 <section id="H820199ED512F4AC6A702596E0BA6B309" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debt Ceiling Alternative Act</short-title></quote>.</text> </section><section id="H3E55108C42774678B2C5053C47784466"><enum>2.</enum><header>Ensuring the Government does not default on its debt obligations</header> <subsection id="H065F1D2804F64C04A2C8172A433C5015"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the Department of the Treasury issues a marketable borrowing estimate for a quarter that estimates that the debt of the United States, as defined in section 3101 of title 31, United States Code, will reach the statutory limit during such quarter, the President shall ensure that the aggregate of the amounts deposited in the Treasury from the sale of assets described under subsection (b) and the disposal of real property pursuant to subchapter VII of chapter 5 of subtitle I of title 40, United States Code, and the amount of any recision of unobligated balances pursuant to section 5, is sufficient to prevent the debt of the United States from reaching such statutory limit during such quarter.</text>
 </subsection><subsection id="H9376F540005044DFB46F18D10C54A578"><enum>(b)</enum><header>Authority To sell assets</header><text>For purposes of subsection (a), the President may order the sale of the following assets, with the proceeds from such sales deposited in the Treasury:</text>
 <paragraph id="H52942C8578FE4F8882E4FAF1B0CE83E6"><enum>(1)</enum><text>On-balance sheet non-performing mortgages of the Federal National Mortgage Association.</text> </paragraph><paragraph id="H607F69FFB56E4AFE97FA019BE7D5B066"><enum>(2)</enum><text>Other mortgages owned or held by the Federal National Mortgage Association.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="H565D2C314B3C449DB6ABE506056B7D42"><enum>(3)</enum><text>Real estate owned properties of the Federal National Mortgage Association.</text> </paragraph><paragraph id="HDA52AE66D96743D9B2DDBC63255CB520"><enum>(4)</enum><text display-inline="yes-display-inline">On-balance sheet non-performing mortgages of the Federal Home Loan Mortgage Corporation.</text>
 </paragraph><paragraph id="H43F1DDC3A7F24D8496368FA2784985D7"><enum>(5)</enum><text>Other mortgages owned or held by the Federal Home Loan Mortgage Corporation.</text> </paragraph><paragraph id="H6BFF093238284D77B8AD1D9CDB9B2714"><enum>(6)</enum><text>Real estate owned properties of the Federal Home Loan Mortgage Corporation.</text>
 </paragraph><paragraph id="HCDC8EA0C2341462CB24A5638A937C1E8"><enum>(7)</enum><text>Mortgage-backed securities held by the Board of Governors of the Federal Reserve System or any Federal reserve bank.</text>
 </paragraph></subsection><subsection id="H0A74461CF26449DBA7341E573DBE157E"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Any funds realized through this Act must be used for the retirement of old debt and issuance of new debt.</text>
			</subsection></section><section id="H93AF7353875D47DC9E720D2AE936706F"><enum>3.</enum><header>Disposal of real property</header>
 <subsection id="H862CB47FE0E44B83A3C4E0CD42B09EA4"><enum>(a)</enum><header>In general</header><text>Chapter 5 of subtitle I of title 40, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7D6492B77F5B4DE5AC3BBB2C1B78DA3F" style="USC">
					<subchapter id="HA0F0F366DAC34A7C91F594706CDD415C"><enum>VII</enum><header>EXPEDITED DISPOSAL OF REAL PROPERTY</header>
 <section id="HC0EE691F62F845DEAAC076B2A3C777E9"><enum>621.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> <paragraph id="H6D535CB8329A4C0D8C3C6CA99781CDD5"><enum>(1)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Management and Budget.</text>
 </paragraph><paragraph id="H73919105602749B58CF424359CD2A387"><enum>(2)</enum><header>Expedited disposal of real property</header><text>The term <quote>expedited disposal of real property</quote> means a demolition of real property or a sale of real property for cash that is conducted under the requirements of section 545.</text>
 </paragraph><paragraph id="H08826D66F06C4296B5C472BE1AA3B946"><enum>(3)</enum><header>Landholding agency</header><text>The term <quote>landholding agency</quote> has the meaning given that term under section 501(i)(3) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411(i)(3)</external-xref>).</text>
							</paragraph><paragraph id="H9129976081BD4187AF46C1660F48BA33"><enum>(4)</enum><header>Real property</header>
 <subparagraph id="H1A411FE2E3C6403F889EE95FE33D7CFD"><enum>(A)</enum><header>In general</header><text>The term <quote>real property</quote> means—</text> <clause id="HBB419C41C2D14D25863D5194195325D5"><enum>(i)</enum><text>a parcel of real property under the administrative jurisdiction of the Federal Government that is—</text>
 <subclause id="HB296776314B94193BD8B90B5C144CDEF"><enum>(I)</enum><text>excess;</text> </subclause><subclause id="HAFE3EAC95A4042B2B3A0C6A5A66D9C25"><enum>(II)</enum><text>surplus;</text>
 </subclause><subclause id="H6D7EA62AB8B2419A891C9FCFA3870B00"><enum>(III)</enum><text>underperforming; or</text> </subclause><subclause id="HA33BE25C275E448786E0D88DC8FC0E1E"><enum>(IV)</enum><text>otherwise not meeting the needs of the Federal Government, as determined by the Director; and</text>
 </subclause></clause><clause id="HBCFD8433597148829B8F8C63EA09A3F5"><enum>(ii)</enum><text>a building or other structure located on real property described under clause (i).</text> </clause></subparagraph><subparagraph id="HF8259DB8C2A8423DA0502C40CFE4AB7D"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>real property</quote> excludes any parcel of real property or building or other structure located on such real property that is to be closed or realigned under the Defense Base Closure and Realignment Act of 1990 (part A of title XXIX of <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note).</text>
 </subparagraph></paragraph><paragraph id="H6CCA49AC2C204869B33131A0F786E591"><enum>(5)</enum><header>Representative of the homeless</header><text>The term <quote>representative of the homeless</quote> has the meaning given that term under section 501(i)(4) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411(i)(4)</external-xref>).</text>
							</paragraph></section><section id="H33C9F9DDF62249109D5F7D483D169493"><enum>622.</enum><header>Pilot program</header>
 <subsection id="H806BAEA105A443DA938A61D4551CCBEB"><enum>(a)</enum><header>Establishment</header><text>The Director of the Office of Management and Budget shall conduct a pilot program, to be known as the <quote>Federal Real Property Disposal Pilot Program</quote>, under which real property that is not meeting Federal Government needs may be disposed of in accordance with this subchapter.</text>
 </subsection><subsection id="H6968B3B8DE824F65AC71225094ECAB54"><enum>(b)</enum><header>Termination</header><text>The Federal Real Property Disposal Pilot Program shall terminate 5 years after the date of the enactment of this subchapter.</text>
							</subsection></section><section id="H8370F5B97BC849E198108725EAF70ACE"><enum>623.</enum><header>Selection of real properties</header>
 <subsection id="HA9BE05EE8C1041BDBB1283A77F46684F"><enum>(a)</enum><header>Agency recommendation of properties</header><text>The head of each executive agency shall recommend candidate disposition real properties to the Director for participation in the pilot program established under section 622.</text>
 </subsection><subsection id="H669800BFBECB4B27ADDC7C3F2FC5A9F4"><enum>(b)</enum><header>Selection of properties</header><text>The Director, with the concurrence of the head of the executive agency concerned and consistent with the criteria established in this subchapter, may then select such candidate real properties for participation in the pilot program and notify the recommending agency accordingly.</text>
 </subsection><subsection id="H3EB96A4629DB4B26ACE5EE9B084A6962"><enum>(c)</enum><header>Website required</header><text>The Director shall ensure that all real properties selected for disposition under this section are listed on a website that shall—</text>
 <paragraph id="H2EC25288745641538B6B5ADB794C851E"><enum>(1)</enum><text>be updated routinely; and</text> </paragraph><paragraph id="H8F682D597FB0409CB258C4269D8E0510"><enum>(2)</enum><text>include the functionality to allow members of the public, at their option, to receive such updates through electronic mail.</text>
 </paragraph></subsection><subsection id="HFD10D90A9D8D4C0FABD7F5DB7FAB110E"><enum>(d)</enum><header>Notification of pilot program</header><text>The Secretary of Housing and Urban Development shall ensure that efforts are taken to inform representatives of the homeless about—</text>
 <paragraph id="H6EC8BBBD0A0342B5AE144AA0FFD8B381"><enum>(1)</enum><text>the pilot program established under section 622; and</text> </paragraph><paragraph id="HB3FFBE9786654CB29104EECF70BB5458"><enum>(2)</enum><text>the website under subsection (c).</text>
 </paragraph></subsection><subsection id="H0EB7488D55B743AB9CEE2CE5F1D5DC6E"><enum>(e)</enum><header>Availability of information</header><text>The Secretary of Housing and Urban Development shall—</text> <paragraph id="H3A6EBCDB44874F5D9A437DD3B215BCD7"><enum>(1)</enum><text>make available to the public upon request all information (other than valuation information), regardless of format, in the possession of the Department of Housing and Urban Development relating to the properties listed on the website under subsection (c), including environmental assessment data; and</text>
 </paragraph><paragraph id="HD4D85FB02B354C279C0B24E9833DBF81"><enum>(2)</enum><text>maintain a current list of agency contacts for making referrals to inquiries for information relating to specific properties.</text>
								</paragraph></subsection></section><section id="H1F5F6B526E0D4C9E92171EA811D62999"><enum>624.</enum><header>Suitability determination</header>
 <subsection id="H531B5B3E54154A30A012060FB6FE4E1A"><enum>(a)</enum><header>Suitability of property To assist the homeless</header><text>After the Director selects the candidate real properties that may participate in the pilot program under section 623, the Secretary of Housing and Urban Development shall determine whether each such real property is suitable for use to assist the homeless.</text>
 </subsection><subsection id="H3CEDB94A2E6B48409DC302D5AF0E40A8"><enum>(b)</enum><header>Suitability determination requirements</header><text>The Secretary of Housing and Urban Development shall base the suitability determination required under subsection (a)—</text>
 <paragraph id="HF1B4B0686798451890CF119E03235321"><enum>(1)</enum><text>on the suitability criteria identified by the Secretary of Housing and Urban Development under section 501(a) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411(a)</external-xref>);</text>
 </paragraph><paragraph id="HA9A90390240C4AB2AD81F0DC01E843D0"><enum>(2)</enum><text>for real properties located within a Federal installation, campus, or compound, on whether such property can easily be transported to an off-site location; and</text>
 </paragraph><paragraph id="H10C8A1A0D2B44948AFAAFCE76AECE823"><enum>(3)</enum><text>for real properties where the predominant use is other than housing, on whether the size of the real property is equal to or greater than 100,000 square feet.</text>
 </paragraph></subsection><subsection id="H556AEC0CD8974708BC4A019814F1480A"><enum>(c)</enum><header>Information required To be published on the website</header><text>Immediately after a determination of suitability is made under this section, the Director shall publish, on the website described in section 623(c) the following information:</text>
 <paragraph id="H2EFA8DD5D107433583C6BB0C6BEDB2AE"><enum>(1)</enum><text>The address of each such real property.</text> </paragraph><paragraph id="HECEE0BB3505E418BB24BDE3E1B935CDC"><enum>(2)</enum><text>The result of the suitability determination required under subsection (a) for each such real property.</text>
 </paragraph><paragraph id="H388BCF6B82964DFCA571CF1242967726"><enum>(3)</enum><text>The date on which the suitability determination was made.</text> </paragraph></subsection></section><section id="H692C306A078D4B3CA2692C5685317F8E"><enum>625.</enum><header>Unsuitable real property</header> <subsection id="HD0F0F2A3C7854EBAB9D290ABFBCF5A1F"><enum>(a)</enum><header><enum-in-header>20</enum-in-header>-Day hold required after determination of unsuitability</header><text>If real property is determined unsuitable under section 624, such real property may not be disposed of or otherwise used for any other purpose for at least 20 days after such determination was made.</text>
							</subsection><subsection id="H17CF4CD62845483C9F2772B9C31CFF6A"><enum>(b)</enum><header>Appeal</header>
 <paragraph id="H8DA55A6B530448BFA8E3F032307F1A77"><enum>(1)</enum><header>Secondary review of determination</header><text display-inline="yes-display-inline">Not later than 20 days after real property has been determined unsuitable under section 624 and before disposal of the real property in accordance with subsection (d), any representative of the homeless may appeal to the Secretary of Housing and Urban Development for a secondary review of such determination.</text>
 </paragraph><paragraph id="HA5AD71940AE947079B61051A4DDDD956"><enum>(2)</enum><header>Clear and convincing evidence</header><text>Not later than 20 days after real property has been determined unsuitable under subsection (b)(3) of section 624, the Secretary of Housing and Urban Development shall deem such real property suitable notwithstanding the requirements of that subsection if a representative of the homeless has produced clear and convincing evidence that such property can be utilized for the benefit of the homeless. Any determination under this paragraph shall be committed to the unreviewable discretion of the Secretary of Housing and Urban Development.</text>
 </paragraph></subsection><subsection id="HE09616CDC80D4777BB7233FCD3BDDC08"><enum>(c)</enum><header>Final suitability determination</header><text>Not later than 20 days after the receipt of any appeal under subsection (b), the Secretary of Housing and Urban Development shall respond to such appeal and shall make a final suitability determination regarding the real property.</text>
							</subsection><subsection id="H85ECC43FD9EB4DF49FF54B36CA08507B"><enum>(d)</enum><header>Disposal of unsuitable real property</header>
 <paragraph id="HE5950E74495D45FB9BA2196B64FB3C5A"><enum>(1)</enum><header>No appeal</header><text display-inline="yes-display-inline">If at the end of the 20-day period required under subsection (a), no appeal for review of a determination of unsuitability is received by the Secretary of Housing and Urban Development, such real property shall be disposed of in accordance with section 627.</text>
 </paragraph><paragraph id="H38AAC00262E84234B7FFD19D4A9BDD9F"><enum>(2)</enum><header>Determination of unsuitability after secondary review</header><text display-inline="yes-display-inline">If after conducting a secondary review of a determination of unsuitability under subsection (b), the Secretary of Housing and Urban Development determines that the real property remains unsuitable under subsection (c), such real property shall be disposed of in accordance with section 627.</text>
 </paragraph><paragraph id="HABAF340B891944D789D74400E1BD2592"><enum>(3)</enum><header>Determination of suitability after secondary review</header><text display-inline="yes-display-inline">If after conducting a secondary review of a determination of unsuitability under subsection (b), the Secretary of Housing and Urban Development determines that the real property is suitable under subsection (c), such real property shall be treated as suitable property for purposes of section 626.</text>
								</paragraph></subsection></section><section id="H0E42744220174479A1A90E3FB7F8008C"><enum>626.</enum><header>Suitable real property</header>
							<subsection id="H6AC9327C2E81414A96E12D1E946570B6"><enum>(a)</enum><header>Disposal of suitable real property</header>
 <paragraph id="H30D66A8B440246BA8C23207C3121649D"><enum>(1)</enum><header>Application for transfer of property</header><text display-inline="yes-display-inline">If real property is determined suitable under section 624 or upon a secondary review under section 625(d), any representative of the homeless shall have not more than 90 days after such determination to submit an application to the Secretary of Health and Human Services for the transfer of the real property to that representative. If an application cannot be completed within the 90-day period due to non-material factors, the Secretary of Health and Human Services, with the concurrence of the appropriate landholding agency, may grant reasonable extensions.</text>
 </paragraph><paragraph id="HE736269DE0534832A6ED85EF1F4FD492"><enum>(2)</enum><header>No application submitted</header><text>If at the end of the time period described under paragraph (1), no representative of the homeless has submitted an application, such real property shall be disposed of in accordance with section 627.</text>
								</paragraph></subsection><subsection id="H52F22C543DAD47ECA388C238BDDAFC50"><enum>(b)</enum><header>Consideration of application</header>
 <paragraph id="HD513DAB9A1AB4C28907FD766B5B77751"><enum>(1)</enum><header>Assessment of application</header><text display-inline="yes-display-inline">Not later than 20 days after the receipt of any application under subsection (a)(1), the Secretary of Health and Human Services shall assess such application and determine whether to approve or deny the request for the transfer of the real property to such applicant.</text>
 </paragraph><paragraph id="HB73B7186A10B4C22926C10D62B7ED320"><enum>(2)</enum><header>Denial of application</header><text>If the application of a representative of the homeless is denied by the Secretary of Health and Human Services under paragraph (1), such real property shall be disposed of in accordance with section 627.</text>
 </paragraph><paragraph id="H7B0498B17EA2499F882ED0DA3C72085F"><enum>(3)</enum><header>Approval of application</header><text>If the application of a representative of the homeless is approved by the Secretary of Health and Human Services under paragraph (1), such real property shall be made promptly available to that representative by permit or lease, or by deed, as a public health use under subsections (a) through (d) of section 550.</text>
								</paragraph></subsection></section><section id="H0375DD1592B24B65BF724B725FDBE6BE"><enum>627.</enum><header>Expedited disposal requirements</header>
 <subsection id="H390DE141703C45A699FA43333AFB3C1B"><enum>(a)</enum><header>Fair market value required</header><text>Real property sold under the pilot program established under this subchapter shall be sold at not less than the fair market value, as determined by the Director in consultation with the head of the executive agency. Costs associated with such disposal may not exceed the fair market value of the property unless the Director approves incurring such costs.</text>
 </subsection><subsection id="H18C065C048834DB8826A51683865E37B"><enum>(b)</enum><header>Monetary proceeds required</header><text>Real property may be sold under the pilot program established under this subchapter only if the property will generate monetary proceeds to the Federal Government, as provided in subsection (a). A disposal of real property under the pilot program may not include any exchange, trade, transfer, acquisition of like-kind property, or other non-cash transaction as part of the disposal.</text>
 </subsection><subsection id="H397EAC1922B94010B422DBC44D80D48C"><enum>(c)</enum><header>Construction</header><text>Nothing in this subchapter shall be construed as terminating or in any way limiting authorities that are otherwise available to agencies under other provisions of law to dispose of Federal real property, except as provided in subsection (d).</text>
 </subsection><subsection id="HB5752148398141EAAA0E3B1CB1A3D8DA"><enum>(d)</enum><header>Expedited disposal exemptions</header><text>Any expedited disposal of real property conducted under this subchapter shall not be subject to—</text> <paragraph id="HC63713C8898E44589633DA9FE60EE506"><enum>(1)</enum><text>subchapter IV of this chapter;</text>
 </paragraph><paragraph id="H01A3D9AD00964D95B1C56A0A543C554C"><enum>(2)</enum><text>sections 550 and 553 of this title;</text> </paragraph><paragraph id="H117CA87F1E2841D9B5AD3D951C2E0019"><enum>(3)</enum><text>section 501 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411</external-xref>);</text>
 </paragraph><paragraph id="H5D1F760A0EC4412EBBA3B2A4D3FCA4B9"><enum>(4)</enum><text>any other provision of law authorizing the no-cost conveyance of real property owned by the Federal Government; or</text>
 </paragraph><paragraph id="HAF3E4C8603124C7B8E40C7A4EC97244E"><enum>(5)</enum><text>any congressional notification requirement other than that in section 545.</text> </paragraph></subsection></section><section id="H37D3072D451C4E07B1B37360A878A037"><enum>628.</enum><header>Special rules for deposit and use of proceeds from disposal of real property</header> <subsection id="HFE9AAC85F30E461FA7BE7E1FE2C33797"><enum>(a)</enum><header>Reimbursement of administrative expenses</header><text>Executive agencies that dispose of real property under this subchapter shall be reimbursed from the proceeds, if any, from such disposal for the administrative expenses associated with such disposal. Such amounts shall be credited as offsetting collections to the account that incurred such expenses, to remain available until expended.</text>
							</subsection><subsection id="H3A42490A3C0D45C0944836C9D72E89C9"><enum>(b)</enum><header>Deposit of proceeds</header>
 <paragraph id="H6FBC6B6B3A4A41D0B168027BAF414617"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">After payment of the administrative expenses described under subsection (a), the balance of the proceeds shall be distributed as follows:</text>
 <subparagraph id="HC79C6A6F7FDF4CFD9D191F885BE80338"><enum>(A)</enum><text>80 percent shall be deposited into the Treasury as miscellaneous receipts.</text> </subparagraph><subparagraph id="HF09DAAC5895C484BB02F61D512EA170A"><enum>(B)</enum><text>20 percent shall be deposited into the account of the agency that owned the real property and initiated the disposal action.</text>
 </subparagraph></paragraph><paragraph id="HE8986A808E0C4F98900731D164A96C6E"><enum>(2)</enum><header>Federal real property capital improvements and disposal activity funds</header><text display-inline="yes-display-inline">Funds deposited under paragraph (1)(A) shall remain available until expended for the period of the pilot program, for activities related to Federal real property capital improvements and disposal activities. Upon termination of the pilot program, any unobligated amounts shall be transferred to the general fund of the Treasury.</text>
 </paragraph></subsection></section><section id="H46B03B935BFD43E5841CF3139D0BDA4F"><enum>629.</enum><header>Limitation on number of permissible cash sales</header><text display-inline="no-display-inline">The total number of cash sales of real properties to be disposed of under this subchapter over the 5-year term of the Federal Real Property Disposal Pilot Program shall not exceed 750.</text>
						</section><section id="H6D85F1822D1B429AB97E8CB1C094C64D"><enum>630.</enum><header>Government Accountability Office study</header>
 <subsection id="H9C833D8F27164BEEAA84BFF22325BAD8"><enum>(a)</enum><header>Study required</header><text>Not later than 36 months after the date of enactment of this subchapter, the Comptroller General of the United States shall submit to Congress and make publicly available a study of the effectiveness of the pilot program.</text>
 </subsection><subsection id="H1133949632AA4461A59839188C602821"><enum>(b)</enum><header>Contents of study</header><text>The study described under subsection (a) shall include at a minimum—</text> <paragraph id="HA88C5B6876154ADD98EC312335049BD6"><enum>(1)</enum><text>recommendations for permanent reforms to statutes governing real property disposals and no cost conveyances; and</text>
 </paragraph><paragraph id="HBB451FDEB6334C82951F86CBEB5FA64F"><enum>(2)</enum><text>recommendations for improving the permanent process by which Federal properties are made available for use by the homeless.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H38A41942CC7A43DF9944AB68C2958675"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for chapter 5 of subtitle I of title 40, United States Code, is amended by inserting after the item relating to section 611 the following:</text>

			</subsection></section><section id="H0702ACD4E46C41269B7AE2D26229F19F" section-type="subsequent-section"><enum>4.</enum><header>Payment of principal and interest on public debt and social security trust funds</header>
 <subsection display-inline="no-display-inline" id="H7C4DD70DD9104D1EBAA466A38716BCCE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the event that the debt of the United States Government, as defined in section 3101 of title 31, United States Code, reaches the statutory limit, the Secretary of the Treasury shall, in addition to any other authority provided by law, issue obligations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/31">chapter 31</external-xref> of title 31, United States Code, to pay with legal tender, and solely for the purpose of paying, the principal and interest on obligations of the United States described in subsection (b) after the date of the enactment of this Act.</text>
 </subsection><subsection id="H00CD995DA83A443DBA89392AF0435D4A"><enum>(b)</enum><header>Obligations described</header><text display-inline="yes-display-inline">For purposes of this subsection, obligations described in this subsection are obligations which are—</text>
 <paragraph id="HB846324C08794ECB9F6DC3D25A8E1757"><enum>(1)</enum><text>held by the public, or</text> </paragraph><paragraph id="HB6E4DDA210164D41AD1A611D1302A1F7"><enum>(2)</enum><text display-inline="yes-display-inline">held by the Old-Age and Survivors Insurance Trust Fund and Disability Insurance Trust Fund.</text>
 </paragraph></subsection><subsection id="H2314360766D342C9BF8C9B543B33C2F3"><enum>(c)</enum><header>Prohibition on compensation for Members of Congress</header><text display-inline="yes-display-inline">None of the obligations issued under subsection (a) may be used to pay compensation for Members of Congress.</text>
 </subsection><subsection id="H8104499ABCD04EEAADF56FE3C701F846"><enum>(d)</enum><header>Obligations exempt from public debt limit</header><text display-inline="yes-display-inline">Obligations issued under subsection (a) shall not be taken into account in applying the limitation in section 3101(b) of title 31, United States Code, to the extent that such obligation would otherwise cause the limitation in section 3101(b) of title 31, United States Code, to be exceeded.</text>
			</subsection><subsection commented="no" id="HF4AE9B0B38C2462D89F0006D2B0E0392"><enum>(e)</enum><header>Report on certain actions</header>
 <paragraph commented="no" id="H38FD82FAC5EF4CFB994286D7CE97D775"><enum>(1)</enum><header>In general</header><text>If, after the date of the enactment of this Act, the Secretary of the Treasury exercises his authority under subsection (a), the Secretary shall thereafter submit a report each week the authority is in use providing an accounting relating to—</text>
 <subparagraph id="H8ECEF1332C2C4C8B9BEAB42DB01F3F8E"><enum>(A)</enum><text>the principal on mature obligations and interest that is due or accrued of the United States, and</text> </subparagraph><subparagraph id="HC1511E69E53348C1AD51DF9D09A31A53"><enum>(B)</enum><text>any obligations issued pursuant to subsection (a).</text>
 </subparagraph></paragraph><paragraph commented="no" id="H773D6089C08649E29D8D8AEBC109E3B6"><enum>(2)</enum><header>Submission</header><text>The report required by paragraph (1) shall be submitted to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate.</text>
				</paragraph></subsection></section><section id="H6558C84F0F57486FA122120056A66254"><enum>5.</enum><header>Rescission of unobligated balances</header>
 <subsection id="H99C5AA686F1F4477B50A2B7C382C6F8C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If a Federal budget deficit exists in 2015, not later than July 16, 2016, of the funds made available before October 1, 2009, the President may rescind any unobligated balances of such funds.</text>
 </subsection><subsection id="H3652E81F751A467DBE637E25B76812AF"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">On the same date that the President orders a rescission under subsection (a), the President shall submit a report to Congress containing the total amounts of the funds rescinded and the affected accounts.</text>
