			 terms of an amendment to, or repeal of, a section or other provision, the
			 reference shall be considered to be made to a section or other provision
			 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
			 1801 et seq.).</text></section><section id="id93C75A3263C6485FBDB28963A1157082"><enum>3.</enum><header>Changes in findings, purposes, and policy</header><subsection id="id052C054CA19E44DFBD7EF8C9B3B54E50"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Section 2(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801(a)</external-xref>) is amended—</text><paragraph id="id433BEFDB5EBD4C03B84551D7DC7BBF3F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking <quote>at an ever-increasing rate over the past decade</quote>;</text></paragraph><paragraph id="id1BC76AEF413342C6AC14D765C427F0DB"><enum>(2)</enum><text>in paragraph (6), by inserting <quote>and marine ecosystems</quote> after <quote>essential fish habitats</quote>;</text></paragraph><paragraph id="id764FE1456878433490FD4092607EB15C"><enum>(3)</enum><text>in paragraph (11), by striking <quote>have demonstrated</quote> and inserting <quote>are demonstrating</quote>;</text></paragraph><paragraph id="idD670958783BD4B77BB70C6E106D9185A"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (7) through (12) as paragraphs (10) through (15), respectively;</text></paragraph><paragraph id="id0E9C8D7F6EF74A03B37E260D2352E212"><enum>(5)</enum><text>by inserting before paragraph (10), as redesignated, the following:</text><quoted-block display-inline="no-display-inline" id="idAEE81E183B0A4E6A8E37C0449CA4815C" style="OLC"><paragraph id="id973FA0976158495F8216BE5DB41A0E6E"><enum>(8)</enum><text display-inline="yes-display-inline">By establishing mechanisms, under authority of this Act, for specifying science-based annual catch
			 limits in fishery management plans at levels such that overfishing does
			 not occur in fisheries, including measures to ensure accountability, the
			 Nation’s fishery resources are now being
			 managed sustainably to prevent overfishing and respond quickly if
			 overfishing occurs.</text></paragraph><paragraph id="id30208C9F1F4F4D878F8530D670309BA2"><enum>(9)</enum><text display-inline="yes-display-inline">It is of critical importance to the health of the Nation’s fishery resources and the coastal
			 communities that depend on them that the United States maintain its
			 progress in preventing overfishing and rebuilding overfished stocks.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id42152505F3E045F5944EDF1A3D295564"><enum>(6)</enum><text>by redesignating paragraphs (4) through (6) as paragraphs (5) through (7), respectively; and</text></paragraph><paragraph id="id79677FE3831E423CB505758D664235C2"><enum>(7)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="idC38178FABB02494F8426E2BFCD235277" style="OLC"><paragraph id="id1EC7CB438F6848A8A98E519B7325CE76"><enum>(4)</enum><text>Subsistence fishing is an integral part of life in many communities throughout the United States,
			 and the Nation’s marine and anadromous fish are important sources of
			 nutrition, sustenance, and the cultural heritage of those communities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA0B632E44A984A4FAE47B1CE57FC14D0"><enum>(b)</enum><header>Purposes</header><text>Section 2(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801(b)</external-xref>) is amended—</text><paragraph id="idB1006E7582A648F89C1F731B09C5F95D"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and recreational</quote> and inserting <quote>, recreational, and subsistence</quote>;</text></paragraph><paragraph id="idE4530B3904014C44AB871BD9532C3800"><enum>(2)</enum><text>in paragraph (5), by striking <quote>the State</quote> and inserting <quote>the States, tribal governments,</quote>; and</text></paragraph><paragraph id="id53769CC9D97B46B58F4C009C58268F47"><enum>(3)</enum><text>in paragraph (7), by striking <quote>the review of projects</quote> and inserting <quote>projects and activities</quote>.</text></paragraph></subsection><subsection id="id603CA31A42C64B1B9EECE3185628C4E7"><enum>(c)</enum><header>Policy</header><text>Section 2(c)(3) (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801(c)(3)</external-xref>) is amended—</text><paragraph id="idAE51235D0CE54CF1A3AE3CD5A88F81E4"><enum>(1)</enum><text>by inserting <quote>, tribes,</quote> after <quote>affected States</quote>; and</text></paragraph><paragraph id="idCA61C44F096045BFB62F7587E859FE3C"><enum>(2)</enum><text>by inserting <quote>tribal,</quote> after <quote>State,</quote>.</text></paragraph></subsection></section><section id="id3D12F403D4A34381B11629696386EC31"><enum>4.</enum><header>Definitions</header><subsection id="idD3562D70CAD2475280CAEBF4D2ABA23C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>) is amended—</text><paragraph id="id011CEFEE35384F11A47B5D42C9576BC8"><enum>(1)</enum><text>by inserting after paragraph (8) the following:</text><quoted-block display-inline="no-display-inline" id="idBB2A0431BD7C42BBBB6C5F7764A2D1BD" style="OLC"><paragraph id="id4784C3F0BCCC4E419BD418C63AED0C35"><enum>(8A)<?LEXA-Enum (8A)?></enum><text>The terms <term>depleted</term> and <term>depletion</term> mean, with respect to a stock of fish in a fishery, that the stock is of a size that jeopardizes
			 the capacity of the fishery to produce the maximum sustainable yield on a
			 continuing basis.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id660C2E34D8E444C39B22EF3D98BB5943"><enum>(2)</enum><text>in paragraph (33)(C), by inserting <quote>or otherwise depleted</quote> after <quote>overfished</quote>;</text></paragraph><paragraph id="id9E65773BC6C04AC39FE7309658A34EB5"><enum>(3)</enum><text>in paragraph (36), by inserting <quote>, tribal,</quote> after <quote>State,</quote>;</text></paragraph><paragraph id="idB7C7AF8052124F7C95D538F0E3466962"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after paragraph (43) the following:</text><quoted-block display-inline="no-display-inline" id="id4F5A81DBBC8D44D68E3E4B24F4508A69" style="OLC"><paragraph id="id3779557FB4B44A5A8F087DE921D27EAD"><enum>(43A)<?LEXA-Enum (42A)?></enum><text>The term <term>subsistence fishing</term> means fishing in which the fish harvested are intended for customary and traditional uses,
			 including for direct personal or family consumption as food or clothing;
			 for the making or selling of handicraft articles out of nonedible
			 byproducts taken for personal or family consumption, for barter, or
			 sharing for personal or family consumption; and for customary exchange or
			 trade.  In
			 this paragraph, the term—</text><subparagraph id="id9E49A1EE410045418559AFECCC9EFAC4"><enum>(A)</enum><text><term>family</term> means all persons related by blood, marriage, or adoption, or any person living within the
			 household on a permanent
			 basis; and</text></subparagraph><subparagraph id="idDE1513DDD1844D4393BD0B329052E53F"><enum>(B)</enum><text>
									<term>barter</term> means the exchange of a fish or fish part—</text><clause id="id389847335F4E42F583F059567EA4C263"><enum>(i)</enum><text>for another fish or fish part; or</text></clause><clause id="id59A99F3FAAEC4841AD87BD2DD7F761B5"><enum>(ii)</enum><text>for other food or for nonedible items other than money if the exchange is of a limited and
			 noncommercial nature.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id9884253428AC4F5F94181DFE60D59882"><enum>(5)</enum><text>by inserting after paragraph (44) the following:</text><quoted-block display-inline="no-display-inline" id="id9B7D247D880F43FD91326AC8717AFF59" style="OLC"><paragraph id="idBD928B35A0D8482C88161F3D03465764"><enum>(44A)<?LEXA-Enum (43A)?></enum><text>The terms <term>tribal</term> and <term>tribe</term> mean an Indian tribe as defined in section 102 of the Federally Recognized Indian Tribe List
			 Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idF030FACB47AE4836A8FAF1FEBA4CD532"><enum>(6)</enum><text>by striking <quote>(33) The term <term>waters of a foreign nation</term> means</quote> and inserting <quote>(51) The term <term>waters of a foreign nation</term> mean</quote>.</text></paragraph></subsection><subsection commented="no" id="id37578F6AEF8745D4989ACAF30B3EB2B8"><enum>(b)</enum><header>Redesignation</header><text display-inline="yes-display-inline">Paragraphs (1) through (51) of section 3 (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>), as amended by subsection (a) of this
			 section, are
			 redesignated as paragraphs (1) through (54), respectively.</text></subsection><subsection commented="no" id="id146095C79C1444F08ED6C5029AA533DA"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph commented="no" id="idA3D31ED35CD745B494E454353565471D"><enum>(1)</enum><header>Title 10</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/7306b">Section 7306b(b)</external-xref> of title 10, United States Code, is amended by striking <quote>defined in section 3(14)</quote> and inserting <quote>defined in section 3</quote>.</text></paragraph><paragraph commented="no" id="id43EDE2BCFE364523B5D50DC19E8315EA"><enum>(2)</enum><header>Whale Conservation and Protection Study Act</header><text>Section 3 of the Whale Conservation and Protection Study Act   (<external-xref legal-doc="usc" parsable-cite="usc/16/917a">16 U.S.C. 917a</external-xref>) is amended by

			 managed under a fishery management plan or international agreement, the
			 status shall be determined using the criteria for overfishing (or
			 depletion, where applicable) specified in the plan or agreement. A fishery
			 shall be classified as approaching a condition of
			 being overfished or otherwise depleted if, based on trends in fishing
			 effort, fishery resource size, and other appropriate factors, the
			 Secretary estimates that the fishery will become overfished or otherwise
			 depleted within 2 years.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idE81827B44D844A68808B97DAB811DF95"><enum>(3)</enum><text>in paragraph (2), by inserting <quote>or otherwise depleted</quote> after <quote>overfished</quote>;</text></paragraph><paragraph commented="no" id="id03EB357E13124D61824574A4E7B97A98"><enum>(4)</enum><text>in paragraph (3)(B), by inserting <quote>or otherwise depleted</quote> after <quote>overfished</quote>;</text></paragraph><paragraph commented="no" id="idF810CDD572AE4A739A3E3F6B12692F1A"><enum>(5)</enum><text>by amending paragraph (4)(A) to read as follows:</text><quoted-block display-inline="no-display-inline" id="id4220CD0A0DE4442899160E604A9BDD45" style="OLC"><subparagraph commented="no" id="idBEE2510224924146953C909F2D731551"><enum>(A)</enum><text>specify a time period for rebuilding the fishery that—</text><clause commented="no" id="id6CC0F2D4B6DE41F6874627313EB16808"><enum>(i)</enum><text>shall be as short as possible, taking into account the status and biology of any overfished stocks
			 of fish, the needs of fishing communities, recommendations by
			 international organizations
			 in which the United States participates, and the interaction of the
			 overfished stock of fish within the marine ecosystem; and</text></clause><clause commented="no" id="id1BA0851F45464E03A23D98CF8F55B10D"><enum>(ii)</enum><text>except where management measures under an international agreement with the United States
			 participates dictate otherwise, shall not exceed—</text><subclause commented="no" id="id2CA8C15420C74ADBB75792E8D382CA88"><enum>(I)</enum><text>10 years, except in cases where the biology of the stock of fish or other environmental conditions
			 dictate otherwise; or</text></subclause><subclause commented="no" id="id43AD8F90916244DBA65C38F580D49BAE"><enum>(II)</enum><text>the sum of the time in which the affected stock of fish is expected to rebuild to its maximum
			 sustainable yield biomass level in the absence of any fishing mortality,
			 and the mean generation of time of the affected stock of fish, if those

			 the House of Representatives a report for that fiscal year on—</text><subparagraph commented="no" id="id0E0E662047C04C0DB21ED700A0D37169"><enum>(A)</enum><text display-inline="yes-display-inline">the Western Pacific Sustainable Fisheries Fund established under section 204(e)(7);</text></subparagraph><subparagraph commented="no" id="id2D85F45DC65940C0B496CA87B271F364"><enum>(B)</enum><text display-inline="yes-display-inline">the Limited Access System Administration Fund established under section 305(h)(5)(B);</text></subparagraph><subparagraph commented="no" id="idDBADC472128748D5A0A5D7CD6D0F44BC"><enum>(C)</enum><text display-inline="yes-display-inline">the North Pacific Fishery Observer Fund established under section 313(d); and</text></subparagraph><subparagraph commented="no" id="idD8CDAC4484FD4955ADE79A132FD98F00"><enum>(D)</enum><text display-inline="yes-display-inline">the Fisheries Conservation and Management Fund established under section 208(a) of the
			 Magnuson-Stevens Fishery Conservation and Management Reauthorization Act
			 of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/16/1891b">16 U.S.C. 1891b(a)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="idAC7DEA5A573B47B6B23CFE08C46BFBB1"><enum>(2)</enum><header>Required information</header><text display-inline="yes-display-inline">The annual report required under paragraph (1) shall include a detailed accounting of—</text><subparagraph commented="no" id="id2E3CE8BBD5A843519BE15EC82C3AA0B2"><enum>(A)</enum><text display-inline="yes-display-inline">all moneys in each fund at the start of the fiscal year;</text></subparagraph><subparagraph commented="no" id="id7807DD214A9241B2950AED7B98E646F5"><enum>(B)</enum><text display-inline="yes-display-inline">all moneys deposited in each fund during the fiscal year;</text></subparagraph><subparagraph commented="no" id="idAF792ED59D5F460DBB4C94320D639E30"><enum>(C)</enum><text display-inline="yes-display-inline">all moneys paid out of each fund during the fiscal year; and</text></subparagraph><subparagraph commented="no" id="id4326AF9235174B529766EF6A2270DD0D"><enum>(D)</enum><text display-inline="yes-display-inline">all projects, programs, and activities funded by each fund during the fiscal year.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="id10C78A352FCE4F2FAAB04463700A84A9"><enum>104.</enum><header>Other requirements and authority</header><subsection commented="no" id="id8387881BA4B64EDD9AA9C81F462CB6DC"><enum>(a)</enum><header>Fish habitat</header><text display-inline="yes-display-inline">Section 305(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1855">16 U.S.C. 1855(b)</external-xref>) is amended—</text><paragraph commented="no" id="idD46F67747EB843D2A52068915F8892FB"><enum>(1)</enum><text>in paragraph (3), by inserting <quote>or tribal government</quote> after <quote>or State agency</quote> each place it appears; and</text></paragraph><paragraph commented="no" id="idAD6B193B582C4F02B06D9F5EC78F3E57"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph commented="no" id="idAB8F5C37F8784E20ABDBA3F38A4CC7C8"><enum>(A)</enum><text>by striking <quote>from a Council or Federal or State agency</quote> and inserting <quote>from a Council, Federal or State agency, or tribal government</quote>; and</text></subparagraph><subparagraph commented="no" id="id9376ECDBFA9D40558A313F60909BCDA1"><enum>(B)</enum><text>by inserting <quote>or tribal government</quote> after <quote>by any State or Federal agency</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idE57BFCAFE35340328145D3E7B297E77D"><enum>(b)</enum><header>Judicial review</header><text>Section 305(f)(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/1855">16 U.S.C. 1855(f)(2)</external-xref>) is amended by striking <quote>including, actions that establish the date of closure of a fishery to
			 commercial
			 or recreational fishing</quote> and inserting <quote>including but not limited to actions that establish the date of closure of a fishery to commercial,
			 recreational, or
			 subsistence fishing</quote>.</text></subsection><subsection commented="no" id="idB915456A39D3477C8E70878C24624051"><enum>(c)</enum><header>Consumer information regarding sustainably caught fish</header><text>Section 305 (<external-xref legal-doc="usc" parsable-cite="usc/16/1855">16 U.S.C. 1855</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idE851152DD4554AB39B8C73B78AEC9282" style="OLC"><subsection id="id5F229010531540FDBC1DC951F4CBD794"><enum>(l)</enum><header>Sustainability standard</header><paragraph id="idD519804E2F0A4E34B3A7514B5D851A32"><enum>(1)</enum><header>In general</header><text>For the purpose of this Act, fish is sustainability caught if—</text><subparagraph id="idDD78F499C4B54729BEC31C2D6B1B78E2"><enum>(A)</enum><text>the fish is harvested in accordance with—</text><clause id="id062750A01BD94EC395735027ADBEEA74"><enum>(i)</enum><text>a fishery management plan prepared and approved under this Act; or</text></clause><clause id="idBF81D3076342401BBC8B0C131203488B"><enum>(ii)</enum><text>equivalent conservation and management measures of a State or tribe, or under an international
			 agreement to which the United States is a party, as
			 determined by the Secretary;</text></clause></subparagraph><subparagraph id="id30AB51EBC64B4C4AB5AB73B72CCAEE73"><enum>(B)</enum><text>the fishery from which the fish is harvested is not overfished or otherwise depleted; and</text></subparagraph><subparagraph id="id45BB792D050647B6876C22629B0559BC"><enum>(C)</enum><text>overfishing or other depletion is not occurring in the fishery from which the fish is
			 harvested.</text></subparagraph></paragraph><paragraph id="idE33C0DC103E74BF1B75BB0494489D50A"><enum>(2)</enum><header>Rebuilding fisheries</header><text>A fishery that is subject to a rebuilding plan under this Act, or equivalent conservation and
			 management measures as determined by the Secretary, meets the criteria
			 specified in subparagraphs (B) and (C) of paragraph (1) if the Secretary
			 determines
			 that the plan is effectively rebuilding the fishery.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="id7D2AAC7F04AF44C28ADF2851FD40559B"><enum>105.</enum><header>Prohibited acts</header><text display-inline="no-display-inline">Section 307(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857(1)</external-xref>) is amended—</text><paragraph commented="no" id="id89C8A0F1521A421396D9B94415A883CA"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (Q), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" id="id98E3C7BF363E453EB81F79F8BF4971D7"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (R) as subparagraph (S); and</text></paragraph><paragraph commented="no" id="id1F5C7DEA05E54DEC865C4BA68BACBACF"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (Q) the following:</text><quoted-block display-inline="no-display-inline" id="id9BF67E77B4FB4CF0BDF1D325CFB51DD5" style="OLC"><subparagraph commented="no" id="id10F1527D36EE4018A915FA50919FEE13"><enum>(R)</enum><text display-inline="yes-display-inline">to knowingly and willfully make or submit any incomplete, invalid, or false record, account, or
			 label for, or any false
			 identification of, any fish or fish product (including false
			 identification of the species, harvesting vessel or nation, or the date or
			 location where harvested) that has been or is intended to be imported,
			 exported, transported, sold, offered for sale, purchased, or received in
			 interstate or foreign commerce, except where such making or submission is
			 prohibited under subparagraph (I); or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="id6C1A437CA1F54EF0AD164F808110AD37"><enum>106.</enum><header>Penalties</header><subsection commented="no" id="id5A5017587574480FB834A8BE9F7F3776"><enum>(a)</enum><header>Civil penalties and permit sanctions</header><text display-inline="yes-display-inline">Section 308 (<external-xref legal-doc="usc" parsable-cite="usc/16/1858">16 U.S.C. 1858</external-xref>) is amended—</text><paragraph commented="no" id="id2DD022EA657D448C9927A57EF9CBAAA9"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>$100,000</quote> and inserting <quote>$180,000</quote>; and</text></paragraph><paragraph commented="no" id="id64E12CC4FBE04CFE95FD1E853352E286"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f), by inserting <quote>or investigation of a violation of this Act</quote> after <quote>under this section</quote>.</text></paragraph></subsection><subsection commented="no" id="id286D89F014534665A7310256FD8808E0"><enum>(b)</enum><header>Criminal penalties</header><text display-inline="yes-display-inline">Section 309(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1859">16 U.S.C. 1859(b)</external-xref>) is amended—</text><paragraph commented="no" id="id36B03D963BB943958E3AE9D7D6242395"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>$100,000</quote> and inserting <quote>$180,000</quote>; and</text></paragraph><paragraph commented="no" id="id759EED1253AB4EC18FA2DBF8075FDD6D"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>$200,000</quote> each place it appears and inserting <quote>$360,000</quote>.</text></paragraph></subsection></section><section commented="no" id="id79FD143C989E42BC8AA3F6561BF1B8B6"><enum>107.</enum><header>Enforcement</header><subsection commented="no" id="id96F5D6F948364F718B987DBCE434BF5C"><enum>(a)</enum><header>Jurisdiction of the courts</header><paragraph commented="no" id="id14B646071CB242769ABF25503CDB238F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 311(d) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861(d)</external-xref>) is
			 amended to read as
			 follows:</text><quoted-block display-inline="no-display-inline" id="id4F462CE4B4C54B4A8E7710089C12BD0E" style="OLC"><subsection commented="no" id="id2E619770BEC64620843ABF25926DC747"><enum>(d)</enum><header>Jurisdiction of the courts</header><paragraph commented="no" id="id544B0184257147CB95653945CCA119D9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The district courts of the United States shall have exclusive jurisdiction over any case or
			 controversy arising under the provisions of this Act.	Any such court may,
			 at any time—</text><subparagraph commented="no" id="id122F94913A654EAFBD0E890BA2AE6184"><enum>(A)</enum><text display-inline="yes-display-inline">enter restraining orders or prohibitions;</text></subparagraph><subparagraph commented="no" id="idDBD4DD83196642AC9288B3733EC5FB9D"><enum>(B)</enum><text display-inline="yes-display-inline">issue warrants, process in rem, or other process;</text></subparagraph><subparagraph commented="no" id="idF046CB4BB0A44F4E995F209BAB283549"><enum>(C)</enum><text display-inline="yes-display-inline">prescribe and accept satisfactory bonds or other security; and</text></subparagraph><subparagraph commented="no" id="id9413156150FE4A929E86A50C389C5451"><enum>(D)</enum><text display-inline="yes-display-inline">take such other actions as are in the interest of justice.</text></subparagraph></paragraph><paragraph commented="no" id="idA45504E74460465EB0812E22FBA4C1D7"><enum>(2)</enum><header>Hawaii and Pacific insular areas</header><text display-inline="yes-display-inline">In the case of Hawaii or any possession of the United States in the Pacific Ocean, the appropriate
			 court is the United States District Court for the District of Hawaii,
			 except that—</text><subparagraph commented="no" id="id746C4771DA9146519C7CCF24EC2C774F"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of Guam and Wake Island, the appropriate court is the United States District Court for
			 the District of Guam; and</text></subparagraph><subparagraph commented="no" id="idE23C2DA5DF844C3D99890C876CB153E9"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of the Northern Mariana Islands, the appropriate court is the United States District
			 Court for the District of the Northern Mariana Islands.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idC156DF02809941F3AFE80D2F83876AB9"><enum>(2)</enum><header>Construction</header><text>Nothing in this section, or the amendments made by paragraph (1), shall be construed to affect any
			 case or controversy commenced,      or any case or controversy pending
			 before a district court of the United States, prior to the date of
			 enactment of this Act.</text></paragraph></subsection><subsection commented="no" id="id37B4AFA7C5214F2899F6A4140C311820"><enum>(b)</enum><header>Payment of storage, care, and other costs</header><text display-inline="yes-display-inline">Section 311(e) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861(e)</external-xref>) is
			 amended—</text><paragraph commented="no" id="idD07299FB88034BFD8E4875488C0AC9BB"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" id="idC3CB339FDD80443FA310FBC464BDCFFC"><enum>(A)</enum><text display-inline="yes-display-inline">by striking “Notwithstanding any other provision of law” and inserting <quote><header-in-text level="paragraph" style="OLC">In general</header-in-text>.—Except as otherwise required under section 204(e)(8)</quote>;</text></subparagraph><subparagraph commented="no" id="idD39BAA2577594092A16E41558A1CFA99"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" id="idB4E4ED7083324D52B79FE66D6ED8AB0D"><enum>(C)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="id40E3CCBBFAB5445DAB996E4992F16648"><enum>(D)</enum><text>by adding after subparagraph (F), the following:</text><quoted-block display-inline="no-display-inline" id="idDE1135D27A9B48A9881959FD14812DCD" style="OLC"><subparagraph commented="no" id="id47268ACD20FA4F2AA3838B1E82211FE6"><enum>(G)</enum><text>the costs of stock assessments, surveys, and data collection in fisheries managed under this Act.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id7B3F8A7451C04D59BBD0F4916AF2821D"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3);</text></paragraph><paragraph commented="no" id="id1F34DF59752A4140A5C55D98CE1D4843"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3), as redesignated, by striking <quote>Any person</quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Liability for costs incurred</header-in-text>.—Any person</quote>; and</text></paragraph><paragraph commented="no" id="id7FCC75CE1B71426BBB2004491F1480C5"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="idAFE8019DB02540E1A77BA557DF0C13C8" style="OLC"><paragraph commented="no" id="id687CACDA850D48ADA4671CD0BA701ECE"><enum>(2)</enum><header>Fisheries Enforcement Fund</header><text display-inline="yes-display-inline">There is established in the Treasury a non-interest bearing fund to be known as the Fisheries
			 Enforcement Fund, into which shall be deposited all sums received as
			 described in paragraph (1), which shall remain available to the Secretary
			 until expended as authorized in paragraph (1), without
			 appropriation or fiscal year limitation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="idA7054547DA33458F98FCBF92999D6696"><enum>(c)</enum><header>Administrative adjudication</header><text display-inline="yes-display-inline">Section 311 (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861</external-xref>) is amended—</text><paragraph commented="no" id="idED4A975857864183AAD4D578E96D9716"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through (j) as subsections (e) through (k), respectively; and</text></paragraph><paragraph commented="no" id="idF92E6880FB804BCCBC2DA6B8A181F5EC"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the following:</text><quoted-block display-inline="no-display-inline" id="idE2011D60A0E541839DE7A447B358012D" style="OLC"><subsection commented="no" id="idF0911D9D985D4DB89F071D8176EF1618"><enum>(d)</enum><header>Administrative adjudication</header><paragraph commented="no" id="id479882E45F0E4A6190BE488BE78EBCAE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/559">section 559</external-xref> of title 5, United States Code, with respect to any marine resource
			 conservation law or regulation administered by the Secretary acting
			 through the National Oceanic and Atmospheric Administration, all
			 adjudicatory functions that are required by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United
			 States
			 Code to be performed by an administrative law judge may be performed by
			 another Federal agency on a reimbursable basis.</text></paragraph><paragraph commented="no" id="id62D342F77EBF442A9203DD895B83E0ED"><enum>(2)</enum><header>Details</header><text display-inline="yes-display-inline">If another Federal agency performing adjudicatory functions under paragraph (1) requires the detail
			 of an administrative law judge to perform any of these functions, such
			 Federal agency may
			 request temporary or occasional assistance from the Office of Personnel
			 Management under <external-xref legal-doc="usc" parsable-cite="usc/5/3344">section 3344</external-xref> of title 5,
			 United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id72D4ED586C364697963247F329349194"><enum>(d)</enum><header>Repeals</header><text display-inline="yes-display-inline">Sections 110 and 111 of title I of Division B of the Consolidated and Further Continuing

			 technology, or observer coverage level.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="idA1C62F27D3AB45BAB367C19D250534A9"><enum>(b)</enum><header>Arctic community development quota</header><text display-inline="yes-display-inline">Section 313 (<external-xref legal-doc="usc" parsable-cite="usc/16/1862">16 U.S.C. 1862</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id57A27A93F6A047F9942F751018FAE70E" style="OLC"><subsection commented="no" id="idE356EDCB23D0481B8564F07C355F9C03"><enum>(k)</enum><header>Arctic community development quota</header><text>If the North Pacific Fishery Management Council issues a fishery management plan for the exclusive
			 economic zone in the Arctic Ocean, or an amendment to its current Fishery
			 Management Plan for Fish Resources of the Arctic Management Area, that
			 makes available to commercial fishing and establishes a sustainable
			 harvest level for any part of such zone, the North Pacific Fishery
			 Management Council shall set aside not less than 10 percent of the total
			 allowable catch therein as a community development quota for coastal
			 villages north and east of the Bering Strait.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id21C4C2FAD2DE4B13A8D900C9EAC77C3C"><enum>(c)</enum><header>North Pacific bycatch report</header><text>Section 313 (<external-xref legal-doc="usc" parsable-cite="usc/16/1862">16 U.S.C. 1862</external-xref>), as amended by subsection (b), is further amended by adding after
			 subsection (k) the following:</text><quoted-block display-inline="no-display-inline" id="idAA82D13DEFB64D5B97DD6D0464B49F01" style="OLC"><subsection commented="no" id="idC1926194E53D4FC2BC7923180BDD535C"><enum>(l)</enum><header>North Pacific bycatch report</header><text>Not later than 1 year after the date of enactment of the <short-title>Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2014</short-title>, the Secretary shall submit a report to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Natural Resources of the House of
			 Representatives which examines agency actions since 2007 to reduce bycatch
			 in fisheries of the North Pacific managed under this Act, including a
			 review of regulatory actions that create incentives for individual vessels

			 by the Gulf Council, except that the Gulf Council may delay action for not
			 more than
			 3 additional 1-year periods if necessary.</text></section><section commented="no" id="id4767A79D0A5B4DD89F49808F9752CE63"><enum>313B.<?LEXA-Enum 313B.?></enum><header>South Atlantic Fisheries conservation and management</header><text display-inline="no-display-inline">At least  once every 5 years, the South Atlantic Fishery Management Council shall review, in
			 accordance with the
			 provisions of this Act, any allocation
			 of fishing privileges among the commercial, recreational, and charter
			 components of a fishery managed under a fishery management plan prepared
			 by the South Atlantic Council, except that the South Atlantic Council may
			 delay action for not more than

			 Management Council shall submit to the Secretary of Commerce, and the
			 Secretary of Commerce may approve, a modified fishery management plan or
			 plan amendment for the commercial and recreational management of summer
			 flounder (Paralichthys dentatus) under the Magnuson-Stevens Fishery
			 Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>).  The modified
			 fishery management plan or plan amendment shall—</text><paragraph commented="no" id="id8EC546E82AFB4F049B26327D54CA8F74"><enum>(1)</enum><text display-inline="yes-display-inline">be based on the best scientific information available;</text></paragraph><paragraph commented="no" id="idC4B9FE67C91C45CAAFF478376361291F"><enum>(2)</enum><text display-inline="yes-display-inline">reflect changes in the distribution, abundance, and location of summer flounder in establishing
			 distribution of the commercial and recreational catch quotas;</text></paragraph><paragraph commented="no" id="id35B81D6146284CD88CF646250BF9079C"><enum>(3)</enum><text display-inline="yes-display-inline">consider regional, coast-wide, or other management measures for summer flounder that comply with
			 the National Standards under section 301(a) of the Magnuson-Stevens
			 Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851(a)</external-xref>); and</text></paragraph><paragraph commented="no" id="id711F6170925642AEA05D53422A39BDE0"><enum>(4)</enum><text display-inline="yes-display-inline">prohibit the allocation of commercial or recreational catch quotas for summer flounder on a
			 State-by-State basis using historical landings data that does not reflect
			 the status of the summer flounder stock, based on the most recent
			 scientific information.</text></paragraph></subsection><subsection commented="no" id="idCA42C2D7090C4E9B866BA2851960D6E7"><enum>(b)</enum><header>Consultation with the Commission</header><text display-inline="yes-display-inline">In preparing the modified fishery management plan or plan amendment as described in subsection (a),
			 the Council shall consult with the Atlantic States Marine Fisheries
			 Commission to ensure consistent management throughout the range of the
			 fishery.</text></subsection><subsection commented="no" id="idEF199CDFC68A4953A4BB3C89AC6D7534"><enum>(c)</enum><header>Failure To Submit Plan</header><text display-inline="yes-display-inline">If the Council fails to submit a modified fishery management plan or plan amendment as described in
			 subsection (a) that may be approved by the Secretary, the Secretary shall
			 prepare and approve such a modified plan or plan amendment.</text></subsection><subsection commented="no" id="idA9F2EED957BB481F9B6AA3E4285642FC"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the approval of a modified fishery management plan or plan
			 amendment as described in subsection (a), the Comptroller General of the
			 United States shall submit to the Committee on Commerce, Science, and
			 Transportation of the Senate and the Committee on Natural Resources of the
			 House of Representatives a report on the implementation of the modified
			 plan or plan amendment that includes an assessment of whether the
			 implementation complies with the national standards for fishery
			 conservation and management under section 301(a) of the Magnuson-Stevens
			 Fishery Conservation and Management Act (16 U.S.C.
			 1851(a)).</text></subsection></section><section commented="no" id="id2F59C1F4FEA14E4B91F018100791A0ED"><enum>112.</enum><header>Study of allocations in mixed-use fisheries</header><subsection commented="no" id="id0E8BF8E8FB764EE1961F5E1A34A667F3"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Commerce shall
			 enter into a contract
			 with the National Academy of Sciences to conduct a study—</text><paragraph commented="no" id="id1EBF31B21CD044398D63F900DE5A25B4"><enum>(1)</enum><text display-inline="yes-display-inline">to provide guidance on criteria that could be used for allocating fishing privileges, including
			 consideration of the conservation and socioeconomic
			 benefits of the commercial, recreational, and charter components of a
			 fishery, to a Regional
			 Fishery Management Council established under section 302 of the
			 Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>)
			 in the preparation of a fishery
			 management plan
			 under that Act; and</text></paragraph><paragraph commented="no" id="id609D8C20E1A94BB3ABEB4C58D5FB71C6"><enum>(2)</enum><text display-inline="yes-display-inline">to identify sources of information that could reasonably support the use of such criteria in
			 allocation decisions.</text></paragraph></subsection><subsection commented="no" id="id8BEEEF0489964BEC997AC94487302F46"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date the contract is entered into under subsection (a), the
			 National
			 Academy of Sciences
			 shall submit to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Natural Resources of the House of Representatives a report on
			 the study conducted under subsection (a).</text></subsection></section></title><title id="id243930608E9B4B1AAA2A9AFB610909F9" style="OLC"><enum>II</enum><header>Fishery information, research, and development</header><section commented="no" id="id9E625D7370D34C748E2799C42B18E144"><enum>201.</enum><header>Integrated data collection program and electronic technologies</header><subsection commented="no" id="id9AACB61F95364D53B8868D605556C6DF"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the use of electronic technologies such as digital video cameras
			 and monitors, digital recording systems, and other forms of electronic
			 technology as a complement to, and in some cases a replacement for,
			 observers can maintain, increase, or improve the amount and accuracy of
			 observer and fishery dependent information collected from fisheries while
			 reducing the need for observers and the financial costs and logistical
			 difficulties associated with such observers and paper reporting
			 requirements.</text></subsection><subsection commented="no" id="id368DBC66266D4304B0438CBC4F858DED"><enum>(b)</enum><header>Integrated data collection program assessments</header><paragraph commented="no" id="id4E98E19EEC714926B0DB2E41DB674171"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Regional Fishery Management
			 Councils, in consultation with the Secretary of Commerce, shall assess the
			 fishery dependent data needs of the fisheries in the regions and, if
			 necessary to meet those needs, develop recommendations for an integrated
			 data collection program, including appropriate electronic technologies, to
			 gather and analyze data required for fisheries management.</text></paragraph><paragraph commented="no" id="idF629A67633794C1D8ACB7779B9D554EF"><enum>(2)</enum><header>Elements of assessments</header><text>Each assessment required by this subsection shall—</text><subparagraph commented="no" id="idD643ED8FB4324ADD8AF4EE41D08BA74E"><enum>(A)</enum><text>identify the fisheries with respect to which the incorporation of electronic technology, as a
			 complement to or replacement for observers, and electronic reporting can
			 decrease costs, improve efficiencies and data accuracy, or ease the
			 logistic constraints posed by observers in the fisheries while continuing
			 to meet the standards and requirements of the Magnuson-Stevens Fishery
			 Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" id="id1E509610740144649EE3DADE3E365DD8"><enum>(B)</enum><text>specify for each fishery identified which type or types of electronic technology can achieve such
			 cost and efficiency improvements; and</text></subparagraph><subparagraph commented="no" id="idD105E584FECF413AA53F1D40ABD89BA9"><enum>(C)</enum><text>outline the system, or systems, of fees required in subsection (c)(3) to support the integrated
			 data
			 collection program.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id51EE80F6A1D548F9812198E025000FE3"><enum>(c)</enum><header>Regional integrated data collection program adoption plans</header><paragraph commented="no" id="id8D59DF7D87E349D0BC70523039693E68"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after receiving the results of the assessments required under subsection (b),
			 the Secretary of Commerce, in consultation with the relevant Regional
			 Fishery Management Council,  shall review the relevant assessment for
			 compliance with provisions of this section and shall develop a plan to
			 adopt and implement, with any changes needed based on the compliance
			 review, an integrated data collection program, including the use of
			 electronic technologies, in each of the fisheries identified in the
			 assessment.</text></paragraph><paragraph commented="no" id="id3B0B062AE0FB4DB197A22E57B5F02D23"><enum>(2)</enum><header>Elements of plans</header><text>Each plan developed under this subsection—</text><subparagraph commented="no" id="idB475744E16A642BAB9E49CF16A504FE4"><enum>(A)</enum><text>shall have fishery dependent data collection as its principal purpose;</text></subparagraph><subparagraph commented="no" id="idBE89EAE436AE4E468C42D1F8911A0C0D"><enum>(B)</enum><text>shall include electronic technologies consistent with the assessment required by subsection (b)
			 and the review required by paragraph (1);</text></subparagraph><subparagraph commented="no" id="idFEA26FAFC58F48248EAB16116ACBF8B2"><enum>(C)</enum><text>shall include an estimate of anticipated improvements in cost effectiveness, accuracy of
			 information, and management efficiency for each fishery in the plan;</text></subparagraph><subparagraph commented="no" id="id00041053082F4DA3A2EA3B5B7455EEB9"><enum>(D)</enum><text>shall include an explanation of why the most cost-effective approach is not being used, if
			 applicable;</text></subparagraph><subparagraph commented="no" id="id8B9EBF5001A54DF7B1F0F3741F152383"><enum>(E)</enum><text>shall prioritize fishery management plans in each region, to guide development, adoption, and
			 implementation of integrated data collection amendments to such plans;</text></subparagraph><subparagraph commented="no" id="idA20513B21F1C4B08AA68F192AEAC501B"><enum>(F)</enum><text>shall set forth an implementation schedule, consistent with the implementation deadline specified
			 in subsection (d), for the development, review, adoption, and
			 implementation of integrated data collection program amendments to fishery
			 management plans; and</text></subparagraph><subparagraph commented="no" id="id7DA04BCCB98D43099EF7CC3E4B1B6214"><enum>(G)</enum><text>may be reviewed or amended annually to address changing circumstances or improvements in
			 technology.</text></subparagraph></paragraph><paragraph commented="no" id="id6C53219189FE4FE9840634073EC6E804"><enum>(3)</enum><header>Integrated data collection program fees</header><text>The Secretary of Commerce shall establish a system, or systems, of fees, which may vary by fishery,
			 management area, or observer coverage level, to pay for the cost of
			 implementing each relevant integrated data collection program implemented
			 under this subsection.</text></paragraph><paragraph commented="no" id="idDF2C3072C5E74C4EA3FE66B356F995D2"><enum>(4)</enum><header>Council action</header><text>Not later than 4 years after the date of enactment of this Act, each Regional Fishery Management
			 Council shall amend its fishery management plans as necessary to comply
			 with this subsection.</text></paragraph></subsection><subsection commented="no" id="idA0CFD9693BF34B6E8A726AD3414D5E8D"><enum>(d)</enum><header>Deadline for implementation</header><text>Not later than 5 years after the date of enactment of this Act, the Regional Fishery Management
			 Councils and the Secretary of Commerce shall complete implementation of
			 the plans developed under subsection (c), subject to available
			 appropriations.</text></subsection><subsection commented="no" id="idCB7E14DA05704BABA1A8E0AA438EEEE0"><enum>(e)</enum><header>Reviews</header><text>The relevant Regional Fishery Management Council shall determine a time period for regular review

			 holding pending processing, distribution after processing, or holding
			 pending distribution, of fish from a fishery;</text></subclause><subclause commented="no" id="id67A1A84E0FAC4C719FBF9335DE74C1AF"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance described in subclause (I); and</text></subclause><subclause commented="no" id="idC7505A905FBD4343A90C9FE44F18F33A"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance that is necessary to perform a
			 function described in subclause (I);</text></subclause></clause><clause commented="no" id="id39EF0036DCCB49D8BD70BBAA37439B2F"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used
			 for, or of a type normally used for, processing fish; or</text></clause><clause commented="no" id="id1754E27334EF49DCBE88D03984F4C0FD"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text><subclause commented="no" id="id223C221896294788B76C1F09D18BAFB0"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text></subclause><subclause commented="no" id="idAE4130A5A6EF4526A01855293CF61DB5"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text></subclause><subclause commented="no" id="idB24EC568C9194ADBAB8BEBA29C5226EC"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and that is necessary to perform a
			 function described in subclause (I); and</text></subclause><subclause commented="no" id="idACAC480F1633446194E531EBFAEC88D9"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States and used for, equipped to be used for, or of a type normally
			 used for, aquaculture.</text></subclause></clause></subparagraph><subparagraph commented="no" id="idBFB4C22DD9AA44719418B332163678BC"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text><clause commented="no" id="idAE0BA7B0ED604A5EA3DD7DE428E2DBC3"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text></clause><clause commented="no" id="id248C3A9AA0B24E9F843942588B7E1DA8"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that is—</text><subclause commented="no" id="idB943EBD9CFF44FCFBAF4B457F30A8836"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501 of this title; and</text></subclause><subclause commented="no" id="idB7A41B666F6E42C6AB3177F572253207"><enum>(II)</enum><text display-inline="yes-display-inline">at least 75 percent owned by citizens of the United States, as determined under section 50501 of
			 this title.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idFC8508EF893E4F64A417DC6BFF1F97EC"><enum>(8)</enum><text display-inline="yes-display-inline">by inserting after paragraph (6), as redesignated, the following:</text><quoted-block display-inline="no-display-inline" id="id77B478D4B4584BA38D557120A8BDD214" style="OLC"><paragraph commented="no" id="id0D64CB94A80D4080B918574B64863B42"><enum>(7)</enum><header>Qualified fishery facility</header><subparagraph commented="no" id="idC5536CFE5B52413CAD44967FF5CC2776"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term <term>qualified fishery facility</term> means—</text><clause commented="no" id="id52804E2E898D4860B78C83DD02B024F2"><enum>(i)</enum><text display-inline="yes-display-inline">for operations on land—</text><subclause commented="no" id="id85447A9904BD46DF88C23D02F921A7FF"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for unloading and receiving from a vessel,
			 processing,

			 described in subclause (I);</text></subclause></clause><clause commented="no" id="id33C974E053BA446FA5FFDA28A8AA167E"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used
			 for, or of a type normally used for, processing fish; or</text></clause><clause commented="no" id="idD7EC48F522094D6F8C4430548B6789A3"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text><subclause commented="no" id="idCADB6E8EE44D4AE5A3D93662B9AE840B"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text></subclause><subclause commented="no" id="id1DB49839CC564C36ACE1439CB3D4D43F"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text></subclause><subclause commented="no" id="id97E19C4A3BC2489C8A739C97DE1B9D6B"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and necessary for performing a
			 function described in subclause (I); and</text></subclause><subclause commented="no" id="id142FBB886B1C44A7994C2850CEFD8771"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id3E0A13C718C14E67A8E781796468A1FF"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text><clause commented="no" id="id0B2203054A1744EE9FF157BC7DC0C73C"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text></clause><clause commented="no" id="idEC92863B93AC4F17AC31C9AA0CB48472"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that is—</text><subclause commented="no" id="id41D2447B6DCC4752A5E9BF3DF287AA19"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501 of this title; and</text></subclause><subclause commented="no" id="id651F5F71554944DB87F91FFFE940EC2E"><enum>(II)</enum><text display-inline="yes-display-inline">at least 75 percent owned by citizens of the United States, as determined under section 50501 of

					<quoted-block id="H4AD524BB85B64F26BDDA2C6A6BFAD829" style="OLC">
						<subsection id="H4F0452CC55BF47A59758376CCD2D2163"><enum>(e)</enum><header>Stock assessment
				plan</header>
							<paragraph id="H8767DE61FF464A64AA154F0B9702F3ED"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Councils, shall
				develop and publish in the Federal Register, on the same schedule
			 as required
				for the strategic plan required under subsection (b), a
			 plan to
				conduct stock assessments for all stocks of fish for which a
			 fishery management
				plan is in effect under this Act.</text>
							</paragraph><paragraph id="HFCFBA0870A01412E8EED125398CCA65D"><enum>(2)</enum><header>Contents</header><text>The
				plan shall—</text>
								<subparagraph id="HD7788E4F208C40EAB64169DB89A7AE85"><enum>(A)</enum><text display-inline="yes-display-inline">for each stock of fish for which a stock
				assessment has previously been conducted—</text>
									<clause id="HC257274A6D1F46C3B0FCD9559BD2C88F"><enum>(i)</enum><text>establish a
				schedule for updating the stock assessment that is reasonable given
			 the biology
				and characteristics of the stock; and</text>
									</clause><clause id="H7C99553148C84CAAAD993CC88F70399A"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of
				appropriations, require completion of a new stock assessment, or an
			 update of
				the most recent stock assessment—</text>
										<subclause id="HF2FB9DF66A5B4FF3BBF1672A4F4A338B"><enum>(I)</enum><text>at least once every 5 years, except a Council may delay action for not more than 3 additional
			 1-year periods;
				or</text>
										</subclause><subclause id="H239D76DBF8E646249E563A79A2E4B84C"><enum>(II)</enum><text>within such other
				time period specified and justified by the Secretary in the plan;</text>
										</subclause></clause></subparagraph><subparagraph id="HB78CCD0C0FCD4942BE6FC7F3011C8E05"><enum>(B)</enum><text>for each economically important stock of
				fish for which a stock assessment has not previously been
			 conducted—</text>
									<clause id="H3C771C84948543AC99A5AD838AC143D7"><enum>(i)</enum><text>establish a
				schedule for conducting an initial stock assessment that is
			 reasonable given
				the biology and characteristics of the stock; and</text>
									</clause><clause commented="no" id="HEF5D2344936A4739BAEE3200051CDFDF"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of
				appropriations, require completion of the initial stock assessment
			 not later than 3
				years after the date that the plan is published in the Federal
			 Register unless
			 another time
				period is specified and justified by the Secretary in the plan; and</text>
									</clause></subparagraph><subparagraph id="H930C0D131EA34E2FA13319E7C855323C"><enum>(C)</enum><text display-inline="yes-display-inline">identify data and analysis, especially
				concerning recreational fishing, that, if available, would reduce
			 uncertainty
				in and improve the accuracy of future stock assessments, including
			 whether that
				data and analysis could be provided by nongovernmental sources,
			 including
				fishermen, fishing communities, universities, and research
			 institutions.</text>
								</subparagraph></paragraph><paragraph id="HC13AB7CBF91E4E45A00A3C8A98594E8E"><enum>(3)</enum><header>Waiver of stock
				assessment requirement</header><text>Notwithstanding subparagraphs (A)(ii) and
				(B)(ii) of paragraph (2), a stock assessment shall not be required
			 for a stock of fish in
			 the plan if
				the Secretary determines that such a stock assessment is not
			 necessary and
				justifies the determination in the Federal Register notice
			 required by this
				subsection.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H471916658F674116B945C78115B4544C"><enum>(b)</enum><header>Deadline</header><text>Notwithstanding
			 subsection (e)(1) of section 404 of the Magnuson-Stevens Fishery
			 Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c(e)(1)</external-xref>), as added by this
			 section,
			 the
			 Secretary of Commerce shall issue the first stock assessment plan under
			 that
			 subsection not later than 1 year after the date of enactment of this
			 Act.</text></subsection><subsection id="idABCF19B184434267854762C708FBF899"><enum>(c)</enum><header>Strategic plan</header><text>Section 404(b)(5) (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c(b)(5)</external-xref>) is amended by striking <quote>and affected States, and provide for coordination with the Councils, affected States, and other
			 research entities</quote> and inserting <quote>, affected States, and tribal governments, and provide for coordination with the Councils, affected
			 States, tribal governments, and other research entities</quote>.</text></subsection></section><section id="HD595E54C2A234D98B1064DB87B127CB2"><enum>204.</enum><header>Improving
			 science</header>
				<subsection id="HCF922BDFBFDD473CA1012308C88A17C5"><enum>(a)</enum><header>Improving data
			 collection and analysis</header>
					<paragraph id="H71F55D7F19534448A338D4788E21BD34"><enum>(1)</enum><header>In
			 general</header><text>Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>), as amended by section 203 of this Act, is further
			 amended by adding at the end the following:</text>
						<quoted-block id="HB7B72F59F08C4CA29344D1EC907970F8" style="OLC">
							<subsection id="H5DDEBB11F77E4767A5B4F0A7A01B7FEE"><enum>(f)</enum><header>Improving data
				collection and analysis</header>
								<paragraph id="HBDA8FA4796B74DF0A7D3FA8CD12F6DC1"><enum>(1)</enum><header>In
				general</header><text>The Secretary, in consultation with the scientific and
				statistical committees of the Councils established under section
			 302(g), shall
				develop and submit to the Committee on Commerce, Science, and
			 Transportation of the Senate and the Committee on Natural Resources of the
			 House of Representatives a report on
			 facilitating
				greater incorporation of data, analysis, stock assessments, and
			 surveys from
				nongovernmental sources, including fishermen, fishing communities,
				universities, and research institutions, into fisheries management
				decisions.</text>
								</paragraph><paragraph id="HC143EA7C67E141EDA4D365AACE768F00"><enum>(2)</enum><header>Content</header><text>The
				report under paragraph (1) shall—</text>
									<subparagraph id="H4E281FEC62A74C4C92AAE173FA1C1B43"><enum>(A)</enum><text display-inline="yes-display-inline">identify types of data and analysis,
				especially concerning recreational fishing, that can be reliably
			 used for purposes of this Act and
			 the basis
				for establishing conservation and management measures as required
			 by section
				303(a)(1), including setting standards for the collection and use
			 of that data
				and analysis in stock assessments and surveys and for other
			 purposes;</text>
									</subparagraph><subparagraph id="HAE07E4DCC1934A36939F2797474E7324"><enum>(B)</enum><text>provide specific
				recommendations for collecting data and performing analyses
			 identified as
			 necessary to
				reduce the uncertainty referred to in section 404(e)(2)(C);</text>
									</subparagraph><subparagraph id="H5E287C3A18424D4EAF7DEC78A8213EE1"><enum>(C)</enum><text>consider the extent to which it is possible to establish a
				registry of persons providing such information; and</text>
									</subparagraph><subparagraph id="id71C615ACE58E439A8738C37456C8107E"><enum>(D)</enum><text>consider the extent to which the acceptance and use of data and analysis identified in the report
			 in fishery management decisions is practicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HA53024A10EE84C35A4E9EA4F5D589CDB"><enum>(b)</enum><header>Deadline</header><text>The
			 Secretary of Commerce shall submit the report required under the
			 amendment
			 made by subsection (a) not later than 1 year after the date of
			 enactment of
			 this Act.</text>
				</subsection><subsection commented="no" id="idA26C9AD4C1364AAA948E8DF87239783D"><enum>(c)</enum><header>Information collection; contracting authority</header><text>Section 402 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881a">16 U.S.C. 1881a</external-xref>) is amended—</text><paragraph commented="no" id="idA10DFC8C413944E4B1C1214A94404A13"><enum>(1)</enum><text>in subsection (b)(1)(H), by striking <quote>including</quote> and all that follows through the end and inserting <quote>including the Coast Guard's 11 statutory missions under section 888(a) of the Homeland Security
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/468">6 U.S.C. 468(a)</external-xref>).</quote>; and</text></paragraph><paragraph commented="no" id="id5ABF442786F84FCAB6820FB7F3BECDAB"><enum>(2)</enum><text>in subsection (d), by inserting <quote>tribal government,</quote> before <quote>Council</quote> each place it appears.</text></paragraph></subsection></section><section id="id60FA468357B8424ABDCE5680767EF611"><enum>205.</enum><header>Focusing assets for improved fisheries outcomes</header><subsection id="idA3AD3AB7009A4044A4B0521CC1855C72"><enum>(a)</enum><header>In general</header><text>Section 2(b) of the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/713c-3">15 U.S.C. 713c–3(b)</external-xref>), is amended—</text><paragraph id="id27DC7FD6606745929670F57F4CFC44A4"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id5A079B8459AB4CB48B830A730BF321BF"><enum>(A)</enum><text>by striking <quote>beginning with the fiscal year commencing July 1, 1954, and ending on June 30, 1957,</quote>;</text></subparagraph><subparagraph id="id4A182AA834E44C62B42318EB35678D3A"><enum>(B)</enum><text>by striking <quote>moneys</quote> the first place that term appears and inserting <quote>monies</quote>; and</text></subparagraph><subparagraph id="id2EAE1B0E234B4FD1A6E6621184F7E304"><enum>(C)</enum><text>by striking <quote>shall be maintained in a separate fund only for</quote> and all that follows through the end and inserting <quote>shall only be used for the purposes described under subsection (c).</quote>; and</text></subparagraph></paragraph><paragraph id="id5E5D08BFE15549EEB79500DF7A39C492"><enum>(2)</enum><text>by striking paragraph (2).</text></paragraph></subsection><subsection id="id6BF3997BD2224EEBAF83DFB994B627E1"><enum>(b)</enum><header>Limitations on bills transferring funds</header><text>Section 2(b) of the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/713c-3">15 U.S.C. 713c–3(b)</external-xref>), as amended by subsection (a) of
			 this section, is further amended by adding at the end the following:</text><quoted-block act-name="" id="idC7CD7044125348F08A5099A1E65D3DE9" style="OLC"><paragraph id="id471525484295467FBE7D47A39D4410DC"><enum>(2)</enum><header>Limitations on bills transferring funds</header><subparagraph id="idAACC590B862243B6A02AC141AB732A15"><enum>(A)</enum><header>In general</header><text>It shall not be in order in the Senate or the House of Representatives to consider any bill,
			 resolution, amendment, or conference report that reduces any amount in the
			 fund referred to in paragraph (1) in a manner that is inconsistent with
			 such paragraph.</text></subparagraph><subparagraph id="idD5594E0BC8844371946C44DA6D5090C4"><enum>(B)</enum><header>Limitation on changes to this paragraph</header><text>It shall not be in order in the Senate or the House of Representatives to consider any bill,
			 resolution, amendment, or conference report that would repeal or otherwise
			 amend this paragraph.</text></subparagraph><subparagraph id="id3CABF4E2910A4619A67C079CC7045B7F"><enum>(C)</enum><header>Waiver</header><text>A provision of this paragraph may be waived or suspended in the Senate only by the affirmative vote
			 of three-fifths of the Members, duly chosen and sworn.</text></subparagraph><subparagraph id="id4DE50F8922F14281AEC5881193819ADB"><enum>(D)</enum><header>Appeals</header><text>An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be
			 required to sustain an appeal of the ruling of the Chair on the point of
			 order raised under this paragraph.</text></subparagraph><subparagraph id="idD26F3A90A3CE48ADAF594B04CFCB689C"><enum>(E)</enum><header>Rules of the Senate and the House of Representatives</header><text>This paragraph is enacted by Congress—</text><clause id="id4B69972C602E4505B38F8CBCB1FBB342"><enum>(i)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives,
			 respectively, and is deemed to be part of the rules of each house,
			 respectively, but applicable only with respect to the procedure to be
			 followed in the House in the case of a bill, resolution, amendment, or
			 conference report under this paragraph, and it supersedes other rules only
			 to the extent that it is inconsistent with such rules; and</text></clause><clause id="idC923C5CFBAC5458690D58723DA120849"><enum>(ii)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as
			 they relate to the procedure of that House) at any time, in the same
			 manner, and to the same extent as in the case of any other rule of that
			 House.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6817B566012145FA8120F125D3383757"><enum>206.</enum><header>Seafood marketing</header><subsection id="id5A54CC3D065A440C866055A8FFD6FA3B"><enum>(a)</enum><header>In general</header><text>The Secretary of Commerce shall analyze the likely costs and benefits of establishing and
			 administering a seafood marketing program to facilitate fuller realization
			 of the commercial and economic value of U.S. fishery resources.</text></subsection><subsection id="id47FE87FAC517462DAF41E01015405922"><enum>(b)</enum><header>Scope</header><text>In performing the analysis required by subsection (a), the Secretary shall consider—</text><paragraph id="id23FE9A7802724DA69AA90073F3E334B4"><enum>(1)</enum><text>the impacts of additional investment in seafood marketing for seafood harvesters, processors,
			 growers, and other persons in the United States on—</text><subparagraph id="id840E59679FFA4653BD2E80451640B56F"><enum>(A)</enum><text>domestic and international markets for U.S. seafood and the competitive position of the
			 United States in those markets;</text></subparagraph><subparagraph id="id903EFEA4F5334C138676E597826AACA7"><enum>(B)</enum><text>sustainable development and utilization of fishery resources of the United States resulting from
			 promotion, public education, and changes in markets;</text></subparagraph><subparagraph id="idB12A5AE757D945A3BEF083A03B2607B9"><enum>(C)</enum><text>the
			 ability of seafood harvesters, processors, growers and other persons in
			 the United States to
			 improve—</text><clause id="id97F27940A4AE4A9CB807A6C48B0BDE89"><enum>(i)</enum><text>the safety, traceability, quality, marketability, and sustainability of U.S. seafood; and</text></clause><clause id="idD29B14BC57394D8DA0C123F5982F3DD2"><enum>(ii)</enum><text>the coordination of their marketing activities; and</text></clause></subparagraph><subparagraph id="id26BD57404F7141CAA823FA3A2650D154"><enum>(D)</enum><text>education of consumers regarding nutritional and health benefits of seafood;	and</text></subparagraph></paragraph><paragraph id="id08AE834624754DF1881E3A1EBCF0146E"><enum>(2)</enum><text>the feasibility of a seafood marketing program that—</text><subparagraph id="id972CDDA15C914A0B9522D19D6E0D6269"><enum>(A)</enum><text>is funded by—</text><clause id="idE9B9814CEF5B4349848084EE9DA155C5"><enum>(i)</enum><text>industry fees;</text></clause><clause id="idDDF86DFE83314FF5B58FCF509FA4E2A5"><enum>(ii)</enum><text>contributions, donations, or gifts by private or nonprofit organizations;</text></clause><clause id="id5FECAE97BDC24207ABB17C835643FC21"><enum>(iii)</enum><text>sums received as fines, penalties, or forfeitures of property for violations of the
			 Magnuson-Stevens Fishery Conservation and Management
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>) or any other
			 marine resource law enforced by the Secretary of Commerce, including the
			 Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371 et seq.</external-xref>);</text></clause><clause id="idFB76B19DB23748998BC422A7A1AFC001"><enum>(iv)</enum><text>interest generated by the investment of amounts described in clauses (i) through (iii); or</text></clause><clause id="idA66308E3DDEE4E42BDFF59395A709CC0"><enum>(v)</enum><text>any combination of the amounts described in clauses (i) through (iv); and</text></clause></subparagraph><subparagraph id="id8F4458E6B21A4828959698B0AFB8D3DC"><enum>(B)</enum><text>apportions funds annually, on a formula basis, to each State, territory, or possession of the
			 United States that is represented on a Regional Fishery Management Council
			 under section 302(a)(1) of the Magnuson-Stevens Fishery Conservation and
			 Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(a)(1)</external-xref>), to award grants through a
			 competitive
			 process to U.S. seafood growers, harvesters, processors, and
			 other persons.</text></subparagraph></paragraph></subsection><subsection id="idA7D53628665A4783AA97B9D6E135BE69"><enum>(c)</enum><header>Deadline for submission</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Commerce shall
			 provide the analysis under this section, together with any
			 recommendations the Secretary considers appropriate, in writing to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Natural Resources of the House of Representatives.</text>
				</subsection></section></title><title id="id407E6971683547C09D4E4934FA3DA1DB" style="OLC"><enum>III</enum><header>Reauthorization of other fishery statutes</header><section id="idA4820845198F4BE5B39446E5936445BE"><enum>301.</enum><header>Anadromous Fish Conservation Act</header><text display-inline="no-display-inline">Section 4 of the Anadromous Fish Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/757d">16 U.S.C. 757d</external-xref>) is amended by striking <quote>2007 through 2012</quote> and inserting <quote>2015 through 2021</quote>.</text></section><section id="id67CA91CCF0F64D34B727DC4914C53721"><enum>302.</enum><header>Interjurisdictional Fisheries Act of 1986</header><text display-inline="no-display-inline">Section 308 of the Interjurisdictional Fisheries Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4107">16 U.S.C. 4107</external-xref>) is amended—</text><paragraph id="idD9BCAF3A87A445D4913EA367AC7AB3C2"><enum>(1)</enum><text>in subsection (a), by striking <quote>$5,000,000</quote> and all that follows through the end and inserting <quote>$5,000,000 for each of fiscal years 2015 through 2021.</quote>; and</text></paragraph><paragraph id="idFDDBB12C9555481FAFFADE89D2C67A4B"><enum>(2)</enum><text>in subsection (c), by striking <quote>$900,000 for each of fiscal years 2007 through 2012</quote> and inserting <quote>$1,000,000 for each of fiscal years 2015 through 2021</quote>.</text></paragraph></section><section id="id07ADA551138C4393A3007D91E87AD5FC"><enum>303.</enum><header>Atlantic Coastal Fisheries Cooperative	Management Act</header><text display-inline="no-display-inline">Section 811(a) of the Atlantic Coastal Fisheries Cooperative Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/5108">16 U.S.C. 5108(a)</external-xref>) is

			 striking <quote>2007, 2008, 2009, 2010, 2011</quote> and inserting <quote>2015 through 2021</quote>.</text></section><section id="id162965E159AC4623B66F34F334D0E0AA"><enum>305.</enum><header>Yukon River Salmon Act of 2000</header><text display-inline="no-display-inline">Section 208 of the Yukon River Salmon Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/5727">16 U.S.C. 5727</external-xref>) is amended by striking <quote>fiscal years 2007 through 2011</quote> and inserting <quote>fiscal years 2015 through 2021</quote>.</text></section><section commented="no" id="idE344548F27C34A408F39E4B3136F298F"><enum>306.</enum><header>State authority for Dungeness crab fishery management</header><text display-inline="no-display-inline">Section 203 of <external-xref legal-doc="public-law" parsable-cite="pl/105/384">Public Law 105–384</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1856">16 U.S.C. 1856</external-xref> note) is amended—</text><paragraph commented="no" id="id5253864F24E54CF6A277211D4C0A0745"><enum>(1)</enum><text>by striking subsection (i); and</text></paragraph><paragraph commented="no" id="id0027BED0E5534085B37FECA5AB77D007"><enum>(2)</enum><text>by redesignating subsection (j) as subsection (i).</text></paragraph></section></title><title id="idC59114E55074491CBDEB7B0F14CACA9E" style="OLC"><enum>IV</enum><header>International conservation and management</header><section id="idB898F1A665ED48D4B2B07245D4498631"><enum>401.</enum><header>Secretarial representative for international fisheries</header><subsection id="id7A61CEC2D8344F6186B4B22190E35FF8"><enum>(a)</enum><header>In general</header><text>Title II (<external-xref legal-doc="usc" parsable-cite="usc/16/1821">16 U.S.C. 1821 et seq.</external-xref>) is amended by inserting after section 202 the
			 following:</text><quoted-block display-inline="no-display-inline" id="id081828A71B784640B4242F49D30E4526" style="OLC"><section id="idA44F0F0098DD45B3A8D362239FBD7F91"><enum>202A.<?LEXA-Enum 202A.?></enum><header>Secretarial representative for international fisheries</header><subsection id="idAEFF7CC4EA974ECDAF08E1576F394FA4"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Under Secretary of Commerce for Oceans and Atmosphere,
			 shall designate a senior official who is appointed by the President, by
			 and with the advice and consent of the Senate, to serve as the Secretarial
			 Representative for International Fisheries for the purpose of performing
			 the duties of the Secretary with respect to international agreements
			 involving fisheries and other living marine resources, including the
			 development of policy and representation of the United States as a
			 Commissioner under such international agreements.</text></subsection><subsection id="id48BC999F05554E91B618F13A40FFEDBF"><enum>(b)</enum><header>Advice</header><text>The Secretarial Representative for International Fisheries shall, in consultation with the Deputy
			 Assistant Secretary for International Affairs and the Administrator of the
			 National Marine Fisheries Service, advise the Secretary, Undersecretary of
			 Commerce for Oceans and Atmosphere, and other senior officials of the
			 Department of Commerce and the National Oceanic and Atmospheric
			 Administration on development of policy on international fishery
			 conservation and management matters.</text></subsection><subsection id="idBD7E2056D7924E6FA20FE6B8B2446608"><enum>(c)</enum><header>Consultation</header><text>The Secretarial Representative for International Fisheries shall consult with the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Natural Resources of the House of Representatives on matters pertaining
			 to any regional or international negotiation concerning living marine
