 </subsection></section><section id="id089FC540D6674975B8607149BA7E3C09" section-type="subsequent-section"><enum>2.</enum><header>Implementation deadline</header><text display-inline="no-display-inline">Section 20157 of title 49, United States Code, is amended—</text> <paragraph id="idF01C16F0F58A4463A0D91BBB06B50D90"><enum>(1)</enum><text>by redesignating subsections (h) and (i) as subsections (i) and (j), respectively; and</text>
 </paragraph><paragraph id="id2ebf5ad82e2a42e6b0f76bc061a57860"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text> <quoted-block display-inline="no-display-inline" id="id276c92d80a5041f09fee6cad04573fce" style="OLC"> <subsection id="ide72d2dfd36354c5a88d5c82a79c74ca8"><enum>(h)</enum><header>Extension</header> <paragraph id="id2971bab37dda49baadf1e7bd40524a70"><enum>(1)</enum><header>In general</header><text>After transmitting the report under subsection (d), the Secretary may extend the implementation deadline, in 1-year increments, upon application, if the Secretary—</text>
 <subparagraph id="idbb9c5f88b2e34ab8a8c2cff99b3a67bc"><enum>(A)</enum><text>determines that—</text> <clause id="idE0BBDAFC26324BDDA898BE9367A4EA49"><enum>(i)</enum><text>full implementation will likely be infeasible due to circumstances beyond the control of the applicant, including funding availability, spectrum acquisition, resource and technology availability, and interoperability standards;</text>
 </clause><clause id="idf067dbb8f8c541a1afa5d21611c53fb6"><enum>(ii)</enum><text>the applicant has demonstrated good faith in its positive train control implementation; and</text> </clause><clause id="idccfc785b56ce4957be0121f8d20d8ba1"><enum>(iii)</enum><text>the applicant has presented a revised positive train control implementation plan indicating how it will fully implement positive train control as soon as feasible, and not later than December 31, 2018; and</text>
 </clause></subparagraph><subparagraph id="ide277acc242af4bb0b03da125b0e8198e"><enum>(B)</enum><text>has taken into consideration—</text> <clause id="idd5b97eebe245479ba8dd5625e8fcc361"><enum>(i)</enum><text>whether the affected areas of track have been identified as areas of greater risk to the public and railroad employees in the applicant’s positive train control implementation plan under section 236.1011(a)(4) of title 49, Code of Federal Regulations; and</text>
 </clause><clause id="id19de0a23dbba48c09657d71aa9559b6e"><enum>(ii)</enum><text>the risk of operational failure to the affected service areas and the applicant.</text> </clause></subparagraph></paragraph><paragraph id="id8f2d474d7c5040579790f409dbe69870"><enum>(2)</enum><header>Application review</header><text>Not later than 120 days after the Secretary receives an application under paragraph (1), the Secretary review and approve or disapprove the application.</text>
 </paragraph><paragraph id="id51D2E237314C4DC98C84A706510E07B0"><enum>(3)</enum><header>Maximum extension</header><text>The Secretary may extend the implementation deadline for an applicant whose application is under review, but may not extend the implementation deadline beyond June 30, 2016.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id4848af84244243ec85f3790100875996"><enum>3.</enum><header>Transparency</header><text display-inline="no-display-inline">Section 20157(a) of title 49, United States Code, as amended by section 2, is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id4DF421774155495AB60C08F302CAFB71" style="OLC">
				<paragraph id="id62a58d21d1794977a9a87ac06dd0ebee"><enum>(3)</enum><header>Progress reports</header>
 <subparagraph id="idb379390007dc450a916c6c7307fa6015"><enum>(A)</enum><header>In general</header><text>Beginning 6 months after the date of the enactment of the <short-title>Positive Train Control Safety Act</short-title>, and annually thereafter until its positive train control system is certified by the Secretary under subsection (h), each Class I railroad carrier, and each entity providing regularly scheduled intercity or commuter rail passenger transportation, required to submit a plan under paragraph (1) shall submit a progress report to the Secretary on the status of the plan.</text>
 </subparagraph><subparagraph id="id9ba74b251690483bb610c8c4953767db"><enum>(B)</enum><header>Contents</header><text>Each progress report submitted under subparagraph (A) shall include—</text> <clause id="id3d8fa0693a3d4871955f9d226b37ea3d"><enum>(i)</enum><text>a section describing—</text>
 <subclause id="id79247A54D935413EA0D2608A2D478E6A"><enum>(I)</enum><text>the total number of positive train control components required;</text> </subclause><subclause id="idD3BD901D31914D8F96D1FE15A047EB13"><enum>(II)</enum><text>the number of such components that have been installed, equipped, or deployed;</text>
 </subclause><subclause id="id6D246C93B3244F008CDA24FB73A332BD"><enum>(III)</enum><text>the number of components that remain to be installed, equipped, or deployed; and</text> </subclause><subclause id="id12F49B3FFB524D979C7B082CD7F2F81B"><enum>(IV)</enum><text>an estimated completion date for full positive train control system completion;</text>
 </subclause></clause><clause id="ide47a850501e940a099b79182a00c7bf6"><enum>(ii)</enum><text>a section summarizing—</text> <subclause id="id2FB99F861BDA43C99781A197EC9E06CE"><enum>(I)</enum><text>the number of employees requiring training under section 236.1041 of title 49, Code of Federal Regulations; and</text>
 </subclause><subclause id="id4848946A52A64F18852F739340F92BC7"><enum>(II)</enum><text>the status of such training activities; and</text> </subclause></clause><clause id="id033f964fac324c4090cb8fd7bf78e548"><enum>(iii)</enum><text>a section summarizing the remaining challenges to full positive train control system implementation, including—</text>
 <subclause id="id73A69B0C06454574A3F5C2F1CF3404B6"><enum>(I)</enum><text>testing issues;</text> </subclause><subclause id="id8D0EDFFD337A48EE8736FCE4510A9324"><enum>(II)</enum><text>interoperability challenges; and</text>
 </subclause><subclause id="idB98F6821A30540B9864C632AC8ADE4A4"><enum>(III)</enum><text>certification challenges.</text> </subclause></clause></subparagraph><subparagraph id="idbc315c12ee6d4cd794720c0193f6a106"><enum>(C)</enum><header>Defined term</header><text>In this paragraph, the term <term>component</term> means a locomotive apparatus, a wayside interface unit, switches in non-signal positive train control territory, a base station radio, a wayside radio, or a locomotive radio.</text>
 </subparagraph><subparagraph id="id283b13e5aa6e4b96984eb97aa12aee60"><enum>(D)</enum><header>Public availability</header><text>Not later than 30 days after receiving a progress report under this paragraph, the Secretary shall make the report available on the website of the Federal Railroad Administration.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id4ca39642a0e34b35a54a1c9e89126409"><enum>4.</enum><header>Positive train control on high-hazard flammable trains</header><text display-inline="no-display-inline">Section 20157(a)(1) of title 49, United States Code, as amended by this Act, is further amended—</text> <paragraph id="ideb93a518589146278114c2db3327a446"><enum>(1)</enum><text>by striking <quote>Not later than 18 months after the date of enactment of the Rail Safety Improvement Act of 2008, each</quote> and inserting <quote>Each</quote>;</text>
 </paragraph><paragraph id="idf5b63fd0950042d3bb4e6061c90f929e"><enum>(2)</enum><text>in subparagraph (B)—</text> <subparagraph id="id21be7edf5f694a84afe2d055a26590a0"><enum>(A)</enum><text>by striking <quote>parts</quote> and inserting <quote>sections</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF4895006A98D438FA1647A453F5E7ED7"><enum>(B)</enum><text>by striking <quote>transported; and</quote> and inserting <quote>transported on or after December 31, 2015;</quote>;</text> </subparagraph></paragraph><paragraph id="id93e95df48d3a4532a1980dc09019fa11"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text>
 </paragraph><paragraph id="id205c7a96c5b8474394022992992f4700"><enum>(4)</enum><text>by inserting after subparagraph (B), the following:</text> <quoted-block display-inline="no-display-inline" id="id9557D1051F3D40F4B40387A2EBC02E71" style="OLC"> <subparagraph id="id64958874af744fc58bdd20be45366d1b"><enum>(C)</enum><text>its main line over which 20 or more tank cars loaded with petroleum crude oil, ethanol, or other Class 3 material (as described in section 172.101 of title 49, Code of Federal Regulations) are transported; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id4c9e3e21055d4b98b84eaacdadacf17b"><enum>5.</enum><header>Coordination of spectrum</header>
 <subsection id="iddada8082d13c47cb9527584334e617db"><enum>(a)</enum><header>Coordination of spectrum</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="ida6350f2c35e5467c89ecfb5596fe9ada" style="USC">
 <section id="id7a44f386f115473d92c65dd8a8402eb1"><enum>20168.</enum><header>Electromagnetic spectrum</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of the <short-title>Positive Train Control Safety Act</short-title>, the Secretary of Transportation, in coordination with the Chairman of the Federal Communications Commission, shall assess spectrum needs and availability for implementing positive train control systems (as defined in section 20157(j)). In carrying out this section, the Secretary and the Chairman may consult with external stakeholders.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="iddc6f87376c6e4a508a826159e53da943"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/20167">section 20167</external-xref> the following:</text>

			</subsection></section><section id="idfaf82ab1d8e44d5287165c41c61e5989"><enum>6.</enum><header>Confidential close call reporting systems</header>
 <subsection id="id3c67565fb79b46baa234416af2777134"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, as amended by section 6(a), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3748318a13f84644a641c950db989fa0" style="USC">
					<section id="id43880d6c4a40499693bc0a04818992d9"><enum>20169.</enum><header>Confidential close call reporting systems</header>
 <subsection id="idb5e3b0bf42cd4071a87240ffc9ca7dde"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of the enactment of the <short-title>Positive Train Control Safety Act</short-title>, the Secretary shall promulgate regulations setting forth the requirements that an applicable railroad carrier shall follow in establishing a confidential close call reporting system program. The Secretary may use any information and experience gathered through research and pilot programs on confidential close call reporting systems in developing regulations under this subsection, including continuing the use of third parties for the collection of close call reports and distribution of close call data. The Secretary shall ensure that an applicable railroad carrier’s employees receive protection under its program from any related Federal Railroad Administration enforcement actions.</text>
						</subsection><subsection id="id705e896d213743d283bd9ab694252e5a"><enum>(b)</enum><header>Program development and oversight</header>
 <paragraph id="idef660b8c31394c939173311d2d897273"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date on which final regulations are promulgated under subsection (a), an applicable railroad carrier shall develop and submit a proposed confidential close call reporting system program to the Secretary for review and approval.</text>
 </paragraph><paragraph id="id89a4b76ed8ab4a1dbd2189f9a923dd7a"><enum>(2)</enum><header>Contents</header><text>The proposal submitted by a railroad carrier under paragraph (1) shall—</text> <subparagraph id="id376671095DC44152A336EF06A38F483C"><enum>(A)</enum><text>a describe the core principles and values of its proposed program;</text>
 </subparagraph><subparagraph id="id613B7D719EAF4E2CAFD67D977C285F55"><enum>(B)</enum><text>explain the rights, roles, and responsibilities of program stakeholders;</text> </subparagraph><subparagraph id="idE94D52FFCE894E5F8B43BEA8165AA20D"><enum>(C)</enum><text>identify concerns and interests; and</text>
 </subparagraph><subparagraph id="idF9C2368047BB4A68841B7F6D1046F27A"><enum>(D)</enum><text>describe how the program will operate.</text> </subparagraph></paragraph><paragraph id="id807138a51b7d4fd9901fcf2b165f8453"><enum>(3)</enum><header>Review</header> <subparagraph id="idb561c958e660434fae708460fe58dd2f"><enum>(A)</enum><header>In general</header><text>The Secretary shall review and approve or disapprove each proposed program within a reasonable amount of time. If a proposed program is not approved, the Secretary shall notify the applicable railroad carrier in writing of the specific areas in which the proposed program is deficient. The applicable railroad carrier shall correct all deficiencies within a reasonable period of time following receipt of written notice from the Secretary.</text>
 </subparagraph><subparagraph id="idd05065f908804f81a7cdbc8e1a553b0e"><enum>(B)</enum><header>Updates</header><text>An applicable railroad carrier shall update its program as needed and obtain the Secretary’s approval prior to making any major changes to its program.</text>
 </subparagraph><subparagraph id="id7dd82c3e2dde41288c89df0d766f2d82"><enum>(C)</enum><header>Annual reviews</header><text>The Secretary shall conduct an annual review to ensure that each applicable railroad carrier is in compliance with its approved program.</text>
 </subparagraph></paragraph></subsection><subsection id="id7c47aaf376fa44129850851832f6b10e"><enum>(c)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of the <short-title>Positive Train Control Safety Act</short-title>, each applicable railroad carrier shall establish a confidential close call reporting system.</text> </subsection><subsection id="iddc91d30ec392407888360943b796a4d3"><enum>(d)</enum><header>Program elements</header><text>Each applicable railroad carrier shall—</text>
 <paragraph id="iddaa3f2cca31147c9b9c1e4d6f93a38b5"><enum>(1)</enum><text>provide a safe environment for its employees to report unsafe events and conditions;</text> </paragraph><paragraph id="ide12d8aa9ff184173b6a121159842253c"><enum>(2)</enum><text>for unsafe events and conditions reported within the scope of a confidential close call reporting system, ensure that its employees are protected from railroad carrier discipline;</text>
 </paragraph><paragraph id="idb5d16a6ab0db4175ac918a9cf92559ce"><enum>(3)</enum><text>use information collected through the confidential close call reporting system to develop and implement targeted corrective actions, as appropriate; and</text>
 </paragraph><paragraph id="id133551e1713f49fb97f77bb0f6296cff"><enum>(4)</enum><text>use information collected by the system to supplement inspection data in identifying safety issues and emerging risks before they develop into accidents.</text>
							</paragraph></subsection><subsection id="id0baa1cd3fca94a5fa56997b020070c20"><enum>(e)</enum><header>Consensus</header>
 <paragraph id="id1603580174104c05910f2da01fe6aba5"><enum>(1)</enum><header>In general</header><text>Each applicable railroad carrier shall consult with, employ good faith with, and use its best efforts to reach agreement with all of its directly affected employees, including any nonprofit employee labor organization representing a class or craft of directly affected employees of the applicable railroad carrier, on the development and implementation of the proposed program.</text>
 </paragraph><paragraph id="id0590100d48b2470495f7bec476e9ddf4"><enum>(2)</enum><header>Statements</header><text>If an applicable railroad carrier and its directly affected employees, including any nonprofit employee labor organization representing a class or craft of directly affected employees of the applicable railroad carrier, cannot reach consensus on the development and implementation of the proposed program, then directly affected employees and such organization may file a statement with the Secretary explaining their views on the proposed program on which consensus was not reached. The Secretary shall consider such views during review of the proposed program under subsection (b)(3)(A).</text>
 </paragraph></subsection><subsection id="id57290475a2004d7aaea73cbd17146d9b"><enum>(f)</enum><header>Voluntary program establishment</header><text>Any railroad carrier that is not an applicable railroad carrier may voluntarily establish a program under this section. This section, and any regulations promulgated under this section, shall apply to a program that is voluntarily established.</text>
 </subsection><subsection id="id751203f910a24af99c8c8a2380b7e46c"><enum>(g)</enum><header>Use of data</header><text>The Secretary may use the confidential close call reporting data when—</text> <paragraph id="idb53e0771fe0343a19276eed6f375a72a"><enum>(1)</enum><text>implementing or updating the Federal Railroad Administration’s National Inspection Plan;</text>
 </paragraph><paragraph id="id10ed24759b1d4edc9a0b9ad333a12d54"><enum>(2)</enum><text>performing focused inspections; or</text> </paragraph><paragraph id="id719316bf289a4836a3937122994995df"><enum>(3)</enum><text>developing agency rulemakings and guidance, as appropriate.</text>
 </paragraph></subsection><subsection id="idd06d114ac9364f10827cb03eedfa883f"><enum>(h)</enum><header>Defined term</header><text>In this section, the term <term>applicable railroad carrier</term> means a railroad carrier that—</text> <paragraph id="id301ee2217fd04bc3929b510bfe9e38dc"><enum>(1)</enum><text>is a Class I railroad;</text>
 </paragraph><paragraph id="idb6f6356d4ccc4f5596f12c5155bd6043"><enum>(2)</enum><text>has inadequate safety performance, as determined by the Secretary; or</text> </paragraph><paragraph id="idc9e09e010209456ca410ea78334ac124"><enum>(3)</enum><text>provides intercity rail passenger or commuter rail passenger transportation.</text>
 </paragraph></subsection><subsection id="ide6f8fb1360494a2cbe0c275048a204ad"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary—</text> <paragraph id="idCAB3C05C6C3E4C80A4D8E477FE4CAF08"><enum>(1)</enum><text>to implement this section; and</text>
 </paragraph><paragraph id="id47B11D9E50BA4E42BE6D509AB4E0A7CC"><enum>(2)</enum><text>to support the nationwide implementation of confidential close call reporting system programs, as the Secretary determines appropriate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idf72f6d856cf94a25b8478ca667bd7256"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, as amended by section 7(b), is further amended by adding at the end the following:</text>

 <subsection id="id7cc2524077494a4aabc5a0ae3a467312"><enum>(a)</enum><header>In general</header><text>When performing a required inspection under subpart F of part 213 of title 49, Code of Federal Regulations, a railroad carrier providing commuter rail passenger transportation on high density commuter railroad lines (as described in section 213.233(b)(3) of title 49, Code of Federal Regulations) shall—</text>
 <paragraph id="ide7a40d2e53b94d0b8d109d6f09724ecc"><enum>(1)</enum><text>at least once each 2 weeks—</text> <subparagraph id="idAAF34B35181E4A67ADE5699AAD9EC25B"><enum>(A)</enum><text>traverse each main line by vehicle; or</text>
 </subparagraph><subparagraph id="id06635159CA2F4BFE93487ACB603DE1DA"><enum>(B)</enum><text>inspect each main line on foot; and</text> </subparagraph></paragraph><paragraph id="idf1bf46ef878c4b6cb9dbc75394d2b10b"><enum>(2)</enum><text>at least once each month, traverse and inspect each siding by vehicle or by foot.</text>
 </paragraph></subsection><subsection id="idc0eb8f9a0481451cad91944d34b62d15"><enum>(b)</enum><header>Construction</header><text>Nothing in this section may be construed to limit the authority of the Secretary to promulgate regulations or issue orders under any other law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id44f5464295d04ba3980bcd041a7d6492"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, as amended by sections 6 and 7, is further amended by adding at the end the following:</text>

			</subsection></section><section id="id82c1271475104efba19298178784f5f3"><enum>8.</enum><header>Positive train control at grade crossings effectiveness study</header>
 <subsection id="id2E1DF3E77DA74B068BA6D50B91968F8E"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation, in consultation with the Administrator of the Federal Railroad Administration, shall conduct a study of the effectiveness of positive train control and related technologies on reducing collisions at highway-rail grade crossings.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idB48C06F9B4CD4673946C536DA46183DF"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary to conduct the study described in subsection (a).</text>
 </subsection></section><section id="id4383c71cbe2b40f68edad2d5f2fa8c09"><enum>9.</enum><header>Redundant signal protection</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Positive Train Control Safety Act</short-title>, the Secretary of Transportation shall promulgate such regulations as the Secretary considers necessary to require that on-track safety programs, as described in subpart C of part 214 of title 49, Code of Federal Regulations, whenever practicable and consistent with other safety requirements and operational considerations, include requiring implementation of redundant signal protection, such as shunting, for maintenance-of-way work crews who depend on a train dispatcher to provide signal protection.</text>
