<section id="H61329D0064874CE2AF52743ECB2F6B8B" section-type="section-one"><enum>1.</enum><header>Development of evidence by Board of Veterans’ Appeals</header> 
<subsection id="H19FFB55E0B014751ACFD2B48FAD3E2BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/71">Chapter 71</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text> <quoted-block style="USC" id="H2F9F42DE49644D27902394AB1A0BF442" display-inline="no-display-inline"> <section id="HF88DB7B0B09B434BAF3A4547130F0311"><enum>7113.</enum><header>Development of evidence</header> <subsection id="H73AA4746AB794F1E985AB3FBCD5395FF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the Board determines that there is insufficient evidence to make a decision in a claimant’s appeal case, the Board shall take such steps as may be necessary to develop the evidence necessary to make a decision in the case.</text></subsection> 
<subsection id="H8A0F55DC3FC64348A8B0489441064A92"><enum>(b)</enum><header>Prohibition on remands</header><text>The Board may not remand any appeal case to the Veterans Benefits Administration.</text></subsection> <subsection id="H264E9FDB3D0F47508A1980FE8F9B49BC"><enum>(c)</enum><header>Provision of access</header><text>The Secretary shall ensure that the Board has access to such information as may be necessary to develop evidence under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
