789D0E7B66364A4DA050F696AA139963"><enum>(C)</enum><text>identify significant challenges to the effective operation of the public alert and warning system and any plans to address these challenges;</text>
 </subparagraph><subparagraph id="HC864D62E6BBA44D295EA7B3E69DC3672"><enum>(D)</enum><text>identify other necessary improvements to the system; and</text> </subparagraph><subparagraph id="H5FBEBDC7AF5F49E59667ABBDCD4DCCC0"><enum>(E)</enum><text>provide an analysis comparing the performance of the public alert and warning system with the performance goals established under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="HE57A6A617BF843DF8E3BCF85BC648631"><enum>(2)</enum><header>Congress</header><text>The Administrator shall submit to the Committee on Homeland Security and Governmental Affairs and the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure and the Committee on Homeland Security of the House of Representatives each report required under paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H794204D36667449D864FFC941AA16B3C"><enum>(b)</enum><header>Integrated Public Alert and Warning System Subcommittee</header>
 <paragraph id="HFBA4B937CC3C408A9F48830ABDC8C47D"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency (in this subsection referred to as the <term>Administrator</term>) shall establish a subcommittee to the National Advisory Council established under section 508 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/318">6 U.S.C. 318</external-xref>) to be known as the Integrated Public Alert and Warning System Subcommittee (in this subsection referred to as the <quote>Subcommittee</quote>).</text>
 </paragraph><paragraph id="HA5445AD9AFB94B218D455951D9597CF7"><enum>(2)</enum><header>Membership</header><text>Notwithstanding section 508(c) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/318">6 U.S.C. 318(c)</external-xref>), the Subcommittee shall be composed of the following members (or their designees):</text>
 <subparagraph id="H60EE619427574551900D24D46021066C"><enum>(A)</enum><text>The Deputy Administrator for Protection and National Preparedness of the Federal Emergency Management Agency.</text>
 </subparagraph><subparagraph id="id8489002AF486488FB3F62B4D10BE02A4"><enum>(B)</enum><text>The Chairman of the Federal Communications Commission.</text> </subparagraph><subparagraph id="HF43D21E248424886B913629A2BBF6D99"><enum>(C)</enum><text>The Administrator of the National Oceanic and Atmospheric Administration of the Department of Commerce.</text>
 </subparagraph><subparagraph id="H7686F83D6EE14B9482572230EF96836E"><enum>(D)</enum><text>The Assistant Secretary for Communications and Information of the Department of Commerce.</text> </subparagraph><subparagraph id="HC1EDEBEC267A42E5A830B4D290B75054"><enum>(E)</enum><text>The Under Secretary for Science and Technology of the Department of Homeland Security.</text>
 </subparagraph><subparagraph id="H0E54F28A5F3D4539AE4851D49CB6EE18"><enum>(F)</enum><text>The Under Secretary for the National Protection and Programs Directorate.</text> </subparagraph><subparagraph id="H20DD8E0751A0424D89AEBA7FC6CB4C7D"><enum>(G)</enum><text>The Director of Disability Integration and Coordination of the Federal Emergency Management Agency.</text>
 </subparagraph><subparagraph id="H2C8E6A9E099B4C79A17C0C92277F1ADD"><enum>(H)</enum><text>The Chairperson of the National Council on Disability.</text> </subparagraph><subparagraph id="H2D989258137E45E08A24B146DCF2B922"><enum>(I)</enum><text display-inline="yes-display-inline">Qualified individuals appointed by the Administrator as soon as practicable after the date of enactment of this Act from among the following:</text>
 <clause id="HB738F426FEA34B61AECB47500859FA35"><enum>(i)</enum><text>Representatives of State and local governments, representatives of emergency management agencies, and representatives of emergency response providers.</text>
 </clause><clause id="H52BECF224E6E4504A312B50F43DC9927"><enum>(ii)</enum><text>Representatives from federally recognized Indian tribes and national Indian organizations.</text> </clause><clause id="H9BC58E75818A4F5CA580C6F2B9D4680E"><enum>(iii)</enum><text>Individuals who have the requisite technical knowledge and expertise to serve on the Subcommittee, including representatives of—</text>
 <subclause id="H6BD82EBA647F4AB0B916B88B13FC8993"><enum>(I)</enum><text>communications service providers;</text> </subclause><subclause id="HBFF21565CAB14F2A8FE4563EB12118C1"><enum>(II)</enum><text>vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for the provision of communications services;</text>
 </subclause><subclause id="HD85511771C1241718B25617EFECF7D64"><enum>(III)</enum><text>third-party service bureaus;</text> </subclause><subclause id="H397CE3E695CE42A582579A5E7739337D"><enum>(IV)</enum><text>the broadcasting industry, including public broadcasting;</text>
 </subclause><subclause id="H3E6592C802FE4ED2945678625A023DA5"><enum>(V)</enum><text>the commercial mobile radio service industry;</text> </subclause><subclause id="HE955A60C6FE2476ABF2A10843FB1ADCC"><enum>(VI)</enum><text>the cable industry;</text>
 </subclause><subclause id="HD58D6B4E0BF849AE8CA4D576A8E85D7A"><enum>(VII)</enum><text>the satellite industry;</text> </subclause><subclause id="HC49AD8488BFB4F62BD731CE7CCE07D64"><enum>(VIII)</enum><text>national organizations representing individuals with disabilities, the blind, deaf, and hearing-loss communities, individuals with access and functional needs, and the elderly;</text>
 </subclause><subclause id="H413E8E7A0C774FEABB29135AF6E82589"><enum>(IX)</enum><text>consumer or privacy advocates; and</text> </subclause><subclause id="H6C8EEBDB5C2445A5B210843D3F81AC6D"><enum>(X)</enum><text>organizations representing individuals with limited-English proficiency.</text>
 </subclause></clause><clause id="H600836D0895D4367986E079BDC3D2EFB"><enum>(iv)</enum><text>Qualified representatives of such other stakeholders and interested and affected parties as the Administrator considers appropriate.</text>
 </clause></subparagraph></paragraph><paragraph id="H889ADCE6115A4F9B9731DDD68360DC78"><enum>(3)</enum><header>Chairperson</header><text>The Deputy Administrator for Protection and National Preparedness of the Federal Emergency Management Agency shall serve as the Chairperson of the Subcommittee.</text>
				</paragraph><paragraph id="H007588BE1EA14644A26176D0F1A8126A"><enum>(4)</enum><header>Meetings</header>
 <subparagraph id="HD5F5EDC557C24AAB9D1E0D7F92B3D0FD"><enum>(A)</enum><header>Initial meeting</header><text>The initial meeting of the Subcommittee shall take place not later than 120 days after the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="HB1E014247D67431BAE944A4B080F4F1C"><enum>(B)</enum><header>Other meetings</header><text>After the initial meeting, the Subcommittee shall meet, at least annually, at the call of the Chairperson.</text>
 </subparagraph></paragraph><paragraph id="HDAC06AC1E23748DDBEFC2C61F44341FD"><enum>(5)</enum><header>Consultation with nonmembers</header><text>The Subcommittee and the program offices for the integrated public alert and warning system for the United States shall consult with individuals and entities that are not represented on the Subcommittee to consider new and developing technologies that may be beneficial to the public alert and warning system, including—</text>
 <subparagraph id="H73CE51D09DC54C38B23EFCC8BF968C1C"><enum>(A)</enum><text>the Defense Advanced Research Projects Agency;</text> </subparagraph><subparagraph id="H8F9B2ACAB8894EB78A1233ADA150621D"><enum>(B)</enum><text>entities engaged in federally funded research; and</text>
 </subparagraph><subparagraph id="H3EC90DC23F0B4F28AA3BFB21F7134AB3"><enum>(C)</enum><text>academic institutions engaged in relevant work and research.</text> </subparagraph></paragraph><paragraph id="HA986AC6EE39A406B8A5E36F84D0B28C7"><enum>(6)</enum><header>Recommendations</header><text>The Subcommittee shall—</text>
 <subparagraph id="id0630F5202A8D40369627C4AC7ACEBE28"><enum>(A)</enum><text>develop recommendations for an integrated public alert and warning system; and</text> </subparagraph><subparagraph id="idF4DB6B241DC34983B7BFFE52F07E77D1"><enum>(B)</enum><text>in developing the recommendations under subparagraph (A), consider—</text>
 <clause id="H71A7120105204949A0E77782AFBAE069"><enum>(i)</enum><text>recommendations for common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system; and</text>
 </clause><clause id="H73D8B7A7785245C8B2FC2B2F962F7150"><enum>(ii)</enum><text>recommendations to provide for a public alert and warning system that—</text> <subclause id="HBCBDD138F87B401881F9C441609A4B09"><enum>(I)</enum><text>has the capability to adapt the distribution and content of communications on the basis of geographic location, risks, or personal user preferences, as appropriate;</text>
 </subclause><subclause id="HE39ECCB2D09A47C2B18D06DE5ED2CEAB"><enum>(II)</enum><text>has the capability to alert and warn individuals with disabilities and individuals with limited-English proficiency;</text>
 </subclause><subclause id="H9A4EB8E233424763AF38E77042762DAE"><enum>(III)</enum><text>to the extent appropriate, incorporates multiple communications technologies;</text> </subclause><subclause id="H6598128BAC0547438BA6EF0C86BF101E"><enum>(IV)</enum><text>is designed to adapt to, and incorporate, future technologies for communicating directly with the public;</text>
 </subclause><subclause id="H5F52CEC2A9494CDB872E42E6B1A544FB"><enum>(V)</enum><text>is designed to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, and improve the ability of remote areas to receive alerts;</text>
 </subclause><subclause id="H28882D2C353D4AAA953DB9B29E911060"><enum>(VI)</enum><text>promotes local and regional public and private partnerships to enhance community preparedness and response; and</text>
 </subclause><subclause id="H4FF7F537A1894033B18E5E6B48583D41"><enum>(VII)</enum><text>provides redundant alert mechanisms, if practicable, to reach the greatest number of people regardless of whether they have access to, or use, any specific medium of communication or any particular device.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H9A9B9E9413D7440CBA53BC0BB88E342C"><enum>(7)</enum><header>Report</header>
 <subparagraph id="id7BBAA7FEC0D549CC8B9ED2AD41C231A5"><enum>(A)</enum><header>Subcommittee submission</header><text>Not later than 1 year after the date of enactment of this Act, the Subcommittee shall submit to the National Advisory Council a report containing any recommendations required to be developed under paragraph (6) for approval by the National Advisory Council.</text>
 </subparagraph><subparagraph id="idE34E4844BC874C91BA0AA1B9D35B3CD8"><enum>(B)</enum><header>Submission by National Advisory Council</header><text>If the National Advisory Council approves the recommendations contained in the report submitted under subparagraph (A), the National Advisory Council shall submit the report to—</text>
 <clause id="id5256B71FF66B451881D2FB5A52082087"><enum>(i)</enum><text>the head of each agency represented on the Subcommittee;</text> </clause><clause id="id7649B0CB1A9E41BAA2C00AAF7B55E037"><enum>(ii)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Commerce, Science, and Transportation of the Senate; and</text>
 </clause><clause id="idF91DAEE14BC34A2583C96B575255C803"><enum>(iii)</enum><text>the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives.</text>
 </clause></subparagraph></paragraph><paragraph id="H2D7679854C5740B1B3D25D46D796012B"><enum>(8)</enum><header>Termination</header><text>The Subcommittee shall terminate not later than 3 years after the date of enactment of this Act.</text> </paragraph></subsection><subsection id="id22FBDEE78598490283E2B4842514461C"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this Act and the amendments made by this Act such sums as may be necessary for each of fiscal years 2016, 2017, and 2018.</text>
			</subsection><subsection id="idE3A01EA6C150400BA8BB51E317E51AB8"><enum>(d)</enum><header>Limitations on statutory construction</header>
 <paragraph id="id9D190CD04562489786E5794D9EF7B30F"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>participating commercial mobile service provider</term> has the meaning given that term under section 10.10(f) of title 47, Code of Federal Regulations, as in effect on the date of enactment of this Act.</text>
 </paragraph><paragraph id="id00ECF403575F4C649E79F05007F2083A"><enum>(2)</enum><header>Limitations</header><text>Nothing in this Act, including an amendment made by this Act, shall be construed—</text> <subparagraph id="id0B1D4F99F11F41A68FE9A6270201B7AE"><enum>(A)</enum><text>to affect any authority—</text>
 <clause id="idC61041646441483CB658F9DFA63893B6"><enum>(i)</enum><text>of the Department of Commerce;</text> </clause><clause id="id50E67A0EEF894B79BA9F00024D329A0F"><enum>(ii)</enum><text>of the Federal Communications Commission; or</text>
 </clause><clause id="id488562D8073141FFAE82E9DAB76F2926"><enum>(iii)</enum><text>provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>);</text>
 </clause></subparagraph><subparagraph id="idEDC216D8992D4508B185B47894BFCEB5"><enum>(B)</enum><text>to provide the Secretary of Homeland Security with authority to require any action by the Department of Commerce, the Federal Communications Commission, or any nongovernmental entity;</text>
 </subparagraph><subparagraph id="id8D3C8D5EC2E04E5E929B35BF0E5DEDAC"><enum>(C)</enum><text>to apply to, or to provide the Administrator of the Federal Emergency Management Agency with authority over, any participating commercial mobile service provider; or</text>
 </subparagraph><subparagraph id="idC7337A78C34E49C4BFBBF03D06FEFEE9"><enum>(D)</enum><text>to alter in any way the wireless emergency alerts service established under the Warning, Alert, and Response Network Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1201">47 U.S.C. 1201 et seq.</external-xref>) or any related orders issued by the Federal Communications Commission after October 13, 2006.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
