		<official-title>To amend title 28, United States Code, to remand certain civil actions transferred by the judicial
			 panel on multidistrict litigation.</official-title>

 <section id="id94CD4F1B005D426F90D2770C92A228BC" section-type="section-one"><enum>1.</enum><header>Multidistrict litigation</header><text display-inline="no-display-inline">Section 1407(a) of title 28, United States Code, is amended—</text> <paragraph id="id290E7F0752FF4E40A7885CD8B14F69AC"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>When</quote> and inserting <quote>(1) When</quote>; and</text>
 </paragraph><paragraph id="idE2D6C652E0524885B6888CD69690DA07"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id0B09DB56F23546419CEC3227FB683EBE" style="OLC"> <paragraph id="idCB7E9292E2FE43B1BE193E860D4A2D99" indent="up1"><enum>(2)</enum><text>Upon a motion of a plaintiff in a civil action described in paragraph (1), if the panel does not remand the action at or before the conclusion of such pretrial proceedings to the district from which it was transferred before the date that is 5 years after the date on which the action is transferred—</text>
 <subparagraph id="id947056F4AE794B27B967193C95BADC3E"><enum>(A)</enum><text>the action shall be remanded to the district court from which it was transferred; and</text> </subparagraph><subparagraph id="idC5F5953394FE444F8A6CC39DC17103D7"><enum>(B)</enum><text>on remand, the district court shall set a schedule for the time for completion of discovery and a trial date for the action in accordance with chapter 23 and the civil justice expense and delay reduction plan of the district court implemented in accordance with that chapter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id6853AA41DDE54D0694B458509F45D509"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by section 1 shall apply to any civil action pending in a transferee district court described in section 1407 of title 28, United States Code, on or after August 1, 2010.</text>
