<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>2d Session</session><legis-num>S. 2952</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20141120">November 20, 2014</action-date><action-desc><sponsor name-id="S229">Mrs. Murray</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Commission on Evidence-Based Policymaking, and for other purposes.</official-title></form><legis-body id="HEF1AD700DADA4CF4BFD4439BDF88B0CC" style="OLC"><section id="HAC322F31514F4E1C876D906D1128C001" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Evidence-Based Policymaking Commission Act of 2014</short-title></quote>.</text></section><section id="HDEBC166AD83848B28A22F324684C0262"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established in the executive branch a commission to be known as the <quote>Commission on Evidence-Based Policymaking</quote> (in this Act referred to as the <quote>Commission</quote>).</text></section><section id="HD3BEC3ABE43A4198AB160DA21B01520C"><enum>3.</enum><header>Members of the Commission</header><subsection id="H30353B9805B348A1A6B4B941D1EE57FD"><enum>(a)</enum><header>Number and appointment</header><text>The Commission shall be comprised of 15 members as follows:</text><paragraph commented="no" id="HDAFD16E229714B6D9EA9F5A65AE9A337"><enum>(1)</enum><text display-inline="yes-display-inline">Three shall be appointed by the President, of whom—</text><subparagraph id="H142C1F4DE0274C01AF6399F757BC1A8C"><enum>(A)</enum><text>1 shall be an academic researcher, data expert, or have experience in program administration;</text></subparagraph><subparagraph id="H2EB72BB5AB8E40B1A9C51FFF0427E172"><enum>(B)</enum><text>1 shall have expertise in database management, confidentiality, and privacy matters; and</text></subparagraph><subparagraph id="H64B88C229A08450A9B2288D1E099A53A"><enum>(C)</enum><text>1 shall be the Director of the Office of Management and Budget (or the Director’s designee).</text></subparagraph></paragraph><paragraph commented="no" id="HBC9A61A4D9C44FB89E568162A8C5C7E2"><enum>(2)</enum><text display-inline="yes-display-inline">Three shall be appointed by the Speaker of the House of Representatives, of whom—</text><subparagraph commented="no" id="idCCDBF7136C854C449326776382F469FB"><enum>(A)</enum><text display-inline="yes-display-inline">2 shall be academic
			 researchers, data experts, or have experience in program administration;
			 and</text></subparagraph><subparagraph commented="no" id="id456F341058DE47AE94F9B235C418B004"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall have expertise in database management, confidentiality, and
			 privacy matters.</text></subparagraph></paragraph><paragraph commented="no" id="H9AF23D85A61A4E2FAB0B8D5C5AD54340"><enum>(3)</enum><text display-inline="yes-display-inline">Three shall be appointed by the Minority Leader of the House of Representatives, of whom—</text><subparagraph commented="no" id="id4A43E0185EA44B10A6F93D994BDF7FF5"><enum>(A)</enum><text display-inline="yes-display-inline">2 shall be
			 academic researchers, data experts, or have experience in program
			 administration; and</text></subparagraph><subparagraph commented="no" id="id63CEF899A62F450396ACAE6DEA9E7CEB"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall have expertise in database management,
			 confidentiality, and privacy matters.</text></subparagraph></paragraph><paragraph commented="no" id="H970E1C087FD247AE93F03D7F9AADF148"><enum>(4)</enum><text display-inline="yes-display-inline">Three shall be appointed by the Majority Leader of the Senate, of whom—</text><subparagraph commented="no" id="id8AB1883E9BD74DB497E8F8D920B7007C"><enum>(A)</enum><text display-inline="yes-display-inline">2 shall be academic researchers,
			 data experts, or have experience in program administration; and</text></subparagraph><subparagraph commented="no" id="idD27853D2CAF5417BA0FD8D0E0CB67D93"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall
			 have expertise in database management, confidentiality, and privacy
			 matters.</text></subparagraph></paragraph><paragraph commented="no" id="H32572D793AE7402EAD44747D79DD8122"><enum>(5)</enum><text display-inline="yes-display-inline">Three shall be appointed by the Minority Leader of the Senate, of whom—</text><subparagraph commented="no" id="id0A7D3BDCE3A2482B96ACDA5BF0E86BE1"><enum>(A)</enum><text display-inline="yes-display-inline">2 shall be academic researchers,
			 data experts, or have experience in program administration; and</text></subparagraph><subparagraph commented="no" id="id514BC962531E4F9F9EAB06E0BBE43853"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall
			 have expertise in database management, confidentiality, and privacy
			 matters.</text></subparagraph></paragraph></subsection><subsection id="H255F9595049E4258909837F74E4D5E3E"><enum>(b)</enum><header>Expertise</header><text>In making appointments under this section, consideration should be given to individuals with
			 expertise in economics, statistics, program evaluation, data security,
			 confidentiality, or database management.</text></subsection><subsection id="H4ECB5C01D67F45E590CBF9B853F87A95"><enum>(c)</enum><header>Chairperson and Co-Chairperson</header><text>The President shall select the chairperson of the Commission and the Speaker of the House of
			 Representatives shall select the co-chairperson.</text></subsection><subsection id="H7AC324B31175434487155CB328C8F9ED"><enum>(d)</enum><header>Timing of appointments</header><text>Appointments to the Commission shall be made not later than 45 days after the date of enactment of
			 this Act.</text></subsection><subsection id="HF968B3702BE94EF282423544BCE8E533"><enum>(e)</enum><header>Terms; vacancies</header><text>Each member shall be appointed for the duration of the Commission. Any vacancy in the
		Commission shall not affect its powers, and shall be filled in the manner in which
			 the original appointment was made.</text></subsection><subsection id="HCAFA179FE7A54924BE5AA7AAB4C881DD"><enum>(f)</enum><header>Compensation</header><text>Members of the Commission shall serve without pay.</text></subsection><subsection id="H3EE23DCDAE1E47D3A2D0AF6DA098EFC8"><enum>(g)</enum><header>Travel expenses</header><text>Each member of the Commission shall be allowed travel
		expenses, including per diem in lieu of subsistence, at rates authorized for
		employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United
		States Code, while away from their homes or regular places of business in the
		performance of services for the Commission.</text></subsection></section><section id="H76B734E6549543D6A6C9498AAD936DF0"><enum>4.</enum><header>Duties of the Commission</header><subsection id="H5E11178E228F4249BBB47029F6F9D076"><enum>(a)</enum><header>Study of data</header><text display-inline="yes-display-inline">The Commission shall conduct a comprehensive study of the data inventory, data infrastructure, and
			 statistical protocols related to Federal policymaking and the statistical
			 and programmatic agencies responsible for maintaining that data to—</text><paragraph id="H6CC46A8178B24F1799BF6414FBAA1471"><enum>(1)</enum><text>determine the optimal arrangement for which administrative data on Federal programs and tax
			 expenditures and related data series may be integrated and made available
			 to facilitate program evaluation, policy-relevant research, and
			 cost-benefit analyses by qualified researchers and institutions;</text></paragraph><paragraph id="H07608F19634F4EB49C757F04566D8D25"><enum>(2)</enum><text>make recommendations on how data infrastructure and protocols should be modified to
			 best fulfill the objectives identified in paragraph (1); and</text></paragraph><paragraph id="HC58F39D53BAA4C9581814B28F80E2D6C"><enum>(3)</enum><text display-inline="yes-display-inline">make recommendations on how best to incorporate outcomes measurement, institutionalize randomized
			 controlled trials, and rigorous impact analysis into program design.</text></paragraph></subsection><subsection commented="no" id="HC7922BA416BB4A2CB868489DEFAD8B19"><enum>(b)</enum><header>Clearinghouse</header><text display-inline="yes-display-inline">In undertaking the study required by subsection (a), the Commission shall consider if and how to
			 create a clearinghouse for program and survey data, which shall include
			 evaluation of—</text><paragraph commented="no" id="H9A6378D9015F4AEE82BBC9F1873F92C2"><enum>(1)</enum><text>what administrative datasets that are relevant for program evaluation and Federal policy-making
			 should be included in a potential clearinghouse;</text></paragraph><paragraph commented="no" id="HA49F0D76074843A8BDACE72C1BBA140C"><enum>(2)</enum><text display-inline="yes-display-inline">which survey datasets the administrative datasets identified in paragraph (1) may be linked to, in
			 addition to linkages across administrative data series;</text></paragraph><paragraph id="H1BB45DD70DEE4349B13C653BD0A8212A"><enum>(3)</enum><text display-inline="yes-display-inline">what are the legal and administrative barriers to including or linking these data series;</text></paragraph><paragraph commented="no" id="HD1AC0901B78046B4952CB035162E2E1A"><enum>(4)</enum><text>what data-sharing infrastructure should be used to facilitate data merging and access for research
			 purposes;</text></paragraph><paragraph commented="no" id="H3109DD6E0E6C4250945596F64DBABCD1"><enum>(5)</enum><text>how a clearinghouse could be self-funded;</text></paragraph><paragraph commented="no" id="H320EFD2340BF44BAA951FE6EBB469606"><enum>(6)</enum><text>which types of qualified researchers, officials, and institutions should have access to data;</text></paragraph><paragraph commented="no" id="H77849BAFD0A447089330DAC8F5A6AC61"><enum>(7)</enum><text>what limitations should be placed on the use of data provided;</text></paragraph><paragraph commented="no" id="H1C865028DEC14278B6D4F13DAA959672"><enum>(8)</enum><text>how to protect information and ensure individual privacy and confidentiality;</text></paragraph><paragraph commented="no" id="HC0F2ADFB37E3417D9414D7B385A9BDCF"><enum>(9)</enum><text display-inline="yes-display-inline">how the data and results of research can be used to inform program administrators and policymakers
			 to improve program design; and</text></paragraph><paragraph id="HE3311A2138B74DDA8BE15753984CF146"><enum>(10)</enum><text display-inline="yes-display-inline">what incentives may facilitate interagency sharing of information to improve programmatic
			 effectiveness and enhance data accuracy and comprehensiveness.</text></paragraph></subsection><subsection id="HD7F7ADB8215446FFA14D2FDAE0D76ADA"><enum>(c)</enum><header>Report</header><text>Upon the affirmative vote of at least three-quarters of the members of the Commission, the
			 Commission shall submit to the President and Congress a detailed statement
			 of its findings and conclusions as a result of the study required by
			 subsection (a), together with its recommendations for such legislation or
			 administrative actions as the Commission considers appropriate in light of
			 the results of the study.</text></subsection><subsection id="HDD045350DEEB4843B93E393B58C8492B"><enum>(d)</enum><header>Deadline</header><text>The report under subsection (c) shall be submitted not later than the date that is 15 months after
			 the date a majority of the members of the Commission are appointed
			 pursuant to section 3.</text></subsection><subsection id="HCB9CA22B79BC4D3E8E3E024AF335A15F"><enum>(e)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>administrative data</quote> means information, in whatever form, generated or collected by an agency in carrying out a Federal
			 program, including any customer service measure, efficiency measure,
			 milestone, outcome measure, or performance indicator, as those terms are
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/31/1115">section 1115(h)</external-xref> of title 31, United States Code.</text></subsection></section><section id="H30E9DEF5FBB64FF7B79EF083B95BF378"><enum>5.</enum><header>Operation and powers of the Commission</header><subsection id="H858B588B2A884EDA93E5526A182AD250"><enum>(a)</enum><header>Administrative assistance</header><text>The heads of the following agencies shall advise and consult with the Commission on matters within
			 their respective areas of responsibility:</text><paragraph id="H64CDD424EA034566A2B2428352C0D0DE"><enum>(1)</enum><text>The Office of Management and Budget.</text></paragraph><paragraph id="H709817B2BAED45B4BC6D811A3A2A35F4"><enum>(2)</enum><text>The Bureau of the Census.</text></paragraph><paragraph id="HDA90D7B5CF63400388D6D0C85E3F57E4"><enum>(3)</enum><text>The Internal Revenue Service.</text></paragraph><paragraph id="HE6093E0B635641D3AEB8223440674BD9"><enum>(4)</enum><text>The Bureau of Economic Analysis.</text></paragraph><paragraph id="H64843DEC4B834AB09D297733D8B069C5"><enum>(5)</enum><text>The Bureau of Labor Statistics.</text></paragraph><paragraph id="H2C59EC3242934AE5A1F434FC85CE992F"><enum>(6)</enum><text>The Department of Health and Human Services.</text></paragraph><paragraph id="H9F1CC982A3E74FC59FF703437B4A644D"><enum>(7)</enum><text>The Department of Agriculture.</text></paragraph><paragraph id="HAB569023C3B14CAD9C26FBD3C43578BC"><enum>(8)</enum><text>The Department of Housing and Urban Development.</text></paragraph><paragraph id="H2069B34E6B88424BB42ABEBEFE031ACB"><enum>(9)</enum><text>The Social Security Administration.</text></paragraph><paragraph id="H4F02A52E66D04CA1AA375CF6B2E137F4"><enum>(10)</enum><text>The Department of Education.</text></paragraph><paragraph id="HCFC5F556C6C7462FB81ADB965B08F25E"><enum>(11)</enum><text>The Department of Justice.</text></paragraph><paragraph id="HCF73CE66FBBE4D2780A31FD75579AC3A"><enum>(12)</enum><text>Any other agency, as determined by the Commission.</text></paragraph></subsection><subsection id="HE1BA827C402E44FA8A9A788E78398EEC"><enum>(b)</enum><header>Meetings</header><text>The Commission shall meet not later than 30 days after the date upon which a majority of its
			 members have been appointed and at such times thereafter as the
			 chairperson or
			 co-chairperson shall determine.</text></subsection><subsection id="HC4C75D368C9241B1A4AC12B482A05AE4"><enum>(c)</enum><header>Rules of procedure</header><text>The chairperson and co-chairperson shall, with the approval of a majority of the members of the
			 Commission, establish written rules of procedure for the Commission, which
			 shall include a quorum requirement to conduct the business of the
			 Commission.</text></subsection><subsection id="H220FD77ECC1D44899A5CECC496363823"><enum>(d)</enum><header>Hearings</header><text>The Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times
			 and places, take testimony, and receive evidence as the Commission
			 considers appropriate.</text></subsection><subsection id="H86400681CC734A438A9912C4E9854C7E"><enum>(e)</enum><header>Contracts</header><text>Subject to the availability of appropriations, the Commission may contract with and compensate
			 government and private agencies or persons for any purpose necessary to
			 enable it to carry out this Act.</text></subsection><subsection id="HDDEF2A8E88824EAFB74293DD10FD324C"><enum>(f)</enum><header>Mails</header><text>The Commission may use the United States mails in the same manner and under the same conditions as
			 other agencies of the Federal Government.</text></subsection><subsection id="HE34062B283414B82BF96EEC63EF9E70D"><enum>(g)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></subsection><subsection id="H868039C09F9A4ECEA47E6EF2AE0E870B"><enum>(h)</enum><header>Census Bureau and NAPA</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Director of the Census shall contract with the
			 National
			 Academy of Public Administration to administer the Commission.</text></subsection><subsection commented="no" id="H2C7BA7D67F3C43A6BF2A80CB65A6664F"><enum>(i)</enum><header>Funding</header><paragraph commented="no" id="H60BB68A8FA26488487B71BA24D5B165B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, at the request of the Director of the Census, the
			 principal statistical agencies shall provide funds, in a total amount not
			 to exceed $2,000,000, to the Director for purposes of funding the
			 operations of the Commission.</text></paragraph><paragraph commented="no" id="H20E2406504B04ABE89D3C8AF3E0CAB68"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>principal statistical agency</quote> has the meaning given that term in the report, published by the Office of Management and Budget,
			 entitled <quote>Statistical Programs of the United States Government, Fiscal Year 2014</quote>.</text></paragraph></subsection></section><section id="H794216F4A7EE46A49291F9B6E03F8DEE"><enum>6.</enum><header>Personnel</header><subsection id="H8438BB1CE3EF43B0A7E7FC7B786832A6"><enum>(a)</enum><header>Director</header><text>The Commission shall have a Director who shall be appointed by the chairperson with the
			 concurrence of the co-chairperson. The Director shall be paid at a rate of
			 pay
			 established by the chairperson and co-chairperson, not to exceed the
			 annual rate of basic pay payable for level V of the
			 Executive Schedule (<external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code).</text></subsection><subsection id="H001219EF232B4A8998DE0A2BA9E110E7"><enum>(b)</enum><header>Staff</header><text>The Director may appoint and fix the pay of additional staff as the Director considers appropriate.</text></subsection><subsection id="HC2B190621987484EA506AFB10F68508C"><enum>(c)</enum><header>Experts and Consultants</header><text>The Commission may procure temporary and intermittent services under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5,
			 United States Code, at rates for individuals which do not to exceed the
			 daily
			 equivalent of the annual rate of basic pay for a comparable position paid
			 under the General Schedule.</text></subsection></section><section id="H6652989975974767B21092D747DDF93D"><enum>7.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate not later than 18 months after the date of enactment of this Act.</text></section></legis-body></bill>
