 <section id="H13F8272FB0BB4BE5905BF5ED2F82C194" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Wasteful Bonuses in Department of Veterans Affairs Act of 2015</short-title></quote> or the <quote><short-title>VA Bonus Accountability Act</short-title></quote>.</text> </section><section id="H887F0057D57740E7B5B547DC84A5F000"><enum>2.</enum><header>Limitation on bonuses for employees of the Department of Veterans Affairs</header> <subsection id="HD4CFA4D4B4F8462FBE3720747640A6BE"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7445A544AF3842BAA446414494AB5909" style="USC">
					<section id="H39772010BEA74D02B350988076F086AC"><enum>714.</enum><header>Limitation and repayment of bonuses </header>
						<subsection id="H91009F39EBA24CCD98901E73018A7095"><enum>(a)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="HCA9650198EC343A8A86838AAC6D10913"><enum>(1)</enum><text>If the Comptroller General of the United States, the Inspector General of the Department of Veterans Affairs, or any other senior ethics official of the Department makes an adverse finding with respect to an employee of the Department, the Secretary, after notice and an opportunity for a hearing, shall issue an order directing the employee to repay to the Department the amount of any bonus paid to the employee during the fiscal year in which the adverse finding is made.</text>
 </paragraph><paragraph id="HBB26B78619C34CB3A96A7220B4ADC3F2" indent="up1"><enum>(2)</enum><text>If the Comptroller General of the United States, the Inspector General of the Department, or any other senior ethics official of the Department makes an adverse finding with respect to an employee under subsection (a), the Secretary may not award a bonus to such employee for a period of 5 years beginning on the last day of the fiscal year during which the adverse finding occurred.</text>
 </paragraph></subsection><subsection id="H7E981B7359E243A99F01D25336BF0065"><enum>(b)</enum><text>In this section—</text> <paragraph id="HBA975BAEA08646E9B46896B3C2FA4E3D"><enum>(1)</enum><text>the term <quote>adverse finding</quote> with respect to an employee means a determination that the conduct of the employee—</text>
 <subparagraph id="HE8A6D7E2193B47E795F2E172390BFDBE"><enum>(A)</enum><text>violated a policy of the Department of Veterans Affairs for which the employee may be removed or suspended; or</text>
 </subparagraph><subparagraph id="H47F8585D898C4519916D44006FF686C3"><enum>(B)</enum><text>violated a law for which the employee may be imprisoned for more than 1 year; and</text> </subparagraph></paragraph><paragraph id="H88A390BE7F03495889894992533ABA58"><enum>(2)</enum><text>the term <quote>bonus</quote> means any bonus or cash award, including—</text>
 <subparagraph id="H2768BE2CFDE7430C9375C641C6E99204"><enum>(A)</enum><text>an award under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5;</text> </subparagraph><subparagraph id="HDCDFFF8868444BF5908ACBE528640E7E"><enum>(B)</enum><text>an award under section 5384 of such title; and</text>
 </subparagraph><subparagraph id="H3F8603188E9E4674BCE8D7157595D97D"><enum>(C)</enum><text>a retention bonus under section 5754 of such title.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H8831F8751DC447ADA16DC0AC5223653D"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text>

 </subsection><subsection id="H77EB6907130F4282BF330CDA85ED24FD"><enum>(c)</enum><header>Application</header><text>The amendments made by this section shall apply to any bonus paid in fiscal year 2014 and each fiscal year thereafter.</text>
