			 fourteen</enrolled-dateline><legis-num display="yes">S. 517</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To promote consumer choice and wireless competition by
		  permitting consumers to unlock mobile wireless devices, and for other
		  purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="H90F6E3EDC5064245AF3B194E3063DA44" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlocking Consumer Choice and Wireless Competition Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H4C48389D404B455CAA810E572AC872D3" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Repeal of existing rule and additional rulemaking by Librarian of Congress</header><subsection commented="no" display-inline="no-display-inline" id="H3FE2FEDDC9184C40B28CAEDC69A2F991"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal and replace</header><text display-inline="yes-display-inline">As of the date of the enactment of this Act, paragraph (3) of <external-xref legal-doc="regulation" parsable-cite="cfr/37/201.40">section 201.40(b)</external-xref> of title 37, Code of Federal Regulations, as amended and revised by the Librarian of Congress on
			 October 28, 2012, pursuant to the Librarian’s authority under <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201(a)</external-xref> of title 17, United States Code, shall have no force and effect, and such paragraph shall read,
			 and shall be in effect, as such paragraph was in effect on July 27, 2010.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HD19512D5874542BFA8D3DA05550A1AD7"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">The Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall consult
			 with the Assistant Secretary for Communications and Information of the
			 Department of Commerce and report and comment on his or her views in
			 making such recommendation, shall determine, consistent with the
			 requirements set forth under <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201(a)(1)</external-xref> of title 17, United States Code, whether to extend the exemption for the class of works described
			 in <external-xref legal-doc="regulation" parsable-cite="cfr/37/201.40">section 201.40(b)(3)</external-xref> of title 37, Code of Federal Regulations, as amended by subsection (a), to include any other
			 category of wireless devices in addition to wireless telephone handsets.
			 The determination shall be made in the first rulemaking under section
			 1201(a)(1)(C) of title 17, United States Code, that begins on or after the
			 date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H6DBDA049D5AA47CB838EB3ED03827CA2"><enum>(c)</enum><header display-inline="yes-display-inline">Unlocking at direction of owner</header><text display-inline="yes-display-inline">Circumvention of a technological measure that restricts wireless telephone handsets or other
			 wireless devices from connecting to a wireless telecommunications network—</text><paragraph commented="no" display-inline="no-display-inline" id="H9DFD7AE4567C405395D533DA16F77199"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8DE924FBF196472591A772506AEF7778"><enum>(A)</enum><text display-inline="yes-display-inline">as authorized by paragraph (3) of <external-xref legal-doc="regulation" parsable-cite="cfr/37/201.40">section 201.40(b)</external-xref> of title 37, Code of Federal Regulations, as made effective by subsection (a); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9723D7C8E9143179FDB1056455F399F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">as may be extended to other wireless devices pursuant to a determination in the rulemaking
			 conducted under subsection (b); or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H99A8114BA9AF4DB3AAF080368806EC88"><enum>(2)</enum><text display-inline="yes-display-inline">as authorized by an exemption adopted by the Librarian of Congress pursuant to a determination made
			 on or after the date of enactment of this Act under <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201(a)(1)(C)</external-xref> of title 17, United States Code,</text></paragraph><continuation-text commented="no" continuation-text-level="subsection">may be initiated by the owner of any such handset or other device, by another person at the
			 direction of the owner, or by a provider of a commercial mobile radio
			 service or a commercial mobile data service at the direction of such owner
			 or other person, solely in order to enable such owner or a family member
			 of such owner to connect to a wireless telecommunications network, when
			 such connection is authorized by the operator of such network.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="HB8A334D45E3F4057AA115151CFC8C67E"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><paragraph commented="no" display-inline="no-display-inline" id="id4119584BDA38461397F13EB12ED1197B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as expressly provided herein, nothing in this Act shall be construed to alter the scope of
			 any party's rights under existing law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6087AB3321D047DB8E810AD89FD8959D"><enum>(2)</enum><header display-inline="yes-display-inline">Librarian of Congress</header><text display-inline="yes-display-inline">Nothing in this Act alters, or shall be construed to alter,
			 the authority of the Librarian of Congress under <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201(a)(1)</external-xref> of title 17, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA457417140EE45A3AE100019F4D8FEAF"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H72C59C1457064D5AB67FF55E755A2627"><enum>(1)</enum><header display-inline="yes-display-inline">Commercial mobile data service; commercial mobile radio service</header><text display-inline="yes-display-inline">The terms <quote>commercial mobile data service</quote> and <quote>commercial mobile radio service</quote> have the respective meanings given those terms in <external-xref legal-doc="regulation" parsable-cite="cfr/47/20.3">section 20.3</external-xref> of title 47, Code of Federal Regulations, as in effect on the date of the enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAE87C10EE97544079CFB39B222C316DD"><enum>(2)</enum><header display-inline="yes-display-inline">Wireless telecommunications network</header><text display-inline="yes-display-inline">The term <quote>wireless telecommunications network</quote> means a network used to provide a commercial mobile radio service or a commercial mobile data
			 service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2FC34F97BF794883BC3FD8CE5D36785C"><enum>(3)</enum><header display-inline="yes-display-inline">Wireless telephone handsets; wireless devices</header><text display-inline="yes-display-inline">The terms <quote>wireless telephone handset</quote> and <quote>wireless device</quote> mean a handset or other device that operates on a wireless telecommunications network.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
