 and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69257C0740234946B238CCC20D0EDBC9"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (6) (as redesignated by paragraph (2))—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0718843E8A274335B2DC646649D154A0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>more nearly</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38986AAAD7B1482AA6F8AD7144947C28"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>have typically provided</quote> and inserting <quote>provide</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id2DFA522533D145B9B646F2BFB1249999" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Program authorized</header><text display-inline="no-display-inline">Section 5202 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221a">20 U.S.C. 7221a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9C01D7DF44C5498A91F148DB2980B69B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0E3A4E2265EF4D498F88E05E649C0608"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>State educational agencies</quote> and inserting <quote>eligible entities</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6BFF45B5739E45A79F38A286224D2A9C"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>such agencies</quote> and inserting <quote>such entities</quote>; </after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE759EBCBE4C9439F83DEDE42F6F08360"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>a State educational agency</quote> and inserting <quote>an eligible entity</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id232257B0DBEA4295A8966F3CF8133C60"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>subpart</quote> and inserting <quote>section</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id499702C3349A4EFBB7C1994E13890318"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id43E4D09364D740A1A4306BE7574D6BE4" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id978DC08CB0BE40CCB162F1775675B124"><enum>(2)</enum><header display-inline="yes-display-inline">Reserve accounts</header><subparagraph commented="no" display-inline="no-display-inline" id="id30C2263F30CB4110B1AA22861D77CC59"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In order to assist eligible entities to accomplish the purposes described in section 5201, an eligible entity receiving a grant under this section shall, directly or indirectly, alone or in collaboration with others, deposit the funds received under this section in a reserve account established and maintained by the eligible entity for this purpose, in accordance with State and local law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID365e34e5ecf8416eaf4f644fdcf4e334"><enum>(B)</enum><header display-inline="yes-display-inline">Investment</header><text display-inline="yes-display-inline">Funds received under this section that are deposited in the reserve account established under subparagraph (A), shall be invested, to the extent practicable, in obligations issued or guaranteed by the United States or a State, or in other similarly low risk securities, in the same manner as funds of a State are invested under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/65">chapter 65</external-xref> of title 31, United States Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32c4219275454cd39de2bf9c6871ca6c"><enum>(C)</enum><header display-inline="yes-display-inline">Reinvestment of earnings</header><text display-inline="yes-display-inline">Any earnings on funds received under this section shall be deposited in a reserve account and used in support of public charter schools in accordance with activities authorized under this Act.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA886D5775754206BF2894E420FF890E"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAE3118A6B3B14DB180B89B269DFD3B95"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>subpart</quote> each place the term occurs and inserting <quote>section</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4415FAB20204424B1667E66A69EB230"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id1CAD2838BC84443F8C83763B12F0469C"><enum>(i)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">states</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">eligible entities</header-in-text></quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idC6F86D88797A4B15885772CAD9ADA028"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>State educational agencies</quote> and inserting <quote>eligible entities</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id730154EB757A4DA4AC95F78CDE15CFCF"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>not more than 3 years</quote> and inserting <quote>not more than 5 years</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6424A25E5194E15B3297DFD2DB7028A"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="id5284E1AD24C2410393D088104DCE01CD"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>State educational agencies</quote> and inserting <quote>eligible entities</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD462A117D18947F082246DCF97ECA7C0"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>not more than 3 years</quote> and all that follows through the period at the end and inserting <quote>not more than 5 years. An eligible applicant may use a portion of the grant period for planning and program design.</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD783E486E8D34000A9B9C6B79AD0BA91"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (d) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id1CFD5CE4CDFB4FBDBFC2A88002E9D6BF" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id981E6B6BA842466D8D2D716247F0FCA3"><enum>(d)</enum><header display-inline="yes-display-inline">Charter schools with multiple
 campuses</header><text display-inline="yes-display-inline">The Secretary shall allow an eligible entity to award multiple subgrants under section 5204(f)(1) to an eligible applicant in order to support multiple campuses of a charter school.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7666F8A6B90C4D6CAB14169F85BE0222"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33F3CF8C8890432899E4595B8367BBCC"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id91A8FF84EF024A0799BF723A20CBAC0E" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id8D352958B5324B0A86C44CF9CDE4C597"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding grants under this section for fiscal year 2015 or any succeeding fiscal year from any funds appropriated under section 5212 (other than funds reserved to carry out section 5205(c)), the Secretary shall give priority to an eligible entity to the extent that the State in which the eligible entity proposes to carry out the activities under the grant meets the criteria described in paragraph (2) and one or more of the criteria described in subparagraphs (A) through (H) of paragraph (3).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4F2F46D9AD2438799198EEE2C0A0A3B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause commented="no" display-inline="no-display-inline" id="idDE6627E89DC84645B39B36CDBA47B83C"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subclause commented="no" display-inline="no-display-inline" id="id19FDFACB954448A38F859D49B3601ABC"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>a State educational agency</quote> and inserting <quote>an eligible entity</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9BA4892FBCF54169AAFFC2B62F05500E"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>subpart</quote> and inserting <quote>section</quote>;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC65E3DB8EA2D4D08B49DB7D6825B4E95"><enum>(ii)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D);</text></clause><clause commented="no" display-inline="no-display-inline" id="id5C32C7171DE0487580CE2AE5C679C9C6"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subclause commented="no" display-inline="no-display-inline" id="idF360CC2BF01D4D3AA946D677DD573186"><enum>(I)</enum><text display-inline="yes-display-inline">by redesignating clause (ii) as subparagraph (C), and aligning the margins of such subparagraph with the margins of subparagraph (A);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7FDFFEA85C38494FAF8C35A08C06846E"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>The State</quote> and all that follows through <quote>provides</quote> and inserting <quote>The State provides</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idBBB6E710BAFB4430894B201B1EDA6E0E"><enum>(III)</enum><text display-inline="yes-display-inline">by striking <quote>law; or</quote> and inserting <quote>law.</quote>;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id86C8C94D26CC4850B739B912445C6EB1"><enum>(iv)</enum><text display-inline="yes-display-inline">in subparagraph (C) (as redesignated by clause (iii)(I)), by striking <quote>in the case</quote> and all that follows through <quote>allows</quote> and inserting <quote>The State allows</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idA400CB65FAC94ACF9753DDF107863740"><enum>(v)</enum><text display-inline="yes-display-inline">in subparagraph (D) (as redesignated by clause (ii))—</text><subclause commented="no" display-inline="no-display-inline" id="idFCFAE9CFC52C470FB664188A8968B2B3"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>school has a</quote> and inserting “school has—</text><quoted-block display-inline="no-display-inline" id="id5C2F8D66193F474081BEE076E2C49976" style="OLC"><clause commented="no" display-inline="no-display-inline" id="id5C0462AA465E452BB0561CB468C00422"><enum>(i)</enum><text display-inline="yes-display-inline">a</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="id0F7B29E45DDF42D780339D762E4273BA"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>expenditures.</quote> and inserting <quote>expenditures; and</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3CED98004A6F43EAB179EF62086B1460"><enum>(III)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5F9D0E6D4131487CAE2569896CE8B143" style="OLC"><clause commented="no" display-inline="no-display-inline" id="id0FFE4C7337FD48378040982F8A58E986"><enum>(ii)</enum><text display-inline="yes-display-inline">an independent governing board that enters into a written performance contract with an authorized public chartering agency.</text></clause><after-quoted-block>;
 and</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6E3674BE95E04E9082BB9FBB7689D358"><enum>(vi)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idE04335EBE37247B3A88D546E875AF2AF" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="ID026fa319744f4311ba075a8eeaaf53cc"><enum>(E)</enum><text display-inline="yes-display-inline">The State—</text><clause commented="no" display-inline="no-display-inline" id="idC0CC340D636E4ED5A0A03A3D4501330D"><enum>(i)</enum><text display-inline="yes-display-inline">provides public charter schools with funding commensurate with the funding provided to other public schools, including capital or facilities aid distributed through a formula or revenue generated by bonds; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6BB8829D5CBD4728AD443730A728F101"><enum>(ii)</enum><text display-inline="yes-display-inline">ensures that the State educational agency and local educational agencies provide public charter schools with the Federal, State, and local funds to which the public charter schools are entitled in a timely manner.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID64296fdc4b3245949352e977cfd3eb7b"><enum>(F)</enum><text display-inline="yes-display-inline">The State makes it a priority to create charter schools in local educational agencies with large numbers of schools designated as in need of improvement, corrective action, or restructuring under paragraph (1), (7), or (8) of section 1116(b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa1c83b9220cb4a3ab58fbad618d23ce8"><enum>(G)</enum><text display-inline="yes-display-inline">The State has developed a transparent authorizer accreditation, training, or review process for evaluating the effectiveness and quality of the State’s authorized public chartering agencies, or each authorized public chartering agency in the State has implemented such a process, including—</text><clause commented="no" display-inline="no-display-inline" id="ID26958036be584371a12ca5edbf89ef8b"><enum>(i)</enum><text display-inline="yes-display-inline">a process for reviewing and evaluating the performance of the authorized public chartering agencies in the State in authorizing or approving public charter schools, including a process that enables the authorized public chartering agencies to respond to any State concerns or deficiencies regarding such authorizing or approving; and</text></clause><clause commented="no" display-inline="no-display-inline" id="IDce822fc9a98649228e4779820bcce0fe"><enum>(ii)</enum><text display-inline="yes-display-inline">any other necessary policies to ensure effective charter school authorizing in the State that are developed in conjunction with the State’s charter school community and in accordance with the principles of high quality charter school authorizing, as determined by the State in consultation with the charter school community and stakeholders.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe49d58c5c3d2492c822f6642da871b73"><enum>(H)</enum><text display-inline="yes-display-inline">The State does not have a cap on charter schools that constrains growth and limits parental options in an unreasonable manner.</text></subparagraph><after-quoted-block>;
 and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B2586794B2C49B28011B51CC94014D6"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (f)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id004F144A86FF4BEC991FF8F75BFF701F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>subpart to a State educational agency</quote> and inserting <quote>section to an eligible entity</quote>; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id841A457AA8644EA2B621C750DB7A0B33"><enum>(7)</enum><text display-inline="yes-display-inline">by striking subsection (g).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idEF864923C81C44329D593D8AA2B919D2" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">National activities</header><text display-inline="no-display-inline">Section 5205 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221d">20 U.S.C. 7221d</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id92A341F7438F428890FE2ADE26DE1CA7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7F63C9B739E14289BFEB3B5E701B2BE9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3)(E), by striking <quote>schools</quote> each place the term occurs and inserting <quote>schools, authorized public chartering agencies, and charter support organizations</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C3EEBD84DE643C3AD6D2BC2BF498630"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4433932B4DD948BDB91B76CCE5358028" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="ID89beb71064614e58ad2c4aa967722666"><enum>(6)</enum><text display-inline="yes-display-inline">To provide technical assistance to charter schools on how to meet the requirements of part B of the Individuals with Disabilities Education Act.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CD6BF1051AF47CC898FBB21A265903A"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (c) and (d), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB2BF98A96C24646A13E0CFD40EE4F69"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text><quoted-block display-inline="no-display-inline" id="id33BAD8A93E53460B932608A85AED122B" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ID0989e4f5137747b8a1e1ae11f825a69f"><enum>(b)</enum><header display-inline="yes-display-inline">National dissemination</header><paragraph commented="no" display-inline="no-display-inline" id="ID17211064d64e46b0a7a9ae748518d71e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To carry out this subsection, the Secretary shall reserve for each fiscal year not more than $8,000,000 of the amount appropriated to carry out this subpart.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ddc2fc00acc4969bcac05ad067e7b84"><enum>(2)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">In order to receive a grant under this subsection, an entity shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2560580EB6DE4208BAE93F4DE8D95D47"><enum>(A)</enum><text display-inline="yes-display-inline">be—</text><clause commented="no" display-inline="no-display-inline" id="ID1cdbdb2fb36e4b9bbcc3fee523c7aa59"><enum>(i)</enum><text display-inline="yes-display-inline">a charter school;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID7a1ca836992f48b39148068a2a76f50f"><enum>(ii)</enum><text display-inline="yes-display-inline">an eligible applicant;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDf78bffc46c86447d95e73efee8d9c618"><enum>(iii)</enum><text display-inline="yes-display-inline">an eligible entity; or</text></clause><clause commented="no" display-inline="no-display-inline" id="IDd08eea8be8e8437089bb9f99e373a274"><enum>(iv)</enum><text display-inline="yes-display-inline">a consortium of entities described in clauses (i), (ii), or (iii); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id804C63D25ECB4834A24CF578193F35DE"><enum>(B)</enum><text display-inline="yes-display-inline">submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd84a97778e0c4122ba0d07e55b330a08"><enum>(3)</enum><header display-inline="yes-display-inline">Criteria</header><text display-inline="yes-display-inline">The Secretary shall award grants under this subsection on the basis of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD9B214D69D644E6B9D62B51ED93AA129"><enum>(A)</enum><text display-inline="yes-display-inline">the quality of the application;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97FF410ABFE4498F9106F5D32AAC0E41"><enum>(B)</enum><text display-inline="yes-display-inline">the capacity of the applicant to execute the application; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E8B5613C7014983B77D779515A5CF2B"><enum>(C)</enum><text display-inline="yes-display-inline">the scale of the expected impact of the application.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe3a0b460bfe74e01bfa318164c03f928"><enum>(4)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">A recipient of a grant under this subsection shall use funds received under the grant to assist other schools in the recipient's State and in other States in adopting charter school innovations, or to disseminate information about charter school innovations, through activities such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID779e9525641649a6bdb87a084bd7cecf"><enum>(A)</enum><text display-inline="yes-display-inline">assisting other entities with the planning and start-up of one or more new public schools, including charter schools;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3c1ed4a741604d8fa899f693cb621d66"><enum>(B)</enum><text display-inline="yes-display-inline">developing partnerships designed to improve student academic achievement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4da98c79a5ed454496b9b7f73f3b07ea"><enum>(C)</enum><text display-inline="yes-display-inline">developing curriculum materials, assessments, and other materials that promote increased student achievement and are based on successful practices at charter schools;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDff32e8573650469aabe9b6199ed101e0"><enum>(D)</enum><text display-inline="yes-display-inline">conducting evaluations and developing materials that document successful practices at charter schools and that are designed to improve student performance in other schools; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID61d969aec0c24cacb44aea06680fa422"><enum>(E)</enum><text display-inline="yes-display-inline">training, regarding the innovative practices developed at the original site, for personnel of—</text><clause commented="no" display-inline="no-display-inline" id="idB91AF52D122340D4901A9A1A6111D4B3"><enum>(i)</enum><text display-inline="yes-display-inline">local educational agencies that are adopting innovations or successful practices used at charter schools;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9066B22907ED45FD9CDE2B4E4536662D"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized public chartering agencies; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5C186B2F7AD14A6D8D1A68C6413519A3"><enum>(iii)</enum><text display-inline="yes-display-inline">charter support organizations.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;

 </after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7CE97CCAD39C4DBB909D88ABBDA35D3C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>or is in operation</quote> after <quote>actually opens</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idB32B8CB5475A4A029604632CE051349E" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Credit enhancement</header><text display-inline="no-display-inline">Subpart 1 of part B of title V of the Elementary and Secondary Education Act of 1965 (as amended by this Act) (<external-xref legal-doc="usc" parsable-cite="usc/20/7221">20 U.S.C. 7221 et seq.</external-xref>) is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idA14C44023D434AD7A449BA64D232074C"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 5207 through 5211 as sections 5208 through 5212, respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8DCD1DB02D72452094E1197CDD884EB2"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 5206 the following:</text><quoted-block display-inline="no-display-inline" id="id6CD2B77F27A148AC8DEBCAF04B05BC21" style="OLC"><section commented="no" display-inline="no-display-inline" id="ID9f685ebb9dc3441ca88fc1799cd12c93" section-type="subsequent-section"><enum>5207.</enum><header display-inline="yes-display-inline">Credit enhancement for charter school
 facilities programs</header><subsection commented="no" display-inline="no-display-inline" id="ID60ab4e11fc2e4ad8b1a67ffd10f07510"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to provide grants to eligible entities to permit the eligible entities to demonstrate innovative credit enhancement initiatives that assist charter schools to address the cost of acquiring, constructing, and renovating facilities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf95a6a8c50394dae80e7d069aab65d52"><enum>(b)</enum><header display-inline="yes-display-inline">Grants to eligible entities</header><text display-inline="yes-display-inline">After reserving any funds as necessary for grant evaluation or administration consistent with any applicable provisions (including section 9601(a) of this Act and section 402(b)(1) of the Department of Education Organization Act), the Secretary shall use the amounts available to carry out this section to award, on a competitive basis, not less than 3 grants to eligible entities that have applications approved under this section to demonstrate innovative methods of assisting charter schools to address the cost of acquiring, constructing, and renovating facilities by enhancing the availability of loans or bond financing for charter schools.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6b980cc1772d42c0baf3612b2673e121"><enum>(c)</enum><header display-inline="yes-display-inline">Grantee selection</header><paragraph commented="no" display-inline="no-display-inline" id="ID301e38ce88b844d398999de7dd8474ac"><enum>(1)</enum><header display-inline="yes-display-inline">Evaluation of application</header><text display-inline="yes-display-inline">The Secretary shall evaluate each application submitted under subsection (e), and shall determine whether the application is sufficient to merit approval.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe78ba6183dbe4760a9f9912d31d26e11"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution of grants</header><subparagraph commented="no" display-inline="no-display-inline" id="id33AEBE29827C49E18962659FF410D551"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B) and paragraph (3), the Secretary shall award—</text><clause commented="no" display-inline="no-display-inline" id="idEB286A0BE3534DEB840A8030EA587A15"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 1 grant to an eligible entity described in section 5211(6)(A);</text></clause><clause commented="no" display-inline="no-display-inline" id="id79962E7FB4E546C597FA032731F899E3"><enum>(ii)</enum><text display-inline="yes-display-inline">not less than 1 grant to an eligible entity described in section 5211(6)(B); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idAC0AC933900C4DFE8BD1C928236EB375"><enum>(iii)</enum><text display-inline="yes-display-inline">not less than 1 grant to an eligible entity described in section 5211(6)(C).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF72C22BDE3574F33A43ADF49704878A6"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall only apply if applications are submitted that permit the Secretary to do so without approving an application that is not of sufficient quality to merit approval.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID731fce5d010e44c39362538b1a6e5a25"><enum>(3)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">In the event the Secretary determines that the funds made available under this section are insufficient to permit the Secretary to award not less than 3 grants in accordance with this section, the 3-grant minimum under paragraph (2) shall not apply, and the Secretary may determine the appropriate number of grants to be awarded in accordance with subsection (d).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2ceaeb1eae554446bff1088a0beb73ac"><enum>(d)</enum><header display-inline="yes-display-inline">Grant characteristics</header><text display-inline="yes-display-inline">Grants under this section shall be of a sufficient size, scope, and quality so as to ensure an effective demonstration of an innovative means of enhancing credit for the financing of charter school acquisition, construction, or renovation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7d6dda23dfe642af83899bc823aa4caa"><enum>(e)</enum><header display-inline="yes-display-inline">Applications</header><paragraph commented="no" display-inline="no-display-inline" id="IDd206f4be8e1c4351b10d7f52fc4cc063"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To receive a grant under this section, an eligible entity shall submit to the Secretary an application in such form as the Secretary may reasonably require.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6eb5811e3f21426c9316fc54f3ae0ab3"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">An application submitted under paragraph (1) shall contain—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID84e6d3e8de3f4e80a5a37c3acd1dbc51"><enum>(A)</enum><text display-inline="yes-display-inline">a statement identifying the activities proposed to be undertaken with funds received under this section, including how the eligible entity will determine which charter schools will receive assistance, and how much and what types of assistance charter schools will receive;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84959a4f971144fc91a29c85551919d5"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the involvement of charter schools in the application's development and the design of the proposed activities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4dc2415e1e7e4050ba4ba866f97a26c1"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the eligible entity's expertise in capital market financing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcdc98ef30eb14da2a334c1eb54b5ef1b"><enum>(D)</enum><text display-inline="yes-display-inline">a description of how the proposed activities will leverage the maximum amount of private-sector financing capital relative to the amount of Federal and State funds used and otherwise enhance credit available to charter schools, including how the applicant will offer a combination of rates and terms more favorable than rates and terms that a charter school could receive without assistance under this section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8405e19f79d94540bda0d04049d31cf6"><enum>(E)</enum><text display-inline="yes-display-inline">a description of how the eligible entity possesses sufficient expertise in education to evaluate the likelihood of success of a charter school program for which facilities financing is sought;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbad7f11139534cb4aedace7df6065fca"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of an application submitted by an eligible entity that is a State governmental entity, a description of the actions that the entity has taken, or will take, to ensure that charter schools within the State receive the funding needed to have adequate facilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID029652bd71d94daa95c321d099a04368"><enum>(G)</enum><text display-inline="yes-display-inline">such other information as the Secretary may reasonably require.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc9ef179fa7864d2fa08bc7c24b802166"><enum>(f)</enum><header display-inline="yes-display-inline">Charter school objectives</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall use the funds deposited in the reserve account established under subsection (g)(1) to assist 1 or more charter schools to access private sector capital in order to accomplish one or more of the following objectives:</text><paragraph commented="no" display-inline="no-display-inline" id="ID64326a99299e44558850083cf6d98397"><enum>(1)</enum><text display-inline="yes-display-inline">The acquisition (by purchase, lease, donation, or otherwise) of an interest (including an interest held by a third party for the benefit of a charter school) in improved or unimproved real property that is necessary to commence or continue the operation of a charter school.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID196dd05e70bf4c53a46a9b5719c922f2"><enum>(2)</enum><text display-inline="yes-display-inline">The construction (including pre­development costs in a case where construction or renovation cannot proceed as a result of predevelopment findings) of new facilities, or the renovation, repair, or alteration of existing facilities, necessary to commence or continue the operation of a charter school.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc99fccbae39f4005bd968b15a6952859"><enum>(g)</enum><header display-inline="yes-display-inline">Reserve account</header><paragraph commented="no" display-inline="no-display-inline" id="ID415a5f4325234a329011251756f14252"><enum>(1)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">To assist charter schools to accomplish the objectives described in subsection (f), an eligible entity receiving a grant under this section shall, in accordance with State and local law, directly or indirectly, alone or in collaboration with others, deposit the funds received under this section (other than funds used for administrative costs in accordance with subsection (h)) in a reserve account established and maintained by the eligible entity for this purpose. Amounts deposited in such account shall be used by the eligible entity for one or more of the following purposes:</text><subparagraph commented="no" display-inline="no-display-inline" id="ID549c8c1e92bb4c5980b51f5cab38567c"><enum>(A)</enum><text display-inline="yes-display-inline">Guaranteeing, insuring, and reinsuring bonds, notes, evidences of debt, loans, and interests therein, the proceeds of which are used for an objective described in subsection (f).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID18b0d4864f744c659533acced6bf923d"><enum>(B)</enum><text display-inline="yes-display-inline">Guaranteeing and insuring leases of personal and real property for an objective described in subsection (f).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf806d6d1f6d847b38a7c5de135f32b3b"><enum>(C)</enum><text display-inline="yes-display-inline">Facilitating financing by identifying potential lending sources, encouraging private lending, and other similar activities that directly promote lending to, or for the benefit of, charter schools.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe7aee41c54b7438ab820721f77aebe32"><enum>(D)</enum><text display-inline="yes-display-inline">Facilitating the issuance of bonds by charter schools, or by other public entities for the benefit of charter schools, by providing technical, administrative, and other appropriate assistance (including the recruitment of bond counsel, underwriters, and potential investors and the consolidation of multiple charter school projects within a single bond issue).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe61fbbd99d1b477ebc8b2a22dda1bbcd"><enum>(E)</enum><text display-inline="yes-display-inline">Making limited loans to charter schools, under such terms and conditions as the Secretary may prescribe.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1d6641b0b5b74967aa20c57b0778c223"><enum>(2)</enum><header display-inline="yes-display-inline">Investment</header><text display-inline="yes-display-inline">Funds received under this section and deposited in the reserve account established under paragraph (1) shall be invested in obligations issued or guaranteed by the United States or a State, or in other similarly low-risk securities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8befec550bff4c4897f484667903238b"><enum>(3)</enum><header display-inline="yes-display-inline">Reinvestment of earnings</header><text display-inline="yes-display-inline">Any earnings on funds received under this section shall be deposited in the reserve account established under paragraph (1) and used in accordance with such paragraph.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8f45cec868754deeb7df6fba7a35fa16"><enum>(h)</enum><header display-inline="yes-display-inline">Limitation on administrative
 costs</header><text display-inline="yes-display-inline">An eligible entity may use not more than 2 percent of the funds received for any fiscal year under this section for the administrative costs of carrying out its responsibilities under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfec9255a8fd74a9da1795e2ffcdc13c8"><enum>(i)</enum><header display-inline="yes-display-inline">Audits and reports</header><paragraph commented="no" display-inline="no-display-inline" id="ID4bab95525f8549429f4c4c7b70f3e622"><enum>(1)</enum><header display-inline="yes-display-inline">Financial record maintenance and
 audit</header><text display-inline="yes-display-inline">The financial records of each eligible entity receiving a grant under this section shall be maintained in accordance with generally accepted accounting principles and shall be subject to an annual audit by an independent public accountant.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID557a416fa2f84ec9baf3d17743022fc8"><enum>(2)</enum><header display-inline="yes-display-inline">Reports</header><subparagraph commented="no" display-inline="no-display-inline" id="IDbeb24c7ca77744c3af8d6b1df194acd9"><enum>(A)</enum><header display-inline="yes-display-inline">Grantee annual reports</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant under this section annually shall submit to the Secretary a report of the eligible entity's operations and activities under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID736bd849c86a4ec387d9454febf63a1e"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each annual report submitted under subparagraph (A) shall include—</text><clause commented="no" display-inline="no-display-inline" id="ID85f14acedc8b4ac59760d7189446bddb"><enum>(i)</enum><text display-inline="yes-display-inline">a copy of the most recent financial statements, and any accompanying opinion on such statements, prepared by the independent public accountant reviewing the financial records of the eligible entity;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID9a3c2f01292b48af8939453c2aae747b"><enum>(ii)</enum><text display-inline="yes-display-inline">a copy of any report made on an audit of the financial records of the eligible entity that was conducted under paragraph (1) during the reporting period;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID7f28316b33b948ee83c61028e624635b"><enum>(iii)</enum><text display-inline="yes-display-inline">an evaluation by the eligible entity of the effectiveness of its use of the Federal funds provided under this section in leveraging private funds;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDb1d824ff9d914e7cb9fd3b6bdd715bf7"><enum>(iv)</enum><text display-inline="yes-display-inline">a listing and description of the charter schools served during the reporting period;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDbae61c34b632422dbb9601bc7525382f"><enum>(v)</enum><text display-inline="yes-display-inline">a description of the activities carried out by the eligible entity to assist charter schools in meeting the objectives set forth in subsection (f); and</text></clause><clause commented="no" display-inline="no-display-inline" id="ID905f2be3a80b42be866d64b6c99259eb"><enum>(vi)</enum><text display-inline="yes-display-inline">a description of the characteristics of lenders and other financial institutions participating in the activities undertaken by the eligible entity under this section during the reporting period.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID38c5b13f912e45cb9a4b485f05759a94"><enum>(C)</enum><header display-inline="yes-display-inline">Secretarial report</header><text display-inline="yes-display-inline">The Secretary shall review the reports submitted under paragraph (2)(A) and shall provide a comprehensive annual report to Congress on the activities conducted under this section.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID825e83ad20204c938605d2b16cf56d53"><enum>(j)</enum><header display-inline="yes-display-inline">No full faith and credit for grantee
 obligations</header><text display-inline="yes-display-inline">No financial obligation of an eligible entity entered into pursuant to this section (such as an obligation under a guarantee, bond, note, evidence of debt, or loan) shall be an obligation of, or guaranteed in any respect by, the United States. The full faith and credit of the United States is not pledged to the payment of funds which may be required to be paid under any obligation made by an eligible entity pursuant to any provision of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ID196ed5b31399479287a066ff1655590a"><enum>(k)</enum><header display-inline="yes-display-inline">Recovery of funds</header><paragraph commented="no" display-inline="no-display-inline" id="ID28d381e1430341f5a99a279f94022643"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/37">chapter 37</external-xref> of title 31, United States Code, shall collect—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID89222fc29cf542c199f999737846bddf"><enum>(A)</enum><text display-inline="yes-display-inline">all of the funds in a reserve account established by an eligible entity under subsection (g)(1) if the Secretary determines, not earlier than 2 years after the date on which the eligible entity first received funds under this section, that the eligible entity has failed to make substantial progress in carrying out the purposes described in this section; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5896c19924954f388ac517fa6389cebf"><enum>(B)</enum><text display-inline="yes-display-inline">all or a portion of the funds in a reserve account established by an eligible entity under subsection (g)(1) if the Secretary determines that the eligible entity has permanently ceased to use all or a portion of the funds in such account to accomplish any purpose described in this section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe256fb257c8c4666af6b3722fff1be91"><enum>(2)</enum><header display-inline="yes-display-inline">Exercise of authority</header><text display-inline="yes-display-inline">The Secretary shall not exercise the authority provided in paragraph (1) to collect from any eligible entity any funds that are being properly used to achieve one or more of the objectives described in subsection (f).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e55db1c0cd7474ebd2ae1f89c9f0180"><enum>(3)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">The provisions of sections 451, 452, and 458 of the General Education Provisions Act shall apply to the recovery of funds under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID882a299f709341469a4c0447c5f7c032"><enum>(4)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to impair or affect the authority of the Secretary to recover funds under part D of the General Education Provisions Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb1af28d651f340f4bfd9c4b6906818dc"><enum>(l)</enum><header display-inline="yes-display-inline">Reservation</header><text display-inline="yes-display-inline">To carry out this section, the Secretary shall reserve for each fiscal year not less than 5 percent and not more than 15 percent of the amount appropriated under section 5212.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idA536CD4797274489840D58A962C71B2B" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 5211 of the Elementary and Secondary Education Act of 1965 (as redesignated by section 8(1)) (<external-xref legal-doc="usc" parsable-cite="usc/20/7221i">20 U.S.C. 7221i</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id15272C617CF5446EB364E07E1E072B81"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC2BEF92494994090AE573B1BF2785D95"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (L);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id127169DC33AC433E954914821B765062"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (D) through (K) as subparagraphs (E) through (L), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEA768211745A4D9E8BE27DA1CCD0EE21"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (C) the following:</text><quoted-block display-inline="no-display-inline" id="id1C45223FD2E54AB79FB56D5100C1C5CA" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="ID851e0f0b6b0e4375bf80d6af96df614c"><enum>(D)</enum><text display-inline="yes-display-inline">has an independent governing board that enters into a performance-based agreement that encompasses one or more campuses with an authorized public chartering agency in the State, which agreement shall include a description of—</text><clause commented="no" display-inline="no-display-inline" id="id603502FDCA8141589F39B9775EDF6642"><enum>(i)</enum><text display-inline="yes-display-inline">how student performance will be measured in each charter school pursuant to the State assessments that are required of other schools and any other assessments or evaluations mutually agreeable to the authorized public chartering agency and the charter school; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa811cba130584c1187e2ddecfb6fef01"><enum>(B)</enum><text display-inline="yes-display-inline">a charter support organization.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14D500C22EC2478784BD4C6CA2C67DC7"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id650C82F376B842FB8A4FBB6348391F2D" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="ID1c112952718d403796a73d6ec29ec9fb"><enum>(5)</enum><header display-inline="yes-display-inline">Charter support organization</header><text display-inline="yes-display-inline">The term <quote>charter support organization</quote> means a public or private nonprofit organization that provides assistance to a developer of a charter school during the planning, program design, and initial implementation of a charter school.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc7f35eddc3e64c689fe8a9bde3deb17a"><enum>(6)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDba8accf815be48f4a98dbe847ab2bf4a"><enum>(A)</enum><text display-inline="yes-display-inline">a public entity, such as a State educational agency or other State or local governmental entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdfa4f0071ccd4eb598eaad5f948d6af3"><enum>(B)</enum><text display-inline="yes-display-inline">a private nonprofit entity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0c0408d8e0934f19ab854990947bd2e3"><enum>(C)</enum><text display-inline="yes-display-inline">a consortium of entities described in subparagraph (A) or (B).</text></subparagraph></paragraph><after-quoted-block>;
