			 loans of principals in high need schools.</official-title>

 <section id="H98244C336DBA426EAD4DF954131C5E2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recruiting and Retaining Effective School Leaders Act</short-title></quote>.</text> </section><section id="H3460E6E8BDB043F6BC827C6189AC177F"><enum>2.</enum><header>Loan forgiveness for principals in high needs schools</header><text display-inline="no-display-inline">Part D of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C. 1087a et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H1003A710ABF14DCF85DF399AD7849700" style="OLC">
				<section id="HA1B00E208B7C424A9A26B16796DC8D82"><enum>460A.</enum><header>Loan forgiveness for principals in high needs schools</header>
 <subsection id="HEE3ED9D094D24ADBBE5074D200C2F321"><enum>(a)</enum><header>Loan forgiveness authorized</header><text display-inline="yes-display-inline">The Secretary shall carry out a program of canceling the obligation to repay a qualified loan amount in accordance with subsection (b) for loans made under this part, which were first disbursed on or after July 1, 2010, to any borrower who—</text>
 <paragraph id="HF5C63075166E4AFA9DA43CCA6427D796"><enum>(1)</enum><text>has graduated from a high-quality program, as determined by the appropriate State agency for higher education, in consultation with the Secretary;</text>
 </paragraph><paragraph id="H4C32D43B001D4651BFF1D950183B7B76"><enum>(2)</enum><text>has been employed as a full-time principal, as defined by, for not less than 1 complete school year in a school or location that qualifies under section 465(a)(2)(A) for loan cancellation for Perkins loan recipients who teach in such schools or locations; and</text>
 </paragraph><paragraph id="H149C112B650346F59EB73ADE3A990B39"><enum>(3)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text> </paragraph></subsection><subsection id="H454EA3149E094432AA76A1F27139CE62"><enum>(b)</enum><header>Qualified loan amounts</header> <paragraph id="H0C821A9F435040F394A4EECD0789720F"><enum>(1)</enum><header>In general</header> <subparagraph id="H2ED603269C16494DA085A7922985371A"><enum>(A)</enum><header>First 4 years</header><text display-inline="yes-display-inline">Subject to paragraph (2), after the completion of service as a principal as described in subsection (a)(2) for a complete school year for any school year after the first complete school year of such service through the fourth complete school year of such service, the Secretary shall cancel—</text>
 <clause id="HA2D0E2D15B764D5099CC103030F6CF4A"><enum>(i)</enum><text>15 percent of the loan obligation on a loan made under this part, which was first disbursed on or after July 1, 2010; and</text>
 </clause><clause id="H5F42391206D949608E5DB2C3524BDF83"><enum>(ii)</enum><text>the total amount of interest that accrued during such school year.</text> </clause></subparagraph><subparagraph id="H2018AC4B8FE14B64AC28287981EFEF2F"><enum>(B)</enum><header>Succeeding years</header><text display-inline="yes-display-inline">Subject to paragraph (2), after the completion of service as a principal as described in subsection (a)(2) for a complete school year for any school year after the fourth complete school year of such service through the seventh complete school year of such service, the Secretary shall cancel—</text>
 <clause id="H4A49648E01604C6A9778E20BBF11DCEA"><enum>(i)</enum><text>20 percent of the loan obligation on a loan made under this part, which was first disbursed on or after July 1, 2010; and</text>
 </clause><clause id="H4C6C2AB89E1B4BDABECCC6D10D229271"><enum>(ii)</enum><text>the total amount of interest that accrued during such school year.</text> </clause></subparagraph></paragraph><paragraph id="H15C6BBC915A14FB096BCBAD2D16AB8AE"><enum>(2)</enum><header>Limitations</header><text>To be eligible for loan cancellation under subparagraph (A) or (B) of paragraph (1) for any school year after the first complete school year of service, a principal—</text>
 <subparagraph id="HAA10BD48E48A44A9BFB6A038DF3F8B8E"><enum>(A)</enum><text>shall be serving as a principal in the school or location in which the principal served for such first year, except that a principal may serve as a principal in a different school or location described in subsection (a)(2) for a school year after such first year if the local educational agency involved places the principal in such different school or location; and</text>
 </subparagraph><subparagraph id="H4C3F6B7267C84D59A584EEC5B5A3FF20"><enum>(B)</enum><text display-inline="yes-display-inline">may stop serving as a principal for not more than 1 complete school year after such first year.</text> </subparagraph></paragraph><paragraph id="HAD5FCBAA737940489C37880127941331"><enum>(3)</enum><header>Treatment of consolidation loans</header><text>A loan amount for a Federal Direct Consolidation Loan, which was first disbursed on or after July 1, 2010, may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, a Federal Direct PLUS Loan for enrollment in a graduate or professional program or a loan made under section 428, 428H, or 428B for enrollment in a graduate or professional program, for a borrower who meets the requirements of subsection (a), as determined in accordance with regulations prescribed by the Secretary.</text>
 </paragraph></subsection><subsection id="HE4F2802DAE6E490FBC7B43D92DAF49FE"><enum>(c)</enum><header>List</header><text>If the list of schools in which a high need principal may perform service pursuant to subsection (a)(2) is not available before May 1 of any year, the Secretary may use the list for the year preceding the year for which the determination is made to make such service determination.</text>
 </subsection><subsection id="H0A9757218DDC485F85AEB33720A5FDFA"><enum>(d)</enum><header>Continuing eligibility</header><text>Any principal who performs service as in a school that—</text> <paragraph id="H774CB4DFB9A747E79F1DE02718033B88"><enum>(1)</enum><text>meets the requirements of subsection (a)(2) in any year during such service; and</text>
 </paragraph><paragraph id="H4B1C13C3A9BE4AE794AEA1A232C5FC1D"><enum>(2)</enum><text>in a subsequent year fails to meet the requirements of such subsection, may continue to serve as a principal in such school and shall be eligible for loan cancellation pursuant to subsection (a).</text>
 </paragraph></subsection><subsection id="H0DA378A50543446A860B40D9A27ECA0A"><enum>(e)</enum><header>Forgiveness not considered income</header><text>The amount of a loan, and interest on a loan, which is canceled under this section shall not be considered income for purposes of the Internal Revenue Code of 1986.</text>
 </subsection><subsection id="HFBEE540F6AA1416CBE3091A3A2E6BCC0"><enum>(f)</enum><header>Construction</header><text>Nothing in this subsection shall be construed to authorize refunding of any refunding of any canceled loan.</text>
 </subsection><subsection id="H11F5DFD44EA84BA39D89A153670700B5"><enum>(g)</enum><header>No double benefit</header><text>No borrower may, for the same service, receive a benefit under both this section and subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601 et seq.</external-xref>).</text>
 </subsection><subsection id="HD3266C8B4414485CA5DCF579BC9A2E79"><enum>(h)</enum><header>Regulations</header><text>The Secretary is authorized to issue such regulations as may be necessary to carry out this section.</text>
 </subsection><subsection id="H51D58EE715B04838A8853F7E3B98F716"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purpose of this section:</text> <paragraph id="H5E1C9B9E3B0D43EAB0975596E6F1FE1E"><enum>(1)</enum><header>Principal</header><text>The term <quote>principal</quote> has the meaning given such term in section 2102 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6602">20 U.S.C. 6602</external-xref>).</text>
 </paragraph><paragraph id="H56E3E74D2C2446669148A51C8DEBFCF8"><enum>(2)</enum><header>Year</header><text>The term <quote>year</quote> where applied to service as a teacher means an academic year as defined by the Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section></legis-body> </bill>
