<section display-inline="yes-display-inline" section-type="undesignated-section" id="H541A8C7D577A4D79820D01E2B92764EA"><text>That </text></section> <section id="H2A7C5CF632B9478497B608DFDF811FD7" display-inline="yes-display-inline" section-type="undesignated-section"><enum></enum><text>in the enrollment of S. 178, an Act to provide justice for the victims of trafficking, the Secretary of the Senate shall—</text> 
<paragraph id="HDAC859CC3A7C467DAF45C2AD25C189BA"><enum>(1)</enum><text>in section 702(b)(2), insert <quote>pilot program</quote> after <quote>identified by the</quote>; and</text> </paragraph> <paragraph id="H8E1C0FF8BA044D719DA64C6ED322FBB3"><enum>(2)</enum><text>strike section 1002 and insert the following:</text> </paragraph></section> 
<section id="HE044DED964F64D09AE99E88A8C5D27B9"><enum>1002.<?LEXA-Enum 1002.?></enum><header>Protections for human trafficking survivors</header><text display-inline="no-display-inline">Section 1701(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(c)</external-xref>), as amended by section 601 of this Act, is amended—</text> <paragraph id="H3F7C74A4D5B04E9FBD0AABD410DF4B34"><enum>(1)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text> </paragraph> 
<paragraph id="H46B643DF0EE54B3DBDF77B769B209FDB"><enum>(2)</enum><text>in paragraph (2)(C), by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph> <paragraph id="HAB42A2F0D4124C87B8F44548954771E7"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text>

<paragraph id="HEB3D8EC81AA84968B781B1E63AB73DAF"><enum>(3)</enum><text>from an applicant in a State that has in effect a law—</text> <subparagraph id="H97368C8AC6C24EE7AA6047E38C8CF45F"><enum>(A)</enum><text>that—</text> 
<clause id="HF4229CE9EA2F4C51803D3A77696BEEF8"><enum>(i)</enum><text>provides a process by which an individual who is a human trafficking survivor can move to vacate any arrest or conviction records for a non-violent offense committed as a direct result of human trafficking, including prostitution or lewdness;</text> </clause> <clause id="HF8FAA91282BE48DAAFDA0C34412815C1"><enum>(ii)</enum><text>establishes a rebuttable presumption that any arrest or conviction of an individual for an offense associated with human trafficking is a result of being trafficked, if the individual—</text> 
<subclause id="H25389A4D8F7A44FDB4C29E8E4B23AA2E"><enum>(I)</enum><text>is a person granted nonimmigrant status pursuant to section 101(a)(15)(T)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(T)(i)</external-xref>);</text> </subclause> <subclause id="HA5C520FACEEF4FEE9073C3DD0B0F5FA5"><enum>(II)</enum><text>is the subject of a certification by the Secretary of Health and Human Services under section 107(b)(1)(E) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(1)(E)</external-xref>); or</text> </subclause> 
<subclause id="HBDD61E479B3441ABB91268258201A4F6"><enum>(III)</enum><text>has other similar documentation of trafficking, which has been issued by a Federal, State, or local agency; and</text> </subclause></clause> <clause id="H21F96D4316224849BCFDDCA18CDAFFE9"><enum>(iii)</enum><text>protects the identity of individuals who are human trafficking survivors in public and court records; and</text> </clause></subparagraph> 
<subparagraph id="HFFFF717BCCAD433782713532ACA11BDF"><enum>(B)</enum><text>that does not require an individual who is a human trafficking survivor to provide official documentation as described in subclause (I), (II), or (III) of subparagraph (A)(ii) in order to receive protection under the law.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> </resolution-body> <attestation><attestation-group><attestation-date date="20150520" chamber="House">Passed the House of Representatives May 20, 2015.</attestation-date><attestor display="no">Karen L.
