			 make available for public comment a draft economic analysis at the time a
 proposed rule to designate critical habitat is published.</official-title></form><legis-body id="H4CB7191F20FA48A9AFE9B6F91684236B" style="OLC"><section id="H9DB80B9500F64B23ADFA410B6F8D97B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Common Sense in Species Protection Act of 2015</short-title></quote>.</text></section><section id="H99780EAADDEA4F0C89CEB4B60EAF82B9"><enum>2.</enum><header>Draft economic analysis for critical habitat designation</header><text display-inline="no-display-inline">Section 4(b)(2) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(2)</external-xref>) is amended—</text><paragraph id="H3A7EEBE48F9240A3A616BCB610EA7CBF"><enum>(1)</enum><text>in the first sentence, by striking <quote>(2) The Secretary shall</quote> and inserting the following:</text><quoted-block id="H2CEA8D16D4834945988CB6670DBE8C64" style="OLC"><paragraph id="HE3517344D02C4EE7BD27C1DD5B636CC6"><enum>(2)</enum><header>Critical habitat designation</header><subparagraph id="H31D2CE6C9BF7494DB056A6EA8C95427B"><enum>(A)</enum><header>In general</header><text>The Secretary shall</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H930FFECE85CD464B94361610350CE5B6"><enum>(2)</enum><text>in the second sentence, by striking <quote>The Secretary may</quote> and inserting the following:</text><quoted-block id="H85C5F8BAE12C40E59C70B79DCA5E30CD" style="OLC"><subparagraph id="HA91CC9537261493184E073532DBD78DF"><enum>(B)</enum><header>Exclusions</header><text>The Secretary shall</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="HE3D752927D8442B4B32026940B28E8B2"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HEC6C44A08F9F4B328E90E973A049F9A7" style="OLC"><subparagraph id="HF4EF3F2B86344497A83E93EDA4220B44"><enum>(C)</enum><header>Draft economic analysis</header><clause id="HE93D3DB073DC49DDB3DED050FCA39984"><enum>(i)</enum><header>In general</header><text>At the time a proposed rule to designate critical habitat is published, the Secretary shall publish and make available for public comment a draft analysis that—</text><subclause id="HCEA7CC2EF3CE49F4A3744DF732256E7D"><enum>(I)</enum><text>examines the incremental and cumulative economic effects of all actions to protect the species and habitat of the species (including the effects of the proposed designation) upon each State and locality that is the subject of, or affected by, the proposed designation;</text></subclause><subclause id="H75EE32FE9A1C4EF98857886F06642746"><enum>(II)</enum><text>includes consideration of public and private economic effects on—</text><item id="HC89354E9861F41F68AD6D11D3691FE5D"><enum>(aa)</enum><text>possible uses of land and property values;</text></item><item id="HC79F7D848AA946B884BFEA4FC546A9C9"><enum>(bb)</enum><text>the provision of water, power, or other public services;</text></item><item id="HAA0CC9BCFAD94C6D8654AF129D5938BA"><enum>(cc)</enum><text>employment; and</text></item><item id="HF503C9B390DB4F688FE8A405C7E8BE6B"><enum>(dd)</enum><text>revenues available for State and local governments, including school districts, any political subdivision of a State that directly or indirectly provides public services, and any other instrumentality of a State;</text></item></subclause><subclause id="H90ADE383555B4F8D85036A1FA9478A7D"><enum>(III)</enum><text>complies with the guidelines issued pursuant to section 515 of the Treasury and General Government Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/554">Public Law 106–554</external-xref>; 114 Stat. 2763A–153); and</text></subclause><subclause id="HB351809C723443C2A2C43DA2EFB1A8D6"><enum>(IV)</enum><text display-inline="yes-display-inline">assesses such effects on a quantitative and qualitative basis.</text></subclause></clause><clause id="H9ECCA70FD1BD49149AECA58EF08741E4"><enum>(ii)</enum><header>Determination factors not affected</header><text display-inline="yes-display-inline">Nothing in clause (i) adds to, subtracts from, or otherwise modifies the factors set forth in subsection (a)(1) or the bases set forth in paragraph (1) of this subsection.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
